The paper explores a structural account of propositional justification in terms of the notion of being in a position to know and negation. Combined with a non-normal logic for being in a position to know, the account allows for the derivation of plausible principles of justification. The account is neutral on whether justification is grounded in internally individuated mental states, and likewise on whether it is grounded in facts that are already accessible by introspection or reflection alone. (...) To this extent, it is compatible both with internalism and with externalism about justification. Even so, the account allows for the proof of principles that are commonly conceived to depend on an internalist conception of justification. The account likewise coheres both with epistemic contextualism and with its rejection, and is compatible both with the knowledge-first approach and with its rejection. Despite its neutrality on these issues, the account makes propositional justification luminous and so is controversial. However, it proves quite resilient in the light of recent anti-luminosity arguments. (shrink)

Some bioethicists argue that conscientious objectors in health care should have to justify themselves, just as objectors in the military do. They should have to provide reasons that explain why they should be exempt from offering the services that they find offensive. There are two versions of this view in the literature, each giving different standards of justification. We show these views are each either too permissive (i.e. would result in problematic exemptions based on conscience) or too restrictive (i.e. (...) would produce problematic denials of exemption). We then develop a middle ground position that we believe better combines respect for the conscience of healthcare professionals with concern for the duties that they owe to patients. Our claim, in short, is that insofar as objectors should have to justify themselves, they should have to do it according to the standard that we defend rather than according to the standards that others have developed. Building Better Beings: A Theory of Moral Responsibility argues that the normative basis of moral responsibility is anchored in the effects of responsibility practices. Further, the capacities required for moral responsibility are socially scaffolded. This article considers criticisms of this account that have been recently raised by John Doris, Victoria McGeer, and Michael Robinson. Robinson argues against Building Better Beings’s rejection of libertarianism about free will, and the account of desert at stake in the theory. considers methodological questions that arise (...) from the account of desert, providing some additional resources for thinking about these issues within the framework of the account. Say that two goals are normatively coincident just in case one cannot aim for one goal without automatically aiming for the other. While knowledge and justification are distinct epistemic goals, with distinct achievement conditions, this paper begins from the suggestion that they are nevertheless normatively coincident—aiming for knowledge and aiming for justification are one and the same activity. A number of surprising consequences follow from this—both specific consequences about how we can ascribe knowledge and justification in lottery (...) cases and more general consequences about the nature of justification and the relationship between justification and evidential probability. Pediatric research without the potential for clinical benefit is vital to improving pediatric medical care. This research also raises ethical concern and is regarded by courts and commentators as unethical. While at least 10 justifications have been proposed in response, all have fundamental limitations. This article describes and defends a new justification based on the fact that enrollment in clinical research offers children the opportunity to contribute to a valuable project. Contributing as children to valuable projects can benefit individuals (...) in two ways. First, individuals may come to ?embrace? the contributions they made as children. Second, contributing to valuable projects can lead to a better overall life. Because these potential benefits can outweigh small research risks, they provide a justification for pediatric research without the potential for clinical benefit, when it poses low risks and has the potential to benefit others in important ways. In a forthcoming paper, Walter Carnielli and Abilio Rodrigues propose a Basic Logic of Evidence whose natural deduction rules are thought of as preserving evidence instead of truth. BLE turns out to be equivalent to Nelson’s paraconsistent logic N4, resulting from adding strong negation to Intuitionistic logic without Intuitionistic negation. The Carnielli/Rodrigues understanding of evidence is informal. Here we provide a formal alternative, using justification logic. First we introduce a modal logic, KX4, in which \ can be read as (...) asserting there is implicit evidence for X, where we understand evidence to permit contradictions. We show BLE embeds into KX4 in the same way that Intuitionistic logic embeds into S4. Then we formulate a new justification logic, JX4, in which the implicit evidence motivating KX4 is made explicit. KX4 embeds into JX4 via a realization theorem. Thus BLE has both implicit and explicit possibly contradictory evidence interpretations in a formal sense. (shrink)

