This volume presents an extended version of the contributions presented at the workshop "Kant's Concept of Law" held at the 26th World Congress of the International Association for Philosophy of Law and Social Philosophy (IVR) in 2013. It handles issues of applied legal philosophy in Kant's Doctrine of Right such as ownership, the alleged right of necessity, the right of resistance and the right of revolution. With each of these applied issues, the focus lies, on the one (...) hand, on the relationship between the principles a priori of law and of the duties of rights, as well as their normative requirements - for instance, the duty of independence from the coercion by others - and, on the other hand, empirical situations and their pressing demands. Thus, this volume illustrates how Kant concretely conceives of the doctrine of "first metaphysical of the doctrine of right" as supplying "the immutable principles for any giving of positive law". My paper tackles the generic relationship between philosophy and law, the necessity of applying philosophy to law, the legitimacy and range of such an approach, the configuration of the way in which philosophy has left its mark in the juridical sphere. It surveys, in a chronological order, as well as in terms of their co-existence, the various stages of the relationship between philosophy and law. 1. Although both have been “within the walls”, law secludes itself, relatively (...) speaking, in “the world taken as a whole”, to shape its own identity, to survive as a self-sufficient, distinct technique (F. Geny), or it does it in a doctrinary way (positivism). 2. The representatives of philosophy in the juridical sphere are doing their best to uphold law’s struggle for knowledge, to have it gain recognition as a “science”, renounce its one-sidedness and harmonize with the others. 3. Juridical norms are not untouchable in relation with philosophy. Philosophy may work within juridical norms if it has an affinity with the content of juridical normativeness and respects its specificity. 4. The conclusion I reach is that we must try to cultivate a joint area bringing together philosophy and law, an area wherein the specific features of the two distinct fields reach a consensus for the sake of the human condition – hic et nunc. Philosophy bestows coherence and casts light on “law for man’s sake”, while the philosophically founded law appears to be the “normative project of the human”, a human practice inextricably connected with other types of practice, with man as a whole. The practical way to fulfil this goal, like the goal itself, will always be liable to criticism and improvement, open to debates and various options in a concrete socio-historical context. (shrink)

In the contemporary intellectual scene, one prominent question is this, what made science and its success possible? One tempting strategy for dealing with this question as a philosopher of science is to use science (or more broadly, empirical inquiry) and its methods to investigate the nature of science and its success. This strategy is what used to be called naturalism. For a philosopher of science, it amounts to naturalizing her philosophical inquiry for understanding the nature of science and its success. (...) The project of naturalizing philosophy of science has not been without its own problems. Some of the concerns are as follows. Willphilosophy of science maintain its traditional normative character after going through the process of naturalization? If it does, what form(s) will its normative content take? Can that normative content be secured without appealing to methods other than those usually used in empirical inquiries? In this essay, I will call these issues collectively the problem of normativity. First of all, I’ll look into the two most representative attempts to naturalize philosophy of science, namely L. Laudan’s and R. Giere’s attempts, focusing on the views that could be taken as their answers to the questions constituting the problem of normativity. Then I’ll examine these views in the light of some prominent criticisms and potential problems, and argue that some of those views could be defended by developing one or other additional conceptual arsenals but still others need to be curbed down admitting the apparent weaknesses of their supporting arguments. This reevaluative process will give us a better idea about what have been achieved by the attempts to naturalize philosophy of science and what their limitations are. (shrink)

The relationship between law and morality is a topic which receives special importance and attention, especially in "liberal democracies" in which the law is supposed to regulate highly pluralized and fragmented societies. Under conditions of plurality of values, many social forces and legal theories require a certain kind of neutrality from the legal system, a means of compatibility of the many "world views" and "moral systems" that are present within the same social space. Such a conciliating commitment sounds particularly relevant (...) in times of the doctrinal ubiquity of ideas such as "peace based on human rights". This was the title of the 28th World Congress of the IVR in Lisbon, with the special workshop "Law and Morals" on which this book is based. This is a special issue of Disputatio on normativity and rationality. The idea for this volume originated after the fifth European Congress of Analytic Philosophy, ECAP5, which took place in Lisbon in August of 2005. This volume collects the contributions of John Broome, Pascal Engel, Kevin Mulligan, Josep Prades and John Skoruspki, who were speakers on that occasion. The common thread in the diverse talks suggested that a volume on the topic would be of general interest. This common thread, (...) which revealed itself naturally, testifies to issues hotly debated in recent years and also to the centrality of normativity in various philosophical areas. (shrink)

In this paper I will argue that normativity in its pure form is a matter of gap. I will elucidate this idea in three aspects. First, I will suggest that the ‘ought’ is the unique creation of human language to deal with the contingencies and the complexity of the world. And the particular merit of the nature of ‘ought’ or the normativity is not what it positively can offer or do, but what it negatively leaves rooms for, because the ‘ought’ (...) opens up some space for reason or action. Second, every normative system must transform the real human being into its own normative construction of person. I call it the subjugation process. Third, the normativity can show its force more deeply through the escape, resistance and refusal, in another word, through struggle for recognition of the agents. This aspect has certain connection with the critical theory. (shrink)

