The Other's War is an intervention into a set of contemporary moral, political and legal debates over the legitimacy of war and terrorism within the context of the so-called global War on Terror. Tarik Kochi considers how, despite the variety of its approaches âe" just war theory, classical realist, post-Kantian, poststructuralist âe" contemporary ethical, political and legal philosophy still struggles to produce a convincing account of war. Focusing on the philosophical problem of the rightness of war, The Other's War (...) responds to this lack. Through a discussion of a number of key Western intellectual traditions, Kochi demonstrates how often conflicting and contradictory conceptions of warâe(tm)s rightness have developed in modernity. He shows how a process of ordering violence around different notions of right has constantly redrawn the boundaries of what constitutes âe~legitimateâe(tm) violence. Such a process has consequences for anyone who claims to be fighting a âe~just warâe(tm). Building upon this account and drawing upon the philosophical heritage of G.W.F. Hegel and Ernst Bloch, The Otherâe(tm)s War proposes a new understanding of war, not just as a social condition characterised by violent conflict and struggles for power, but as the attempt of individuals and groups to realise their normative claims through violence. Kochi argues that both of these aspects of war are an expression of the metaphysics of human subjectivity. War begins with, and is the radical exaggeration of, a fundamental activity of human subjectivity, in which the subject constitutes its normative and material identity; realising and positing itself through acts that involve negation and violence. By drawing consideration of the problem of war back to the level of a philosophical examination of the metaphysics of human subjectivity, The Other's War develops a novel theory of war that helps us to better understand the nature of contemporary conflict as a process of recognition. This paper discusses the D-N model of scientific explanation. It is suggested that explanation is a part of assertive discourse where certain principles must be observed. Then use is made of the relation between the informative content and logical content of a sentence (as shown, for instance, by Popper) to draw some of the conditions necessary for a sound model. It is claimed that the conditions of the model proposed in the present paper exhaust the insights of the papers in (...) the literature, solve the difficulties encountered by other authors, but have some damaging consequences on the D-N model of scientific explanation. Jan-Werner Müller’s analysis of ‘authoritarian populism’ represents a highly limited approach to the issue that is typical of many mainstream approaches within populism studies and liberal-democratic constitutional theory. Through a critique of Müller, the article develops an account of the historical emergence of authoritarian populism as a ‘long counter-revolution of the radical right’ against the values and institutions of the social-democratic welfare state. Focussing on the USA and UK, the article shows how, rather than being a novel phenomenon emerging from (...) the fringes in the 1980s and 1990s, authoritarian populism emerges from the middle of the twentieth century as a highly successful form of hegemonic struggle over the Republican and Conservative parties and over American and British societies. The political success of a highly contradictory ideological framework of the radical right has helped to largely normalise a language, rhetoric and imaginary of authoritarian populism and place it at the centre of contemporary politics and culture. By largely ignoring such a development, and the highly contingent nature of North Atlantic ‘democracy’, theorists and commentators like Müller fail to grasp the depth of the current authoritarian populist threat and offer only liberal-democratic mythology in response to the ranting and chanting of ‘fake news’. In this article, I engage with aesthetic experience as a central hermeneutic endeavour for theorising performing arts audiences in the Arab region. I argue that a critical engagement with Arab performing arts audiences’ aesthetic experiences necessitates both an archaeological manoeuver and a re-articulation of two keywords: ‘experience’ and ‘everyday’. The article advances, using evidence from research, that allowing the audiences of performing arts in the Arab region to speak may be a step towards democratising the triangular meaning making process