Wrongdoing and the Moral Emotions provides an account of how we might effectively address wrongdoing given challenges to the legitimacy of anger and retribution that arise from ethical considerations and from concerns about free will. The issue is introduced in Chapter 1. Chapter 2 asks how we might conceive of blame without retribution, and proposes an account of blame as moral protest, whose function is to secure forward-looking goals such as the moral reform of the wrongdoer and reconciliation in relationships. Chapter 3 considers whether it's possible to justify effectively dealing those who pose dangerous threats if they do not deserve to be harmed, and contends that wrongfully posing a threat is the core condition for the legitimacy of defensive harming. Chapter 4 provides an account of how to treat criminals without a retributive justification for punishment, and argues for an account in which the right of self-defense provides justification for measures such as preventative detention. Chapter 5 considers how we might forgive if wrongdoers don't basically deserve the pain of being resented, which forgiveness would then renounce, and proposes that forgiveness be conceived instead as renunciation of the stance of moral protest. Chapter 6 considers how personal relationships might function without retributive anger having a role in responding to wrongdoing, and contends that the stance of moral protest, supplemented with non-retributive emotions, is sufficient. Chapter 7 surveys the options for theistic and atheistic attitudes regarding the fate of humanity in a deterministic universe, and defends an impartial hope for humanity. (shrink)

Transcendental freedom consists in the power of agents to produce actions without being causally determined by antecedent conditions, nor by their natures, in exercising this power. Kant contends that we cannot establish whether we are actually or even possibly free in this sense. He claims only that our conception of being transcendentally free involves no inconsistency, but that as a result the belief that we have this freedom meets a pertinent standard of minimal credibility. For the rest, its justification depends (...) on practical reasons. I argue that this belief satisfies an appropriately revised standard of minimal credibility, but that the practical reasons Kant adduces for it are subject to serious challenge. (shrink)

Most people assume that, even though some degenerative or criminal behavior may be caused by influences beyond our control, ordinary human actions are not similarly generated, but rather are freely chosen, and we can be praiseworthy or blameworthy for them. A less popular and more radical claim is that factors beyond our control produce all of the actions we perform. It is this hard determinist stance that Derk Pereboom articulates in Living Without Free Will. Pereboom argues that our best (...) scientific theories have the consequence that factors beyond our control produce all of the actions we perform, and that because of this, we are not morally responsible for any of them. He seeks to defend the view that morality, meaning and value remain intact even if we are not morally responsible, and furthermore, that adopting this perspective would provide significant benefit for our lives. The question I raise is whether Mark Balaguer’s event-causal libertarianism can withstand the disappearing agent objection. The concern is that with the causal role of the events antecedent to a decision already given, nothing settles whether the decision occurs, and so the agent does not settle whether the decision occurs. Thus it would seem that in this view the agent will not have the control in making decisions required for moral responsibility. In this book, Derk Pereboom explores how physicalism might best be formulated and defended against the best anti-physicalist arguments. Two responses to the knowledge and conceivability arguments are set out and developed. The first exploits the open possibility that introspective representations fail to represent mental properties as they are in themselves; specifically, that introspection represents phenomenal properties as having certain characteristic qualitative natures, which these properties might actually lack. The second response draws on the proposal that currently unknown fundamental (...) intrinsic properties provide categorical bases for known physical properties and would also yield an account of consciousness. While there are non-physicalist versions of this position, some are amenable to physicalism. The book's third theme is a defense of a nonreductive account of physicalism. The type of nonreductivism endorsed departs from others in that it rejects all token identity claims for psychological and microphysical entities. The deepest relation between the mental and the microphysical is constitution, where this relation is not to be explicated by the notion of identity. (shrink)

This paper is concerned with the logical structure of arithmetical theories. We survey results concerning logics and admissible rules of constructive arithmetical theories. We prove a new theorem: the admissible propositional rules of Heyting Arithmetic are the same as the admissible propositional rules of Intuitionistic Propositional Logic. We provide some further insights concerning predicate logical admissible rules for arithmetical theories.

This chapter analyses the problem of free will and moral responsibility, to which the history of philosophy records three standard reactions. Compatibilists maintain that it is possible for us to have the free will required for moral responsibility if determinism is true. Others contend that determinism is not compossible with our having the free will required for moral responsibility – they are incompatibilists – but they resist the reasons for determinism and claim that we do possess free will of this (...) kind. They advocate the libertarian position. Hard determinists are also incompatibilists, but they accept that determinism is true and that we lack the sort of free will required for moral responsibility. In his paper "Undecidability without arithmetization," Andrzej Grzegorczyk introduces a theory of concatenation $\mathsf{TC}$. We show that pairing is not definable in $\mathsf{TC}$. We determine a reasonable extension of $\mathsf{TC}$ that is sequential, that is, has a good sequence coding.

This paper features Derk Pereboom’s replies to commentaries by Victor Tadros and Saul Smilansky on his non-retributive, incapacitation-focused proposal for treatment of dangerous criminals; by Michael McKenna on his manipulation argument against compatibilism about basic desert and causal determination; and by Alfred R. Mele on his disappearing agent argument against event-causal libertarianism.

