This paper addresses three factors that have contributed to shifts in decision making in health care. First, the notion of patient autonomy, which has changed due to the rise of patient-centred approaches in contemporary health care and the re-conceptualization of the physician-patient relationship. Second, the understanding of patient autonomy has broadened to better engage patient participation. Third, the need to develop cross-cultural health care ethics. Our paper shows that the shift in the West from the individual to the relational self (...) indicates an important change in the understanding of autonomy through the lens of culture. With the advance of biomedicine, certain individuals and groups are vulnerable because of their incapacities to defend themselves. The International Bioethics Committee as a UNESCO working group has for the last several years dedicated to deepen this principle of human vulnerability and personal integrity. The advent of COVID-19 has been the occasion for a renewed interest in the principles governing triage when the number of critically ill patients exceeds the healthcare infrastructure’s capacity in a given location. Some scholars advocate that it would be morally acceptable in a crisis to withdraw resources like life support and ICU beds from one patient in favor of another, if, in the judgment of medical personnel, the other patient has a significantly better prognosis. The paper examines the arguments (...) for and against this approach from the point of view of natural law theory, especially using the principle of double effect. We conclude that it is inadmissible to withdraw life-saving medical interventions from patients who are still benefiting from them, on the sole grounds that other patients might benefit more. Those who are currently using such technology should only interrupt their treatment if, in the judgment of medical personnel and, if possible, taking into account the wishes and needs of the patient and his family, the treatment is deemed futile, burdensome, or disproportionate. This article looks at the question of sin and disease in bioethics with a spiritual-theological analysis from the book of Job. The biblical figure Job is an innocent and just man who suffered horrendously. His dialogues with others—his wife, his friends, and God—can give many valuable insights for patients who suffer and for those who interact with them. Family, friends, physicians, nurses, chaplains, and pastoral workers can learn from Job how to communicate properly with sufferers. The main question for Job (...) was how to maintain the tension between God’s justice and God’s mercy and not yield to the temptation of cursing God but to speak well of Him in moments of difficulties. The author discusses natural law reasoning, from the 1960s in the context of Pope Paul VI’s Humanae vitae, to recent cultural and intellectual currents and their influence on the tradition. The challenges that have skewed acceptance of a common human nature and the existence of natural law are addressed. The author shows how the debate on contraception initiated this challenge against natural law reasoning and led to a more evolutive concept of human nature. The recent comments by Pope Francis on abortion have caused a bit of a stir in the media. His nuanced responses are often lost in the media, and also by advocates on both sides of the abortion debate. While the Catholic position against abortion is common knowledge, this does not preclude an openness to dialogue. This article looks at some recent attempts at dialogue on the controversial topic of abortion. The first example comes from a book that surveys the public (...) view on abortion that surprisingly finds many areas of common ground. Followed by this is a theological reading of Pope Benedict’s encyclical ‘Charity in truth’ that can be the basis of dialogue between parties with divergent views. Truth is a pervasive feature of ordinary language, deserving of systematic study, and few theorists of truth have endeavoured to chronicle the tousled conceptual terrain forming the non-philosopher’s ordinary view. Joseph Ulatowski recasts the philosophical treatment of truth in light of historical and recent work in experimental philosophy. He argues that the commonsense view of truth is deeply fragmented along two axes, across different linguistic discourses and among different demographics. Call this endoxic alethic pluralism. To defend this view, four (...) conclusions must be reached: (1) endoxic alethic pluralism should be compatible with how the everyday person uses truth, (2) the common conception of truth should be derivable from empirical data, (3) this descriptive metaphysical project is one aspect of a normative theory of truth, and (4) endoxic alethic pluralism is at least partially immune to challenges facing the ecological method in experimental philosophy and alethic pluralism. The title of the film by Steve Kloves (1989) refers to the dual-piano, languishing lounge act performed by two brothers. The resurgence and demise of the musical team is brought about by the addition of a sultry, female vocalist--Susie Diamond. Embedded within the story is an exploration of integrity and its augmentation by the virtues of courage and honesty. Integrity marks an individual whose self is a coherent, consistent whole. Important elements of the individual’s personality are mutually supportive rather than (...) being disparate or in conflict. The integrity scrutinized by the film is Jack’s; it involves the younger brother’s inconsistent fidelity to his considerable musical talent. Late in the story we learn that he despises performing the popular musical fare with his brother and that he really wants to be creative, playing jazz. Although Jack is shown playing piano with modulated passion at a jazz club, we infer that he does so infrequently. Jack’s older brother is not in conflict with himself because his talent is suited to playing the bland tunes that are the staple of the act. Jack’s integrity is compromised because his commitment to his art is half-hearted; he cannot make the leap of faith--in himself. He knows that he hates playing the lounge music, is moved by jazz, and has considerable ability. Jack therefore realizes, however vaguely, that he ought to give himself to the music he loves, despite the risks this would entail. The trajectory of the film-story can be viewed as Jack finally summoning the courage to honestly confront his struggle with integrity and deciding to do something about it. (shrink)

