Educational philosophy helps to orient the educational development process of each country and develop the capacity of each individual in society. In the educational history of each country, there is always a process of preserving and transferring social heritages. The educational system prepares the next generation to enter society and imparts ideas, values, and beliefs that will shape young people’s thinking and behavior for the rest of their lives. Therefore, this article wishes to clearly and vividly clarify the importance of (...) studying Pragmatism’s educational philosophy to realize its present influence. At the same time, it is crucial to deeply understand the educational process of Pragmatism to derive meaning and clarify the primary function of educating Vietnamese people in the context of current global integration. The article uses the materialist dialectic method with broad and specific historical principles to evaluate Vietnamese education with opportunities and challenges in the current integration process by studying Pragmatism’s philosophical education. The article found that the theory of education by Pragmatism clarifies the role of social educational institutions – schools in the educational process. In parallel, it is a teacher with educational methods and programs that are the basis for educating learners to become comprehensive citizens in the future. And students are the goal and the product that the educational philosophy needs to implement. Research results, the article clarifies the need to develop an educational philosophy for Vietnamese people to build comprehensively in the socialist orientation in the current globalization context. This study contrasts the evidence exclusion principles within the adversarial legal system of the United States, particularly the “fruit of the poisonous tree” doctrine, with the inquisitorial system of Vietnam. The U.S. model, emphasizing the exclusion of unlawfully obtained evidence to protect the presumption of innocence and ensure fair trials, relies on the Fourth Amendment to prevent police misconduct. Conversely, Vietnam, with its focus on uncovering the truth, has started to adopt adversarial elements, including evidence exclusion, to align with international (...) standards and enhance human rights protections within its criminal justice system. The research examines the application of the “fruit of the poisonous tree” doctrine in the U.S. and its implications for Vietnamese legal reforms, especially the proposed amendments to Article 87 of Vietnam's Criminal Procedure Code. These reforms aim to exclude unlawfully obtained evidence while allowing for the use of evidence collected independently from illegal actions. Highlighting the need for a balanced approach that respects procedural rights and promotes justice, the study advocates for comprehensive legal reforms in Vietnam. It suggests amendments to refine evidence exclusion principles, ensuring they reflect both the Vietnamese context and the progressive features of U.S. criminal justice practices, thereby enhancing the fairness and integrity of criminal proceedings. Crime victims are forgotten in criminal proceedings. Criminal justice systems tend to treat crime victims quite poorly, but, when they deal with child victims, their frequent failure to respect the child’s rights finds no excuse. Law enforcement and criminal justice interventions made in the name of protecting children against violent crime often fail to consider what is truly in the best interests of the child and end up further victimizing the child victims. Vietnam has instituted justice reforms that recognize the (...) need for special measures to protect the rights of child victims and witnesses of crime. This article reviews the progress achieved in implementing these reforms and points at several areas where implementation has been slow or further reforms are needed. Based on a comparative legal analysis, the article exemplifies how legal semiotics can contribute to an understanding of the complexity of policy transfer in the area of justice and human rights. Hòa Hảo Buddhism belongs to that traditional lay and frugal buddhism encouraging practicing at home (tu tại gia) while being engaged with the world (nhập thế). It appeared in Southern Vietnam at the end of the 1930’s. Obviously, colonial contest and economic depression have played the part of a powerful catalyst in the spread by a young charismatic and reformist character of this millenarianism. Then, during three decades of postcolonial and cold wars (1945–1975), this New Religious movement hardly expressed its (...) Buddhist ethic of social statements in order to lend moral support and material protection to the local peasantry. Eventually, at the end of the war, this autonomous Buddhist community finally tried to morph again into a legal religion at a time when the Vietnamese Communist Party had to urgently impose a new sovereign socialist republic (1976). In other words, the new regime had to reunify the Nation and build a new secular state. In the southern part of the country, the replacement of a former liberal regime (Republic of Vietnam) by a socialist republic (called formerly a Democratic Republic in Northern Vietnam) completely changed the nature of the State-Church relations. Therefore, many religious groups’ agencies suffered a drastic blow as these groups were subordinated to the Patriotic Front and its mass organizations. Nevertheless, in 1991, the reorientation of the religious policy officially reaffirmed the religions’ social utility. Since then, new debates emerged to define the nature of the social actions of religious groups and then to delineate the legal sphere of their activities in this secular state. This essay intends to question how the two notions of being engaged with the world (nhập thế) and that of the secular state (nhà nước trung lập thế tục) interacted during these last decades. To tackle this pivotal issue, we focused on the specific implementation of Hòa Hảo social activism, from 1940’s until now, to underline how this activism evolved under different political regimes and how a new culture of social service has been promoted since the Hòa Hảo official church was recognized in 1999 and achieved years later. It questions more generally how religious groups can negotiate with the state for the emergence of a civil society or, at least, for the acceptance of their own tribute to the prosperity of the Nation. In the discussion of global ethics, philosophical ethics risks losing its distinct theoretical horizons. This predicament arises primarily from philosophy's failure to anchor its own object and to provide a rational basis for global justice from within its current confined theoretical paradigm. Against this background, this paper will first prioritize global co-existence as the primary concern of global ethics, then propose ontological co-existence justice as its foundational principle, and finally argue that the normative validity of co-existence justice is predicated on (...) the nations fulfilling the critical requirements of modern civilization, namely, the advancement of individual freedom. A comparison of the political ideas of the 18th-century Vietnamese poet, encyclopedist, and government official Lê Quý Đôn and the younger Korean agronomist, philosopher and poet Chŏng Yag-yong as expressed in their commentaries on the Shu jing.

