Prominent analytical jurisprudents assert that a theory of law consists of necessary, universal truths about the nature of law. This often-repeated claim, which has not been systematically established, is critically examined in this essay. I begin with the distinction between natural kinds and social artifacts, drawing on the philosophy of society to show that necessity claims about law require a fundamental reworking of basic understandings of ontology and epistemology, which legal philosophers have not undertaken. I show law is (...) a poor fit for a priori and a posteriori knowledge. I distinguish between universal application and universal truth, showing the former is sound while the latter is not. I expose the implications that follow from the initial selection of the central case of law, demonstrating that this choice must be justified, and I reveal two ways analytical jurisprudents shield their theories of law from refutation. This analysis raises significant doubts about the claim by analytical jurisprudents that they are identifying necessary, universal truths about the nature of law. (shrink)

When Nishida Kitarô wrote Studies of the Good, he was a high school teacher in Kanazawa far from Tokyo, the center of Japanese scholarship. While he was praised for his intellectual effort, there was no substantive agreement about the content of his ideas. Critics disagreed with the way he conceived of reality and of truth as contained in reality. Taken together, I believe that the responses to Nishida's early work give us a window on the state of Japanese philosophy in (...) the early twentieth century. In what follows, I give evidence for the existence of such a debate about the nature of truth and reality. After a sketch of Nishida's position, I outline the positions of two other contemporary thinkers: Katô Hiroyuki and Takahashi Satomi. With respect to Nishida, they offer markedly different takes on the question of universal truth: Katô favors an antireligious, scientific positivism while Takahashi accepts an existentialist notion of radical human finitude, in which human access to any certainty is denied. I conclude that one is confronted with a lively debate by Japanese philosophers inside Japan about the definition of truth and consequently about the nature of reality. (shrink)

This book is about one of the most baffling of all paradoxes – the famous Liar paradox. Suppose we say: 'We are lying now'. Then if we are lying, we are telling the truth; and if we are telling the truth we are lying. This paradox is more than an intriguing puzzle, since it involves the concept of truth. Thus any coherent theory of truth must deal with the Liar. Keith Simmons discusses the solutions proposed by medieval philosophers and offers (...) his own solutions and in the process assesses other attempts to solve the paradox. Unlike such attempts, Simmons' 'singularity' solution does not abandon classical semantics and does not appeal to the kind of hierarchical view found in Barwise's and Etchemendy's The Liar. Moreover, Simmons' solution resolves the vexing problem of semantic universality – the problem of whether there are semantic concepts beyond the expressive reach of a natural language such as English. Mazur argues that logical reasoning is not purely robotic. At its most basic level, it is a creative process guided by our intuitions and beliefs about the world.

In this paper, Anniina Leiviskä examines the moral, political, and epistemic claims of the social justice movement known as “decolonizing the university” from the perspective of Jürgen Habermas's distinction between objective and normative validity and the respective notions of truth and moral rightness. Leiviskä challenges the view, held by some representatives of decolonization, that the normative and epistemic claims of the movement are inseparable from each other and suggests that evaluating the justification of the movement requires holding these claims at (...) least analytically distinguishable. She argues that while the moral and political claims of “decolonizing the university” find strong justification through Habermas's discourse morality, its epistemic claims, especially the rejection of shared standards of knowledge, might have epistemically problematic consequences. Accordingly, Leiviskä suggests here that the epistemic justification of decolonization is conditional on the acceptance of shared epistemic standards — the pragmatic truth concept and the criterion of impartiality — which she develops in the paper on the basis of Habermas's pragmatic theory of truth and rational discourse as a model of justification. Finally, she proposes that the implications of these criteria for practices of higher education and the curriculum should be determined through an open and unconstrained discussion by the members of an inclusive university community. The article demonstrates the conflict between university and post-truth, namely the inability of university to fight post-truth due to the underestimation of objective truth in society. The facts that university is losing the opportunity to develop students’ critical thinking as a result of the deprivation of its independence in obtaining objective truth are given as arguments. The attention is focused on the historical context of this conflict. In this paper, we investigate abstract model-theoretic properties which hold for models in which a truth or satisfaction predicate for a sublanguage of the signature is definable. We analyze in which cases those properties in fact ensure the definability of the respective truth predicate. In some cases, we formulate different axiomatic theories which are indispensable for such properties to hold and we analyze the mutual definability relations between those theories.

