In this article, the author aims to demonstrate how Agamben’s concept of Homo Sacer is ideally epitomized by a soldier in war. A soldier in war holds a peculiar position, as killing of soldiers is considered neither illegal by laws nor immoral by ethics, and so a soldier is not considered to be legally or morally “guilty” in the usual sense of the word if he or she kills another soldier in war. The author analyzes the notion of Homo (...) Sacer – a figure representing a human that can be killed without the killer being punished, but at the same time someone who cannot be sacrificed – and further demonstrates that a soldier in war can be said to hold precisely such a status. The reason why a soldier cannot be sacrificed resides in the fact that he has already been “sacrificed to war” by his own society, in exchange for the safety of all other members of society. Perceiving a soldier as Homo Sacer provides a novel explanation and an additional argument for the moral symmetry of combatants, one of the pillars of non-revisionist Just War Theory, as all soldiers can be understood as persons sacrificed by their own societies. This collection is a unique joint venture of teachers in, and practitioners of military ethics.

This article describes the progress and impact of the King’s College London Centre for Military Ethics since its collaboration with the Colombian military forces’ educational institutions. More specifically, the article focusses on expanding the military ethics course across different educational facilities of the Colombian Army and the Colombian Navy and Air Force. The impact of the education delivered using an online course designed to be completed without a tutor is analysed and presented. This essay introduces this special issue on virtue ethics in relation to military AI. It describes the current situation of military AI ethics as following that of AI ethics in general, caught between consequentialism and deontology. Virtue ethics serves as an alternative that can address some of the weaknesses of these dominant forms of ethics. In order to maximize human performance, defence forces continue to explore, develop, and apply human performance enhancement (HPE) methods, ranging from pharmaceuticals to (bio)technological enhancement. This raises ethical, legal, and societal concerns and requires organizing a careful reflection and deliberation process, with relevant stakeholders. We discuss a range of ethical, legal, and societal aspects (ELSA), which people involved in the development and deployment of HPE can use for such reflection and deliberation. A realistic military scenario with proposed HPE application (...) can serve as a starting point for such an iterative and participatory process. Stakeholders can discuss this application, modify its features, and design appropriate processes around it – for instance, procedures for informed consent. We propose that organizing aspects into these three categories – ethical, legal, and societal – can help involve appropriate interlocutors at different moments: legal aspects with people in strategy or management roles, from the start of a project; ethical aspects with people in operations and medical roles, during development; and societal aspects with people in communication and personnel roles, during deployment. Asa Kasher and Amos Yadlin’s article is a penetrating and well argued presentation of the Israeli perspective on the military ethics of terror. It does not claim to be official Israeli policy. Yet, its philosophic theoretical exposition is evident in the Israeli practice of fighting terror. On this basis it is a practical guide to action inspired by a lucid, coherent and compelling theoretical argumentation.

