Religion’s sudden re-appearance on the scene of international politics has resulted in a creative challenge for the discipline of International Relations. Although the leading tendencies suggest that religion is once again present in international relations, this article will carry out an exercise of introspection within the discipline based on the idea of religious continuity. As a result, questions arise concerning secularization as the foundational myth of modern international relations. Introducción: Se presenta un análisis cualitativo del acompañamiento psicosocial a jóvenes en condiciones de vulnerabilidad desde la ecología humana durante 12 meses entre 2010 a 2011; utilizando técnicas pedagógicas evaluativas participativas. Éstas, son una alternativa para crear espacios reflexivos con el propósito de potenciar la resiliencia en las relaciones comunicativas y formar en el respeto. Objetivo: Generar bienestar, prevenir la farmacodependencia y contribuir a la promoción de la salud. Material y Métodos: Se revisaron los antecedentes temáticos, fueron seleccionados 100 estudiantes (...) entre 11 y 19 años de dos instituciones educativas públicas en condiciones vulnerables;se desarrollaron cuatro talleres reflexivos y cuatro prácticas lúdicas y se realizaron tres grupos focales con estudiantes, profesores y padres de familia. Resultados y Discusión: El contexto social de la población intervenida, revela problemas de abuso sexual, violencia intrafamiliar y eventos violentos en el vecindario por grupos armados ilegales, entre otros, que constituyen factores de riesgo importantes para la farmacodependencia. Conclusión: Se infiere que lo psicosocial incide en la farmacodependencia, afectando la convivencia de la población estudiada por múltiples causas del orden psicoafectivo, sociocultural, económico y político que van desde el consumo cultural hasta la seguridad alimentaria. Introduction: A qualitative analysis of the psycho-social support to young people in situations of vulnerability from human ecology is presented for 12 months between 2010 to 2011; using participatory evaluative pedagogical techniques. These are an alternative to create reflective spaces with the purpose of enhancing resilience in communicative relationships and working in respect. Objective: to generate well-being, prevent drug abuse and contribute to the health promotion. Material aids and methods: the thematic background was reviewed, 100 students between 11 and 19 years of two public schools in vulnerable conditionswere selected; four reflective workshops and four playful practices were developed and three focus groups with students, teachers and parentswere conducted. Results and discussion: the social context of the manipulated population reveals sexual abuse problems, domestic violence and violent events in the neighborhood by illegal armed groups, among others, which constitutemajor risk factors for drug abuse. Conclusion: It can be inferred that the psychosocial factors impact on drug dependence, affecting the coexistence of the population studied by multiple causes of the psychological, socio-cultural, economic and political order, ranging from cultural consumption to food security. We agree with the author's working model, but we suggest that (a) the classical distinction between fast and slow processes as separable processes can be softened, and (b) human performance might result from an interplay between fast and slow processing and these processes may be mediated by systems that evolve to satisfy the need for operation in a complex environment.

The signal functions of infant crying cannot be understood properly without due attention to their ontogenetic development. Based on our own research on the development of infant cries, we argue that the controversies in cry literature will not be solved by static models, but that progress will made only when considering ontogenetic changes in interpreting cry data.

Given the sensitive nature of trauma-focused research, it is important that researchers understand the impact of research participation on study participants. The current study examined the relationship between type of child abuse, psychological adjustment, and self-reported participatory distress in 105 female adult survivors of childhood abuse. Several key findings emerged: (a) overall, participants reported low levels of participatory distress; (b) greater levels of participatory distress were reported by sexual abuse survivors and were associated with higher scores on depressed mood and (...) posttraumatic stress; and (c) posttraumatic stress symptomatology served as a mediator in the relationship between abuse type and participatory distress. The findings inform researchers and members of Institutional Review Boards on variables related to participatory distress in studies of child abuse. (shrink)

