I would like to assume that Reichenbach's distinction of Justification and Discovery lives on, and to seek arguments in his texts that would justify their relevance in this field. The persuasive force of these arguments transcends the contingent circumstances apart from which their genesis and local transmission cannot be made understandable. I shall begin by characterizing the context distinction as employed by Reichenbach in "Experience and Prediction" to differentiate between epistemology and science (1). Following Thomas Nickles and Kevin T. (...) Kelly, one can distinguish two meanings of the context distinction in Reichenbach's work. One meaning, which is primarily to be found in the earlier writings, conceives of scientific discoveries as potential objects of epistemological justification. The other meaning, typical for the later writings, removes scientific discoveries from the possible domain of epistemology. The genesis of both meanings, which demonstrates the complexity of the relationships obtaining between epistemology and science, can be made understandable by appealing to the historical context (2). Both meanings present Reichenbach with the task of establishing the autonomy of epistemology through the justification of induction. Finally, I shall expound this justification and address some of its elements of rationality characterizing philosophy of science(3). (shrink)

Insoweit das Humesche Induktionsproblem die Frage der Rationalität des induktiven Vorgehens aufwirft, ist es in positiver Weise lösbar. Die Lösung basiert auf der Einsicht, daß es eine fundamentale Form der Induktion gibt, ohne welche Beobachtungen und Experimente überhaupt sinnlos würden, und ein rationales Verfahren zur Bestimmung einer induktiven Voraussetzung existiert, das eine bestimmte Fassung dieser Induktion validiert.

Der Neue Experimentalismus musste sich angesichts seines Gegensatzes zwischen experimentellen Praktiken und grundlegenden Theorien mit dem Problem der Beziehung zwischen der Einmaligkeit der ersteren und der Allgemeinheit der letzteren auseinandersetzen. Andere Autoren (von Charles A. Baylis und Nelson Goodman bis Catherine Elgin) haben das Konzept der Exemplifikation verwendet, um die Beziehung zwischen partikulären und universellen/allgemeinen Begriffen oder Gesetzen zu klären. Es stellt sich jedoch die Frage, ob sie zwar einen Gesichtspunkt andeuten, der neue Aspekte des Problems beleuchten kann, das Problem (...) selbst aber nicht lösen. In diesem Artikel wird auf der Grundlage von Überlegungen, die an anderer Stelle entwickelt wurden, sowie in Anlehnung an eine Anregung von Aristoteles vorgeschlagen, den Begriff der Exemplifikation mit dem Problem der Induktion und der Abduktion zu verknüpfen, die hier als Bezeichnung für eine Vielzahl methodischer Verfahren verstanden werden, die darauf abzielen, eine kognitive Beziehung zwischen der Reproduzierbarkeit wissenschaftlicher Begriffe oder Gesetze und der Konkretheit, der Lokalität und dem situierten Charakter experimenteller Praktiken herzustellen. Eine notwendige Voraussetzung für die Lösung des durch diese Beziehung aufgeworfenen Problems ist die Unterscheidung zwischen zwei Bedeutungen − einer reflexiv-transzendentalen und einer genetisch-methodologischen − des Begriffspaares Entdeckung/Rechtfertigung. Dies wirft gleichzeitig Licht auf das Problem der Induktion sowie auf das Problem des Verhältnisses zwischen der Universalität wissenschaftlicher Gesetze und dem stets lokalen und situierten Charakter experimenteller Praktiken. Der letzte Teil des Artikels zeigt, wie diese Schlussfolgerungen auch für Gedankenexperimente gelten, indem auf John Nortons Auffassung eingegangen wird. (shrink)

