The nature and consistency of John Locke's views about liberty and suspension, as well as their bearing on what is now called determinism, remain matters of controversy and sometimes, despair. This chapter explains what it is that "determines the will" according to John Locke. It begins by explaining the central terms Locke employs and the meanings he assigns them. Next, the chapter cites and discusses some of the main doctrines that he formulates using that terminology. In light of these (...) explanations, the chapter analyzes two recent interpretations of Locke's doctrines about liberty, suspension, and the will. The first of these, offered by Vere Chappell, convicts Locke of inconsistency; the second, offered by Gideon Yaffe, proposes away to acquit him. Finally, drawing on the lessons of those examinations, the chapter presents and develops a consistent and more satisfying interpretation of Locke's treatments of liberty and suspension in relation to the will. My basic question in this paper is pretty straightforward: which resources does the Christian tradition have to overcome envy? If one reads the story of Christ’s passion as an “envy drama” and Christ’s cross as the unjust result of his enemies’ sinful envy (see Mk 15:10), one might offer a more elaborate version of the initial question: what do the crucifixion and resurrection mean when reconsidered as overcoming – or, as I shall say: suspending – envy as cardinal sin? Section (...) one lays out conceptual issues, while section two repudiates two attempts of defending a particular form of envy. Section three is dedicated to different soteriological and Christological models in asking how they can deal with sin (and envy). It reacts to the problems implied by these accounts, particularly the subjectivist one, by suggesting a praxeological answer to the question of this paper. (shrink)

Technological mediation theorists (such as Don Ihde and Verbeek) believe that human beings’ moral actions can be transformed through technological artefacts to constitute a “good life”. This paper, however, critically analyses two understandings of technological mediation, (1) technological mediation is something between humans and the world (prominent in Don Ihde), and (2) technological mediation is a direct constitutive effect (prominent in Verbeek), which will inevitably lead to the problem of “moral suspension” that I define. In the first understanding (following (...) Zygmunt Bauman), the causal relations between moral actions and actual consequences are distanced from each other because of the “interval” effects of technological artefacts. In the second understanding (following Jean Baudrillard), designers are just “simulating” moralities in specific use and design contexts. Thus, moral realities are ultimately replaced by moral “simulacra”. Then, I argue that to overcome the problem of “moral suspension,” rather than distancing actions from their consequences or simulating moralities in specific scenarios, two possible approaches may be needed, the Way of Zhuangzi who declined to use any adroit technology to improve efficiency, thereby clarifying the relationship between moral actions and consequences; and the attitude of Bauman, who motivated our moral consciences and moral sensitivities, thereby reflecting the side effects of technological mediations and systems. In the end, I conclude that both of these two approaches are too difficult to universally apply, and the most viable approach is to use what Confucius called “the Doctrine of the Mean,” i.e., seeking a balance between the two approaches. That is, while we should acknowledge that technologies intervene our lifeworld and constitute our thinking and moralizing ways, we also need to break away from technological trivialities to think about and pursue long-term moral goals. In the first edition of the Essay concerning Human Understanding, Locke claims that human beings have freedom of action - that is, that some of their actions are free - but that they do not have freedom of will - that is, that none of their volitions are free. Volitions themselves are actions for Locke; they are operations of the will and hence acts of willing. And volitions give rise to other actions: an action that follows and is caused by (...) a volition is thereby a voluntary action. But volitions are not subject to the will; they cannot be caused by acts of willing and so cannot themselves be voluntary actions. This doctrine, that acts of willing cannot be voluntary, is one of Locke’s reasons for thinking that they are not free. (He also has a reason for holding this doctrine, and a second reason for thinking that acts of willing cannot be free, both of which I’ll be considering later on.) Locke follows not only the scholastics but also Descartes and Hobbes in holding that being voluntary is a prerequisite for being free. But unlike Descartes and Hobbes, though not unlike the scholastics, Locke does not make voluntariness sufficient for freedom. In addition to being voluntary, a free action must be one its agent can avoid - avoid, that is, merely by willing, whether by willing not to do it or by willing to do something else that is incompatible with doing it. In Book II, chapter xxi of the Essay Concerning Human Understanding, on ‘Power’, Locke presents a radical critique of free will. This is the longest chapter in the Essay, and it is a difficult one, not least since Locke revised it four times without always taking care to ensure that every part cohered with the rest. My interest is to work out a coherent statement of what would today be termed ‘compatibilism’ from this text – namely, a doctrine which (...) seeks to render free will and determinism compatible. By emphasizing the hedonistic dimension of his argument, according to which we are determined by “the most pressing uneasiness” we feel, I show how a deterministic reading is possible. This was seen by Locke’s favorite and also most radical disciple, the deist Anthony Collins, whose treatise A Philosophical Inquiry Concerning Human Liberty (1717) is both a critique of Essay II.xxi and a radicalization of its contents. I argue that Collins articulated a form of determinism which recognizes the specificity of action, thanks in large part to the uniquely ‘volitional’ determinism suggested by Locke. (shrink)

This paper takes up two questions regarding Locke’s doctrine of suspension. First, what motivates suspension? Second, what are the conditions under which we are motivated to suspend? In response to the first question, I argue that suspension is motivated by the desire to avoid the possible future evils that might result from acting precipitately upon some desire without suspending. This article proposes a reconstruction of the Sextan critique against the Pythagorean conception of number as principle of all existing things. Taking into consideration all the parallel passages concerning the presentation and the polemic about the Pythagorean doctrine, the present article proposes a division of the sceptical critique into two sections, the first one presenting the Pythagorean reasons to consider the numbers as principle existing apart from numbered things, and the second one presenting the arguments that Sextus himself built (...) against them. This paper will show that this structure is consistent with the sceptical method, which consists in pointing out the ἰσοσθένεια among different positions which leads to suspension of judgment. Regarding the Pythagorean doctrine that emerges from these passages, the present article discusses the way in which Sextus testified a juxtaposition between Pythagorean and Platonic