According to the general rule explaining apparent authority, if the behaviour of a principal gives reasonable grounds for the third party to think that the principal has appointed the other person to be his agent, contracts concluded by the third party in the principal’s name shall be binding on the principal, notwithstanding the fact that the agent was not authorised by the principal to conclude particular contracts. In the absence of evidence of apparent authority the agent shall have to redress (...) the damage incurred on a third party in cases where the third party was not aware, and was under no obligation to be aware, of circumstances that the person acted in other person’s name without their express authorisation or in excess of their authority. The principal shall be liable for actions of the apparent agent if the following three requirements are proven: words or conduct of the principal caused the impression of authority; third party could reasonably presume the existence of sufficient authority; third party acted in good faith. The third party’s legitimate expectations must be aligned with the principal’s will in order to apply the doctrine of apparent authority efficiently. (shrink)

Many meta-ethicists have thought that rationality requires us to heed apparent normative reasons, not objective normative reasons. But what are apparent reasons? There are two kinds of standard answers. On de dicto views, R is an apparent reason for S to \ when it appears to S that R is an objective reason to \ . On de re views, R is an apparent reason for S to \ when R’s truth would constitute an objective reason for S to \ (...) , and it appears to S that R. De re views are currently more popular because they avoid overintellectualizing rationality. But they face problems owing to the way in which they do so. Some assume that we can escape these problems by requiring more information to be apparent or by appealing to defeat. But these strategies fail. So, I defend a new view: apparent reasons are apparent facts that agents are competently attracted to treat like objective reasons, where competence is indirectly defined in terms of objective reasons and a competence/performance distinction is honored. Since one can treat X like an F without having the concept of an F, the view does not overintellectualize rationality. But it is also strong enough to dodge the pitfalls of de re views. (shrink)

This paper explores the scholastic debate about antiperistasis, a mechanism in Aristotle’s dynamics described in the first book of Meteorology as an intensification of a quality caused by the action of the contrary one. After having distinguished this process from a homonymous, but totally different, principle concerning the dynamics of fluids that Aristotle describes in his Physics, I focus on the medieval reception of the former. Scholastic commentators oriented their exegetical effort in elaborating a consistent explanation of an apparently paradoxical (...) process like the intensification of a quality by the opposite one. From the fourteenth century onwards, most of the commentators resorted to the theory of the multiplication of species, according to which each entity acts through the emission of simulacra of the objects (species) that spread spherically in the medium. When these rays encounter an obstacle, such as a contrary quality, they are pushed back towards their source. The reflection of the species determined by the surrounding and opposite quality produces a concentration of the first one, which is therefore intensified. Another distinctive feature of the scholastic interpretation of Aristotle’s antiperistasis is the convergence between the discussions on inorganic and organic matter, physical and medical discourse. This convergence found its most significant expression in the adoption of the model described in the first book of Aristotle’s Meteorology to the biological context of Hippocrates’s Aphorisms I, 15. Following Galen’s exegesis of this passage, medieval commentators established a link between physics and medicine substantially extraneous to Aristotle’s theory. (shrink)

has offered a lovely example to motivate the intuition that a successful prediction has a kind of confirmatory significance that an accommodation lacks. This paper scrutinizes Maher's example. It argues that once the example is tweaked, the intuitive difference there between prediction and accommodation disappears. This suggests that the apparent superiority of prediction to accommodation is actually a side effect of an important difference between the hypotheses that tend to arise in each case.

Moulines in his "A Logical Reconstruction of Simple Equilibrium Thermodynamics" shows that Sneedian constraints play an essential role even in the purely theoretical development of the mathematical formalism of at least one actual scientific theory. However, Moulines' treatment is apparently inconsistent because of the way he represents constraints. A very simple non-Sneedian way of representing constraints is given which removes the difficulty.

Apparent motion is an illusion in which two sequentially presented and spatially separated stimuli give rise to the experience of one moving stimulus. This phenomenon has been deployed in various philosophical arguments for and against various theories of consciousness, time consciousness and the ontology of time. Nevertheless, philosophers have continued working within a framework that does not reflect the current understanding of apparent motion. I develop Special Relativity with backward-light-cone simultaneity, which I call, for reasons made clear in the paper, ‘Apparent Simultaneity’. In the first section I show some advantages of this approach. I then develop the kinematics in the second section. In the third section I apply the approach to the Twins Paradox: I show how it removes the paradox, and I explain why the paradox was a result of an artificial symmetry introduced to the description of the process by Einstein’s simultaneity (...) definition. In the fourth section I discuss some aspects of dynamics. It has been suggested that our experiences of embodiment in general appear to constitute an experiential ground for dualist philosophy and that this is particularly so with experiences of dissociation, in which one feels estranged from one’s body. Thus, Drew Leder argues that these play “a crucial role in encouraging and supporting Cartesian dualism” as they “seem to support the doctrine of an immaterial mind trapped inside an alien body”. In this paper I argue that as dualism does not capture (...) the character of such experiences there is not even an apparent separation of self and body revealed here and that one’s body is experienced as uncanny rather than alien. The general relationship between our philosophical theorizing and the phenomenology of lived experience is also considered. (shrink)

