Hannah Ginsborg rejects my ‘two-acts’ interpretation of Kant’s conception of aesthetic judgement as untrue to Kant’s text and as philosophically problematic, especially because it entails that every object must be experienced as beautiful. I reject her criticisms, and argue that it is her own ‘one-act’ interpretation that is liable to these criticisms. But I also suggest that her emphasis on Kant’s ‘transcendental explanation’ of pleasure as a self-maintaining mental state suggests an alternative to the common view that pleasure is (...) a distinctive feeling, even if Ginsborg herself does not draw that conclusion. I focus on one approach to understanding quotation, the identity theory; I delineate varieties thereof; and I cite some considerations for favoring a speech-act version. Along the way we shall see how the study of quotation can illuminate the general conflict between speech-act semantics and formal semantics, and we shall see fresh arguments for insisting that the mechanism of quotation is referentially indeterminate.

So declares Archbishop Stefan Hesse of Hamburg, Germany, in the summer of 2020, where "a (...) paper" refers to an apostolic letter, Pope St. John Paul II's 1994 Ordinatio Sacerdotalis, which definitively rules out the admissibility of women to priestly ordination.1 No doubt the archbishop was drawing inspiration from Cardinal Archbishop Reinhard Marx of Munich and Freising, who a month earlier had opined that arguments against women's ordination were becoming increasingly "weaker" (schwächer).2 In his capacity as president of the German bishops' conference, Bishop Georg Bätzing [End Page 805] of Limburg also pronounced on the issue in even more unabated terms; after insisting in June of the same year that Catholics can "continue to talk about the issue of women's ordination," he went further in an interview with the German magazine Herder Korrespondenz six months later: "There are well-developed arguments in theology in favor of opening up the sacramental ministry to women," he asserted, after declaring his desire for "change" (Veränderung), a change that he opined could begin with ordaining women as deacons before ordaining them as priests and bishops.3 Two years later, Bätzing remained adamant, going so far as to declare to speak in the name of the faith of the entire Church on this issue: "The sensus fidelium, that is, the sense of the faithful," he stated, "has moved on" (geht weiter).4 Since the deposit of faith, of which the sensus fidelium is expressive, does not and cannot "move on," that is, change, Bätzing's appeal to the sensus fidelium marks a curious—if also audacious—move, to say the least.It appears we are destined ever "to think about and discuss" the issue of women's ordination, no matter if the Holy Father himself, in the person of the John Paul II, should seek to quell this discussion in the strongest and most authoritative of terms: "In order that all doubt be removed regarding [this] matter," writes the Polish Pontiff, "I declare that the Church has no authority whatsoever to confer priestly ordination on women and that this judgment is to be definitively held by all the Church's faithful" (Ordinatio Sacerdotalis §4).As regards John Paul II's assertion that his judgment is to be "definitively held" by all Catholics, it is worth recalling that, even if one high-ranking German churchman (Hesse) might esteem Ordinatio Sacerdotalis as [End Page 806] tantamount to ein Papier das erstickt, "a paper that stifles," another, Joseph Ratzinger (in his role as cardinal prefect of the Congregation for the Doctrine of the Faith [CDF], before becoming Pope Benedict XVI), holds up John Paul II's apostolic letter as expressive of the infallible teaching of the Church's ordinary magisterium and as "belonging to the deposit of faith." As such, the letter requires all Catholics, asserts Ratzinger, to offer their "definitive assent" to the Holy Father's pronouncement.5John Paul II and Ratzinger may as well have been talking to the wind. I draw upon speech act theory to understand the speech acts appropriate to the multiple aims of scientific practice and the role of nonepistemic values in evaluating speech acts made relative to those aims. First, I look at work that distinguishes explaining from describing within scientific practices. I then argue speech act theory provides a framework to make sense of how explaining, describing, and other acts have different felicity conditions. Finally, I argue that if explaining aims to (...) convey understanding to particular audiences rather than describe literally across all contexts, then evaluating explanatory acts directed to the public or policymakers involves asking nonepistemic questions. The Gamer’s Dilemma challenges us to justify the moral difference between enacting virtual murder and virtual child molestation in video games. The Dilemma relies for its argumentative force on the claim that there is an intuitive moral difference between these acts, with the former intuited as morally acceptable and the latter as morally unacceptable. However, there has been no empirical investigation of these claims. To explore these issues, we developed an experimental survey study in which participants were asked to (...) reflect on imaginary video game scenarios as part of a 2 (undertake virtual murder or molestation) X 2 (against an adult or child) X 2 (in a high or low realism virtual environment) factorial design. We found that there was a significant difference between people’s views about virtual murder and virtual molestation. Whether the virtual act was performed against an adult or child was non-significant in most conditions, whereas whether it was performed in a high or low realism virtual environment was significant in most conditions. Gender did not impact these results, whereas perceived gaming experience, hours of video game play per week, and integrity did. These results provide an empirical grounding for future discussions of the Gamer's Dilemma. (shrink)

