This paper uses a study of the life story narratives of former classmates of Dutch and Moluccan descent to argue that the constructionist approach to intersectionality, with its account of identity as a narrative construction rather than a practice of naming, offers better tools for answering questions concerning intersectional identity formation than a more systemic intersectional approach. The case study also highlights the importance of the quest for origins in narratives. It demonstrates that theories of intersectionality are unjustified in subsuming (...) the issue of belonging under the identity marker of ethnicity, when all identities are performatively produced in and through narrative enactments that include belonging. Belongingness is a precarious achievement. The case study illustrates that if narrative accounts of a life fail to achieve narrative closure regarding roots, attempts to trace routes are seriously hampered. (shrink)

This article discusses the viability of a feminist constructivist approach of knowledge through the careful reading of the work of the feminist scholar and historian of science and technology, Donna Haraway. Haraway proposes an interpretation of objectivity in terms of "situated knowledges. " Both the subject and the object of knowledge are endowed with the status of material-semiotic actors. By blurring the epistemological boundary between subject and object, Haraway's narratives about scientific discourse become populated with hybrid subjects/objects. The author argues (...) that the ethics of these hybrid subjects consists of an uneasy mixture of a Nietzschean and a socialist-Christian ethic. The article concludes by setting out why Haraway's project constitutes an inter esting effort tofuse postmodern insights and feminist commitments. (shrink)

La méthodologie de Hobbes est interprétée par la plupart des commentateurs en termes de l'idéal scientifique moderne comme celui-ci fut exprimé par exemple par Galilée. Cependant, en ce qui concerne son approche purement méthodologique, tant du problème de la vérité que de celui de la certitude, et son ambiguïté vis-à-vis du rôle épistémologique de l'expérience, sa méthodologie paraît beaucoup plus apparentée aux conceptions méthodologiques, inspirées par les mathématiques grecques, de certains aristotéliciens éclectiques du seizième et de la première moitié du (...) dix-septième siècle. Cette affinité se manifeste notamment dans les conceptions de Hobbes concernant le rapport entre les sciences théoriques et appliquées, dans sa plaidoirie pour la méthode axiomatiquedeductive des géomètres comme le procédé logique par excellence, et dans son idéal d'un système cohérent des sciences qui, se basant sur la philosophie première au sens d'une nomenclature adéquate des choses, obtient principalement son unité de la méthode. This paper explores the interrelations between temporality and emotion in rhetorical argumentation. It argues that in situations of uncertainty argumentation affects action via appeals that invoke emotion and thereby translate the distant past and future into the situated present. Using practical inferences, a threefold model for the interrelation of emotion and time in argumentation outlines how argumentative action depends on whether speakers provide reasons for the exigence that makes a decision necessary, the contingency of the decision, and the confidence required (...) to act. Experiences and choices from the past influence the emotions experienced in the present and inform two intertemporal mechanisms that allow speakers and audiences to take the leap of faith that defines decision-making under uncertainty: retrospective forecasting and prospective remembering. Retrospective forecasting establishes a past–future–present link, whereas prospective remembering establishes a future-past-present link, and, together, the two mechanisms provide a situated presence that transcends the temporal constraints of uncertainty. Finally, the applicability of the model is illustrated through an analysis of a speech delivered by Danish Prime Minister Mette Frederiksen at the outset of the COVID-19 pandemic, a time where the need for decisive, yet argumentative action was crucial. In the early 1990’s, many feminist philosophers found that the practice of the women´s movement as well as those of other new social movements, could be articulated most adequately in terms of citizenship. The classical political vocabulary of citizenship seemed to offer a viable alternative to the vocabularies that until then had been dominant in feminist political theory: the individualistic, rights-oriented discourse of liberalism, and the structuralist, interest-oriented perspectives of socialism and marxism.