The paper discusses the disciplinary production of the normative feminine body and analyses the shift that has taken place in the rationality underpinning our current techniques of gender. I argue that Foucault’s radical intervention in feminist philosophy, and more generally in the philosophy of the body, has been the crucial claim that any analysis of embodiment must recognize how power relations are constitutive of the embodied subjects involved in them. His studies of disciplinary technologies show how bodies are (...) constructed through mundane, everyday habits and techniques as certain kinds of subjects. Similarly, feminist appropriations of Foucault’s thought have demonstrated how feminine subjects are constructed through patriarchal, disciplinary practices of beauty. My argument is that that there have been significant changes in the last decades in the rationality underpinning these techniques of gender, however, which have emerged in tandem with the rise of the neoliberal, economic subject. I will appropriate Foucault’s idea of governmentality, and particularly of neoliberal governmentality, as an alternative framework to discipline for studying the contemporary construction of the feminine body. I will show that it provides us with a more comprehensive conceptual framework for understanding the construction of the feminine body in its current form. (shrink)

Can moral philosophy alter our moral beliefs or our emotions? Does moral scepticism mean making up our own values, or does it leave us without moral commitments at all? Is it possible to find a basis for ethics in human nature? These are some of the main questions explored in this volume, which is devoted to the ethics of the Hellenistic schools of philosophy. Some of the leading scholars in the field have here taken a look at the (...) bases of the Stoics' and Epicureans' thinking about what the Greeks took to be the central questions of philosophy. Their essays, which originated in a conference held at Bad Homburg in 1983, the third in a series of conferences on Hellenistic philosophy, propose important interpretations of the texts, and pose some fascinating problems about the different roles of argument and reason in ancient and modern moral philosophy. Ageing has become a central topic of medical ethical debates, e.g. regarding autonomy and care in geriatric practice, the just distribution of healthcare or the implications of anti-ageing medicine. In all these debates, however, particular conceptions of ageing are tacitly presupposed. The aim of my research is to develop an explicit understanding of the relevance of ageing for ethical reasoning, providing a conceptual framework for discussing concrete medical ethical problems in a more comprehensive and reflected manner. I proceed from the (...) life course approach, assuming that our life is shaped by a time regime defined and implemented by social institutions and structures, reflected in cultural images, and internalized as an “inner clock” directing individual decisions. From the ethical viewpoint, two concepts appear particularly significant: In a deontological perspective, the idea of “age norms”, social standards of age-appropriate behavior, becomes relevant. In a teleological perspective focusing on individual flourishing and good life, the concept of life plans, comprising age-related self-images and expectations, is important. I will briefly sketch the current medical ethical debates around ageing, then delineate the life course perspective and its implications for ethical reasoning, and finally exemplify its theoretical potential regarding medical ethical controversies about long time care, resource allocation and life extension. Philosophy of science is the object of metaphilosophical investigations. Metaphilosophy is the philosophy of philosophy. Philosophy is an archetypical thinking of being or an experience-of-being. History of Greek-European tradition of philosophy has three archetypes of thinking: objectivity, subjectivity, and inter-subjectivity. They are three archetypical contexts of interpretations of the concept of a philosophy of science too. Is philosophy of science part of philosophy? Is philosophy ofscience part of epistemology? What are methods (...) of philosophy of science? These questions are the topics of metaphilosophy. The topic of a scientific fact is a focal point of contemporary epistemology and philosophy of science. Is a scientific fact a fallible knowledge? The nature of a scientific fact is discussed in keeping with to the opposition of fallibilism and infallibilism. If fallibilism is universal quality of knowledge then there is a problem: is a scientific fact a fallible knowledge too? We are understanding and make clear the nature of a scientific fact by correlation of facts with: (1) data and evidence; (2) languages and theories; (3) methods of empirical investigations; (4) values, norms, and conventions of scientific investigations. Philosophy of science communicates with philosophy ofeconomics as the contemporary branch of philosophy. Its problems arise from the relationship of philosophy and philosophy of science with economics and practice. (shrink)

