THE FREEHOF INSTITUTE OF PROGRESSIVE HALAKHAH The Freehof Institute of Progressive Halakhah is a creative research center devoted to studying and defining the progressive character of the halakhah in accordance with the principles and theology of Reform Judaism. It seeks to establish the ideological basis of Progressive halakhah, and its application to daily life. The Institute fosters serious studies, and helps scholars in various portions of the world to work together for a common cause. It provides an ongoing forum through (...) symposia, and publications including the quarterly newsletter, HalakhaH, published under the editorship of Walter Jacob, in the United States. The foremost halakhic scholars in the Reform, Liberal, and Progressive rabbinate along with some Conservative and Orthodox colleagues as well as university professors serve on our Academic Council. This collection of essays is the product of the symposia held in Atlanta and Pittsburgh in 1995 and 1996. This book follows the volumes DYNAMIC JEWISH LAW; Progressive Halakhah - Essence and Application (1991), RABBINIC -LAY RELATIONS IN JEWISH LAW (1993), CONVERSION TO JUDAISM IN JEWISH LAW (l994), DEATH AND EUTHANASIA INJEWISH LAW (1995) and THE FETUS AND FERTILITY IN JEWISH LAW (1995), ISRAEL AND THE DIASPORA IN JEWISH LAW (1997). The attitude towards death and dying reflects the society’s view on a human being as a subject. Due to the progress in medical science a growing interest has been observed in the problem of death, including the right to dignified dying. One of the issues connected with the phenomenon of dying is the problem of euthanasia seen as one’s right to decide on one’s own death in extreme cases. The question of the legality of euthanasia is becoming a (...) subject of consideration more and more often, which is a result of a celebratory culture of death and the obsolescence of faith and religious practice. The aim of the following report is to show the attitude of major religions of the world towards euthanasia. What arguments of religious nature are against the legality of mercy killing? Both Christian and non-Christian religions rise to speak on the matter. All religions stress their veto over mercy killing, justifying their view in various ways. Christians claim that God is the donor and lord of life; a man cannot decide on ending human life as he or she is only the user, not the owner of it. Judaism assumes that human life has an absolute value, is sacred, untouchable, as God’s gift. Islam, quoting Koran, also preserves life as God’s gift. According to Buddhist ethics, the annihilation of both one’s own and someone else’s life is the worst of evil deeds. Over the past decade much significant new work has appeared in the field of Jewish ethics. While much of this work has been devoted to issues in applied ethics, a number of important essays have explored central themes within the tradition and clarified the theoretical foundations of Jewish ethics. John Harris is one of the prominent philosophers and bioethicists of our time. He has published tens of books and hundreds of papers throughout his professional life. This paper aims to take a ‘deep-look’ at Harris' works to argue that it is possible to find some principles of Islamic ethics in Harrisian philosophy, namely in his major works, as well as in his personal life. This may be surprising, or thought of as a ‘big’ and ‘groundless’ claim, since John Harris (...) has nothing to do with any religion in his intellectual works. The major features of Harrisian philosophy could be defined as consequentialism or utilitarianism with liberal overtones. Despite some significant and fundamental differences in the application of principles (ie, abortion, euthanasia), the similarities between the major principles in Harrisian philosophy and Islamic ethics are greater at some points than the similarities between Islamic ethics and some other religious ethics (ie, Christian, Judaism). In this study I compare Harrisian teachings with major Islamic principles on ‘Responsibility’, ‘Side-effects and Double-effects’, ‘Equality’, ‘Vicious choice, guilt and innocence’, ‘Organ transplantation and property rights’ and ‘Advance directives’. "dialogic engagement," modeled upon their own interdisciplinary exchange with one another (4). In fact, each of the seven main chapters is explicitly structured as a dialogue: each author laying out his particular approach in two separate sections, which are then followed by a question-and-answer section where the authors pose questions to one another and provide brief responses. Intending to address death as it relates to the moral lives of the living, the chapters cover topics that are of enduring interest to students, scholars, and the general public: abortion, the death penalty, war, suicide, physician-assisted suicide, and euthanasia. To distinguish it from other recent titles that explore the dying experience in contemporary medical contexts, the book might be more accurately described as addressing the ethics of killing. Background In 2002, Belgium set a legal framework for euthanasia, whereby granting and performing euthanasia is entrusted entirely to physicians, and—as advised by Belgian Medical Deontology—in the context of a trusted patient–physician relationship. Euthanasia is, however, rarely practiced, so the average physician will not attain routine in this matter. Aim To explore how general practitioners in Flanders (Belgium) deal with euthanasia. This was performed via qualitative analysis of semistructured interviews with 52 general practitioners (GPs). Results Although (...) GPs can understand a patient's request for euthanasia, their own willingness to perform it is limited, based on their assumption that legal euthanasia equates to an injection that ends life abruptly. Their willingness to perform euthanasia is affected by the demanding nature of a patient's request, by their views on what circumstances render euthanasia legitimate and by their own ability to inject a lethal dose. Several GPs prefer increasing opioid dosages and palliative sedation to a lethal injection, which they consider to fall outside the scope of euthanasia legislation. Conclusions Four attitudes can be identified: (1) willing to perform euthanasia; (2) only willing to perform as a last resort; (3) feeling incapable of performing; (4) refusing on principle. The situation where GPs have to consider the request and—if they grant it—to perform the act may result in arbitrary access to euthanasia for the patient. The possibility of installing transparent referral and support strategies for the GPs should be further examined. Further discussion is needed in the medical profession about the exact content of the euthanasia law. (shrink)

