This book identifies the criteria for successful constitutions in both theory and practice using the research and methodology of Vincent Ostrom.

Although it is commonplace for political scientists to draw upon historical thinkers and the ‘great books’ of the past, the practice of using historical works as reference points for contemporary issues remains under-investigated. To address this practice, this article is positioned at the crossroads of social science and intellectual history. By examining the relationship of political economists Elinor and Vincent Ostrom with Alexis de Tocqueville, the article demonstrates some of the potential risks incurred by social scientists drawing on (...) historical thinkers. After exploring the similarities between the Ostroms and Tocqueville, it identifies three key pitfalls of the Ostroms’ ‘Tocquevillian’ rhetoric. These pitfalls result in obscuring meaning and overlooking philosophical insights, both of which detract from the Ostroms’ project. Insights from the field of intellectual history are offered. A final section presents a key example of Vincent Ostrom overlooking Tocqueville's thought where Tocqueville's insights were directly applicable to his work. The article parses political science's relationship with the past and offers a critique that is applicable beyond Tocqueville and the Ostroms. (shrink)

Liberalism offers communities an eclectic set of core values and diverse institutions that may improve the chances that people with varying beliefs and life goals can live and work together in relative peace and prosperity. Yet liberal democracy is under threat, once again. Anti-liberal populists on the right and radicals on the left both dismiss core civil and political rights, but for different reasons: unrealistic expectations for moral consensus or equality of outcomes, respectively. Similarly, too many self-described liberals act illiberally, (...) allowing their enthusiasm for a particular cause to justify sacrificing other core values. Recent studies have shown that self‐explanation is an effective metacognitive strategy, but how can it be leveraged to improve students' learning in actual classrooms? How do instructional treatments that emphasizes self‐explanation affect students' learning, as compared to other instructional treatments? We investigated whether self‐explanation can be scaffolded effectively in a classroom environment using a Cognitive Tutor, which is intelligent instructional software that supports guided learning by doing. In two classroom experiments, we found that students who explained their steps during problem‐solving (...) practice with a Cognitive Tutor learned with greater understanding compared to students who did not explain steps. The explainers better explained their solutions steps and were more successful on transfer problems. We interpret these results as follows: By engaging in explanation, students acquired better‐integrated visual and verbal declarative knowledge and acquired less shallow procedural knowledge. The research demonstrates that the benefits of self‐explanation can be achieved in a relatively simple computer‐based approach that scales well for classroom use. (shrink)

When engaging with magic, we are moved by seemingly impossible events that contradict what we believe to be possible in the real world. We are surprised, curious, and baffled when we cannot explain how the magic we are witnessing is possible. We generally understand the events to be illusions. But how is it possible to be moved by something we know to be unreal? This problem is related to the paradox of fiction in aesthetics. Here, we introduce the problem in (...) the domain of theatrical magic, discuss possible solutions, and present a tentative account that allows us to accommodate inconsistent, seemingly incompatible beliefs at different representational levels in the viewers’ mind. In this paper, I present a discrete solution for the paradox of Achilles and the tortoise. I argue that Achilles overtakes the tortoise after a finite number of steps of Zeno’s argument if time is represented as discrete. I then answer two objections that could be made against this solution. First, I argue that the discrete solution is not an ad hoc solution. Je propose d’analyser une pratique de la recherche en mathématiques constructives, celle qui consiste à reformuler constructivement les théories physiques. Je discute plus précisément trois aspects de cette pratique. Je montre d’abord que celle-ci a la particularité d’être motivée par des considérations philosophiques et comment la physique est utilisée pour arbitrer un débat de philosophie des mathématiques entre constructivisme et classicisme. Ensuite, j’identifie la méthodologie de la recherche en mathématiques que cette pratique implique et montre qu’il s’agit, selon une terminologie (...) empruntée à Poincaré, d’une méthodologie de « logiciens ». Enfin, je montre que dans cette pratique, les théories physiques ont un rôle heuristique sur le développement des mathématiques constructives. Elles permettent avec succès de stimuler la recherche d’énoncés constructifs et d’orienter la recherche en mathématiques constructives vers de nouveaux domaines. (shrink)

Abstract.We use a model theoretic approach to investigate properties of local-global principles for positive primitive formulas in spaces of orderings, such as the existence of bounds and the axiomatizability of local-global principles. As a consequence we obtain various classes of special groups satisfying local-global principles for all positive primitive formulas, and we show that local-global principles are preserved by some natural constructions in special groups.