This paper examines what role the law can and should play with regard to unreliable information available on fast communication networks, such as the Internet. Users of electronic information find it increasingly difficult to assess its reliability. The traditional structures for assessing reliability are lacking or function inadequately. Clear social norms have not yet been developed. As regards the law, traditionally liability law is the first legal guard against undesirable societal developments. We conclude however, that liability law is an inadequate (...) remedy for unreliable information. Self‐regulatory initiatives such as trust mark seals for websites providing reliable information offer a more promising perspective, although these also have their limitations, especially in the sphere of enforcement and legitimacy. In this paper, self‐regulation is nonetheless hailed as an important instrument because it provides an indispensable test‐bed for more concrete legal norms derived from reliability criteria for information. Even if self‐regulation may not completely materialise, discussion about self‐regulation could be a stepping stone to the development of pertinent social norms. (shrink)

IntroductionResearch on the impact of cancer on close relationships brings up conflicting results. This systematic review collects empirical evidence on the research questions whether a cancer diagnosis in general or the type of cancer affects the divorce rate.Materials and MethodsThis systematic review was conducted according to the guidelines of the Cochrane Collaboration and the PRISMA statement. The following electronic databases were searched: Web of Science, Ovid SP MEDLINE, PsycINFO, PsyINDEX, CINAHL, ERIC. Risk of bias assessment was performed with the preliminary (...) risk of bias for exposures tool template. The grading of methodological quality was assessed with the Newcastle-Ottawa Scale.ResultsOf 13,929 identified records, 15 were included in the qualitative synthesis. In 263,616 cancer patients and 3.4 million healthy individuals, we found that cancer is associated with a slightly decreased divorce rate, except for cervical cancer, which seems to be associated with an increased divorce rate.DiscussionAccording to this systematic review, cancer is associated with a tendency to a slightly decreased divorce rate. However, most of the included studies have methodologic weaknesses and an increased risk of bias. Further studies are needed. (shrink)

Software agents extend the current, information-based Internet to include autonomous mobile processing. In most countries such processes, i.e., software agents are, however, without an explicit legal status. Many of the legal implications of their actions (e.g., gathering information, negotiating terms, performing transactions) are not well understood. One important characteristic of mobile software agents is that they roam the Internet: they often run on agent platforms of others. There often is no pre-existing relation between the owner of a running agents process (...) and the owner of the agent platform on which an agent process runs. When conflicts arise, the position of the agent platform administrator is not clear: is he or she allowed to slow down the process or possibly remove it from the system? Can the interests of the user of the agent be protected? This article explores legal and technical perspectives in protecting the integrity and availability of software agents and agent platforms. Software agents that play a role in E-commerce and E-government applications involving the Internet often contain information about the identity of their human user such as credit cards and bank accounts. This paper discusses whether this is necessary: whether human users and software agents are allowed to be anonymous under the relevant legal regimes and whether an adequate interaction and balance between law and anonymity can be realised from both the perspective of Computer Systems and the perspective of Law.

The field of Neuro-Engineering seems to be on the fast track towards accomplishing its ultimate goal of potentially replacing the nervous system in the face of disease. Meanwhile, the patients and professionals involved are continuously dealing with human bodily experience and especially how neuro-engineering devices could become part of a user’s body schema: the domain of ‘embodied phenomenology’. This focus on embodiment, however, is not sufficiently reflected in the current literature on ethical and philosophical issues in neuro-engineering. In this article (...) we will focus on this lacuna by explaining existing data on neuro-engineering user’s experiences by using phenomenological concepts such as transparency and the concepts that may facilitate this: functionality, sensorimotor feedback and affective tolerance. By introducing and applying these concepts to four real life case examples, we will discuss practical implications and guidelines which can contribute to the actual success of incorporation of the device by the patient. First, we will discuss the importance of a ‘Patient Preference Diagnosis’, which can serve as a way to prepare the patient for the existential reorientation involved in the process. In addition, a Patient Transparency Diagnosis during and after such a process is also relevant when wanting to provide the medical field in general with feedback, and the patient in particular with possibilities to fine-tune the device. From these practical guidelines we will conclude that the phenomenological approach can be very valuable when applied to the field of neuro-engineering. (shrink)

