This article analyses jurisdiction regarding administrative proceedings (lawsuits) in Jordan and France. Moreover, it also discusses the fact that jurisdiction regulates two matters of the utmost importance: the distribution of jurisdiction between ordinary and administrative jurisdictions and the distribution of jurisdiction between administrative jurisdictions themselves in States whose jurisdiction in administrative proceedings is distributed to more than one administrative organ. Moving on, this research was conducted using several research approaches such as, the comparative and analytical approach. The research concluded with (...) a number of conclusions and recommendations, the most important of which was the establishment of an Administrative Proceedings Management Service (APMS), as did the French Administrative Judicial Code, in which attendance was compulsory. To add on, the office of the Administrative Proceedings Administration must have a judge of its own, which corresponds to the post of the judge in the French Administrative Court. The judge will handle the completion of the data regarding both lawsuit parties, and request the documents needed for the case at hand. With that being said, the Jordanian Constitutional Court must reverse its interpretative decision, stating that the administrative justice is part of the ordinary judiciary—in referral to The Constitutional Court’s interpretation of the provisions of the Constitution, which considered the administrative judiciary as an integral part of the ordinary judiciary. Lastly, the research concluded that The French Administrative Judiciary must be taken into consideration regarding the establishment of an administrative judiciary independent from all aspects of the ordinary judiciary, and the explicit introduction of the dual judicial system. This study aimed to evaluate Jordanian pharmacy postgraduate students’ knowledge, behavior and perception about plagiarism and why do they commit such research misconduct.This is a cross-sectional survey that was conducted in Jordan during the period between June-July 2019. The study targeted postgraduate pharmacy students from all Jordanian universities. Recruited students were asked to fill out the study questionnaire to evaluate their knowledge, behavior, and perception about plagiarism.A total of 103 postgraduate students participated in this survey, most of them were enrolled (...) in masters programs. Most of them reported that they have committed plagiarism during their studies, but this work was unintended for about 76.4% of the plagiarist.Students were asked about 12 items that represented plagiarism actions and most of postgraduate students were able to identify most of the actions as plagiarism. Overall, the mean knowledge score for students about plagiarism was 8.6 ± 2.6.Regarding students’ perceptions towards plagiarism, many students believed that plagiarizing is as bad as to steal from someone and 92.2% reported that plagiarism is considered against their ethical values.This study found a high rate of plagiarism among postgraduate pharmacy students in Jordan despite their awareness and understanding of the concept and its different forms. Academic institutions must establish formal policies to raise awareness about plagiarism, enforce and implement penalties for those who commit plagiarism. (shrink)

Bipolar soft set is formulated by two soft sets; one of them provides us the positive information and the other provides us the negative information. The philosophy of bipolarity is that human judgment is based on two sides, positive and negative, and we choose the one which is stronger. In this paper, we introduce novel belong and nonbelong relations between a bipolar soft set and an ordinary point. These relations are considered as one of the unique characteristics of bipolar soft (...) sets which are somewhat expression of the degrees of membership and nonmembership of an element. We discuss essential properties and derive the sufficient conditions of some equivalence of these relations. We also define the concept of soft mappings between two classes of bipolar soft sets and study the behaviors of an ordinary point under these soft mappings with respect to all relations introduced herein. Then, we apply bipolar soft sets to build an optimal choice application. We give an algorithm of this application and show the method for implementing this algorithm by an illustrative example. In conclusion, it can be noted that the relations defined herein give another viewpoint to explore the concepts of bipolar soft topology, in particular, soft separation axioms and soft covers. I argue that the temporality of colonialism is a disabling duration. To elaborate, I focus on a site in Frantz Fanon’s Black Skin, White Masks where disability/debility and racism intertwine – Fanon’s refusal of “amputation” in his experience of cinema. While such disability metaphors have been problematized as ableist, I argue that amputation is more than a metaphor of lack. It extends what racializing debilitation means and makes tangible the prosthetics that colonialism imposes and the phantoms and affects of colonized (...) life that it attempts to sever. Engaging with disability studies, especially Black and anticolonial theories, I articulate racism and (dis)ability as more than parallel or analogy and conceptualize a debilitating colonial duration, as instanced in our pandemic time. By reconfiguring the possibilities foreclosed through colonialism, I ask what routes there may be to make colonial duration hesitate and destabilize its inevitability, while dwelling with its wounds