Recent developments such as the 'new wars' or the growing privatisation of warfare, and the ever more sophisticated military technology, present the military with difficult ethical challenges. This book offers a selection of the best scholarly articles on military ethics published in recent decades. This book examines the role of military virtues in today's armed forces. -/- Although long-established military virtues, such as honor, courage and loyalty, are what most armed forces today still use as guiding principles in an effort to enhance the moral behavior of soldiers, much depends on whether the military virtues adhered to by these militaries suit a particular mission or military operation. Clearly, the beneficiaries of these military virtues are the soldiers themselves, fellow-soldiers, and (...) military organizations, yet there is little that regulates the behavior of soldiers towards civilian populations. As a result, troops trained for combat in today's missions sometimes experience difficulty in adjusting to the less aggressive ways of working needed to win the hearts and minds of local populations after major combat is over. It can be argued that today's missions call for virtues that are more inclusive than the traditional ones, which are mainly about enhancing military effectiveness, but a convincing case can be made that a lot can already be won by interpreting these traditional virtues in different ways. -/- This volume offers an integrated approach to the main traditional virtues, exploring their possible relevance and proposing new ways of interpretation that are more in line with the military tasks of the 21st century. -/- The book will be of much interest to students of military ethics, philosophy, and war and conflict in general. This paper explores the topic of military ethics, what we mean by that term, what it covers, how it is understood, and how it is taught. It suggests that the unifying factor that makes this a coherent subject beyond individual national interpretations of it is the core idea of military professionalism. The paper draws out the distinction between training and education and draws on research conducted by a number of different people and agencies, including the International Committee (...) of the Red Cross, to establish what factors contribute to effective pedagogy and the inculcation of appropriate attitudes and behaviours. The paper concludes by looking at the way military ethics contributes to military outcomes from protecting civilians and the vulnerable to building resilience in our own military personnel to protect their mental health, through to the strategic costs of losing the moral high ground if behaviour is seen to fall short of that expected from military professionals. ABSTRACTIn this article, I examine the extent to which military officers are morally responsible for the actions of others by virtue of shared membership in various groups. I argue that career military officers share membership in morally relevant groups that include their branch of service, Department of Defense and the entire Executive Branch of Government, and I outline the circumstances under which career officers bear moral culpability for the actions of members of this group. A number of implications (...) arise from these findings. The first and most important is that military officers have an interest in ensuring the moral rectitude of government agents specifically as it pertains to their official capacities. Additionally, military officers have a duty not only to be informed about problematic government policies but also to educate themselves on the pertinent legal jurisprudence or ethical considerations. Three methods for ethics instruction are used in Taiwanese military education: the ‘bag-of-virtues’, value-clarification and virtue-ethics methods. This article explains, analyzes and discusses each of these, thereby giving an introduction to how military ethics is taught – and thought of – within the Taiwanese military system. Recommendations are given for how to improve the parts of the system that do not seem to live up to the stated intentions.

This essay offers a proposal for the missing constructs and language with which we can more precisely think about and examine the Army's Professional Military Ethic, starting with its macro context which is the profession's culture. We examine three major long-term influences on that culture and its core ethos, thus describing how they evolve over time. We contend that in the present era of persistent conflict, we are witnessing dynamic changes within these three influences. In order to analyze these (...) changes, we introduce a more detailed framework which divides the Ethic into its legal and moral components, then divide each of these into their institutional and individual manifestations. Turning from description to analysis, we also examine to what extent, if any, recent doctrinal adaptations by the Army (FM 3-0, 3-24, and 6-22, etc.) indicate true evolution in the essential nature of the profession's Ethic. In the past three decades, philosophers have delved into applied ethics, pursuing a surprisingly wide range of practically oriented normative questions, and a number of fields of applied ethical research and teaching are flourishing. There have, however, been few comparative studies of different fields in applied ethics, but such studies can, I believe, teach us something. Accordingly, this essay compares and contrasts business ethics and military ethics as distinct disciplinary or sub-disciplinary areas. The two subjects (...) might appear to be worlds apart. Yet there are not only differences, but also intriguing similarities between them. Specifically, I discuss the skepticism that often greets the idea of both business ethics and military ethics, compare the emergence of the two as academic fields, and examine some pedagogical issues they face. I then try to put some central questions in both fields in fresh light by comparing and contrasting the goals and responsibilities of corporations and their managers, on one hand, and of the military and its officers, on the other. The purpose of the present document is to briefly present principles that constitute a new doctrine within the sphere of Military Ethics : The Just War Doctrine of Fighting Terror.The doctrine has been developed by a team we have headed at the Israel Defense Force College of National Defense. However, the work has been done on the general levels of moral, ethical and legal considerations that should guide a democratic state when it faces terrorist activities committed against its (...) citizens. Accordingly, the proposed principles are meant to be justified and practically applicable under any parallel circumstances. Moreover, those principles are intended to be universal in the sense that the justification of none of them rests on any particular stance with respect to the desired solution of the conflict under consideration. The present paper is devoted to a detailed presentation of a new Military Ethics doctrine of fighting terror. It is proposed as an extension of the classical Just War Theory, which has been meant to apply to ordinary international conflicts. Since the conditions of a fight against terror are essentially different from the conditions that are assumed to hold in the classical war (military) paradigm or in the law enforcement (police) paradigm, a third model is needed. The (...) paper proposes such a model in the form of principles that should govern the activity of a democratic state when faced with terror. Eleven principle are proposed. Two are on the level of the state, including the Principle of Self-Defense Duty. Six are related to military preventive acts against activities of terror, including new formulations of a Principle of Military Necessity, a Principle of Distinction, and a Principle of Military Proportionality. Principles of Low Probabilities, Time Span Considerations and Professional Understanding are also included. Finally, three principles that are related to consciousness-directed activities against terror are added: a Principle of Permanent Notice, a Principle of Compensation, and a Principle of Operational Deterrence. The exposition of the principles is accompanied by arguments about their moral justification. The doctrine has been developed on the background of the IDF fight against acts and activities of terror performed by Palestinian individuals and organizations. (shrink)