Toulmin, Hull, Campbell, and Popper have defended an "Evolutionary-Analogy" view of scientific evaluative practice. In this view, competing concepts, theories and methods of inquiry engage in a competitive struggle from which the "best adapted" emerge victorious. Whether applications of this analogy contribute to our understanding of science depends on the importance accorded the disanalogies between natural selection theory and scientific inquiry. Michael Ruse has suggested instead an "Evolutionary-Origins" view of scientific evaluative practices in which scientific inquiry is directed by application (...) of epigenetic rules that have become encoded in homo sapiens in the course of evolutionary adaptation. Among these rules are "formulative theories that are internally consistent," "seek severe tests of theories," and "achieve a consilience of inductions". As a descriptive theory of science, the "Evolutionary-Origins" view is prima facie inconsistent with evidence that human beings often make decisions that violate the "genetically-hard-wired rules." As a normative-prescriptive philosophy of science, the "Evolutionary-Origins" view is limited by the fact that in biological evolution, adaptation to present pressures may be achieved at the expense of a loss of adaptability. I present an outline of a normative and non selectionist theory capable of ascribing functional statements to biological items. Biological items are ussually exemplified by the organs as well as traits or behaviours. But we can consider representations too. In fact, my proposal is focused towards a teleosemantical theory of mental content. The teleosemantic approach explains the content of beliefs in terms of the biological functions of those states. Usually, teleosemantical theories of mental representation either ellaborate previously a general theory (...) of functions for biological items, this is the case for Millikan, Neander or Price, orassume a previous selectionist one, as Papineau does. But these proposals are frequently adaptationist in order to keep normatitvity in whatever functional adscription. The recent contributions to the state of the art show the problems of this kind of selectionist view. But they don’t consider the problem of normativity in functional adscriptions. And this problem become important when we pay attention to mental representations as biological facts. I propose an outline of a nonselectionist nor adaptationist account of biological functions capable of keeping normativity. My account is suitable to biological traits, in general, and mental representations characterized in terms of biological functions. (shrink)

The controversies in our time between teleological and deontological ethics which come down to the problem "from being to ought," referring to human being or nature, can be resolved only by an adequate conception of human nature. Taking up the ancient tradition again, we can re-examine the teleological conception of human nature as primarily instinctive and selfish, and say that human nature is constituted also by reason and that the instinctive nature is predisposed to be guided by reason or intellect. (...) The constitutive order of the human soul, with the subordination of the instinct under the intellect, involves already some natural goodness, of which the intellect is aware and for which the will strives. This is the basis for the "moral law" and for normative ethics. Thus, human nature is not selfish in itself. Although moral goodness as humankind’s perfection is an ideal, it has in us already imperfect natural beginnings, a "natural morality." In a certain sense, the moral ought of actions comes from one’s being, from the natural moral goodness of which the intellect is aware in itself, and from its good intentions. (shrink)

My objective here is to motivate certain distinctive forms of dynamic normativity at some level deeper than that of our ordinary usage of ‘norm’ or ‘rule’ in the prescriptive sense of ‘ought’-forms of normativity not only bound by evolution but ultimately, via the same dynamic process, giving rise to our prescriptive-normative practices. As a theoretical backdrop for this motivation, I give a review of the familiar frog case in the studies of representational content from a new perspective: i.e., try (...) to reveal the diachronic holism embedded in Millikan’s teleo-semantic functions via a thought experiment called ‘the frog prince’. Then I will show how such a version of diachronic holism relates to my proposed notions of dynamic normativity. (shrink)

Thick ethical concepts are characterized by having both a “world-guided”/descriptive and an “action-guiding”/prescriptive aspect. The purpose of this paper is to argue that if we conceive of rationality as a thick ethical concept we will be able to understand two things. First, why people are inclined to believe that rationality – even if defined in terms of rational requirements – actually is normative. The action-guiding aspect of the concept of ‘rationality’ is responsible for this. It is highlighted for example by (...) the fact that accusing somebody of behaving irrationally works as a stand-alone criticism of an action or actor. Second, we can also understand why those recent arguments by Broome and Kolodny trying to show just how rationality is normative fail. They are proceeding solely based on a world-guided definition of rationality. This does not lead to a misapplication of the concept stricto sensu; but to a thin concept which necessarily fails to grasp the evaluative force of the concept of ‘rationality’. This is particularly insightful for economists who often tend to use ‘rationality’ as a standard for judging behavior. (shrink)

Hannah Ginsborg has recently introduced a new kind of nor-mativity which is supposed to avoid the pitfalls of both non-reductionist and dispositionalist theories of meaning. Ginsborg calls her kind of normativity ‘primitive’, for, though it is not to be conceived of in purely naturalistic terms, it is nonetheless to be applied to states or facts that are not purely intentional or contentful in that they are ‘below the level’ of meaning facts. Primitive normativity provides an explanation of how we first (...) come to grasp the meaning of an expression. This explanation, according to Ginsborg, is missing in both non-reductionism, for which the state of meaning is sui generis, and dispositionalism, which does not explain how we go from mere discriminating to genuine understanding and meaning. I wish to defend non-reductionism, first, by showing that Ginsborg’s account does not yield the kind of explanation it aims at and, second, by suggesting that non-reductionism does not preclude a constructive account of the philosophical nature of meaning. In this paper, I criticize naturalized epistemology. To this end, I critically examine several versions of naturalistic epistemology (Quine, Kornblith, and Plantinga). While Quine’s epistemology eschews any kind of normativity not invoked in science, Kornblith’s and Plantinga’s views attempt to explain normativity in the light of descriptivity. I provide an argument against them. The upshot of my argument is that since we are self-conscious beings, we have reflective ability to see what we ought to believe. In other words, the fact (...) that we are self-conscious beings requires us to find reason for our belief. I argue that naturalistic epistemology cannot capture that idea, since it is only concerned with third-person, impersonal approach. It simply shifts our thinking about justification from a subjective or first-person perspective to an objective or third-person perspective. Therefore, naturalistic epistemology, even if it is a weak version, is untenable in that it simply ignores human consciousness and its role in justification of beliefs. (shrink)