Karl Popper's well-known refusal of induction consists of three theses which have to be distinguished clearly: the thesis of deduction, the thesis of rationality, and the thesis of use. Whereas the first thesis is correct, the second thesis is pretty questionable and the third thesis is definitely false. It will be argued that Popper himself does not adhere to the second and third thesis consequently, insofar he thinks that practical induction is legitimate whereas theoretical induction is not. (...) SummaryIn this paper, two different theoretical problems of induction are delineated. The first problem is addressed; the second problem is deferred to the sequel to this paper. The first problem of induction is taken to be the seemingly unformalizable nature of traditional inductive arguments. Das „Problem der Induktion", dessen Formulierung man gewöhnlich David Hume zuschreibt, hat Leibniz schon am Anfang des 18. Jahrhunderts formuliert und gelöst. Die Methode von Leibniz war sowohl „Hume-isch" als auch rationalistisch. Sie begreift in sich eine Herabsetzung des Empirischen und auch den Gebrauch der „Geheimkräfte", die Hume ausschalten wollte. Ohne solche „Geheimkräfte" gibt es keine Harmonie im klassischen Sinn von Leibniz . Für Leibniz ist eine Hypothese vorzuziehen, die eine Harmonie behauptet oder die maximale Verschiedenheit der Phänomene mit (...) der minimalen Kompliziertheit der zugrundeliegenden Regel zusammenfaßt. Hier sind Beispiele von Gesetzen mit „produktiven Mechanismen" oder „Geheimkräften" gegeben, die der Leibnizschen Erklärung in der Physik und der Mathematik entsprechen. Die Schwerkraft entspricht diesen Gesichtspunkten nicht und ist daher unvernünftig im Leibnizschen Sinne; deshalb werden Induktionen über Schwerkraftsysteme als empirische Regeln betrachtet. Die Leibnizsche Theorie zeigt auch, wie man die wohlbekannten Beispiele von Hume erkennen und vorhersagen kann, nämlich aufgrund des richtigen wissenschaftlichen Verständnisses der Natur der Nahrung und des Feuers. Kants Prinzip der zeitlichen Reihenfolge wird zu seinen Ungunsten mit dem sechsten Grundsatz der Leibnizschen Abhandlung über die Metaphysik verglichen. Wir haben nach Leibniz doch einen vernünftigen Zugang zu der Wirklichkeit, die hinter den Empfindungen liegt, und die Verneinung dessen war es, was das empiristische Problem der Induktion erzeugt hat. For the last 30 years there have been debates in philosophy about the concept of rationality. In anglo-american circles they have been primary characterized as discussions about “justified beliefs.” By contrast, the debate in Germany among discourse-theorists (Habermas, Apel) has been linked to the problem of justification of communicative speech-acts (within the concept of the entire communicative situation). Herbert Schnädelbach has modified the discours-theoretical account. His concept can be regarded along a number of dimensions. He has developed a linguistic (...) analysis of the validity claims made in various speech-act situations (following Paul Taylor). In Schnädelbach’s view, normative characterizations of speech acts can be used descriptively, too. Furthermore, the hierarchy of justifications ends on the level of rational choice.My starting point here is: there is a fundamental distinction between justifications in everyday-life and a theoretical level of justification (discoursive justifications). Thus, I discuss the hierarchy of justifications developed by Schnädelbach.Furthermore, I evaluate Schnädelbach’s concept in a semantic perspective. I will show that Schnädelbach’s pragmatical account requires a semantic analysis. Without recourse to such analysis, we cannot understand the universe of normative language. (shrink)

In this paper I offer a coherentist justification of induction along the lines of a Sellarsian coherence theory. On this coherence theory, a proposition is justified if we can answer all objections raised against it in our social practice of demanding justification and responding to such demands. On the basis of this theory of justification, I argue that we are justified in accepting the uniformity of nature partly because we have no alternative but to accept it (...) for rationally pursuing our epistemic goal. In addition, my coherentist view explains which inductive inferences it is rational to accept. Furthermore, my coherentist view also explains why we can hardly determine a particular numerical value x such that we can draw the conclusion ‘it is rational to accept that p’ from the premise ‘the numerical probability of p is greater than or equal to x’. Jin Yuelin (1895?1984), a Chinese logician and philosopher, is greatly influenced by Hume's and Russell's philosophies. How should we respond to Hume's problem of induction? This is an important clue to understand Jin's whole philosophical career. The first section of this paper gives a brief historical review of Russell and Jin. The second section outlines Hume's skeptical arguments against causality and induction. The third section expounds Russell's justification of induction by discussing his views on Hume's skepticism, (...) causality, principle of induction, and empirical postulates. The fourth section clarifies Jin's justification of induction by discussing his critique of Hume's epistemology and his arguments for the reliability of causality and the eternal truth and apriority of the principle of induction. The final section compares Jin's justification of induction with Russell's and concludes that there are similarities and differences between their projects and that both their attempts fail. This paper takes the similar responses to the problem of induction by Jin and Russell to demonstrate the communication that there has been between Chinese philosophers and the Western ones. (shrink)

