In this article, I argue we have collective duties to people who suffer from kidney failure and these duties are best fulfilled through a government-monopsony market in kidneys. A government-monopsony market is a model where the government is the sole buyer, and kidneys are distributed according to need, not ability to pay. The framework of collective duties enables us to respond to several of the most pressing ethical and practical objections to kidney markets, including Cécile Fabre's objection that it is (...) unjust to be paid to do one's duty, Simon Rippon's objections that it is harmful to be pressured to sell a kidney and that a market is unfair, Richard Titmuss's crowding out objection, and Ronald Dworkin's objection that body parts should not be among the goods we owe each other. This paper criticises necessitarianism, the thesis that there is at least one necessary truth; and defends possibilism, the thesis that all propositions are contingent, or that anything is possible. The second section maintains that no good conventionalist account of necessity is available, while the third section criticises model theoretic necessitarianism. The fourth section sketches some recent technical work on nonclassical logic, with the aim of weakening necessitarian intuitions and strengthening possibilist intuitions. The fifth section considers several a prioristic attempts at (...) demonstrating that there is at least one necessary proposition and finds them inadequate. Worldwide 1.2 million people are dying from kidney failure each year, and in the USA alone, approximately 100 000 people are currently on the waiting list for a kidney transplant. One possible solution to the kidney shortage is for governments to pay donors for one of their healthy kidneys and distribute these kidneys according to need. There are, however, compelling objections to this government-monopsony model. To avoid these objections, I propose a small adjustment to the model. I suggest we reward (...) kidney sellers with both money and a ceremony that celebrates their noble act. They should, in other words, receive a prize rather than a price. (shrink)

Background Interest in strengthening residents’ autonomy in nursing homes is intensifying and professional caregivers’ experience ethical dilemmas when the principles of beneficence and autonomy conflict. This increased focus requires expanded knowledge of how residents experience decision-making in nursing homes and how being subject to paternalism affects residents’ dignity. Research question/aim This study explored how residents experience paternalism in nursing homes. Research design This study involved a qualitative interpretive design with participant observations and semi-structured interviews. The interpretations were informed by Gadamer’s (...) hermeneutics. Participants and research context Eleven residents were interviewed after a period of participant observation in two nursing homes. Ethical considerations The study was performed in accordance with the Helsinki declaration. The Regional Ethics Committee (REK) permitted the researcher to perform participant observation in the nursing homes. The use of audio recordings of interviews was registered and supervised by Sikt - Norwegian Agency for Shared Services in Education and Research. The resident’s consent was assessed continuously. Three interviews were terminated for ethical reasons. Findings The resident interviews revealed that residents found it obvious for caregivers to possess the decision-making authority in nursing homes. When residents explained their views, three main themes emerged: (1) To be included even though caregivers make the decisions, (2) Surrender to dependency, and (3) Adherence to nursing home norms. Conclusions Residents submit to their caregivers and give caregivers the responsibility and function as leaders. Paternalism was experienced as dignifying in situations where it contributed to residents being able to live according to second order desires and values, and when it implied respect and appraisal of residents’ capabilities. Paternalism was experienced as debasing when residents felt left out, and when residents felt that their capabilities were underestimated. Do we have stronger duties to assist in emergencies than in nonemergencies? According to Peter Singer and Peter Unger, we do not. Emergency situations, they suggest, merely serve to make more salient the very extensive duties to assist that we always have. This view, while theoretically simple, appears to imply that we must radically revise common-sense emergency norms. Resisting that implication, theorists like Frances Kamm, Jeremy Waldron, and Larry Temkin suggest that emergencies are indeed normatively exceptional. While their approach is (...) more in line with common-sense, however, it is theoretically less simple, and it is has proven difficult to justify the exception. In this paper we propose a model of emergencies that we call the Informal-Insurance Model, and explain how this can be used to combine theoretical simplicity with common-sense emergency norms. Nudging is a concept in behavioural science, political theory and economics that proposes indirect suggestions to try to achieve non-forced compliance and to influence the decision making and behaviour of groups and individuals. Researchers in medical ethics are currently discussing whether nudging is ethically permissible in healthcare. In this article, we examine current knowledge about how different decisions (rational and pre-rational decisions, major and minor decisions) are made and how this decision-making process pertains to patients. We view this knowledge in (...) light of the nursing project and the ongoing debate regarding the ethical legitimacy of nudging in healthcare. We argue that it is insufficient to discuss nudging in nursing and healthcare in light of free will and patient autonomy alone. Sometimes, nurses must take charge and exhibit leadership in the nurse–patient relationship. From the perspective of nursing as leadership, nudging becomes a useful tool for directing and guiding patients towards the shared goals of health, recovery and independence and away from suffering. The use of nudging in nursing to influence patients’ decisions and actions must be in alignment with the nursing project and in accordance with patients’ own values and goals. (shrink)