and ruptures. In the first three centuries of Hijri, the first schools of qırā’a emerged in cities such as Medina, Mecca, Kufa, Basra and Damascus. The science of qırā’a concentrated in these cities spread to the newly conquered geographies in parallel with the conquests and the Islamization activities carried out, and under the influence of different factors, some qırā’a’s became dominant in certain regions. Having a special place among the first schools of recitation, Nāfi' b. Abdirrahman al- Madanī’s (d. 169/785) qırā’a gained (...) fame in Medina. This qırā’a, which is of great importance in terms of reflecting the accumulation of recitation of the city of the prophet, has begun to spread in the Maghreb and North Africa regions since the early periods of Islam. In this region, the Medina school of qırā’a was favored by the people and thus became almost the only qırā’a preferred for centuries. As a matter of fact, the mushafs in the region in question have been printed according to this qırā’a from past to the present day. In this study, the phases of the historical progress of Nāfi‘ qırā’a in Ma-ghrib and North Africa are shed light on. In this context, after dwelling on the first qırā’as transferred to the region since the conquest, an evaluation has been made on the entry of Nāfi‘ qırā’a to the region, its pioneers, development and historical process. Then, the reasons and motives behind the spread of Nāfi‘ qırā’a in the region are given, and the reasons for its preference in the region are analysed. Afterwards, information was given about the teaching of Nâfi' qırā’a and its riwāyahs (narrations) and tareqs (ways) in the main sources of recitation. Then, the education of the Nâfi' qırā’a in Maghrib and the ten ways, with al-Ashara al-Nāfe'eyya education program which was distinguished from other Islamic geographies, were tried to be revealed. This paper presents a methodology to design and implement programs intended to decide cases, described as sets of factors, according to a theory of a particular domain based on a set of precedent cases relating to that domain. We useDialectical Frameworks, a recent development in AI knowledge representation, as the central feature of our design method. ADFs will play a role akin to that played by Entity–Relationship models in the design of database systems. First, we explain how the factor hierarchy (...) of the well-known legal reasoning system CATO can be used to instantiate an ADF for the domain of US Trade Secrets. This is intended to demonstrate the suitability of ADFs for expressing the design of legal cased based systems. The method is then applied to two other legal domains often used in the literature of AI and Law. In each domain, the design is provided by the domain analyst expressing the cases in terms of factors organised into an ADF from which an executable program can be implemented in a straightforward way by taking advantage of the closeness of the acceptance conditions of the ADF to components of an executable program. We evaluate the ease of implementation, the performance and efficacy of the resulting program, ease of refinement of the program and the transparency of the reasoning. This evaluation suggests ways in which factor based systems, which are limited by taking as their starting point the representation of cases as sets of factors and so abstracting away the particular facts, can be extended to address open issues in AI and Law by incorporating the case facts to improve the decision, and by considering justification and reasoning using portion of precedents. Post-human technologies, such as human enhancements and artificial intelligence, blur or displace the boundaries of our common humanity. While these technologies enhance many valuable human powers, there is limited philosophical discussion as to whether and how they can also be dehumanizing? To answer this question, I start from a philosophical discussion of the concept of ‘dehumanization' and argue that it conflates three social mechanisms through which (i) human flourishing is impeded; (ii) subalterns are degraded; and (iii) automated processes replace typically (...) human activities. Furthermore, I argue in realist fashion that we should consider both the natural powers harnessed by post-human technologies and the social contexts through which the latter are designed, produced, marketed and consumed. I then illustrate my thinking with three recent inquiries that I conducted on post-human technologies’ dehumanizing potential. All three inquiries happen in the contemporary neo-liberal context, but each one foregrounds a distinct mechanism of dehumanization. (shrink)

The editors of scholarly journals have a duty to uphold and promote the highest standards of ethical conduct of research. They also have a responsibility to maintain the integrity of the literature, and to promote transparency and honesty in reporting research findings. In the process of screening manuscripts they receive for possible publication, editors have the obligation to report infractions to the institutions of offending authors, and request an investigation. Since editors can reject a paper on ethical grounds, they can (...) be considered to be the guardians of ethics who should express high ethical standards in conducting and publishing their own research. An examination of several publishers’ websites reveals no such requirement or clear selection criteria for journal editors. Therefore, we aim to discuss the factors that publishers, in a broad sense, should consider when selecting editors for scholarly journals and believe that such criteria should be made public to