In this essay we explain some of the problems of the Venezuelan criminal justice sub-system and, in general, the criminal law enforcement. That is to say, that which is expressed in the persecutory actions of the investigating authorities and the criminal courts, after having established in Venezuela a Carl Schmitt concept of Dual State with the purpose of eliminating “bourgeois” democracy and implanting the model of so-called Socialism of the XXI Century. In this sense, it is a question of (...) identifying the flagrant persecution and violation of human rights of those who do not have the capacity to resist the attacks emanating from the State in the abusive use of coercion and legal violence. With the Dual State want to impose an utopia by force, which leads to dystopia, due to the division and polarization of society with the dichotomous politics of friend-enemy, In a process of etiquette and "demonization" of the enemy. Socialism is dead and Christianity, at least in the modern West, is not feeling too good either. What remains of the substantive goals, ethics, and ideals of socialism in an epoch of political defeat and in the aftermath of a century of tragic experiments? Are ‘still existing’ socialists simply nostalgic, seeking consolation in an opiate of lost dreams, or are there fragments of ideas and policies that constitute a still living politics of hope for humanity? Christian socialism is one (...) class='Hi'>socialist tradition well-suited to address these meta-questions of faith, meaning and goal, not least because it has no unitary political ideology, party or even movement. It is argued here that Christian socialism’s best legacy and use-value today is in its historic failure to be anything other than a modest discourse and practice of a social ethic of free association, political pluralism and a gift economy. To these ends, I use a case study of a clash between two rival versions of contemporary Christian socialism. I then explicate the more difficult and radical version to be found in the work of its leading representative. I outline Milbank’s arguments for Christian socialism as a counter ontology to the secular politics of the modern nation state, an alternative complex space that conceives of community as ‘nomadic city’, and a free market economy based on the poetic practice of gift-giving. This is an agenda, a discourse and a poetic practice bound to failure. Therein is its use value to socialism. (shrink)

In the history of Brazilian education, it is only since the 1980s, during the redemocratization of Brazil, that proposals for public education in a socialist perspective have been presented. The past two decades have been marked by a growing interest in Gramscian thought, mainly in the educational field, making possible the elaboration of proposals for public school organization in Brazil. However, intellectuals and pedagogues in Brazil have confused the Gramscian ‘unitary school’ with what is known in Brazil as (...) the ‘polytechnical school’, a vague idea of education which is attributed to Marx and taken up by Lenin in the course of the Soviet Revolution. The two conceptions of education differ because of the varying historical contexts in which Marx, Lenin and Gramsci lived and developed their thinking on the roles of State and school. These fundamental differences have been overlooked during the diffusion of Gramscian thought in Brazil, causing confusion in the understanding of the ‘unitary school’ and the ‘polytechnical school’. The State reform is at the root of a deep mutation of institutions in Wallonia. Indeed, the regionalist trend has increased. With this renunciation of the French speakers from Brussels, the two political parties, FDF and PRL, have decided to join their efforts in order to safeguard their interests. A lot of Walloons get worried about federal Belgium Kingdom. Being anxious to demonstrate their attachment to Belgium, they organize a unitary demonstration and thus show their affection to late (...) King Baudouin, symbol of national unity. 1993 is also theyear of "juridical affairs". With the investigations about the murder of André Cools, some socialist politicians are harassed. Misappropriation of stolen securities, corruption, murder are the headlines in the newspaper almost wholeyear. From an economic point ofview, the province of Hainaut region highly reached by the economic crisis gets some help from the European Community being called "Objective I Europe". The article discusses the immediate post-war persistence and subsequent rejection of eugenics in East-Central European socialist states, exploring the case of premarital medical certificates. Building our analysis on published and archival sources, we show that immediately after the war, policies formulated at the governmental level were informed by eugenic ideas in medical expertise. Premarital medical certificates were aimed at combatting contagious diseases and thus securing a healthy population. Their legal status varied: in Poland, they were formally introduced; in the (...) Soviet Occupied Zone and East Germany, Nazi law was abolished, but local officials still advocated for the introduction of certificates; and in Czechoslovakia, medical certificates were planned but not introduced. Despite these differences, after a short period between 1949 and 1950, the attempts to put a measure into practice ended in all three countries. We argue that the communist takeover and consolidation of power played a decisive role. After 1950, premarital medical certificates were not discussed again in Czechoslovakia or East Germany; in Poland, the debate re-emerged in 1959–60 during political liberalization. (shrink)