Organ shortage is a major survival issue for millions of people worldwide. Globally 1.2 million people die each year from kidney failure. In this paper, we critically examine and find lacking extant proposals for increasing organ supply, such as opting in and opt out for deceased donor organs, and parochial altruism and paired kidney exchange for live organs. We defend two ethical solutions to the problem of organ shortage. One is to make deceased donor organs automatically available for transplant without (...) requiring consent from the donor or their relatives. The other is for society to buy nonvital organs in a strictly regulated market and provide them to people in need for free. (shrink)

Australia has recently experienced what many regard as its greatest judicial crisis. The appointment of Timothy Carmody QC as Chief Justice of Queensland in 2014 emerged from a process that was tainted by the state government’s willingness to break confidences gained in the course of consultation for the appointment. Equally, a strongly negative and heterodox reaction to the appointment by the whole Queensland Supreme Court bench meant that, together, politicians and judges brought on a collapse of the traditional ethics surrounding (...) judicial appointments. Nevertheless, the extreme circumstances of the Carmody affair suggest that, where judges have a legitimate concern that a judicial appointment might put a fundamental constitutional value like judicial independence at risk, a court may be justified in publically expressing concern about the appointment. In his book on Plutarch'sMaxime cum principibus philosopho esse disserendumfrom 2009, Geert Roskam takes up the question of the genre of the work. Few scholars have approached this question and they have had little to say. Hence, Roskam's treatment of the question is much appreciated. Among the suggestions previously put forth is the suggestion by F.H. Sandbach, who argued that the work should be regarded as a treatise, while H.N. Fowler stated in the ‘Introduction’ to the Loeb Classical Library translation (...) that the work is an essay. Other suggestions regarding the genre ofMaxime cum principibusinclude the notion that it is a diatribe and aparva disputatio e magisterio orta. Of course, although all four suggestions have something to say for themselves, they are rather imprecise and not actual genres in a specific sense. The diatribe often surfaces as a convenient label for ancient philosophical discourses, but it is a misleading label, since what it picks out was not recognized as a distinctive form or stylistic level in antiquity. In addition, the technical and literary uses of the Greek word διατριβή were entirely different. (shrink)

This paper investigates the topological construction of Wedge Sum, with the aim of showing that it can be done mathematically, via a quotient construction, or logically, via Merge. Consistent and Inconsistent versions are given, while noting that the natural outcome of Merging is an inconsistent theory. Finally it is observed that algebraic constructions can also be treated via Merge, where the extra functionality makes for various triviality and non-triviality results.

A principle of continuity due to Leibniz has recently been revived by Graham Priest in arguing for an inconsistent account of motion. This paper argues that the Leibniz Continuity Condition has a reasonable interpretation in a different, though still inconsistent, class of dynamical systems. The account is then applied to the quantum mechanical description of the hydrogen atom.

The question of the interpretation of impossible pictures is taken up. Penrose's account is reviewed. It is argued that whereas this account makes substantial inroads into the problem, there needs to be a further ingredient. An inconsistent account using heap models is proposed.

When widespread use of sex‐selective abortion and sex selection through assisted reproduction lead to severe harms to third parties and perpetuate discrimination, should these practices be banned? In this paper I focus on India and show why a common argument for a ban on sex selection fails even in these circumstances. I set aside a common objection to the argument, namely that women have a right to procreative autonomy that trumps the state's interest in protecting other parties from harm, and (...) argue against the ban on consequentialist grounds. I perform a pairwise comparative analysis of sex selection and its plausible alternatives and argue that that the ban fails to improve the state of affairs relative to a scenario without a ban. The ban makes the situation worse, especially for mothers and their daughters. India should therefore repeal its ban on sex selection. (shrink)

