Within the context of the insurable interest in cargo insurance contracts, in this publication the writer analyses the theoretical aspects of the insurable interest and the relevant laws. Dealing with the problems of determining the insurable interest in cargo insurance contracts the writer has examined the possible options of insurance of the cargo in transit, and while analysing the law governing transport and the sale of goods he examines a person‘s insurable interest in the cargo insured and legal remedies to (...) protect such an interest by concluding a cargo insurance contract. The writer believes that the legal regulation of the insurable interest in Lithuania, interpreting the insurable interest as a loss sustained by a policyholder, the insured or the beneficiary upon an event insured against, fails to guarantee the protection of proprietary and economic interests of persons engaged in the circulation of commodities. Laws governing cargo insurance contracts in Lithuania do not provide a flexible protection of interests of the participants in trade operations and impedes the development of trade and transit, therefore the legal regulation of cargo insurance, especially of the insurable interest should be improved. Riječ “intelektualac” francuskog je porijekla, nastala krajem 19. vijeka. Stvorena tokom afere Dreyfus, uglavnom se odnosi na one mislioce koji su spremni da interveniraju u javnom forumu, čak i ako to znači da sebe izlažu riziku (Le Sueur 2001:2). Teoretičari kao što su Edward Said, Paul Ricoeur, Jean-Paul Sartre i Michael Waltzer dali su doprinos diskusiji o intelektualcima: intelektualca Said vidi kao kritički nastrojenog autsajdera, Ricoeur kao političkog edukatora, Sartre kao čovjeka od akcije, a Waltzer kao brižnog insajdera. Opisati intelektualca (...) na ovaj način, pak, ne spominje prostor unutar kojeg intelektualac djeluje, tj. građansko društvo. Upravo se u takvom prostoru ljudskog udruživanja i odnosnih mreža može promovirati kultura dijaloga, tolerancije, umjerenosti i uzajamno korisnog rješavanja sukoba, upravo onakva kultura kakva otjelotvorava stavove i vrijednosti demokratizacije. Mada intelektualac, onakav kakav je gore opisan, igra značajnu ulogu u održavanju dobro razvijenih demokratskih društava, u postkonfliktnim društvima, kakva su i kosovsko i bosanskohercegovačko, pojavljuje se potreba za intelektualcem koji je više od pukog kritičara društva, edukatora, čovjeka od akcije i saosjećajnog pojedinca. I tu na scenu stupa hiperintelektualac. Najupečatljivija karakteristika hiperintelektualca je možda upravo stepen u kojem se intelektualac bavi društvenom kritikom, političkim obrazovanjem, akcijom i “insajderizmom”, ne kao ideolog, već kao nestranačka fi gura. Društvena kritika i političko obrazovanje hiperintelektualca manifestiraju se na nestranački način, tako da se jasno čuje sve što je moguće i napadati i braniti, i sa jedne i sa druge strane. Od objavljivanja Chalmersova utjecajnog rada The Conscious Mind , bilo je uobičajeno dijeliti filozofijske probleme svijesti na dvije grupe. Dok se tzv. »teški problem svijesti« tiče prirode fenomenalne svijesti i perspektive prve-osobe, »laki problem svijesti« uglavnom se bavi pojmom intencionalnosti. No je li stvarno moguće potpuno istraživati intencionalnost bez uzimanja u obzir iskustvene dimenzije? I vice versa, je li moguće razumjeti prirodu subjektivnosti i iskustva ako ignoriramo intencionalnost, te, ne izlažemo li se tako riziku ponovnog postavljanja kartezijskog dualizma subjekt-svijet, koji (...) ignorira sve obuhvaćeno frazom »bitka-u-svijetu«? U mom članku, istražit ću da li su fenomenalna svijest i intencionalnost dvije strane istoga novčića što se ne mogu razdvojiti a da se počini pogreška razdiobe.Since the publication of Chalmer’s influential work, The Conscious Mind , it has been customaryto divide the philosophical problems of consciousness into two groups. Whereas the socalled“hard problem” of consciousness concerns the nature of phenomenal awareness and thefirst-person perspective, the “easy problems of consciousness” mainly concern the notion of intentionality.But is it really possible to investigate intentionality thoroughly without taking the experientialdimension into account? And vice versa, is it possible to understand the nature of subjectivityand experience if we ignore intentionality, or do we not run the risk of thereby reinstating a Cartesiansubject-world dualism that ignores everything captured by the phrase “being-in-the-world”? Inmy article, I will inquire whether phenomenal consciousness and intentionality are two sides of thesame coin that cannot be separated without committing a fallacy of division. (shrink)

