The primary objective of this research was to investigate the impact of Commitment Towards Islamic Banks, Attitude Towards Islamic Bank, Islamic Religious Obligation, trust, and Hijra intention on customer loyalty towards Islamic banks. Additionally, the study aimed to explore the moderating role of customer trust and the mediating effect of hijra intention. The research employed a cross-sectional research design and a quantitative approach, gathering data from customers of Islamic banks in the Kingdom of Saudi Arabia. A questionnaire, based (...) on previous studies, was designed for data collection and distributed to respondents through purposive sampling. The collected data underwent analysis using AMOS. The study revealed that Commitment Towards Islamic Banks, Attitude Towards Islamic Bank, and Islamic Religious Obligation positively influence hijra intention. Furthermore, trust and hijra intention significantly impact loyalty towards Islamic banks. The results also supported the moderating influence of trust and the mediating role of hijra intention. This research contributes to the existing body of literature in religious studies, offering valuable insights that can assist banking strategists in customer retention efforts. (shrink)

This article examines the mutual imbrication of gender and class that shapes how some transgender women seek incorporation into social hierarchies in postcolonial India. Existing literature demonstrates an association between transgender and middle-class-status in the global South. Through an 18-month ethnographic study in Bangalore from 2009 through 2016 with transgender women, NGO workers and activists, as well as textual analyses of media representations, I draw on “new woman” archetypes to argue that the discourses of empowerment and respectability that impacted middle-class (...) cisgender women in late colonial, postcolonial and liberalized India also impact how trans women narrate their struggles and newfound opportunities. Trans woman identities are often juxtaposed to the identities of hijras, a recognized group of working-class male-assigned gender-nonconforming people. Instead of challenging stereotypes of gender nonconformity most evident in the marginalization of hijras, some transgender women are at pains to highlight their difference from hijras. These trans women are from working-class backgrounds. It is partly their similarities in class location that propel trans women’s efforts to distinguish themselves from hijras. They employ the figure of the disreputable hijra to contain negative stereotypes associated with gender nonconformity, thus positioning their identities in proximity with middle-class respectable womanhood. The hypothesis of our work is that the concepts of globalization, the information technology boom and Postmodernism are closely linked and that somehow eroded the ontological concepts of identity, individual and cultural diversity, in terms of the relationship I and the other. In the international strategic framework that other has fallen on Arab-Islamic culture. The thought of the Western world, with its logic of instrumental rationality has built stereotypes about that culture, ignoring its archetype. This reality is the one that (...) perceives the concepts of the Arab-Islamic tradition of Jihad and Hijra only as ideas that lead to the destruction and not as a heritage of the philosophical and religious thought for the development of humanity. From a Jungian interpretation, both concepts and the psychic behaviors that derive from them, outside the fallacious and violent interpretations, are valuable contributions to humanity in the current situation. In July 2021, a series of gruesome videos exposed a case of brutal torture perpetrated by a guru or leader of the trans feminine hijra community in eastern India. This guru was allegedly of a Bangladeshi Muslim background, and various community members used the case as an alibi to target hijras of such national and religious origin, sometimes even demanding their expulsion from India. This phenomenon paralleled increasing affiliations between certain sections of trans/hijra communities and the Hindu Right. (...) This article situates this case within the broader rise of queer and trans Hindutva or Hindu nationalism and locates it as indicative of Hindutva’s expansion to its erstwhile ‘elsewheres’: areas outside its traditional strongholds such as eastern India and communities such as hijras who are known for their mixed religious practices and have been historically stigmatised by Hindu society. However, the article also analyses the case to show how hijras and related communities evidence contingently wavering political alliances and complex dynamics of intra-community power and resistance that remain irreducible to typical equations of Hindu right-wing politics. Queer/trans Hindutva might become disrupted by its potential constituents themselves, showing how Hindutva’s ‘elsewheres’ trouble its assimilationist capacities. (shrink)

Farabi defines “Ilm al-Hiyal” in Ihsa al-Ulum as “knowing a way by which, human can adjust all of the concepts that have been proved in mathematics with verification to exotic objects, and helps their states in exotic objects to be carried”. He believes this will be recognized and be attained by craft. This was the common view in Islamic wisdom and philosophy in third and fourth Hijra centuries. Researchers believe that the unique emphasis on parallelism between theoretical science and (...) practical work is an important feature of Baghdad school and affected Islamic visual culture. Baghdad school had been affected by translation. In this way, Ikhwan-al-Safa, whom wrote the first encyclopedia of science in Islamic culture, had a very efficient role. They devised geometry into intellectual and sensual ones in the second part of their book, al-Rasa-el, and considered intellectual geometry as one of the middle philosophy and recognition and understanding factor for meaning of sensual geometry evidences. They insisted on basic situation of intellectual geometry in guidance of whom, want to learn intellectual things from sensual ones. They knew intellectual geometry as the factor for requiring skill in scientific crafts, and sensual geometry as the factor of practical crafts, and made a vast relation between them. They also defined end of intellectual geometry understanding the base of all sciences and the main factor of wise, essence of self. Important feature of Ikhwan-al-Safa’s wisdom is omitting the gap between theory and practice, making a vast relation between them, which affected the meaning of crafts in Islamic culture, and rendered a spiritual feature to crafts and arts. It seems this relation has created the concept of traditional arts, and integrating wisdom and crafts in Iranian-Islamic culture constructed all of the Fotowat-Nam e. This article reviews the concept, which affiliates theory and practice in third and fourth centuries and has a deep effect on recognition of art and craft in Islamic culture. (shrink)

Ash’arism, which emerged in the first quarter of the fourth century of Hijra, is a theological sect that has been accepted by the majority of hadith scholars throughout Islamic history. This fact, which has important consequences for the history of hadith, raises the question of the extent to which the hadith scholars belonging to the Ash’arite sect were interested in theology. This is because theology, which is considered an heretical innovation according to the traditional understanding of Ahl al-hadīth, was (...) severely criticised by hadith scholars representing Salafī thought and positioned as the opposite pole of hadith. Accordingly, Ash’arism could not escape from being the target of the anti-theological Ahl al-hadīth. However, this did not prevent the adoption of the Ash’arite sect by hadith scholars and the emergence of a group of Ash’arite hadith scholars who engaged in theology. Thus, from the fourth century of Hijra, Ash’arite theology, like other Islamic sciences, became a natural part of education and teaching activities. Andalusia and the Maghrib, one of the regions where the Ash’arite sect was widespread, provide a favourable ground for determining the place of theology in the scholarly life of the hadith scholars. The famous hadith scholars who lived in this region in the fifth and sixth centuries of Hijra are analysed in this study in terms of their affiliation with Ash’arism and their interest in the science of kalām. By analysing the education and training lives of the hadith scholars subject to the research, the details that highlight their Ash’arite identities were determined. Issues such as how the Ash’arite tradition was inherited by hadith scholars in the Western Islamic region, what roles hadith scholars played in the spread of the Ash’arite sect in this region, which books were most widely used by hadith scholars in the study of kalām, and which methods were used to read and transmit theological texts are clarified within the framework of available data. As a result, it was revealed that in the Western Islamic world of the fifth and sixth centuries of Hijra, the science of kalām was in great demand among the Ash’arite hadith scholars and that important texts of Ash’arite theology remained in circulation among hadith scholars through reading and transmission. We can find the origins of the notion of void in the Kalām tradition’s recognition of atomism. However, the main debates on the subject appeared after the Greek philosophical heritage transitioned to the Islamic world in the 3 rd century of Hijra. The literature of Kalām, just as in the metaphysical tradition, has two main types for this void being discussed. The first one is the external void (extracosmic) in which the cosmos floats. In the sources of Kalām, the (...) question of whether such a type of void exists is debated around the questions of whether anyone who might look beyond the cosmos can see anything or whether someone who stretches their hand outside the cosmos can move it. The second type of void, which occupies more of the mutakallimūn (Muslim theologians) agenda, is the internal void (intercosmic), assumed to be within the cosmos and between the body-forming atoms. This kind of void is discussed around the question of “Whether separating the two atoms is possible so that a third one can be inserted between them?” An ongoing discussion on the intercosmic void is found between the Baṣran and Baghdād Schools of Mu’tazila. Ibn Mattawayh and al-Nīsābūrī narrated the evidence presented in these discussions in their original form. The current essay discusses the debates between the two Schools and assesses the theoretical and experimental arguments both Schools present to justify their viewpoints, considering their philosophical origins. The foundations of almost all Islamic sciences were laid in the first and second centuries of hijra. With the expansion of the Islamic world since the first century of hijra, the existence of a collective effort to transfer oral information into writing is notable. With the invitation of the prophet Muḥammad to Islam, an unprecedented increase in the culture of writing has been observed. Since the emergence of Islam, the world history scene has