This book by Paul F. M. Zahl, Dean of Cathedral Church of the Advent (Episcopal) in Birmingham, Alabama, is billed as “an exercise in New Testament theology.” Jesus, Zahl declares, was “the First Christian,” and this can be so only because the relation between Jesus and his Judaic background is not what mainstream biblical scholars have thought. Zahl sees the historical Jesus as mainly discontinuous with his own Judaic context and (or, it seems, because) he thinks that this is the (...) only way the Christian faith can offer more than simply “Judaism for gentiles.” Despite some very good material in the book, Zahl seems unaware that the conservative Protestant reliance on Romans as a primary lens for interpreting the mission of the historical Jesus has faced serious challenges in recent decades, and though Zahl is not unaware of “higher criticism,” his book reflects only a rather limited engagement with it. The discourse of postmodernism proclaims with a unified voice the context-dependence or knower-dependence, the relativity or subjectivity, of all truth claims. But the discourse of postmodernism also proclaims universal truths upon which this antirealist epistemology itself rests. These constitute the very foundational claims that the postmodernist campaign, in all of its alleged antifoundationalism, strives to subvert. In this article, the author considers 3 universal truth claims of PM discourse. And because the antirealism that defines much of PM (...) discourse is often grounded in the doctrine of social constructionism , the 3 truth claims under consideration constitute the claims of SC itself, especially the claims of SC as it has been propounded within postmodern therapy circles. Each of the 3 claims is articulated, and then followed by a critique which asks whether the claim is not either simply a variant of the so-called modernist paradigm that is under attack, or the product of the very observational/empirical powers that PM doctrine seeks to erode in its anti-empiricist spirit. The logic with independent truth and falsehood operators TFL is proposed. In TFL(→) standard truth-conditions for the implication are adopted. Nevertheless the laws of classical logic are not valid. In this language more then 107 different binary connectives can be defined. So this logic can be treated as universal logic relatively to the class of sentential logics.

The growing number of universities today makes it relevant to consider again the idea of the university. Consulting the classics of the discussion, I argue that we must retain the idealist notions of knowledge, science and truth professed by Newman in his argument for liberal education, although he neglects the possible corruption of the university faculty. The problem of corruption is recognized by Jaspers, criticizing all idealist notions and leaving science and scholarship to rely only on existential commitment. The problem (...) for both classics, however, is that they conceive of academic freedom in an all-too individualist way. Instead, I argue that the idea of the academic republic should be taken seriously, i.e., that a contemporary idea of the university must include suggestions for university government comprising institutional checks and balances. Only such a constitutional notion of academic freedom may counter neo-liberal reification of higher education, science, and scholarship. (shrink)

Throughout history, oppressors have used multiple forms of violence to impose their own logic on the human universe they oppress. One such form is epistemic violence, which is based on the monopoly control of truth and the hijacking of universality. Those who apply this violence seek to convince everyone of the absolute character of their supposed truths, of the quasi-natural universality of their ways of thinking, of living, of organizing socially. Truth and universality are ineludible objects in dispute between (...) conservative and emancipating forces. The scenario of this complaint today reaches global dimensions. Life itself is at stake. It is obvious that, without an undermining of oppressive truths and predatory particularisms dressed-up as universalities, social emancipation is not feasible. It is also not possible to conserve life. Unlimited growth, the permanent trend towards wealth accumulation, the pursuit at all costs of profit, make capital increasingly incompatible with life. False truths, such as the inevitable centrality of the market and the natural character of capitalism, must be dismantled. Following the logical-deductive method, this work aims to speak critically of the truth, but not denying its existence. This work speaks critically of truth, but does not negate its existence. Attempts are made to uncover the social conditions of the possibility of truth. It seeks to describe how truth can and should exist, if it aspires to be free and decolonized within a social paradigm such as Our America. (shrink)

This is the first full-length study of Vico's Diritto Universale to be written in English. This study places the work within the wider traditions of Roman legal scholarship and natural law, which Vico was confronting. Truth and Authority in Vico's Universal Law breaks new ground in the treatment of Aristotelian influences on Vico. It examines Vico's idea that a theory founded on the subjective right of the single individual cannot be the foundation of social relationships. This essay proposes that the crisis of the contemporary university presents a unique challenge and opportunity to re-imagine the university as a quest for truth, reflecting John Henry Newman's ideal of a "wholeness of vision" and "enlargement of the mind" in educating the whole person. Higher education can become more meaningful and relevant by combining a strong core curriculum in the liberal arts with vocational and career preparation, interdisciplinary engagement, and consilience between Athens and Jerusalem as modeled in the science-ethics-religion (...) dialogue. A rediscovery of natural law and the moral law, universals and absolutes, which guide human aspirations for justice, fairness, and community, can counter the postmodem temptation for subjectivity and disconnection. The most cogent remedy for student boredom and faculty apathy is intellectual diversity for a renewed sense of excitement in exploring insights across the disciplines regarding ourselves and the world. This calls also for superceding the anti-liberal strictures of political correctness, rededicating the university to its essential task of free inquiry. (shrink)