The literature on management identifies three models for the relationships between a company’s management, its board, its shareholders and other stakeholders, as well as the corporation’s goals: the shareholder model of corporate governance, the employee governance model and the stakeholder model. One can identify in current business practice a further model of corporate governance, which may be entitled “the controlling shareholder model”. The goal of this paper is to show that these models are grounded in long-standing philosophical ideas. The philosophical (...) basis of the shareholder model is to be traced to John Locke’s theory of private property; Karl Marx’s approach underlies the employee governance model; the stakeholder model reflects the Aristotelian theory of the golden mean; and the controlling shareholder model expresses Thomas Hobbes’s conception of the sovereign power. We wish to argue that recognizing these philosophical ideas at the basis of the models of corporate governance would facilitate the analysis of the difficulties inherent to these models. We also maintain that this recognition is instrumental in forming a normative position concerning the meaning of corporate governance to present-day society. (shrink)

The aim of this study is to undertake an in-depth conceptual and ethical analysis of African philosophy of sex and the HIV/AIDS epidemic in Africa by taking the Oromo of Ethiopia as an example. The continent with just 10% of the world’s population is home to over 70% of the world’s HIV/AIDS infection. HIV/AIDS is a social, economic, demographic and moral problem as well as a health care issue. Some scholars hypothesise that the unique nature of African sexuality, sexual (...) promiscuity, the prevalence of other ailments, and the unique nature of the viral subtypes (known as clades) are the major reasons for Africa’s AIDS prevalence. However, there is little substance to their hypotheses. As of today there is no sound explanation for the prevalence of HIV/AIDS in Africa. So far the HIVintervention has largely focused on behaviours, systems and structures which are visible without fully taking into account culture, values, norms and traditions which are invisible but have a strong influence on visible aspects of individual behaviours and societal structures. Thus, this issue requires further research into people’s philosophy of sex and indigenous moral values. This study and the contributions of many scholars have shown that Africans have a diverse spectrum of sexual behaviour ranging from the very restrictive to the permissive. Although some ethnic groups have developed a profound philosophy of ex that can curb the expansion of HIV/AIDS, there have been some sexual and religious norms and expectations in Africa that have contributed to the rapid spread of HIV/AIDS. Social, economical, and political forces have also shaped the HIV/AIDS epidemic. This paper thus suggests that global fight against HIV/AIDS should go beyond a narrow focus on the behavioural and biological, and consider broader structural and underlying factors such as poverty, homelessness, widespread sex work, rural to urban migration, instability, a high rate of unemployment, unequal gender relations, harmful traditional practice and global injustice that have facilitated the spread of HIV/AIDS. African governments should involve the local people and civil society organisations in the fight against HIV/AIDS by using a wide range of participatory methodologies and culturally sensitive advocacy strategies. This study thus suggests that a multi-faceted approach is needed to deal with the challenges of the 21st century and address the HIV/AIDS epidemic in our world. Values are essentially interpretive: they can, even must be interpreted and can and should be understood as (somehow socially or personally standardized) interpretive constructs of a specific kind and according to different types to be distinguished and classified within an hierarchical typology. There is a special connection between values and actions as well as their characteristic of being related to their ascription to persons, goods, events etc. This connection is indeed covered, borne or carried out by interpretation. In fact, any (...) ascription of a value concept or predicate whatsoever is dependent on a structure and hierarchy of normative and in part descriptive schemes of at times conventional and dispositional scheme-interpretations. Generally speaking, the thesis is that the methodological model of interpretive constructs (scheme-interpretationism) can be thoroughly applied to the concept and usage of values. Social values are then in this sense socially originated, institutionally sanctioned or standardized interpretational constructs of a social character, notably for social comparisons in using and establishing preferences for a kind of (limited) uniformity and expectability and predictability of social behavior and actions. Reiterative coordination games in large groups demonstrate that social norms, once attained, create stable equilibria. This shows that thin social capital is stable, and in some cases preferable to thick SC since it lowers transacting costs. This finding, supported indirectly by R. Putnam’s own early research, runs counter to his claim that the loss of thick social capital is detrimental to the modern society and to Coleman’s argument that closure is required for maintaining social capital.