witnessed feverish writing activity. Especially (...) in the 2th/8th century, when the transition from oral culture to written culture accelerated, the founding texts of the science of language and religion, which were the carriers of these sciences related to aqāid-kalām, fiqh and uṣūl al-fiqh, tasawwuf, tafsir, and hadith, were compiled. Thanks to the founding texts containing the basic principles, the sciences have had the opportunity to develop by deepening. In this study, the contribution of Fiqh al-akbar, the founding text of the science of creed, to the science of kalam, which has made significant progress, will be discussed. In order for a text to be considered a founding and root, there must be a system that it establishes as the fruit of the tree. In this sense, Fiqh al-akbar established a moderate and defensible belief system. There is an organic link between the most concise faith texts and the most voluminous kalām books. While the creed texts, which consist of writing the goals at the end of the road, are the counting of the principles of faith, the texts of the kalām represent the walking of the road that leads to the goal of faith. Fiqh al-akbar, which marks the end of the road by finishing the roads to be walked, is the first and most important of the milestones of Islamic thought. In this study, the contribution of Fiqh al-akbar, the founding text of the science of aqāid, to the science of kalām will be discussed in the context of its belonging to its author. This text gave direction to Ahl al-Sunna theology, which would be written in the later stages of Islamic thought. In this study, the internal and external contexts of the founding text mentioned will be confirmed in terms of its relative acumen to Abū Ḥanīfa. In addition, the reason for the increase in the commentaries (Sharḥ) of Fiqh al-akbar during the Ottoman period will be shown. As a matter of fact, each annotation strengthens that it belongs to the author. In the annotations, there is no sentence stating that the text does not belong to Abū Ḥanīfa, on the contrary, the authenticity of the belonging is emphasized. Of course, not all the annotations of the relevant text will be included here, but mostly printed works will be emphasized. Theology, prophecy and the hereafter are discussed in Fiqh al-akbar. Here, how theological debates and problems related to the history of theological concepts are handled in the commentaries will be shown. In this article, within the framework of the method discussed as an example, a preparation will be made for further studies to evaluate the topics and concepts of prophecy and the hereafter in the context of commentaries. The point that should be emphasized here is that none of the scholars who commented on the text pointed out that the subject or concept was not discussed in the period of Abū Ḥanīfa. Moreover, from the early period until as late as the 7th/13th century, both theology and bibliography books did not have any doubts about the belonging of Fiqh al-akbar to Abū Ḥanīfa. Gathering information about theological Islamic dissidents/sects and classifying and listing them in various ways as a literary genre in Islamic literature has been of interest to Muslim scholars as a result of scholarly curiosity or in the aim of criticizing and refuting their ideas from a certain ideological and theological point of view. After especially taking the ḥadīth saying that the Muslim community will divide into 73 sects as a main reference, heresiological classifications or lists became more systematic and schematic. (...) These heresiological classifications or lists are in fact mostly different attempts in terms of material, method and style. This enables to determine and offer possible traditions of classifying and listing sects based on the similarities, differences and connections among them. This dissertation that examines heresiological classifications and lists that emerged in particularly seven centuries after the hijra and appeared in books of various literary genres tries to identify their characteristics and historical development, and categories them according to their methods, scopes, styles and contents in order to reach a holistic understanding. Also it offers possible traditions for heresiological classifications or lists after analysing and comparing the available ones. (shrink)

The bond of faith that man has established with his creator was realized through the prophet. The problem of anti-prophecy, which is widely experienced at the intellectual level with its dimensions affecting our age, corresponds to a serious belief problem. The principles known via prophecy in monotheistic religions are summarized as beliefs in Allah, prophecy, and afterlife. The theology of monotheistic religions emerged within the framework determined by the prophethood. As a result, the prophethood, as the starting point of religion, (...) appears as the most accurate way to obtain information about God and the afterlife. An anti-prophetic attitude has been observed in the anti-religious circles and names renowned for it have been seen in the historical path. This anti-prophetic attitude seen in the Iranian origin dualist traditions and in the Indian origin belief circles of Barāhima and Buddhism living in the lands acquired as a result of the Islamic conquests, has led to serious debates in the Islamic society. Scholars who wrote polemical works against them produced answers by staying in the scope of reason. In these works, which stand out with their erudition, the institution of prophethood in the person of the Prophet Muhammad is supported by historical and traditional arguments and then by verses of the Qurʾān. The basic arguments of the prophethood called ‘hujaj and a‘lām’ are included in apologetic works of the early period, which are mainly based on the traditional evidence of prophethood accepted by the People of the Book. The Works aiming to demonstrate the propehthood in muslim thought until the classical period diveded into two groups in terms of content. Firstly : works that deal with prophethood only through traditional evidence and narrations that narrate miracles and similar wonderful events that took place in the hands of the messenger. Secondly, works aiming to prove prophethood in historical and sociological terms, along with its traditional evidence. In the following period, scholars whose main purpose is to systematically prove the prophethood continued their writing activities on the same subject. During this activity, a special literary genre named Dalāʾil al-nubuwwa was formed in the literature. This article aims to introduce the essential examples of Dalāʾil al-nubuwwa Works, written against the anti-prophetic challenges emerged in the second century of the hijra and gradualy increased during the third and fourth centuries of the hijra and focus on their place and importance in the literature. One of the five pillars of the Islam, zakat (alms) was made necessary after the hijra. Although Zakat was one of the most important resources of Islamic state treasury for many years, it was excluded from the state authority in the period of Omar bin Abdul-Aziz. In recent years, it has been seen that some Muslim-majority states have made significant attempts to manage zakat under the control of the state. For example; Indonesia, Pakistan, Bangladesh, Sudan, and Nigeria are very (...) important states in terms of zakat application in İslamic world and Malaysia, a Southeast Asian country, comes first among those. Especially after 1990, Malaysia activated a new zakat management. This study deals with the Malaysian zakat system in the context of the state administration of zakat. The aim of the study is to examine the Malaysian zakat system in a comprehensive way. In the study, the history of zakat system in Malaysia, the current zakat models applied in there and the areas to which zakat is distributed are investigated. As a qualitative research method, document analysis was employed in the study. In this context, many international studies were examined which are directly related to the subject, and twenty-five Malaysian websites belonging to the institutions which collect and distribute the funds were also scanned. It has been found that Malaysian zakat system consists of public model, semi-public model and private model and seen that the states are divided into three regions and different zakat models are applied in each region. Human actions have been one of the most discussed topics in the science of kalām since the first centuries of Hijra. Many scholars from different schools of kalām have tried to solve this problem. Efforts to solve the problem have brought different views. In this framework, three main views emerged Jabrī, Qadarī/Muʿtazilī and Salafī/Sunnī. The views of Islamic philosophers were added to these and this number was increased to four. Nevertheless, Sunnī scholars, who agree on the basic propositions, disagreed (...) on the nature of kasb. While there are differences of opinion between Ashʿarī and Māturīdī schools, there are also those who put forward different views among scholars belonging to the same school. Abū Bakr al-Bāqillānī (d. 403/1013), Abū Isḥāq al-Isfarāyīnī (d. 418/1027) and Juwaynī (d. 478/1085), Sadr al- Shrīʿa (d. 747/1346) and Ibn al-Humām (d. 861/1457) are the most obvious examples of this. These views on human actions have been mentioned in their works by scholars of kalām. One of these scholars is Gelenbevî Ismāʿil (d. 1205/1791). In this article, the views on human actions will be examined in the context of Gelenbevî’s work named Ḥāshiya ʿalā Sharḥ al ʿAqāʾid al ʿAḍudiyya. Gelenbevî makes concise or detailed explanations about the views mentioned in his work with the exception of Ibn al-Humām. In addition, he also mentions the views of al-Ghazālī (d. 505/1111). While Gelenbevî mentions these views and the discussions that took place around them, He makes use of his works Ījī’s (d. 756/1355) named Mawāqif, Taftāzānī’s (d. 792/1390) Sharḥ al Maqāṣ̣ıd and Jurjānī’s (d. 816/1413) Sharḥ al - Mawāqif. Gelenbevî states that Ashʿari’s view is middle jabr (jabr al muṭavaṣṣıṭ) and even he is accused of being pure jabr (jabr al- maḫẓ). Based on the concept of partial will (al-irādah al-juzʾiyyah), he says that the views of Bāqillānī and Māturīdī school are the same and states that this view is more successful than Ashʿari’s in explaining human responsibility. This thought indicates that he is closer to the Māturīdī view of human actions than to Ashʿarī. He points out that Isfarāyīnī’s views are open to criticism in some respects. He implicitly states that he does not agree with the idea that Juwayni agrees with the Islamic philosophers. Rather than Muʿtazila’s views, it focuses on whether their views and the views of Islamic philosophers are the same. (shrink)