Groups of people perform acts. For example, a committee passes a resolution, a team wins a game, and an orchestra performs a symphony. These collective acts may be evaluated for rationality. Take a committee’s passing a resolution. This act may be evaluated not only for fairness but also for rationality. Did it take account of all available information? Is the resolution consistent with the committee’s past resolutions? Standards of collective rationality apply to collective acts, that is, (...) class='Hi'>acts that groups of people perform. What makes a collective act evaluable for rationality? What methods of evaluation apply to collective acts? This paper addresses these two questions. Collective rationality is rationality’s extension from individuals to groups. The paper’s first few sections review key points about rationality. They identify the features of an individual’s act that make it evaluable for rationality and distinguish rationality’s methods of evaluating acts directly and indirectly controlled. This preliminary work yields general principles of rationality for all agents, both individuals and groups. Applying the general principles to groups answers the paper’s two main questions about collective rationality. (shrink)

Moral rules come with exceptions, and moral judgments come with uncertainty. For instance, stealing is wrong and generally punished. Yet, it could be the case that the thief is stealing food for their family. Such information about the thief's context could flip admonishment to praise. To varying degrees, this type of uncertainty regarding the context of another person's behavior is ever-present in moral judgment. Hence, we propose a model of how people evaluate others’ behavior: We argue that individuals principally judge (...) the righteousness of another person's behavior by assessing the likelihood that they would act the same way if they were in the person's shoes. That is, if you see another person steal, you will consider the contexts where you too would steal and assess the likelihood that any of these contexts are true, given the available information. This idea can be formalized as a Bayesian model that treats moral judgment as probabilistic reasoning. We tested this model across four studies (N = 601) involving either fictional moral vignettes or economic games. The studies yielded converging evidence showing that the proposed model better predicts moral judgment under uncertainty than traditional theories that emphasize social norms or perceived harm/utility. Overall, the present studies support a new model of moral judgment with the potential to unite research on social judgment, decision-making, and probabilistic reasoning. Beyond this specific model, the present studies also more generally speak to how individuals parse uncertainty by integrating across different possibilities. (shrink)

There is a puzzle about how to understand the conclusion of a successful instance of practical reasoning. Do the considerations adduced in reasoning rationalize the particular doing of an action, as Aristotle is sometimes interpreted as claiming? Or does reasoning conclude in the formation of an attitude – an intention, say – that has an action-type as its content? This paper attempts to clarify what is at stake in that debate and defends the latter view against some of its critics.

The object of this paper is to throw light on the reciprocal exchanges between legal philosophy and the theory of speech acts (as developed by Austin and Searle). The first part concerns the contributions to legal philosophy made by the theory of speech acts with a view to developing new perspectives. The second part deals with the contributions of legal philosophy to speech act theory.

This paper considers the meaning of the term ‘intrusive research’, as used in the UK Mental Capacity Act 2005, in relation to studies in which an informant is asked to provide information about or on behalf of a person who lacks capacity to consent, and who is not otherwise involved in the study. The MCA defines ‘intrusive research’ as research that would legally require consent if it involved people with capacity. The relevant ethical principles are that consent should be sought (...) from people who would be affected by a piece of research and that this requirement should be implemented proportionately. The critical question, for investigators and research ethics committees, is: would provision of the personal information specified in the research protocol significantly affect a person whose capacity is not impaired? If the answer to this question is ‘no’, then the study falls outside the definition of ‘intrusive research’, and the MCA does not apply. (shrink)

The approach to managing the involuntary detention of people suffering from psychiatric conditions can be divided into those with clinicians at the forefront of decision-making and those who rely heavily on the judiciary. The system in England and Wales takes a clinical approach where doctors have widespread powers to detain and treat patients involuntarily. A protection in this system is the right of the individual to challenge a decision to deprive them of their liberty or treat them against their will. (...) This protection is provided by the First-tier Tribunal; however, the number of successful appeals is low. In this paper, the system of appeal in England and Wales is outlined. This is followed by a discussion of why so few patients successfully appeal their detention with the conclusion that the current system is flawed. A number of recommendations about how the system might be reformed are offered. (shrink)

When a community has risked its life by confessing its faith, when the cumulative pressures of existence in the world have made faith that dubious, an internal dialogue develops which can be called a dialogue between credulity and skepticism.