Direct brain intervention based mental capacity restoration techniques-for instance, psycho-active drugs-are sometimes used in criminal cases to promote the aims of justice. For instance, they might be used to restore a person's competence to stand trial in order to assess the degree of their responsibility for what they did, or to restore their competence for punishment so that we can hold them responsible for it. Some also suggest that such interventions might be used for therapy or reform in criminal legal (...) contexts-i.e. to make non-responsible and irresponsible people more responsible. However, I argue that such interventions may at least sometimes fail to promote these responsibility-related legal aims. This is because responsibility hinges on other factors than just what mental capacities a person has-in particular, it also hinges on such things as authenticity, personal identity, and mental capacity ownership-and some ways of restoring mental capacity may adversely affect these other factors. Put one way, my claim is that what might suffice for the restoration of competence need not necessarily suffice for the restoration of responsibility, or, put another way, that although responsibility indeed tracks mental capacity it may not always track restored mental capacities. Epistemic logic begins with the recognition that our everyday talk about knowing and believing has some systematic features that we can track and re‡ect upon. Epistemic logicians have studied and extended these glints of systematic structure in fascinating and important ways since the early 1960s. However, for one reason or another, mainstream epistemologists have shown little interest. It is striking to contrast the marginal role of epistemic logic in contemporary epistemology with the centrality of modal logic for metaphysicians. This article (...) is intended to help in correcting this oversight by presenting some important developments in epistemic logic and suggesting ways to understand their applicability to traditional epistemological problems. Obviously, by itself, tweaking the formal apparatus of epistemic logic does not solve traditional epistemological problems. Epistemic logic can help us to navigate through problems in a systematic fashion by unpacking the logic of the problematic concepts, it can also lead us to recognize problems that we had not anticipated. This is basically analogous to the role that modal logic has played in contemporary metaphysics. (shrink)

The way in which we characterize the structural and functional differences between psychopath and normal brains – either as biological disorders or as mere biological differences – can influence our judgments about psychopaths’ responsibility for criminal misconduct. However, Marga Reimer (Neuroethics 1(2):14, 2008) points out that whether our characterization of these differences should be allowed to affect our judgments in this manner “is a difficult and important question that really needs to be addressed before policies regarding responsibility... can be implemented (...) with any confidence”. This paper is an attempt to address Reimer’s difficult and important question; I argue that irrespective of which of these two characterizations is chosen, our judgments about psychopaths’ responsibility should not be affected, because responsibility hinges not on whether a particular difference is (referred to as) a disorder or not, but on how that difference affects the mental capacities required for moral agency. It has become a truism that we live in so-called information societies where new information technologies have made information abundant. At the same time, information science has made us aware of many phenomena tied to the way we process information. This article explores a series of socio-epistemic information phenomena resulting from processes that track truth imperfectly: pluralistic ignorance, informational cascades, and belief polarization. It then couples these phenomena with the hypothesis that modern information technologies may lead to their amplification so (...) as to give rise to what are called “infostorms.” This points to the need for studying further the exact relations between information technologies and such infostorms, as well as the ways we may design technologies to avoid being misled away from what we have good reasons to believe. In this article, we reflect critically on how moral actions are categorised in some recent studies on moral spillovers. Based on classic concepts from moral philosophy, we present a framework to categorise moral actions. We argue that with a finer classification of moral values, associated behaviour is better understood, and this understanding helps to identify the conditions under which moral licensing takes place. We illustrate our argument with examples from the literature on pro-environmental behaviours. Moral spillovers are frequently studied in (...) this behavioural domain and to understand what causes their occurrence is highly (policy) relevant if we wish to promote sustainable behaviour. In this paper, we study VC-minimal theories and explore related concepts. We first define the notion of convex orderablity and show that this lies strictly between VC-minimality and dp-minimality. To do this we prove a general result about set systems with independence dimension ≤ 1. Next, we define the notion of weak VC-minimality, show it lies strictly between VC-minimality and dependence, and show that all unstable weakly VC-minimal theories interpret an infinite linear order. Supranational governance is being challenged by politicians and citizens around the EU as over-centralized and undemocratic. This book is premised on the idea that polycentric governance, developed by Vincent and Elinor Ostrom, is a fruitful place to start for addressing this challenge. Assessing the presence of, and potential for, polycentric governance within the EU means approaching established principles and practices from a new perspective. While the debate on these issues is rich, longstanding and interdisciplinary, it has proven difficult (...) to sidestep the 'renationalisation/federalisation' dichotomy. The aim of this volume is not to reject the EU's institutional structure but provide a different benchmark for the assessment of its functioning. Polycentric theory highlights the importance of multilevel horizontal relationships within the EU - between states, but also between many sub-state actors, all the way down to individuals. Abstract: Pluralistic ignorance is a nasty informational phenomenon widely studied in social psychology and theoretical economics. It revolves around conditions under which it is "legitimate" for everyone to remain ignorant. In formal epistemology there is enough machinery to model and resolve situations in which pluralistic ignorance may arise. Here is a simple first stab at recovering from pluralistic ignorance by means of knowledge transmissibility.