The sixteen essays in this volume confront the current debate about the relationship between philosophy and its history. On the one hand intellectual historians commonly accuse philosophers of writing bad - anachronistic - history of philosophy, and on the other, philosophers have accused intellectual historians of writing bad - antiquarian - history of philosophy. The essays here address this controversy and ask what purpose the history of philosophy should serve. Part I contains more purely theoretical and methodological discussion, of such (...) questions as whether there are 'timeless' philosophical problems, whether the issues of one epoch are commensurable with those of another, and what style is appropriate to the historiography of the subject. The essays in Part II consider a number of case-histories. They present important revisionist scholarship and original contributions on topics drawn from ancient, early modern and more recent philosophy. All the essays have been specially commissioned, and the contributors include many of the leading figures in the field. While post-modernist assaults on modernity correctly expose the pretensions of modernity – including its constructs of meaning in history, its abnegation of mystery, and its lapses into scientism, historicism, and relativism – the philosopher and theologian Bernard Lonergan discerned progress as well as decline in recent intellectual history. In part this is because under contemporary conditions we can avoid the pretensions of modernity, since – in the wake of modern science and modern historical scholarship – we witness the differentiation of (...) interiority, which, properly understood as the discovery of the self, may be seen as leading to a new integration of the spiritual, the intellectual, the moral, and the historical. Vittorio Hösle’s evaluation of the Soviet Revolution on the ground of the philosophy of history can be usefully examined from the value-pluralist perspective of Isaiah Berlin. Although Berlinwould agree with most ofHösle’s judgements on the Revolution, he would do so for very different reasons. Most importantly, Berlin would not accept the teleology that lies at the heart of the philosophy of history. For Berlin, the notion of a human telos to be realized at the end of history is a species (...) of moral monism, and so falsified, indeed rendered incoherent, by the deeply pluralist reality of human values. However, Berlin’s pluralism also seems to present a problem for the justification of liberalism, and I consider a range of responses to this difficulty. (shrink)

Many Victorian philosophers of history attempted to explain what they took to be the evident divergence in the level of civilizational achievement that was attained by different peoples. One prominent paradigm for explaining this divergence was the biological-racialist paradigm. According to this paradigm, endorsed by the likes of Robert Knox, Samuel George Morton, Carl Vogt, and James Hunt, what explains divergence is racial difference. In this paper, I show how one African philosopher, James Africanus Beale Horton, sought to undermine this (...) paradigm and to offer an alternative explanatory paradigm. I argue that Horton presents an alternative paradigm which does not deny that there are divergences that must be explained and which seeks to explain such divergences by appealing to factors such as environmental changes, cultural contact with other societies (and the severing of such contacts), and failures of social organization due to decadence after a period of high civilizational achievement in a given society. Horton presented an alternative philosophy of history which does not give up on the concept of progress, but which also does not condone colonialism and imperialism. (shrink)

The world history is an integral process having dialectically contradictory tendencies. Humanism is an objective tendency of the world history but the alienated tendency prevails in the epoch of globalization. Collisions between civilizations are outcomes of the alienated capitalist world system. Many problems both in practice and in theory are connected with a fortune of humanism and (...) a problem of mutual understanding between representatives of different cultures is among them. hilosophy of history and history of philosophy of science make for an interesting case of “mutual containment”: the former is an object of inquiry for the latter, and the latter is subject to the demands of the former. This article discusses a seminal turn in past philosophy of history with an eye to the practice of historians of philosophy of science. The narrative turn by Danto and Mink represents both a liberation for historians and a new challenge to the objectivity (...) of their findings. I will claim that good sense can be made of “working historical veins of possibility” (contrary to how the phrase was originally intended) and that already Danto and Mink provided materials (although they did not quite advertise them as such) to assuage fears of a constructivist free-for-all. Philosophy of history, theory of history, and historical theory are three existing labels that are sometimes, but not always, treated as synonyms.1 Each of these has been used by both historians and philosophers to define a specific field of inquiry, which entailed its own approaches, methods, concepts, and problems, as well as specific venues and audiences, though these often overlap each other. As such, it is difficult to state clearly which label has been used by which community for what ends.