While there had been much radical thought before John Stuart Mill, Joseph Persky argues it was Mill, as he moved to the left, who provided the radical wing of liberalism with its first serious analytical foundation, a political economy of progress that still echoes today. A rereading of Mill's mature work suggests his theoretical understanding of accumulation led him to see laissez-faire capitalism as a transitional system. Deeply committed to the egalitarian precepts of the Enlightenment, Mill advocated gradualism and (...) rejected revolutionary expropriation on utilitarian grounds: gradualism, not expropriation, promised meaningful long-term gains for the working classes. He endorsed laissez-faire capitalism because his theory of accumulation saw that system approaching a stationary state characterized by a great reduction in inequality and an expansion of cooperative production. These tendencies, in combination with an aggressive reform agenda made possible by the extension of the franchise, promised to provide a material base for social progress and individual development.The Political Economy of Progress goes on to claim that Mill's radical political economy anticipated more than a little of Marx's analysis of capitalism and laid a foundation for the work of Fabians and other gradualist radicals in the 20th century. More recently, modern philosophic radicals, such as Rawls, have deep links to this Millean political economy. These links are still worthy of development. In particular, a politically meaningful acceptance of Rawls's radical liberalism waits on a movement capable of re-engineering the workplace in a manner consistent with Mill's endorsement of worker management. Joseph Dunne’s essay begins by examining the ways in which schooling in modern liberal–democratic societies tend to function as the agent of cultural homogenization and alienation, and thus block liberal–democratic efforts to offer meaningful recognition of local cultures and to promote the skills and dispositions required for participatory democratic citizenship. The danger here, Dunne points out, is that when the homogenizing elements of modern schooling become dominant, they might serve to encourage an ‘insouciant cosmopolitanism that may fail to meet (...) people’s needs for identity ’. The chapter concludes by reflecting on some possible educational responses that might offer some hopeful ways of addressing such dismal extremes. In particular, he is interested in the educational possibilities offered by a reconfiguration of national identities and state institutions in the emerging European Community in the context of national, cultural, and religious strife that currently besets Northern Ireland. Thus, like Waldron, Dunne sees local cultural identities – be they national, religious, or cultural – as complexly related to, but potentially compatible with, cosmopolitan historical forces. BackgroundBioethics and law distinguish between the practices of "physician-assisted death" and "allowing the patient to die."DiscussionAdvances in biotechnology have allowed medical devices to be used as destination therapy that are designed for the permanent support of cardiac function and/or respiration after irreversible loss of these spontaneous vital functions. For permanent support of cardiac function, single ventricle or biventricular mechanical assist devices and total artificial hearts are implanted in the body. Mechanical ventilators extrinsic to the body are used for permanent support (...) of respiration. Clinical studies have shown that destination therapy with ventricular assist devices improves patient survival compared to medical management, but at the cost of a substantial alteration in end-of-life trajectories. The moral and legal assessment of the appropriateness and permissibility of complying with a patient's request to electively discontinue destination therapy in a life-terminating act in non-futile situations has generated controversy. Some argue that complying with this request is ethically justified because patients have the right to request withdrawal of unwanted treatment and be allowed to die of preexisting disease. Other commentators reject the argument that acceding to an elective request for death by discontinuing destination therapy is 'allowing a patient to die' because of serious flaws in interpreting the intention, causation, and moral responsibility of the ensuing death.SummaryDestination therapy with cardiac and/or ventilatory medical devices replaces native physiological functions and successfully treats a preexisting disease. We posit that discontinuing cardiac and/or ventilatory support at the request of a patient or surrogate can be viewed as allowing the patient to die if--and only if--concurrent lethal pathophysiological conditions are present that are unrelated to those functions already supported by medical devices in destination therapy. In all other cases, compliance with a patient's request constitutes physician-assisted death because of the pathophysiology induced by the turning off of these medical devices, as well as the intention, causation, and moral responsibility of the ensuing death. The distinction between allowing the patient to die and physician-assisted death is pivotal to the moral and legal status of elective requests for death by discontinuing destination cardiac and/or ventilatory medical devices in patients who are not imminently dying. This distinction also represents essential information that must be disclosed to patients and surrogates in advance of consent to this type of therapy. (shrink)

