The Old Testament cannot pin God down to a single soteriologe ; it can only speak of God's saving acts within a whole series of events, and that necessarily involves some kind of verbal exchange between God and man. This latter includes both the cry of man in distress and the response of praise which the saved make to God.

A common view is that ceteris paribus clauses render lawlike statements vacuous, unless such clauses can be explicitly reformulated as antecedents of ?real? laws that face no counterinstances. But such reformulations are rare; and they are not, we argue, to be expected in general. So we defend an alternative sufficient condition for the non-vacuity of ceteris paribus laws: roughly, any counterinstance of the law must be independently explicable, in a sense we make explicit. Ceteris paribus laws will carry (...) a plethora of explanatory commitments; and claims that such commitments are satisfied will be as (dis) confirmable as other empirical claims. (shrink)

This article investigates journalists? attitudes regarding the interface between the craft's commitment to detached observation when covering the news and the perhaps equally compelling drive to assist other human beings in need at the scene of a life?threatening newsworthy incident. Also examined is the journalistic attitude toward the propriety of incorporating relevant ?good Samaritan?; provisions in existing codes of ethics and policy statements as exceptions to the primary goal of detached observation. While journalists generally are in agreement that they have (...) a responsibility to help others in need, these same journalists are reluctant to see provisions codifying this position included in written codes of ethics. It is suggested, however, that a properly written clause outlining appropriate journalist intervention in life?saving acts would be beneficial, and a model provision is proposed. (shrink)

There is renewed scholarly interest in studying the dynamics of constitutional revolutions and the explanations for the rise of constitutional courts around the world. At the same time, there is growing discussion of democratic backsliding and concern that democracies are exhibiting extremism, weakening of opposition forces and constitutional courts, and violations of civil and political rights that are pertinent to vibrant democracies. Scholars try to study both phenomena and understand the relationship between them. Israel is an important case study for (...) both agendas. This Article analyzes the jurisprudence of Aharon Barak, one of the greatest jurists of our time with a worldwide reputation for revolutionizing both Israeli constitutional law and comparative constitutional law. It explains the tactics and strategy used by Barak to revolutionize Israeli constitutional law on issues of reasonableness, proportionality, standing, justiciability, constitutional review, equality, and supra-constitutional law. It reveals how each revolution paved the way for the next. It offers explanations for the effectiveness of these judicially-led revolutions as well as possible bases for their legitimation. Barak was a common law judge and ultimately treated parliamentary sovereignty as a doctrine arising from common law and constrained by common law, though he never quite put it in these terms. The Article concludes with explanations for the political backlash experienced by the current Israeli Supreme Court that some have characterized as democratic backsliding. It argues that the Court contributes to the development of law as part of a dialog and interaction between the different branches of government. As the Court operates within these dynamics, it must understand and take into account the institutional, political, and social environments in which it operates to preserve legitimacy and achieve efficacy. Barak was a strategic player that laid foundations for an expansive judicial power, but his Court was very prudent in utilizing that power. His successors may have contributed unintentionally to the backlash against the Court by following Barak’s substantive jurisprudence, but not necessarily his prudent tactics and strategy. (shrink)

Can Rawls’s theory provide a framework for assessing obligations to future generations? Extending the veil of ignorance so that participants in the original position do not know to which generation they belong appears to fail in this endeavour. Earlier generations cannot improve their situation by “cooperating” with later generations. Such circumstances, lacking mutuality, leave no room for an agreement or contract. Nevertheless, the original position can be reconstructed so as to model relations of mutuality between generations even if these are (...) absent from the real world. This chapter assesses earlier attempts to do this and provides a rationale for viewing the just savings principle as a clause in the full formulation of the difference principle. (shrink)

In order to know what a belief is, we need to know when it is appropriate to say that two subjects (or the same subject at two different times) believe(s) the same or entertain the same thought. This is not entirely straightforward. Consider for instance1. Tom thinks that he himself is the smartest and Tim believes the same2. In 2001, Bill believed that some action had to be taken to save the rain forest and today he believes the same.What does (...) Tim think? That he, Tim, is the smartest, or that Tom is? And what does Bill believe today? That action had to be taken in 2001 or that it has to be taken now? Both answers are intuitively acceptable. This has to be accounted for somehow.Building on Mark Richard's work on tense, Scott Soames 1 claims that the substitutional interpretation of the quantifiers is unable to account for the intended meaning of such statements as (2) and the validity of some inferences involving them. I will show that his argument is not convincing. Not only does the substitutional interpretation fare no worse than the objectual one, but it seems to be able to avoid a problem which could be seriously damaging for any account of the sameness of thoughts based on the notion of structured proposition. In the first section, I state the problem allegedly raised by tensed belief ascriptions to the substitutional interpretation of the quantifiers. In the second, Soames's argument is shown to be flawed. I also show that the content of the that-clause in (2) is not faithfully represented by any kind of structured proposition. Finally, I show how the substitutional interpretation can handle all such statements as (1) and (2) and the inferences involving them. (shrink)