The problem of why something exists rather than nothing is doubtless as old as human philosophising. Of comparable antiquity is the observation that one cannot hope to explain why something exists rather than nothing by appealing to the existence of something else, on pain of vicious circularity.In this paper, I distinguish between the question of why anything exists, and the question of why particulars exist. These two questions are equivalent only if the only things that exist are particulars. Certainly many (...) have held that universals as well as particulars exist. I take it here that there is a prima facie distinction between universals and particulars. It follows that the former question is prima facie more general than the latter. The question about the nature of art is at the centre of the philosophy of art. The thesis seeks to replace the two dominant approaches to this question in contemporary English-speaking philosophy--essentialism and descriptivism--with an historicist approach. The historicist approach I develop and defend holds that answers to the question "What is Art?" must take the form of localized cultural-historical narratives. ;This alternative approach is applied to write the history of the development of what I call "the modern conception of (...) art" in the early eighteenth century. A changing notion of art that emerges in Britain in this period is decisive for all later philosophy of art. Its genesis must be understood in a context of social, political and cultural changes. These changes deeply affected many people's conception of themselves and of their place in society. Social status becomes uncertain, and new criteria for the presentation of the self and evaluation of others emerge. Knowledge about art and the display of taste become indicators of social distinctions and thus criteria for social evaluation, replacing older notions of birth and rank. The modern conception of art emerges as part of new ideas of the presentation of the self, as part of a new ideal of edification. ;In contemporary philosophy of art, the evaluative contents of the conception of art--its historical and contemporary connection to notions of the moral and social order--are seldom discussed. Yet, as I show, these connections exist and have existed for a long time. At the centre of contemporary philosophy of art, therefore, there is a conception of art which is ideological in the sense that it treats the normative as factual and the historically contingent as the natural. Only a historical analysis of the kind I carry out is able to bring to light this aspect of the conception of art presupposed in contemporary philosophy of art. (shrink)

The Paradox of Transgression in Games looks at transgressive games as an aesthetic experience, tackling how players respond to game content that shocks, disturbs, and distresses, and how contemporary video games can evoke intense emotional reactions. The book delves into the commercial success of many controversial videogames: although such games may appear shocking for the observing bystander, playing them is experienced as deeply rewarding for the player. Drawing on qualitative player studies and approaches from media aesthetics theory, the book challenges (...) the perception of games as innocent entertainment, and examines the range of emotional, moral, and intellectual experiences of players. Which party characteristics contribute to the representation of young legislators? We examine this question quantitatively, focusing on the European Parliament, and gauge the influence of the age of the party leader, the age of the party, the size of its support, party ideology and party nomination procedures on the age of politicians, based on data of all members who have served in the EP. The global allocation of vaccines during the COVID-19 pandemic is widely perceived as unfair. Priority was given to countries that paid the most with little or no concern for who needed the vaccines the most. No satisfactory institutions have been established to allocate vaccines in a future pandemic. In this paper, we join reformers in proposing a new scheme for vaccine distribution: a global auction for vaccines where profits are distributed fairly to participating countries. Our proposal improves upon previous suggestions (...) morally by taking countries’ differing valuations of money and vaccines seriously. Since an auction is in the interest of both vaccine manufacturers and high-income countries, it is also politically feasible. A global redistributive auction for vaccines thus promises to be a robust and morally desirable way to allocate vaccines. -/- . (shrink)

In this article we address the question of how many impossible images Escher produced. To answer requires us first to clarify a range of concepts, including content, ambiguity, illusion, and impossibility. We then consider, and reject, several candidates for impossibility before settling on an answer.

The phenomenon of multi-used stock photography in the news contradicts the photojournalism professional values of truthful and emotional depictions. This reality echoes other false images increasingly appearing in the media, including deepfakes and artificial intelligence. In the present study, a two (stock and staff photo) by two (positive and negative valence) quasi-experiment is conducted. The dependent variables include: 1) credibility; 2) self-reported arousal level; 3) emotional valence perceptions; 4) fixation duration; and 5) fixation count. Participants viewed staff photos as more (...) credible in both positive and negative valences. Negative photos were perceived as slightly less credible. Stock and staff photos were similarly arousing, received similar valence perceptions, and had similar gaze fixations and durations. Overall, participants perceived the genuine emotion portrayed truthfully in photojournalism as opposed to the faux emotion acted out in stock photos. (shrink)

This paper offers an inconsistent model of motion perception. It was prompted by work on inconsistent motion due to Hegel and, following him, Priest. But the paper skirts Hegel's full scale idealism, by proposing that the inconsistency is with the cognitive contents of motion perception. The paper draws on work in the psychology of perception, and in the theory of inconsistency. I begin by noting the prima facie argument that temporal change threatens inconsistency, and canvassing ways in which this might (...) be avoided. The orthodox reply to the prima facie argument is that one and the same thing can have different incompatible properties at different times. This is plausible when applied to motion in the physical world. However, applied to cognition, it can be seen that the phenomenon of phi or beta, combined with the mechanism of a Reichardt detector, lends support to one key step in the prima facie argument, namely re-identification over time. The inconsistency of the model is then seen to follow from application of the Fade Principle. Advantages of the model are stressed: including a simple explanation of the debilitating condition of akinetopsia, that is, motion blindness; and a suggestion as to how to account for the “moving now.”.