Divine commands are typically held, by theists, to be made not only at the foundations of morality, but also in an 'everyday' setting, when there are already moral considerations applicable to the addressee(s). My aim is to show how a particular command could relate to these pre-existing moral considerations, if it is more than just a repetition of them. If it is right that an action be obligatory, wrong or supererogatory, why would God want to change its status? Anyone can (...) make a normative difference by giving information, making co-ordination proposals, or transferring rights, and it is clear why these actions will sometimes by worthwhile. The problem must be focused on when God makes a moral difference directly, using a 'special moral authority', when His commands are efficacious qua commands. Using this authority, God can perfect imperfect duties, which may make it easier to carry them out. He can extend duties, to make sure more value is produced. He can allocate sacrifices, which can be carried by anyone. And He can resolve conflict games, to everyone's benefit. This explains why God should issue commands in the way that theists typically represent him as doing. (shrink)

_Strategies of Deconstruction _ was first published in 1991. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. In the past two decades, the "movement" of deconstruction has bad tremendous impact on a number of academic, disciplines in the United States. However, its force has been rather limited in the field of philosophy, despite the fact that in Europe the practice of deconstruction emerged in (...) the work of philosophers. Although the reasons for this can be debated, two of the more obvious explanations are the mainstream Anglo-American philosophers rarely studied the German and French philosophical traditions in great detail, and deconstruction's focus on discourse and interpretation has made it more attractive to the literary and humanistic disciplines. With this context, _Strategies of Deconstruction _ focuses on the early work of Jacques Derrida, the French philosopher who introduced deconstruction in _Speech and Phenomena_,his study of Edmund Husserl, and _Of Grammatology_, and whose philosophical reputation stems in no small part from his work on Husserl. In examining the philosophical import of Derrida's theories of reading, text, and language, specifically as they related to _Speech and Phenomena_,J. Claude Evans makes careful reference to Husserl's own texts. His analysis indicates that there are many systematic irregularities in Derrida's study and that without those irregularities Derrida's conclusions cannot be substantiated. (shrink)

In Albert M. Hyamson’s invaluable reference work “The British Consulate in Jerusalem in relation to the Jews in Palestine 1838–1914” a letter from Sir Moses Montefiore is quoted. Montefiore was at that time President of the London committee of Deputies of the British Jews. The letter is addressed to Earl Russell, the Foreign Secretary, and in this letter Montefiore mentions that he is enclosing a Memorial from the Jewish Communities in Safed and Tiberias, complaining about the deplorable condition in which (...) they find themselves as a consequence of the withdrawal of British Protection which they had enjoyed during the preceding 10 years. The original Memorial is an address to Sir Moses Montefiore, sent by the Ashkenazi Chief Rabbis of Safed and Tiberias in 1863. (shrink)

In these learned essays, Joseph M. Levine shows how the idea and method of modern history first began to develop during the Renaissance, when a clear distinction between history and fiction was first proposed. The new claims for history were met by a new skepticism in a debate that still echoes today. Levine's first three essays discuss Thomas More's preoccupation with the distinction between history and fiction Erasmus's biblical criticism and the contribution of Renaissance philology to critical method and (...) the way in which Renaissance rhetoric, as in Thomas Elyot's Book of the Governor, continued to inhibit the autonomy of history. He then shows how these issues persisted into the eighteenth century, even as critical method developed. He concludes with a close description of the great controversy that culminated in Edward Gibbon's day over the authenticity of a biblical text that had been used for centuries to defend the Trinity but which turned out to be a forgery. This is a description of an avian-shaped feature that rests below a network of cellular structures found on a mound within the Argyre Basin of Mars in Mars Global Surveyor image M14-02185, acquired on April 30, 2000, and released to the public on April 4, 2001. The area examined is located near 48.0° South, 55.1° West. The formation is approximately 2,400 meters long from the tip of its beak to the tip of its farthest tail feather. There is a minimum (...) of six different variations in appearance of the surface material over this small area. Utilizing the public targeting request form provided on the Mars Global Surveyor (MGS) website, co-author Miller secured a second image of the area that was obtained on July 3, 2006, showing this feature under different conditions S20-00165. The new image was then released to the public on August 11, 2006. A third image of the formation identified as MGS S13-01480 was acquired on December 15, 2005, and although officially processed on June 20, 2006, it was not made available to the public until August 22, 2009, on NASA’s Planetary Data System (PDS) website. All three of the MGS images reveal defining aspects of this avian feature, including a head, beak, body, eye, leg, foot, toes, wing, and feathers. When taken together, these components induce the visual impression of an avian-shaped formation that exhibits a unique set of proportional features. Adjoining this formation is a composite of complex cellular features that form a compartmentalized infrastructure. The three authors who are veterinarians provide a critical analysis of the avian features, and the geologist and geoscientist authors examine natural mechanisms that could contribute to the formation of this feature. An extensive search of comparable regions within and beyond the area of the Argyre Basin was conducted. A list of these sites is provided, and terrestrial comparisons are also offered. (shrink)

