The contribution describes the differences between modernism and postmodernism as historical periods of the twentieth century and establishes comparable differences between structuralism and post-structuralism as semiotic approaches. Like modernism, structuralism rejects traditional modes of thought, attempts to reconstruct academic disciplines on the basis of a few fundamental principles and strives to work with reconstructed terminologies and axioms. Like post-modernism, post-structuralism is characterized by the necessity of finding ways to continue research based on the fragmentary results left by structuralist projects. (...) In the beginning of the twentieth century, structuralism itself had responded to materialism, atomism, historicism, and naturalism by introducing its own methodology built around the dichotomies of signified and signifier, paradigm and syntagm, synchrony and diachrony, langue and parole. Rather than rejecting this apparatus, post-structuralism explicated the paradoxes behind these dichotomies and tried to overcome them by under-mining the first concept of each pair. This change of perspective foregrounded the material, processual, and intertextual character of signs as well as the sense-producing function of interpretation. Rejecting rigidly fixed methods as well as general theories, and waiving the distinction between object-signs and meta-signs in favor of their joint reflection, post-structuralist semiotics became an alternative to conventional practices of academic sign analysis and now approaches the status of an art. It is argued, that theory sf signs, especially in the tradition of the great philosopher Charles Sanders Peirce (1839–1914) can inspire the study of central problems in the philosophy of biology. Three such problems are considered: (1) The nature of biology as a science, where a semiotically informed pluralistic approach to the theory of science is introduced. (2) The peculiarity of the general object of biology, where a realistic interpretation of sign- and information-concepts is required to see sign-processes as (...) immanent in nature. (3) The possibility of an artificial construction of life, hereby discussed as a conceptual problem in the present form of the artificial life project and its implied definition of life. (shrink)

Basic, key concepts of semiotic are surveyed en route to establishing signs, units of signification, as always dealing in relations. These relations are triangular and mediate. Signs span and mediate between the internality and externality of things, thing being defined as a composite of subjectivity and objectivity. Because signs are relational and mediate, identicality is postulated as the limit of the sign. Identicality is aligned with things-in-themselves, which are assigned to meta-reality, to associate semiotic and (...) metaphysic. Mind, thought, world, and reality are conceptualized in such a way as to link signs with experience. Experience is explained as being founded in relations and practices between things. These relations and practices are formulated in significations. From these signification relations experience is founded, and through experience identities are situated and selves emerge. Holding experience as being formative of and fundamental to reality, it is concluded that reality is best described as being constituted in signs and ultimately bound by significations and relations between things. Since the beginning of signed language research, the linguistic units have been divided into conventional, standard and fixed signs, all of which were considered as the core of the language, and iconic and productive signs, put at the edge of language. In the present paper, we will review different models proposed by signed language researchers over the years to describe the signed lexicon, showing how to overcome the hierarchical division between standard and productive lexicon. Drawing from the (...) class='Hi'>semiotic insights of Peirce we proposed to look at signs as a triadic construction built on symbolic, iconic, and indexical features. In our model, the different iconic, symbolic, and indexical features of signs are seen as the three sides of the same triangle, detectable in the single linguistic sign. The key aspect is that the dominance of the feature will determine the different use of the linguistic unit, as we will show with examples from different discourse types. (shrink)

The article aims to provide a semiotic interpretation of the sign of the Ecclesiastical Court within the legal framework from temporal and spatial perspectives. The starting point of the research is the idea that the history of the Russian Ecclesiastical Court is inextricably linked to the history of Russian society and secular court. Consideration of the pre-revolutionary ecclesiastical and secular law helps us explore principles of the ecclesiastical proceedings and organization, identify contradictions in understanding modern Ecclesiastical Court. Its sign (...) is not only limited to the legal interpretation. In his novel The Brothers Karamazov, Dostoevsky F. M. gave the sign of the Ecclesiastical Court symbolic meaning and, thus, expanded it beyond the existing legal framework. The Ecclesiastical Court is one of the symbols of Russian spirituality which is reflected in the concept of “Russian soul”. Rational elements of the sign of Ecclesiastical Court as well as its sensual and metaphorical components, are analyzed using the category of Truth. Clearly, the Cross is sign-symbol for Christianity. But if applied to the concept of Ecclesiastical Court, the Orthodox Cross becomes a sign-index. As a result, several semantically heterogeneous meanings of the sign of Ecclesiastical Court are revealed and described. (shrink)