doctrines, probably due to a Middle-Platonic or Neopythagorean elaboration, against which Sextus used Platonic concepts, adopting in original way arguments taken from the Parmenides and the Phaedo. Despite the ἐποχή about the nature of the number, this article will argue that Sextus did not avoid to use the number in practical daily life, in a way that is consistent with the sceptical practical criterion. Scholars who wonder how the Buddha would take sides in the traditional debate on the existence of free will generally believe that it is possible to attribute to him a single point of view capable of reconciling apparent inconsistencies that arise from the reading of the scriptural pages that might be related to this issue. The thesis of this article is that the Buddha’s position on the question of free will is in fact far from being univocal. Rather, in each (...) of the three philosophical registers that can be identified in his teachings, different answers to the same question are implicit—in the personalist dimension of the Buddhadharma, a libertarian language is spoken; the reductionist register of the nonself doctrine, on the other hand, necessarily implies a hard determinist position; and finally, in the antimetaphysical context of the middle path, we find a suspension of judgment regarding the determinism/free will dilemma. Scientific knowledge is often categorized as experimental or theoretical. There is, however, a third layer where philosophy of science and science proper overlap, the realm of metatheoretic shaping principles. For example, we assume that the causal regularities observed today will also hold tomorrow. Researchers are thereby relying on two metaphysical doctrines: the uniformity of nature and mechanistic causation. There are also the “explanatory virtues” of simplicity, testability, internal and external coherence, fruitfulness, and wide scope. My first goal is to categorize (...) these principles and show how they’ve operated in the history of science. Particular attention will be paid to their suspension and rejection, even of widely held principles. My second goal is to consider how certain shaping principles impinge on open theology. Of particular interest will be naturalism (both metaphysical and methodological), reductionism, and realism. Surprisingly, differences within the open theology camp are more relevant to these issues than open theism itself. (shrink)

THE END TIMES OF PHILOSOPHY The phrase “end times of philosophy” is not a new version of the “end of philosophy” or the “end of history,” themes which have become quite vulgar and nourish all hopes of revenge and powerlessness. Moreover, philosophy itself does not stop proclaiming its own death, admitting itself to be half dead (...) and doing nothing but providing ammunition for its adversaries. With our sights set on clearing up this nuance, we differentiate philosophy as an institutional entity, and the philosophizability of the World and History, of “thought-world,” which universalizes the narrow concept of philosophy and that of “capital.” We also give an eschatological and apocalyptical cause to this end, of “times” or “ages” rather than those of philosophical practice. Last but not least, it is the Future itself in the performativity of its ultimatum that determines this end times, reversing these times from the Identity the Future accorded to it, withdrawing the thought-world from the lie of its death. Why this style of axioms and oracles, these more or less subtle distinctions, old and debased, with an appeal to the ultimata , to end times and last words? We fight to give, parallel to the concept of Hell, its new theoretical position, for its philosophical return and its non-philosophical transformation. No more so than any other word, Hell is not a metaphor here, just the Principle of Sufficient World. Every man, no doubt, has his “hell” readily available, connivance, control, conformism, domestication, schooling, alienation, extermination, exploitation, oppression, anxiety, etc. We have our little list that the Contemporaries established in the previous century in the same way one used to construct lists of virtues and vices or honors and wealth. They invented it for us without knowing it, for us-the-Futures who have as our responsibility to invent its use. In the Christian and Gnostic tradition, the struggle of the End Times takes place “on earth.” The most sophisticated of believers have it taking place in Heaven as well, above all in Heaven. The various kinds of gnosis imagine infinite falls and vertiginous highs, the vertigo of salvation. On Earth as in Heaven, a hell is available. The Marxists have the law of profit and the control of production, the class struggle Capital imposes on man. The Nietzscheans, the dull grumble of the struggle in the foundations of World and History, the domestication of man, the society of control. The phenomenologists, the capture of being, the most superficial amongst them, the age of suspicion. But all of these “hells” are taken from World, History, Society, and Religion. What we call Hell is no longer of the order of these specific and total intra-worldly generalities, it is both more singular and more universal, no longer being at all of the same order, it is the determinant Identity of these small hells strung out through history but unified here in the name of the last Humaneity. It is even found within the French idiom for hell [ enfer ], en-fer literally means “in-irons.” We are as much “in-irons” as we are “alive” [ en-Vie ]. We believe in Hell but as non-philosophers and it is even because we are non-philosophers that we can believe in it outside of any sort of religion. Hell is less mythological than ideological, it combines philosophizability with universal capital. Under what form? A single term could work for them without being a metaphor or something they would participate in by analogy, a more innovative and conjectural term than control, more universal than profit. It would denote the growing and permanent extortion of a surplus-value of communication, of speed and of urgency in change, in productivity and in work, in the pressure of images and slogans. It would be worse than solicitation, more tenacious than capture, more active and persecutory than control, softer and more insidious than a frontal attack, just as perverse as questioning and accusation, less brutal and offensive than extermination, less ritualized than inquisition, it would be soft and dispersed, instantaneous and vicious, it would be a crime without declared violence. Collusion and conformism, it would be afraid to show itself. Related to rumor, from which it borrows its infinite and tortuous ways. It is harassment. As a modernized form of Hell, perhaps harassment has a long future in front of it, of innocent torture, slow assassination, in short the fall, but radical with no way of recovering and which tolerates only salvation. THE PHILOSOPHICAL PAST OF NON-PHILOSOPHY Non-philosophy is thus Man as the utopian identity of the philosophical form of the World, a utopia destined to transform it. We still have to understand these equations, in particular that of the being-uni-versed from Man, and this book adheres to this by re-exposing non-philosophy in a different way via one of its new possibilities. It uses this opportunity to once again take up formulations that lead to objections answering certain external critics, as well as revisiting diverging interpretations specific to non-philosophers. A portion of this book is devoted to going through these theories via a strict or “lengthy” presentation of non-philosophy, and its defense