In the article, I engage with H.G.Gadamer’s reading of Kant’s aesthetic theory. Gadamer accused Kant of subjectivizing the aesthetic experience so that it would be reduced to the free play of the cognitive faculties of the subject. Consequently, the ethical dimension of aesthetic experience that played such an important role in the preceding tradition of European humanism has been lost. Yet, this charge of Gadamer is not quite right. The connection between the experience of beauty and ethics has been maintained (...) by Kant, but it has assumed a different form. The free, disinterested beauty of the objects of nature, on his account, harmonizes with the disinterested experience of the moral law. Similarly, the dependent beauty of the work of art appeals to the ethical dimension of the human being. As a result of this, the connection between aesthetics and ethics not only has not been severed by Kant, but it has also assumed an entirely new, radical form. (shrink)

Artykuł przedstawia polskie regulacje prawne z lat 1998-2007 będące podstawą lustracji. Analizuje szereg aktów prawnych prezentując zakładane cele lustracji, jej zakres, procedury i przewidywane sankcje karne. Celem autora jest identyfikacja aksjologicznych podstaw regulacji prawnych dotyczących lustracji. W trakcie analiz wskazuje on m. in. na brak proporcji między sankcjami karnymi a winą jednostek, zwłaszcza w niektórych przypadkach penalizacji oświadczeń lustracyjnych niezgodnych z prawdą lub penalizacji niezłożenia oświadczeń. Autor argumentuje także, że analizowane rozwiązania zakładały – wbrew deklarowanym celom – przeniesienie odpowiedzialności za (...) zło systemu politycznego z jego aktywnych twórców na jednostki wbrew woli poddane działaniu tego systemu. Ponadto argumentuje, że lustracja oparta na przeprowadzanym przez państwo „teście moralności” radykalnie ingeruje w wewnętrzną sferę moralności jednostki i stąd zakłada elementy typowe dla aksjologii systemów totalitarnych; państwo nakazuje dokonać działania, które bezpośrednio i wprost zmierza do realizacji ściśle wewnętrznej wartości moralnej opartej na zgodności oświadczenia z przekonaniami, i jednocześnie państwo ustanawia siebie nie tylko obserwatorem i sędzią realizacji tej wartości, ale także autorem wzorca przekonań, z którymi oświadczenie ma być zgodne. Referat stanowi próbę rekonstrukcji poglądów moralnych i etycznych Krzysztofa Celestyna Mrongowiusza, skrystalizowanych w okresie pobytu w Królewcu, gdzie był studentem tamtejszej Albertyny i uczniem Kanta. Ważnym składnikiem duchowej formacji młodego Mrongowiusza stał się religijny nurt pietyzmu, wywierający w ówczesnych czasach jeszcze znaczny wpływ na atmosferę życia umysłowego zarówno Królewca jak i Albertyny. Wpływ ten widoczny jest także w późniejszych głoszonych przez pastora Mrongowiusza kazaniach. Natomiast fakt dokonanego u schyłku życia przekładu na język polski i publikacji w Gdańsku notatek z królewieckich (...) wykładów wydanych jako „Rozprawa filozoficzna o religii i moralności” Kanta świadczy o wierności gdańskiego kaznodziei wobec nauki moralnej swego najsłynniejszego nauczyciela i zamiarze przekazania jej rodakom jako rodzaj duchowego testamentu. This article focuses on the presentation and critical analysis of selected arguments concerning the ethical evaluation of assisted suicide. The arguments discussed in the article are drawn from both Polish and English-language literature. Four contemporary arguments concerning the ethical acceptability of assisted suicide are presented and critically analysed. These are: the argument from pity and the argument from dignity by Antony Flew, the argument from the value of suffering and natural death by Jerzy Brusila. The aim of this article is (...) to analyse the arguments and determine whether the chosen arguments are conclusive, as well as to identify further areas of research related to the consideration of the ethical acceptability of assisted suicide. Przemocy jest coraz mniej – zarówno w czasie pokoju, jak i podczas wojen. Na przykładzie trzech konfliktów zbrojnych z ostatnich lat zastanawiam się, czy decydenci powinni prowadzić działania zbrojne w taki sposób, by zminimalizować całkowitą liczbę ofiar. Pokazuję, że ani obowiązujące obecnie normy prawa międzynarodowego, ani osądy moralne na temat dopuszczalności stosowania przemocy nie wymagają od decydentów ograniczania całkowitej liczby ofiar konfliktów zbrojnych w każdym przypadku.

