The article analyzes the changes of legal regulation on natural gas market in the context of the third European Union (EU) energy package. The paper consists of the introduction, two parts and conclusions. The first part analyses the main provisions on the natural gas market of the Third EU energy package. The second part of the paper focuses on the effect of the Third EU energy package on legal regulation of natural gas market in Lithuania. For this purpose, the author (...) analyzes the relevant provisions of the future legal regulation that are laid out in the Conception on draft amendment of the Lithuanian law on natural gas (the Conception) that was adopted by the Resolution of 19 May 2010 No. 585 of the Government of the Republic of Lithuania (the Government). The author analyses the chosen model of implementation of the Directive 2009/73/EC of the European Parliament and of the Council concerning common rules for the internal market in natural gas of 13 July 2009 and repealing Directive 2003/55/EC (Directive 2009/73/EC), and the possible negative and positive consequences of the implementation of the model chosen by the drafters of the Conception. The article analyses the legal status of the natural gas market regulatory institutions in Lithuania and in the member states of the European Union. First, the authors assess the most important elements of the legal status of the natural gas market regulators in the EU member states, namely, the degree of autonomy (type of institution, appointment and dismissal procedures of management, duration of the terms of office, sources of funding) and the measures aimed at ensuring accountability, transparency, and prevention of (...) conflicts of interest. Second, the legal status of the National Control Commission for Prices and Energy, which carries out functions of regulation and control of the natural gas sector in Lithuania, is examined. Finally, the authors conclude that the imperfections in the regulation of the legal status of the Commission result in several negative effects and provide reasoned proposals regarding the improvement of the legal status of the Commission. The present study is based on the work by Sara Maitland entitled A Book of Silence and seeks to reflect on this theme in the line of high spirituality by crossing it with the figures of the imaginary that form the silence itself. To this end, we seek in the first part, devoted to silence, to understand the nature of silence in its manifestations, types and images, as it was thought and studied by Sara Maitland in her A Book of (...) Silence. Then, in the second part, reflect on the meaning of this constellation of images to try to delineate the imaginary of silence. In the third part, taking into account the developments of the first and second parts, we will reflect on the trilogy of silence-imaginary-creativity. We will conclude with some reflections and questions raised by the analysis of the author’s work. (shrink)

A educação sempre foi um fator determinante na vida dos homens e das sociedades, mas hoje ganhou enorme relevância sendo um dos grandes temas da atualidade pela sua importância tanto no presente como para o futuro. Para a educação confluem hoje inúmeros contributos científicos, tanto das ciências sociais e humanas como das ciências empíricas, sem que o fundo social, cultural, espiritual e moral que a educação é deixe de correr incessantemente como um rio profundo que, todavia, os ventos e as (...) turbulências da superfície agitam e perturbam. A problemática que atravessa hoje a educação, bem como a informação científica e a investigação empírica que a podem esclarecer, não dispensam análises teóricas para novas formas de compreensão tanto mais complexas quanto mais problemáticos e difíceis são atualmente os temas educativos. O presente livro congrega múltiplas perspetivas sobre o fenómeno educativo, levadas a cabo por numerosos professores e investigadores de Portugal e de Espanha, em trabalhos individuais e coletivos nos domínios da teoria e da filosofia da educação. Congregando representantes de vinte e duas universidades da Península Ibérica, os trabalhos refletem uma multiplicidade de abordagens teóricas da educação, dando uma visão global do que nesta realidade cultural e geográfica do oeste europeu hoje se pensa sobre o assunto. É, pois, uma excelente ocasião para aprofundar estes temas e perspetivá-los sob pontos de vista inovadores e férteis. (shrink)

Identity has been widely understood in Western societies as a specular construction that operates simultaneously both from within and from outside oneself. However, this process is fiercely changing in a world in which almost every human action is mediated by information and communication technologies. This paper, from a theoretical perspective, aims to discover the main educational implications of this change. For that purpose, we first consider the traditional meaning and process of forming the self in Western culture. Afterwards, we identify (...) and describe the mechanisms for the construction of the self in our current context, highlighting the fact that technologies, in themselves and regardless of the use we make of them, hide implications. Taking this into account, we show to what extent the current development of the self presents shades, conflicts and tangible risks from an educational perspective. We finally conclude that it is essential to promote an education on technology that goes beyond the use regulation in which, up to now, it has been solely focused on. (shrink)