Quote marks, I claim, serve to select from the multiple ostensions that are produced whenever any expression is uttered; they act to constrain pragmatic ambiguity or indeterminacy. My argument proceeds by showing that the proffered account fares better than its rivals-the Name, Description, Demonstrative, and Identity Theories. Along the way I shall need to explain and emphasize that quoting is not simply the same thing as mentioning. Quoting, but not mentioning, relies on the use of conventional devices.

A recent note by lan Inkster observed that a Parliamentary Act of 1817 to suppress seditious meetings also posed a threat to scientific lecturers and societies between 1817 and 1820. Further evidence is presented here as to the intentions of the 1817 Act and its effects on science. It is particularly important to add to the observations of Inkster, first, that chartered societies were exempt, and second, that the Act expired on 14 July 1818, although further measures were introduced in (...) December 1819. To explain the provisions of these Acts, especially the distinctions made between lectures held by chartered societies as opposed to independent associations, it is relevant to consider how legislation to prevent seditious meetings and societies in the wake of the French Revolution demarcated between seditious blasphemy and legitimate scientific inquiry. The Acts provide an opportunity of locating science in contreversies over the freedom of speech and association. The questions arise of the relation of the 1817 Act to legislation of 1795, 1799, 1801, and 1819 which imposed licensing on lectures, and of the extent to which repressive legislation inhibited the activities of lecturers and societies. The intellectual repercussions were of such magnitude that the mathematician de Morgan observed in retrospect, ‘From 1815 to 1830 the question of revolution or no revolution lurked in all our English discussions’. My aim in this article is to propose that an insightful way of articulating the feminist concept of epistemic injustice can be provided by paying significant attention to recognition theory. The article intends to provide an account for diagnosing epistemic injustice as a social pathology and also attempts to paint a picture of some social cure of structural forms of epistemic injustice. While there are many virtues to the literature on epistemic injustice, epistemic exclusion and silencing, current discourse on diagnosing (...) as well as explicating and overcoming these social pathologies can be improved and enriched by bringing recognition theory into the conversation: under recognition theory, social normative standards are constructed out of the moral grammar of recognition attributions. A philosophical account of risk, such as this book provides, states what risk is, which attitudes to it are rational, and which acts affecting risks are rational. Attention to the nature of risk reveals two types of risk, first, a chance of a bad event, and, second, an act’s risk in the sense of the volatility of its possible outcomes. The distinction is normatively significant because different general principles of rationality govern attitudes to these two types of risk. Rationality (...) strictly regulates attitudes to the chance of a bad event and is more permissive about attitudes to an act’s risk. Principles of rationality governing attitudes to risk also justify evaluating an act according to its expected utility given that the act’s risk, if any, belongs to every possible outcome of the act. For a rational ideal agent, the expected utilities of the acts available in a decision problem explain the agent’s preferences among the acts. Maximizing expected utility is just following preferences among the acts. This view takes an act’s expected utility, not just as a feature of a representation of preferences among acts, but also as a factor in the explanation of preferences among acts. The view extends to evaluations of combination of acts, either simultaneous or in a sequence. It takes account of an agent’s attitudes to an act’s risk without weakening the standard of expected-utility maximization. The book’s theory of risk also grounds a justification of the risk-return evaluation of investments that finance advances, and a generalized version of this type of evaluation that a professional may use to advise clients about risks and that a government regulatory agency may use to make decisions about risks on behalf of the public. The World Health Organisation encourages that blood donation becomes voluntary and unremunerated, a system already operated in the UK. Drawing on public documents and videos, this paper argues that blood donation is regarded and presented as altruistic and supererogatory. In advertisements, donation is presented as something undertaken for the benefit of others, a matter attracting considerable gratitude from recipients and the collecting organisation. It is argued that regarding blood donation as an act of supererogation is wrongheaded, and an alternative account (...) of blood donation as moral obligation is presented. Two arguments are offered in support of this position. First, the principle of beneficence, understood in a broad consequentialist framework obliges donation where the benefit to the recipient is large and the cost to the donor relatively small. This argument can be applied, with differing levels of normativity, to various acts of donation. Second, the wrongness of free riding requires individuals to contribute to collective systems from which they benefit. Alone and in combination these arguments present moral reasons for donation, recognised in communication strategies elsewhere. Research is required to evaluate the potential effects on donation of a campaign which presents blood donation as moral obligation, but of wider importance is the recognition that other-regarding considerations in relation to our own as well as others’ health result in a range not only of choices but also of obligations. Psychologists and philosophers often work hand in hand to investigate many aspects of moral cognition. In this paper, we want to highlight one aspect that to date has been relatively neglected: the stability of moral judgment over time. After explaining why philosophers and psychologists should consider stability and then surveying previous research, we will present the results of an original three-wave longitudinal study. We asked participants to make judgments about the same acts in a series of sacrificial dilemmas three (...) times, 6–8 days apart. In addition to investigating the stability of our participants’ ratings over time, we also explored some potential explanations for instability. To end, we will discuss these and other potential psychological sources of moral stability (or instability) and highlight possible philosophical implications of our findings. (shrink)