among (...) the performer, the audience, and the art institution, and a means towards dislocating, if not liberating, the categories Arab culture, art, performance, and experience, from their teleological articulations. The rapid evolution that has taken place since the state reform of 1980 has made the need felt that some options of this state reform must be adjusted. In spite of this need, the core question is whether or not one should, in the first place, adapt the structures of the national government so it can carry out its national tasks. The clear establishment of communities and regions, the structuring of the political parties on the basis of these entities, the (...) socio-economic substratum that is based on the duality, of the country, are indexes that show that the regions have numerous policy supporting structures while they are virtually absent on the national level. The political decision making on the national level is very restricted in this perspective. The state reform of 1980 has established three levels of equal standing between which the division is total. However, the probem immediately arises of a common parliament and a socio-economic substratum on which a national parliament and a national government should be able to rest if the Belgian state is to survive with its substructures. The solution here is twofold : either the substructures wilt have to create organs of the central state or the organs of the central state wilt have to be assembled on the basis of a national political election free of the substructures. El tango es la música más evocativa del área del Río de la Plata. Mucho se ha dicho y escrito sobre este género que conquistó multitudes en varios contextos históricos y en diferentes lugares del mundo, pero existe un problema de visibilidad. En sus inicios y posterior desarrollo hay un aporte que se ha silenciado, el de la africanía, en línea con el blanqueo y el discurso histórico en Argentina que ha convertido al colectivo africano y afrodescendiente en el “primer (...) desaparecido”, un discurso que se repite hasta el hartazgo desde el sentido común y con el que resulta complicado lidiar. Si la música es una importante generadora de identidades, es necesario no perder de vista la participación y la impronta afro en el género arquetípico que define la argentinidad, y es característico de la región rioplatense, puesto que hace a la definición de un marco multicultural en donde la huella africana, entre otras, define el ser argentino y, en general, su impronta es fuerte en el área del Río de la Plata. Según estimaciones y pruebas pilotos, se estiman dos millones de afrodescendientes en Argentina y el último Censo indicó casi 150.000 auto-reconocidos/as a sí mismos/as, por primera vez en la historia nacional. This essay presents an interpretation of the juridical thought of Cicero, Hugo Grotius and Adam Smith. Focussing upon questions of property, capital accumulation and violence, the essay traces a tension within their writings between a social ethic of human fellowship and compassion, and, a theory of the utility of ‘unsocial’ commercial self-interest. This tension forms a key problem for the tradition of liberal international law. For Grotius and Smith one response to this tension is to attempt to reign in capitalist (...) markets by asserting a range of moral duties to individuals and to the nation-state. The importance of stressing such an interpretation is to reject the flattening-out of the liberal political and juridical tradition by contemporary neoliberal thought, and to reclaim a number of ways of thinking about the global economy and international law in which moral action and political intervention are understood as playing a necessary and essential role. O artigo examina a concepção de Searle sobre a redução da consciência (em especial a sua teoria acerca de seus poderes causais), que se mostra obscura e incoerente. Porém, essa incoerência não é inevitável, pois o naturalismo biológico possui elementos que permitiriam a articulação de uma teoria mais clara a respeito das capacidades causais. O exame da teoria de Pereboom e Kornblith possibilita entender por que a afirmação de identidade das capacidades causais leva a um reducionismo. John Searle claims that consciousness is ontologically subjective, since conscious mental phenomena only exist as long as they are experienced. Therefore, mental phenomena are essentially conscious, insofar as their mental character depends on their connection with consciousness. However, to align the acceptance