Immigration law is exceptional enough to deserve an administrative law focus of its own. The Administrative Procedure Act (APA) does not demand uniformity in adjudication. Therefore, it may be counterintuitive to argue that any one area of administrative adjudication is exceptional. Removal adjudication is indeed exceptional because it is an extremely dysfunctional system, it operates in a double void of fewer constitutional protections and without the protections of the APA, it relies on a vast network of civil detention, and it (...) is of a different genre than the type of regulation that drove the development of the APA. The exceptionality of removal adjudication demands a review of administrative law doctrine with this exceptionality in mind. (shrink)

This article discusses the epitaphs with epithets from two burial grounds at Carthage excavated by Alfred-Louis Delattre in the last decades of the 19 th century. He found more than 900 Latin inscriptions that can be dated between the late first century and the early third century CE. Most of those buried at the so-called ‘cimetières des _ officiales _ ’ were imperial slaves and freedmen together with their relatives and include almost 1300 individuals. Epithets occur just in about sixty (...) epitaphs or about 6 % of the inscriptions from the imperial burial grounds at Carthage. The inscriptions are mostly short with certain conventions. The employment of epithets characterized the moral qualities of the commemorated seen from the commemorator’s point of view and is an expression of feelings, emotions and grief. The epitaphs from Carthage come from a well-defined context within a well-defined group, which may share the same feelings and be called an emotional community. The analysis of the most common epithets demonstrates remarkable differences between their use at Carthage and in the funerary inscriptions found in Rome. (shrink)

In immisgration policies the use of genetical parental testing has become a common procedure to decide which applicants have a legal claim for family reunification. Many scholars argue that this introduction of DNA analyses establishes a biologically biased understanding of family relationships and undermines a social concept of family. This paper reflects on the underlying concepts of the relationship between family and the state in this field. Referring to Hegel it can be shown that even today family is conceived as,presocial‘, (...) as the constitutive other of the social sphere. This assumption helps to explain the privileging of the nuclear family in national and international legislation. The main logic and intention of family rights is neither to protect incomparable emotional ties between individuals nor biological blood bounds. It is not about saving loving relationships as such, but rather about trying to govern them and to legitimate the State itself. (shrink)

This article deals with different kinds of family life and parenthood that have developed. It is pointed out that for their own and their child's sake the parents should regard their relationship as a Iasting commitment, so that a spirit ofreliability, mutual trust and love can grow. The ethical task in this respect is not so much that ofmeeting a mere demand but- since what is demanded for is, in the first place, a gift-tobe truly aware of one's commitment. The discovery of a new homonin species called Homo naledi evoked unprecedented interest, even outside the scientific disciplines who are researching extinct homonin species. The reason for this is that Prof. Lee Berger, attached to the University of the Witwatersrand and his team, known as the Rising Star-expedition, came to the conclusion that the fossils that were discovered in the Dinaledi cave room in Sterkfontein outside Johannesburg in 2013, were placed there deliberately. The theory postulates the possibility of symbolic or (...) ritual behaviour by a species that lived and later became extinct approximately 1 to 2 million years ago. If this is indeed the case, it also offers theologians the opportunity to join the conversation with regard to the evolvement of our spirituality and religiousness. This article is an attempt to render a contribution, with the data available to us, about the value of the prehistoric signs of spirituality with specific reference to the so-called cemetery theory. Together with this, other usable theories will be employed to consider the possible signs of ritual and symbolic behaviour by Homo naledi. The condition for a meaningful discussion about the evolvement of our spirituality and religiousness is that epistemological contours be clearly drawn. With the first part of the article these contours are drawn and with the second part the possible implications of the cemetery theory are reviewed. (shrink)

The article starts with a review about the current public debate on the crisis of family. In the author‘s perspektive this debate is motivated less by the hard facts about the situation of family in the current western societies - although there are many changes - but rather it indicates a changing correlation between a »private« and a »public« concept of family. Up to the 1970ties family was understood as an area of privacy, but the frameset of this area was (...) defined by the public sphere only - mainly by the state and the church. Their representatives assigned a certain form of private life to individual people. But the advantages of emanzipation caused especially young women to decline this structure. They want to design their own conception of family, based on the compatibility of job and motherhood. This formation is described as »crisis of family« by the detractors of modernity. In contrast, it is the author‘s position to take this developments as a chance - especially in a protestant perspective. At the end, the article stetches the basic framework of such a concept of family. (shrink)