Church-ethical statements in the context of contemporary medicine often give rise to a lot of controversy and commotion. Just think of the debates about medically assisted reproduction, genetics, prenatal diagnosis, stem cell research, organ donation, palliative sedation or euthanasia. Paul Schotsmans notes that many of these statements are inspired by a well-defined ethical model, specifically the act-deontological model. He argues that a more dynamic ethical model (personalism based on Western-European value-systems) creates space for a humane integration of the new medical (...) possibilities. We typically assume that the standard for what is beautiful lies in the eye of the beholder. Yet this is not the case when we consider morality; what we deem morally good is not usually a matter of opinion. Such thoughts push us toward being realists about moral properties, but a cogent theory of moral realism has long been an elusive philosophical goal. Paul Bloomfield here offers a rigorous defense of moral realism, developing an ontology for morality that models the (...) property of being morally good on the property of being physically healthy. The model is assembled systematically; it first presents the metaphysics of healthiness and goodness, then explains our epistemic access to properties such as these, adds a complementary analysis of the semantics and syntax of moral discourse, and finishes with a discussion of how we become motivated to act morally. Bloomfield closely attends to the traditional challenges facing moral realism, and the discussion nimbly ranges from modern medical theory to ancient theories of virtue, and from animal navigation to the nature of normativity. Maintaining a highly readable style throughout, Moral Reality yields one of the most compelling theories of moral realism to date and will appeal to philosophers working on issues in metaphysics or moral philosophy. Evil acts strike us, by their very nature, as not only horrifying and reprehensible, but also as deeply puzzling. No doubt for reasons like this, evil has often been seen as mysterious, demonic and beyond our human powers of understanding. The question I examine in this paper is whether or not we can (or would want to) overcome this puzzlement in the face of evil acts. I shall argue that we ought want to (in all cases) and can (...) (in at least most cases) come to understand why people perpetrate evil acts. This is an appealing conclusion as it allows us to take practical steps to both minimise future occurrences of evil and come to terms with its past abominations. (shrink)

The rejection of the ‘dialectics of nature’ has long been thought of as the most fundamental factor distinguishing Western Marxism from official Soviet-style Marxism. Yet, in Tailism and the Dialectic, Georg Lukács – perhaps the most influential figure in Western Marxism – strongly endorses the existence of an objective dialectic in nature. A close examination of Lukács’s main writings on science shows, however, that he still in effect denied the possibility of applying dialectical method to nature. This paradox is bound (...) up with a dualistic conception of natural and social science with distinctly adverse implications for the development of an ecological Marxism. (shrink)

This increase is warming our planet via the greenhouse effect. What is climate change doing to and for us? Dry regions are drier and wet ones wetter. Wildfires have increased threefold, hurricanes more violent, floods setting record heights, glaciers melting, and seas rising. Parts of Earth are increasingly uninhabitable. Climate change requires us to (...) act as a global community. Climate justice enjoins emitters to pay the social‐environmental costs of fossil fuel burning. This would expedite green solar, wind, and next‐generation nuclear energy sources. Individuals should conserve resources, waste less food, and eat a plant‐rich diet. (shrink)

