Wir hoffen nicht zu Unrecht, mittels der Erziehung das zukünftige Lebensglück unserer Kinder günstig beeinflussen zu können. Strittig bleibt jedoch, wie umfangreich dieser Einfluss zu denken ist und wie begründet unsere Erziehungshoffnungen diesbezüglich sind. In der Antike wurde das Glück als launisch und nicht vorhersehbar betrachtet. Weitgespannte Hoffnungen galten deshalb als trügerisch; und der Einfluss der Erziehung für eine bessere Zukunft wurde tendenziell eher skeptisch beurteilt. Die Neuzeit rückt ihre Erziehungshoffnungen dagegen in die Nähe der Erfüllbarkeit. Der moderne Mensch (...) entdeckt seine Gestaltungskraft für eine bessere Zukunft; und die professionalisierte Erziehung dient ihm als effektives Mittel, sich eben diese Zukunft verfügbar zu halten. Als Tugend dürfte die Hoffnung des Pädagogen darum wesentlich irgendwo _zwischen_ der Verzweiflung und der Vermessenheit der Erziehung liegen, und also _zwischen_ einem zu radikalen Glücksskeptizismus einerseits und der zu optimistischen Vorstellung einer einflussreichen Glücksmaschinerie andererseits. Eben darum muss ihr konkretes Maß aber in jeder Situation prinzipiell neu verhandelt werden. (shrink)

Die Geltung von Entschädigungsansprüchen für historisches Unrecht wird in der philosophischen Literatur vor allem aus zwei Gründen bestritten: auf Grund des Nichtidentitätsproblems und auf Grund der von Jeremy Waldron behaupteten möglichen Aufhebung historischen Unrechts durch die Veränderung von Umständen. Für die Beurteilung des Rechts der palästinensischen Flüchtlinge auf Rückkehr sind beide Einwände nur von geringer Bedeutung. Die Palästinenser sollten jedoch auf ihr Recht auf Rückkehr vorläufig verzichten , um einen Kompromiss zu ermöglichen, der es ihnen erlaubte, ihr Selbstbestimmungsrecht (...) in einem Teil ihres Heimatlands zu realisieren. Eine solche Zwei-Staaten-Lösung könnte sicher helfen, die Grundrechte von Israelis und Palästinensern zu sichern und die Voraussetzungen für eine Versöhnung der verfeindeten Gruppen und für gerechte Verhältnisse in der Region zu schaffen. Caesars "Bellum Civile" ist als Dokument römischer Geschichtsschreibung und als Quellenwerk über den Bürgerkrieg für jeden am antiken Rom Interessierten von außerordentlicher Bedeutung. Dennoch führt er neben dem "Gallischen Krieg" fast ein Schattendasein: zu Unrecht, wie sich erweist. Denn an Klarheit der Diktion und Prägnanz des Gedankens steht der "Bürgerkrieg" diesem nicht nach. Dazu ist der Zweikampf um die Macht zwischen Caesar und Pompeius ein erregender historischer Stoff, selbst dort, wo er weniger objektive Historiographie als eine Rechtfertigung für Caesars (...) Handeln darstellt. Es liegt Caesar daran zu beweisen, dass ihm der Krieg, den er gern vermieden hätte, vom Gegner aufgezwungen wurde und dass er selbst schuldlos daran sei. Wie abenteuerlich in Rom intrigiert wurde, wie Caesar stets edel ist und die anderen üble Rechtsbrecher und Staatsfeinde sind, das lohnt sich auch 2000 Jahre später noch nachzulesen. (shrink)

In this paper I want to reconnect the theoretical debate on the concept of law and the relationship between law and morality with legal issues constituted by highly unjust norms. Proceeding from a critique of more or less emphatic positivist attempts at ethical purification of legal thought, I shall roughly sketch a Davidsonian-Dworkinian framework which seems to provide us with a more appropriate background for dealing with immoral norms than positivist and natural law accounts. This claim will be substantiated by (...) way of an analysis of three different cases: (1) immoral norms of a past system of civil law; (2) immoral norms of a past system of criminal law; (3) immoral norms of the present legal system. Gegen einheitswissenschaftliche Nivellierung sind Grundlagen-, Natur- und Kultur- wissenschaften zu unterscheiden . Zu den Kulturwissenschaften gehören die historisch-hermeneutischen Disziplinen, und zwar als handlungsverstehende Wissenschaften unter erschwerten Bedingungen. Die Geschichtswissenschaft soll die verborgenen Gründe und Zwecke vergangener Handlungen aufklären, die Textwissenschaften in Form problematischer Texte vorliegende Sprachhandlungen. Texte können in verschiedener Hinsicht problematisch sein: für ein Verstehensinteresse an begründeten Behauptungen oder an subjektiver Bekundung . Entsprechend ist hier methodisch zwischen apophantischer und ästhetischer Texthermeneutik zu unterscheiden. Ziel aller historisch-hermeneutischen Fächer sollte kritische (...)