Recognizing inherent and inalienable nature of dignity and universality of certain values, the Constitution of the Republic of Poland, introduces to the foundations of Polish legal system some elements of natural law which may be used for application of the Basic Law. Constitutional recognition of these elements only makes sense on the assumption of their cognizability. Therefore, as an important element of constitutional concept of natural law is taken the recognition of the argument of cognitivism according to which moral assessments (...) may have the nature of judgments and truth qualification (they may be true or false). In the course of application of the constitution, norms of natural-law character and natural-law justification. Since dignity and the essence of freedoms and rights based on dignity are the only inviolable values recognized by the constitution, the arguments of natural law lead to a far-going reinterpretation of constitutional norms. The norm of natural law protecting inviolable values will have precedence in the event of collision with norms protecting other values, also with constitutional norms. Even if such a norm is formulated on the basis of the provisions of the constitution, in fact natural law is given higher rank than elements based only on enacted law. Despite that, reliability of a legally established order does not seem to be radically endangered. -/- Konstytucja RP uznając przyrodzoność i niezbywalność godności oraz uniwersalność niektórych wartości, wprowadza do podstaw całego polskiego systemu prawnego elementy prawnonaturalne, które mogą być wykorzystane w stosowaniu konstytucji. Konstytucyjne uznanie takich elementów ma sens przy założeniu ich poznawalności, stąd istotnym elementem konstytucyjnej koncepcji prawa naturalnego jest uznanie tezy kognitywizmu głoszącej, że oceny moralne mogą mieć charakter sądów i kwalifikację prawdziwościową – mogą być prawdziwe lub fałszywe. W procesie stosowania konstytucji mogą być formułowane normy o charakterze prawnonaturalnym oraz uzasadnienia prawnonaturalne. Ponieważ jedynymi wartościami uznanymi w konstytucji za nienaruszalne jest godność oraz istota wolności i praw, których godność jest źródłem, argumentacja prawnonaturalna może prowadzić do daleko idącej reinterpretacji norm konstytucyjnych. Norma prawnonaturalna chroniąca warunki konieczne poszanowania godności lub istoty wolności i praw będzie miała pierwszeństwo w razie kolizji z normami chroniącymi inne wartości, także z normami konstytucyjnymi. Choć norma taka będzie formułowana na podstawie przepisów konstytucji, to jednak faktycznie prawo naturalne uzyskuje wyższą rangę od elementów opartych jedynie na stanowieniu. Mimo tego bezpieczeństwo prawne nie wydaje się być radykalnie zagrożone. O prawnonaturalnym charakterze normy i uzasadnienia decyduje oparcie w ocenach moralnych, które pretendują do bycia sądami, do bycia prawdziwymi lub fałszywymi. Z punktu widzenia stosowania konstytucji i wymogu intersubiektywnej komunikowalności i kontrolowalności dookreślania treści prawnonaturalnych, dla nadania ocenom charakteru sądów istotny jest kształt procedur i argumentacji prowadzących do tego dookreślenia. Powinny to być procedury i argumentacja typowe dla dyskursu mającego na celu sformułowanie prawdziwych sądów. Maksymalizowana powinna być dyskursywność takich procedur, a podstawą rozstrzygnięcia powinien być, jeśli to tylko możliwe, konsens. Nie mogą być uważane za rozstrzygające argumenty odwołujące się do woli indywidualnej lub zbiorowej, reakcji emocjonalnych, stopnia rozpowszechnienia danej oceny czy do tradycji kulturowej. (shrink)

Zatem wartości, jak również problemy moralne z jednej strony mają genezę w tradycji filozoficznej, z drugiej – wynikają ze złożoności współczesnej gospodarki i swoistego mariażu doradztwa z biznesem. Konsulting jest profesją o dużym kapitale zaufania społecznego, dlatego od konsultantów należy wymagać nie tylko wiedzy w wąskim zakresie udzielania rad, ale też przygotowania filozoficzno-etycznego, działań odpowiedzialnych, wręcz odważnych moralnie.

The article is a continuation of a paper published in “Etyka”, vol. 21, Concepts of Man in the Náhuatlan Culture and contains an overview of the fundamental types of education provided by the Aztecs, with special emphasis on moral ideals. The investigation of Indian education not only furthers historical knowledge but also plays a role in the search of the origins of the specific religious, moral and behavioural expression of contemporary Mexico, due to the fact that some elements of the (...) education preceding the Spanish conquest became an integral part of the culture of that country. The analysis to which this article bears a testimony permits the author to say that before the conquest, the Aztecs had an integral educational system, an ideal to be put into practice, adequate institutions, competent teachers, didactic material elaborated by specialists. Skill formation practised at all levels of education, was complemented by moral instruction and intellectual, religious and aesthetic guidance. The norms inculcated through training had been worked out through the ages in the náhuatl tribes and served to protect the principal values of the family and social life. They had the function of elementary moral rules and emerged from the conditions of the perennial culture of Mexican Indians. Aside from setting models of behaviour and values, the norms that the author finds in all forms of education display some differentiation which is a reflection of the multi-layered, complex structure of that culture. It embraced two different lifestyles and two ideals. Beneath the dominant religious and military habits of the Aztecs survived the old morality of the Toltecs, preserved most conspicuously in the traditional norms of family life. It has also been expressed in the poetry of the 16th and early 17th centuries. (shrink)

Artykuł dotyczy dość mało popularnych, aksjologicznych teorii choroby. Autor opisuje cztery drogi, które mogą doprowadzić do uznania choroby za moralne zło. Wśród tych dróg, reprezentowanych przez różnych autorów, znajdują się: droga fenomenologiczna, kantowska, psychiatryczna i quasi-historyczna. Po zaprezentowaniu ich głównych cech i inspiracji, artykuł rozważa pewne obiekcje, które można im stawiać oraz stara się wskazać możliwe rozwiązania. W podsumowaniu autor umiejscawia aksjologiczne teorie choroby na ogólnej mapie bioetyki.