This volume provides a critical roadmap through the major historical sources of legal semiotics as we know them today. The history of legal semiotics, now at least a century old, has never been written (a non-event itself pregnant with semiotic possibility). As a consequence, its sources are seldom clearly exposed and, as word, object and meaning change, are sometimes lost. They reach from an English translation of the 1916 inaugural lecture of the first Chair in Legal Significs at the (...) Amsterdam University, via mid 20th century studies on "property" or "contract," to equally fascinating essays on contemporary semiotic problems produced by former students of the Roberta Kevelson Semiotics Roundtable Seminar at Penn State University 2012 and 2013. Together, the materials in this book weave the fabric of semiotics and significs, two names for the unfolding of semiotics in law and legal discourse at least until the second half of the 20th century, and both of which covered a lawyer's focus on sign and meaning in law. The latter is embedded within the cultural imperatives of the civilization that gave these terms meaning and made them an effective tool for the dissection of law, its reconstitution as an instrument to be used by the lawyer to advance the interests of her clients, and for judges as a means to restructure language as a narrative of law whose power could bend behavior to its strictures. Legal semiotics has become an indispensible part of the elite lawyer's toolkit and a fundamental approach to analysis of legal texts. Two previous volumes published in 2011 and 2012 explored the conceptual, methodological and epistemological progress in the field of legal semiotics, the modern forms of semiotics study, and the mechanics of meaning making processes by lawyers. Yet the great lessons of semiotics requires a focus on the origins of the concepts and frameworks that would become contemporary legal semiotics, its origins as an object of the consciousness of meaning making-one whose roots, as lessons for the oracular conversations of law, are expanded in this volume. This book presents programmatic texts on biosemiotics, written collectively by world leading scholars in the field (Deacon, Emmeche, Favareau, Hoffmeyer, Kull, Markoš, Pattee, Stjernfelt). In addition, the book includes chapters which focus closely on semiotic case studies (Bruni, Kotov, Maran, Neuman, Turovski). According to the central thesis of biosemiotics, sign processes characterise all living systems and the very nature of life, and their diverse phenomena can be best explained via the dynamics and typology of sign relations. This article applies some conceptual tools from semiotics to better understand the disastrous impacts of the world economy on global ecology. It traces the accelerating production of material disorder and waste to the logic of the money sign, as economic production processes simultaneously increase exchange-values and entropy. The exchange of indexical and iconic signs is essential to the dynamics of ecological systems and the proliferation of biological diversity. The human species has added a third kind of sign, the symbol, (...) and more recently a fourth: all-purpose money. Money does not refer to any referent either through contiguity, similarity, or convention. It is an empty sign, capable of assuming any significance that its owner attributes to it. The article argues that the concept of symbolic reference should be restricted to cultural and linguistic phenomena. Money qualifies as a new species of sign based on its exceedingly open mode of reference. It does not refer to any object by social convention but owes its specific properties precisely to the absence of such conventions. The logic of money pivots on decontextualisation: it presupposes and encourages the detachment of exchange values, people, and concepts from the particular and the local. Selective advantage is no longer primarily about calibration within local contexts, but increasingly a matter of transcending or emancipating oneself from the specific. This drift toward decontextualisation reverses the evolution of complexity and diversity throughout the planetary biosphere. (shrink)

Semiotics, the theory of sign and meaning, may help physicians complement the project of interpreting signs and symptoms into diagnoses. A sign stands for something. We communicate indirectly through signs, and make sense of our world by interpreting signs into meaning. Thus, through association and inference, we transform flowers into love, Othello into jealousy, and chest pain into heart attack. Medical semiotics is part of general semiotics, which means the study of life of signs within society. (...) With special reference to a case story, elements from general semiotics, together with two theoreticians of equal importance, the Swiss linguist Ferdinand de Saussure and the American logician Charles Sanders Peirce, are presented. Two different modes of understanding clinical medicine are contrasted to illustrate the external link between what we believe or suggest, on the one hand, and the external reality on the other hand. This book analyses various examples of the imaginative semiotisation of the Fall of Man and the Church's semiotic perception of the Divine plan for Redemption. Based on a close reading of primary sources, it analyses the meaning-making inherent in these ideas, which are filtered through and given material representation by the semiotic paradigms of various cultural fields, including philology, verbal arts and science.

