Jurisprudence is the prudence of jus, law's consciousness and conscience. Throughout history, when thinkers wanted to contemplate the organisation of society or the relationship between authority and the subject, they turned to law. All great philosophers, from Plato to Hobbes, Kant, Hegel, Marx and Weber had either studied the law or had a deep understanding of legal operations. But jurisprudence is also the conscience of law, the exploration of law's justice and of an ideal law or equity at (...) the bar of which state law is always judged. Jurisprudence brings together 'is' and 'ought', the positive and the normative, law and justice. But after a long process of decay, legal theory is today characterised by cognitive and moral poverty. Jurisprudence has become restricted and academically peripheral, a guidebook to technocratic legalism and a legitimation of the existent. Critical jurisprudence returns to the classical tradition of a general philosophy of law and adopts a much wider concept of legality. It is concerned both with posited law and with the law of the law. All legal aspects of the economic, political, emotional and physical modes of production and reproduction of society are part of critical jurisprudence. This widening of scope allows a radical rethinking of the nature of rights, justice, sovereignty and judgement. A political philosophy of justice today must examine the political economy of law; transitions from Empire to nation; ideological and imaginary constructions through which we understand ourselves and relate to others; ways in which gender, race or sexuality create forms of identity that both discipline bodies and offer sites of resistance. Law's complicity with political oppression, violence and racism has to be faced before it is possible to speak of a new beginning for legal thought, which in turn is the necessary precondition for a theory of justice. Critical Jurisprudence offers an ethics of law against the nihilism of power and an aesthetics of existence for the melancholic lawyer. (shrink)

Recent histories of American jurisprudence tend to ignore the fact that ideas that appeared in the United States often appeared simultaneously in Europe. Even those works that do not ignore the European context are content with tracing the influence or reception of European thought in America. This article suggests that another possible approach is to compare jurisprudential developments in the United States, Europe, and other places in order to reach more general, sociology-of-knowledge-like insights into the reasons why certain ideas (...) appear at certain times and places. One concrete example is discussed: the rise of an interest in the distinction between formal and "living" law in American and European jurisprudence in the first decade of the twentieth century. This distinction was central to the work of Roscoe Pound in the United States and the work of the Austro-Hungarian legal thinker Eugen Ehrlich. Pound and Ehrlich shared similar personal backgrounds. When they began advocating the study of informal law, both Pound and Ehrlich were teaching law in provincial towns situated on the frontiers of empires. Both towns were marginal places where different cultures clashed and where the legal culture of the center of the empire had only a tenuous hold. Scholars working in such an environment, it is argued, would tend to be more aware of the gap between formal state law and the actual norms governing the daily lives of people than scholars working at the center of an empire. The article offers additional support for this argument by looking at the scholarship of Guido Tedeschi, an Italian-Israeli legal scholar who taught at the Hebrew University of Jerusalem in the 1940s. The article concludes by calling for the study of the history of American jurisprudence from a comparative perspective, taking into account such issues as the interaction between center and periphery and between empire and provinces in more than one national context. This is the first full analysis of Adam Smith's jurisprudence; it emphasizes its normative and critical function, and relates this to the psychological, sociological, and histroical aspects which hitherto have attracted most attention. Dr Haakonssen is critical of both purely descriptivist and utilitarian interpretations of Smith's moral and political philosophy, and demonstrates the implausibility of regarding Smith's view of history as pseudo-economic or 'materialist'. This book is a study of an important revolution in the history of thought, a break-through on the twin fronts of law and history in which the outstanding campaigner, on both fronts, was Jean Bodin. Roman law was, from its revival in the eleventh down to the beginning of the sixteenth century, studied and interpreted in a very literal and textual fashion; it was assumed that the Codification of Justinian included all the legal wisdom there was and that the function (...) of the glossator was simply to show it forth. The sixteenth century philologists, led by Budé, raised serious doubts. And by the middle of the same century there was not merely a demand for a proper philological study of the texts but for a systematization of the vast mass of legal disposition that constituted the Corpus Iuris Civilis—jus in artem redigere. The result was an undermining of the authority of Roman law and a realisation that, while it might be an incomparable store of legal wisdom, there was no good reason for thinking that it was the only, or the best, system for actual conditions in sixteenth-century France. French customary law, which by now had been written down, was clearly adapted to the needs of the time in a way that Roman law never could be. This may seem obvious; but the realization of the obvious took time. And Bodin’s importance lies in his working out of a three-pronged comparative approach in his exposition of jus gentium, his comparative jurisprudence and his sociological theory of legal history. Reading A Sociology of Modernity made me turn again towards history and encounter the path of a historical sociology. One can say that Peter Wagner´s work opens up particularly rich perspectives towards a new consideration of the complex relations between sociology and history and on the consequences that the internal movements within each discipline have had on the other. I shall approach some issues regarding these relations by looking, first, at the theme of temporality and at the distinction between the (...) past and a present (often turned towards the horizon of the future) and, second, at the theme of the events and their frequent contradistinction to structures. Sociology once debated ‘the social’ and did so with a public readership. Even as late as the Second World War, sociologists commanded a wide public on questions about the nature of society, altruism and the direction of social evolution. As a result of several waves of professionalization, however, these issues have vanished from academic sociology and from the public writings of sociologists. From the 1960s onwards sociologists instead wrote for the public by supporting social movements. Discussion within sociology became constrained (...) both by ‘professional’ expectations and political taboos. Yet the original motivating concerns of sociology and its public, such as the compatibility of socialism and Darwinism, the nature of society, and the process of social evolution, did not cease to be of public interest. With sociologists showing little interest in satisfying the demand, it was met by non-sociologists, with the result that sociology lost both its intellectual public, as distinct from affinity groups, and its claim on these topics.