Zwischen 1987 und 1994 sandte ich 20 Briefe an Karl Popper. Die meisten betrafen Fragen bezüglich seiner Antiinduktionsbeweise und seiner Wahrscheinlichkeitstheorie, einige die organisatorische und inhaltliche Vorbereitung eines Fachgesprächs mit ihm in Kenly am 22. März 1989 (worauf hier nicht eingegangen werden soll), einige schließlich ganz oder in Teilen nicht-fachliche Angelegenheiten (die im vorliegenden Bericht ebenfalls unberücksichtigt bleiben). Von Karl Popper erhielt ich in diesem Zeitraum 10 Briefe. Der bedeutendste ist sein siebter, bestehend aus drei Teilen, geschrieben am 21., 22. (...) und 23. Oktober 1992, in dem er eine Vorform jener Definition der probabilistischen Unabhängigkeit entwickelte, die er 1994 im neuen Anhang *XX der 10. Auflage seiner Logik der Forschung (LdF) der wissenschaftstheoretischen Forschergemeinde vorstellte. Der berührendste ist sein letzter, geschrieben am 26. Juli 1994, in dem er trotz Erschöpfung mit Humor schildert, wie mühselig der Druck des Anhangs *XX verlaufen ist. We show there is only one consistent way to update a probability assignment, that given by Bayes's rule. The price of inconsistent updating is a loss of efficiency. The implications of this for the problem of induction are discussed.

One of the recurrent temptations in theory of knowledge is to try to provide an inductive justification for employing the principles of inductive inference. The purpose of the present paper is to suggest that this approach is misguided by exposing the deficiencies of what appears to be the most carefully constructed attempt of this kind which has thus far been made. I refer to the attempt made by R. B. Braithwaite in his Scientific Explanation.

This article poses a challenge to Schurz’s proposed metainductive justification of induction. It is argued that Schurz’s argument requires a notion of optimality that can deal with an expanding pool of prediction strategies.

I evaluate Schurz's proposed meta-inductive justification of induction, a refinement of Reichenbach's pragmatic justification that rests on results from the machine learning branch of prediction with expert advice. My conclusion is that the argument, suitably explicated, comes remarkably close to its grand aim: an actual justification of induction. This finding, however, is subject to two main qualifications, and still disregards one important challenge. The first qualification concerns the empirical success of induction. Even though, I (...) argue, Schurz's argument does not need to spell out what inductive method actually consists in, it does need to postulate that there is something like the inductive or scientific prediction strategy that has so far been significantly more successful than alternative approaches. The second qualification concerns the difference between having a justification for inductive method and for sticking with induction for now. Schurz's argument can only provide the latter. Finally, the remaining challenge concerns the pool of alternative strategies, and the relevant notion of a meta-inductivist's optimality that features in the analytic step of Schurz's argument. Building on the work done here, I will argue in a follow-up paper that the argument needs a stronger dynamic notion of a meta-inductivist's optimality. (shrink)

This paper discusses recent attempts to solve the problem of induction. Two broad strategies to escape Hume's fork can be distinguished. The first tries to localize the justification of specific inductions in uncontroversial empirical knowledge, e.g.mundane scientific knowledge (J. D. Norton) or perception (M. Lange). I argue that related attempts to (dis)solve the problem fail. The second strategy tries to put forward an argument in favor of induction. As a discussion of work by R. White shows, this (...) argument can barely prove that induction is reliable or at least not unreliable. But D. Steel, F. Huber and G. Schurz could show that enumerative induction is necessary and sufficient for a certain epistemic goal or optimal in a certain sense. These proofs, however, only solve the problem of induction if the goal or a certain standard has priority over the avoidance of error. This suggests that the difficulties to justify induction do not so much derive from Hume's fork, but rather from a plurality of sensible epistemic goals that can conflict with each other. (shrink)