This paper is concerned with some of the differences between philosophy and contemporary science, and with the significance of these differences for the question of the nature of philosophy. Differences of particular interest here are ones that tend to be concealed and ignored through the influence of the professionalist attitudes of contemporary science, an influence that manifests itself in the prevailing normative attitude to the vocabularies and linguistic practices of professional philosophy. It is argued that this normative (...) attitude is questionable in the light of a feature that we take to be essential to philosophy: always being open to the question of its own nature and task. Many attempts have been made to define analytic philosophy in a nonhistorical or otherwise deictic way, and to provide a set of necessary and sufficient conditions for a piece of philosophical work to be part of analytic philosophy. This is more difficult than might appear, for the conditions appealed to are normative and must be claimed by non-analytic philosophers to apply to their production as well. In fact, no such set of conditions has been forthcoming, and it is (...) unlikely that it ever will. Instead, I offer a holistic characterization of analytic philosophy as a mode of organization of philosophical work modeled on science. This accounts for analytic philosophy’s success in the academic world, its pedagogic virtues, and its ability to expand beyond its initial boundaries. Two related questions remain: one about the indirect justification analytic philosophy might be granted from outside of philosophy, the other about its ability to make contact with cultural realms other than those with which it has until now established a fruitful exchange. A brief history of environmental consciousness in the western world places our views in perspective and provides a context for understanding the maze of related and unrelated thoughts, philosophies, and practices that we call “environmentalism”. Environmental ethics is a collection of independent ethicalgeneralizations, not a tight, rationally ordered set of rules. Environmental ethics is a collection of interrelated independent tendencies - a process field that is brought together for a long time. Ethics really results from people’s perceptions, attitudes and behaviour. (...) Society is facing many important decisions about the useof science and technology. These decisions affect the environment, human health, society and international policy. To resolve these issues, and develop principles to help us make decisions we need to involve anthropology, sociology, biology, medicine, religion, psychology, philosophy, and economics; we must combine the scientific rigour of biological data, with the values of religion and philosophy to develop a world-view. The goal of environmental ethics is not to convince us that we should be concerned about the environment. Instead of it, environmental ethics focuses on the moral foundation of environmental responsibility, and how far this responsibility extends. The challenge of duty-based eco-centrism is to explain how conflicts are to be resolved between human‐centered duties and environment-centered ones. An adequate duty-based approach to environmental obligation requires prioritizing environmental duties according to a ranked importance of the various ecosystems in question. Conflicts between prioritized environmental and human duties, then, can only be resolved on a case by case basis. Although eco-centrism fails as a normative theory, eco-centrism may have merit as a way of expressing emotionaloutrage at environmental damage and demanding change. (shrink)

My presentation deals with developments and transformations of the concept of the transcendental within Anglo-American analytical philosophy. According to Kant – the “founding father” of transcendental philosophy – the methodical domain of the transcendental is to denote and to expose the a priori epistemic structureof human mind and cognition (perception, experience, knowledge), as well as to provide a priori foundations for normative ethics. Analytical philosophy has adopted the term of the transcendental, mostly within sceptical argumentations or for (...) sceptical refutations. What is the methodological function of the transcendental in these debates, in the context of philosophical scepticism? My contribution tries to show that the notion of the transcendental becomes concave in analytical contexts. It might be appropriate to refute scepticism, but in these analytical contexts it’s not possible to deduct epistemic structures (e.g. categories,epistemic schemes) of experience and knowledge or to bridge the gap to foundations in ethics – one of the core goals in Kantian transcendental philosophy. What is the importance in transcendental analysis and reflection or is this term obsolete all together nowadays? My paper tries to discuss and mediate between various positions and ideas. (shrink)