of unconscious mental phenomena with his Cartesian view of consciousness, Searle defends adispositional account of the unconscious. The problem is that some cases of unconscious mental causation require that certain decisive mental properties exist in an occurrent way, and (...) not merely as dispositions. By accepting unconscious mental causation, Searle commits himself to a mental existence that isindependent from consciousness. Filozofların tasarladıkları şehir ve devlet modelleri kendi düşünceleri çerçevesinde ideal felsefi ortamın yaşanacağı toplumu da öne çıkarmaktadır. Üretilen bu düşüncelerden bazıları ütopya olarak değerlendirilmiş ve hayata geçirilme imkânı açısından eleştiriye tabi tutulmuştur. Platonopolis adı verilen bu şehir çeşitli sebeplerden dolayı kurulamamıştır. Diğeri ise 9 ve 10. yüzyıllarda Ortadoğu’da yaşamış olan el-Farabi’dir. O da ‘el-Medīnetü’l-Fāḍıla’ adını verdiği bir erdemli şehir tasavvur etmiştir. el-Farabi devletin yönetim sistemini varlık hiyerarşisinin Tanrı tarafından yönetilmesine benzeterek insan ve toplum düşüncesini ele almış ve ideal düşünsel ortamın nasıl ortaya çıkacağını göstermeye çalışmıştır. O artigo examina a teoria de David Armstrong sobre a consciência e sua concepção do inconsciente. Após uma discussão do caráter anti-cartesiano dessa teoria, são discutidas as noções de consciência mínima e consciência perceptiva, bem como o conceito de consciência introspectiva, que é o mais importante para Armstrong. A conclusão é que, apesar do valor explicativo dos seus conceitos de consciência, Armstrong defende uma perspectiva insatisfatória a respeito do inconsciente, pois essa perspectiva não dá conta da real influência do inconsciente (...) em nossa vida mental. In this paper, we offer an overview of Aristotle’s account for his belief that honeybees reproduce without copulation. Following this, we draw the three following implications: First, that Aristotle’s position on this question is quite unconventional, and undercuts many traditional and “Aristotelian” hierarchies; secondly, that the method that requires him to hold this unconventional position is largely dialectical; and finally, that the lineage behind this method is Socratic. In this sense, Aristotle’s biological work may be seen as taking up where (...) young Socrates left off according to his autobiographical remark in Plato’s Phaedo 95E-99E. (shrink)

I Das Grenzland Im Jahre 1772 annektierte das Habsburgerreich im Süden Polens gelegene Gebiete und gliederte sie als „Königreich Galizien und Lodomerien“ in seinen Herrschaftsbereich ein. Nach dem Zusammenbruch der Habsburger Monarchie im I. Weltkrieg wurde Galizien 1918 Teil des erneut unabhängigen Polen. In Ostgalizien gründeten ukrainische Nationalisten eine kurzlebige „West-Ukrainische Republik“. Im Anschluss weiterer Kampfhandlungen zwischen Polen, Ukrainern und Sowjets annektierte Polen dann ganz Ostgalizien, das von den Polen „Kleines Ostpolen“ genannt wurde, einschließlich der nördlichen Gebiete Wolhyniens und Polesiens. (...) Die im Gefolge des Kriegsendes neu entstandenen Grenzen wurden 1923 international anerkannt. Ostgalizien und Wolhynien wurden 1939 von der UdSSR annektiert und der ukrainischen Sowjetrepublik angegliedert. Während der deutschen Besatzung zwischen 1941–1944 war Ostgalizien Teil des von den Deutschen kontrollierten Generalgouvernements Polen. Im Anschluss an die Befreiung dieser Gebiete durch die Rote Armee kam Ostgalizien wiederum an die ukrainische Sowjetrepublik. Seit der ukrainischen Unabhängigkeit 1991 ist es Teil der West-Ukraine. Das ehemalige ostgalizische Grenzlandgebiet erstreckt sich von der im Norden gelegenen Kreishauptstadt L'viv bis zu der im Süden gelegenen, der ehemaligen österreichischen Provinz Bukowina zugehörigen Stadt Chernivtsi, von der Bergkette der Karpaten im Westen bis zum Fluss Sbrutsch und zu den Ebenen von Podolien im Osten. Od tri velika ideala modernog demokratskog doba, bratstvo je vrlo brzo zasjenjeno drugim dvjema vrijednostima, slobodom i jednakošću. Suvremena politička teorija je skoro jednoglasno zamijenila i sam pojam bratstva pojmom solidarnosti ili društvene pravednosti: u svojoj Teoriji pravednosti, John Rawls izričito izjednačuje bratstvo s »načelom razlike« koje legitimira mehanizme distributivne pravednosti. Ipak, pogrešno prevodeći francusko fraternité kao community, neke angloamerički autori uvode treći republikanski ideal u okoštalu debatu liberala i komunitarijanaca: tamo gdje fraternité shvaćena kao solidarnost omogućuje suopstojnost slobode i (...) jednakosti, fraternité shvaćena kao zajednica postavlja granice izgradnji dobro uređenog demokratskog društva.De trois grands idéaux de l’âge démocratique moderne, la fraternité a été très tôt éclipsée par les deux autres valeurs que sont la liberté et l’égalité. La théorie politique contemporaine a quasi unanimement supplanté la notion même de fraternité par celle de solidarité ou de justice sociale : dans sa Théorie de la justice, John Rawls assimile explicitement la fraternité au « principe de différence » légitimant les dispositifs de justice distributive. Toutefois, par une traduction abusive, certains courants de la pensée politique anglo-saxonne interprètent fraternité comme communauté, en l’introduisant de la sorte dans le débat sclérosé entre libéraux et communautariens : là où la fraternité/solidarité rend compossibles liberté et égalité, fraternité/ communauté pose des limites à la construction d’une société démocratique bien ordonnée. Searle defende a perspectiva – historicamente associada a Descartes – segundo a qual a consciência é a essência da mente. Isso gera complicações para que ele possa explicar a existência de fenômenos mentais inconscientes – existência que o próprio Searle aceita. Sua estratégia para conciliar a essencialidade da consciência com a existência de fenômenos mentais inconscientes é recorrer a uma teoria disposicional: estados inconscientes existem na forma de disposições para a causação de estados conscientes. O presente artigo se concentra em (...) uma dificuldade enfrentada por essa teoria, dificuldade decorrente da eficácia causal que o próprio Searle atribui aos fenômenos mentais inconscientes. Se um fenômeno inconsciente causa uma determinada ação, então ele o faz em virtude de suas propriedades mentais aspecto qualitativo de sensações, ou o conteúdo representativo de desejos), mas se estas propriedades mentais desempenham um papel essencial na causação, então elas existem efetivamente, o que significa que o fenômeno inconsciente possui uma existência mental independente da consciência, o que contradiz a visão cartesiana da consciência como a essência do mental. O artigo investiga a concepçáo de reduçáo de Searle no que se refere à compatibilidade entre redutibilidade causal e simultânea irredutibilidade ontológica da consciência à atividade cerebral. A reduçáo causal da consciência – a explanabilidade causal de suas características por processos cerebrais e a identidade de suas capacidades causais (seçáo 2) – é incompatível com a irredutibilidade ontológica (seçáo 3), porque a diferença ontológica entre características subjetivas e objetivas torna a identidade das capacidades causais incompreensível (seçáo 4). This paper contains an analysis of a famous criticism from John Searle on materialist tradition. This tradition uses to ignore or even refuse the subjectivity of mental phenomena. This paper examines Searle’s strategy to defend this subjectivity, refusing the essential character of behavior to the mental aspect (section II), distinguishing subjective and objective in epistemic and ontological senses (section III) and showing his solution to the problem of other minds (section IV). However, his attempt to obtain an indirect access to (...) subjective mental phenomena through causal explanations (section V) of these phenomena by brain processes is not enough to integrate the ontological subjectivity in our scientific worldview, once that this supposed ontological irreducibility from subjective to objective phenomena seems to result in the conclusion that mental phenomena are something beyond natural reality. Khalīfa b. Khayyāt(d. 240/854-855) was an historian- muḥaddith in the ʿAbbāsid’s period. There are references in sources to his competence in history and lineage rather than Ḥadīth. Two works of him have survived. The first one is al-Ṭabaḳāt which is about study of men and the second one is al-Taʾrīkhwhich chronologically narratesthe events in the history of Islam until 232 AH. The latter is the most significant work to be applied for the historiography of ibnKhayyāt. In this article, Khalīfa b. (...) Khayyāt’s methodology in historiography is examined. In this study, the early period of Islamic histography is handled and the subject is discussed comparatively. The main characteristics of his historiography are his adoption of a chronological style that facilitates the follow-up of the book, his knowledge for the lineage of those who died in wars and the details about the wars. Also, among the charactersitics are his application of isnād