The account of meta-induction (G. Schurz, Hume’s problem solved: the optimality of meta-induction, MIT Press, Cambridge, 2019) proposes a two-step solution to the problem of induction. Step 1 consists in a mathematical a priori justification of the predictive optimality of meta-induction, upon which step 2 builds a meta-inductive a posteriori justification of object-induction based on its superior track record (Sect. 1). Sterkenburg (Br J Philos Sci, forthcoming. 10.1086/717068/) challenged this account by arguing that (...) meta-induction can only provide a (non-circular) justification of inductive predictions for now and for the next future, but not a justification of inductive generalizations (Sect. 2). This paper develops a meta-inductive method that does provide an a posteriori justification of inductive generalizations, in the form of exchangeability conditions (Sect. 3). In Sect. 4, a limitation of the proposed method is worked out: while the method can justify weakly lawlike generalizations, the justification of strongly lawlike generalizations (claimed to hold for all eternity) requires epistemic principles going beyond meta-induction based on predictive success. In 1947 Donald Cary Williams claimed in The Ground of Induction to have solved the Humean problem of induction, by means of an adaptation of reasoning first advanced by Bernoulli in 1713. Later on David Stove defended and improved upon Williams’ argument in The Rational- ity of Induction (1986). We call this proposed solution of induction the ‘Williams-Stove sampling thesis’. There has been no lack of objections raised to the sampling thesis, and it has not been (...) widely accepted. In our opinion, though, none of these objections has the slightest force, and, moreover, the sampling thesis is undoubtedly true. What we will argue in this paper is that one particular objection that has been raised on numerous occasions is misguided. This concerns the randomness of the sample on which the inductive extrapolation is based. (shrink)

In his monograph on the Vienna Circle Kraft writes that “one of the earliest and most fundamental insights of the Vienna Circle” was “that no deductive or logical justification of induction is at all possible”. In Logik der Forschung Popper developed his philosophical conception starting from a very emphatic critique of logical positivism and its alleged essential feature inductivism. Although Kraft’s assessment is essentially correct, as the present paper intends to show, Popper’s opinion prevailed and came to dominate (...) philosophical handbooks for decades. However, it must be admitted that the Vienna Circle attitude towards induction might have been misleading, and in a sense invite misunderstandings. Whilst the members of the Schlick-Kreis clearly recognized the impossibility of any logical justification of induction, some of them believed that induction was a part and parcel of scientific conduct and instead of denying its existence they tried to change its epistemological status. The aim of this paper is twofold. Firstly, it is to display this evasive policy—namely, how to keep induction rationally, nevertheless without justification. Secondly, it is to demonstrate that Popper’s criticism of the 1930s was already by then an anachronism. (shrink)

Il problema apparentemente insolubile di una giustificazione non circolare dell’induzione diverrebbe più abbordabile se invece di chiederci solo cosa ci assicura che un fenomeno osservato si riprodurrà in modo uguale in un numero potenzialmente infinito di casi futuri, ci chiedessimo anche come si spiega che esso si sia manifestato fin qui in modo identico e senza eccezioni in un numero di casi finito ma assai alto. E’ questa l’idea della giustificazione abduttiva dell’induzione, avanzata in forme diverse da Armstrong, Foster e (...) BonJour: serie talmente regolari di fenomeni sono da un punto di vista logico talmente improbabili che se il mondo fosse puramente casuale (se cioè gli eventi si presentassero con frequenza proporzionale alla loro probabilità logica) esse non potrebbero verificarsi se non per una coincidenza miracolosa. Pertanto, tali regolarità si spiegano solo assumendo che siano prodotte da meccanismi o necessità nomiche; ma se questo è il caso, è corretto concludere che tali regolarità persisteranno anche in futuro senza eccezioni, e dunque le inferenze induttive su di esse sono giustificate. Anche Kornblith argomenta dall’effettivo successo delle inferenze induttive all’esistenza di regolarità oggettive in natura; mentre Sankey parte dall’ uniformità della natura per giustificare l’induzione. Congiungendo le due argomentazioni, dunque, si ottiene di nuovo una giustificazione dell’induzione in base all’argomento del “se non è un miracolo …”. Un ostacolo su questa via è specificare in che senso la natura sia uniforme (dato che ovviamente non lo è in ogni suo aspetto) e di quali regolarità possiamo aspettarci che persistano senza eccezione anche in futuro (dato che evidentemente non tutte lo fanno: l’acqua non bolle sempre a 100°, la pressione non è sempre funzione della temperatura, e così via). Entrano qui in gioco le conoscenze di sfondo e la ripetizione delle osservazioni in condizioni diverse, che ci mostrano quali circostanze siano rilevanti al verificarsi del fenomeno dato. In tal modo, le nostre descrizioni delle regolarità naturali convergono su descrizioni che specificano sia le condizioni individualmente necessarie e congiuntamente sufficienti, sia tutti gli argomenti delle funzioni che costituiscono tali regolarità. Ciò consente di formulare i principi di Uniformità della Natura e di Induzione in modo non generico (e dunque, a seconda della formulazione, vuoto o eccessivo), ma circostanziato: così essi asseriscono, rispettivamente, che la natura è uniforme negli aspetti evidenziati dalle descrizioni su cui convergiamo grazie alle osservazioni ripetute, e che solo queste descrizioni possono essere induttivamente generalizzate. Ciò consente anche di risolvere enigmi alla Goodman, quali: poiché le osservazioni ci hanno mostrato (solo) il verificarsi di una data regolarità fino al momento presente t, come possiamo presumere che essa si verificherà anche dopo t? La risposta è che osservazioni e conoscenza di sfondo non ci dicono che vi sia alcun limite temporale tra le condizioni necessarie della regolarità data. (shrink)