In many ways, I am reminded of Angus Graham's Disputers of the Tao and Benjamin Schwartz' The World of Thought in Ancient (...) China—but updated. A signal difference is that it is more constrained in its coverage of figures, texts, and especially in having the topical focus upon moral-political philosophy. At the same time and within the chosen (narrower) confines, it often examines its subject in greater detail and draws on more recent discussions.One neat thing that Jiang does is to deliberately weave in explicit discussions of how each subsequent thinker or text incorporated or criticized ideas associated with earlier thinkers. (I formulated it this way since there isn't enough historical evidence about who-actually-read-what in the ancient world, citation practices being what they were.) In this regard, I am especially heartened to read, for example, the sections on "Traces of Mohist Elements in the Laozi" (3.3.2), and "Mohist Elements in Han Feizi's Thought" (7.3.3).By no means should the desultory remarks below be counted as a full review or assessment (impressionistically, this is the sort of book I will recommend that my grad students read—there, I've said it). Think of them as humble shards of pottery thrown in the hope for some jade in response. To make my task more focused, I will comment on the Sinology versus Philosophy distinction, and Jiang's treatment of the Mohists.I. Philosophy and History of PhilosophyAn important part of Jiang's Introduction is devoted to discussing the situation of Chinese Philosophy as a field in the Western Academy, caught between Sinology on the one hand and academic Philosophy on the other. Due to the different scholarly objectives and norms in the two disciplines, scholars working on Chinese Philosophy often find themselves caught [End Page 420] between two distinct audiences who demand different things. Jiang's aim is to propose an "interpretive model to distinguish two sets of scholarly objects operative in Sinology and philosophy. These objects are related and at times overlap, but they are also often irreducibly distinct, i.e., original text versus inherited text, historical author versus textual author, and authorial intent versus textual intent, with the former in the pairs belonging to Sinologists and the latter to philosophers" (p. 7). In general, I am highly sympathetic to the distinctions Jiang draws. But I do wonder if we need to step back and start from a wider context involving what is potentially a deeper divide.Now, it is entirely a caricature but the joke around the water cooler is that philosophers—especially those of a more "analytic" bent—often exude the attitude that they are not in the business of reading old books. Their project is one focused on issues and problems and puzzles that are ultimately about the natural and human world, rather than about texts and their interpretation, or even the historical thinkers themselves. To give some obvious examples, the intellectual questions they see themselves as answering are the likes of:• Can we know that God exists, if God exists at all?• What is the nature of moral claims? Do they admit of truth and falsity?• How is causation related to possibility?• Is a logic that dispenses with the law of non-contradiction viable?• What are the necessary and sufficient conditions of knowledge?• Is abortion morally justifiable?Sometimes the questions they ask even infringe on the results and insights from nearby fields, for instance linguistics and the natural and empirical sciences:• What is time?• Can a presentist conception of time be made consistent with contemporary physics?• What is the nature of consciousness? How is it related to physical neural states or informational computational processes?• Can computers be sentient?• How is morality related to the passions?• In what sense is a political order that does justice to diversity of moral beliefs... The category of the meaning of history has long existed in European philosophy as one of its fundamental themes, which has undergone many collisions during its development. The last century has been marked by a radical revision of approaches to this theme both in the philosophy of history and in the tradition of intellectual history. In the twentieth century, Kant’s historical criticism was taken by German thought to its logical conclusion in such a way that the assertion of the meaning (...) of history has actually suffered a fiasco in the field of rationalist philosophy. The purpose of this article is to attempt to show how the Russian philosopher Nikolai Berdyaev, witnessing the spiritual and political crisis of European and Russian culture, seeks a solution to this problem within the philosophy of history, reformulating the problem of the meaning of history in a metaphysical way. To do this, he investigates theologically the foundations on which the historiosophic projects of the New Age are built, and tries to resolve the contradictions in the understanding of Christian revelation that are revealed in them. Returning the question of the meaning of history to its theological source allows Berdyaev to reconcile the contradictory hopes of philosophers of history for the realization of the personal freedom of its subjects with the existence of a universally meaningful sense in it. In this article, the relationship between philosophy and history of education is delved into. First, it is noted that both disciplines have diverged from each other over the last few decades to become relatively autonomous subsectors within the pedagogical sciences, each with its own discourses, its own expositional characteristics, its own channels of communication, and its own networks. From the perspective of the history of education, it seems as though more affiliation has been sought with the science of history. The (...) history of education, in any event, has in the past few years become more historicizing and less ‘educationalizing’. According to the author, (who is not a philosopher of education) there are signs that indicate that such an analogous line of reasoning, mutatis mutandis, also applies for the philosophy of education. Does this mean that there are no longer any bridges from the one area to the other or that none are possible? Probably not. In the second portion, it is shown that the modern or even postmodern ‘new cultural history of education’, with its often ironical and demythologizing traits uses or can use a considerable amount of ‘grand theory’ (à la Foucault). Indeed, the development of an adequate conceptual apparatus that also has to cope with the problem of ‘presentism’ assumes a constant dialogue with the past and for this a philosophical‐interpretative (casu quo, hermeneutic) approach is still the best situated. Inversely, the Foucauldian perspective shows that philosophy in general and philosophy of education in particular equally hardly do without history. Within the reflection on pedagogical praxis, the historical and the philosophical thus probably will continue to rely on each other—if only as allies against the dominance of short‐winded empirical‐quantitative research. Still, it would be naive to think that, from this possible alliance, the fragmentation of historically developed knowledge systems with their own sociological and institutional foundation of scientific activities can be rectified in a trice.