Many contributors to military ethics from diverse locations and philosophical perspectives maintain that virtues are central to martial theory and practice. Yet several contemporary philosophers and psychologists have recently challenged the empirical adequacy of this perspective. Their challenge is known as the situationist critique, a version of which asserts that: situational features rather than character traits such as virtues cause and explain human behavior, and ethical theories and development programs are empirically inadequate to the extent that they incorporate (...) virtues. Most books and articles still treat leadership and ethics as related though separate phenomena. This edited volume is an exception to that rule, and explicitly treats leadership and ethics as a single domain. Clearly, ethics is an aspect of leadership, and not a distinct approach that exists alongside other approaches to leadership. This holds especially true for the for the military, as it is one of the few organizations that can legitimately use violence. Military leaders (...) have to deal with personnel who have either used or experienced violence. This intertwinement of leadership and violence separates military leadership from leadership in other professions. Even in a time that leadership is increasingly questioned, it is still good leadership that keeps soldiers from crossing the thin line between legitimate force and excessive violence. (shrink)

This article analyzes two traditional approaches to teaching military ethics, aspirational and functionalist approach, in light of the existing technological development in the military. Introduction of new technological solutions to waging warfare that involve dehumanization, such as unmanned aerial vehicles, as well as employment of different technological tools to enhance humans participating in war and to improve military efficiency, not only bring to the surfaces the obviously existing weakness and inadequacies of the two traditional approaches to (...) military ethics education, which have been rendered suboptimal, but also raise new challenges. The paper argues that teaching military ethics solely from the two perspective does not meet the demands of the upcoming military technological revolution and that the future will demand a more profound and conceptual moral education of military personnel that will reassess the role of martial virtues, increase responsibility for killing in war and result in military professionals that resemble “a Renaissance man” in their philosophical outlook. Only by ensuring that all military professionals have been properly and adequately ethically educated, future armies, as well as entire societies, can actively aspire toward optimal armed forces structure, a more professional and efficient approach to military profession, and ultimately better and more responsible military personnel in total. Military ethics seeks to provide practical guidance for the resolution of real ethical problems associated with the conduct of military operations. In doing so, it must reflect how actual persons give and take-up reasons when deliberating what actions to take. The Just War Tradition, for example, provides deontological and consequentialist considerations soldiers should take up when considering how to conduct operations. Sometimes, unfortunately, soldiers may find themselves in tragic situations where principles and consequences provide no clear guidance. (...) To fill that gap, a full account of military ethics requires an account of virtue, which focuses more on the agent than the act and can provide resources necessary to avoid, or failing that, resolve, otherwise unresolvable ethical dilemmas that can arise during military operations. This point does not mean virtue ethics supersedes or assimilates other ethical approaches. Rather it means that in the context of a process aimed at establishing reflective equilibrium, it provides important beliefs, judgments, and ways of thinking about applied ethics that are critical not just to building a robust, maximally coherent equilibrium but also to maintain it. These resources are especially critical when one is faced with the kind of tragic situations soldiers confront in war. (shrink)