against more expeditious solutions. This work of rectification is the occasion, merely the occasion, for refocusing non-philosophy on Man (the “Man-in-person,” “Humaneity”), and in a more innovative manner, on its utopian vocation established since the book Future Christ . As for this “occasion,” it is quite obvious. A school of posture, not to say a school of thought, supposes a minimum of closure from the most liberating of knowledge, a heritage, its utilization, and its no less certain dispersal. Within its development, a variety of interpretations will no doubt appear, deviations that are as much normalizations, and a struggle against this multiplication of divergent tendencies. These are perhaps not inevitable evils, especially here, merely a normal development according to the twisting paths of history. But the problem is made worse by the fact that this school of non-philosophers is that of utopia. Not the former attempts devoted to commenting on the worst authoritarian and criminal forms of the past and the present, but utopia as the determinant principle for human life, or to put it another way, of the Future as an irreducible presupposition of (for) thinking the World and History. Non-philosophers are engaged in an aleatory navigation between the respect for the most rigorous utopia, whose rules are not that of the reproductive imagination but those from the Future determining imagination itself, as well as the temptations, diversions, and remorse of history. Little by little, we will begin to understand that the Future as we understand it no longer has any temporal consistency or positive content, without being an empty form or a nothingness, but that it is foreclosed to past and present History, just as it is foreclosed to the place of places, the World, and that it is the only method for establishing the practice of thinking in a non-imaginary instance. Because it is the World and History that are imaginary and have a terrible materiality, it is not necessarily utopia. We will overlap two objectives here: the defense of non-philosophy against the (non-) philosophers that we are, only occasionally, and the introduction of philosophy to a rigorous future. Together they set out to definitively render, without any possible return to philosophical conformism or towards the facilities of the past and present, the non-philosophical enterprise understood as utopia or uchronia. Imagination and speculation, left to themselves and thus undistinguished, are quite good for participating in the grand game of History but have little value or worse for the Future which is unimaginable and unintelligible and must be maintained as such. MAN-IN-PERSON AS SUSPENSION OF THE PHILOSOPHICAL CHORA The point where philosophical resistance is concentrated is without a doubt the invention of the Name-of-Man, first name, oracular as much as axiomatic, of the determining cause for the non-philosophical posture. And that which concentrates the differends is the style of non-philosophy as identity that possesses the dual aspect, of discipline and of the oeuvre, of the theorem and of the oracle. But the real difficulty in understanding the simplicity of non-philosophy is profoundly hidden in the depths of philosophy itself. Because philosophy, from Parmenides to Derrida, even Levinas, continues to be a divided gesture, without a veritable immanence, transforming its thematic contents of transcendence in also forgetting to transform the operative transcendence in the element from which the ontology of surface is established which we will call, in memory of Plato, the chorismos. The general effect of the chora literally gives place to philosophy, demanding binding and sutures to which we will once and for all “oppose” the Man-in-person, his power of cloning, and his future being. All philosophy contains a hinter-philosophy in which it deploys its operations and weaves its tradition like an understudy of a topographical nature and in the best of cases being itself topological. Philosophy as well consists of two levels, its pre-ontological operative conditions on the one hand, and its superficial theme on the other, it too has its presupposed, but is not aware of it or erases it within the unity of appearance named Logos. Rightly, the Logos, and its flash or lightning nature, possesses a “dark precursor,” the chora, which is as much a virtual image, and philosophy, dazzled by its own lightning flash, seems to completely forget about it at the same time it sets itself up within it. Non-philosophy risks taking this same path, of confusing what it believes to be the real with its phantom double, contenting itself to working on the thematic level of philosophy, not its surface objects and its idle chatter (we stopped talking about this a long time ago and in any case they are merely simple materials for inducing a work of transformation), but the transcendence-form of its objects. In the end it risks, through precipitation, taking back up the heritage of philosophy, a heritage of a misunderstood presupposed, even more profound than the play of transcendences. This is what the imperative of the radicality of immanence meant, to treat immanence in an immanent manner, not to make a new object out of it. And from here we get non- (philosophy) and its refusal of the Platonic chorismos , symbol of all abstraction, and thus all transcendental appearance. There are no illusions. The message will leave a heritage in tattered pieces and interpretations. But it was difficult not to dispute the differend to its core. There will be complete confusion of the multiple, possible, and necessary effectuations of non-philosophy with its interpretations. The non-philosophical or human freedom of philosophical effectuation and the philosophical freedom of interpretation. Effectuations demand non-philosophy to return to zero from the point of view of its philosophical material and thus also but within these limits the formulation of its axioms , but in no way providing from the outset divergent interpretations of the aforementioned axioms. They are divergent because they do not take into account the material from which these axioms are derived within non-philosophy, and because they do not see themselves as symptoms of another vision of the World. The utterances of non-philosophy are not mathematical theorems and pure axioms, they merely have a mathematical aspect . They are, by their extraction or origin, mathematical and transcendental. And by their determined function in-Real, within non-philosophy, they are identically in-the-last-Humaneity entities which have an aspect of an axiom and an aspect of interpretation (or an oracular aspect as we say) that attempts (sometimes it is ourselves who provide the occasion) to isolate and transform, in complete freedom of interpretation. There will be an opportunity to complain about the complex character of the language of non-philosophy, an idiom saturated with classical references, sophisticated in a contemporary way. Its freedom of decision up against the whole of philosophy demands these effects of “complication” and “privatization,” as the saying goes. But it also demands fighting against the drift [ dérive ] of the pedagogical-all and the mediatic-all that leads philosophy into the shallow depths of opinion, which is the site of its impossible death. The noble idealism of “pop-philosophy” has been consumed into a “philo-reality;” against this we propose philo-fiction. Parricide, which is at the bottom of these interpretations and which we can judge as being quite fertile, although it has informed tradition, only takes place once or within one lone