In this paper, the authors describe an aspect of a program of research around grief and clinical practice. The first phase of the study involves examination of experiences of grief with attention to troublesome or problematic beliefs that fuel the extent of suffering in the bereaved. The data, obtained from a review of videotaped clinical interviews with families seen in the Family Nursing Unit at the University of Calgary, were analyzed according to philosophical hermeneutic tradition. Findings suggest that grief is (...) an experience that is ongoing, that changes in nature over time, but that involves a continuing relationship with the deceased; it is a graceful, periodic, deliberate walk backwards while keeping a sure foot in living forward. In his historical novel from 1835, Prince Otto of Denmark and his Time, the poet Bernhard Severin Ingemann (1789-1862) established the unknown, yet historical character, Prince Otto of Denmark (1310-1346) as the hero of the novel. This choice has puzzled critics ever since, due to the fact that Prince Otto seems less a potential king than his brother Valdemar IV (1320-1372) who actually became a king of Denmark. Georg Brandes (1842-1927) claimed that Otto mirrored Ingemann’s persona as weak and feminine, (...) a “monk” not suited for kingship. In his ridicule of Prince Otto and Ingemann, Brandes reveals his ideas about gender, masculinity and femininity, but as this article seeks to show, such ideas are tied to time and place. Read from the distance of 2019, Ingemann’s feminine medieval hero might seem more modern and progressive than Brandes would have him. In this sense, the article is a piece of “queer medievalism”. In the Netherlands, the poet Herman Gorter is mostly known as the author of the neo-romantic poem May and the “sensitivistic” Poems, but internationally he became famous as a propagandist of radical Marxism: the author of influential brochures and of an “open letter” to comrade W.I. Lenin in 1920. During the 1890s, Gorter became increasingly dissatisfied with his poetry, considering it as ego-centric, disinterested and “bourgeois”, unconnected with what was happening in the real world. He wanted to put his poetry (...) on a scientific footing, notably by endorsing a dialectical materialist worldview. In the communist society he envisioned, science would become poetry and poetry would become science. In his opus magnum Pan, two terms are rather prominent, namely heelal and kristal. These signifiers not only reflect important themes, but also two friendships which began around 1900, namely with prominent astronomer and marxist Anton Pannekoek and with Ada Prins, the first woman in the Netherlands who acquired a PhD in chemistry, specialised in liquid crystal research. Whereas Ada Prins is mostly remembered as one of Gorter’s secret lovers, she was first and foremost his educated guide into the complex and enigmatic world of twentieth-century chemistry research. Liquid crystal chemistry became an important source of inspiration for Gorter’s work and the main objective of this paper is to demonstrate her influence on Gorter’s Pan as a scientific poem After presenting the two heroes of this paper, and their work in poetry and chemistry respectively, I will analyse the role of liquid crystals in Herman Gorter’s Pan, highlighting important connections with Ada Prins’ research into liquid crystal chemistry. In the Romanian Orthodox theology, the words mission and pastoral care are used very often in a mixed way. Nevertheless, there are some differences between them and we explain why. In the main part of our article, we demonstrate that the biblical verse regarding the great commandment for mission was translated in a wrong way and it gave a different paradigm for mission. In the second part, we speak about catechesis and catechumenate at the beginning of the Church and about (...) the present situation regarding these activities. In the last part, we analyze what happens around the Holy Sacrament of Baptism when we speak about mission or pastoral care. In consequences, this article presents some conclusions which can be applied in the life and activity of the Romanian Orthodox Church. (shrink)

At the beginning of the Posterior Analytics, Aristotle says that “all learning and all rational teaching arises from previously existing knowledge”. How, then, can we have any knowledge? If all our knowledge is acquired by learning that depends on previously existing knowledge, then we would have an infinite regress of still prior knowledge, with the result that we cannot learn anything without having learned something else first. If we reject this possibility, then the only one that remains is that we (...) have some knowledge that we did not learn. This might happen in two ways: either we have some knowledge that we never acquired at all, or we have some knowledge that we acquired but without learning it. We would have knowledge that we never acquired if there was never a time at which we did not have it (which would entail, of course, that we were born with it). Plato held that we do have such knowledge, and indeed that all the genuine knowledge that we have is innate in this way. Aristotle, however, denies that we have innate knowledge (for instance at An. Post. II.19, 100a10). Since he nevertheless does think that we have knowledge, he must think that we have some knowledge which we did not acquire by learning. In fact, he does present such a view in Posterior Analytics II.19, where he claims that our knowledge of the principles ( ¢¡¤£¦¥¨§ ) of sciences comes to us through perception and induction and that the state of knowledge of them is “intelligence” or “thought” ( © ). Aristotle says explicitly that in this process the mind is passive; therefore, it is reasonable for us to regard it as not being a kind of learning (or at any rate as a kind of rational learning). Thus, Aristotle’s overall position is consistent. (shrink)

