Thus the biography of a major political figure (...) of the late Republic comes as a refreshing change and evokes a certain nostalgia, for this reviewer at least. One encounters many of the old topics that so preoccupied scholars a generation ago--the Bona Dea scandal, the exile and recall of Cicero, the conference at Luca--and, to judge by the paucity of recent works on them and their like in Tatum's bibliography, excite little interest now. A pity, really, for Tatum shows how much is still to be learned from their study, even if solutions to puzzles like the Vettius affair seem as elusive as ever. The outlines of the story Tatum has to tell will be familiar to its readers; as one would expect, the interest lies in the changes of emphasis and tone and the new insights he brings to these events.Tatum admits that Clodius' personality is largely beyond recovery but [End Page 592] suggests that "One will probably not err by much in picturing Clodius as a handsome, urbane, and proud (at times, indeed, obnoxious) noble, of violent temper and of somewhat dubious moral fiber--possessed of a fascination with adventure yet capable nonetheless of very traditional pretensions" (43). Tatum describes an early career that was largely conventional: like other young nobles Clodius sought military experience abroad and political involvement at home, prosecuting Catiline (Tatum dismisses contemporary claims of collusion with the defense), and serving as Murena's go-between to the divisores in the consular elections for 62 b.c.e. (something neither "novel or in any way indicative of the direction of his later mastery of the plebs urbana" [58]). With regard to the events of late 63, Tatum accepts Plutarch's statement that Clodius supported Cicero against Catiline, despite Cicero's later claims to the contrary. The sole anomaly here is Clodius' instigation of a mutiny among Lucullus' troops at Nisibis in the winter of 68-67 because the latter failed to accord Clodius the honor he thought his due. Tatum downplays the importance of this episode, however, arguing that it did not compromise Lucullus' position, which had already collapsed at Rome, nor did it reveal an incipient demagogic bent, only arrogance.However, the "dangerous combination of arrogance and immaturity" (86), coupled with curiosity and perhaps the hope of an affair with Caesar's wife led Clodius to profane the rites of the Bona Dea. Tatum has no doubt of Clodius' guilt or that the prosecution for incestum was trumped up by Clodius' enemies, since the patres traditionally left the punishment of religious delicts to the gods themselves. But more than factional politics was involved. The most attractive feature of Tatum's study is that it draws on recent studies of aristocratic culture to explore dimensions of the events he describes that prior treatments overlooked. Linderski, North, and other students of Republican religion have made it impossible any longer to doubt that senators and plebs alike took the civic cult seriously. Hence for Tatum, genuine religious outrage enabled the factio out to get Clodius to press home its attack. Likewise, Tatum follows Brunt and others in recognizing the importance of ideas as well as personal alignments in shaping the political struggles of the era; guided by Millar, he sees sovereignty of the people as no mere slogan and stresses that a principled popularis stance was well within the bounds of aristocratic ideology. Tatum therefore argues that, by attacking the senate's proposal that the praetor should hand-pick the jurors who would hear the case against Clodius, his supporters cast the struggle as one over the limits of senatorial auctoritas in the face of libertas and the iurapopuli. The claim revived the central conflict in Cicero's suppression of the Catilinarian conspiracy and once again roused the... (shrink)

The nazi-diplomacy, with secrecy as a keystone, permitted some of the most important Belgian politicians and businessmen to meet the.nazi-leaders without being disapproved by public opinion or even parliament. This resulted in a «practical» way to improve political and above all economical relations between Belgium and nazi-Germany. In “Truth by Convention” W.V. Quine gave an influential argument against logical conventionalism. Even today his argument is often taken to decisively refute logical conventionalism. Here I break Quine’s arguments into two— the super-task argument and the regress argument—and argue that while these arguments together refute implausible explicit versions of conventionalism, they cannot be successfully mounted against a more plausible implicit version of conventionalism. Unlike some of his modern followers, Quine himself recognized this, but argued that implicit conventionalism was (...) explanatorily idle. Against this I show that pace Quine’s claim that implicit conventionalism has no content beyond the claim that logic is firmly accepted, implicit rules of inference can be used to distinguish the firmly accepted from the conventional. As part of my case, I argue that positing syntactic rules of inference as part of our linguistic competence follows from the same methodology that leads contemporary linguists and cognitive scientists to posit rules of phonology, morphology, and grammar. The upshot of my discussion is a diagnosis of the fallacy in Quine’s master critique of logical conventionalism and a re-opening of possibilities for an attractive conventionalist theory of logic. My claim is that despite powerful arguments to the contrary, a coherent moral distinction between the jus in bello code and the jus ad bellum code can be sustained. In particular, I defend the traditional just war doctrine according to which the independence between the in bello and ad bellum codes reflects the moral equality between just and unjust combatants and between just and unjust non-combatants. It is widely held that the current refugee Convention is inadequate with respect to its specification of who counts as a refugee and in its assignment of responsibility concerning refugees to states. At the same time, there is substantial agreement among scholars that the negotiation of a new Convention would lead states to extricate themselves from previously assumed responsibilities rather than sign on to a set of more desirable legal norms. In this paper, I argue that states should (...) ultimately negotiate a new Convention, but that first they must alleviate the institutional and motivational constraints that make progress currently unattainable. With the publication of the final report of the WHO Commission on the Social Determinants of Health, it becomes clear that there is considerable convergence between a policy agenda rooted on social epidemiology and one rooted in a concern for human rights. As commentators like Jonathan Mann have argued, concern for human rights and the achievement of social justice can inform and improve public health. In this article, we ask a different question: what does a health perspective adds to the (...) enduring fight for a more just world? We consider three possibilities: (1) that public health, in an inversion of Mann's argument, actually provides useful tools for specifying social injustice; (2) that, contrary to the usual critical stance and assumption of weakness, the institutions of public health bring powerful capacities to the practical promotion of social justice; and (3) that health as a banner mobilizes people who would not be mobilized to act in the name of social justice. Inertial frames and Lorentz transformations have a preferred status in the special theory of relativity (STR). Lorentz transformations, in turn, embody Einstein's convention that the velocity of light is isotropic, a convention that is necessary for the establishment of a standard signal synchrony. If the preferred status of Lorentz transformations in STR is not due to some particular bias introduced by a convention on signal synchronism, but to the fact that the Lorentz transformation group is the symmetry (...) group of the theory, then the signal synchronism is not a matter of convention but rather a matter of fact. In order to explore the conventionalist thesis, that within the frame of STR isotropy in the velocity of light and, hence, signal synchronism is a matter of convention, we need a generalized Lorentz transformation group that does not embody Einstein's isotropy convention, and upon which STR can be based. We present here a new approach to the resulting search for a generalized STR, which is well suited for establishing some well-known results of Winnie as well as some new results. (shrink)