Jerome Wakefield criticizes my biostatistical analysis of the pathological—as statistically subnormal biological part-functional ability relative to species, sex, and age—for its lack of a harm clause. He first charges me with ignoring two general distinctions: biological versus medical pathology, and disease of a part versus disease of a whole organism. He then offers 10 counterexamples that, he says, are harmless dysfunctions but not medical disorders. Wakefield ends by arguing that we need a harm clause to explain American psychiatry’s 1973 decision (...) to declassify homosexuality. I reply, first, that his two distinctions are philosophic fantasies alien to medical usage, invented only to save his own harmful-dysfunction analysis (HDA) from a host of obvious counterexamples. In any case, they do not coincide with the harmless/harmful distinction. In reality, medicine admits countless chronic diseases that are, contrary to Wakefield, subclinical for most of their course, as well as many kinds of typically harmless skin pathology. As for his 10 counterexamples, no medical source he cites describes them as he does. I argue that none of his examples contradicts the biostatistical analysis: all either are not part-dysfunctions (situs inversus, incompetent sperm, normal-flora infection) or are indeed classified as medical disorders (donated kidney, Typhoid Mary’s carrier status, latent tuberculosis or HIV, cherry angiomas). And if Wakefield’s HDA fits psychiatry, the fact that it does not fit medicine casts doubt on psychiatry’s status as a medical specialty. (shrink)

Much of the literature on "ceteris paribus" laws is based on a misguided egalitarianism about the sciences. For example, it is commonly held that the special sciences are riddled with ceteris paribus laws; from this many commentators conclude that if the special sciences are not to be accorded a second class status, it must be ceteris paribus all the way down to fundamental physics. We argue that the (purported) laws of fundamental physics are not hedged by ceteris paribus clauses (...) and provisos. Furthermore, we show that not only is there no persuasive analysis of the truth conditions for ceteris paribus laws, there is not even an acceptable account of how they are to be saved from triviality or how they are to be melded with standard scientific methodology. Our way out of this unsatisfactory situation to reject the widespread notion that the achievements and the scientific status of the special sciences must be understood in terms of ceteris paribus laws. Given the costs of litigation high-profile court cases about withdrawing life-sustaining medical treatment for seriously ill children in England & Wales tend to be followed by discussion about how to avoid similar cases in future. Whilst two proposals, mediation and replacing the best interests standard with a harm threshold, have received broad attention, a proposal to replace the court by a specialist review committee has not been further investigated. This article analyses the effects of a putative replacement of the courts (...) by a specialist review committee using the process enacted by the futility clauses in the Texas Advance Directives Act (TADA) as a model. Under TADA life-sustaining treatment may legally be withdrawn when a review committee deems it futile and no alternative healthcare provider can be identified. The investigation finds that installing a national review committee with the power to decide whether life-sustaining treatment is futile would have reduced the number of court cases about withdrawal thereof in England & Wales to a handful over the last 3 decades. In addition to shorter procedures and costs savings, a national review committee modelled after TADA would have advantages for both clinicians and parents. Advantages for clinicians are more limited exposure to delivery of clinical care that may cause moral distress and less exposure to adverse press and social media content. Advantages for parents are that the process would establish them as ethical decision makers and offer the possibility of a transfer of the care of the child provided an alternative healthcare provider can be found. As such decisions taken by a specialist review committee may be more acceptable for parents than those of the courts. (shrink)

