Resumo: A atuação do tradutor e intérprete de língua de sinais no contexto educacional inclusivo é tema de constantes embates teóricos acerca da concepção de seu ‘papel’. Desse modo, verificam-se prescrições que delimitam suas práticas e atribuições pela caracterização de uma pretensa ‘identidade’ profissional. Na contramão disso, esse estudo tenciona um adensamento analítico acerca daquilo que é produzido na atividade interpretativo-pedagógica do intérprete educacional, fora do âmbito da ‘identidade profissional’, mas no âmbito das efetivas ações produzidas pela posição e contextos (...) de ensino, assumidos na prática cotidiana. Assim, entende-se que essa função interpretativa se constitui na lógica da ‘diferença’, pela ativação relacional e pedagógica com o sujeito surdo no contexto escolar. A tese empreendida é a de que a função pedagógica do intérprete educacional é estabelecida como efeito do ato educativo. Nosso foco se dará na análise do aprender surdo e sua co-construção de conhecimento, produzidos com e pelos signos emitidos pelo intérprete educacional como efeito do acontecimento educativo. Portanto, cabe neste artigo, analisar o movimento conceitual da posição-mestre a partir dos estudos da hermenêutica do sujeito, em Michel Foucault, sendo ela articuladora da função interpretativo-pedagógica do intérprete educacional que se materializa no e pelo contexto de ensino. The role of the educational interpreter and deaf learning: an analysis of the master position in the educational relationship in an inclusive classroom Abstract: Sign language translators and interpreter’s part within inclusive education constantly rises theoretical debates about the conception of their 'role'. Thus, we commonly see prescriptions that delimit their practices and attributions by characterizing a supposed professional "identity". Nevertheless, this study aims to analyze what is produced in the interpretive-pedagogical activity of the educational interpreter, beyond the scope of 'professional identity', and within the effective actions produced by the position and context assumed on a daily basis. Thus, we understand that this interpretative function is constituted in the logic of 'difference', by relational and pedagogical activation with the deaf subject in the school context. The thesis undertaken is that the pedagogical function of the educational interpreter is established as an effect of the educational act. We focus on the analysis of deaf learning and its co-construction of knowledge, produced with and by the signs emitted by the educational interpreter as an effect of the educational event. Therefore, this article analyzes the conceptual movement of the master position from the studies of the hermeneutics of the subject, in Michel Foucault, assuming it as an articulator of the interpretative-pedagogical function of the educational interpreter that materializes in and through the teaching context. __Neurotechnology and Direct Brain Communication__ focuses on recent neuroscientific investigations of infant brains and of patients with disorders of consciousness, both of which are at the forefront of contemporary neuroscience. The prospective use of neurotechnology to access mental states in these subjects, including neuroimaging, brain simulation and brain computer interfaces, offers new opportunities for clinicians and researchers, but has also received specific attention from philosophical, scientific, ethical and legal points of view. This book offers the first systematic assessment of these (...) issues, investigating the tools neurotechnology offers to care for verbally non-communicative subjects and suggesting a multidisciplinary approach to the ethical and legal implications of ordinary and experimental practices. The book is divided into three parts: the first and second focus on the scientific and clinical implications of neurological tools for DOC patient and infant care. With reference to these developments, the third and final part presents the case for re-evaluating classical ethical and legal concepts, such as authority, informed consent and privacy. Neurotechnology and Direct Brain Communication will appeal to researchers and postgraduate students in the fields of cognitive science, medical ethics, medical technology, and the philosophy of the mind. For the past two decades, Einstein's Hole Argument (which deals with the apparent indeterminateness of general relativity due to the general covariance of the field equations) and its resolution in terms of "Leibniz equivalence" (the statement that pseudo-Riemannian geometries related by active diffeomorphisms represent the same physical solution) have been the starting point for a lively philosophical debate on the objectivity of the point-events of space-time. It seems that Leibniz equivalence makes it impossible to consider the points of the space-time (...) manifold as physically individuated without recourse to dynamical individuating fields. Various authors have posited that the metric field itself can be used in this way , but nobody so far has considered the problem of explicitly distilling the "metrical fingerprint" of point-events from the gauge-dependent elements of the metric field. Working in the Hamiltonian formulation of general relativity, and building on the results of Lusanna and Pauri (2002), we show how Bergmann and Komar's "intrinsic pseudo-coordinates" (based on the value of curvature invariants) can be used to provide a physical individuation of point-events in terms of the true degrees of freedom (the "Dirac observables") of the gravitational field, and we suggest how this conceptual individuation could in principle be implemented with a well-defined empirical procedure. We argue from these results that point-events retain a significant kind of physical objectivity. (shrink)