meaning. In regards to Parmenides, it was possible; Plato introduced the Other as non-being and language, bringing into existence the philosophical system of the World, but is it possible to repeat it again with the same fecundity in regards to non-philosophy, this time in introducing (non) religion or (non) art, still mixing them without taking into account this mixture, alternatively as a philosophical or religious resentment? If philosophy begins via a crime, it is no doubt obliged to continue down similar pathways, to the effect that the crimes of philosophy, once the founding crime has been committed, are a reaction of self-defense. It is undoubtedly from this that we get Marx’s declaration that history begins by tragedy and repeats itself or ends in farce. The preservation of rigor and fecundity is, in every respect, a psychologically difficult task within a theory such as non-philosophy. Having posited an essential objective of liberation in regards to philosophy and its services, one has often understood this objective as an authorization of providing particular interpretations of its axioms and ends up obliterating their scope. This ends up confusing, on one hand, two kinds of freedoms in regards to non-philosophy, the freedom of its interpretations and the freedom of its effectuations. On the other hand, any defense of “principles” against precipitated interpretations is immediately taxed with a will to orthodoxy, a prohibitive objection when we are dealing with, as is the case here, a heretical theory of thought. Nevertheless, it is time to stop confusing heresy as the cause of thought with an ideology of heresies, which is certainly not at all our object, but rather a form of normalization. As for the “disciplinary” aspect, which is not the only aspect, it demands something other than philosophical “answers to objections,” a precision in the definition and use of its procedures in the formation of utterances, since non-philosophy is neither a supplementary doctrine interior to philosophy nor a vision of the world but one whose priority is a “vision of Man,” or rather Man as “vision” that implies a theory and a practice of philosophy. In the end, struggle is only one aspect of non-philosophy, not its whole or telos, struggle coming only from its materiality. In particular, if the discipline of non-philosophy is inseparable from struggle, it is not a question of reducing the monomaniacal obsession of its “marching orders.” This would reduce its complexity and kill its indivisibility, deploying it in a “long march” and a form of Maoization whose philosophical presuppositions no longer have any pertinence here, a case of the One and the Two, which are now cloned and no longer tied together. More generally, non-philosophy is a complex thought composed of a multitude of aspects, which is to say, unilateral interpretations, of a philosophical origin but reduced by their determination in-the-last-instance . The “liberalism” of non-philosophy is merely one of the aspects of which it is capable, not an essence. Similarly, it is only capable of having a “Maoist” aspect. Let us generalize. The weakness of non-philosophy is due to a specific cause, the determination-in-the-last-Humaneity of a subject for the World. Everything that has a right to the philosophical city can be said about it in turn and in a retaliatory mode since Man contributes nothing of himself that Man takes from the World. We can consider non-philosophy as being pretentious, absurd, idealistic, empty, materialistic, formalistic, contradictory, modern, post-modern, Zen, Buddhist, Marxist; it endures or tolerates, perhaps “appeals” to, or at least renders possible, sarcasms, ironies, and insults without even talking about the misunderstandings, partly for the same reason as psychoanalysis. All of this goes beyond simple “deviations.” They are its aspects, which is to say, its “unilateral” philosophical interpretations in both senses of the word, being either sufficient coming from the mouth of philosophers, or reduced to their absolute dimension of sufficiency and totality in the mouths of non-philosophers, and both times due to the weakness and strength of Man-in-person as their determination only in-the-last-instance. The non-philosopher is certainly not a Saint Paul fantasizing about a new Church. The non-philosopher is either a (Saint) Sebastian whose flesh is pierced with as many arrows as there are Churches, or a Christ persecuted by a Saint Paul. What is engaged in here is the practice of retaliation. A negative rule of the non-philosophical ethics of outlawed discussion by way of argumentation (the sufficient is you, the orthodox one is always you, you are the fashionable one, and when a master you are someone else) that is founded on the confusion of effectuations of non-philosophy and of its overall interpretations. Retaliation is the law but as with any too-human law, it must acquire a dimension that displaces it, or rather emplaces it and takes away its authority but not all of its effectiveness. If the non-philosopher is only authorized by himself, which is to say by philosophy but limited by the Real-of-the-last-instance, its critique of other non-philosophers can merely be retaliatory under the same conditions, only by the Real limited in-the last-instance. THE TREE OF PHILOSOPHICAL SAINTLINESS The thematic horizon or material of these debates is in the relationships between philosophy, religion as gnosis, and non-philosophy. It is inevitable, regarding non-philosophers in general (whether they are non-philosophers by name or simply its neighbors) that we often end up evoking Marx’s Holy Family and imagining, arranged on the neighboring branches of the tree of philosophy and annexed, sometimes abusively, to non-philosophy, authors who would quite evidently and quite rightly refuse this label. So it is that we find, for example, a Saint Michel, a Saint Alain, a Saint Gilles 1 without even mentioning the youngest who aspire as well to the freedom of “saintliness” and who make their muted voices heard here. If there is a Holy Family of non-philosophers, it extends completely beyond these three, provided that the sectarian spirit can save us. This book is organized in the following manner: To begin, in order to recall the essential part of the problematic, we have organized a Summary of Non-Philosophy , a vade-mecum of notions and basic problems, in a classical style. Secondly, there is Clarifications On the Three Axioms of Non-Philosophy , designed to posit their proper use as much as to elucidate their meaning. Thirdly, an analysis of Philosophizability and Practicity , both being extreme constituents of philosophical material or the contents of the third axiom. Fourthly, the heart of this work: Let us Make a Tabula Rasa of the Future or of Utopia as Method . Fifthly, we have a theoretical outline of a non-institutional utopia, The International Organization of Non-Philosophy, L’Organisation Non-Philosophique Internationale, (ONPHI) already created in practice but under the conditions of possibility and functioning from which here we put into question “de jure,” thus not without a perplexity concerning “facts,” in any case, without the capability of “getting to the bottom of things.” Sixthly, an essay characterizing The Right and the Left of Non-Philosophy , a brief topology of several philosophizing and normalizing positions of proponents or tenants of this problematic. Seventhly, Rebel in the Soul: A Theory of Future Struggle , a systematic discussion starting from a confrontation of non-philosophical gnosis and non-religious gnosis to the extent that they pose, posed or perhaps still will pose themselves as rivals to non-philosophy in a mixture of fidelity and infidelity. Despite the fact that it can also be read as putting non-philosophy into perspective: it pits against a standard Platonism two contemporary appropriations of Gnosticism. On the basis of the paradigm of Man who never ceases to come as the Future-in-person, each one of these moments strives to reestablish not the “true” non-philosophy and its orthodoxy, but the minimal conditions to respect in order to allow for its maximum fecundity. And in order to bring about one of the last possibilities of its development, making explicit Humaneity as a utopia-for-the-World. In introducing these considerations in the form of a “testament” and “ultimatum,” we want to indicate two things: First, that this is the last time we will intervene in order to caution non-philosophers against the temptation of returning and looking backwards towards philosophy. Only a disillusioned nostalgia for the former World and its traditions barely remain permissible to us.