Moral Dilemmas and Deontic Logic In the paper I discuss an argument of deontic logic concerning the problem of the existence of moral dilemmas. First, I draw attention to the philosophical context of this argument and present three proofs which reveal an inconsistency in the nature of moral dilemmas. These proofs, however, are philosophically and logically controversial. Accordingly, I provide an alternative proof, based on the LP-system of deontic logic. The system is described from syntactic and semantic point of view. (...) Assuming only the noncontroversial axiom K and a certain formulation of Elzenberg’s principle, I argue that, from the point of view of the LP-system, there is an inconsistency in the definition of moral dilemmas. The essay deals with moral problems in Proust’s A la recherche du temps perdu. The novel has been viewed by many as a survey of the ruling customs, as an outstanding psychological novel, as a study of human characters, and as a story of the decline of aristocracy. The description of facts has been noted in this way, but not the underlying idea. This essay shows Proust not only as an etologist, but also as a moralist. The essay consists of (...) three parts. The first one deals with Proust’s views connected with the theory of knowledge to be found in the novel. Special emphasis is put on the influence both of the atmosphere of his home and that of his time on the formation of Proust’s views, as his point of departure was the positivistic method as well as scientific and naturalistic approach to all events. Further, it should be stressed – and this has escaped many readers for a long time – that having applied his method Proust arrived at general conclusions which have proved to be in a sheer contradiction with this method. No writer of fiction before him has pointed out the importance of subjective factors in cognition better than he did. In defiance of positivism, Proust denies neither the existence of the essence of things nor of qualitative differences. Considerations relating to Proust’s analysis of the phenomenon of remembering and of different kinds of memory show how important they were for fixing his views on the insufficiency and inadequacy of intellectual cognition as well as on discovering its falsifications, simplifications and utilitarian character. Both the world of common experience and common sense and that of science are worlds of delusion. These conceptions show a striking coincidence with those of Bergson. (shrink)

The idea of the moral good is considered a desirable and appreciated real existence. With reference to teachers it constitutes a personal pattern of judicious acting. Their special task is not only to teach necessary knowledge to students but also to instil moral conduct in them i.e. to form ‘a correct character’. This notion was present at the beginning of the 20th century and is also reflected in Archbishop Józef Bilczewski’s letter ‘The Character’ (1920). The ideas presented there remain still (...) valid also in the present historic moment of the nation. (shrink)

The aim of the paper is to investigate into the relations between basic moral categories, namely those of norms, ideals and supererogation. I discuss, firstly, the ways of understanding these categories, secondly, how moral acting can be described using them and thirdly, how they relate within certain moral system. Yet, what is of a special importance is the relation between norms and ideals and their complementary character. For it might be argued that omission of one these categories may lead to (...) posing important limitations on the possibilities of grasping certain moral issue adequately and setting the full range of possible solutions. Hence, I argue that to resign from two-level form of moral analysis may lead to the atrophy of the very idea of ethics itself. (shrink)

The starting point of these reflections on the personality-creating function of moral examples is a differentiation between two concepts of man: one, which puts stress on the fact that human nature is predetermined and the man’s task is therefore to develop his talents and endowments in order to become a compete man, and the other, which emphasizes the fact that man is himself a specific and uniquely precious value, and thus he should endeavor to learn about himself and how he (...) should realize himself to his own image. In the first instance we have “an ethics of examples”, in the second, “an ethics of authenticity”. In the first case we have a man who creates himself, in the second, a man who is in search for himself. These two conceptions describe different attitudes toward the world and toward oneself. We can reach for their synthesis, however, if we assume that through the search for himself man creates himself, by finding out what his authentic intentions are, man creates himself, and thereby avoids petrification in the established schemes, functioning in social life. Thus he becomes a more valuable individual in his society. (shrink)

The academic community believes that the ulterior end of science is accumulation of knowledge. Other ethical constraints that pertain to the scientist are not different from those which oblige every other man in society to act decently, except for specifically professional norms which bind academics, but these, in point of fact, have their counterparts in any other profession, too. Thus the specific moral commitment of the academic profession worthy of a careful study and discussion is the claim that knowledge should (...) be accumulated as an ulterior end. Moral underpinnings of this position have to be laid bare together with social and moral consequences of the growth of knowledge. (shrink)

The article attempts to provide a brief account of the ways in which lawyers carry through their arguments concerning some closed moral evaluations or norms and showing how by reference to those norms and evaluations they argue some legal issues as, e.g., the question of the interpretation of legal norms. The author based his reasoning on examples taken from Polish legal literature.