ensure accountability. This would restore some of the eroding public trust in disseminated research, fortify confidence in the composition and qualification of members of an editorial board, and help to protect the reputations of publishers and editors. Ethical scandals, as well as unethical behaviour, are becoming major concerns in recent times. Thus, this study focused on the role of ethical climate and employees’ moral identity. Specifically, this study examined the mediation effect of ethical climate on the relationship between ethical leadership and employees’ ethical behaviour. Also, the study investigated the moderating role of employee moral identity on the relationship between ethical climate and employees’ ethical behaviour. Data were collected from 620 full-time employees working at thirty-three Iraqi organisations (...) from five Iraqi provinces. These organisations were from various industry sectors such as manufacturing, retailing, medical, insurance, information technology, legal, finance, and telecommunication sectors. The study found that ethical leadership impacted on the ethical behaviour of employees and the ethical climate also significantly mediated the relationship between ethical leadership and employees’ ethical behaviour. The moderating role of moral identity on the relationship between ethical climate and ethical behaviour was found to be insignificant in this context. (shrink)

It has had significant implications not only for the conduct of linguistic analysis itself, but also for our understanding of the status of linguistics as a science. The reflections and analyses in this book contain insights into the strengths and the weaknesses of the MP. The purpose of this essay is to articulate and defend the epistemological foundations of international human rights education from the perspective of a hermeneutical interpretive methodology. Fuad Al-Daraweesh and Dale Snauwaert argue here that this methodology potentially alleviates the challenges that face the cross-cultural implementation of human rights education. While acknowledging the necessity of global human rights awareness, the authors maintain that local cultural conceptualization is imperative to the negotiated, local embrace of human rights. Because the pandemic has kept the world busy in the last two years, a revival of Derrida's writings on biology is an urgent prerequisite today. The tsunamic invasion of the Coronavirus or Covid-19 pandemic took more than two million lives and thousands are still being tested positive as I write. The speed of the virus and the seeming human inability to stop its spread necessitates a study on the relationship between Covid-19 and Derrida's deconstructive philosophy. Hence the portmanteau Coviderrida – (...) inspired by Hélène Cixous’ ‘ derridevilishly’ – attempts to demonstrate how the pathogen operates as an event or possibility to which Derrida's neologisms ‘différance’, ‘supplement’, ‘trace’, ‘archi-writing’, and ‘text’ testify. The main concern of this paper is to restore the deconstructive logic that Derrida advocates to restructure the relationship between life and death in his 1975-6 seminar La vie la mort, and reshape our notion of human survival in his 2001 interview with Giovanna Borradori, ‘Autoimmunity’. The purpose of this study was to examine the relationship between metacognition as measured in real-life situations and IQ scores as reflected by performance on the Raven Standard Progressive Matrices Scale. It is also intended in this study to report on whether or not there were significant differences in performance on the metacognitive instrument among participants with typical development, deaf and hard-of-hearing, and low-achieving individuals with and without the influence of IQ. Analysis showed significant correlations between IQ, metacognitive test, and (...) metacognitive test scores divided by mean reaction time but not with reaction time itself. Results revealed the influence of IQ on metacognition being greater than the influence of metacognition on IQ. Results showed when controlling for the effect of IQ, differences among the three groups of participants on the metacognitive instrument become non-significant. Darwin's book On the Origin of Species by Means of Natural Selection (henceforth The Origin) abounds with metaphors. In fact, the very theory of natural selection is couched in a system of metaphors that exhibit striking consistency and coherence. I argue that the phenomenon for which Darwin tries to detect the basic mechanisms, that is, biological evolution, involves vast, indeterminate, and ambiguous observations that are difficult to subject to the empirical methods. This fact motivates Darwin's extensive use of metaphors to (...) organize his observations, structure the vague concepts, and ultimately render his observations meaningful and intelligible. I demonstrate that Darwin's metaphors, as far as they are elements of Idealized Cognitive Models, prove valuable in achieving this goal. First, I identify the conceptual metaphors underlying the main metaphorical expressions and show how these conceptual metaphors give rise to entailments and inferences central to Darwin's theory. The conceptual metaphors I identify are “NATURE IS A MOTHER,” “NATURE IS A BREEDER,” “LIFE IS WAR,” “LIFE IS A RACE,” and “EVOLUTION IS PROGRESS.” I also comment briefly on the conceptual blending involved in these metaphorical mappings. I then turn to characterizing the idealized cognitive models (ICMs) that function as the pre-conceptual ground in virtue of which Darwin's metaphors are meaningful, coherent, and helpful to scientific thinking.