… Secondly, that non-philosophy is also a sort of ultimatum for considering one’s life and transforming one’s thought from the perspective of a uni-version rather than a conversion. Man as future is this ultimatum in action, not an impatient self-proclaimed genius, and philosophy is his testament. It is obviously the ultimatum that determines this testament as “old” with a view towards a life that is, itself, non-testamentary. In and of itself, the “old” can never bear a veritable eschaton. Thus, this book intersects according to the logic of this paradigm, under the sign of the ultimate or “last” as future, philosophy as testament and cautionary note for maintaining the non-philosophical oeuvre as “future” or “utopian.” We will see that between these two dimensions it cradles a theory of struggle. In the end, this book envisions non-philosophers in multiple ways. It inevitably sees them as subjects of knowledge, most often academics insofar as life in the world demands, but above all as close relatives of three great human types. The analyst and political militant are quite obvious, for non-philosophy is close to psychoanalysis and Marxism insofar as it transforms the subject in transforming philosophy. Here again, one must have a sense not of certain nuances but of aspects (of the interpretations, albeit unilateralized) and not in order to construct a simple proletarization or militarization of thought as theory. To be rigorous, rather than authoritarian or spiteful, is its task. And lastly, non-philosophy is a close relative of the spiritual but definitely not the spiritualist. Those who are spiritual are not at all spiritualists, for the spiritual oscillate between fury and tranquil rage, they are great destroyers of the forces of Philosophy and the State, which are united under the name of Conformism. They haunt the margins of philosophy, gnosis, mysticism, science fiction and even religions. Spiritual types are not only abstract mystics and quietists; they are heretics for the World. The task is to bring their heresy to the capacity of utopia, and their utopia to the capacity of the paradigm. NOTES We will recognize allusions, and sometimes references, to closely related or distant themes, but which are related, in the work of Michel Henry, Alain Badiou and via the representative of “non-religious” gnosis of a Platonic origin, in Gilles Grelet. It goes without saying that these discussions are current and local, neither concerning the ensemble of doctrines nor prejudging the eventual evolution of certain amongst them. This concerns defining certain proximities with non-philosophy (rather than adversaries which in some sense they are) and typological and emblematic differends (rather than conflicts with a certain author). The aporia inherent in Kojève’s discussion of the end of history stems from the temporality implicit in the moment of inscribing the end of history in philosophy. Hegel’s Phenomenology as the unfolding of absolute knowledge stands at the last moment in history, without necessarily constituting its end. Reading the post-NEP Soviet ideology through Kojève demonstrates that the doctrine of “socialism in one country” similarly situates itself outside historical time as history’s last moment, marked by the coincidence of being and (...) concept, the disappearance of negation, and classless society without an historical agent. In the reconceptualization of labor in Stalinist ideology as a temporalization of being without negation, the representation of time in five-year plans radically reinvents temporality as a suspension of history in the perpetual deferral of its end. Going beyond Kojève, the immanent logic of temporality of five-year plans enables a non-teleological reading of Hegelian philosophy with regard to the status of its method and the function of the end of history. Since the publication of the edition of John Blund's Tractatus de anima by the British Academy in 1970 there has been widespread acceptance of the importance of this text for the history of thought. Blund (ca. 1175-1248) was probably one of the first commentators on the libri naturales at Paris before the prohibition of 1210, and later introduced them to Oxford. Indeed, apart from the prohibitions of 1210 and 1215, the De anima of Blund is the one text which sheds (...) light on the first reception of Aristotle at Paris. The text was probably composed at Paris, before 1204. Blund taught arts at Paris ca. 1200-1205, then at Oxford towards 1207-1209. He returned to study theology at Paris during the interdict (1208-1214) and the contemporaneous suspension of the schools at Oxford (1209-1214). He was regent in theology at Paris for twelve years, and taught theology at Oxford after 1229. With the Tractatus a whole area of philosophical speculation--namely Greek and Arabic psychology--arrived at Oxford, where it would continue to grow and be debated throughout the century. Blund did not know Averroes but he reflects the state of Latin Aristotelianism during the first third of the thirteenth century. Like his contemporaries Blund regarded the De anima of Avicenna as a commentary on Aristotle; indeed they found it clearer than the text of Aristotle and were guided by it. Blund is faithful to Aristotle and to Avicenna, rejecting, for example, the binarium famosissimum drawn from the Fons vitae of Avicebron. In expounding the doctrine of Aristotle and following the plan laid out by Avicenna, he considers the arguments for and against before offering his own reasoned position in the solutio. He defends the role of the philosopher as considering the nature of the soul and as distinct from theological considerations. This new English translation makes available this important text to a wider audience of scholars interested in philosophy, theology, medieval history and the history of science and psychology. Students who are learning medieval Latin will be able to follow the original Latin with the help of the parallel translation and text notes. (shrink)

Pyrrhonism, named after the scepticism of Pyrrho of Elis, as one of the significant philosophical doctrines in the history of philosophy, was revived by Aenesidemus and Agrippa, and defended by Sextus Empiricus, its last follower, against criticisms in the theoretical and practical contexts. Pyrrhonian scepticism, based on three tenets as the state of equipollence, suspension of judgment and ataraxia, accepts adherence to appearances as a practical guide for life. The aim of this study is to discuss Sextus’ objections regarding (...) two main problems, the nature of good and evil and the art of living, elaborated in Outlines of Pyrrhonism and Against the Ethicists and contemporary remarks on the subject. Thus, it will be addressed whether the sceptic way of life prescribed by Sextus is compatible with his theoretical framework and therefore, whether it can be applied in practice. (shrink)