In this paper, I take a critical stance on the emerging field of nanoethics. After an introductory section, “Conceptual Foundations of Nanotechnology” considers the conceptual foundations of nanotechnology, arguing that nanoethics can only be as coherent as nanotechnology itself and then discussing concerns with this latter concept; the conceptual foundations of nanoethics are then explicitly addressed in “Conceptual Foundations of Nanoethics”. “Issues in Nanoethics” considers ethical issues that will be raised through nanotechnology and, in “What’s New?”, it is argued that (...) none of these issues is unique to nanotechnology. In “It’s a Revolution!”, I express skepticism about arguments which hold that, while the issues themselves might not be unique, they nevertheless are instantiated to such a degree that extant moral frameworks will be ill-equipped to handle them. In “What’s Different?”, I draw plausible distinctions between nanoethics and other applied ethics, arguing that these latter might well identify unique moral issues and, as such, distinguish themselves from nanoethics. Finally, in “What Now?”, I explore the conclusions of this result, ultimately arguing that, while nanoethics may fail to identify novel ethical concerns, it is at least the case that nanotechnology is deserving of ethical attention, if not a new associative applied ethic. Should our degree of commitment to a value, relationship, or goal be proportional to the degree of justification that we take the commitment to possess? Or are there reasons for maintaining wholehearted commitments even in cases where we have relatively weak justifications for those commitments? I argue in favor of the latter position: degree of commitment should sometimes diverge from degree of justification. To make this case, I introduce and critique what I call Locke’s Dictum: the claim that (...) our degree of our commitment to an evaluative claim should match the degree of justification for it (decisive justification warrants full commitment, whereas weaker justification warrants weaker commitment). While it has initial appeal, I argue that Locke’s Dictum is mistaken. I argue that many important goals, values, and relationships require wholehearted commitment to evaluative propositions in the absence of decisive justification for them. So we are faced with a choice: either we violate Locke’s Dictum; or we forgo the goods internal to full-fledged commitments; or we deny a reasonable pluralism about possible commitments. I argue that we must reject Locke’s Dictum and with it a series of seeming platitudes about the connection between justificatory reflection, commitment, and fanaticism or extremism. ​. (shrink)

In this response, we first tackle what we take to be the core disagreement between ourselves and Hammersley, namely the justification for our model of social research ethics governance. We then consider what follows from our defence of governance for ethics review and show how these claims attend to the specific concerns outlined by Hammersley.

An important question in epistemology concerns how the two species of justification, propositional and doxastic justification, are related to one another. According to the received view, basing one’s belief p on the grounds that provide propositional justification to believe p is sufficient for the belief to be doxastically justified. In a recent paper, however, John Turri has suggested that we should reverse the direction of explanation. In this paper, I propose to see the debate in a new (...) light by suggesting that the best way to understand the relationship between these species of justification is by viewing propositional justification as an dispositional property that a subject can have with doxastic justification as its manifestation. I show how the debate in metaphysics over the question of how disposition statements should be analyzed runs parallel to the epistemological debate, and bring some of the results in the dispositions debate to bear on the epistemological question. I end by offering some tentative remarks regarding the order of priority of these two species of justification. (shrink)

Public justification-based accounts of liberal legitimacy rely on the idea that a polity’s basic structure should, in some sense, be acceptable to its citizens. In this paper I discuss the prospects of that approach through the lens of Gerald Gaus’ critique of John Rawls’ paradigmatic account of democratic public justification. I argue that Gaus does succeed in pointing out some significant problems for Rawls’ political liberalism; yet his alternative, justificatory liberalism, is not voluntaristic enough to satisfy the desiderata (...) of a genuinely democratic theory of public justification. So I contend that—pace Gaus, but also Rawls—rather than simply amending political liberalism, the claims of justificatory liberalism bring out fatal tensions between the desiderata of any theory of liberal-democratic legitimacy through public justification. What is the epistemic function of imagination? Traditionally, philosophers have claimed that the epistemic function of imagination is exhausted by its ability to provide justification for modal beliefs, or that it is epistemically irrelevant. However, in recent years a number of philosophers have broken with the tradition by arguing that imagination can generate justification or knowledge about contingent empirical facts. This paper argues against this view by developing a new dilemma. The upshot of the argument is that although (...) imagination does have an important epistemic function that has evaded the traditional view, it cannot give rise to new empirical justification or knowledge. Two important objections have been raised against exclusivist public reason. First, it has been argued that EPR entails an unjust burden for citizens who want to appeal to non-public reasons, especially religious reasons. Second, it has been argued that EPR is based on a problematic conception of religious reasons and that it ignores the fact that religious reasons can be public as well. I defend EPR against both objections. I show that the first objection conflates two ideas of public (...) class='Hi'>justification and that the second objection conflates two ways to understand and identify religious reasons. Ultimately, it turns out that those who defend such objections actually share the concerns that justified EPR in the first place. In other words, if we are clear about the idea of public justification and the kind of religious reasons that EPR is really about, it appears that justificatory liberals are in fact all exclusivists. This paper takes part in the methodological debate concerning the nature and the justification of hypotheses about computational systems in software engineering by providing an epistemological analysis of Software Testing, the practice of observing the programs’ executions to examine whether they fulfil software requirements. Property specifications articulating such requirements are shown to involve falsifiable hypotheses about software systems that are evaluated by means of tests which are likely to falsify those hypotheses. Software Reliability metrics, used to measure the growth (...) of probability that given failures will occur at specified times as new executions are observed, is shown to involve a Bayesian confirmation of falsifiable hypotheses on programs. Coverage criteria, used to select those input values with which the system under test is to be launched, are understood as theory-laden principles guiding software tests, here compared to scientific experiments. Redundant computations, fault seeding models and formal methods used in software engineering to evaluate test results are taken to be instantiations of some epistemological strategies used in scientific experiments to distinguish between valid and non-valid experimental outcomes. The final part of the paper explores the problem, advanced in the context of the philosophy of technology, of defining the epistemological status of software engineering by conceiving it as a scientifically attested technology. Joseph Raz's defence of government is grounded in his ‘normal justification thesis’. This thesis justifies the exercise of state authority in just those cases where subjects are more likely to fulfill their duties by obeying the state than by carrying out their own deliberations. I argue that the assumptions underlying this argument are importantly similar to those made by the Enlightenment anarchist philosopher William Godwin. Raz's arguments can supplement Godwin's political theory, producing an argument which, though grounded in anarchist (...) principles, justifies a limited state authority. (shrink)