We argue that in extensive decision problems (extensive games with a single player) with imperfect recall care must be taken in interpreting information sets and strategies. Alternative interpretations allow for different kinds of analysis. We address the following issues: 1. randomization at information sets; 2. consistent beliefs; 3. time consistency of optimal plans; 4. the multiselves approach to decision making. This paper addresses a largely neglected question in ongoing debates over disagreement: what is the relation, if any, between disagreements involving credences and disagreements involving outright beliefs? The first part of the paper offers some desiderata for an adequate account of credal and full disagreement. The second part of the paper argues that both phenomena can be subsumed under a schematic definition which goes as follows: A and B disagree if and only if the accuracy conditions of A's doxastic attitude (...) are such that, if they were fulfilled, this would ipso facto make B's doxastic attitude inaccurate, or vice-versa. The pluralist sheds the more traditional ideas of truth and ontology. This is dangerous, because it threatens instability of the theory. To lend stability to his philosophy, the pluralist trades truth and ontology for rigour and other ‘fixtures’. Fixtures are the steady goal posts. They are the parts of a theory that stay fixed across a pair of theories, and allow us to make translations and comparisons. They can ultimately be moved, but we tend to keep them fixed temporarily. Apart (...) from considering rigour of proof as a fixture, I discuss fixed models, invariant notions and fixed information about objects across theories. Most scientific theories are globally inconsistent. Chunk and Permeate is a method of rational reconstruction that can be used to separate, and identify, locally consistent chunks of reasoning or explanation. This then allows us to justify reasoning in a globally inconsistent theory. We extend chunk and permeate by adding a visually transparent way of guiding the individuation of chunks and deciding on what information permeates from one chunk to the next. The visual representation is in the form of bundle diagrams. (...) We then extend the bundle diagrams to include not only reasoning in the presence of inconsistent information or reasoning in the logical sense of deriving a conclusion from premises, but more generally reasoning in the sense of trying to understand a phenomenon in science. This extends the use of the bundle diagrams in terms of the base space and the fibres. We then apply this to a case in physics, that of understanding binding energies in the nucleus of an atom using together inconsistent models: the liquid drop model and the shell model. We draw some philosophical conclusions concerning scientific reasoning, paraconsistent reasoning, the role of logic in science and the unity of science. (shrink)

L’articolo ricostruisce la genealogia del concetto di ideologia nei Quaderni del carcere di Antonio Gramsci, mostrando come esso sia centrale nell’elaborazione del marxista sardo e come sia funzionale a una lettura materialista ma non riduzionista dei fenomeni “sovrastrutturali”. L’ideologia viene analizzata attraverso la costellazione concettuale di cui fa parte, insieme ai concetti di blocco storico, senso comune, religione, scienza e filosofia. All’interno di questo quadro emerge un concetto di ideologia peculiare ed “eterodosso” per un marxista della prima metà del XX (...) secolo, che anticipa teorizzazioni successive e acquisizioni scientifiche in altri campi del sapere. La teoria dell’ideologia in Gramsci, per come è qui ricostruita, rappresenta la premessa necessaria alla sua teoria dell’egemonia. (shrink)