to his history book as a muḥaddith, his knowledge for the previous resources via his teachers who belong to the schools of al-Madīna and ʿIrāḳ and when required, his usage of ayah, ḥadīth and poems. These issues are dealed in the artcile with examples. Besides, a study in the West about Khalīfa b. Khayyātasserts that he was a follower of Umayyad dynasty and so this affected his historiography. In this article, this assertion is tackled by analyzing the whole book and it concludes that it is not valid because of some narrations against this assertion.SummaryKhalīfa b. Khayyāt (d. 240 / 854-55), who grew up in Basra, one of the most important centers of scholarship of the time and the meeting point of scholars, and he continued his scholarly works in this city. Since his grandfather and father are engaged in the field of Ḥadīth, Khalīfa b. Khayyāt started his scholarly adventure at an early age and he took his first education in the field of Ḥadīth.Scholars, in the early periods, continued their studies in the fields of sciences related to each other. Khalīfa b. Khayyāt’s studies are also in this kind. Although there are references in sources to his accumulation of Ḥadīth, Khalīfa b. Khayyāt ’s main area of ​​expertise is history and nasab/genealogy. The fact that his works and references to him in later sources are largely related to historical events, knowledge of the nasab/genealogy, and wafayāt (death dates of Ḥadīth scholars and narrators) reveals his considerable knowledge on these issues. Khalīfa b. Khayyāt lived in the period of ʿAbbāsid caliphs al-Maʾmūn (813-833) and al-Muʿtaṣim (833-842). This period is important because of the fact that the al-Mihna incident took place and the pressure on the Ḥadīth scholars increased. Although Khalīfa b. Khayyāt is not one of the direct opponents of Muʿtazila, his participation in a debate against them provides clues about the place where he stands. The scholarly atmosphere of Basra, enabled Khalīfa b. Khayyāt to benefit from a wide range of teacher-student network. In addition to his professors from whom he benefitted in the field of Ḥadīth, he had the opportunity to obtain the knowledge and understanding of the history of that time through his teachers who are important historians of the period in his field. Two works related to Khalīfa b. Khayyāt whose reliability is confirmed by djarh wa l tadil scholars reached to our time. One of the oldest Ṭabaḳāt works in the history of Islam is al-Ṭabaḳāt; the other one is the book, al-Taʾrīkh, which provides a new method for Islamic historiography.This study deals with the principles of the method of historiography, which can be put forward through Khalīfa b. Khayyāt 's al-Taʾrīkh. al-Taʾrīkhis important in terms of being the first example of chronological writing type in Islamic historiography and has not been subject to any independent study to date. There are two ongoing M.A. thesis about Khalīfa b. Khayyāt, however, no study has been identified that directly deals with its methodology of history. On the other hand, based on some riwāyats/narrations in al-Taʾrīkh, there is a work that claims that Khalīfa b. Khayyāt had sympathy towards Umayyads. The study named “Khalīfa b. Khayyāt’s History on the Umayyad Dynasty (660-750), prepared by Carl Wurtzel as his PhD. Dissertation, examined the life of Khalīfa, partly the historiography and the religious-political narrations in the work. On the case of Muʿāwiya’s (d. 60/680) request of the allegiance to Yazīd (d. 64/683), Wurtzel compared an event that took place between the envoy of Ibn al-Zubayr (d. 73/692) and Muʿāwiya with al-Balādhurī’s (d. 279/892-93) narrative and concluded that Khalīfa was an Umayyad sympathizer. However, Khalīfa b. Khayyāt’s exclusion of an event such as al-Mihna which was against the ʿAbbāsid and changed the course of history in his book, shouldn’t be considered as a symptom of sympathy; It would be more appropriate to accept it as a feature of history writing.At the top of Khalīfa b. Khayyāt's principles of historiography, adopting chronological method comes first. Accordingly, Khalīfa b. Khayyāt, gives a brief history about the siyar of the Prophet Muhammad at the introduction of the book. Then, by beginning from the first hijri year, he gives the important events, wars and deaths by the years. Sometimes, he refers to the people assigned by the caliphs of the period by referring to the Amîrs (Administrators) of the Hajj. He gives lists of those who died on both sides of the wars. The importance of mentioning the tribes of the