In lieu of an abstract, here is a brief excerpt of the content:146 BOOK REVIEWS Natural Law Theory: Contemporary Essays. Edited by ROBERT P. GEORGE. Oxford: Clarendon Press, 1992. Pp. 371. $39.95 (cloth). As the editor of this volume, Robert P. George points out in his foreword that this hook is yet another manifestation of the renewed and growing interest in natural law theory. But why this recent increased interest in natural law theory? What purpose is this theory supposed to (...) serve, or in what way do its proponents see it as an improvement on existing theories? First of all, it must be noted, as the variety of essays in this volume makes abundantly clear, that natural law theory, as it is presently conceived, most certainly does not represent anything like a unified, single theory of tightly knit principles and conclusions. In the present volume one can easily see a half-dozen or more different approaches to natural law theory. So different in tone and spirit are some of the essays that one can easily wonder if they have enough in common even to classify them as " family resemblances." But if they all in their different ways do indeed evidence, as the editor claims, an increased awareness of and interest in natural law theory, the question immediately arises, why this increased interest? What problems do the advocates of these theories hope to solve by them or what questions do they think their theories will better address than the theories currently in place? First of all, one may make a division which places the theories, however divers~ among themselves, into two general groups. The first of these groups wishes natural law theory to function as a general approach to morality. For this group natural law does the work of a moral theory. In this group I would place the essays of Joseph Boyle, Robert George, Russell Bittinger, John Finnis, and Hadley Arkes (probably). The second group uses natural law theory as a way of determining the connection between moral law and positive law or legal theory. The essays of Jeffrey Stout, Neil MacCormick, Jeremy Waldron, Michael Moore, Lloyd Weinreb, Joseph Raz, and Ernest Weinrib fall into this second category. In all there are twelve essays in this volume. Space will not permit me to give a detailed analysis and critique of each. At most I can only indicate very briefly some of their more salient features. The book is divided into four parts, the first of which is titled "Natural Law, Practical Reasoning and Morality." In the very illuminating first essay of this section, "Natural Law and the Ethics of Traditions," Joseph Boyle undertakes to clarify the question of the relation of natural law theory to tradition. Certain approaches to moral theory currently popular BOOK REVIEWS 147 which are called virtues ethics, of which Alasdair Macintyre would he an example, claim that natural law theory is tradition-dependent. If Macintyre and other virtues ethicists are correct, then since natural law theory is culture-hound, and since the culture in which it was horn and flourished, medieval culture, has irretrievably retreated into the pages of history, then natural law theory is equally dead, of interest, if at all, only in an antiquarian way. Boyle carefully points out that there is more than one sense of being tradition-dependent. It is true that natural law theory is tradition-dependent in the sense that it did indeed come into existence in a particular historic epoch and that its language and thought do indeed express the period of its flourishing, i.e. the medieval period. But this, Boyle is careful to point out, does not mean that its validity and meaning were exhausted with the end of that culture. Rather the tradition is a living tradition so that its rich resources can continue to be exploited as that tradition is enlarged by its application to present day moral problems. Boyle's conclusion then is that in some senses natural law is indeed dependent on an ancient and medieval tradition, hut not so totally dependent that it has lost all validity for contemporary moral theory. In his account of power, Bertrand Russell combines a perverse psychological thesis about a will to power for its own sake with an acute perception of different forms power takes. The psychology is that of the most brutal leaders of the 1930s, when Russell wrote. His account focuses on the power of a political leader to compel a following as Hitler, Stalin, and others did. But the strength of his account is its analysis of three distinct forms of (...) power: one grounded in resources, such as weapons, and the others grounded in the coordination of large numbers of people, either by the force of ideas or by the force of institutional arrangements. This third volume of Boston Studies in the Philosophy of Science contains papers which are based upon Colloquia from 1964 to 1966. In most cases, they have been substantially modified subsequent to presentation and discussion. Once again we publish work which goes beyond technical analysis of scientific theories and explanations in order to include philo sophical reflections upon the history of science and also upon the still problematic interactions between metaphysics and science. The philo sophical history of scientific ideas has (...) increasingly been recognized as part of the philosophy of science, and likewise the cultural context of the genesis of such ideas. There is no school or attitude to be taken as de fining the scope or criteria of our Colloquium, and so we seek to under stand both analytic and historical aspects of science. This volume, as the previous two, constitutes a substantial part of our final report to the U. S. National Science Foundation, which has continued its support of the Boston Colloquium for the Philosophy of Science by a grant to Boston University. That report will be concluded by a subse quent volume of these Studies. It is a pleasure to record our thanks to the Foundation for its confidence and funds. We dedicate this book to the memory of Norwood Russell Hanson. Between September 1955 and November 1957 Russell published some sixty-one articles, reviews, statements, contributions to books and letters to editors, over fifty of which are contained in this volume. The texts, several of them hitherto unpublished, reveal the deepening of Russell's commitment to the anti-nuclear struggle, upon which he embarked in the previous volume of Collected Papers ( Man's Peril, 1954-55 ). Political liberalism began in the eighteenth century with the effort to establish a secular state in which religious differences would be tolerated. If religious views include universal principles to apply to all by force if necessary, diverse religions must conflict, perhaps fatally. In a sense, then, political liberalism was an invention to resolve a then current, awful problem. Its proponents were articulate and finally persuasive. There have been many comparable social inventions, many of which have failed, as Communism, egalitarianism, and (...) perhaps socialism have all failed to date. The extraordinary thing about political liberalism is that it seems to have succeeded in its authors' initial hope for it. It may have helped end the turmoil occasioned by religious differences. Political liberalism has since expanded in various ways under other influences, and, if it were not for Islamic fundamentalism with its seemingly coercive theocratic program, we might no longer today associate religious conflict with the core of liberalism in its actual practice. When we press the “A” key on our computer keyboard, an “a” appears on our screen almost simultaneously. In between those two points there are a number of layers of computer program which communicate with each other: the keyboard controller sends a message to the operating system which is interpreted by a word processor, which then returns a message to the operating system, which communicates with the video controller and the video board sends a message that it needs an “a” (...) and this is mapped as a group of pixels which light up on the screen. Except that none of this actually happens. At the level of physical reality, all that happens is the shifting of magnetic fields and the passing of electrons. The electrons orbiting atoms slide from one atom to the next along wires, among silicon and metal. Entities like computer programs and operating systems are. (shrink)

I believe that the time has now arrived when this unsatisfactory state of affairs can be brought to an end'_ - _Bertrand Russell_ So begins _Our Knowledge of the Eternal World_, Bertrand Russell's classic attempt to show by means of examples, the nature, capacity and limitations of the logico-analytical method in philosophy.

Many libertarians believe that self-ownership is a separate matter from ownership of extra-personal property. “No-proviso” libertarians hold that property ownership should be free of any “fair share” constraints, on the grounds that the inability of the very poor to control property leaves their self-ownership intact. By contrast, left-libertarians hold that while no one need compensate others for owning himself, still property owners must compensate others for owning extra-personal property. What would a “self” have to be for these claims to be (...) true? I argue that both of these camps must conceive of the boundaries of the self as including one's body but no part of the extra-personal world. However, other libertarians draw those boundaries differently, so that self-ownership cannot be separated from the right to control extra-personal property after all. In that case, property ownership must be subject to a fair share constraint, but that constraint does not require appropriators to pay compensation. This view, which I call “right libertarianism,” differs importantly from the other types primarily in its conception of the self, which I argue is independently more plausible. (shrink)