This article analyzes the position of Ibn Hilāl, who is regarded as nāsıbī and ghālī, in the science of Shia rijāl, his reports and the validity of the accusations against him. It is found that narrators are criticized for various reasons in the science of Shiʻa rijāl. Some of them are the Shiite followers that the imams cursed and wanted to be kept away from their adherence. It is seen that the narrations reported by some of the narrators are included (...) in the main sources of Shiite hadith, albeit these narrators were cursed by the innocent imams. Ahmed Ibn Hilāl (d. 267/880) is one of these narrators cursed by the imams and his name is found in the report (the isnād) of many early narrations. Ibn Hilāl, one of the close companions of Shia's 10th imam Ali b. Muḥammed al-Hādī (d. 254/868) and 11th imam Ḥasan al-ʻAskarī (d. 260/874), was first cursed by the letter of al-Askarī allegedly sent, and the Shiite followers were ordered to move away from him. Ibn Hilāl refused to accept the ambassadoriality of Muḥammed b. Osman (d. 305/918), the ambassador of the 12th Imam. Thus, he was cursed by Muḥammad al-Mahdī as well. In later periods, Ibn Hilāl was accused of being nāsıbī and ghālī. However, there are also some Shiite scholars who supported (tavthîk) Ibn Hilāl. In the Shi'a tradition, Nāsibism indicated the meaning of hating ʻAli and Ahl al-bayt or feeling anger towards them. Later on, this meaning has been changed into a meaning including the haters of ʻAli and then the Shiʻa Nāsibism is regarded as a position towards Shiʻa outside of Shiʻa. Ghulāt is a form of a belief generally found in the Shi'a tradition. In the belief of Ghulāt, holiness is attributed to the imams. When the Shiite sources are examined, it can be seeb that Ibn Hilāl represents neither a ghālī nor a nāsıbī position. In the Shiʻa, when the narrator leaves his sect, his narrations are evaluated differently. Therefore, among Ibn Hilāl's narrations only those which narrated before he left can be accepted. The likely reason for this attitude can be those narrators such as Ibn Hilāl brought in many narrations to the Shiite hadith literature. Ibn Bābeveyh and Sheikh Sadūk reported many narrations that includes Ibn Hilāl in their report chain (the isnad). Among these narrations, they criticized only one. Again, in the 4th century of Hijrī, Numānī, al-Hazzāz, Ibn Qavlaveyh and Mufīd reported many narrations transmitted by Ibn Hilāl. However, none of them mentioned about the negative perception on Ibn Hilāl in any of these narrations. This shows that Ibn Hilāl was not regarded as nāsıbī or ghālī in the eyes of the these scholars. As regards to, Tūsī, in the 5th century after Hijra, claimed that Ibn Hilāl was a ghālī and he was accused of being an adherent to this religion. He narrated in sum fifty narrations that included Ibn Hilāl in the report chain, but Tūsī criticized only three of them because of including Ibn Hilāl. The reason why Ibn Hilāl was accused of being nāsıbī and ghālī, which Shiʻa deemed the worst, was probably related to the political conditions of that period. On the other hand, there is no report that Ibn Hilāl shared a nāsıbī and ghālī thought or had a tendency towards them. It is obvious that if Ibn Hilâl, who has an important place in the eyes of the Shiite community, does not accept the second ambassador of al-Mahdī, and that this would cause discord among the followers. This complex situation was tried to be remedied by letters alleged to have been written by the imams, cursing Ibn Hilâl and ordering them to stay away from him. Later, Ibn Hilāl was accused of being a nāsıbî or ghālī who expressed the attitudes and thoughts that Shiʻa saw the most distant from him. Sadūk first reported the narration that Ibn Hilāl was Nāsıbî. Tūsī, on the other hand, described Ibn Hilāl as ghālī in the 5th century (after hijra). This study tries to reveal that there is no explicit evidence that proves Ibn Hilāl’s nāsıbī or ghālī position. (shrink)

Koran manuscripts that fit comfortably within the palm of one’s hand are known as early as the 10th century CE.For the sake of convenience, all dates will be given in the common era (CE) without further mention, and not in the Islamic or Hijra calendar. Their minute and sometimes barely legible script is clearly not intended for comfortable reading. Instead, recent scholarship suggests that the manuscripts were designed to be worn on the body like pendants or fastened to military (...) flag poles. This is corroborated by some preserved cases for these books which feature lugs to attach a cord or chain, but also their rare occurrence in contemporary textual sources. While pendant Korans in rectangular codex form exist, the majority were produced as codices in the shape of an octagonal prism, and others as scrolls that could be rolled up into a cylindrical form. Both resemble the shapes of similarly dated and pre-Islamic amulets or amulet cases. Building on recent scholarship, I will argue in this article that miniature or pendant Koran manuscripts were produced in similar forms and sizes because of comparable modes of usage, but not necessarily by a deliberate imitation of their amuletic ‘predecessors’. The manuscripts’ main functions did not require them to be read or even opened; some of their cases were in fact riveted shut. Accordingly, the haptic feedback they gave to their owners when they carried or touched them was not one of regular books but one of solid objects (like amulets) or even jewellery, which then reinforced this practice. In the science of Sufism, the concept of migration is widely used, both in an external and internal sense. Hijra, or migration, is not merely a physical journey but also reflects a deeper, broader meaning. Beyond the universally understood meaning of hijra, it also encompasses concepts such as "leaving behind evils, undergoing spiritual transformation, abandoning forbidden activities, staying away from bad traits, and embarking on a spiritual journey." According to hadiths, the Prophet Muhammad (saw) defined the Muhajir (a (...) person who has migrated) as "...the Muhajir is a person who distances themselves from what God has forbidden." Additionally, students of knowledge and Sufi sheikhs often traveled to different countries to further their education, spread the religion, and share their knowledge with others. They frequently stayed for extended periods in the places they visited. In the science of Sufism, many terms are closely related to the concept of migration. Examples include the phenomena of Isra and Miraj, as well as concepts like seiri-suluk, journey, asceticism, and riyazat. Each of these holds its own significance and wisdom in the lives of those who seek knowledge. (shrink)

Muʽtazilah is one of the kalām schools in which intellectual freedom is seen the most and therefore divergences within the sect are the most common. Although al-usûl al-ḥamsa/five principles constitute the main framework on which Muʽtazilah has agreed, opposing ideas have emerged within the sect on the principles of ʽadl (divine justice) and al-manzilah bayna al-manzilatayn and on the issues of nature and imamah. As a matter of fact, Muʽtâzilī scholars wrote many refutations to each other on the disputed issues. (...) One of those who have opposing views within the Muʽtazilah is Muḥammad b. Shabīb al-Baṣrī (d. mid 3rd/9th century), who lived between the end of 2nd and the middle of the 3rd century of hijra. Ibn Shabīb is one of the students of Ibrāhīm Ibn Sayyār al-Naẓẓām (d. 231/845), who was one of the leading scholars of Muʽtazilah. He initially opposed the principle of al-manzilah bayna al-manzilatayn, while he was Muʽtezilî, and accepted the Murji’ah approach on this issue. However, after he accepted the idea of irjā’, he continued his loyalty to Muʽtazilah with regard to the principles of tawhīd (divine unity) and ʽadl. Ibn Shabīb, who had a theological assembly of his own and is respected by the people in Baṣra, was an important scholar who stands out with his comprehensive knowledge of religious and philosophical schools of his time. In the doxographical tradition, his adoption of Murjī’ ideas is generally emphasized, except that he has not been referred to much. However, when the sources of kalām are examined meticulously, it is understood that he influenced many Muslim theologians with his works and views and that he was a source for them regarding many topics. The most important reason for this is that he was one of the first scholars to defend the Islamic belief against various philosophical and religious movements. Naturally, this situation provided him with a wide knowledge of religious and philosophical trends. Considering the quotations made from him, it is understood that he recorded this accumulation in a doxographical work. Another remarkable feature of Ibn Shabīb is that he was one of the first scholars to write in the genre of Kitāb al-Tawhīd. It is possible to see both contextual and methodological effects of this work in the quotations and narratives of Al-Māturīdī's book with the same name. What makes him different is that he adopts Muʽtazilī and Murjī’ ideas at the same time and develops a unique discourse on the subjects of grave sins and waʽīd (divine warning). Although he was raised in a strong tradition of thought such as Muʽtazilah, his ability to oppose his sect and his teacher Al-Naẓẓām and also to develop a different definition of faith despite accepting the doctrine of irjā’, makes him stand out as an original and intellectual personality. His different definition of faith is important in that it represents a more moderate approach to the issue of takfīr. For, he drew an encompassing framework based on the Quran and the Sunnah regarding the definition of faith and the conditions of takfīr, thus, he tried to preserve the unity of Muslims. He did not consider the denial of controversial issues that are not explicitly included in the Quran and Sunnah as a reason for takfīr. With this attitude, Ibn Shabīb took an important approach in ensuring social peace and free thought. In this article, all the information contained in Muʽtazilī sources, and doxographical works related to the life, scientific personality and theological views of Ibn Shabīb are gathered and analyzed, and then his theological thought is reconstructed based on these data. From this point of view, identifications and evaluations have been made regarding the issues that make him different and unique in the history of Muslim thought. (shrink)