deceased shows his competence in the knowledge of nasab. One of the highlights of his historiography is that he sometimes does not touch upon some of the events and situations that are considered to be turning points in Islamic history; and sometimes he does not go down into detail but just gives relevant narratives. For example, he doesn’t mention any narrations about the selection of the Caliph which perhaps the most fundamental point of separation between Ahl al-Sunnah and Shīʿa in the history of Islam.Although he gave detailed information about The Battle of The Camel (36/656) and Ṣiffīn cases (37/657), it is not possible to determine his views on this subject. In addition, he never mentioned the al-Mihna incident, which deeply influenced society and the scholarly environment during the ʿAbbāsid period. Isnād is also holds an important place in the methodology of history of Khalīfa who was a muḥaddith at the same time. In many of the narrations he used the words haddathanā and ahbaranā.In our study, the siyar section of al-Taʾrīkhwas examined in order to determine the sources of the Khalīfa’s historiography and has been seen that the works of Ibn Isḥāḳ (d. 151/768) and Ibn Hishām (d. 218/833) were the main sources of this chapter. Considering Khalīfa b. Khayyāt’s emphasize to isnād and his reach to Ibn Isḥāḳ 's work through the mediation of Bekr b. Suleiman, it can be said that he was dominant in historiography on the sources before him. Khalīfa b. Khayyāt rarely refers to Qur’anic verses and hadiths when describing events. He referred to the verses in only two places and hadiths in only five places. One of them, and perhaps the most remarkable one in the book is the Ḥadīth of the Prophet Muḥammad: “I am the guardian of whom; ‘Alī is his guardian” This narration is used in the letter of Caliph Mahdī (d. 169/785) of the ʿAbbāsid to khārijī (outer) Abd al-Salām b. Hishām who rebelled. The study is based on the principles outlined above. At the end of the study it is also considered that Khalīfa b. Khayyāt ’s works should be the subject of graduate studies which should be prepared with deep readings. (shrink)

A discussão que Searle faz dos conceitos de autoconsciência e de introspecção mostra que ele acredita que uma autoconsciência implícita é uma característica (...) constitutiva do campo unificado de consciência. O artigo investiga a frequente alegação na literatura filosófica de que a concepção de Searle sobre a redução da consciência é incoerente. Após um exame das teses básicas de sua teoria da mente , é discutida sua posição a respeito da identidade entre a consciência e a atividade cerebral . Da adesão de Searle a uma tese da identidade de ocorrências deve-se concluir que não há contradição entre esta tese e a irredutibilidade ontológica que ele defende. Porém, é possível deduzir (...) de sua teoria asserções que contradizem esta mesma teoria , uma vez que essa irredutibilidade resulta em um dualismo de propriedades. (shrink)

The Middle Included is a systematic exploration of the meanings of logos throughout Aristotle’s work. It claims that the basic meaning is “gathering,” a relation that holds its terms together without isolating them or collapsing one to the other. This meaning also applies to logos in the sense of human language. Aristotle describes how some animals are capable of understanding non-firsthand experience without being able to relay it, while others relay it without understanding. Aygün argues that what distinguishes human language, (...) for Aristotle, is its ability to both understand and relay firsthand and non-firsthand experiences. This ability is key to understanding the human condition: science, history, news media, propaganda, gossip, utopian fiction, and sophistry, as well as philosophy. Ömer Aygün finds Aristotle’s name for this peculiar but crucial human ability of “gathering” both experiences is logos, and this leads to a claim about the specificity of human rationality and language. Resumo: John R. Searle articulou uma filosofia da mente de acordo com a qual a consciência é o mais importante dos fenômenos mentais, sendo essencialmente caracterizada por uma subjetividade de seu modo de existência. O problema é que a existência de fenômenos mentais inconscientes coloca essa concepção em dificuldades, pois fenômenos inconscientes existem sem serem vivenciados, ou seja, existem de forma objetiva. Para escapar desse problema, Searle propõe uma teoria disposicional do inconsciente, mas a tese do presente trabalho é que, (...) ao aceitar a possibilidade