The Confucian doctrine of _tianxia_ outlines a unitary worldview that cherishes global justice and transcends social, geographic, and political divides. For contemporary scholars, it has held myriad meanings, from the articulation of a cultural imaginary and political strategy to a moralistic commitment and a cosmological vision. The contributors to _Chinese Visions of World Order_ examine the evolution of tianxia's meaning and practice in the Han dynasty and its mutations in modern times. They attend to its varied interpretations, its relation (...) to realpolitik, and its revival in twenty-first-century China. They also investigate tianxia's birth in antiquity and its role in empire building, invoke its cultural universalism as a new global imagination for the contemporary world, analyze its resonance and affinity with cosmopolitanism in East-West cultural relations, discover its persistence in China's socialist internationalism and third world agenda, and critique its deployment as an official state ideology. Like all my generation at Oxford, in the far-away years of the turn of the century, I received my first introduction to the Philosophical Theory of the State through the reading of Plato’s Republic. There followed Aristotle, Hobbes, Locke, Rousseau, Hegel, Bosanquet— with a disapproving glance at Mill and Spencer. Alongside this survey of widely varying theories there ran a lively interest in the politics of the day under a “democratic,” i.e. parliamentary, system of government, with much experience of (...) “democratic” methods in the running of various college and university societies, the officials of which were elected by the members, and the actions of which were determined, after discussion, by majority vote. Founded on the mode of « coordination », the struggle of the « intermittents et précaires » of the Greater Paris area is a genuine laboratory which has the means to bring to light the invalidation of the political schema stemming front the socialist and communist tradition. Where the latter insists on a logic of contradiction, of the political representation of an injustice which stages remarkable identities, the political form of « coordination » is resolutely expressive, transformist, and attentive (...) to the unstable dynamics of post-identity identities which weave together the reality of our world. Coordination does not aim at the constitution of a unitary collective which seeks to guarantee the equality of its members at any cost, but rather, at the emergence and « becoming » of singularities which it brings together in an unstable rmtltiplicity, a network, a form always close to the patchwork - exceeding any theoretical definition, but also any appropriation by union forces or State representations. A politics of experimentation which dismisses prior forms of knowledge and opens itself up to the unknown, without which no new form of life is imaginable. (shrink)

The orthodox presentation of quantum theory often includes statements on state preparation and measurements without mentioning how these processes can be achieved. The often quoted projection postulate is regarded by many as problematical. This paper presents a systematic framework for state preparation and measurement. Within the existing Hilbert space formulation of quantum mechanics for spinless particles we show that it is possible (1)to prepare an arbitrary state and (2)to reduce all quantum measurements to local position measurements in (...) an asymptotic way by unitary evolution processes without recourse to the projection postulate. A generalization to spin-1/2particles is also given. The theory presented provides a general mathematical and theoretical foundation for many practical schemes for state preparation and measurement. This paper aims to analyze the social structure of the society in Teutonic state (1226-1525), which was distinct from structure of estate societies. The author put hypothesis that Teutonic Knight monopolised in their state political, economical and spiritual power. In the light of this thesis certain trends from history of the state of Teutonic Order are explained.

The question of the nature and regularities of development of the socialist state is quite urgent at present, because identification and application of the objective laws of development of the socialist state will facilitate successful solution of practical problems of governmental, economic, and sociocultural construction and make possible a deep and comprehensive analysis of the course of evolution of statehood in the modern world. This is the first of two papers responding to ‘recent’ commentary on various aspects of hyperplane dependence by several authors. In this paper I focus on the issues of the relations of HD to state reduction and unitary evolution. The authors who’s comments I address here are Maudlin and Myrvold. In the second paper of this set I focus on HD dynamical variables and localizable properties and measurements and address comments of de Koning, Halvorson, Clifton and Wallace. Each (...) paper ends with some reflections on the implications of HD for the ontology of Minkowski space-time. To set the stage for my responses, I begin this paper with some general position statements designed to correct what seem to be widespread and erroneous construals of some of my views. Two central points are argued for in this first paper. First, dynamical evolution occurs not only within foliations of Minkowski space-time. Rather the transition from the physical state of affairs on any one hyperplane to any other, whether the hyperplanes intersect or are parallel, is always an instance of dynamical evolution between them, generated by some active combination of boost-like transformations and/or time-like translations and/or state reductions and ‘reconstructions’. This point gives rise to a generalized conception of a history of dynamical evolution, allowing for the use of parameterized families of hyperplanes that multiply cover some portions of space-time. Nevertheless, and this is the second central point, for any two generalized histories, H and H’, the quantum states for a system on all the hyperplanes of H from the asymptotic past up to some hyperplane, h, determine the quantum states for the system on all the hyperplanes of H’ from the asymptotic past up to any hyperplane, h’, such that h’ lies to the past of all those state reduction regions that lie to the future of all hyperplanes of H that are ‘earlier’ than h. Consideration of these results should defuse concerns that have been voiced about the coherence and consistency of HD. The paper outlines the debate on European state socialism as a social and political order. There are different attempts to obtain a better understanding of the core principles of this type of society and a continuing public debate on it. Following the end of the decade of the transition from “socialism to capitalism” we can observe a renewal in the debates on the “Ancient regime” and its heritage. There are different reasons for this phenomenon; these include new insights from (...) the archives and the recent politics on history in post-socialist societies. The new “zeitgeist” following the world financial crisis of 2008 might be an additional reason. The issues that developed are discussions on the nature of state socialism, some hypotheses on the role of reformers within the changes to late socialism from the perspective of political science, and some assumptions on the methods adopted by former reform socialists after 1989. This paper investigates various properties that may by possessed by quantum states, which are believed to be specifically “quantum” and their opposites. It also considers their “absolute” counterparts in the following sense: a given state has a given property absolutely if after an arbitrary unitary transformation it still possesses it. The known relations between the listed properties and between their absolute counterparts are summarized. It is proven that the only two-qubit state that has zero quantum discord absolutely (...) is the maximally mixed state. Finally, related conceptual issues concerning the terms “classical” and “quantum” are discussed. (shrink)