There has been no shortage of such conceptual analyses and no shortage of counterexamples to all of them. The counterexamples exploit, at least partly, situations in which we are presumed to have clear intuitions about what causes what, but which intuitions are not being respected by the suggested philosophical analysis. The counterexamples typically lead to a battery of sophisticated attempts to revise or amend the philosophical analysis so that it is saved from refutation. These attempts, typically, either deny the intuitions (...) on which the counterexamples are based or accommodate the problematic cases within the theory by adding further clauses to the original philosophical analysis. The result of all this is that where the original philosophical theory rested on a simple, forceful and intuitively plausible idea (e.g., that causation consists in a relation of counterfactual dependence between discrete events), the modified philosophical theory becomes very convoluted, somewhat ad hoc and implausible. The author congratulates Dr Brian Hurwitz, who recently reported the successful “intimidation” of an elderly competent widow into accepting badly needed therapy for a huge ulcerated carcinoma. He reports approvingly of the Israeli Patients' Rights Law, enacted in 1996, which demands detailed informed consent from competent patients before permitting treatment. But the law also provides an escape clause which permits coercing a competent patient into accepting life-saving therapy if an ethics committee feels that if treatment is imposed the patient will (...) give his/her consent retroactively. He suggests this approach as an appropriate middle road between overbearing paternalism and untrammelled autonomy. (shrink)

The etiological account of teleological function is beset by several difficulties, which I propose to solve by grafting onto the etiological theory a subordinated goal-contribution clause. This approach enables us to ascribe neither too many teleofunctions nor too few; to give a unitary, one-clause analysis that works just as well for teleological functions derived from Darwinian evolution, as for those derived from human intention; and finally, to save the etiological theory from falsification, by explaining how, in spite of appearances, the (...) theory can allow for evolutionary function loss. The categorical imperative can be construed as a universalization test for moral permissibility. False negatives of the categorical imperative would be maxims failing this test, despite the permissibility of their actions; maxims like: ‘I’ll withdraw all my savings on April 15th’. Examples of purported false negatives familiar from the literature can be grouped into three general categories, and dispatched by applying category-specific methods for proper formulation of their maxims, or for proper testing. Methods for reformulating failing maxims, such as (...) the addition of appropriate conditional clauses, do not generate false-positive counterexamples in other instances. (shrink)

The metaphysics of miracles put forward in my article, "Miracles: Metaphysics, Physics and Physicalism," above (125-147) are, argues Robert Larmer, both unnecessary and unworkable. Here, I try more clearly to explain that my goal of saving important physicalist intuitions that are incompatible with both the ’open-systems’ and ’exemption’ approaches’ use of powerful ’ceteris paribus’ clauses. I also defend the two mechanisms proposed in the paper from Larmer’s criticisms.

We provide welfarist evaluations of decision rules for federations of states and consider models, under which the interests of people from different states are stochastically dependent. We concentrate on two welfarist standards; they require that the expected utility for the federation be maximized or that the expected utilities for people from different states be equal. We discuss an analytic result that characterizes the decision rule with maximum expected utility, set up a class of models that display interstate dependencies and run (...) simulations for different dependency scenarios in the European Union. We find that, under positive correlations, the welfare distribution tends to be less sensitive to the choice of the decision rule, whereas it can be important under negative correlations. The results that Beisbart and Bovens (SCW 29, p. 581, 2007) have found for two types of models without interstate dependencies are relatively stable. There are exceptions, though, under which the way the welfare distribution is shaped by a decision rule is significantly affected by dependencies. (shrink)

The search for a quantum theory of the gravitational field is one of the great open problems in theoretical physics. This book presents a self-contained discussion of the concepts, methods and applications that can be expected in such a theory. The two main approaches to its construction - the direct quantisation of Einstein's general theory of relativity and string theory - are covered. Whereas the first attempts to construct a viable theory for the gravitational field alone, string theory assumes that (...) a quantum theory of gravity will be achieved only through a unification of all the interactions. However, both employ the general method of quantisation of constrained systems, which is described together with illustrative examples relevant for quantum gravity. There is a detailed presentation of the main approaches employed in quantum general relativity: path-integral quantisation, the background-field method and canonical quantum gravity in the metric, connection and loop formulations. The discussion of string theory centres around its quantum-gravitational aspects and the comparison with quantum general relativity. Physical applications discussed at length include the quantisation of black holes, quantum cosmology, the indications of a discrete structure of spacetime, and the origin of irreversibility. This book will be of interest to researchers and students working in relativity and gravitation, cosmology, quantum field theory and related topics. If cosmology is to obtain knowledge about the whole universe, it faces an underdetermination problem: Alternative space-time models are compatible with our evidence. The problem can be avoided though, if there are good reasons to adopt the Cosmological Principle (CP), because, assuming the principle, one can confine oneself to the small class of homogeneous and isotropic space-time models. The aim of this paper is to ask whether there are good reasons to adopt the Cosmological Principle in order to avoid underdetermination (...) in cosmology. Various strategies to justify the CP are examined. For instance, arguments to the effect that the truth of the CP follows generically from a large set of initial conditions; an inference to the best explanation; and an inductive strategy are assessed. I conclude that a convincing justification of the CP has not yet been established, but this claim is contingent on a number of results that may have to be revised in the future. (shrink)