Numenius is one of the most important authors who, in the Imperial Age, deal with the figure of Socrates. Socrates is important in the Platon­ic tradition, in particular in the sceptical tradition, when the Socratic dubitative “spirit” of the first Platonic dialogues became important to justify the “suspension of judgement.” Numenius criticises the whole Academic tradition by saying that the Academics (particularly the sceptics) betrayed the original doctrine of Plato and formulated a new image of Socrates. For Numenius, (...) Socrates plays a central role because Plato would have inherited his doctrine. What does Socrates’s doctrine consist in? According to Numenius, Socrates theorised a “doctrine of three Gods” (which can be likely found in the second Platonic epistle) which is strictly bound up with the main aspect of Plato’s thought. In fact, in Numenius’s view, Plato belongs to a genealogy which can be linked to Pythagoras himself. From this perspective, Numenius says that Socrates’s original thought is a theology which also belongs to the Pythagorean tradition and which Plato further developed. For Nume­nius, Socrates is not the philosopher of doubt, but a theologian who first theorised the existence of three levels of reality (Gods), which is also the kernel of Numenius’s metaphysical system. For this reason, Numenius puts Socrates within a theological genealogy that begins with Pythago­ras and continues with Socrates and Plato, and that the Academics and the Socratics failed to understand. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. This essay is concerned with two interrelated questions. First, a broad question: in what sense is Skepticism a philosophy− or in what sense is it “philosophy” (as we will see, these are not identical questions)? Second, a narrow one: how should we understand the process whereby ataraxia (freedom from disturbance) emerges out of epochē (suspension of judgment)? The first question arises because Skepticism is often portrayed as anti-philosophy. This depiction, I contend, surreptitiously turns a Skeptical method into a so-called (...) Skeptical doctrine which is then either condemned for being self-refuting or salvaged as a plausible (albeit odd) epistemological theory. Instead, philosophy, for the Skeptics, is a matter of practice. Skepticism is not so much a philosophy that has a worldview to proclaim as it is a philosophy that invites us to perform something. It is intended to problematize the concept of essence, based on Edmundo Huserl’s menology, which is directly related to the zero of knowledge, which takes place from the process of époche, or suspension of the degree of judgment, to apprehend the knowledge of to intentional experiences (Husserl, 1907). Would we be able to reach the zero degree of knowledge? Would it be possible to apprehend the essence of things? Would the phenomenological method give us elements that allow it to (...) aim at things? Would we be able to overcome, through suspension of judgments, the concepts that we use on a daily basis? What essence would this be, when we are formed and conformed to the concept of essence, as a pure form deriving from the Platonic doctrine (Plato, 1972). What conclusion can we reach on this matter? And what are the consequences for a rigorous reading of the concept of essence in Husserl? This is our intention in this article, as a reflective challenge. (shrink)

The first part of this paper will provide a reconstruction of Francis Bacon’s interpretation of Academic scepticism, Pyrrhonism, and Dogmatism, and its sources throughout his large corpus. It shall also analyze Bacon’s approach against the background of his intellectual milieu, looking particularly at Renaissance readings of scepticism as developed by Guillaume Salluste du Bartas, Pierre de la Primaudaye, Fulke Greville, and John Davies. It shall show that although Bacon made more references to Academic than to Pyrrhonian Scepticism, like most of (...) his contemporaries, he often misrepresented and mixed the doctrinal components of both currents. The second part of the paper shall offer a complete chronological survey of Bacon’s assessment of scepticism throughout his writings. Following the lead of previous studies by other scholars, I shall support the view that, while he approved of the state of doubt and the suspension of judgment as a provisional necessary stage in the pursuit of knowledge, he rejected the notion of acatalepsia. To this received reading, I shall add the suggestion that Bacon’s criticism of acatalepsia ultimately depends on his view of the historical conditions that surround human nature. I deal with this last point in the third part of the paper, where I shall argue that Bacon’s evaluation of scepticism relied on his adoption of a Protestant and Augustinian view of human nature that informed his overall interpretation of the history of humanity and nature, including the sceptical schools. Belgian law on child euthanasia uses the concept of discernment to bestow the right to die to minors. Jacques Derrida’s deconstruction of oppositional logic grasps the ambiguity of this use of discernment and generally challenges the alleged force of a textual sign meaningfully to differentiate itself from its different and meaningless else. This alleged ability to discern the presence of discernment impinges the truth-value of the distinction between worthy/unworthy lives. The resulting undecidability morally suggests the respect for otherness and promotes (...) the moral value of the suspension of arbitrary judgment and, in so doing, de facto converges towards the praxis of the doctrine of the sanctity of life that embraces the ‘life is always quality’ argument. In 1935, when the U.S. Supreme Court’s new building opened and displayed the phrase “Equal Justice Under Law,” racial segregation was commonplace, as were barriers limiting opportunities for men and women of all colors to participate in economic and political life. The justices on the Court and the lawyers appearing before them reflected those facts; almost all were white men. Today, the Supreme Court’s inscription has become its motto, read as if it always referenced an understanding of equality that has (...) become central to the identity and the legitimacy of courts. The judiciary “looks” somewhat different than it did and, in a sense, has become more “representative” of the range of people appearing in courts. Given the role that courts had played in sustaining discrimination, the impression that courts ought to welcome everyone is a major achievement. Yet, to assess the impact of new judicial demographics requires analysis of other major alterations in U.S. courts—the influx of diverse litigants newly entitled to pursue legal claims; the economic barriers facing many claimants; the emergence of judiciaries as agency-like promoters of agendas; and the displacement of public adjudication through the privatization of dispute resolution. Studies of women as judges focus mostly on their rulings, but probing the “difference that difference makes” requires looking beyond judicial opinions. Courts in the United States have developed structural capacities to propose rules and legislation, create education programs, commission research and task forces, and lobby for resources. When women of all colors and men of