The concept of cultural capital has been increasingly used in American sociology to study the impact of cultural reproduction on social reproduction. However, much confusion surrounds this concept. In this essay, we disentangle Bourdieu and Passeron's original work on cultural capital, specifying the theoretical roles cultural capital plays in their model, and the various types of high status signals they are concerned with. We expand on their work by proposing a new definition of cultural capital which focuses on cultural and (...) social exclusion. We note a number of theoretical ambiguities and gaps in the original model, as well as specific methodological problems. In the second section, we shift our attention to the American literature on cultural capital. We discuss its assumptions and compare it with the original work. We also propose a research agenda which focuses on social and cultural selection and decouples cultural capital from the French context in which it was originally conceived to take into consideration the distinctive features of American culture. This agenda consists in 1) assessing the relevance of the concept of legitimate culture in the U.S.; 2) documenting the distinctive American repertoire of high status cultural signals; and 3) analyzing how cultural capital is turned into profits in America. The intriguing issue of pain and suffering in patients with disorders of consciousness (DOCs), particularly in Unresponsive Wakefulness Syndrome/Vegetative State (UWS/VS) and Minimally Conscious State (MCS), is assessed from a theoretical point of view, through an overview of recent neuroscientific literature, in order to sketch an ethical analysis. In conclusion, from a legal and ethical point of view, formal guidelines and a situationist ethics are proposed in order to best manage the critical scientific uncertainty about pain and suffering in DOCs (...) and ensure the best possible care for the patient. Leandra Medine indicates that she wants the Man Repeller multi-author blog to ‘serve as an open forum for women to draw their own conclusions’ instead of making ‘any sort of feministic statement’. Medine renders feminism as amorphous and an individual choice but she has been widely lauded for offering a feminist engagement in fashion. Her practices and position, as I argue throughout this article, allow her to fashion feminism, including associating feminism with the man repeller style and replacing aspects of (...) second wave and rights-based feminisms with the purportedly more equitable and liberating website ethos of choice and equality feminism. Yet in replacing ‘feministic’ critiques with promises of stylish cultural change and clothing that reportedly repels men, Medine and other Man Repeller authors elide how systemic oppression functions. This ambivalent relationship to feminism, and dearth of intersectional advocacy, prompted a backlash in 2020. Critics interrogated Medine's facile statement about #BlackLivesMatter, the company's lack of diversity and the unsuccessful restructuring of the blog. As a means of analysing Man Repeller, I employ textual analysis, feminist and queer literature and media theory. I define fashioning feminism as a collaborative and ongoing process of producing feminist positions and thinking, including the negation of certain forms of feminism. I assert that attending to the fashioning of feminism can foreground central and developing feminist theories; the appeal, unstylishness and effacement of feminism; and the connection between style and politics. This includes readers’ interrogations of Man Repeller's politics, which are occurring along with contemporary examinations of racism. Since fashioning feminism is a collaborative and ongoing process of producing feminist positions and thought, engaging with its concepts and debates can further the critical study of feminism, nurture feminist conversations and advocate for social change. In this paper, I argue that Husserl offers an important, although almost completely neglected so far, contribution to the reductionist/antireductionist debate about testimony. Through a phenomenological analysis, Husserl shows that testimony works through the constitution of an intentional intersubjective bond between the speaker and the hearer. In this paper I focus on the Logical Investigations, a 1914 manuscript now published as text 2 in Husserliana 20.2, and a 1931 manuscript now published as Appendix 12 in Husserliana 15. I argue that, (...) in those texts, Husserl highlights three essential phenomenological features of testimony: a) testimony is personal, meaning that it only takes place among persons, b) testimony is social, meaning that it requires the joint effort of multiple cognitive agents, c) testimony is community-building, meaning that it generates a long-lasting social bond among the parts involved. Tradition has it that first-person thought is somehow special. It is also commonplace to maintain that the first-person concept obeys a rule of reference to the effect that any token first-person thought is about the thinker of that thought. Following Annalisa Coliva and, more recently, Santiago Echeverri, I take the specialness claim to be the claim that thinking a first-person thought comes with a certain guarantee of its pattern of reference. Echeverri maintains that such a guarantee is explained by a (...) fairly flatfooted interpretation of the thinker-reflexive rule. I argue, however, that the explanatory aspirations of the thinker-reflexive rule are fulfilled only if we accept an epistemically loaded gloss on the notion of a thinker of a thought featuring the rule. That gloss is unpacked in terms of the subject’s ability to be acquainted with the phenomenal character of their thoughts. (shrink)