Wilderness Search and Rescue is the process of finding and assisting persons who are lost in remote wilderness areas. Because such areas are often rugged or relatively inaccessible, searching for missing persons can take huge amounts of time and resources. Camera-equipped mini-Unmanned Aerial Vehicles have the potential for speeding up the search process by enabling searchers to view aerial video of an area of interest while closely coordinating with nearby ground searchers. In this paper, we report on lessons learned by (...) trying to use UAVs to support WiSAR. Our research methodology has relied heavily on field trials involving searches conducted under the direction of practicing search and rescue personnel but using simulated missing persons. Lessons from these field trials include the immediate importance of seeing things well in the video, the field need for defining and supporting various roles in the search team, role-specific needs like supporting systematic search by providing a visualization tool to represent the quality of the search, and the on-going need to better support interactions between ground and video searchers. Surprisingly to us, sophisticated autonomous search patterns were less critical than we anticipated, though advances in video enhancement and visualizing search progress, as well as ongoing work to model the likely location of a missing person, open up the possibility of closing the loop between UAV path-planning, search quality, and the likely location of a moving missing person. Parkinson, Joseph Research shows that sexual orientation is neither well defined nor ultimately defining for adolescents seeking self-identity. Rather, the data on instability of sexual orientation among youth and young adults suggest that most of the time unquestioning affirmation of an adolescent's claimed same-sex attraction will do more long-term harm than good. This article explores this complexity and proposes more appropriate ways to provide excellent pastoral care in schools.

Thorstein Veblen is perhaps best thought of as America’s answer to Karl Marx. This is sometimes obscured by the rather unfortunate title of his most important work, The Theory of the Leisure Class (1899), which misleading, insofar as it suggests that the book is just a theory of the “leisure class.” What the book provides is in fact a perfectly general theory of class, not to mention property, economic development, and social evolution. It is, in other words, a system of (...) theory that rivals Marx’s historical materialism with respect to scope, generality and explanatory power. Furthermore, it is a system of theory whose central predictions, with respect to the development of capitalism and the possibilities for emancipatory social change, have proven to be essentially correct. When stacked up against Marx’s prognostications, this success clearly provides the basis for what might best be described as an invidious comparison. (shrink)

Interpreting John Paul II's message to the Pontifical Academy of Sciences in the context of the new scientific discoveries concerning the mitochondrial DNA, one can argue that the human species emerged in Africa some 200,000 years ago. The very problem of the emergence of the human soul in the process of biological evolution represents a subject outside the cognitive competence of science. Attempts can be undertaken to explain this issue in the epistemological perspective of philosophy and theology. In traditional versions (...) of evolutionary theism, God* s interaction in nature was interpreted in causal categories when deterministic dependences were stressed in the process of evolutionary growth. In new proposals, God's presence in an evolving nature has been explained in categories of potentialities and propensities built by God into an evolving Nature. Consequently, in this approach God could be conceived not as a Paleyan designer but rather as a composer unfolding the possibilities hidden in His creation. The future of the evolutionary process depends not only on cosmic physical determinants; it depends to a large extent on the quality of cooperation of human actions with the influence of the Divine Creator. No contexto de novas propostas interpretativas, a presença de Deus na ordem evolutiva tem sido explicada em termos das potencialidades e das propensidades induzidas por Deus na Natureza em evolução. Consequentemente, segundo esta abordagem Deus poderia ser concebido não como sábio projectista de que fala William Paley, mas antes como um compositor fazendo vir ao de cima as possibilidades escondidas na sua própria criação. O futuro do processo evolutivo depende não apenas das determinantes físicas do cosmos; ele depende em larga medida da qualidade da cooperação das acções humanas com a influência do Criador. Neste sentido, o artigo defende que a forma da cultura humana, bem como o estado da consciência moral do homo sapiens deve ser tido em consideração em ordem a se poder discutir a evolução futura da espécie humana. The design argument for God’s existence was critically assessed when in the growth of modern science the cognitive value of teleological categories was called into question. In recent discussions dealing with anthropic principles there has appeared a new version of the design argument, in which cosmic design is described without the use of teleological terms. The weak anthropic principle (WAP), a most critical version of all these principles, describes the fine-tuning of physical parameters necessary to the genesis of carbon-based life. (...)