Translation in the Middle Ages did not involve the same constraints as translation today for various reasons, which this article will attempt to highlight through a semiotic analysis of the opposing powers and other translation-related pressures which interact in the translation process. This process involves a source language and a target language, but above all a source culture and target culture. Translation in the Middle Ages, like translation today, is primarily about taking into consideration certain constraints, some of which (...) are shared between the two eras but which, in all cases, take into account the period in which they were translated. Indeed, an era involves modes of thought, political and religious ideologies, translation and stylistic practices that are unique to that particular time. If, as example periods, we have chosen two eras which are quite remote from each other, it is to demonstrate that the issues certainly differ, but not as much as one might imagine, particularly in certain political and ideological contexts. This paper analyses the immunological response of breast cancer patients through the lens of medical semiotics. From this perspective both psychological and physiological symptoms are treated as a set of transitive signs. The symptomatic journey of breast cancer patients was documented through an ethnographic engagement with a breast cancer charity. This journey consists of diagnosis, treatment and remission, where both the physical and psychological trauma maybe irreversible. Equally the genetic disposition of each patient and the variability of the treatment (...) give rise to a plethora of possible immunological responses. The case study organization provided both therapeutic treatment but also sold oncology products to its patients, matching the products’ composition to the specific immunological responses caused by breast cancer treatment, e.g., brittle skins or hair loss, etc. This paper explores how the varied and transient nature of immunological semiosis is identified and commoditized into an economic process. This challenging social context is of interest from a semiotic stand point because it offers a singular paradigm to explain the evolution of signs and symptoms into sales. (shrink)

Peirce's "Neglected Argument" uses more or less standard logical vocabulary, such as "argument," "retroduction," "premise," "conclusion," and "hypothesis." There cannot be any doubt, however, that the musement process as he characterizes it must be regarded as a semiotic process—that is, one that relates a sign to an object by way of forming an interpretant. This assumption follows from the simple observation that, according to Peirce, all processes of thought are semiotically structured. Specific systems of connotations and their relations with semantic structures, paradigmatics, and typical signal structures are described. _How to Make Our Signs Clear_ focuses on selected aspects of Peirce´s philosophy and semiotic, possible historical connections of his work and contemporary challenges to Peirce’s semiotic theories.

In 1976, Richard Dawkins coined the term meme as a way to metaphorically project bio-evolutionary principles upon the processes of cultural and social development. The works of Dawkins and of some other enthusiasts had contributed to a rise in popularity of the concept of memetics (“study of memes”), but the interest to this new field started to decline quite soon. The conceptual apparatus of memetics was based on a number of quasi-biological terms, but the emerging discipline failed to go beyond (...) those initial metaphors. This article is an attempt to rebuild the toolkit of memetics with the help of the more fundamental concepts taken from semiotics and to propose a synthetic conceptual framework connecting genetics and memetics, in which semiotics is used as the transdisciplinary methodology for both disciplines. The concept of sign is used as the meta-lingual equivalent for both the concepts of gene and meme. In the most general understanding, sign is a thing which stands for another thing. In genetics, this translates into gene that is a section of DNA that stands for the algorithm of how a particular biomolecule is built. In memetics, the similar principle works in meme that is a thing that stands for the rules of how a particular cultural practice is performed. (shrink)

Lawyers write, blog and are otherwise producers of words; they structure public life through legal discourse and integrate all issues that reinforce legal reasoning. Even if one is inclined not to justify the power of their words in the context of a democratic theory, one is hardly able to challenge its public acceptance. But semiotic analyses harden the question whether these emperors wear nothing but robes. That attitude intensifies where medicine becomes increasingly relevant for legal discourse, as becomes clear (...) where for instance US political viewpoints bring bioethical issues to the Courts. One major theme in today’s medicine pertains to identity in its psychological, philosophical and social dimensions. Identity thus becomes a groundbreaking semiotic issue in law and medicine; both discourses are particular important to the otherness of the other. A US criminal law case interests here (Harrington v. State of Iowa, 2003; cited as: 659N.W.2d 509). The case is decided with “information about what the person has stored in his brain”. A chain of signs is involved: from “brain-function” to “brain-storage” via “brain-scan” to “brain-fingerprint”, for which the case became famous. A long series of signs and meanings belong here to intertwined discourses. Central is a particular sign in each discourse: “brain” means brain scan, and “fingerprint” means law! The two display trading mechanisms, which determine the otherness of the other and the self! The chain of signs in the Harrington case shows inter-disciplinarity in law and inter-discursivity among law and medicine. The trading itself underlines the semiotic dimensions in cyberspace, in particular the semiotics of the virtual (Hayles, Kurzweil) and their effects on legal discourse. (shrink)