Farrell’s Norms of Rhetorical Culture (1993, 6) remains both a masterly synthesis of previous constructive work in rhetorical theory and the essential starting point for anyone committed to reconciling the practical impulses of Aristotelian rhetoric, ethics, and politics with the (...) critical imperatives of modernity. In what follows, I try to make a very simple point about Farrell’s recuperation of Aristotelianism: he neglects matters of social causation and institutional design that were essential to Aristotle’s understanding of rhetoric. In turn, by displacing the social in favor of the cultural—a displacement characteristic of much recent work in the human sciences (Schudson 1997)—Farrell lacks a coherent account of the gap between the normative aspirations of classical rhetoric and the empirical characteristics of public life in modern liberal democracies.The problem appears most clearly in chapter 7 of Norms : “Criticism, Disturbance, and Rhetorical Community.” Farrell defines culture as “the common definition of places for the invention and perpetuation of meaning. A culture offers to those who live in it symbols and families of practices that [End Page 402] permit ongoing performances of meaning and value” (1993, 277). Summarizing his previous arguments, Farrell contends that Aristotle’s Rhetoric informs modern “cultural occasions” in three ways: “the impetus for rhetorical meaning, which we find in Aristotle’s seminal understanding of phronēsis, typified by deliberative prudence; a concept of rhetorical form, which we have found in the prototype for public inference and judgment—the enthymeme; and a modern rhetorical forum, a space of engagement wherein the modern constraints of rhetorical culture might assert themselves” (1993, 277). Although these three concepts are inherently useful, both for analyzing past rhetorical episodes and for projecting emancipatory rhetorical possibilities in the present, they are insufficiently grounded in a historical account of the differences between ancient and modern prudential deliberation, rhetorical forms, and rhetorical forums. An adequate history of these differences would require attention to modern social systems as a whole, which include the economy, the polity, and social institutions such as the family, schools, religious and ethnic organizations, and, most crucially for contemporary social systems, the entire apparatus of the culture industry, including the news and entertainment “media.”The cultural aspect of the modern social system, loosely following Talcott Parsons (1951), includes norms, which make for communal solidarity, and values, which undergird the whole system. Although a thoroughgoing account of the place of rhetoric in the entire contemporary social system of a modern liberal democracy such as the United States or Canada would have required a book three times as long as Norms, there are three ways in which modernity complicates the appropriation of Aristotle’s concepts. First, rhetorical meaning is very different in a social system in which individual autonomy takes precedence over communal solidarity as a fundamental value (Pippin 1999). Second, rhetorical forms function differently in a social system in which those forms can be commodified (Aune 1994, 2001). Third, rhetorical forums are also far more complex, especially in an extended republic like Canada or the United States, requiring greater attention to the way in which constitutions literally create persons who speak (such as the president or prime minister) and spaces for speaking (Congress, the state or provincial houses [White 1984]). The need to raise massive sums of money to obtain media access for common rhetorical deliberation, as is especially the case in the United States, complicates the notion of a rhetorical forum immensely. Even without adopting a broadly Marxian framework, it is clear that the rise and development of capitalism have permanently altered rhetorical deliberation and its forms and forums. Mircea Eliade, often described by scholars and in the popular press as the world's most influential scholar of religion, symbolism, and myth, was trained as a philosopher, received his Ph.D. in philosophy, and taught in the Department of Philosophy at the University of Bucharest in the 1930s. Although he became a historian and phenomenologist of religion within the field of religious studies, his approach, methodology, and analysis are informed by philosophical assumptions and philosophical normative judgments. In several of (...) his writings, he goes far beyond the history and phenomenology of religion and presents a strong critique of contemporary Western philosophy as part of his larger critique of contemporary Western culture. He submits that contemporary philosophy,as a development of the Enlightenment, claims to be universal, but is in fact ethnocentric and provincial; claims to be innovative and creative, but is in fact increasingly trivial, insignificant, and uncreative. Eliade repeatedly charges that contemporary philosophy is bankrupt and desperately in need of renewal. I shall provide his philosophical critique of dominant Western philosophy, his analysis of self-other encounters, and his alternatives for philosophical renewal through the emerging confrontations, engagements, and creative dialogues between Asian, other non-Western, and Western philosophical perspectives. This paper raises a moral issue for contemporary post-revolutionary Muslim intellectuals in Iran. According to traditional Islamic philosophers such as Al-Ghazali, ethics, following what Prophet Mohammed said, must transcend people form this mundane world. If this is so, ethics would need to teach people how to improve their virtues. Most of the contemporary Muslim intellectuals tried to pave the way for accomplishing this goal. After clarifying the reasons why new Muslim intellectuals have faith in virtue ethics, as the best possible (...) moral normative theory, I claim that virtue ethics fails to support some of our modern problems, such as human rights. Also, I argue that virtue ethics is not the best theory for ordinary average people who have a weak will. A preliminary conclusion of the paper will be that Utilitarianism, generally, and principle of utility, specifically, can do this job better. This has been overlooked by new Muslim intellectuals, according to my opinion. Yet, I suggest that among different versions of Utilitarianism, Rule-Utilitarianism is more suitable for this role. Ethics is frequently divided into three parts: metaethics, normative ethical theory, and the more specific normative ethics. However, only metaethics is explicitly philosophical insofar as it is concerned with fundamental questions about the content, objects, and status of ethical thought and discourse. During the heyday of conceptual analysis, philosophers were admonished to restrict themselves entirely to metaethics. Since, it was said, they lacked any special expertise as philosophers on normative questions, their pronouncements