color became lawyers and judges, they created affinity organizations and pressed courts to research court-based bias and to revise rules of ethics, doctrine, and practice. Those changes are part of the impact of diversification within the legal profession, as is the backlash against affirmative efforts to reform practices. Another difference of the last decades is that new rights have brought into court many claimants with limited means. Participatory participation remains elusive, while the “justice gap” is pervasive. Worse yet, in some jurisdictions, courts have served as “revenue centers,” using court-imposed assessments as income. Failure to pay “legal financial obligations” can result in suspension of driver’s licenses, the loss of voting rights, and other sanctions levied disproportionately on people who are poor and of color. Instead of being seen as fonts of fairness, courts are coming to be identified as sites of inequality. In addition, many courts have embraced alternative forms of dispute resolution that make both processes and outcomes less visible to the public. Through doctrine and rules, U.S. courts have shifted their own practices as well as enforced mandates imposed on consumers and employers that push them out of court and out of class or joint actions. In sum, the new faces on the bench ought not to obscure that the project of representation, inclusion, and equality is far from complete. Sextus, Montaigne, Hume: Pyrrhonizers. Brill: Leiden, 2021. Pp. 165. Hardback, $154.00. Brian C. Ribeiro’s Sextus, Montaigne, Hume: Pyrrhonizers is a charming and quirky investigation of his three titular skeptics. It is perhaps best understood as a skeptical investigation of skepticism. By that I mean that, like a good Pyrrhonist, Ribeiro explains how (...) things appear to him without claiming to lay down a doctrine or dogma. His topic is how and why skepticism still matters (7). And he suggests that those who are moved by skeptical arguments can learn intellectual modesty from them and thereby achieve a degree of philosophical “calmness of soul” (141).Ribeiro approaches his three figures by taking the cogency of their skeptical arguments for granted. There is little investigation of why these philosophers call various beliefs into question, and his concern is rather what remains once the skeptical doubts are taken on board. Because what he calls “Pyrrhonizing” philosophers reveal that large swaths of our beliefs lack epistemic merit, they also show us how we are not fully rational creatures in our everyday lives. In the case of Sextus, Ribeiro’s focus is on the famous question of whether skeptics can live their skepticism once they have actually suspended all belief. With Sextus, as with Montaigne and Hume, Ribeiro opts for the more radical of the interpretive options; he is not persuaded by Michael Frede’s suggestion that Pyrrhonists restrict their suspension only to abstruse matters, not the everyday (51). But even if we follow the “four-fold way” (20–23) that Sextus offers us as guides for life—the directives of nature, feelings, custom, and expertise—Ribeiro still thinks we will inevitably fall back into belief. He concludes that the original Pyrrhonists should be read aspirationally: insofar as we develop our capacities [End Page 517] to argue on both sides of every question and thus are able to suspend judgment, to that extent we will achieve tranquility. In the case of Montaigne, Ribeiro focuses on his Christian fideism. Once he recognizes the incapacity of reason to resolve intellectual problems, he falls back on faith. And Ribeiro argues that the Catholic flavor of this faith is simply a reflection of Montaigne’s surroundings. In a different community, he could just as easily have embraced a different faith. The heart of the book concerns Hume, whom Ribeiro discusses in three chapters, as opposed to the one each devoted to Sextus and Montaigne. In keeping with his interpretive preferences, Ribeiro’s Hume is a radical skeptic, though he acknowledges the significant yet “utterly perplexing” (95n22) naturalist strains that are also present. Ribeiro takes the resulting tension to be insoluble (98), though I was not convinced. Consider that, in both the Treatise and the Enquiry, Hume uses causal reasoning to investigate causal reasoning. He learns that our ideas are caused by prior impressions; that repeated experience of conjoint events causes us to associate our ideas of similar events; and so on. In the Treatise, he concludes the argument that association is at the root of such causal reasoning by presenting a set of rules, a “logic,” for it. The argument is not as such skeptical, though when Hume “recasts” it in the first Enquiry, he does so in terms of “sceptical doubts” and a “sceptical solution.” In the Treatise, “total” and “extravagant” skepticism come into play only as “systems of philosophy” that Hume uses to shed light on his own core commitments. The problem, I think, is that Ribeiro tends to read Hume a little too literally, as if he is himself falling prey to the skeptical upheaval of the conclusion to the first book of the Treatise, or the final section of the first Enquiry. But I would suggest that Hume is rather deploying the rhetoric of skepticism in these discussions, using it for his ultimate philosophical ends (a point that is especially clear in Ribeiro’s favorite of Hume’s works, the Dialogues). He is showing his reader how his naturalistic philosophical project is itself rooted in human nature, and thus does not yield insight into the intrinsic structure of... (shrink)

The best representatives of the self-reflection of xinxue 心学 (the School of Mind) and its development during the Ming and Qing Dynasties are the three masters from the late Ming Dynasty. The overall tendency is to shake off the internal constraints of the School of Mind by studying the Confucian classics and history. During the Qing Dynasty, Dai Zhen had attempted to set up a theoretical system based on Confucian classics and history, offering a theoretical foundation for a new academic (...) movement that gradually suspended issues studied by the School of Mind. But the suspension of these issues does not mean they were resolved. For Peng Shaosheng, xinzong 心宗 (the Doctrine of Mind) has emerged from a bottleneck in the development of the Confucian yi li zhi xue 义理之学 (doctrine of meanings and principles): The only way to find the transcendent connection between the doctrine of meanings and principles and the Dao was through the internality of belief. In this case, the Lay Buddhists, represented by Peng Shaosheng, Wang Dashen and Luo Yougao, as lixue biepai 理学别派 (Alternative School of Principles), played the role that the School of Mind had undertaken in the late Ming Dynasty, thus becoming a shelter for the Confucian doctrine of meanings and principles. To a certain extent, the revival of weishixue 唯识学 (the Consciousness-Only School) during modern times was simply a continuance of the “Alternative School of Principles”. It took over the Lay Buddhist theme of the doctrine of meanings and principles of the Qing Dynasty and tried to construct a new pattern of learning for Confucian classics that matched up with the doctrine of meanings and principles, offering a model of integration for the reconstruction of the Confucian tradition. John Locke’s views on the nature of freedom of action and freedom of will have played an influential role in the philosophy of action and in moral psychology. Locke offers distinctive accounts of action and forbearance, of will and willing, of voluntary (as opposed to involuntary) actions and forbearances, and of freedom (as