Based on the mysterious ‘conversations with Dionysus’, which also include the Dionysian Dithyramb „Ariadneʼs Lament“, the paper outlines their enigmatic structure and, on this basis, proposes an interpretive model for Nietzscheʼs labyrinthine texts.

In business ethics journals, Kant’s ethics is often portrayed as overly formalistic, devoid of substantial content, and without regard for the consequences of actions or questions of character. Hence, virtue ethicists ride happily to the rescue, offering to replace or complement Kant’s theory with their own. Before such efforts are undertaken, however, one should recognize that Kant himself wrote a “virtue theory” (Tugendlehre), wherein he discussed the questions of character as well as the teleological nature of human action. Numerous Kant (...) scholars argue that Kant already erected precisely the kind of integrative moral architecture that some of his modern interpreters (while aiming to supersede him) wish to construct. For business ethics, this divergence of scholarly opinion is of crucial importance. It shows first that the standard portrayals of Kant’s ethics in business ethics textbooks—as rigidly deontological, narrowly individualistic, and hence unsuitable for the specific demands of corporate agency—might have to be revised. Second, discussions in the business ethics literature on stakeholder-engagement and managerial decision-making likewise stand to gain from a more nuanced picture of Kant’s moral philosophy. Third, a reassessment of Kant’s ethics with regard to questions of personal character and moral sentiments might also lead to a more favorable view of the relevance of his ethics for managerial practice. Last, but not least, the many current attempts to reconcile Kant’s freedom-oriented philosophy with virtue theories stand to benefit considerably from a better understanding of how Kant himself conceived of one such synthesis between the formal and substantial aspects of morality. This, ultimately, could lead to an important overlapping consensus in the academic literature as to the role and relevance of virtuous conduct in business. (shrink)

As a philosopher, whose theory about economics and business is systematically connected to a moral and political philosophy, Aristotle provides a rich conceptual framework to reflect upon personal wellbeing, the wealth of households, and the welfare of the state. Even though Aristotle has mainly been portrayed as an enemy of business, interest in his teachings has been on the rise among management scholars. Several articles have examined Aristotle's position with regard to current managerial approaches such as total quality management, knowledge (...) management, crisis management, and networking. Even though Aristotle is a constant reference point for business ethics scholars, only rarely have there been attempts to see what consequences his thinking would have for reorienting business philosophy and organizational strategy. In this study, we wiD outline how Aristotle's theory of household management can be applied to the management of modern corporations. We argue that conceptions of chrematistike and oikonomia provide a basis to discuss the relationship between business and society and to draw important conclusions for business management. (shrink)

By generalising methods of Belegradek we classify some stable torsion-free nilpotent groups modulo isomorphism and elementary equivalence.

The nature of attention is one of the oldest and most central problems in psychology. A huge amount of research has been produced on this subject in the last half century, especially on attention in the visual modality, but a general explanation has remained elusive. Many still view attention research as a field that is fundamentally fragmented. This book takes a different perspective and presents a unified theory of visual attention: the TVA model. The TVA model explains the many aspects (...) of visual attention by just two mechanisms for selection of information: filtering and pigeonholing. These mechanisms are described in a set of simple equations, which allow TVA to mathematically model a large number of classical results in the attention literature. Statistical physicists assume a probability distribution over micro-states to explain thermodynamic behavior. The question of this paper is whether these probabilities are part of a best system and can thus be interpreted as Humean chances. I consider two Boltzmannian accounts of the Second Law, viz. a globalist and a localist one. In both cases, the probabilities fail to be chances because they have rivals that are roughly equally good. I conclude with the diagnosis that well-defined micro-probabilities under-estimate the robust character (...) of explanations in statistical physics. (shrink)