Ascriptions of rationality are related to our practices of praising and criticizing. This seems to provide motivation for normative accounts of rationality, more specifically for the view that rationality is a matter of responding to normative reasons. However, rational agents are sometimes guided by false beliefs. This is problematic for those reasons-based accounts of rationality that are also committed to the widespread thesis that normative reasons are facts. The critical aim of the paper is to present objections to recent proposed (...) solutions to this problem, according to which the responses of deceived agents would be rationalized by facts about how things appear to them. My positive aim is to argue that accounts of reasons in terms of apparent reasons manage to capture the intuitions that seem to favor a normative account of rationality. (shrink)

Hutto and Satne, Philosophia propose to redefine the problem of naturalizing semantic content as searching for the origin of content instead of attempting to reduce it to some natural phenomenon. The search is to proceed within the framework of Relaxed Naturalism and under the banner of teleosemiotics which places Ur-intentionality at the source of content. We support the proposed redefinition of the problem but object to the proposed solution. In particular, we call for adherence to Strict Naturalism and replace teleosemiotics (...) with autopoietic theory of living beings. Our argument for these adjustments stems from our analysis of the flagship properties of Ur-intentionality: specificity and directedness. We attempt to show that the first property is not unique to living systems and therefore poses a problem of where to place a demarcation line for the origin of content. We then argue that the second property is a feature ascribed to living systems, not their intrinsic part and therefore does not form a good foundation for the game of naturalizing content. In conclusion we suggest that autopoietic theory can not only provide a competitive explanation of the basic responding of pre-contentful organisms but also clarify why Ur-intentionality is attributed to them in such an intuitive manner. In apparent motion experiments, participants are presented with what is in fact a succession of two brief stationary stimuli at two different locations, but they report an impression of movement. Philosophers have recently debated whether apparent motion provides evidence in favour of a particular account of the nature of temporal experience. I argue that the existing discussion in this area is premised on a mistaken view of the phenomenology of apparent motion and, as a result, the space of possible philosophical (...) positions has not yet been fully explored. In particular, I argue that the existence of apparent motion is compatible with an account of the nature of temporal experience that involves a version of direct realism. In doing so, I also argue against two other claims often made about apparent motion, viz. that apparent motion is the psychological phenomenon that underlies motion experience in the cinema, and that apparent motion is subjectively indistinguishable from real motion. A process model of concept development is proposed as a means of understanding the mind body problem. This paper reviews some definitions and views of mind, reiterates Karl Popper's description of the development of scientific as compared to essentialist methods of concept definition, compares the development of physical and psychological concepts, notes an apparent illogic of the mind and body issue, and discusses a range of psychological theories in relation to this process model, that is, Skinner's behavior view, to Pribram's (...) presentation of cognitive theory, to Epstein's theory of the self concept, and to existentialistic views. In terms of meaning and usefulness, mind and behavioral concepts appear to evolve in the same manner. (shrink)

In this paper I compare Kwame Gyekye’s transcendentalist interpretation of the Akan conception of God with Kwasi Wiredu’s immanentist interpretation. I highlight the tension between the two thinkers’ interpretations of Akan religious thought within the broader conflict between transcendence and immanence. Using the analytic, critical, and interpretative method, I show how the reconciliation of Gyekye and Wiredu’s divergent, yet paradoxically overlapping visions can be effected in the idea of panpsychism. In the process of effecting this reconciliation, I open up a (...) new area of research in African philosophy of religion that African philosophers will find rewarding to engage. (shrink)

In Plato's Sophist, a mysterious Eleatic Stranger, the main character of the dialogue, undertakes a systematic definition of the philosopher's fiercest rival, the sophist. His hunt for a definition of the sophist, however, is interrupted by an attempt to refute the ontology of Parmenides. The philosophical significance of this refutation and its exact relationship to the sought-after definition remains a matter of great scholarly dispute. This book, by means of a running commentary on the dialogue, argues that the oft-neglected distinction (...) between dialectic and appearances is not only the key to solving this and other exegetical conundrums, but also reveals the unity and originality of Plato's argument in the Sophist. It has often been claimed that adequate aesthetic judgements must be grounded in the appreciator's first-hand experience of the item judged. Yet this apparent truism is misleading if adequate aesthetic judgements can instead be based on descriptions of the item or on acquaintance with some surrogate for it. In a survey of responses to such challenges to the apparent truism, I identify several contentions presented in its favour, including stipulative definitions of ‘aesthetic judgement’, assertions about conceptual gaps between determinate aesthetic (...) properties and even the most perfect descriptions, and claims about the holistic and sensibility-relative character of aesthetic qualities and values. With reference to considerations advanced by Frank Sibley, Alan H. Goldman, and particularists and anti-particularists in meta-ethics, I contend that strong versions of the apparent truism lack sufficient warrant. Two successors are proposed, however. One reframes the thesis in terms of our contingently limited descriptive and theoretical capacities with regard to a subset of the aesthetic qualities of extraordinary works; the second involves a shift from epistemic to axiological matters: what even the most perfect descriptions cannot provide, and in some cases spoil, is our gauging of an item's inherent, experiential value.