de causação mental inconsciente, Searle está comprometido com a existência de propriedades mentais genuínas, mas independentes da consciência, de modo que sua tese da subjetividade ontológica da mente desmorona. This examination of three early Islamic theological texts will show that the discursive practices within their respective genera of writing in its nascent stages were scripturally hermeneutical in character. Primary focus was on arguing for the proper understanding of Quranic statements rather than offering extensive arguments based on purely rational grounds. Formal analysis of early writings on divine determinism such as we have selected suggests that Quranic content not only made up the substantive matter of these discourses but even influenced (...) their structure of argumentation and their modes of reasoning. What this study ultimately shows is that the development of Islamic theological thinking and the discursive practices associated with it may have had their impetus in the internal sources of the religion itself and had not merely evolved under foreign influences. In this note, I provide an axiomatic characterization of the relative utilitarian bargaining solution to Nash bargaining problems. The solution is obtained when Nash’s independence of irrelevant alternatives axiom is replaced by the weak linearity axiom, while retaining the other three axioms. RU maximizes the sum of proportional gains, or, equivalently, minimizes the sum of proportional losses. RU is scale invariant and compared to the Nash and Kalai and Smorodinsky solutions, it is ex ante efficient when the bargaining problem is (...) considered as a lottery of future bargaining problems. Judges and juries often make factual decisions even if the facts are disputed and there is no clear-cut evidence available. Despite this common state of uncertainty, verdicts are thought of as having clear winners and losers––either the plaintiff wins and receives a full remedy, or the defendant wins and the plaintiff gets nothing. In private disputes, factfinders base their binary factual determinations on the preponderance of the evidence. There are, however, several doctrines that allow for partial remedy, discounted by the (...) probability that the facts support the plaintiff’s case, given the available evidence (proportional liability). This Article offers a general theory for proportional liability in private law. It identifies three types of factual uncertainty—mutual uncertainty, unilateral uncertainty, and institutional uncertainty—and shows that legal economists should support proportional liability when the state of uncertainty is shared by the parties and the court (mutual uncertainty), and they should adopt an all-or-nothing rule whenever the information is observable but unverifiable (institutional uncertainty). In cases where one party holds private information (unilateral uncertainty), proportional liability is sometimes, but not always, superior to an all-or-nothing rule. (shrink)

Spandrel or Fitrah? An Essay on the Relationship Between Cognitive Science of Religion and Fitrah.

O artigo examina o papel do conceito de ‘forma aspectual’ – o fato de toda representação representar seu objeto sob certos aspectos, e não outros – na argumentação de Searle para sustentar uma teoria disposicional do inconsciente. Após uma discussão dos argumentos de Searle para a conexão entre a intencionalidade inconsciente e a consciência (seção 2), são discutidas as razões para aceitar que a forma aspectual tem existência objetiva (seção 3) e o modo como a causação mental inconsciente exige a (...) presença de propriedades mentais ocorrentes (seção 4). A única razão para Searle negar a existência mental inconsciente é a sua restriçãoexcessiva, e injustificada,ao ponto de vista subjetivo da experiência consciente (seção 5). (shrink)

O artigo defende a tese de que a irredutibilidade ontológica que Searle atribui à consciência envolve o naturalismo biológico (proposto por ele como uma solução para a parte conceitual do problema mente-corpo) em diversas incoerências, especialmente no que diz respeito ao tema da causação mental. Após uma apresentação das teses básicas da teoria (seção 2), são discutidos os problemas que a tese da irredutibilidade ontológica gera para a visão de Searle sobre a causação mental (seção 3), e as incoerências decorrentes (...) dessa tese (seção 4). A conclusão é que o modo como Searle concebe a irredutibilidade ontológica da consciência é uma fonte de problemas para o naturalismo biológico. (shrink)