Although Kirk Lougheed recognises the need to integrate diverse frameworks into its predominantly Anglo-American tradition,1 his argument contains a limited understanding of vital force as well as a restricted view of communal relationships. We therefore suggest a broader framework for understanding vitality, community and what is permissible by emphasising how African beliefs by the Akan, advance care directives and Afro-Caribbean religious practice such as Santería expand perspectives within global bioethics and thus encourage more inclusive approaches to addressing bioethical dilemmas. For (...) the Akan (in Ghana), the fundamental concept of ‘being’ is construed on the belief that Okra (considered as soul, or the life-giving spirit in man) and Nkrabea (considered as destiny) determine the life of every individual. Individual autonomy in the matter of ‘death’ is linked to the collective responsibility for the preservation of life. For a terminally ill person, his family and community members, this responsibility is upheld by allowing Nkrabea (destiny) to take its natural course without any human intervention especially in matters of ‘death’. Several religious traditions are widely believed to advocate the use of life-sustaining treatment in all circumstances. Hence, many believe that these faiths would require the use of a feeding tube in patients with advanced dementia who have lost interest in or the capacity to swallow food. This article explores whether one such tradition—halachic Judaism—in fact demands the use of artificial nutrition and hydration in this setting. Traditional arguments have been advanced holding that treatment can be withheld in persons who are (...) dying, in individuals whose condition causes great suffering, or in the event that the treatment would produce suffering. Individuals with advanced dementia can be considered to be dying, often suffer as a result of their dementia, and are likely to suffer from the use of a feeding tube. Given these observations and the absence of a compelling case for distinguishing between tube feeding and other forms of medical treatment, traditional Judaism appears compatible with withholding artificial nutrition for individuals with advanced dementia. In this paper I shall examine the philosophical cosmology of medieval Jewish thinkers as developed against the backdrop of their views on time and creation. I shall concentrate upon the Neoplatonic and Aristotelian traditions, with a particular eye to the interweaving of astronomy, cosmology and temporality. This interweaving occurs in part because of the influence of Greek cosmological and astronomical texts upon Jewish philosophers. The tension between astronomy and cosmology is best seen in Maimonides' discussion of creation. Gersonides, on the (...) other hand, is more willing to incorporate astronomical material into his cosmological thinking. By examining these motifs, we shall arrive at a greater understanding of the dimension of temporality within Jewish philosophy. (shrink)

The development of Talmudic Judaism from the first to the fifth century A.D. is marked by a decline of interest in the knowledge and explanation of historical events. Neither the destruction of the Temple in 70 A.D. nor the advent of the Sasanians in Babylonia in 226 A.D. provoked refiection on history among the Talmudic rabbis. In Jerusalem in the first century, Yohanan ben Zakkai stressed an interim ethic and policy for survival and redemption; Rav and Samuel, in third century (...) Babylonia, converted messianic speculation and scriptural exegesis into a policy of passive acceptance of political events. But lack of interest in political history masked belief that the covenant of Sinai would win redemption not through the course of historical events but apart from it. (shrink)

The chapter focuses on cases of assisted suicide and voluntary euthanasia in relation to the rarely discussed notion of indirect paternalism. Indirect paternalism involves not just a paternalistic intervener and a person whose welfare is supposed to be protected, but also another party, whom I call “assistant.” Indirect paternalism interferes with an assistant in order to prevent harm to another person. I will introduce a strategy that paternalists can pursue to justify indirect paternalism. It specifically targets an element of (...) assistance cases, namely the fact that people do not necessarily have a justified claim or entitlement to demand such assistance. To prevent people from providing assistance seems normatively different from preventing a person to do something to herself by her own means. I critically discuss arguments from the goals of medicine and from the conscientious objection. These aspects are not deemed decisive when considering the case of indirect paternalistic intervention. Finally, I argue against the rationale of indirect paternalism by showing that there are at least two situations where it does not succeed. One such situation that undermines the justification of indirect paternalism is present when the offered service is itself harmless, another pertinent situation consists of a person necessarily requiring assistance to be really free. At least in some cases, these very conditions are given when contemplating assistance to die. (shrink)