In the following paper, I suggest an interpretation of Petrovici’s and Merleau-Ponty’s philosophy, both of them structured in accordance with the concept of unity of existence (the world), itself given in a close relation with the idea about an existential subject. Each philosophy includes a representation of the unity of existence, founded, the first, in a spiritual conviction (noetic belief), and the second, in a perceptual faith. This representation is in the same time a privileged kind by which a subject (...) enters the world. Also, I will suggest arguments in order to legitimate the idea that each representation and its construction let themselves be led by the regulativity of a model of philosophizing: the philosophy of life (in the context of a metaphysics) – Petrovici; the existential philosophy (in a phenomenological context) – Merleau-Ponty. Dacă cercetarea fenomenologică are o anumită intuiţie mai mult sau mai puţin vagă a direcţiei în care se îndreaptă, ea nu ştie dintru început unde anume va ajunge, unde anume o vor ghida întrebările. Ca în Călăuza lui Tarkovski, cercetătorul aruncă înaintea sa întrebarea şi apoi o urmează, înaintând oarecum în necunoscut, în orizontul neştiut pe care întrebarea îl deschide. Tocmai de aceea cercetarea fenomenologică este o explorare, o înaintare în necunoscut, fără o hartă sigură, fără o busolă infailibilă, alta (...) decât cea a propriei pre-înţelegeri, care poate fi confirmată sau infirmată pe parcurs. Spre deosebire de alte tipuri de cercetare, care pornesc de la un dat pozitiv deja disponibil, deja asigurat, în fenomenologie cercetătorul trebuie să îşi obţină datul originar, să şi-l asigure constant, să-l extragă din contexte fenomenale în care el este de cele mai multe ori ocultat, mascat şi obturat. Tot aşa şi noi, întrebându-ne dacă şi cum ar putea fi conceput un sens originar şi integrator al trupului, unul care să premeargă şi totodată să cuprindă diversele forme de expresie corporală a existenţei umane, noi nu presupunem că îl avem deja, gata dat, disponibil, apt de a fi arătat cu degetul: iată-l! Dimpotrivă, este mult mai plauzibil ca acest sens originar să ne fie dat întâi de toate prin ocultările sale, prin formele sale derivate, privative sau sărăcite. Explorarea fenomenologică ia atunci chipul unei operaţii de desfoliere, de recuperare a unui strat de sens originar, ascuns în spatele unor aluviuni care îl acoperă şi, uneori, îl fac de nerecunoscut. Unul dintre cele mai importante subiecte de dezbatere în contextul deliberărilor publice privind revizuirea Constituției a fost lansat, fără îndoială, de solicitările de revizuire a ei in sens creștin. Solicitările în discuție au fost făcute, după cum este cunoscut, de Sinodul mitropolitan al Mitropoliei Moldovei și Bucovinei în 5 martie 2013. Potrivit acestor solicitări, ar fi dezirabil ca, printre altele, noua Constituție „să facă referire la numele lui Dumnezeu”, să „sublinieze ... importanța tradiției creștine a poporului român”, să evidențieze „rolul (...) pe care Biserica Ortodoxă Română l-a avut și îl are în istoria țării” și – nu în ultimul rând – să recunoască „necesitatea predării religiei în școală.” In acest articol, explorez, în limitele spațiului pe care îl am la dispoziție, fiecare dintre aceste solicitări. Obiectivul meu fundamental este acela de a arăta că – și de a explica de ce – niciuna dintre ele nu este o solicitare „rezonabilă”. Prin aceasta înțeleg că niciuna dintre solicitările Sinodului mitropolitan al Mitropoliei Moldovei și Bucovinei nu este suficient susținută argumentativ și – mai ales – că niciuna dintre ele nu este compatibilă cu idealul unei societăți organizate și guvernate în baza unor valori precum libertatea, egalitatea și echitatea în relațiile dintre cetățeni. Ceea ce sper să arăt este, cu alte cuvinte, că, dat fiind respectul pe care îl datorăm acestor valori, România trebuie să rămână și în viitor un stat laic sau, poate mai corect spus, unul neutru din punct de vedere religios, așa cum statuează în prezent articolul 9 al Legii nr. 489/2006 privind libertatea religioasă și regimul general al cultelor. Articolul precizează, reamintesc, că în România „nu există religie de stat” și că „statul este neutru față de orice credință religioasă sau ideologie atee”. (shrink)