Human dignity consists of freedom. Yet freedom simultaneously means both autonomy and heteronomy, being an absolute and relation. As an absolute a human is in the realm of being , and as relative in the realm of having . Without "alterity" or "otherness" there is no having. The following aspects of social life must be distinguished: social transcendentals, categories, institutions and groups. The state , for example, cannot be equated with politics . Of the categories , the former are conditions, (...) the latter guiding instances. In the absence of a logical interplay between these conditions and guiding instances, one abides in abstraction. The interplay, the relation between them, is not random. Today economy has become a guiding instance. This attempt can never be finally consummated. Without private property, production is impossible. But private property needs to be universalized, justified and thus requires law. Law is always intrinsically pre-positive, but just as the economy cannot be realized without law, law cannot be enforced without politics. Politics determines law; however without a political element, law remains, although real, nevertheless powerless, impractical. Justification, of which political decisions are also in need, is post-positive law. In relation to law, a purely rational foundation for legislation is insufficient and thus impractical. Consequently there is a) pre-positive law as universally recognized by society; b) positive law as established by the political instances; c) post-positive law as the sphere from which politicians justify their legislation. This differentiation is necessary to illuminate the specific duality of conditions and guiding instances. A politician never simply acts on mandate or as proxy for the general will of the people. Post-positive law thus always involves a certain ethical position as a criterion for decision-making. Yet religion is that instance which imparts final practicability, effective force to ethics. In short, no social sub-system can exercise total or despotic power over the others. Any mistake in this respect makes the entire social stratum abstracter and less constituted. Die Würde des Menschen besteht in seiner Freiheit; Freiheit aber bedeutet gleichermaßen Autonomie und Heteronomie, zugleich absolut und Verhältnis sein. Bei den Kategorien sind die ersteren Bedingungen, die letzteren sind Leitinstanzen. Ohne diese Logik der Bedingungen und Leitinstanzen bleibt nur das Verharren in der Abstraktion. Das Spiel, das Verhältnis zwischen den einen und den anderen ist nicht beliebig. Heute ist Wirtschaft Leitinstanz. Dieser Versuch kann nie endgültig gelingen. Ohne Privateigentum ist kein Erwirtschaften möglich. Jenes bedarf aber einer Verallgemeinerung, einer Rechtfertigung und fordert damit die Präsenz des Rechts. Das Recht ist immer wesentlich vorpositiv, aber genau wie die Wirtschaft ohne das Recht nicht realisierbar ist, ist das Recht ohne Politik auch nicht vollstreckbar. Die Politik setzt das Recht; ohne ein politisches Element jedoch bleibt das Recht zwar reell, aber machtlos, unpraktisch. Die Rechtfertigung, der auch die politische Entscheidung bedarf, ist nach-positives Recht. In bezug auf das Recht ist eine reine Vernunftbegründung des Gesetzes unzulänglich und deshalb unpraktisch. Kurz: es gibt a) vor-positives Recht als das von der Gesellschaft allgemein anerkanntes Recht; b) positives Recht als das von der politischen Instanz gesetztes Recht; c) nach-positives Recht als die Sphäre aus der die Politiker die Begründung ihrer Gesetzgebung schöpfen. Diese Unterscheidung ist notwendig, um die spezifische Dualität von Bedingungen und Leitungsinstanzen besser ans Licht zu bringen. Der Politiker ist nie ein reiner Mandatar oder Bevollmächtigter des allgemeinen Volkswillens. Im nach-positiven Recht ist daher das Entscheidungskriterium immer eine gewisse ethische Position. Die Religion ist jedoch diejenige Instanz, die der Ethik letzte Praktizität, effektive Gewalt, verleiht. Kurz gesagt: kein gesellschaftliches Subsystem kann über die anderen total oder despotisch verfügen. Ein Irrtum diesbezüglich macht das ganze soziale Gefüge abstrakter, unkonstituierter. (shrink)