What is the role of practical thought in determining the intentional action that is performed? Donald Davidson’s influential answer to this question is that thought plays an efficient-causal role: intentional actions are those events that have the correct causal pedigree in the agent's beliefs and desires. But the Causal Theory of Action has always been plagued with the problem of “deviant causal chains,” in which the right action is caused by the right mental state but in the wrong way. This (...) paper addresses an alternative approach to understanding intentional action inspired by G.E.M. Anscombe, interpreting that view as casting practical thought in the role of formal rather than efficient cause of action and thereby avoiding the problem of deviant (efficient) causal chains. Specifically, on the neo-Anscombean view, it is the agent’s “practical knowledge” – non-observational, non-inferential knowledge of what one is doing – that confers the form of intentional action on an event and is the contribution of thought to determining what is intentionally done. This paper argues that the Anscombean view is subject to its own problematic type of deviance: deviant formal causation. What we know non-observationally about what we are doing often includes more than what we intend to be doing; we also know that we are bringing about the foreseen side effects of acting in the intended way. It is argued that the neo-Anscombean view faces difficulty in excluding the expected side effects from the specification of what is intentionally done, whereas the Causal Theory has no such difficulty. Thus, the discussion amounts to an argument in favor of the Causal Theory of Action. (shrink)

We present a computational evaluation of three hypotheses about sources of deficit in sentence comprehension in aphasia: slowed processing, intermittent deficiency, and resource reduction. The ACT-R based Lewis and Vasishth model is used to implement these three proposals. Slowed processing is implemented as slowed execution time of parse steps; intermittent deficiency as increased random noise in activation of elements in memory; and resource reduction as reduced spreading activation. As data, we considered subject vs. object relative sentences, presented in a self-paced (...) listening modality to 56 individuals with aphasia and 46 matched controls. The participants heard the sentences and carried out a picture verification task to decide on an interpretation of the sentence. These response accuracies are used to identify the best parameters that correspond to the three hypotheses mentioned above. We show that controls have more tightly clustered parameter values than IWA; specifically, compared to controls, among IWA there are more individuals with slow parsing times, high noise, and low spreading activation. We find that individual IWA show differential amounts of deficit along the three dimensions of slowed processing, intermittent deficiency, and resource reduction, overall, there is evidence for all three sources of deficit playing a role, and IWA have a more variable range of parameter values than controls. An important implication is that it may be meaningless to talk about sources of deficit with respect to an abstract verage IWA; the focus should be on the individual's differential degrees of deficit along different dimensions, and on understanding the causes of variability in deficit between participants. The configurational dimension, in turn, displays temporal features that may be opposed to these "features" of episodic time. The configurational arrangement makes the succession of events into significant wholes that are the correlate of the act of grouping together. Thanks to this reflective act—in the sense of Kant's Critique of Judgment—the whole plot may be translated into one "thought." "Thought," in this narrative context, may assume various meanings. It may characterize, for instance, following Aristotle's Poetics, the "theme" that accompanies the (...) "fable" or "plot" of a tragedy.1 "Thought" may also designate the "point" of the Hebraic maschal or of the biblical parable, concerning which Jeremias observes that the point of the parable is what allows us to translate it into a proverb or an aphorism. The term "thought" may also apply to the "colligatory terms" used in history writing, such terms as "the Renaissance," "the Industrial Revolution," and so on, which, according to Walsh and Dray, allow us to apprehend a set of historical events under a common denominator. In a word, the correlation between thought and plot supersedes the "then" and "and then" of mere succession. But it would be a complete mistake to consider "thought" as a-chronological. "Fable" and "theme" are as closely tied together as episode and configuration. The time of fable-and theme, if we may make of this a hyphenated expression, is more deeply temporal than the time of merely episodic narratives. · 1. abstract This paper is an investigation of the moral psychology of decisions that involve a conflict of interest. It draws on the burgeoning field of affective neuroscience, which is the study of the neurobiology of emotional systems in the brain. I show that a recent neurocomputational model of how the brain integrates cognitive and affective information in decision‐making can help to answer some important descriptive and normative questions about the moral psychology of conflicts of interest. These questions include: Why are (...) decisions that involve conflicts of interest so common? Why are people so often unaware that they are acting immorally as the result of conflicts of interest? What is the relation of conflicts of interest to other kinds of irrationality, especially self‐deception and weakness of will? What psychological, social, and logical steps can be taken to reduce the occurrence of immoral decisions resulting from conflicts of interest? I discuss five strategies for dealing with conflicts of interest: avoidance, optimal reasoning patterns, disclosure, social oversight, and understanding of neuropsychological processes. (shrink)