Computer simulations are often claimed to be opaque and thus to lack transparency. But what exactly is the opacity of simulations? This paper aims to answer that question by proposing an explication of opacity. Such an explication is needed, I argue, because the pioneering definition of opacity by P. Humphreys and a recent elaboration by Durán and Formanek are too narrow. While it is true that simulations are opaque in that they include too many computations and thus cannot be checked (...) by hand, this doesn’t exhaust what we might want to call the opacity of simulations. I thus make a fresh start with the natural idea that the opacity of a method is its disposition to resist knowledge and understanding. I draw on recent work on understanding and elaborate the idea by a systematic investigation into what type of knowledge and what type of understanding are required if opacity is to be avoided and why the required sort of understanding, in particular, is difficult to achieve. My proposal is that a method is opaque to the degree that it’s difficult for humans to know and to understand why its outcomes arise. This proposal allows for a comparison between different methods regarding opacity. It further refers to a kind of epistemic access that is important in scientific work with simulations. (shrink)

The present paper defends a position advanced in Oetke ) to the effect that a piece of reasoning allegedly advocated by proponents of Indian Materialism does not deserve to be dismissed as a sophism but embodies a significant philosophical criticism. In addition the article argues for the contention that for this type of theoretical assessment consideration of history of reception possesses at best a limited relevance and is even apt to impede the attainment of an adequate evaluation of the matter.

Computer simulations and experiments share many important features. One way of explaining the similarities is to say that computer simulations just are experiments. This claim is quite popular in the literature. The aim of this paper is to argue against the claim and to develop an alternative explanation of why computer simulations resemble experiments. To this purpose, experiment is characterized in terms of an intervention on a system and of the observation of the reaction. Thus, if computer simulations are experiments, (...) either the computer hardware or the target system must be intervened on and observed. I argue against the first option using the non-observation argument, among others. The second option is excluded by e.g. the over-control argument, which stresses epistemological differences between experiments and simulations. To account for the similarities between experiments and computer simulations, I propose to say that computer simulations can model possible experiments and do in fact often do so. (shrink)

The idea of a higher level phenomenon having a downward causal influence on a lower level process or entity has taken a variety of forms. In order to discuss the relation between emergence and downward causation, the specific variety of the thesis of downward causation (DC) must be identified. Based on some ontological theses about inter-level relations, types of causation and the possibility of reduction, three versions of DC are distinguished. Of these, the `Strong' form of DC is held to (...) be in conflict with contemporary science; the `Medium' version of DC may for instance describe thoughts constraining neurophysiological states, while the `Weak' form of DC is physically acceptable but may not in practice be a feasible description of the mind/brain or the cell/molecule relation. All forms have their specific problems, but the Medium and the Weak version seems to be most promising. (shrink)

What role does intelligence play in separating the organic from the inorganic, the living from the inert? Does life evolve along a predestined path, or does it suddenly emerge from what appeared lifeless and programmatic? The utopian energy of the liberal social-democratic state, which is unable to answer the great questions of today's world, is now spent. The way forward will involve a struggle, not against the institutions, but for the emergence of a new rationality, corresponding not only to a new organisation of society, but also to a strategic and multidimensional concept of class.

Should the Western democracies, contrary to their prevailing self-image as "planned" and "managed," be seen as highly disorganized systems of social power and political authority? If so, what are the symptoms, consequences of, and possible remedies for these disorganizing tendencies?In these ten essays, Claus Offe seeks to answer such questions. I argue that neglect of the idea of freedom in economic theory has led to an inadequate conceptualization of the ethical responsibilities of corporations within management theory. In a critical review of the history of economic ideas, I investigate why and how the idea of freedom was gradually removed from the canon of economics. This reconstruction aims at a deconstruction of certain (...) axioms of neoclassical economics that hamper contemporary efforts in integrating ethics firmly into management education. I intend to show by these deconstructive endeavors that a constructive use of the idea of responsible freedom could correct and complement the current quantitative focus in business theory through qualitative orientations. I argue that with the help of qualitative success criteria, the strategic integration of the tenets of both business ethics and Corporate Social Responsibility into business practice can be advanced by further research. A syntactic formalism for the modeling of belief revision in perfect information games is presented that allows to define the rationality of a player's choice of moves relative to the beliefs he holds as his respective decision nodes have been reached. In this setting, true common belief in the structure of the game and rationality held before the start of the game does not imply that backward induction will be played. To derive backward induction, a “forward belief” condition is formulated (...) in terms of revised rather than initial beliefs. Alternative notions of rationality as well as the use of knowledge instead of belief are also studied within this framework.
