Majalla al-Aḥkam al-‘Adliyyah, which is the first example of codification based on Islamic law, has been the subject of criticism from different angles in terms of its preparation and content. The main reasons for criticism are following the casuistic method, being limited to the Hanafi sect, and therefore, the regulations on some issues not meeting the needs of the period, and the lack and excesses that do not comply with the content of the civil law. The commentator of the Majalla, (...) ‘Ali Ḥaydar Efendi, also criticized Majalla from different angles. In this study, it was aimed to identify, describe, and classify Ali Ḥaydar Efendi's critics of the Majalla, and -with some exceptions- no evaluation was made about the criticism of the commentator. Ali Ḥaydar Efendi, the author of the most comprehensive and famous commentary of the Majalla, Dureru'l-hukkâm, criticized the Majalla both in terms of law technique and content, justified his criticisms, and offered alternative suggestions regarding the issues he criticized. Although Ali Ḥaydar Efendi criticized an item for only one reason, he criticized some items from more than one point of view. In the article, each of the criticisms of Ali Ḥaydar Efendi on the Majalla’s items is discussed under a separate heading, and the items criticized from more than one point of view are discussed under a separate heading and exemplified as much as possible. His criticisms of the Majalla in terms of law technique are as follows: The statements of the items are prone to making wrong judgments, not of a general nature, the concepts are not used appropriately, both the concepts and the items are not compatible with each other and with the fiqh books, having some missing, unnecessary or incorrect statements in the items, and the lack of records in the statements. Among the criticisms made in terms of content, first of all, the fact that the provision contained in the article is contrary to the ruling in the fiqh books or the view of the sect should be mentioned. Some of the criticisms in terms of content are related to the preferences made while preparing the Majalla. In this context, it has been the subject of criticism that some of the preferred views are not suitable for the needs of the period or the preferred view in the madhhab, conflicting between preferences from time to time, and not making a choice in some controversial issues. The existence of provisions that do not comply with the requirements of the time, and the asl-far' incompatibility is another reason for criticism. In such criticisms, the suitability of the content of the law with the madhhab books in various aspects has been tried to be revealed, and inappropriate aspects have been criticized. However, ‘Ali Ḥaydar Efendi also pointed out that the text of the law should be prepared by making use of the provisions of different madhhabs, since it does not meet the needs of the time, although it is in accordance with the provisions of the madhhab. ‘Ali Ḥaydar Efendi also criticized the Majalla in terms of missing some issues or not being regulated sufficiently, and included provisions regarding the qarḍ contract and crimes against animals, which were not dealt with even though they should have been included in the Majalla. However, he never touched upon the subjects of consumption and ribā, which were not dealt with in the Majalla, although they should have been. ‘Ali Ḥaydar Efendi said that there is a deficiency in the items dealing with subjects such as luqata and hacr, since some conditions regarding these issues are not included. ‘Ali Ḥaydar Efendi also criticizes the Majalla in terms of the contradiction between the provisions contained in the items; the lack of unity in language, style and terminology among the items; and unnecessary repetitions both between the items and within the items. ‘Ali Ḥaydar Efendi, who did not make any criticism about the repetitions due to the fact that the Majalla was prepared with the casuistic method, justified or criticized the other repetitions and offered suggestions to avoid such repetitions. Also, according to him, there are deliberate repetitions in the Majalla. In addition, he also criticized the Majalla from a systematic point of view, such as the incompatibility of the title and content, the arrangement of similar subjects in different chapters/items/paragraphs, or the handling of different subjects in the same chapter/item/paragraph. Another criticism of ‘Ali Ḥaydar Efendi about the Majalla is about definitions. He criticizes the definitions made as not being collectively exhaustive, mutually exclusive and not being in the definition technique such as the tautology, but also on the grounds that it is not comprehensive, contrary to the method followed in other definitions made in the Majalla, and not being included in the fiqh books. In this paper I present Jan Nepomucen Miller’s universalism, i.e. his own conception of literature, which pursues the right to compete with its Romantic model. Universalism, whose elaboration of the philosophical premises took place in the years 1923-1925, never received a complete and finite form; it only indicated a certain option for which the whole, universality and universum was more important than a part. Although this conception proved to be a Utopian project, without its driving force, being too far from (...) the reality to support the spiritual values of the Polish culture, it constitutes (especially in our interwar thought) one of unique attempts to create a culture based on a non-Romantic canon of values. Bu bağlamda şer’î hüküm içeren haber ifadelerinin emir ve nehiy manasında oldukları için metninin daha sonra gelen şer’î bir delille nesh edilmesi caiz görülmüştür. Haberin ifade ettiği şeye gelince; Allah’ın sıfatları ve kıyametin kopuşu gibi değişmesi mümkün olmayan şeylerden ise, yalana yol açacağı için, bunun nesh edilmesi caiz görülmemiştir. Bu iki (...) konuda âlimler ittifak etmişlerdir. Geçmişte olanları ve gelecekte olacak hâdiseleri bildiren haberin ifade ettiği şeyin neshin konusu olup olmayacağı konusunda ise ihtilafa düşmüşlerdir. Keza vaad ve vaid bildiren haberler ile ebedîlikle kayıtlanan haber ifadelerini neshin caiz olup olmayacağı da tartışma konusu olmuştur. Burada Kur’an’da geçen haber ifadelerinin hangisinin nesh edilmesinin mümkün, hangisinin mümkün olmadığı meselesinin ana hatlarıyla ortaya konulması amaçlanmıştır. (shrink)