In this paper, we show that VC-minimal ordered fields are real closed. We introduce a notion, strictly between convexly orderable and dp-minimal, that we call dp-small, and show that this is enough to characterize many algebraic theories. For example, dp-small ordered groups are abelian divisible and dp-small ordered fields are real closed.

In philosophical studies regarding mathematical models of dynamical systems, instability due to sensitive dependence on initial conditions, on the one side, and instability due to sensitive dependence on model structure, on the other, have by now been extensively discussed. Yet there is a third kind of instability, which by contrast has thus far been rather overlooked, that is also a challenge for model predictions about dynamical systems. This is the numerical instability due to the employment of numerical methods involving a (...) discretization process, where discretization is required to solve the differential equations of dynamical systems on a computer. We argue that the criteria for numerical stability, as usually provided by numerical analysis textbooks, are insufficient, and, after mentioning the promising development of backward analysis, we discuss to what extent, in practice, numerical instability can be controlled or avoided. The so-called daxue zhi dao 大學之道, though a Confucian way of self-cultivation, can inspire contemporary universities through a process of creative interpretation. Having examined the ethos of modern university in its four historical stages, I come up with its last stage of reaching out in the era of globalization and dialogue among civilizations, in which we have to rethink the idea of university from the fuller development of human reason. This can be achieved only through increasingly reaching out toward many (...) others by means of mutual waitui 外推 and self-reflection, which presuppose and announce an ethics of generosity in priority over and implementable by reciprocity. Universities today should learn from classical Confucianism, and we should keep in mind their initial generous spirit as exemplified by Confucius himself. Strangification and self-reflection, being moved by original generosity and implemented by reciprocity, will eventually bring us the hope of reason. (shrink)

The religious question in China is not limited to the contemporary tensions between the Catholic and Protestant churches and the Beijing regime, the repression suffered by Tibetan Buddhists or Uighur Muslims and the problems associated with so-called ‘sectarian’ movements. Though these issues are very important and worthy of interest in themselves, they have to be understood in a wider context which takes in the totality of religious realities in China, including those we in the West do not see because they (...) fall outside our representations of what is religious. Furthermore, the contemporary religious question assumes meaning only if we consider all the struggles between the Chinese state and society's religious structures since the end of the 19 th century. In another publication I have sketched out the modern history of relations between the Chinese state and the religious structures of the society. Here I should like to show the importance of the concept of religion itself and of the controversies around it in the history of those conflicting relations. We shall see that the concepts, such as religion, used in the humanities and social sciences have consequences that go far beyond the context of academic debates and can help to feed repression and social conflict. The issue of the subjection of women sheds a new light on the nature of this disagreement. Firstly, I will show how the role Comte ascribed to the consideration of biological factors in sociological explanations is inconsistent with the received view according to which he is to be regarded as the founding father of an autonomous sociology. Examining nationalism in two ways, this study first draws out the ideological connections and associations of nationalism by analyzing its relationship to a series of key political concepts, theories and practices: sovereignty, the nation state, citizenship, liberal theory, patriotism, communitarianism, multiculturalism and cosmopolitanism.