The evolving nature of armed conflict, characterized by a new emphasis on crisis management and peace support, is bringing morality to the forefront of military leadership. The challenges of today's military operations place a new imperative upon Professional Military Education (PME) to maximize the quality of instruction on ethics in terms of both content and effectiveness. This volume presents the refined proceedings of two conferences of the European Forum on Military Pedagogy dealing with ethical issues (...) of teaching and learning in PME. It explores the philosophical and scientific aspects of current ethical questions, as well as the historical, psychological, and technological dimensions of education in ethics. Humanitarian operations may pose challenges to which armed forces prepared for warfighting seem rather ill-equipped. It is the aim of this article to examine in what way military ethics should be adapted to humanitarian tasks. Two ideal types of military ethics are defined here: warfighting and humanitarian. The warfighting ethic is supposed to maximise the utility of the military in war and combat and to that end utilises the virtues of loyalty and honour. In contrast, (...) humanitarian obligations require to a larger extent the development of personal integrity and an ability to follow one’s own conscience. The adaptation of military ethics is demonstrated in the case studies of the UK armed forces and the German Bundeswehr. Whereas the moral code of the UK armed forces remains anchored in the principles of the warfighting ethic, the case of the Bundeswehr presents a military ethic closely approximating the humanitarian ideal type. We investigated the ethical decision-making processes and intentions of 151 military personnel responding to 1 of 2 ethical scenarios drawn from the deployment experiences of military commanders. For each scenario, option choice and perspective affected decision-making processes. Differences were also found between the 2 scenarios. Results add to the emerging literature concerning operational ethical conflicts and highlight the complexity and challenge that often accompanies operational ethics.

Military ethics education programmes must prepare soldiers and other military personnel to carry out their duties responsibly, honourably and, above all, ethically. But the practical, moral, and ethical reasoning employed by soldiers in their professional activities—what I call ‘military ethical thinking’—is deeply challenging. The successful interpretation and application of principles and other demands of military ethical thinking presupposes more fundamental commitments that serve as its grounding. But whether soldiers address questions of grounding in their training (...) and education tends to depend upon their rank and role. The ethics education provided to senior officers, junior officers, NCOs, enlisted soldiers, new recruits, or conscripts varies greatly. Nonetheless, to facilitate coordination and cooperation across ranks and roles, there must be an overall unity and coherence to an ethics education programme. This paper asks which ethical approaches are best suited as grounds of military ethical thinking and education. According to a widely held view, the militaries of many democratic states are committed to ‘hybrid approaches’ to military ethical thinking and education. Here I argue that while hybrid decision-making procedures are valuable tools for soldiers facing ethically challenging situations, hybrid approaches cannot play the fundamental grounding role. Instead, I make a case for grounding military ethics education in a non-reductive virtue ethics which is based around the concept of ‘the good soldier’ and which is able to meet objections commonly put to virtue-based approaches. In this article we suggest and discuss key virtues that are needed, including the virtue of prudence and the accompanying virtue of good and proper storytelling. In this chapter, I explore the importance of ethics education for senior military officers with responsibilities at the strategic level of government. One problem, as I see it, is that senior commanders might demand “ethics” from their soldiers but then they are themselves primarily informed by a “morally skeptical viewpoint” (in the form of political realism). I argue that ethics are more than a matter of personal behavior alone: the ethical position of an armed service is (...) a matter of the collective responsibility of the people who constitute it, and senior military officers, having authority to give the orders, have a particularly important role. First, I discuss the continued prominence of a neorealist mindset in strategic thinking. Neorealist theory assumes that ethics is a largely irrelevant concern for strategic decision-makers. In contrast, I argue that consideration of moral values should be at the center of strategic theory and practice. Then, in the second section, I explore the “professional ethics” of senior military officers in order to develop an appreciation of the shared values and expectations regarding required conduct within any professional military service. I argue that senior military leaders should be concerned with what it means to be “good” and that this concept of the good can, and should, be applied across cultures and national boundaries. In the final section, I examine armed conflict and briefly discuss the moral reasoning involved to justify deliberate killing and destruction. I conclude that senior military officers require an understanding of sound moral reasoning to implement effective strategy. (shrink)

Reflections on, and analysis of, ethical issues facing military service in the United States.

This book offers a critical analysis, both theoretical and practical, of ethics education in the military. In the twenty-first century, it has become increasingly important to ensure that the armed forces of Western and other democracies fight justly and behave ethically. The 'good soldier' has to be not only professionally skilled but morally intelligent. At a time of relentless media scrutiny, the publicising of incidents of morally and legally unacceptable behaviour, such as the gross mistreatment of prisoners and (...) the torture of suspected terrorists, can do much to undermine the credibility of those who claim to hold the moral high ground in any particular conflict.