Imāmiyya holds that the theory of imāmate must rely on scriptural evidence and designation and that the Imām, the successor to Muḥammad, is in charge of all political and religious issues. The authority of the Imām includes some religious and social duties such as executing the legal punishments, collecting almsgiving, sustaining social order and declaring holy war. The fulfillment of these duties requires actual leadership of the Imām or his deputy. With the beginning of the great occultation in 329/941, there (...) was an uncertainty among the Imāmiyya followers about who would uphold these responsibilities. In this period, Shīʿī ʿulamā began to undertake the duties of the Imām in order to overcome this uncertainty and to avoid the possible schism. In the beginning, this delegation of authority was limited to the religious sphere; but, later, its scope gradually became wider. This process of delegation of power, which covers a long process, needs to be examined in its various periods. In this study, this subject will be considered with special reference to the scholars of the fifth century of hijra (hijrī). An effort is made in this article to reveal how the issues of the Imām’s powers are discussed in the context of the problem of expanding or narrowing the authority of the scholars who played significant roles in systemization of Uṣūlī (rationalist) thought in the period after Shaykh al-Mufīd.Summary: In the issues of Imām/Caliphate which led to political division among Muslims after the Prophet Muḥammad, Imāmī Shīʿa opines that the Imāmate theory relies on scriptural evidence and designation. According to this theory, apart from scriptural evidence and designation, personal qualities such as immaculacy, knowledge, bravery, and vantage are found in Ali, Ḥasan, Ḥusayn and nine people from the lineage of Ḥusayn. The Imām as a successor to the Prophet Muḥammad is a person who has both religious and political power which includes implementation of punishments, collecting alms, ensuring justice, declaring holy war. For the Imāmī Shīʿa, there is a need for imām or his deputy who has absolute power to fulfill these duties.Imāmī Shīʿa, who held that the disappeared twelfth Imām would return back to restore justice in the world, had to confront various problems in finding solutions to some issues related to the existence of Imām himself, as well as theological issues during the period of great occultation. Particularly, the period of great occultation (329/941), in which the link with the Imām was severed completely, the Shīʿī community were uncertain on how to fulfill the responsibilities of the Imām probably due to the lack of religious sources. Shaykh al-Mufīd draws attention to the issue of khums (a one-fifth share of the spoils of war and of other specified forms of income). In this period of uncertainty, the Shiite scholars came into prominence in order to fill the gap and to prevent the social disorder. Referring to a tawqī‘ (rescript) from the Twelfth Imām, they claimed that they would take responsibility for the Twelfth Imām on his behalf. In the beginning, the delegation of the power was limited to the religious sphere. It was gradually extended to other spheres by the contribution of some scholars. It reached the largest dimension with the implementation of “wilāyat al-faqīh” theory.From that period until our times, the era when Sharīf al-Murtaḍā and his disciples lived can be considered as the beginning of this period. In the fifth century when Sharīf al-Murtaḍā and his disciples lived the delegation of power was limited to the religious sphere. In this article, how the scholars who played a role in the systematization of Uṣūlī thought dealt with the issue of the limits of the authority of Imām and how they defined the role of the Imāmī jurists (faqīh) will be examined.Sharīf al-Murtaḍā and his disciples were sometimes cautious on the issue of the delegation of the power of Imām. They, however, pointed out the role of the faqīh in the occultation period in order to overcome the uncertainty. As a matter of fact, Shaykh al-Ṭūsī and al-Qādī Ibn al-Barrāj made significant contributions to the issues of collection and distribution of khums. However, Sallār al-Daylamī’s contribution to the subject is more crucial. He considered khums as the grace of God and believed that it can be allocated by taking into account the share of the Imām. They put forward the views that explained in details the role of the faqīh in the collection and distribution of alms. Even Ibn al-Barrāj opined that in the absence of Imām and his deputy alms are to be allocated to the Faqihs on the ground that they know better how to distribute it. Therefore, in the absence of Imām and his deputy, by suggesting that faqīh must be in charge of collecting and distributing alms, they proposed a remedy in an early period.On the issue of leading the Friday prayer (ṣalāt al-jum‘a), which is one of the social duties of Imām, Sharīf al-Murtaḍā and his disciples considered the presence of the Imām or his deputy as a condition for a valid Friday prayer. In addition to this condition, Al-Ḥalabī, also added that a person who meets the necessary conditions can be also considered in leading Friday prayer. This addition by Ḥalabī was an important contribution to the solution of the problems encountered during the period of great occultation on both Friday prayer and delegation of Imām religious and political authorities to faqīh. On the other hand, Sallār, another disciple of Sharīf al-Murtaḍā, opposed the idea of the faqīh leading the Friday prayer in the absence of the Imām even when the necessary conditions are met. It can be said that this approach of Sallār led to the opinion of some Imāmis which considered Friday prayer unlawful in the absence of Imām. In the occultation period, Sharīf al-Murtaḍā and his disciples showed a cautious attitude about the implementation of the punishments. They argued that only Imām could implement the punishments. However, the major step was taken by Shaykh Ṭūsī on the issue of who implements the punishments in the occultation period. He argued that the Imām’s designated the faqihs to implement the punishments. In addition to this subject, Shiite scholars discussed the issue of whether a Shiite officer under the reigning rule in the occultation period implemented the punishments. On this issue, Sharīf al-Murtaḍā compiled a treaty untitled Mas’ala fi’l-‘amal ma‘a’al-sulṭan. For him, the main criteria are whether such person has necessary responsibilities and qualifications. Sharīf al-Murtaḍā and his disciples also continued their master’s conciliatory attitude. In the final analysis, the contribution of Sharīf al-Murtaḍā and his disciples on the issue of who will undertake the duties and responsibilities of the Imām is crucial in the systematization of the idea of transferal of the power of the Imām to faqīh including political one. In fact, Sharīf al-Murtaḍā’s advice to take part in the existing administrations has been considered a way out for the scholars who want to establish relations with the authorities in the later periods. Madani surahs generally describe the process in which various rules related to the regulation of the moral dimension of religion are determined. Some of the divine declarations made in this framework consist of rules and principles in the nature of command and prohibition. These statements, which have a normative character, also contain some evaluations about the attitudes of the interlocutors in relation to the events that took place in the period of descent. The warnings against the words and actions of (...) believers, which cannot coincide with faith, are among the most striking subjects of the Madani surahs. It is striking that these warnings, which sometimes increase in severity, generally focus on the economic concerns, demands and expectations of the believers. The increase in the welfare level with the Hijra, the inability of the new converts to fully comprehend the teachings of the religion, and the negative effect of the Jahiliyya tradition are among the main reasons for warnings against believers. On the other hand, these warnings and criticisms, which point to the weakness of speech and action, aim to prompt the believers to question their attitudes and stances by determining the ideal style of behavior compatible with faith, rather than merely condemning. In this respect, the article aims to examine the relationship of believers with worldly possibilities and material blessings in the axis of this differing dimension of Madani surahs. (shrink)

Abstract The claim that the Shi’i Imamite thought is heavily influenced by the Mu’tazilite outlook has been alleged since the fouth century of hijra. However, beginning with Shaikh Mufid, the first representative of the Usuli branch of Shi’a, the Shi’is vehemently denied this allegation. In this article, this issue is dealt with by making a comparison between the idea of Qadi Abd al-Jabbar, the prominent Mu’tazilite scholar who made a major contribution to the consolidation of the schools’ theaching and that of al-Tusi, who also made a contrubitued to the integration of the Shi’ite kalam and the spreading of the usuli approach initiated by Shaikh Mufid. Leaving aside the differences in deatil, it seems that there is no noteworthy difference between their approcah to the issue of justice. After the death of Prophet Muhammad (p.b.u.h), one of the most significant debated topics of Muslims was the institution of caliphate. This institution caused crucial argumentations through the ages from Abu Bakr to Abd-al-Majid who was the hundreth khalifa. Some prominent issues in that regard as follows: How khalifa comes to power, who becomes khalifa, whether he is descended from Quraysh or not, which kind of traits khalifa should have, and how khalifa should behave in certain circumstances. While these arguments (...) were going on, caliphate was maintained based on the reign under some certain dynasties’ responsibilities after the Rashidun (rightly guided) Caliphs. Umayyads, Abbasids and Ottoman Dynasties were the most well-known ones of these dynasties. Throughout history, even though caliphate passed in one another’s hands among aforementioned dynasties, none of them did attempt to abolish this position. However, Turkish Muslims who became defeated with European occupation of non-western territories decided to abolish caliphate for the sake of modernization activities within the period of transition from imperialism to nation state. This decision brought about a trauma, which was much more critical than former argumentation around the position in Muslim world. Many congresses were organized in Islamic world in order to recover from this trauma. While this kind of quests were continuing, Muhammad Hamīdullah proposed “High Caliphate Council” in relation to rearrangement of caliphate in accordance with the conditions of Islamic countries. This proposal offers an applicable model to today’s modern nation states by establishing unity among them and leaving aside their conflicts and differences. This proposal offers a resolution of much-discussed matters of the position within the limits of principals. It also draws attention by showing a possibility of Islamic union in contemporary Islamic thought. Summary: The matters of who undertakes the management of societies, how rulers come to power and in what manners the rulers maintain the management have been discussed throughout history. It is seen that rulers adopted kingdom as regime before the period of the Prophet Muhammad (p.b.u.h). There was also two-person management. The discussions about this matter were also seen around khalifas who were the rulers of Muslims after the death of Prophet Muhammad (p.b.u.h). Some debated issues in that regards as follows: Who becomes khalifa, how he is elected, which traits he should possess, and so on. Caliphate continued its existence despite the discussions until the first quarter of the 14th Hijra era. Abolition of caliphate was a trauma for Muslims undoubtedly. From Anatolia to Egypt and from India to the Balkans, many attempts were carried out to recover from this trauma. However, this matter was oversimplified in the conditions of that period since it became a topic which was hushed over in just congresses and conventions. One of the people who wrote on this topic, which maintains its vitality even today was Muhammad Hamīdullah. He was an important Islamic scholar, a lawyer and a historian