Kant, Schelling, and Hegel research has frequently highlighted differences when considering their three respective concepts of philoso-phy. Especially with regard to natural philosophy, there seems to be little common ground between them. In my paper, however, I want to revise this perspective, picking up on what brings them together. Taking the concept of matter as my primary example, I will argue that neither Kant nor Schelling nor Hegel are interested in conceiving of nature from the viewpoint of empirical observation and (...) as independent of the subject. Rather, their respective philosophical inquiries into nature’s first prin-ciples hinge on critical examinations of reason, providing all three with the conceptual resources to address nature from a metaphysical point of view that is ultimately bound up with rational beings. Aceasta nu este o carte de matematică, ci una despre matematică, care se adresează elevului sau studentului, dar şi dascălului său, cu un scop cât se poate de practic, anume acela de a iniţia şi netezi calea către înţelegerea completă a matematicii predate în şcoală. Tradiţia predării matematicii într-o abordare preponderent procedural-formală a avut ca efect o viziune deformată a elevilor asupra matematicii, ca fiind ceva strict formal, instrumental şi calculatoriu. Pierzând contactul cu baza conceptuală a matematicii, elevii dezvoltă pe (...) parcurs o "anxietate matematică" şi renunţă la a mai căuta înţelegerea matematicii, care devine "duşmanul tradiţional" din şcoală. Această lucrare şi-a propus materializarea rezultatelor cercetărilor inter- şi trans-disciplinare având ca obiect înţelegerea matematicii, care au concluzionat că domeniile care au potenţialul de a contribui în acest fel la educaţia matematicii, unificând abordările procedurală şi conceptuală, sunt epistemologia şi filosofia matematicii şi ştiinţei, precum şi fundamentele şi istoria matematicii. Aceste rezultate susţin teza că teama de matematică poate fi înlăturată prin abordarea conceptuală, iar un elev cu o bună înţelegere conceptuală va fi un rezolvitor de probleme mai bun. Autorul a identificat acele zone şi concepte aparţinând acestor discipline, care pot fi adaptate şi prelucrate în vederea familiarizării elevului sau studentului cu acest tip de cunoştinţe, care să însoţească conţinutul tradiţional al matematicii şcolare. Lucrarea a fost astfel organizată încât să contureze cititorului o imagine unificatoare asupra complexităţii naturii matematicii, precum şi o perspectivă conceptuală necesară, în final, înţelegerii de tip holistic a matematicii şcolare. Autorul vorbeşte despre matematică, pentru a convinge că a înţelege matematica înseamnă mai întâi să o înţelegem ca întreg, dar şi ca parte a unui întreg. Natura matematicii, conceptele sale primare (cum ar fi numerele şi mulţimile), structurile, limbajul, metodele, rolurile şi aplicabilitatea matematicii, sunt prezentate în conţinutul lor esenţial, iar explicarea conceptelor non-matematice este făcută într-un limbaj accesibil, însoţită de multe exemple relevante. Cartea este o unitate didactică concepută să reprezinte punctul de plecare şi un ghid de orientare către dobândirea înţelegerii de tip holistic a matematicii (pentru elev sau student) şi (pentru dascăl) către o predare de tip epistemic-conceptual, în care înţelegerea conceptuală este la fel de importantă ca antrenarea abilităţilor procedural-aplicative. This paper comments on a recent article “Revolutionary poetry and liquid crystal chemistry: Herman Gorter, Ada Prins and the interface between literature and science” by Hub Zwart, in which the author explores the influence of the liquid crystal research of Ada Prins on the epic poem Pan written by her long-time lover Herman Gorter. The present paper reviews the basic science of liquid crystals and explains the connections between the work of Prins and its influence on the (...) poem. Other examples of the use of “liquid crystal” as a literary device are identified from renaissance poetry, and the uses of the metaphor in these poems are analysed from a scientific perspective. From these examples it is suggested that creative concepts from poetry may contain elements of substance that appear in hitherto unrecognised scientific realities. (shrink)

We present a new axiomatization of classical mereology in which the three components of the theory—ordering, composition, and decomposition prin-ciples—are neatly separated. The equivalence of our axiom system with other, more familiar systems is established by purely deductive methods, along with additional results on the relative strengths of the composition and decomposition axioms of each theory.