English summary: The freedom potential of modern societies, above all the justification of political authority, is today linked to a democratically constituted order. What is meant by the idea of being democratic seems, however, to be anything but clear. Is it only a question of representing the people through elections, ballots, and political parties, or does it include institutional culture, the division of powers, and the legal regime within a community? A "philosophy of the republic," as developed in this (...) volume's contributions, shows that the current "dominance of the democratic" falls short of accounting for the independent significance to the republican self-organisation of state and society. Weshalb betrifft die Rechtfertigungslehre keinen Einzel-Locus, sondern das Ganze der Theologie?Die Antwort darauf ergibt sich im Aufweis der ontologischen Bedeutung der Rechtfertigung: Ausgehend von Luthers berühmter Formulierung im Kleinen Katechismus »ohn all mein Verdienst und Würdigkeit« wird eine theologisch verantwortete wie philosophisch diskutable Ontologie der Zusage und Gabe vorgestellt.In seinem ungeschuldeten Kommen zur Welt zerbricht Gott jedes “do ut des”. Er gibt sich ganz und gar unverdient und handelt in dieser Logik der kategorischen Gabe para-dox – als der, der (...) »die Toten lebendig macht und das, was nicht ist, ruft, dass es sei« . Dieses Verständnis der creatio ex nihilo ermöglicht es, Schöpfung als Rechtfertigung und Rechtfertigung als Schöpfung wahrzunehmen. Nicht nur das Sein des Menschen besteht darin, allein aus Glauben gerechtfertigt zu sein . Vielmehr gilt nicht nur anthropologisch, sondern schöpfungstheologisch und ontologisch umfasssend und durchdringend: mundum iustificari fide.In seiner Identitätssuche verfängt und verkrümmt der Mensch sich jedoch in sich selbst: Er will selbst sein. Diese Ontologie des Selbstseins ist eine Ontologie der Selbstrechtfertigung. Zwischen dieser und der kategorischen Gabe kommt es zum Streit der Rechtfertigungen – in der Dimension der eigenen Lebensgeschichte, der Dimension der Weltgeschichte und der Dimension der Naturgeschichte. Mein Beitrag untersucht die folgende Fragestellung: „Kann S gerechtfertigt sein, X zu tun, wobei es erlaubt ist, X zu tun, wenn die Bedingungen B vorliegen, wenn S fälschlich, aber vernünftigerweise glaubt, dass die Bedingungen B vorliegen?“ Ich plädiere für eine Bejahung dieser Frage, und zwar im Gegensatz zu der von Joachim Hruschka in seinem Aufsatz „Justifications and Excuses: A Sy-stematic Approach“ vertretenen Posi-tion. Ich bin der Auffassung, daß eine Rechtfertigung eine vernünftige Annahme voraussetzt; es ist nicht notwendig, daß diese (...) Annahme auch zutrifft. Dass S vernünftigerweise glaubt, daß p, während in Wirklichkeit p nicht vorliegt, scheint jedenfalls kein entschuldigender Umstand zu sein. Diese Situation ist vielmehr wesentlich unterschieden von krankheitsbedingter Zurechnungsunfähigkeit oder sonst verminderter geistiger Fähigkeit. Es ist daher wichtig, zwischen zwei Arten von Gründen zu unterscheiden, die dazu führen, daß eine Person nicht verantwortlich gemacht wird für X, obwohl sie X getan hat; und zwar sind dies einerseits Gründe, die im Hinblick auf Probleme der handelnden Person selbst entschuldigend wirken, und andererseits solche Gründe, die weder einen Mangel noch Verwirrung der handelnden Person selbst reflektieren, noch einen Fehler in dem Entscheidungsprozeß, der zu der Handlung geführt hat. My essay addresses the following question: "Can S be justified in doing X, where it is permissible to do X when conditions C obtain, if S mistakenly but reasonably believes that conditions C do obtain?" I defend an affirmative reply, contrary to the position taken by Prof. Hruschka in his "Justifications and Excuses: A Systematic Approach" . I understand justification as requiring reasonable belief; it is not necessary that the belief be true. That S believes on reasonable grounds that p when in fact p is false seems not to be an excusing condition. It is importantly different from insanity, or diminished capacity. I stress the importance of differentiating between two very different kinds of reasons for holding someone not to be culpable for X despite having done X, viz, reasons that exculpate due to problems with the agent himself and those that do not reflect any deficiency or disorder in the agent, or any flaw in the process by which she chose as she did.
