These comments consist of reflections on the papers Anastasios Brenner and R. N. D. Martin presented at the Conference on Pierre Duhem: Historian and Philosopher of Science. I argue they present nicely complementary accounts of Duhem's turn to history of science: Brenner emphasizes reasons internal to Duhem's philosophical concern with scientific methodology while Martin highlights reasons derived from the broader context of Duhem's engagement with religious controversies of his culture. I go on to suggest that seeing Duhem in (...) this broader perspective can help us cope with the conflicts between science and religion in our own culture. (shrink)

A review article on Bruce Anderson and Philip McShane, Beyond Establishment Economics: No Thank-You Mankiw (Nova Scotia: Axial Press, 2002).

In a series of papers R. L. Martin propounds a theory for dealing with the semantical paradoxes. This paper is a criticism of that theory.

We prove that a form of the $Erd\H{o}s$ property (consistent with $V = L\lbrack H_{\omega_2}\rbrack$ and strictly weaker than the Weak Chang's Conjecture at ω1), together with Bounded Martin's Maximum implies that Woodin's principle $\psi_{AC}$ holds, and therefore 2ℵ0 = ℵ2. We also prove that $\psi_{AC}$ implies that every function $f: \omega_1 \rightarrow \omega_1$ is bounded by some canonical function on a club and use this to produce a model of the Bounded Semiproper Forcing Axiom in which Bounded (...) class='Hi'>Martin's Maximum fails. There can be no doubt that discrimination based on sex, race, ethnicity, religion or beliefs should not be tolerated in academia. Surprisingly, however, in recent years, policies of Diversity, Inclusion and Equity(DIE), officially introduced to counteract discrimination, have increasingly led to quite the opposite result: the exclusion of individuals who do not share a radical 'woke' ideology on identity politics (feminism, other gender activisms, critical race theory, etc.), and to the suppression of the academic freedom to discuss such dogmas. Horrendous evils may be considered in a religious context (as in the paper by m mcc adams to which this is a reply). An example from tolstoy of a nonreligious case is discussed. Professor adams's arguments for the refusal of the christian to be overwhelmed by horrendous evils are evaluated in the light of this. They are found inadequate on two grounds: (i) inadequate treatment of the mattering of others; (ii) they undermine the unqualified moral judgment presupposed in the characterization (...) of suffering as 'horrendous evils'. Some critics believe Quine's semantic indeterminacy (indeterminacy of radical translation at home as well as abroad) thesis is true, but innocent, since it is just scientific underdetermination in linguistics. The Quinean reply is that in scientific underdetermination cases there are facts of the matter making claims true or false (whether knowable or not), whereas in semantic indeterminacy cases there simply are not. The critics' rejoinder that there are such facts, studied in linguistics, is met by the final reply that linguistics (...) either on the whole or in part is riddled with appeals to "meanings" and is, thereby, as suspect as analyticity and radical translation. I recommend "saving"(?) linguistics by holding that it is permanently entangled in epistemology. Finally, the argument the critics should have made concerns paralleling semantic indeterminacy to indeterminacies in current quantum mechanics. (shrink)

Health care may be the most regulated industry in the United States, at least in terms of the volume of State and Federal laws and regulations that affect business practices. Lawyers who counsel health care clients often face a dilemma: is the client seeing legitimate advice about the legal limitations on his or her conduct, or is the client seeking to use the lawyer's skills to evade the law? The history of health care fraud prosecutions involving lawyers and other professional (...) advisors in recent years makes this an issue of more than academic interest. The well publicized case of U.S. v. Anderson, in which health care counsel faced charges as co-defendants for purported kickback violations, the recent prosecution of Ernst & Young for allegedly aiding Medicare fraud on behalf of client hospitals, and the recent indictment and conviction of an in-house lawyer in a national durable medical equipment fraud case, make clear that the wrongful use of legal advice by health care clients can lead to significant criminal and civil charges against attorneys.