This research has been carried during the spring semester of 2021-2022 in Nevşehir Hacı Bektaş Veli University Theology Faculty, with five male and eight female senior class students that took the “teaching practice” course anda re determined by the method of simple random sampling. It has followed the phenomenological method of qualitative research. Among the purposes of phenomenological research, it is also possible to describe how one or more individuals describe the situations they have experienced and what they have in (...) common in these definitions. The focus problem of the research consists of the expectations of the students who took the teaching practice course through the research study group, and to what extent these expectations were met at the end of the process. The focus problem is subdivided in the following issues: “What are the expectations of the students from the partners of the process, such as the academician, the guiding teacher, the students, the administration of the school and the faculty management who accompany them throughout the practice?”. At the same time “what are the problems that they think are caused by these partners throughout the process?”. For this purpose, one-on-one interviews were conducted with the students in the research group, stating on 28 February 2022, the beginning of the “teaching practice course” in the spring term of 2022. In the next stage, another meeting was held in the last week of May, before the date of 23 June 2022, which is the date when the implementation ends. In these interviews, semi-structured questions were directed to the students in the research group at the beginning and end of the process in one-on-one interviews, and the interviews were audio-recorded. These audio recordings constitute the data source of the research. Among the findings obtained from the research, the main expectations of the theology faculty students in the study group from teaching practice are to be aware of their development in terms of teaching competencies. It is concluded that the low self-efficacy perception of the participants, who expressed their feelings with concepts such as fear, anxiety, and worry that are confused with each other in daily life before the application, lies in the anxiety of not being socially accepted by other partners in the school environment, experiencing communication problems and encountering undesirable student behaviors in the classroom. As a result of the implementation process, the majority of the participants got rid of these concerns and came to the fore with the result that their expectations from the process and the partners accompanying them in the process were met. It has been observed that the problems encountered by the study group in the process occur in the form of classroom management problems, communication problems and not being socially accepted in the school system. In the present research, analyzes are given regarding the solution of the problems encountered in the implementation process by the working group at the point of the responsibilities of the partners. One of the findings obtained from the research is that the teaching practice course should not be online, but should be face-to-face in terms of course learning outcomes and effectiveness. (shrink)

The Zaydī-Muʿtazilī interaction, which dates back to the early periods, increased when The Būyid vizier al-Ṣāḥib b. ʿAbbād invited Qāḍī ʿAbd al-Jabbār to Rayy and many Caspian Zaydī scholars studied with Qāḍī. Ibn Sharwīn, who is mentioned among the students of Qāḍī ʿAbd al-Jabbār and accepted as one of the Zaydī- Muʿtazilī scholars, is one of these names. The works of Ibn Sharwīn, who had writings in the field of kalām and fiqh, did not remain within the borders of the (...) Caspian and reached the Zaydīs of Yemen; one of these works is Ḥaqāʾiq al-ashyāʾ. Considering that, unlike other theological schools, there are not many works on the definitions of theological concepts in Muʿtazilī literature and -as far as is known- did not reach today, this treatise helps to understand better especially the terms in Zaydī- Muʿtazilī theology and the effects of Bahshamiyya on Zaydī thought. This work, edited and translated based on the only extant manuscript only manuscript found in Yemen and a previous publication, on the one hand, is important in understanding the point of view of Zaydī- Muʿtazilī thought on the disciplines of theology, jurisprudence, debate, history of Islamic sects, on the other hand, it is a helpful resource for understanding the terms used in the theory of aḥwāl, which is still an intricate issue. Ibn Sharwīn in his Ḥaqāʾiq al-ashyāʾ; explains over 150 terms in relation to cosmology such as substance, accident, line, surface, space; to ontology such as existing, non-existence, originated (muḥdath); to epistemology such as knowledge, creed, ignorance, doubt, skepticism, obligatory and acquired knowledge; to methodology such as evidence, madlūl, debate, and disputation; to fiqh such as sunnah, farḍ, mandūb, cause, command-prohibition, general-particular (ʿumūm-ḫuṣūṣ); to the history of sects such as ʿadliyya, compulsionists (mujbira) and qadarī; to divinity such as the oneness of God (tawhīd); to justice such as promise and threat (al-waʿd wa-l-waʿīd), good and evil, necessary and acquired, grace, compensation, repentance, major and minor sins; to the theory of al-aḥwāl such as attribute of the essence, determinant (muḳtaḍī), entail (muḳtaḍā), muṣaḥḥiḥ, cause. Describing ḥadd that corresponds to “definition” and ḥaḳīḳat that he used together with it as collectively exhaustive, mutually exclusive, Ibn Sharwīn defines knowledge, power, living (ḥayy), speech (kalām), speaker (mutakallim), permanent (bāqī) etc. in a way that is true for both God and human beings. While making these definitions, he draws on poems, linguistic usages and verses and divides the nouns into three parts at the end of his work, namely linguistic, religious and conventional (sharʿī and waḍʿī); in particular, he gives detailed information about metaphors and parts of truth. Another striking aspect of the work is the explanation of the meanings of the imperative mood which is included in the subjects of the Methodology of Fiqh. (shrink)