could be no more than hortatory. I will (...) argue that there is no satisfactory alternative to conducting normative ethical inquiry in conjunction with metaethics. Only by investigating normative and metaethical questions together in an integrated philosophical ethics can we hope to make real progress with either. Ethics should remain part of philosophy. The notion of ‘philosophical culture’ can be defined as the totality of conditions of philosophical thought and theory. Among these conditions is an awareness of the historical background of the philosophical culture in question. This awareness, which plays an important cognitive and normative role, often takes the form of a relatively independent discipline: history of philosophy. Over the last decade, Russian historians of philosophy have been attempting to make the repressed past accessible to contemporary philosophy, often modifying (...) their earlier, Soviet work. Following the design of the author, reforms of the UN would consist of four rules. The first rule: Payments from the global community should correspond with the services provided by the UN. - For this purpose it is necessary to develop a system of compensation in which payment would be made only for the completion of a concrete service. Such a system would in effect serve as a continuous audit and guarantor of quality service at all times visible to the (...) entire public. The second rule: Servantura not dictatorship - The author has created a word "servantura" and has given it the following meaning: the performance of administrative service, guided by (1) ethical conduct, (2) democratic norms, (3) the newest scientific knowledge, (5) safe technology, (6) justice, (7) equality of people and (8) the priority of human life. On an idea of the author, servantura is a global managerial philosophy with a system of global service in which each decision should be in accordance with the wishes and the will of the entire global community, not of a separate group of nations, or a single nation, or person. The third rule: Noncommercial services. Commercialization of the UN should be considered a crime. Further commercial use of the UN should be stopped, as it will lead to aglobal catastrophe. The fourth rule: Without enemies or competitors, Full transparency and a strict prohibition of secrecy and privacy in the UN must be established. i.e. openness, publicity and a strict international prohibition on any secret structures or secret activities within the UN. Most individuals realise that we have a moral obligation to avoid the evils of war. But this realization raises a host of difficult questions when we, as responsible individuals, witness harrowing injustices such as ""ethnic cleansing"" in Bosnia or starvation in Somalia. With millions of lives at stake, is war ever justified? And, if so, for what purpose? In this book, Richard J. Regan confronts these controversial questions by first considering the basic principles of just-war theory and then applying those (...) principles to historical and ongoing conflicts. Part One presents two opposing viewpoints: first, that war is not subject to moral norms and, second, that war is never morally permissible. The author rejects both perspectives, and moves to define the principles of just-war theory. He evaluates the roles of the president, Congress and, most importantly, the UN Security Council in determining when long-term US military involvement is justified. The moral limits of war conduct and the moral problem of using, or threatening to use, nuclear weapons are also discussed. On the just cause to wage war, Regan argues that defense of nations and nationals - whether in self-defense or in defense of others - remains the ""only"" classical cause that in the modern world would justify resorting to war. With respect to military intervention in secessionist and revolutionary wars, he contends that such intervention might be justified, but that prudence dictates extreme caution. In considering acceptable war conduct, Regan elaborates the specific principle of discrimination and proportionality; he maintains that civilians uninvolved in the enemy's war should not be directly targeted and that the costs of military action must be proportionate to the anticipated benefits of destroying military targets. The second part of the book presents case studies of eight historical wars - World War I, the Vietnam War, the Falklands War, the revolution and civil war in Nicaragua, the civil war in El Salvador, the Gulf War, the intervention in Somalia, and the Bosnian War - and poses several provocative questions about each. It invites readers and students to apply just-war principles to complex war-related situations and to understand the factual contingencies involved in moral judgements about war decisions. If nothing else, the twelve papers assembled in this volume should lay to rest the idea that the interesting debates about the nature of science are still being conducted by "internalists" vs. "externalists,"" rationalists" vs. "arationalists, n or even "normative epistemologists" vs. "empirical sociologists of knowledge. " Although these distinctions continue to haunt much of the theoretical discussion in philosophy and sociology of science, our authors have managed to elude their strictures by finally getting beyond the post-positivist preoccupation of (...) defending a certain division of labor among the science studies disciplines. But this is hardly to claim that our historians, philosophers, sociologists, and psychologists have brought about an "end of ideology," or even an "era of good feelings," to their debates. Rather, they have drawn new lines of battle which center more squarely than ever on practical matters of evaluating and selecting methods for studying science. To get a vivid sense of the new terrain that was staked out at the Yearbook conference, let us start by meditating on a picture. The front cover of a recent collection of sociological studies edited by one of us (Woolgar 1988) bears a stylized picture of a series of lined up open books presented in a typical perspective fashion. The global shape comes close to a trapezium, and is composed of smaller trapeziums gradually decreasing in size and piled upon each other so as to suggest a line receding in depth. Peirce, Europe, ScienceThe common image of Charles Sanders Peirce as an isolated thinker writing in Arisbe without any contact with the world is not only historically inaccurate, but also makes it difficult to understand some key elements of his philosophy. Charles S. Peirce traveled to Europe on five different occasions. The five trips occurred between the (...) years 1870 and 1883, all of them in the service of the Coast and Geodetic Survey, at that time the chief scientific agency of the United States. Those trips—which covered a total of thirty-eight months—were a rich mixture of scientific research and tourism, of communication with other scientists and also of enjoying the artistic treasures of Europe. The