in Indian geography. Hamīdullah did deal caliphate by indicating its history broadly. The distinctive feature of Hamīdullah from others who wrote on this topic is that he also presented a considerable offer to solve the matter. In this sense, Hamīdullah experienced the trauma in his own life as all muslims did it with the abolition of caliphate. Hence he mentioned this matter in his writings in the mood of care and dignity of a scientist and also in feeling of a heartbroken muslim. Hamīdullah made clear that the method of election of the ruler differed throughout history. Indeed, the verses of Holy Qur’ān, the applications of the Prophet Muhammad (p.b.u.h) and the differences of Four Great Chaliphs on coming to power testified this claim. According to Hamīdullah, it is quite normal that the method of regime can vary according to the conditions of societies. He recommended acting based on timeless rules rather than the changes that vary according to conditions and places. He also stated that the regime which Islam approves is a combination of kingdom and democracy in his lines dealing with methods of regime. To him, kingdom is the method of regime of empire. Empire is the regime in which various nationalities live together with all their differences and interact with one another intensely and in which the rulers rule over wide borders. On the other hand, Islamic world lost its edges of empire, changed its regime and divided to nation states after the decline of the Ottoman Empire and Mughal Empire which were established by Muslims. On the contrary, westerners attempted to establish a head empire several times after building nation states in Europe. Some of them are UN, NATO, EU, to name but a few. In our opinion, in the transition process of Muslim rulers from empire to nation state, Hamīdullah made an offer to accomodate Islamic law in state law, Islamic politic and administrative principles in politics and administration practices, Islamic education system in education system, and principles of Islamic economics in economic decisions of government using the Prophet Muhammed’s life as a base. He also explained to Muslims that the method of regime can be changed and the essential matter is to apply Islamic management principles in such a new situation. He played a role in clearing the way for Muslims by indicating that the method of Islamic regime can be changed according to conditions but the principles of Islam are unalterable. To the writer of these lines, Hamīdullah intimates that it is not so true to stick to the form of the process in Muslim territories in which a compulsory transition from the empires or multinational social structures to the nation state structures have been experienced for the last two ages. However, the first matter to dwell on should be whether the ruler of the government behaves in accoradance with the principles of Islam or not. To Hamīdullah, the second matter is that even though Muslim countries had to enter in the process of becoming nation states, Muslims should make an effort to establish supra-state associations as required by Islam. In this respect, Hamīdullah’s proposal is “High Caliphate Council”. This council is a considerable offer presented to Muslim countries in the age when a universal caliphate is not possible and Muslims head towards a unified state form all over the world. Today, this offer recommends countries of which great majority is Muslims and in which Muslims are minority to meet on a common ground rather than conflict because of differences among them. The High Caliphate Council is an institute consists of presidents or hereditary administrators as leading and regular members and so it avoids regional competition. It is established by Muslim presidents who shares the chair alternately. Based on this, all Muslim presidents play a role altogether in this council without need to be Sunni, Shia, or from Quraysh. The High Caliphate Council is a reflection of a dream, which started a century and half a century ago but is required more today. It is also a reflection of the discourse of “Islamic Union” in Contemporary Islamic Thought. The Caliphate Council and International Islamic Legists’ Association, which is the first practical step of the council can be seen as the theory of a new world order based on the unity principle of Islam. Hamīdullah does not consider this order not only in the range of belief but also with the aim of institutionalizing ‘ijmā (consensus of Islamic legists) and qiyās(legal analogy). He stated that International Islamic Legists’ Association, which is a scientific institution could not be established beforetime by Muslims spread on three continents due to lacking of communication among them. However, thanks to today’s possibilities, the establishment of such association is easier today. Hamīdullah found dynamic solutions such these two institutions for the realization of caliphate, which is a religious necessity. Abū Lahab (d. 2/624), one of the notables of Mecca, was one of the Prophet’s four uncles who reached the Islamic period. Abū Lahab who had generally good relations with the Prophet before the Islamic period developed bad attitudes towards his nephew when his prophethood was proclaimed and maintained these until his death. He, known for loyalty to his ancestor’s religion, did not believe in his nephew’s prophecy and was one of the chief antagonist and enemy of the Prophet in (...) Mecca. In addition to the fact that Abū Lahab had an identity devoted to his ancestor, by force of emphasis of social justice, the Prophet’s new religion defending equality among people and ordering to the faith of afterlife caused to have a strong opposition to his nephew. In the development of Abū Lahab’s opposing attitude his wife Umm Jamīl (d.?/?) plays a crucial role. In this article, Abū Lahab and the reasons which prompted to oppose to the Prophet and his religion were examined in detail. In addition, his life and relations with the Prophet before and after nubuwwa were detailed.Summary: bū Lahab is one of the four uncles of the Prophet Muḥammad, who reached the time of his prophethood. There is no information in the sources related to his birth, childhood and youth. His real name is known as ‘Abd al-‘Uzzā, and his nickname is Abū ‘Utba or, according to a weak opinion, Abū ‘Utayba. In most of the sources, it is noted that the (second) nickname of Abū Lahab was given by his father because he was so handsome, that he was shining like a fire or his cheeks were reddish as if they were fevering. Detailed information about Abū Lahab belongs to the post-prophetic period; information about his life before prophethood is less. Among these rare information there are findings that he was among the richest and most respected people of Mecca; saved by paying his diet a Meccan aristocrat who was held hostage by a caravan he met on the road to Mecca- al-Ṭāʾif; was involved with his friends in the theft incident against the golden gazelle statue in the Kaaba to supply his drinking money. The sources record that he was delighted with the birth of the Prophet and allowed his concubine to breastfeed the Prophet. Relations with the Prophet during this period, except for the anger of the Prophet because the supported Abū Ṭālib (d. 619) in a fight with Abū Ṭālib, generally followed a positive course. So much that he asked the two daughters of the Prophet to marry his two sons. However, these positive relations were broken and replaced by hostility after the Prophet was given the duty of prophethood and the Messenger of Allāh started to serve this duty.Abū Lahab, who can be regarded as a filiopietist, made every attempt to eliminate this new belief, which he saw as contrary to his ancestors' beliefs. He watched his nephew, did everything he could to deny what he was saying and prevent him from getting a response. He would grind him by throwing feces, carrion, animal droppings and stinking things to the door of his house to disturb him. He did not hesitate to increase the severity of this hostility. So much that he was among those who sentenced him to hunger by applying a socio-economic boycott to Muḥammad and his close relatives, Banū Hāshim and Banū Muṭṭalib, who supported him. However, in the pre-Islamic period, a sense of tribalism was dominant in Mecca and its nearby basin. This understanding was also dominant in the lower arms of the Quraysh tribe, who was a resident of Mecca. These communities, especially Banū Umayya and Banū Makhzūm, who represent the Mecca aristocracy, strongly opposed the prophecy of one of the Banū Hāshim. On the other hand, the Banū Hāshim adopted the Prophet with the same understanding. However, there was only one person who acted against this understanding among all Banū Hāshim, and this was Abū Lahab. He treated his nephew so much in hostility that he became the only person among the Mecca polytheists who was condemned by the Qur'ān. Perhaps the most important and influential factor in his persistence in a stubborn and systematic opposition to the Prophet, was his ancestral identity. In addition, in the pre-Islamic Mecca, the people were divided into social strata, inequality among people, and the aristocratic segment was the highest level of society. Islam advocated equality among people due to its vision of social justice. The Mecca aristocrats, including Abū Lahab, considered themselves superior to other people and thought that they were in no way equal to those who were lower in terms of property, position and nobility. This understanding was one of the most important factors that enabled Abū Lahab to take place in the block against this new belief system communicated by the Prophet. Again, one of the important factors in his displaying a stubborn and systematic opposition to the Prophet is that Islam accepts the belief in the hereafter as one of the basic principles of religion. Like the other polytheist Meccans, Abū Lahab did not believe in the resurrection. His wife Umm Jamīl was another factor of his opposition stance. The traditional rivalries between Umm Jamīl’s family Banū Umayya and Abū Lahab’s family Banū Hāshim, lead to a sense of competition against. This feeling prompted her to oppose the prophecy of one of the Banū Hāshim. So she always provoked her husband and Abū Lahab’s hatred toward his nephew never stopped to such an extent that it was mentioned in the surah Tabbat/al-Masad by a metaphor of carrying wood to feed the fire of hatred. Actually it was only Abū Lahab who was hostile to Muḥammad's prophethood among all the Banū Hāshim. With the prophethood of Muḥammad, beginning to display a stubborn and systematic opposition to Islam, Abū Lahab continued this opposition intensely in the following periods and died in the second year of the hijra with this attitude. His wife, Umm Jamīl, died with the same understanding and shared the same contractual fate with him. However, all her children -except for ‘Utayba (d.? /?) - were honored with Islam and were among the Prophet's distinguished companions. (shrink)