In this paper I examine contemporary accounts of noninferential justification in light of what I take to be the Cartesian project of building epistemology on foundations made secure by the impossibility of error. I argue that familiar abstract arguments for foundationalism, by themselves, don’t seem to motivate Cartesianism. But I further argue that there is one version of foundationalism that is more closely linked to the way in which Descartes sought ideal knowledge.

The Weatherall report on the use of non-human primates in research was published in 2006. Its main conclusion was that there is a strong scientific case for the use of non-human primates in some cases, but the report stressed the importance of evaluating each case in the light of the availability of alternatives. In addition to arguing for the scientific necessity of using non-human primates in research, the report also provided an ethical justification. As could be expected, the report (...) was harshly criticised by animal rights groups, but in the academic literature, only two critical replies appeared. In what follows, I will describe the ethical justification for non-human primate research as it is laid out in the Weatherall report and then consider the criticism in the academic literature. I conclude that the report’s ethical justification for the use of non-human primates in research, in particular in basic neuroscientific research, has not been convincingly challenged by its critics. Since the criticism of the report is limited and represents only a small part of the academic discussion about the use of non-human primates in research, and a still smaller part of the ethical discussion about animal research, it is important that the discussion continue both at the academic and social level. Broadly speaking, a naturalistic approach to epistemology seeks to explain human knowledge – and justification in particular – as a phenomenon in the natural world, in keeping with the tenets of naturalism. Naturalism is typically defined, in part, by a commitment to scientific method as the only legitimate means of attaining knowledge of the natural world. Naturalism is often thought to entail empiricism by virtue of this methodological commitment. However, scientific methods themselves may incorporate a priori elements, so empiricism (...) does not follow from the methodological commitments of naturalism alone. And given a suitably-naturalistic conception of the a priori, a priori forms of justification may be compatible with naturalism generally. A priori justification is, in principle, compatible with naturalism – and hence naturalistic epistemologies – if the a priori is understood in a way that is free of some of the inessential properties that have been associated with the concept. I argue that some of the more prominent strategies for accommodating normative notions within a naturalistic framework allow for the possibility of a priori justification. These include reliabilism, instrumental rationality, and nonfactualism about justification. A priori justification thus need not be seen as standing in opposition to all naturalistic epistemologies. It is only with nonnormative naturalistic epistemologies that a priori justification per se is incompatible, and this only because the notion of justification itself has no role to play within a nonnormative approach to epistemology. : This paper explicates and defends the thesis that individual rational judgment, of the kind required for justification, whether in cognition or in morals, is fundamentally socially and historically conditioned. This puts paid to the traditional distinction, still influential today, between ‘rational’ and ‘historical’ knowledge. The present analysis highlights and defends key themes from Kant’s and Hegel’s accounts of rational judgment and justification, including four fundamental features of the ‘autonomy’ of rational judgment and one key point of Hegel’s (...) account of ‘mutual recognition’. These themes are linked to Kant’s and Hegel’s transformation of the modern natural law tradition.