Marginal structural models can be used to estimate the causal effect of a potentially time-varying treatment in the presence of time-dependent confounding via weighted regression. The standard approach of using inverse probability of treatment weighting can be sensitive to model misspecification and lead to high-variance estimates due to extreme weights. Various methods have been proposed to partially address this, including covariate balancing propensity score to mitigate treatment model misspecification, and truncation and stabilized-IPTW to temper extreme weights. In this article, we (...) present kernel optimal weighting, a convex-optimization-based approach that finds weights for fitting the MSMs that flexibly balance time-dependent confounders while simultaneously penalizing extreme weights, directly addressing the above limitations. We further extend KOW to control for informative censoring. We evaluate the performance of KOW in a simulation study, comparing it with IPTW, sIPTW, and CBPS. We demonstrate the use of KOW in studying the effect of treatment initiation on time-to-death among people living with human immunodeficiency virus and the effect of negative advertising on elections in the United States. Prenatal screening can significantly benefit parents and the community. However, it has created a dilemma for women as it requires them to quickly decide whether to continue a pregnancy or terminate it should the test indicate a foetal abnormality. This can be psychologically traumatic for women torn between their connection to an unborn child with all its possible imperfections, and a desire to prevent its suffering as a disabled child in later life. A woman must also consider her own and (...) her family's future welfare. Extensive research into the physical aspects of prenatal screening has not explored the meaning of the experience for women or whether termination is the most appropriate option. This article examines recent qualitative studies, concluding that women who terminate a pregnancy following prenatal screening may experience an acute grief reaction or be plagued by guilt and fear that can precipitate marital breakdown. Additionally, there is a risk that through striving to eradicate congenital disability, a community risks promoting a cult of perfectionism that may have discriminatory effects on disabled people. This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

Trust and monitoring are traditionally antithetical concepts. Describing trust as a property of a relationship of reliance, we introduce a theory of trust and monitoring, which uses mathematical models based on two classes of functions, including _q_-exponentials, and relates the levels of trust to the costs of monitoring. As opposed to several accounts of trust that attempt to identify the special ingredient of reliance and trust relationships, our theory characterizes trust as a quantitative property of certain relations of reliance that (...) can be quantified and expressed as a scalar quantity. Our theory is applicable to both human–human and human–artificial agent interactions, as it is agnostic with respect to the concrete realization of trustworthiness properties, and is compatible with many views differing on which properties contribute to trust and trustworthiness. Finally, as our mathematical models make the quantitative features of trust measurable, they provide empirical studies on trust with a rigorous methodology for its measurement. (shrink)

Here, we provide an ethical analysis of discrimination in private insurance to guide the application of non-discriminatory algorithms for risk prediction in the insurance context. This addresses the need for ethical guidance of data-science experts, business managers, and regulators, proposing a framework of moral reasoning behind the choice of fairness goals for prediction-based decisions in the insurance domain. The reference to private insurance as a business practice is essential in our approach, because the consequences of discrimination and predictive inaccuracy in (...) underwriting are different from those of using predictive algorithms in other sectors. Here we focus on the trade-off in the extent to which one can pursue indirect non-discrimination versus predictive accuracy. The moral assessment of this trade-off is related to the context of application—to the consequences of inaccurate risk predictions in the insurance domain. (shrink)