Some scholars have responded to the increasingly widespread concerns about Immanuel Kant’s racism by promoting his cosmopolitanism as if the two were self-evidently incompatible, but his particular form of cosmopolitanism has its own history of difficulties when it comes to both racism and anti-Judaism. These concerns can be grounded historically if one links his 1784 essay on history with his account of cosmopolitanism in his 1793 lectures on the metaphysics of morals, where he criticized Jews for failing to embrace cosmopolitanism. Kant’s attack on the Jews was in line with Johann Gottlieb Fichte’s attack on them that had provoked Saul Ascher, a young Jewish Kantian, to accuse Fichte of inventing a new form of anti-Judaism. In this essay I reaffirm my rejection of the widespread claim that Kant toward the end of his life abandoned his belief in a racial hierarchy. I also demonstrate that he used the idea of cosmopolitanism as a tool not only against non-whites, but also against Jews. Kant’s cosmopolitanism should not be presented as the corrective to his racism, but as a new and dangerous addition to his earlier focus on inferiority. (shrink)

An understanding of what we mean by the present is one of the key issues in literature, philosophy, and culture today, but also one of the most neglected and misunderstood. _Present Hope_ develops a fascinating philosophical understanding of the present, approaching this question via discussions of the nature of historical time, the philosophy of history, memory, and the role of tragedy. Andrew Benjamin shows how we misleadingly view the present as simply a product of chronological time, ignoring the role of (...) history and memory. Accordingly, discussion of what is meant by the present disappears from philosophical concern. To draw attention to this absence, Andrew Benjamin introduces the notion of hope and asks what this concept can tell us about the present. At the heart of the outstanding work is an emphasis on the relation between hope and the Jewish tradition. Through discussions of philosophical responses to the Holocaust, the work of Walter Benjamin, Daniel Libeskind's Jewish Museum, and the poetry of Paul Celan, _Present Hope_ shows how we must look beyond the purely philosophical horizon to understand the present we live in. This book examines the origins of communal and institutional almsgiving in rabbinic Judaism. It undertakes a close reading of foundational rabbinic texts and places their discourses on organized giving in their second to third century CE contexts. Gregg E. Gardner finds that Tannaim promoted giving through the soup kitchen and charity fund, which enabled anonymous and collective support for the poor. This protected the dignity of the poor and provided an alternative to begging, which benefited the community as a whole (...) - poor and non-poor alike. By contrast, later Jewish and Christian writings would see organized charity as a means to promote their own religious authority. This article's main purpose is to verify if, and to what extent, an attitude of religious tolerance stems from the essential pivots of Biblical and Rabbinic theology. After a careful perusal of the sources, Neusner comes to a negative conclusion: while classical Judaism provides open eschatological views, embracing all humanity in the acknowledgement of the One God at the end of days, it does not contain theological foundations for tolerating other religions in the here and now. The idea of history, with its rigid distinction between past and present and its careful sifting of connections from the one to the other, came quite late onto the scene of intellectual life. Both Judaism and Christianity for most of their histories have read the Hebrew Scriptures from within an other-than-historical framework. They found in Scripture's words paradigms of an enduring present, by which all things must take their measure; they possessed no conception whatsoever of the pastness of the past. (...) Rabbinic Judaism invented an entirely new way to think about times past and to keep all time-past, present, and future-within a single framework. For that purpose, a model was constructed, consisting of selected events held to form a pattern that imposes order and meaning on the chaos of what happens, whether past or present or future. Time measured in the paradigmatic manner is time formulated by a free-standing, atemporal model, not appealing to the course of sun and moon, nor concerned with the metaphor of human life and its cyclicality. Not only so, but the paradigm obliterates distinctions between past, present, and future, between here and now and then and there. The past participates in the present, the present recapitulates the past, and the future finds itself determined, predetermined really, within the same free-standing structure comprised by God's way of telling time. For Max Weber, modernity is characterized by a tragic conflict among value spheres, each claiming to possess the ‘true meaning’ of human life. In particular, Weber argues that while the political sphere is dominated by the unifying, exclusionary, power-driven, and war-prone nation state, the ethical sphere is characterized by the universalization of individually based, deontological norms. For Weber, I argue, the modern separation between the ethical and political spheres originates in ancient Judaism. His work on Judaism, mostly neglected by political (...) theorists, describes the emergence of politics as an autonomous, naturalistic sphere with the establishment of kingship. One of the central concepts in rabbinic Judaism is the notion of the Evil Inclination, which appears to be related to similar concepts in ancient Christianity and the wider late antique world. The precise origins and understanding of the idea, however, are unknown. This volume traces the development of this concept historically in Judaism and assesses its impact on emerging Christian thought concerning the origins of sin.