Depuis la parution de ses Logische Untersuchungen en 190~ 1901, le monde philosophique international avait suivi, avec UD interet toujours croissant, les exposes successifs et de plus en plus approfondis, que le maUre fribourgeois publiait sur les prin~ cipes de sa methode, dite pMnomenologique, sur les applications concretes de celle-ci aux problemes philosophiques (...) les plus divers, ainsi que sur la phenomenologie comme systeme philo­ sophique autonome et pour ainsi dire "autarchique". Ces publi­ cations, relativement peu nombreuses, mais fort remarquees des leur parution, furent etudiees avec le plus grand soin par les representants les plus autorises des differents courants de la pensee contemporaine. Les critiques, il va sans dire, ne manquerent point. On attira l'attention sur le caractere plutöt programmatique de ces etudes, sur la terminologie fort neuve, quelque peu arbitraire, parfois meme deroutante, dont se servait l'auteur, sur son pen­ chant prononce pour des distinctions subtiles et pour des defini­ tions minutieuses a l'exces, sur la difficulte de son style et les complications parfois inutiles de son expose, enfin et surtout -­ au moins depuis 1913 - sur le caractere audacieux de sa theorie de la reduction, presentee par lui avec une insistance toute par­ ticuliere comme le fondement dernier et indispensable de toute phenomenologie presente ou future. Newton certainly regarded his second law of motion in the Principia as a fundamental axiom of mechanics. Yet the works that came after the Principia, the major treatises on the foundations of mechanics in the eighteenth century—by Varignon, Hermann, Euler, Maclaurin, d’Alembert, Euler (again), Lagrange, and Laplace—do not record, cite, discuss, or even mention the Principia’s statement of the second law. Nevertheless, the present study shows that all of these scientists do in fact assume the principle that the Principia’s second (...) law asserts as a fundamental axiom in their mechanics. (For what that second law asserts, we rely on Newton’s own testimony.) Some, like Varignon and Hermann, assume the axiom implicitly, apparently unaware that any assumption is being made, while others, like Maclaurin and Euler, assume the axiom explicitly, apparently unaware that the assertion assumed is the second law as Newton himself understood it. De ce a fost fondată Uniunea Europeană? Un prim răspuns ar fi dorinţa de pace după un război devastator şi umilitor. Un al doilea răspuns ar fi realizarea importanţei unităţii. O unitate care se va caracteriza printr-o diversitate a culturilor şi a limbilor. Statele europene nu au dorit să renunţe la suveranitatea lor, au vrut să devină un corp comun pentru a nu a mai putea fi călcate în picioare de iureşul istoriei. Ca orice unitate, UE avea nevoie de un (...) cadru de reglementare oferit de instituţii şi politici europene. De asemenea, pentru a armoniza ceva trebuie să poţi pune împreună anumite elemente separate. Armonizarea Uniunii a fost realizată prin fondarea instituţiilor şi a reglementărilor acestora (structura instituţională a UE este prezentată în Anexa nr. 1). Instituţionalizarea Uniunii Europene este cheia de boltă a construcţiei istorice europene. Început în anul 1957, acest proces a lăsat urme adânci în conştiinţa politică europeană. Since the time of the Eastern Han (25–220), the composition of “Nines,” suites of nine poems written in the Chuci style, has been perceived as a practice to transmit the paradigmatic poet Qu Yuan’s texts and intention. The actual practice of composition, however, invites the negotiation, if not tension, between two voices: the actual author’s and that of Qu Yuan’s texts. This paper examines Lu Yun’s 陸雲 (262–303) “Jiumin” 九愍 (Nine sufferings), a rewriting of Qu Yuan’s “Jiuzhang” 九章 (Nine declarations), (...) in light of Lu Yun’s private letters clarifying his prin- ciples of rewriting. I argue that, despite Lu Yun’s claimed fidelity to Qu Yuan, the suite is largely a private projection of Lu’s own literary criticism and family experience, a projection giving rise to an anachronistic persona of Qu Yuan in the poems. Through a close reading of the “Jiumin” and Lu’s literary criticism, the paper sheds light on the authorial role in rewriting canonical texts and its cultural significance. (shrink)