This is an exploration of a cluster of related logical results. Taken together these seem to have something philosophically important to teach us: something about knowledge and truth and something about the logical impossibility of totalities of knowledge and truth. The book includes explorations of new forms of the ancient and venerable paradox of the :Liar, applications and extensions of Kaplan and Montague's paradox of the Knower, generalizations of Godel's work on incompleteness, and new uses of Cantorian diagonalization. It survived among his papers and ultimately came into the possession of the University of Pittsburgh in the circumstances detailed in the Editor's Introduction. Son of a distinguished mathematician and President of Magdalene College, Cambridge and brother of Arthur Michael, eventual Archbishop of Canterbury, Ramsey was closely connected with Cambridge throughout his life, ultimately becoming lecturer in Mathematics in the University. Notwithstanding his great mathematical talent, it was primarily logic and philosophy that engaged his interests, and he wrote original and important contributions to logic, semantics, epistomology, probability theory, philosophy of science, and economics, in addition to seminal work in the foundations of mathematics. Modern philosophers have not seriously considered the imagination as an avenue to truth, partly because those philosophers, particularly the British empiricists, have been preoccupied with external observations.

Speaking the Truth about Oneself is composed of lectures that acclaimed French philosopher Michel Foucault delivered in 1982 at the University of Toronto. As is characteristic of his later work, he is concerned here with the care and cultivation of the self, which becomes the central theme of the second and third volumes of his famous History of Sexuality, published in French in 1984, the month of his death, and which are explored here in a striking and typically illuminating fashion. (...) Throughout his career, Foucault had always been interested in the question of how constellations of knowledge and power produce and constitute subjects. But in the last phase of his life, he became especially interested not only in how subjects are constituted by outside forces but in how they constitute themselves. In this lecture series and accompanying seminar, we find Foucault focused on antiquity, starting with classical Greece, the early Roman dynasties, and concluding with fourth- and fifth-century Christian monasticism. Foucault's claim is that, in these periods, we see the development of a new kind of act-"speaking the truth" (about oneself)-as the locus of a new form of subjectivity, which he deemed important not just for historical reasons but also as something modernity could harness anew or adapt to its own purposes. John Corcoran was a very well-known logician who worked on several areas of logic. He produced decisive works giving a better understanding of two major figures in the history of logic, Aristotle and Boole. Corcoran had a close association with Alfred Tarski, a prominent 20th-century logician. This collaboration manifested in Corcoran's substantial introduction to Tarski's seminal book, Logic, Semantics, Metamathematics (1956). Additionally, Corcoran's posthumous editorial involvement in 'What are logical notions?' (1986) breathed new life into this seminal paper authored by (...) Tarski. His scholarly pursuits extended to the intricate explication of fundamental concepts in modern logic, including variables, propositions, truth, consequences, and categoricity. Corcoran's academic curiosity extended further to the intersection of ethics and logic, reflecting his contemplation of their interrelation. Beyond these theoretical contributions, Corcoran was deeply engaged in the pedagogical dimensions of logic instruction. (shrink)

This chapter has two aims. The first aim is to present an overview of Bolzano's universe from the point of view of his metaphysics and its relationship to logic, relying fundamentally on Bolzano's Wissenschaftslehre. The author's preferred reading of Bolzano is one according to which he is a 'platonistic nominalist': a platonist about propositions and a nominalist about properties. Bolzano's nominalistic tendencies are particularly conspicuous in his mereological analyses, which play a major role in every aspect of his philosophy. The (...) author's second aim is to answer the open question of whether in Bolzano there is any 'ontology of truth'. This chapter argues for a negative answer. Bolzano does not make room for any special object which plays the role of the counterpart of a truth-bearer, or at least his propositions do not connect semantically in a direct way to anything that would count as such a special object. Provability, Computability and Reflection.

ABSTRACT: In its strongest unqualified form, the principle of wholistic reference is that in any given discourse, each proposition refers to the whole universe of that discourse, regardless of how limited the referents of its non-logical or content terms. According to this principle every proposition of number theory, even an equation such as "5 + 7 = 12", refers not only to the individual numbers that it happens to mention but to the whole universe of numbers. This principle, its history, (...) and its relevance to some of Oswaldo Chateaubriand's work are discussed in my 2004 paper "The Principle of Wholistic Reference" in Essays on Chateaubriand's "Logical Forms". In Chateaubriand's réplica (reply), which is printed with my paper, he raised several important additional issues including the three I focus on in this tréplica (reply to his reply): truth-values, universes of discourse, and formal ontology. This paper is self-contained: it is not necessary to have read the above-mentioned works. The principle of wholistic reference (PWR) was first put forth by George Boole in 1847 when he espoused a monistic fixed-universe viewpoint similar to the one Frege and Russell espoused throughout their careers. Later, Boole elaborated PWR in 1854 from the pluralistic multiple-universes perspective. (shrink)