impact of this extensive travelling was so relevant in Peirce’s life and thought that it makes perfect sense to identify this period of time as his “cosmopolitan period”—to use Max Fisch’s expression (Fisch 1986, 227).Peirce’s experiences of his European trips are lively reflected in his broad correspondence (professional and family letters), which until now has been unduly neglected by the scholarship, due in part to the difficulties accompanying access to it and in part to the general lack of interest from the analytic tradition in the biographical aspects of philosophy. We are convinced that the feelings that Peirce experienced in Europe were seeds which bore fruit in later years. A close study of Peirce’s letters and other documents of those years will help in avoiding a number of misunderstandings about his thought and its evolution by highlighting his active participation in the first line of several fields of cooperative scientific research (astronomy, geodesy, etc.). [End Page 425]In this issue we collect three papers presented at the 2014 Charles S. Peirce International Centennial Congress, authored respectively by Nathan Houser, Sara Barrena and myself. The first paper, written by Nathan Houser, describes how Peirce’s European experiences influenced the development of his thought and helped shape his philosophy. It appears likely that his thought was decidedly influenced by his intellectual and personal contact with European scientists and philosophers. So to understand Peirce as an American philosopher it is necessary to grasp that he was profoundly influenced by European thought and culture and to inquire how his American and European experiences worked together to form his ideas and shape him into the world-renowned philosopher he became.Sara Barrena’s paper focuses on Peirce’s aesthetics. While Peirce claims to not be well acquainted with aesthetics, he always was interested in that field. In spite of the fact that Peirce did not develop the issue in depth, aesthetics is at the foundation of the other normative sciences. Barrena suggests that the trips through Europe and the contemplation of so many works of art and of historic places left in his memory impressions that are at the basis of the importance that Peirce would assign to art and aesthetics in his later years.The final paper, by Jaime Nubiola, describes—with documental support from Peirce’s correspondence from his first and second European trips—Peirce’s conception of science as a collective and cosoperative activity of people whose lives are animated by the desire to find out the truth and by “an impulse to penetrate into the reason of things” (CP 1.44, c.1896). This paper is based on the work of Pierre de Coubertin and his view of Olympism. It deals with Coubertin's distinction between two kinds of sport: Olympic sport and world championship sport. I shall examine these two possibilities with respect both to education through sport and to how one lives one's life, and I shall show the necessity of choosing between them, with reference to Coubertin's closing remarks in his speech at the 1925 Olympic Congress in Prague: ?Fair or temple (...) ? sportsmen must make their choice; they cannot expect to frequent both one and the other ? let them choose!? (Coubertin 2000f, 559). I shall address the topic of the choice between these two kinds of sport through the two metaphors in the above quotation: ?fair?, in the sense of a market, or in ancient Greek agora; and ?temple?. Since this is also a choice of the way one lives one's life, the ideas will be worked out from within the philosophy of existence, particularly from the work of Jan Pato?ka, who develops the idea of different ?movements of human existence? in connection with different overall life directions that one might follow. The notion of ?fair? (or agora) is characterised by a human being's following of the prevailing patterns, norms and aims prescribed by society, without much reflection upon his or her individual aims and attitudes. It is described in Heideggerian terms as inauthenticity and in Pato?ka's idea of the second life movement, which is characterised by work, struggle, competition, comparisons, endless striving and self-assertion. Within sport, this is represented by wanting to win at all costs, lack of respect, self-promotion and striving for rewards. The notion of ?temple? is contrasted with the above mentioned character of the fair and is related to a certain clarity about one's existence and striving, one's doing and thinking, as described in Pato?ka's third movement of existence. Recent theory and criticism has investigated direct and indirect exclusions. Direct exclusions expressly prevent the participation of particular individuals and groups in public discussions and debates. Prohibitions against women speaking in (...) public, for example, have served historically to inhibit women's participation in various forums (see, e.g., Landes 1998). Indirect exclusions function tacitly through discursive norms and practices that prescribe particular ways of interacting in public forums. Indirect exclusions compel participants to conform to established modes of discourse that effectively negate the perspectives and contributions of previously directly excluded individuals and groups. Calls for "objective" and "dispassionate" debate, for instance, sometimes have restricted public agendas by portraying culturally specific forms of address as universally practiced (see, e.g., Warner 1993). Indirect exclusions may regulate discourse in various forums even when direct exclusions have been counteracted. Scholarship seeking to overcome these exclusions has proceeded on two levels. On one level, scholars have recounted the efforts of excluded persons to participate in public life despite restrictions by developing alternative modes of publicity (see, e.g., Ryan 1990; Zaeske 2002). On a second level, theorists have proposed more inclusive conceptual models of the public sphere that may overcome historical exclusions of the bourgeois public sphere while retaining a commitment to critical publicity (see, e.g., Asen 1999; Benhabib 1996; Hauser 1999; Mouffe 2000).Practicing democratic discourse fairly and justly depends indispensably on enabling inclusion. Proponents of deliberative democracy argue that political legitimacy arises from processes of inclusive public debate. Others regard inclusive public discourse as crucial for the formation of affirmative individual and collective identities. Identity formation entails mutual recognition among members of diverse cultures, yet theorists have observed that truncated discursive processes may inhibit mutual recognition. Charles Taylor writes that practicing a politics of recognition requires an openness toward other cultures—a presumption of value tested through sustained engagement so that "what we have formerly taken for granted as the background to valuation can be situated as one possibility alongside the background of the formerly unfamiliar culture" (1994, 67).