While writing the foreword for this special edition of the International Journal for the Semiotics of Law, I was informed of Dr. Nelson R. Mandela’s death. While saddened with his passing, I was struck by the fact, he was one of the two men who most influenced my study and practice of Restorative Justice; the other was my father. Both passed away while this edition was compiled and edited.In the mid 1990s, I first read about Restorative Justice as an aspect (...) of the Truth and Reconciliation Commission (“TRC”) established by Dr. Mandela in post-apartheid South Africa. I was fascinated by his forgiveness of his oppressors and how he infused the ideals of reconciliation and forgiveness into a court-like hearing. It was an opportunity for the victim of human rights violations to face the perpetrator and tell the perpetrator the extent of the injuries he or she suffered. After the victim spoke, the perpetrator had an opportunity to admit to the wrongdoing, take full responsibility for the har. (shrink)

This engaging book examines the origins and first effects of the concept ‘legal semiotics’, focusing on the inventor of the term, Roberta Kevelson. It highlights the importance of her ideas and works which have contributed to legal theory, legal interpretation and philosophy of language. Kevelson’s work is particularly relevant today, in our world of global electronic communication networks which rely so much on language, signs, signals and shortcuts. Kevelson could not have foreseen the 21st century, yet the story of (...) her work and influence deserves more attention as it is key to our understanding of modern legal discourse and why law fascinates and is accepted in modern society. The authors draw on Kevelson’s hitherto unknown Office Papers and Notes, and a biographical examination points to key influences in her work such as the early feminist movements of the US East Coast, the philosophy of Charles Sanders Peirce and the semiotics of Thomas Sebeok. This forms the basis for a more encompassing research of Kevelson’s position, work and philosophical background, which the authors call for. A quick and enlightening read, this book interests a wide range of readers with an interest in legal history and the fields which Kevelson both drew on and influenced, including lawyers, students and scholars. Semiotics, the age-old investigation of signs, is still striving for acknowledgement as a scientific discipline. Though the ‘linguistic turn’ in the philosophical disciplines seemed to be followed by a ‘semiotic turn’ in many sciences during the 1970s, efforts were not crowned by great success. When seen from a certain distance, a definition of semiotics as a discipline can only be obtained from its history. Research into the sources of the human pre-occupation with signs, and with concepts or (...) conceptions of signs, is really desirable and even necessary when a field of considerable scientific interest at the brink of being awarded the rank of a discipline runs the risk of getting lost between the unificationism of the Morris-type and the elegance of pseudo-mathematical empty classificationism on the one side, and profitable exploitation of the sign's popularized design qualities on the other. This article analyses the use of signs (in a semiotic sense) in the analysis of Teresa of Avila's book, The Interior Castle. It takes one through the various levels of the castle, which stands as a sign for contemplation. Exploring Avila's creative use of imagery and language, it focus on what these signs (as pertaining to American semiotics and Charles S. Peirce) come to signify within Teresa's mental construction of the castle as a road to pure contemplation, (...) in the Catholic tradition. (shrink)

This paper demonstrates that Edmund Husserl’s frequently overlooked 1890 manuscript, “On the Logic of Signs,” when closely investigated, reveals itself to be the hermeneutical touchstone for his seminal 1891 Philosophy of Arithmetic. As the former comprises Husserl’s earliest attempt to account for all of the different kinds of signitive experience, his conclusions there can be directly applied to the latter, which is focused on one particular type of sign; namely, number signs. Husserl’s 1890 descriptions of motivating and replacing (...) signs will be respectively employed to clarify his 1891 understanding of the authentic and inauthentic presentations of numbers via number signs. Moreover, his schematic classification of replacement-signs in Semiotic will illuminate the reasons why he believed the number system to be necessary for the operation of replacing number signs.