Tiemersma untersucht, wie Merleau-Ponty durch eine Auseinandersetzung mit kulturanthropologischen Forschungen zu einer Erweiterung des Bewußtseinsbegriffs und der Rationalitätskonzeption gelangt. Die Ansprüche einer interkulturellen Philosophie werden von J. Hoogland von einer Habermas'schen Position aus kritisch überprüft. A.W. Prins interpretiert Heideggers 'Angang der interkulturellen Auseinandersetzung' trotz anders lautenden Äußerungen dieses Autors als einen wichtigen Beitrag zur interkulturellen Philosophie. Für einen Aufweis der inneren Affinität zwischen (...) japanischem Denken und einigen neonietzscheanischen Philosophen bezieht sich H. Oosterling auf Bataille, Barthes, Foucault, Lyotard und Derrida. Aus feministischer Perspektive wendet sich J. van den Oord der Frage der Universalität der Menschenrechte zu. In der Absicht, den Universalitätsanspruch der westlichen Demokratieform zu kritisieren, konfrontiert F. Uyanne afrikanische und westliche Demokratie-Konzeptionen. C. Jacobs beschreibt den interkulturellen Dialog, der in einigen wichtigen Kunstausstellungen in New York und Paris stattgefunden hat. Nachdem E. de Schipper tiefgehende Zweifel am hier beschrittenen Weg zur interkulturellen Philosophie ausgesprochen hat, werden zum Schluß in einer 'Replik' der Herausgebers noch einmal einige Ausgangspunkte des Projekts klargestellt. On his interpretation, the Truth Rule is intended to provide an epistemic principle that grounds specifically existential knowledge. Vinci builds his account around Descartes' doctrine that "if we perceive the presence of some attribute, we can infer that there must also be present an existing thing or substance to which it may be attributed" (Prin. 1:51, CSM 1:210, AT 8a:25). Is it possible to combine different logics into a coherent system with the goal of applying it to specific problems so that it sheds some light on foundational aspects of those logics? These are two of the most basic issues of combining logics. Paranormal modal logic is a combination of paraconsistent logic and modal logic. In this paper, I propose two further combinatory developments, focusing on each one of these two issues. On the foundational side, I combine paranormal modal logic (...) with normal modal logic, resulting into a paraconsistent and paracomplete multimodal logic dealing with the notions of plausibility and certainty. On the application side, I combine this logic with Reiter’s default logic, resulting into an inductive and consequently nonmonotonic paraconsistent and paracomplete logic able to represent some key inductive principles. Abū Ishāq al-Isfarāyīnī (d. 418/1027) was one of the prominent figures of Khorasan Shafiʻīsm and a jurist among the Aṣḥāb al-Wujūh. He received education in Irāq from important scholars in the fields of theology (kalām), jurisprudence (fiqh), principles of jurisprudence (usul al-fiqh), and hadīth. After returning to Nishabur, he taught at a madrasa built in his name. He trained students such as ʿAbd al-Qāhir al-Baghdādī (d. 429/1037-38), Abū al-Ṭayyib al-Ṭabarī (d. 450/1058), Abu al-Qāsim al-Isqāf al-Isfarāyīnī (d. 452/1060), Abu al-Rabīʿ Ilākī (...) (d. 465/1073), and Abu al-Qāsim al-Qushayrī (d. 465/1072), who later influenced the course of Shāfiʿīsm. He authored works as an important hadith scholar and Ashʿarī theologian. Although most of these works have not survived to the present day, we learn about his views through excerpts from them. He held views, reflected in the prin-ciples of jurisprudence, that led to criticism for being influenced by the Muʿtazila. Despite being a theologian, his adoption of the jurists' method in jurisprudence further emphasizes the importance of his views. The aim of this study is to reveal Abū Ishāq al-Isfarāyīnī's thoughts on the principles of jurisprudence, specifically in the areas of hadīth, consensus (ijmā), indepen-dent reasoning (ijtihād), and imitation (taqlīd), and to identify their reflecti-ons on the Shāfiʿī school of jurisprudence. Since there is no specific study on Abū Ishāq al-Isfarāyīnī’s thoughts on jurisprudence in our country, we beli-eve that this research will contribute to future studies on his legal scholarship. Sam Lebens’ The Principles of Judaism is an extraordinary book in its rigor and richness. It is a sophisticated examination of three central propositions, which Lebens maintains, are the fundamental doctrines that “can make sense of continued commitment to an Orthodox Jewish lifestyle.” (Lebens, 273). He presents and discusses the following three propositions: 1) The universe is the creation of one God; 2) The Torah is a divine system of laws and wisdom, revealed by the creator of the universe; and, (...) 3) The creator exercises provi-dential care over his creation, manifest in the creator’s continued sustenance of the world, reward and punishment for human action, and in the promise of ultimate salvation. (Lebens, 3).Lebens presents the principles as they were variously explicated and de-fended in key Jewish texts written by the most influential Jewish thinkers; he then turns to search for “the most plausible rendering of this set of prin-ciples...” (Lebens, 274). After so doing, he specifies those doctrinal compo-nents among them, which he deems necessary “for making sense of commit-ment to Judaism” (Lebens, 275), identifying a “commitment to Judaism” with being “faithful to the tenets of Judaism” in the sense of having faith in them:To the extent that these principles are necessary for making sense of commitment to Judaism, I argue that you cannot be considered faithful to the tenets of Judaism without holding an attitude of faith toward some element of each of the three principles... (Lebens 275).The distance between Lebens’ philosophical and religious outlook and pre-suppositions, as they show themselves in his Principles of Judaism, and my own is great. I shall start with a critique of Lebens’ reduction of Judaism to so-called Orthodox Judaism, and argue that Lebens has no justification for characterizing the principles that he identifies, as the “principles of Judaism” without qualification. I shall then turn to argue that there are grounds for questioning whether the principles that Lebens identifies can be understood as the principles that so-called “Orthodox Jews”, too, have faith in. It is, how-ever, clear that the utterances that Lebens discusses do play a central role within the life of committed Jews. I shall end by proposing that we adopt the later Wittgenstein’s philosophical method for making perspicuous their meaning and their different roles. (shrink)