In recent years, the fascination with K-Pop music, its singers and groups, which have rapidly gained popularity in the world and in our country, increasingly attracted notice and is the subject of many studies. The daily lives and lifestyles of the people representing this musical style and groups become the focus of attention of the younger generations and are imitated by them. This fact necessitates to research K-Pop music. Studies in the world and in Turkey reveal that K-Pop has significant (...) effects on young people. This trend, supported by industrial and cultural forms, attracts the attention of young people and affects their lifestyles. It is important to research how K-Pop singers and groups with their dynamic compositions, lively dances, innocent expressions, sexless looks, unique clothing, makeup, images, gestures and facial expressions affect their young fans, as well as what their religious, national and cultural consequences are on individual and social basis. The research was conducted with a phenomenological approach and the data was collected via semi-structured interviews with 20 young people born between 2000 and 2010, who were selected by snowball sampling method. As a result of the analysis, the data were classified as two themes, namely, the interest of young people in K-Pop and the influence of K-Pop on young people. In this study, it was aimed to determine how and in which subjects K-Pop music style and group mem-bers are influential on the imagination of adolescents, and the meaning and importance of this situation in terms of religious-moral education and deve-lopment. It was observed that the participants admire K-Pop singers and groups, like their lifestyle, and view every behaviour of these people positively. Moreover, in the study, the effects of K-Pop music on emotions, behaviours and thoughts were examined and their advantages and disadvantages were evaluated in terms of religious-moral education. At the end of the study, suggestions are given for the young people to be selective about the people that they will choose as a phenomenon or an idol in terms of religious education. (shrink)

It is experienced that online education has become further more widespread in recent years. Especially with the pandemic period, it is seen that there is more demand for online training. In the same way, formal and non-formal of religious education is also provided online In this study, a scale development study was carried out to measure attitudes of Online Religious Education. The data was obtained via electronic forms. This data consisted of information from 642 adult participants. The age range of (...) these groups is 18-40 and older. The scale study has been advanced by adhering to the scale development stages. Various conclusions have been drawn through the analysis of the data obtained as a result of these stages. The KMO value of the scale is found to be 0.961, the Bartlett test value found to be x2(153)=9972,397 p=0.000, and chi-square value is determined to be significant. As a result of the analysis, the three factor groups are determined as “cognitive”, “affective” and “behavioural”. İt is observed that the total variance explained by the scale, which consists of a total of 45 items, is 72,766, and the factor loads of the items ranged between 0.578 and 0.896. This situation has showed that the items are related to each other. When the item correlations are analysed, it is found that there was no item below 0.30 and the total correlation values of the items varied between 0.663 and 0.852. This has revealed that the items are related to each other. At the same time, when the mean scores of the lower 27% and upper 27% were compared with the independent group t-test, it is determined that there is a significant difference in the mean scores. In other words, it has been demonstrated that the scale is distinctive in terms of measuring the desired quality. All these data and analyses have shown that the Online Religious Education Attitude Scale is a valid, reliable and distinctive tool that can measure the achievements of online religious education. This paper reviews the recent writing of Sergio Bologna and Carlo Formenti. These authors are proposed as post-workerist dissenters with respect to Hardt and Negri’s conceptualisation of contemporary capitalism. Therefore, while the latter has risen to prominence within Anglo-American academia astheradical account of the political economy of the knowledge economy, the work of Bologna and Formenti is here presented as providing alternative accounts of contemporary capitalism and its dynamics. In doing so, this work challenges the Anglo-American reception of post-operaismo. However, (...) these analyses are also assessed by showing the many similarities they share with Hardt and Negri’s account. These similarities are argued to pose immanent limits, impeding this post-workerist dissent’s ability to carryoperaismobeyond Hardt and Negri. (shrink)

Interpretation of the Mīmāṃsānyāyaprakāśa of Āpadeva, treatise on Mimamsa philosophy.