: In a recent issue of Der Islam, Stephen R. Shoemaker has contributed an extensive article in which he challenged the processes and findings of a number of studies conducted by Gregor Schoeler, Harald Motzki, and Andreas Görke. The following article offers a response to his findings. Whereas the three authors argued the case for the possibility that authentic traditions of the first century of the Hijra can be reconstructed, Shoemaker holds the contrary point of view, as already stated (...) in the abstract of his study: “While az-Zuhrī and occasionally other authorities of his generation can often be persuasively linked with the tradition in question, the reach back to ’Urwa is generally not convincing …” Yet he is not entirely consistent in his views. In his study several statements are to be found that in fact support the views of the authors whose studies he critically examines. Overall, Shoemaker makes more concessions towards the possible authenticity of some of the material traced back to the first century than any “sceptic” prior to him. Unfortunately, Shoemaker’s criticism and rendering of the three authors’ studies is fraught with misunderstandings and inconsistencies. They are the focus of attention in this critical review. In addition, hitherto unknown traditions as well as sources that Shoemaker mentions without quoting or paraphrasing them will be presented. This article aims at examining the limits of change in the field of worship through a study on the origins of the ḥukm[religious ruling] of Shawwāl fasting that is widely practiced in the different parts of Muslim world. The study, firstly, deals with the evolution of the ḥukm of Shawwāl fasting chronologically among four sunnī schools of law, then analyzes the solitary reports on the topic. It concludes that in Mālikīand Ḥanefīschools, the ḥukm of this specific worship changed within the (...) limits of karāha [reprehensibility], ibāha [permissibility], and nadb [recommendation]. This ḥukm was constructed based on solitary reports which later became a paradigmatic source of religious legitimacy in the Ḥanbalīschool beginning with the eponymous Imām and in the Shāfiʿīlong after the founding authorities. It also claims that it is strongly probable that the solitary reports on the topic go back to a deduced opinion in the age of companions, but then reached to a form of prophetic solitary report in the corpus of hadīth reports. Ultimately, this specific worship that has restricted number of fasting was established with the paradigmatic effect of the approach to solitary reports as the only authentic way of transmitting the sunna, even though it is at odds with the fact that this worship had not been implemented in the first two centuries after hijra, i.e. contrary to the established practice [ʿamal]. Summary: The issue of change of rulings in Islamic law comes up frequently on various occasions, and an increasing number of academic studies are trying to determine the characteristics and limits of this change in numerous books, articles and papers. These studies mostly seem to focus on bringing together the arguments that can be compiled under the title of ‘the flexibility of Islamic law in response to the challenges of modernity’. Although the change of rulings in Islamic law is an undeniable fact, reading it only from the lens of the change in Islamic law depending on the requirements of time is an inadequate reading. The change of rulings in Islamic law has different motives; and the change of time, more precisely the change of custom, is only one of them.On the other hand, another issue that comes up in relation to the change of rulings is the claim that this change can only take place in terms of the rulings regulating the interpersonal relations, i.e. muʿāmalāt. In fact, this claim relies on the abovementioned approach that limits the change in Islamic law with the change of custom. Hence, because other two main areas of Islamic law, worships (ʿibādāt) and punishments (ʿuqūbāt) are not open to change through custom, their rulings will not change at all. This article will try to reveal that the change in rulings might reside in a sort of another change emerged in relation to the sources of these rulings, which is a neglected point. Thus, by exposing that the field of worships which is mostly considered as a closed area for change in rulings is actually open to it, this article will examine the limits of this change.For this analysis, the article deals with the fasting of six days in the month of Shawwāl as an example, which is widely practiced in various parts of the Islamic world. The main evidence on which this fasting is based on is a report transmitted in the considerably authentic hadith sources of Ahl al-Sunnah, which reads as follows “Whoever fasts the Ramaḍān and adds six days from Shawwāl, will get reward of the entire year”. This fasting, which is the subject of a great agreement on its ruling as recommended (mustaḥāb) practice today, was actually regarded as reprehensible (makrūh) by the two great eponymous jurists of the first two schools of law in the second Hijrī century, namely Mālik b. Anas and Abū Ḥanīfa. In his al-Muwaṭṭaʾ,Mālik clearly expresses that he did not recognize any scholar who keeps this fast, and that no [authentic] report has reached him on this. The fact that both Mālik b. Anas and Abū Ḥanīfa declared an opinion on the subject shows that this practice started to appear in the first half of the second ḥijrī century as a practice or as a solitary report (khabar al-wāḥid). However, both imāms have stated that such a specific worship would be makrūh. In spite of these very sharp expressions, the schools of law, which were founded by the followers of these two eponymous scholars, abandoned their views and widely accepted Shawwāl fasting as mustaḥāb. This article examines why this sharp change occurred in a worship in the schools of law and in which way it took place.Accordingly, the fundamental motive in this change is a paradigmatic transformation in understanding and identifying the sunna as a source of normativity. Although an agreement was formed on the validity of solitary reports as a source of knowledge in the second ḥijrī century, it was not yet accepted that these narrations are identical to sunna as a source of normativity. For that reason, both Abū Ḥanīfa and Mālik did not hesitate to reject any solitary report that contradicted a stronger evidence. However, as a result of the extraordinary efforts of Ahl al-Ḥadīth, the epistemic value of solitary reports has reached to an authority equating them to the sunna with a very rapid acceleration as of the end of the second century and throughout the third century. This situation led later scholars of schools to abandon the views of the eponymous scholars of these schools on certain topics in favor of certain solitary reports. This was also the process for the change in Shawwāl fasting.This thesis will be put under two headings, a section that tries to determine the periods and processes for the Sunnī schools of law in considering this fasting as mustaḥāb; and another section that provides an evaluation of transmitted reports in relation to the Shawwāl fasting. Accordingly, in the Mālikī and Ḥanafī schools, due to the effect of the reports, the ruling of Shawwāl fasting has been transformed from makrūh into the mustaḥāb as a result of the interpretational activities that started in the fourth ḥijrī century. Shawwāl fasting was accepted as mustaḥāb in the Shāfiʿī school, although there was no transmitted opinion on the subject from the founding imāms, in the fifth ḥijrī century; and in the Ḥanbalī school directly by the founding imām Aḥmad b. Ḥanbal, whose main aim was to follow a concept of religion that puts the transmitted reports at the center. When the reports on the subject are examined, it demonstrates that the mustaḥāb ruling is mainly rooted in a report by Saʿd b. Saʿīd transmitted in the famous hadīth compilations including Muslim’s Ṣaḥīḥ.Yet, this report was criticized in its both chain and text. Combining the facts that the same report with the same chain was also transmitted as the words of the companion in some sources and the verse that declares good deed will be rewarded ten times higher than what it deserves will make the following explanation a valid one: As Mālik put it such a fasting practice was commonly unknown to the Muslim society in the first two centuries after the ḥijra. Sometime after the death of the Prophet, an inference was made probably by a companion(s) as that it would be a good deed if someone who fasted an entire month already and got used to the fasting to fast six more days in order to get a reward of fasting for the entire year according to the verse that rewards good deeds with ten times higher. Since it is a recommended practice in essence, i.e. fasting for the sake of Allah, this inference transformed into a report and easily passed through the filters of hadīth scholars who are linked to a sort of piety promoting worships among people. After the solitary reports gained an authority to the extent that they can rarely be challenged, the followers of later schools of law preferred to get in a process of re-interpreting the opinions of their imāms in order either to reconcile them with the content of report, or at least to show why these imāms actually spoke against this fasting. Eventually, the later scholars of madhhab decided for the standard opinion of the madhhab depending on the reports in favor of the Shawwāl fasting rather than following their eponymous imāms. : The schools of fiqh applied different methods to eliminate contradictions between narrations. In fact, this difference in methodology directly led to fiqh disagreement. Thus, a school explains within the framework of its own procedural system which of the contradictory narratives it uses as evidence, the reason for using this narrative, how they interpret other narrations about the subject or the reason for not using these reports as evidence. This article aims to chronologically examine the theory that the Ḥanafī developed (...) about antithetical narratives based on ‘Īsā ibn Abān, al-Karkhī, al-Jaṣṣāṣ, al-Dabūsī, al-Pazdawī and al-Sarakhsī. Moreover, the criticisms and contributions made by the scholars of the principles of jurisprudence are determined. Frequently repeated approach in some research that the Hanafis first used the abrogation to fulfill the contradiction between the narrations is questioned within the framework of the aforementioned scholars’ viewpoints Summary: The theory of contradictory narratives, developed as part of the narration theory, has an important position in the sense of the school’s approach to the Sunnah. This is because the system that a school of jurisprudence implements to fulfill the contradiction between narrations has an important influence in scholars’ juridical opinion. In some studies carried out today, the system developed by the Ḥanafī to eliminate the contradiction between narratives is presented in two different ways as abrogation, preference, conciliation and not to use as evidence or abrogation, conciliation and applying principles. The common point of the two hierarchies of solution is placing abrogation in first rank. In order to test the accuracy of this information in this research, we studied the system that the Ḥanafi scholars who lived in the first five centuries of the Hijra followed to eliminate the contradiction between the narrations. The development of this theory in the five centuries of the Hijra was examined on the basis of the views of ‘Īsā ibn Abān, al-Karkhī, al-Jaṣṣāṣ, al-Dabūsī and al-Sarakhsī. It is an indisputable fact that the construction and development of a theory requires a process. In this context, the present study investigated when and on which principles the theory of contradictory narratives on Ḥanafīan theory of narrative/Sunnah is started to be instituted; who and for what reasons contributed to it during this evolution process and how; and how it is instituted the way of solution hierarchy in theearly period which makes a differentiation in comments between Ḥanafīan later. This theory was enriched by principles that were developed with different perspectives during a long process and its comprehensibility was boosted using new concepts and systematic expression. Ḥanafī legal theorists benefited from the opinions of masters of the jurisprudence school to enrich this theory in terms of principles. This suggests that the theory is a scientific effort aimed at discovering how masters of the jurisprudence school are following a method in the face of contradictory narratives. As far as known, Isā ibn Abān is the first theoretician to have detailed methodological explanations related to contradictory narratives between the Hanafi scholars. This shows that the theory related to contradictory narratives was established at the beginning of the third century of the hegira. 