High quality pedagogical practise is one of the most important mechanisms to support families and children at risk of social exclusion (RSE) in the early childhood and pre-school education system (ECEC). This paper describes and presents the results of the evaluation of the model for the prevention of adverse developmental outcomes of children with RSE achieved through quality pedagogical practise. The contribution of using the model to children's social inclusion was determined using a quasi-experimental quantitative method. 60 educators from 15 (...) kindergartens in seven districts of the Republic of Croatia participated in the study. Before and after six months of implementing the model, they completed the scale for assessing the child's social inclusion and the protocol for documenting pedagogical practise in relation to the child. The qualitative thematic analysis describes the ways in which the application of the model contributes to children's well-being. 30 educators who implemented the model were interviewed. The use of the model was found to contribute to better developmental outcomes for children at RSE and to educators' professional development and practise. The results suggest that the pedagogical practise of ECEC needs to be improved to prevent unfavourable developmental outcomes for children at RSE. (shrink)

The United Nations has shown recurrent inability to respond to international threats caused by severe human rights violations and thus failed to perform one of its main function—preservation of international peace and security in the world. This evidenced gaps in the United Nations, caused mainly by the veto right in the voting system within the Security Council and limited powers of the General Assembly. The international community gave a twofold answer to this problem: radical humanitarian intervention and the recent concept (...) of the responsibility to protect. The main problem with regard to humanitarian intervention is its legality—its compliance with the prohibition of the use of force. The responsibility to protect does not clash with the prohibition of the use of force, but its legal implications are rather vague—being intensively discussed in the international forum, the responsibility to protect has not yet appeared in any legally binding international document. This article discusses the legal significance of humanitarian intervention and the responsibility to protect, and aims to determine how they affect, if at all, the regulation of the use of force in the international relations, as well as how they respond to the issue of large scale atrocities in the world. The protection of national minorities forms a constituent part of the international protection of human rights. General human rights treaties (the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights, the Convention for the Protection of Human Rights and Fundamental Freedoms and others) create guarantees for the protection of persons belonging to national minorities on the basis of individual human rights. Although the mentioned treaties are not specifically devoted for the protection of national (...) minorities, it is important to underline that non-minorities treaties establish articles of special relevance for persons belonging to national minorities. Non-minorities treaties on the basis of non-discrimination and equality oblige the contracting states to ensure equal treatment of persons, including those belonging to national minorities. It may be noticed that non-minorities treaties provide the protection for persons belonging to national minorities indirectly through the interpretation of the ambit of general human rights. The core question is whether the protection granted on the basis of general human rights is sufficient for the effective protection of persons belonging to national minorities. The aim of the article is to analyze general and specialized international legal grounds of special significance for persons belonging to national minorities in order to determine the particularities of the protection granted for them. The conclusion is drawn that general human rights alone do not effectively protect national minorities: general human rights contribute to the protection of persons belonging to national minorities as a supplement element that inextricably interrelates with specialized rights together comprising the protection devoted to national minorities. In international arbitration, timely application and enforcement of interim measures can have a substantial effect on the possibility of the enforcement of final arbitration award, especially when issues relating to the protection of assets or evidence arise before or during the course of arbitration proceedings. Though the substantive amendments to the UNCITRAL Model Law on International Commercial Arbitration concerning the application and enforcement of interim measures in international arbitration were made in 2006, the legal regulation of these matters in Lithuania (...) by the Law on Commercial Arbitration remained as previous. Hence, the purpose of this article is to provide a brief analysis of the contemporary universal legal doctrine and international practice regarding the availability, application and enforcement of interim measures in international arbitration; to examine and evaluate the Lithuanian law and court practice, their compliance with the analyzed contemporary universal legal doctrine and international practice on the application and enforcement of interim measures in international arbitration.