opposed to necessity). These positions lead him to dismiss the traditional question of free will as absurd, but also raise new questions, such as whether we are (or (...) can be) free in respect of willing and whether we are free to will what we will, questions to which he gives divergent answers. Locke also discusses the (much misunderstood) question of what determines the will, providing one answer to it at one time, and then changing his mind upon consideration of some constructive criticism proposed by his friend, William Molyneux. In conjunction with this change of mind, Locke introduces a new doctrine (concerning the ability to suspend the fulfillment of one’s desires) that has caused much consternation among his interpreters, in part because it threatens incoherence. In these dialogues Plato speaks of the soul sometimes as wholly rational, as having three parts, and so forth. But in these dialogues he is t~lklng of the human soul, which is a special (...) case, whereas in this essay I am de~Hng with the wider role and the concept of the soul as the efficient cause of motion, change, and all becoming everywhere in the cosmos. My cardinal texts in this exposition are the Sophist (246a-249d), the Phaedrus (245c, d), and a considerable portion of Laws, X. Consider the Phaedo, a dialogue with at least four motifs: it is a dramatic evocation of the last day in the life of Socrates, it is an argument for the immortality of the soul and for the reality of the world of ideas, it is a myth of the nether world, and finally, it is a theory of the cosmos as ruled by purpose--all in all, one of the great pieces of literature of the Western world. For the reader, it is an evocation of an attitude to life, based on Plato's conception of the soul--an attitude expressed in the famous phrase that the wise man spends his life meditating on death. As contrasted with what may be called his existential concern with the soul, in the other dialogues on which I will comment, Plato approaches the topic of the soul as part of his explanation of the cosmos. In these his attitude is objective and quasi-scientific. It is to this side of Plato's thought that I wish to call attention in this essay, where the establishment of the immortality of the soul is incidental to the more basic doctrine that the soul is an arche, a primary factor and an ontological principle. In the,Sophist, we find Plato playing the music of his philosophy in a new key. He refers to the "friends of the forms" as though he, himself, were an outsider looking in; then, too, he asserts that motion is really real in contrast to his derogatory references to motion in the Cratylus, the Phaedo, and the Republic.I In these (and other) dialogues, Plato contrasts change and changing things with the timeless forms in respect of reality: the former are said, at best, to be semi-real; only the latter are really real. But in the Sophist he changes his tune, arguing that total reality (~o ~v, to' ~a~rE~ By) includes both motion and rest (248e 8; 249d 3-4). What does he mean by these two words? That by 'rest' he means the realm of ideas is indicated (if not proved) by his references to the forms in the same context (247b 1But in the Theaeteius,he classifiesmotions in a semi-scientific fashion, leaving the impression on the reader that he regards motion as a reality. What is more to the point is Plato's insistence that motion and what is moved are onta (beings, 249b 2, d 3). Plato uses change (metabol$) interchangeably with kinesis; anticipating the Phaedrus, I will include activity under change. This article analyzes the origins of the “responsible corporate officer” doctrine: the trial of Joseph Dotterweich. That doctrine holds that an officer may be personally liable for the criminal act of a subordinate if the officer was, in some indefinite way, able to prevent the violation. Applying this doctrine, the prosecution of Dotterweich entailed strict liability for a strict liability offense. The underlying offenses—the interstate sale of one misbranded and adulterated drug and one misbranded drug—were said to (...) be strict liability offenses. And then, with respect to Dotterweich as the corporation’s general manager, the government argued that he was strictly liable because he stood in “responsible relation” to the company’s acts. The government never tried to prove that the company, Buffalo Pharmacal, was negligent, nor did it try to prove that Dotterweich was negligent in his supervision of the employees of Buffalo Pharmacal. The prosecutor and judge were candid about this theory throughout the trial, although the judge conceded that it seemed bizarre and unfair. The defense lawyer repeatedly sought to inject what became known throughout the trial as the “question of good faith,” but was circumvented at almost every turn. What would thus seem to be the crux of any criminal trial—the personal fault of the defendant—was carefully shorn from the jury’s consideration. The government’s theory was so at odds with intuitive notions of liability and blame that, as one probes into the case, and looks at the language used in the government’s appellate briefs, imputations of moral fault inevitably crept in. Yet the government was not entitled to make such accusations, as it had pruned moral considerations from the trial. The article argues that the responsible corporate officer doctrine can never enjoy a secure place in our legal system. First, the doctrine is at a minimum in tension with, and often in direct opposition to, basic principles of the criminal law; and second, the doctrine fails, when followed to its logical conclusions, to accord with basic notions of fair play. The article concludes that the responsible corporate officer doctrine is either unnecessary, in cases in which the evidence establishes personal fault, or unjust, in cases in which it creates liability in the absence of personal fault through the unspecified notion of “responsibility.” The Dotterweich case illustrates what is contemplated by the latter possibility, and why it is problematic in any judicial system that purports, in the words of the Model Penal Code, “to safeguard conduct that is without fault from condemnation as criminal.”. The Doctrine of Double Effect has been challenged by the claim that what an agent intends as a means may be limited to those effects that are precisely characterized by the descriptions under which the agent believes that they are minimally causally necessary for the production of other effects that the agent seeks to bring about. If based on so narrow a conception of an intended means, the traditional Doctrine of Double Effect becomes limitlessly permissive. In this paper (...) I examine and criticize Warren Quinn's attempt to reformulate the Doctrine in such a way that it retains its force and plausibility even if we accept the narrow conception of an intended means. Building on Quinn's insights, I conclude by offering a further version of the Doctrine that retains the virtues of Quinn's account but avoids the objections to it. I The key element in the Doctrine of Double Effect (DDE) is the claim that there is a stronger presumption against action that has harm to the innocent as an intended effect than there is against otherwise comparable action that causes the same amount of harm to the innocent as a foreseen but unintended effect. Since it is relatively uncontroversial that, except perhaps in cases involving desert, it is wrong to cause harm as an end in itself, the DDE is normally invoked to distinguish morally between harm that is intended as a means and harm that is considered a merely foreseen side-effect.