'Isā ibn Abān divides the opposite narratives into hadiths that are compatible with consensus and hadiths that are contrary to consensus on the basis of consensus. He accepts the hadith in the first group and he evaluates the hadith in the second group as the abrogated if it is authentic. It must be stated that this solution path which Isā ibn Abān put forth is of high practical value. There is no practical value in fıqh to eliminate the contradiction between the hadith which is compatible with the consensus and the hadith contrary to this consensus by the conciliation method. Moreover, giving an active role to the consensus in the determination of the abrogating and abrogated also prevents easy access to the method of abrogation. ‘Isā ibn Abān divides hadiths that are without consensus about their provisions into two: the appearance date is known and unknown. He first applied the conciliation method to fulfill the contradictions between the narrations in both groups. If the problem is not solved by the conciliation method, Isā applies the abrogation method for narrations whose the appearance date is known. The ones that the date is not known can be acceptable in accordance with the originals, and if this is not possible, he says that both narrations cannot be used as evidence. al-Jaṣṣāṣ, who is one of the people who convey mostly al-Karkhī's views on fiqh methodology, does not convey the views of al-Karkhī on contradictory narratives in integrity that we see in the transmission of 'Isā ibn Abān’s theory and its interpretation. It is understood that al-Jaṣṣāṣ benefited from the views of al-Karkhī to improve the system of Isā ibn Abān. This suggests that al-Karkhī basically accepted the system of contradictory narratives established by Isā ibn Abān. al-Jaṣṣāṣ 's most important role in the theory of contradictory narratives is based on the principles laid down by ‘Isā ibn Abān and al-Karkhī. The person who mostly contributed to this theory after al-Karkhī is al-Dabūsī. It is understood from al-Dabūsī’s accounts that he divides the contradiction into two parts, the truth and the apparent. al-Dabūsī stipulated for evaluating a contradiction as a real contradiction. These conditions are, in essence, solutions for the elimination of the contradiction. When it comes to al-Sarakhsī, he dealt with this issue more precisely with concepts such as “evidence”, “judgement”, “state”, “date is clear in the text”, “date is not clear in the text”. In the system of al-Sarakhsī, the last option is the abrogation to eliminate the contradiction. (shrink)

The law of responsibility (compensation), which was formed around the concept of the ḍamān and was developed by the scholars within the system of furû‘ al-fiqh (substantive law) over time, constitutes one of the important parts of Islamic law. Although compensation law (ḍamān) was not addressed as a private subject in the first period fiqh literature, it is seen that the literature on this specific area started to emerge after the early period. It is the Hanafi jurists who first brought (...) together these issues that are scattered in the classical books of fiqh that are related to the law of responsibility. Compensation law took its classical form in the texts of the early periods and was shaped around the views of the founding imams of the Ḥanafī school (madhab). It has later been expanded with the fatwā and interpretations of the Sheikhs (mesāikh) of Hanafi in the type of waqi'at works. These works were a product of the need for the law to adapt to the new conditions. These issues, which are related to the compensation law in the Hanafi school have been covered as a special section (chapter) in the studies that are classified as waqi'at, such as Usrūshanī’s al-Fuṣūl fī al-muʿāmalat (Fuṣūl al-Usrūshanī), ʿImād al-Dīn al-Marginānī’s Fuṣūl al-iḥkām fī uṣūl al-aḥkām and Shaykh Badr al-Dīn’s Jāmiʿal-Fuṣūlāyn. Later, the topics discussed in these works were developed and continued, and ultimately separate works related to this field have been copyrighted. In this study, the kinds of development and expansion which are in the literature and related subjects will be discussed by examining the above-mentioned works. Therefore; first of all, the first examples of Hanafi jurists related the compensation will be analysed comparatively. Afterwards, the place of ad-Ḍamānāt fī al-furūʻ al-Ḥanafīyyah of Fuḍayl Chalābī (d. 991/1583), one of the Zenbillizade’s, will be addressed.Summary: The core idea of the law of responsibility, which constitutes one of the important parts of Islamic law, was stated in the Qur'an and Hadith, and then have accumulated by the contributions of the jurists (fuqaha), as they developed the idea of the law of responsibility within the furû‘ al-fiqh in relation to the systematic of the legal school (madhab) that they belonged to.These issues, which constitute one of the important parts of the law, were addressed by sprinkling among the topics in almost every part of classical fiqh books. In other words, the subject of ḍamān (responsibility) was not considered as a separate subject in the fiqh works of the first period. In this way, it is seen that the literature on compensation law started to emerge in the following periods, and at first several independent sections on this subject, and then separate works specific to this field, albeit limited in number, were written.It is the Ḥanafī jurists who first brought together these issues that are scattered in the classical fiqh books related to the law of responsibility. Compensation law, which took its classical form in the texts from early periods, shaped around the views of the pioneering imams of the Ḥanafī school, has been expanded with the fatwā and interpretations of the Sheikhs (mesāikh) of Ḥanafī in the waqi'at works, which is a product of the need for the law to adapt to new conditions. Firstly, one of the Ḥanafī jurists, Majd al-Dīn al-Usrūshanī (d. 637/1240) dealt with the responsibilities arising from the contract and unfair acts in the 29th section of his book named al-Fuṣūl fī al-muʿāmalat under the title “Types of Compensation Required to be Paid and Their Situation”. The method and system that Usrūshanī started in this work, the Ḥanafī jurisits ʿImād al-Dīn al-Marginānī in the Fuṣūl al-iḥkām fī uṣūl al-aḥkām and Shaykh Badr al-Dīn Ibn Qāḍī Samāwnā in the Jāmiʿ al-Fuṣūlāyn continued to develop the compensation section in their books. Afterwards Fuḍayl Chalābī (d. 991/1583), one of the members of Zenbillizade’s family, enriched these issues and made it an individual work, named ad-Ḍamānāt fī al-furūʻ al-Ḥanafīyyah. Marginānī titled the issues that Usrūshanī had handled in the compensation section and systemised it even more by gathering the fatwās on the related issues under one heading. It is noteworthy to mention that when the compensation sections of both works are compared, the way the subjects handled are exactly the same. But unlike Usrūshanī, Marginānī added the compensation for damages to the fetus in the womb and the responsibility of the person who brought back the fleeing slave at the end of the chapter. On the other hand, unlike them, Shaykh Badr al-Dīn added only the responsibility of the person who found the lost item. Considering that almost all of the topics in the compensation section of Sheikh Badr al-Dīn existed exactly in the compensation section of Marginānī, and that most of them were stated in Usrūshanī’s al-Fuṣūl, it is necessary to say that all of these discussions are based on Usrūshanī as the main backbone of this particular subject and that his work has a unique place in the Islamic legal literature. Chalābī’s ad-Ḍamānāt, is the first work that was written as a separate book in the field of compensation law. Even though in some modern works claim that the work Ghānim al-Baghdādī’s (d. 1030/1620) book named Majma‘ al-ḍamānāt fī madhhab al-Imām al-A'zam Abī Ḥanīfa al-Nu'mān was the first written book in this field; it is known that Chalābī's ad-Ḍamānāt had been written before Baghdādī’s Majma‘ al-ḍamānāt. As a matter of fact, the work of Chalābī had been completed in 984 Hijra, and the Baghdādī’s Majma‘ al-ḍamānāt was completed in 1027 Hijra. Although the subject sequence in Baghdādī’s work is different; this work is regarded as a continuation of the same tradition.An examination of the systematic and the content of the work reveals that Chalabi’s ad-Ḍamānāt is the continuation of the type of writing that Usrūshanī started and developed by Marginānī and Shaykh Badr al-Dīn. When compared with the compensation sections of these works before him, Chalābī has added new compensation issues to his book that are not addressed in these three works; such as partnership, mudaraba, suretyship (kafāla) transfer (ḥawāla), peace, legal disability (hajr), freedom of trade (idhn) and testament. Among the works mentioned above, works out of Shaykh Badr al-Dīn’s Jāmiʿ al-Fuṣūlāyn and Baghdādī’s Majma‘ al-ḍamānāt are available as manuscripts in the libraries. Therefore, these works have not been used much in modern studies on compensation. In addition, the Chalābī's ad-Ḍamānāt is almost unknown. Although there is little information about this work in some bibliographic studies, it is noteworthy to state that this work is not used as a source in contemporary studies written in Arabic on compensation law. The fact that this work is available as manuscripts in Istanbul libraries is probably the reason for this outcome. It is also very difficult to say that this work is known and used sufficiently in studies written in Turkish.Usrūshanī’s al-Fuṣūl fī al-muʿāmalat and Marginānī’s Fuṣūl al-iḥkām are currently in the form of manuscripts, so there is no comprehensive study on the whole work and the compensation section. It is possible to see the compensation issues discussed in the work, since Shaykh Badr