Abstract

Ce que Platon considérait comme l'innovation la plus importante en matière de législation était l'adjonction d'un préambule à l'ordonnance nue de la loi. Il y a, dans la pensée platonicienne, une continuité quant au rôle de la persuasion en politique et notamment dans la loi. L'argumentation des préambules convient au but spécifique de la loi, puisqu'elle concerne la partie de l'âme affectée par la norme. Le préambule vise à favoriser l'acceptation de la limite par les parties inférieures de l'âme. La structure même de la loi, divisée en partie persuasive (préambule) et partie coercitive (commandement légal au sens strict), est déterminée par la tension qui existe dans la nature de l'âme comme dans l'ordre naturel et ontologique. The philosophical foundations of nomos in the Laws What Plato held as being the most important innovation in legislation was the adjunction of the preamble to the bare edict of law. There is a continuity in Plato's thought as regards the idea of the part played by persuasion in politics and more specifically, in law. The argumentation of preambles is fit to the specific aim of law, since it deals with that very part of the soul which is affected by the norm. The preamble aims at facilitating the acceptance of the limit by the lower parts of the soul. The very structure of law, divided into a persuasive part (the preamble) and a coercive part (the legal command in its strictest meaning) is determined by the tension existing in the nature of the soul as in the natural and ontological order