In 2003, the South Carolina Supreme Court upheld the conviction of Regina McKnight, an African American woman who was convicted at the age of twenty‐two for committing “homicide by child abuse.” She became the first woman in the United States to be arrested, prosecuted, and convicted for experiencing a stillbirth. Rather than an outlier case in the annals of American jurisprudence that stretched law beyond reason while restraining compassion and justice, McKnight's conviction inspired similar prosecutions of other poor black women (...) and then of other women. More than one‐third of states consider pregnant women's illicit drug use a form of child abuse, resulting in unprecedented forms of criminal and civil punishment. Laws previously understood to protect pregnant women from domestic violence during pregnancy, such as fetal protection laws, now serve as the vehicles for prosecuting pregnant women. What these prosecutions and laws expose are the multitudinous ways in which the criminalization of poor pregnant women—and normalization of that criminalization, such that even doctors and nurses are expected to participate in it—serve to humiliate women, interfere with their reproductive health, and ultimately rob women of reproductive autonomy. Ethical reflection on Artificial Intelligence (AI) has become a priority. In this article, we propose a methodological model for a comprehensive ethical analysis of some uses of AI, notably as a replacement of human actors in specific activities. We emphasize the need for conceptual clarification of relevant key terms (e.g., intelligence) in order to undertake such reflection. Against that background, we distinguish two levels of ethical analysis, one practical and one theoretical. Focusing on the state of AI at present, we (...) suggest that regardless of the presence of intelligence, the lack of morally relevant features calls for caution when considering the role of AI in some specific human activities. In the literature, there have been several methods and definitions for working out whether two theories are “equivalent” or not. In this article, we do something subtler. We provide a means to measure distances between formal theories. We introduce two natural notions for such distances. The first one is that of axiomatic distance, but we argue that it might be of limited interest. The more interesting and widely applicable notion is that of conceptual distance which measures the minimum number of (...) concepts that distinguish two theories. For instance, we use conceptual distance to show that relativistic and classical kinematics are distinguished by one concept only. (shrink)

The article addresses the definition of the State as an institution that holds the monopoly of the legitimate use of force/violence. It is divided into three parts: the first one discusses some chief scholarly contributions on the topic. The second focuses on Weber’s use of “monopoly” within his work, with the aim of showing that the expression “monopoly of the legitimate use of force/violence” can be better understood if conceived and explained within the much wider employment of this term. The (...) third part analyses the expression “monopoly of the legitimate use of violence ” in Weber’s Intermediate Reflections. Religious Rejections of the World and Their Directions. Ethical medical decision-making for a child is generally navigated with various standards and models that have been developed to address its complexities. A case is presented of the parents’ refusal of a surgical procedure for their child considered by medical providers as essential and potentially lifesaving, along with the ethical debate of whether the parents’ decision was in the child’s best interest and whether their refusal reached a threshold to report and seek state intervention. Utilizing the best interest standard and (...) additional ethical decision-making tools, the ethicists helped the medical team accept the parents’ decision as reasonable, thus avoiding involvement with Child Protective Services. It is my goal to clarify the parents’ decision as reasonable and as honoring their child’s best interests and inherent dignity through the lens of Catholic anthropological and moral principles. These strengthen the ethical and moral arguments for the parents’ decision and the opposition to state intervention. (shrink)

Norman Daniels argues that health is important for justice because it affects the distribution of opportunities. He claims that a just society should guarantee fair opportunities by promoting and restoring the “normal functioning” of its citizens, that is, their health. The scope of citizens' mutual obligations with respect to health is defined by a reasonable agreement that, according to Daniels, should be based on the distinction between normal functioning and pathology drawn by the biomedical sciences. This paper deals with the (...) question whether it is legitimate to ascribe the responsibility of defining this important moral boundary to the biomedical sciences, which Daniels regards as value neutral. Daniels appeals to Christopher Boorse's sophisticated bio-statistical theory (BST) to show the plausibility of a value-neutral distinction between normal functioning and pathology. Here I argue that a careful analysis of the concept of normal functioning, such as the one offered by the recent critique by Elselijn Kingma, shows that it depends from evaluative assumptions. This, I argue, implies that Daniels's theory must give up its naturalistic commitments. In the conclusion, the paper offers a detailed discussion and an objection to one of Daniels's arguments in favor of a moderate form of normativism that remains too close to Boorse's naturalism.