al-Dīn’s Jāmiʿ al-Fuṣūlāyn, which has been published as printed, was translated into Turkish by an editorial group under the presidency of H. Yunus Apaydın. In addition, Kemal Yıldız, who translated the compensation section in this translation, published this section in Jāmiʿal-Fuṣūlāyn as a separate book with the name of “Sources of the Jāmiʿ al-Fuṣūlāyn and Compensation in the Practice of Ḥanafī School”. Yıldız, first introduced the sources of the Jāmiʿ al-Fuṣūlāyn in the first part of this work and then translated the compensation section from beginning to end by adding his own explanations and evaluations around the subject during the second part. Even though some introductory information about the books of Usrūshanī and Marginānī is presented in Yıldız’s study, the absence of information on the contents of the compensation sections of these books does not allow the opportunity for the researchers to evaluate on the subject wholly. After receiving the divine authorization from Allah to openly notify people of Islam, the Messenger of Allah started to publicly to invite the people of Mecca to Islam. Idolaters however felt heavy shame to give up the faith of their ancestors, and the pagans did not accept the Prophet's invitation to Islam. They applied various pressures to the Messenger of Allah and the believers to renounce the cause of Islam. When the animosity against the new Muslims became intolerable, Almighty Allah (...) gave permission to immigrate, first to Habasha and then to Medina. Some of the companions of the Prophet periodically immigrated to Habasha and then to Medina. In the sources that have survived to the present day, poets (ṣaḥāba: companion of the Prophet Muhammad peace be upon him) reflect the events experienced during the immigration to Medina and the intensity of emotions they felt during the holy journey. These poets demonstrate in their writings a sense of elation and pride, having followed the Prophet's favorable advice to immigrate to Medina and portend that their religion will be strengthened in Medina by their presence. Their poems in terms of style are more focused on unscripted, or spontaneous feelings, a style of pauses to give harmony between the shorter verses, unlike long poetic tradition in the period of ignorance (Jāhiliyya).Summary: The Messenger of Allah comes into the world of Mecca, where injustice and distorted belief forms prevail, and when he is forty years old, he is commissioned as a prophet by Allah Almighty. Considering the possibility that the Islamic invitation will not be accepted and welcomed by the pagan Arabs in Mecca, the Prophet tries to spread his cause among the people only he has trusted for three years. When revelation regarding publicly conveying Islam came, the Prophet begins to openly invite the people of Mecca to Islam. Since leaving the beliefs that are patrimonies preponderated the pagans, they started oppressing the Prophet and the believers. When the pressure exerted by the pagans exceeded the limit of tolerance, the Prophet advised the Ṣaḥāba for the temporary migration to Abyssinia. Some Muslims in need of protection followed the advice of the Messenger of Allah, and they migrated to Abyssinia. In the meantime, the Prophet was under the protection of his uncle Abū Ṭālib. After the death of Abū Ṭālib, the pressure on the Prophet increased day by day. Moreover, it was even planned by the pagans to have them eradicated through conspiring against them. The Prophet, who understood that he cannot convey Islam in Mecca, went to Tāif to describe his case. The Prophet, however, faced a harsh reaction in Tāif and was forced to return to Mecca.In the meantime, the people of Medina were in search of a leader to eliminate the mess in consequence of wars and instability with Jews on the one hand and among each other on the other hand. The Prophet came to Mecca in the Ḥājj (pilgrimage) season and also presented the religion of Islam to groups from Medina People who perceived that the Prophet has the features to overcome the disasters between them, they pledge allegiance to the Prophet through the agreements known as Bay‘a al-‘Aqaba in the region called al-‘Aqaba, respectively as Bay‘a al-‘Aqaba I and II. In this way, the city of Medina became ready to welcome the immigrants and to be a base of the Islamic religion that will open up to the world. Almighty Allah is first allowed to Ṣaḥāba and then to Prophet to migrate to Medina and with migration of Prophet to Medina, a significant breakthrough was achieved in the history of Islam.Since the issue of the migration to Medina corresponds to the early period of Islam, the sources of poetry reflected the migration of the Ṣaḥāba to Medina are few in number. Relevant texts in the available sources can be found consist of five articles as, three of them belong to Abū Aḥmad b. Jaḥsh, the fourth belongs to Bujaid b. 'Imran al-Huzâ'î'e and the last one belongs to an unknown poet. Because of his connection to the hegira, a verse pursuant to idolater poet Utbe b. Rabî‘a was also included in the subject. In related poem texts, it is seen that the Ṣaḥābahs poets had prided themselves on the fact that they followed the advice made by the Messenger of Allah on his way to hegira to Medina and they tried to reflect the intensity of emotions they experienced in the face of the developments that occurred since the first moments of the movement of emigration to the poems. Determined to migrate to Medina in order to strengthen the Islamic invitation, the poet Abū Aḥmad reflected the self-confidence of walking on the right way. Abū Aḥmad promised the Messenger of Allah that he will migrate to Medina and he was faithful to his word. Abū Aḥmad tried to resolve his concerns of his wife Umm Aḥmad that they might be harmed by the polytheists if they migrate to Medina and emphasized that they migrate to Medina in order to strengthen the God Almighty against superstitions.Undoubtedly, the concerns of Umm Aḥmad in this context give clues about the dimensions of mobbing, oppression and torture policies applied to Muslims in Mecca. Abū Aḥmad and his associates were full of belief that Almighty Allah will meet their expectations as they migrate to Medina in line with the recommendations of the Prophet. In this respect, the poet turns a deaf ear to the advice of many men, women and friends to not to leave Mecca environment that he was born and grew up in and the memories that adorns his inner life shaped. The poet also points to the importance of the fellowship of Islam, rather than the spirit of Jāhiliyya As a matter of fact, because of tribal chauvinism, the poet called for the termination of hostilities in the past and convinced those around him to follow the call. In this respect, the poet is in peace with the fact that the family members will also have the blessings waiting for those who migrate for Allah. According to the poet, the idolaters who favored blasphemy and who opposed Muslims, deserved the wrath of Allah. Even if there are blood ties with the Muslims, the idolaters who favor the blasphemy and opposed the Muslims are frustrated. In another poem, the poet also boasts Ghanm family, of whom he was a member, because they had fulfilled the promise they had given to the Prophet, that they would migrate to Medina. According to the poet, the Ghanm family is essentially loyal to the Prophet. As a matter of fact, the Ghanm family, which once occupied Mecca and lived off in Mecca, left the lands they lived in for Allah and migrated to Medina in groups of single and two in order to strengthen the invitation to Islam.Poet Bujaid b. ʿImrān al-Khuāz‘i boasts about the fact that Khuzā'a tribe, of which he was a member, that is the lower tribe of the Kaʿb sons, supported the Prophet and some of his people migrated to Medina in his verses. In fact, according to the poet, the members of the Khuzā'a tribe trotted off to the Medina on the advice of the Prophet without wasting any time. Moreover, due to the agreement between the Khuzā'a tribe, who played a key role in the reasons causing conquest of Mecca, and the Prophet, Mecca was conquered and Mecca skies were cleaned from idolatry mist. The Khuzā'a tribe was instrumental owing to their admirable attitude in the conquest of Mecca and the Prophet to gain strength, despite the idolaters who once forced the Prophet to leave Mecca. In the verses of the unidentified poet, it is seen that the names of the eight Ṣaḥāba who were subjected to oppression in the most troubled early periods of Islam, who left their homeland for Allah, migrated to Abyssinia or Medina and were heralded to enter heaven were mentioned. According to an unidentified poet, it is not possible for anyone to reach the rankings of these eight people due to the beautiful actions they performed.In the last poem text, it is seen that the poet Abū Aḥmad was dissatisfied with the confiscation and sale of his house by Abū Sufyān when he emigrated to Medina. In the verses, the poet likens his home being unjustly confiscated by Abū Sufyān to a hunter holding the dove he seized tightly and he emphasizes that he will get his due in the afterlife from Abū Sufyān.The poetry texts bearing the traces of migration to Medina are a continuation of the poetry technique of the period of Jāhiliyya in terms of the poetry technique, when wordings that are in accordance with the spirit of Islam are left aside. As a matter of fact, poets try to reflect the intensity of emotions they live in short verses instead of long term poems. Again, poets use the types of art, such as borrowing, metaphor and comparison, which are frequently used in the poetry of the Jāhiliyya in order to bring the intensity of emotion they live in closer to the audience's perception. Poets build on these poems on taweel, muteqâreb, baseet and qamel, which are frequently found poetic measures in the poetry of Jāhiliyya. As a last word, it is necessary to say that the poetry texts of Ṣaḥāba poets are historical objects in terms of shedding light on the events experienced during the Hijra. Again, the poem texts in question are important in terms of getting an idea about the state of old Arabic poetry during the transition period from the period of Jāhiliyya to the period of Islam. Cet article interroge, à l’aide d’une trajectoire singulière issue de la clinique des auteurs, le lien entre la construction des imagos parentales chez une femme française issue de l’immigration maghrébine et son adhésion à l’idéologie religieuse radicale de Daech. Il s’agit plus précisément d’entrevoir les échecs et les impasses de l’institution familiale et sociale et la manière dont cette jeune femme s’est saisie de la Umma (la communauté des musulmans dans le monde) – dont la racine Um signifie en arabe (...) « mère » – pour rompre avec la France et construire une nouvelle famille au sein de l’organisation terroriste de Daech. Cette analyse permettra de faire des hypothèses cliniques quant à la défaillance des fonctions maternelles et paternelles dans la construction d’un devenir femme et de mettre en lumière l’absence ou l’exclusion du tiers et la tentative de séparation avortée menant vers des positions radicales. Un extrême qui ramène à une fusion avec le corps maternel à travers la Umma et le groupe des sœurs musulmanes. (shrink)
