Abstract

This paper is in part a reply to a recent article by Professor Lisa Bressman, entitled "Procedures as Politics in Administrative Law" (107 Columbia Law Review 1749) and, in part, a precis of future work on prescriptive administrative law in the positive political theory tradition.