Since its original publication in Chinese in the 1930s, this work has been accepted by Chinese scholars as the most important contribution to the study of their country's philosophy. In 1952 the book was published by Princeton University Press in an English translation by the distinguished scholar of Chinese history, Derk Bodde, "the dedicated translator of Fung Yu-lan's huge history of Chinese philosophy". In this paper we study 1. the frame-theory of certain bimodal provability logics involving the reflection principle and we study2. certain specific bimodal logics with a provability predicate for a subtheory of Peano arithmetic axiomatized by a non-standardly finite number of axioms.

In this paper we describe a framework for the construction of entities that can serve as interpretations of arbitrary contiguous chunks of text. An important part of the paper is devoted to describing stacking cells, or the proposed meanings for bracket-structures.

National legal systems undergo profound changes when they are confronted with undemocratic power seizure. The same occurs when they experience a transition (back) to democracy. Thus far, these two types of transition have been studied in relative isolation. Nevertheless, it seems that both undemocratic usurpers and democratizing regimes affect the role of fundamental rule-of-law principles in similar ways. This article compares both types of transition and suggests that pragmatism and national identity are the driving forces behind similar legal mechanisms, affecting (...) legal principles, in those two forms of transition. Drawing on Carl Schmitt's idea of the state of exception and Ruti Teitel's work on transitional justice, this article shows that both kinds of transition share the same fundamental legal structure. Scientism, Enough of That In this paper I argue that it is not a good idea to employ the notion of scientism in public debates concerning issues like free will. Moreover, I claim that, also in philosophy proper, thinking through the notion of scientism is not an urgent task. It is better to reflect directly on notions like justification, evidence, authority of science and the like.

This article sets out a forward-looking account of moral responsibility on which the ground-level practice is directly sensitive to aims such as moral formation and reconciliation, and is not subject to a barrier between tiers. On the contrasting two-tier accounts defended by Daniel Dennett and Manuel Vargas, the ground-level practice features backward-looking, desert-invoking justifications that are in turn justified by forward-looking considerations at the higher tier. The concern raised for the two-tier view is that the ground-level practice will be insufficiently (...) responsive to the forward-looking aims that are held to justify it. On the single-tier alternative, forward-looking considerations can more readily motivate substantial revisions, which the practice, due to serious and pervasive deficiencies, requires. (shrink)

This dissertation is an interpretation of Kant's theory of mental representation, and an attempt to elucidate this theory by viewing it from both historical and contemporary perspectives. After an exposition of Kant's notions of intuition, sensation, and concept, I argue that the theory as a whole can be seen as an Aristotelian reaction against Leibnizian rationalism and Humean empiricism and naturalism. As in Aristotelian theories, Kant argues that there are two distinct types of mental representation, and two distinct types of (...) processes involved in cognition. ;I construe the Transcendental Deduction and the Second Analogy as a series of arguments against Hume for the thesis that our mental repertoire contains conceptual as well as passively received representations. The division of the anti-Humean arguments I find to be most fruitful is the division into arguments from above and arguments from below. I find it illuminating to view several aspects of Kant's anti-Humean arguments from the perspective of contemporary concerns in the theory of intentionality. Some of Kant's contentions against Hume can be seen as an attempt to resist a tendency to redescribe intentional relations so that the resulting description is extensional. Kant can be viewed as trying to preserve the idea that sentences describing intentional relations from the perspective of the subject are irreducibly intensional. ;I argue that the chapter of the Critique of Pure Reason entitled 'The Amphiboly of Concepts of Reflection' together with portions of a later work, On a Discovery, contain an argument against Leibniz or the Leibnizians of Kant's day for the thesis that nonconceptual elements, as well as concepts, are required for the cognition of physical objects. Questions arise here about the relation between Kant's views on this issue and modern studies of indexicality. My view is that Kant can be construed as providing a theory about what underlies the irreducibly indexical element in our cognitions of physical objects. Kant's idea of passive receptivity, closely tied to the notion of what the experience of a quality is like, is relevant to this, as is the notion of an external or relational quality developed in the Amphiboly. The claim that moral responsibility for an action requires that the agent could have done otherwise is surely attractive. Moreover, it seems reasonable to contend that a requirement of this sort is not merely a necessary condition of little consequence, but that it plays a decisive role in explaining an agent's moral responsibility for an action. For if an agent is to be blameworthy for an action, it seems crucial that she could have done something to avoid this blameworthiness. If (...) she is to be praiseworthy for an action, it seems important that at least she could have done something less admirable. Libertarians, in particular, have often grounded their incompatibilism precisely in such intuitions. By contrast, I shall argue that the availability of alternative possibilities is in a significant sense irrelevant to explaining an agent's moral responsibility for an action. At the same time I do not want to disavow incompatibilism, but rather to defend a version in which the pivotal explanatory role is assigned to features of the causal history of the action, and not to the availability of alternative possibilities.