Multiple states are at risk of becoming uninhabitable due to climate change, forcing their populations to flee. While the 1951 Refugee Convention provides the gold standard of international protection, it is only applied to a limited subset of people fleeing their countries, those who suffer persecution, which most people fleeing climate change cannot establish. While many journalists and non-lawyers freely use the term “climate refugees,” governments, and courts, as well as UNHCR and many refugee experts, have excluded most climate (...) refugees from the Convention as a matter of legal interpretation. In our 2015 paper, “Unable to Return in the 1951 Refugee Convention: Stateless Refugees and Climate Change”, we sought to reopen the debate on “climate refugees” by arguing that some climate refugees qualify under the 1951 Convention as it is currently written (even if they are not persecuted): those who are stateless and are unable to return to their country of origin because climate change has rendered it uninhabitable. Our interpretation, however, has been rejected by Goodwin-Gill and McAdam (2021) and by Foster and Lambert (2019), which explicitly responds to our paper. Here, we address and respond to their arguments, and develop a new supplementary one, drawing on the principle of systemic integration, as enshrined in Article 31(3)(c) of the Vienna Convention on the Law of Treaties. This paper aims at understanding the concept of convention in mechanics as a notion transferred from the field of jurisprudence. This enables us to clarify it as a new epistemic category having a pertinent role in the transformation of mechanics in the nineteenth century. Such understanding permits a separation from linguistic and arbitrary conventions, thus highlighting its epistemic features and not transforming fundamental principles into mere arbitrary agreements. After addressing the main references in the literature discussing the role of (...) convention in mechanics, we analyze its classical use as a concept originating from law. Then we explain its use by Carl G. Jacobi, Ferdinand F. Reech, and J. Henri Poincaré. Here we also show how their uses conform to the features analyzed regarding conventions in jurisprudence. Finally, we try to explain how the use of this concept, among other factors, contributed to the transformation of mechanics. (shrink)

In a recent article Merritt has claimed that current observational data provide “severe tests” falsifying the standard cosmological model. Based on Popper’s idea of conventionalism, he concludes that the introduction of some essential components of the standard cosmological model—including dark matter and dark energy—are a consequence of conventionalist stratagems. In this article, I provide more recent discoveries and discussions showing that the standard cosmological model is not built on any conventionalist stratagem.

I present a game-theoretical multi-agent system to simulate the evolutionary process responsible for the pragmatic phenomenon division of pragmatic labour (DOPL), a linguistic convention emerging from evolutionary forces. Each agent is positioned on a toroid lattice and communicates via signaling games , where the choice of an interlocutor depends on the Manhattan distance between them. In this framework I compare two learning dynamics: reinforcement learning (RL) and belief learning (BL). An agent’s experiences from previous plays influence his communication behaviour, (...) and RL agents act in a non-rational way whereas BL agents display a small degree of rationality by using best response dynamics . The complete system simulates an evolutionary process of communication strategies, which agents can learn in a structured spatial society. The significant questions are: what circumstances could lead to an evolutionary process that doesn’t result in the expected DOPL convention; and to what extent is interlocutor rationality necessary for the emergence of a society-wide convention à la DOPL? But while President George W. Moral indeterminacy can be problematic: prospectively it can give rise to deliberative anguish, and retrospectively, it can leave us in a limbo as to what attitudes it is appropriate to form with respect to past actions with indeterminate moral status. These problems give us reason to resolve ethical indeterminacy. One mechanism for doing so involves the use of our normative powers to place obligations on ourselves and to waive our claims against others. This mechanism could operate through an explicit agreement, (...) but could also operate through implicit endorsement of a social convention. However, there are important limits on when the mechanism can eliminate moral indeterminacy. (shrink)

Making decisions is an important component of everyday living, and issues surrounding autonomy and self-determination are crucial for persons with intellectual disabilities. Adults with intellectual disabilities are characterized by the limitations in their intellectual functioning and in their adaptive behavior, which compromises three skill types, and this starts before the age of 18. Though persons with intellectual disabilities are characterized by having these limitations, they are thought to face significant decisionmaking challenges due to their disability. Moving away from this generalization, (...) Article 12 of the United Nations Convention on the Rights of Persons with Disabilities addresses this issue of decision-making for persons with disabilities, recognizing the right to legal capacity. A Theory of Interpretation of the European Convention on Human Rights provides a philosophically informed study of the methods of interpretation used by the European Court of Human Rights in Strasbourg. By drawing on Anglo-Americal legal, political and moral philosophy, the book also aims to provide a normative theory of the foundations of the ECHR rights.