The purpose of the present thesis is to apply philosophical methods to the ongoing debate of the precautionary principle, in order to illuminate this debate. The thesis consists of an Introduction and five papers. Paper I con-cerns an objection to the method of conceptual analysis, the Charge from Psychology. After a brief characterisation of conceptual analysis, I argue that the Charge from Psychology is misdirected. In Paper II, the method of conceptual analysis is applied to the concept of precaution which (...) is ana-lysed in terms of precautionary actions. The purpose is explicatory. A definition involving three necessary and jointly sufficient conditions is proposed, and the implications of this analysis for the debate on the pre-cautionary principle are discussed. Paper III attempts to provide an ana-lytical apparatus which may be used for finding improved formulations of the precautionary principle. The approach is lexicographical. Several exist-ing and possible formulations of the precautionary principle are examined, and four common elements and a common structure of the precautionary principle are identified. It is suggested that the analytical apparatus pre-sented can be used in negotiations of the precautionary principle. Paper IV questions the soundness of some arguments against the precautionary prin-ciple. Five common arguments are discussed and rejected. In Paper V, two of these arguments are further discussed. I argue that an attempt at rejec-tion of the precautionary principle delivered by John Harris and Søren Holm is unwarranted, because their arguments against it are based on in-terpretations of the precautionary principle that ignore context. Paper VI deals with the idea of de minimis risk. After a discussion of the distinction between disregarding a risk and accepting it, I examine one way of deter-mining how small a risk ought to be in order to be disregarded, namely the use of natural risk levels as benchmarks. I argue that this approach fails, even if the distinction between what is natural and what is not natural can be upheld. (shrink)

Williamson (2000a) has argued that posi- tive introspection is incompatible with in- exact knowledge. His argument relies on a margin-for-error requirement for inexact knowledge based on a intuitive safety prin- ciple for knowledge, but leads to the counter- intuitive conclusion that no possible creature could have both inexact knowledge and posi- tive introspection. Following Halpern (2004) I put forward an alternative margin-for-error requirement that preserves the safety require- ment while blocking Williamson’s argument. I argue that the infallibilist conception of knowledge (...) that underlies the new require- ment provides a better account of inexact knowledge and higher-order knowledge than both Williamson’s and Halpern’s. Atenţia principală este acordată modelelor structurale, deoarece noţiunea de structură matematică intervine esenţial atât în caracterizarea matematicii pure, cât şi aplicate, iar procesele mentale implică la rândul lor reprezentări de tip structural.