My topic is extraterrestrial intelligence. Following current conventions, I use the abbreviation ‘ETI’ to stand for three related concepts: the abstract idea of extraterrestrial intelligence, individuals who are both extraterrestrial and intelligent, and the hypothesis that there are ETIs. SETI is the search for ETIs, and CETI is the attempt to communicate with ETIs. In this paper, I will try to answer the two most basic questions in extraterrestrial studies. First, what is the status of the ETI hypothesis? In (...) the light of what we know, how likely is it that there are ETIs? Secondly, what is the value of pursuing SETI? Are the expected epistemic and pragmatic payoffs sufficient to warrant an extensive search? The first, substantive question is discussed in Section 2, Section 3 and Section 4. The second, ‘program evaluation’ question is the subject of Section 5 and Section 6. But first we'll take a brief look at some of the early history of the topic. (shrink)

Lepenies si propone di individuare le cause storico-sociali e le conseguenze sociologicamente rilevanti degli atteggiamenti individuali e collettivi melanconici per la genesi, la conservazione e innovazione delle strutture sociali. Egli afferma che non intende definire a priori che cosa sia la melanconia, ma piuttosto ricostruirne il significato tramite le rappresentazioni dei vissuti interiori di coloro che si sono autodefiniti tali attingendo alla letteratura di corte, salottiera nobiliare e borghese, francese e tedesca. In realtà, egli (...) esamina le differenti rappresentazioni della malinconia, alla luce del quadro clinico elaborato dalla psicoanalisi di S. Freud e dalla psichiatria di E. Kraepelin, H. Tellenbach, ecc., e dello schema sociologico dei tipi di adattamento di R.K. Merton. Queste categorie concettuali consentono a Lepenies di ricostruire gli atteggiamenti malinconici che si diffusero presso due diversi ceti sociali in tempi e in luoghi differenti: 1) i ceti nobiliari francesi dopo la sconfitta della Fronda e 2) la borghesia tedesca del ‘700. En México, CETYS Universidad, pretende promover sistemáticamente entre sus estudiantes la formación del carácter, la cultura y la ciencia; así como el cumplimiento de exigencias éticas. En este estudio se describe la experiencia de aprendizaje de estudiantes de la escuela de ingeniería en la asignatura Ser humano y ética, se realizó un análisis cualitativo, emergieron tres categorías: Asumir una postura ética, Reflexión (...) personal sobre la sociedad y sus problemáticas, y Acercamiento a la filosofía y la ética. Nella nuova Italia gli interpreti e i difensori delle civili libertà (l'espressione è di Romagnosi) furono pochi e poco considerati. Tra essi, gli amici e i seguaci radicali e federalisti di Carlo Cattaneo, ma anche un moderato come Pasquale Villari, il maestro di Gaetano Salvemini. Tutti ebbero in comune la condivisione del pensiero filosofico e politico di John Stuart Mill e il proposito di favorirne la diffusione nella cultura del loro tempo. Mill fu uno degli autori più tradotti nell'Italia dell'Ottocento. (...) Se la sua filosofia ebbe pochissima fortuna, il suo liberalismo attraversò invece tutta la classe politica ed intellettuale italiana: fu come un crocevia di strade diverse per provenienza e destinazione. Ciò vale per Francesco Ferrara e per Vilfredo Pareto, per Marco Minghetti e per Luigi Luzzatti, per i liberisti della Società Adamo Smíth e per i vincolisti del Giornale degli economisti. Il confronto con Mill permette di individuare i caratteri della filosofia civile del liberalismo post-unitario, le sue aspirazioni di buon governo e di giustizia, la sua fiducia nella cultura della modernità. La ricostruzione dei dibattiti e delle polemiche che si susseguirono tra gli anni sessanta e settanta sul decentramento, sulla rappresentanza proporzionale, sul suffragio femminile, sui rapporti fra stato e società civile, sul metodo dell'economia politica, sul socialismo e sull'utilitarismo i temi essenziali del liberalismo milliano aiuta a cogliere il significato storico del complesso rapporto tra liberalismo e positivismo in Italia. Ne viene fuori, come mette in rilievo Norberto Bobbio nella prefazione al volume, il carattere tortuoso e difficile del liberalismo italiano; la sua difficoltà a divenire una base effettiva di riferimento del nuovo stato, dei suoi ceti dirigenti, delle sue elite intellettuali.