This article was developed from a paper given at an international conference on the influence of Malthus, held in Paris in January 1980; its purpose was to suggest the way in which the U.S. experience of Malthusianism and neo-Malthusianism was profoundly different from that in Europe . Thus the points made here were chosen specifically to hightlight the U.S.-European contrasts. The paper draws on materials and arguments in numerous articles and a book on the subject by myself. In 1975, a delegation of U.S. entomologists traveled to socialist China to observe Chinese insect control science. Their overwhelmingly positive reports highlighted in relief the pernicious effects of pesticide corporations on U.S. agriculture; some entomologists hoped this would goad the United States to catch up to China in environmentally sensible insect control practices. Of course, insect control in socialist China carried its own political baggage, some of which—for example, mass mobilization and self-reliance—the state made highly visible to (...) visitors, and some of which—for example, harsh treatment of scientists—it sought to obscure. For both the U.S. and the Chinese participants, the act of comparison itself was of primary significance in the exchange, allowing them to construct socialist Chinese science as refreshingly different from U.S. science. At the same time, however, this construction of difference meant forgetting the much longer transnational history in which U.S. and Chinese entomology had been intertwined. (shrink)

Contrary to the accepted Cold War stereotypes about state socialist mass women’s organizations, we will show that Communist leaders were attentive to the construction of gender roles and used women’s magazines as a forum to discuss openly the changing ideals of masculinity and femininity. Through a discourse analysis of articles in Vlasta and Zhenata Dnes, our article will interrogate the categories of “man” and “woman” and their negotiation during the Communist era on the pages of official state (...) magazines. In the Bulgarian case, we will discuss key articles that explicitly dealt with the importance of fathers and fatherhood, as for the case of Czechoslovakia, we will examine a series of articles and letters in which women’s union leaders and ordinary citizens discuss women’s entry into the workforce that had previously been the purview of men. Malgorzata Fidelis in her bookWomen, Communism, and Industrialization in Postwar Polandsets out to examine gender policies during Stalinism and their transformation under the subsequent ‘Polish road to socialism’. She shows that the relative political liberalisation in the late 1950s was also accompanied by the abandonment of policies favouring women and the return to conservative prewar gender hierarchies. The essay finds that the book is a valuable contribution to the understanding of the vicissitudes of gender struggle during Communism in Poland. It (...) also makes a contribution to the understanding of how the principles declared by the Communist Party were modified in response not only to economic necessities but also to local cultures and popular struggles. In this way it sheds light on the process of the legitimation of the Communist regime in Poland and beyond by accommodating demands from below. (shrink)

Social life is changing very fast. People are trying to find out reasons of living in a safe society and understand their role in it. The ‘wrong’ and ‘right‘ models of the social life, state and law systems are appearing. In the XXth century, one of them – socialism – made suggestion how to solve social problems, determinated of capitalism. This work deals with the situation of Lithuanian social thought in the Republic of Lithuania (1900-1940). In the article, the (...) standpoint of catholics of socialism is reflected. Catholics displayed socialism as a system, which accumulated many distorted images about human nature, motivations of human behavior, society and its functionating. Considering the society being an organic totality of individuals, but not a faceless mass, and an individual being a personality having natural rights to be respected, but not considered as a little screw without any rights in the state machine, with whom any experiments may be performed, they disclosed Utopia of the idea, proposed by socialists, of the possibility of a perfect society creation by the only preliminarily arranged correct plan,. For this purpose to be achieved, they constructed a model of socialist economy and then destroyed it, demonstrating economical unefficiency of this system. In this manner, intellectuals warned Lithuania and its people about the destructiveness of the realization of such an experiment. In spite of criticism of socialism, some intellectuals, such as A. Maceina, S. Šultė and S. Šalkauskis, appeared to be rather respective to the new social ideas and did not distinguish any social economic system as the best and only one. They thought that all the world, including Lithuania, has to create a new social life and take as a base the progressive ideas of socialism and capitalism. According to the opinion of the catholics, the most reliable way to a safe sočiety and economical welfare passes through the cooperation of individuals and state’s duty to create right laws. Ideological spirit was the main obstacle for the intellectuals to recognize trends of socialism by their aims and methods. That is the reason, why socialism was identified as bolsevism. However, the expression of the intellectuals’ opinion about socialism, its ideological herritage and perspectives enriches the research of the Lithuanian legal phylosophical and political thought and allows to understand better the ideological development of socialism and to define its competence and limits of validity in the contemporary world. Valuable ideas may be fruitfully used in creating a democratic society, social state and the rule of law. (shrink)