Cet article compare les philosophies de Marc Richir et Gilles Deleuze à travers les notions d'« anarchie » et de « sens », en explorant comment celles-ci transforment la phénoménologie classique. Il est soutenu que les deux auteurs remplacent l’approche traditionnelle du sujet par une phénoménologie du Sinnbildung, ou « le sens en train de se faire ». Richir radicalise l’epoché phénoménologique vers une contingence générative, tandis que Deleuze développe une science des effets de surface fondée sur la création de (...) concepts et le simulacre. Tous deux proposent un « soi » dynamique, détaché de la subjectivité traditionnelle, et articulent le lien entre intériorité et extériorité dans des processus de formation du sens. Ce travail montre comment Richir et Deleuze déstabilisent les fondements subjectifs, en proposant une phénoménologie anarchique qui redéfinit la relation entre apparence, simulacre et production de sens. Este texto realiza uma revisão de literatura em torno dos principais aspectos que envolvem a construção da cena dissensual em Jacques Rancière, evidenciando como a potência fabulativa da racionalidade ficcional produz momentos quaisquer que perturbam os encadeamentos consensuais de ações, gestos, existências e experiências. A partir da produção de intervalos e liminaridades, é possível reconfigurar temporalidades e espacialidades a fim de desestabilizar e desierarquizar as relações de dominação e propor outros imaginários. O momento qualquer suspende a ordem corriqueira do tempo, (...) redispõe o visível, as ações e as formas como as coisas e os seres aparecem, a maneira habitual de ocupar um espaço, a forma de identificar-se como indivíduo e de inscrever-se nas relações. Assim, a cena de dissenso, tomada como singularidade e como operação a partir da qual se pode produzir momentos de rêverie (devaneio fabulador) que fraturam imaginários consensuais, altera o modo como lemos, vemos e ouvimos o outro e o mundo a nosso redor. Argumentamos que a cena realiza uma desmontagem das explicações previsíveis, deslocando consensos e oferecendo um imaginário antihierárquico e no qual coexistem múltiplos tempos, espaços e existências. Research on applying signature character strengths demonstrated positive effects on well-being, health and work behavior. Future health care professionals represent a group at risk for impaired well-being due to high study demands. This study investigates potential long-term protective effects on well-being. In total, 504 medical students participated in a longitudinal online study, with at least 96 providing complete data at all three time points. Data on individual signature character strengths and their applicability, thriving, work engagement, burnout, mental and physical health (...) were collected. Longitudinal relations of signature character strengths’ applicability and well-being, mental and physical health were tested with cross-lagged panel analyses. Moreover, indirect longitudinal mediation effects via work engagement and emotional exhaustion were considered. Cross-lagged panel analyses demonstrated significant positive effects of thriving on signature character strengths’ applicability at later time points indicating that higher levels of well-being might be mandatory first to have access to one’s own signature character strengths in a naturalistic setting. Disentangling thriving, the effect was only significant for psychological well-being. Across all three time points, significant indirect effects via work engagement on the relation of the applicability of signature character strengths and well-being were identified, whereas significant indirect effects on mental and physical health were only evident at t2 and t3. A longitudinal mediation analysis via work engagement revealed a significant indirect effect. These results call for further research as previous studies showed that the applicability of signature character strengths affected well-being, not vice versa. The ‘broaden-and-build’ theory and the assumption of well-being in a “top-down” model could possibly explain these novel results. (shrink)

Si bien el pensamiento spinozista se inscribe en la conversión antropológica, en donde lo bello resulta ser un efecto en el sujeto y no una cualidad de los objetos, su comprensión del arte es inasimilable a la “estética” como ámbito diferenciado y autónomo que se consolida en el siglo XVIII, (...) y más bien concibe el arte integrado a la vida y a la experiencia común -a la vez que, en cuanto praxis de origen corporal al alcance de cualquiera, presenta puntos de contacto con las vanguardias históricas del siglo XX-. Spinoza, según se propone en este texto, concibe la producción de “obras de arte” menos como un hecho estético que como una actividad corporal éticamente orientada a la vida buena.: The present work explores the status of art in the philosophy of Spinoza, within the framework of the Copernican revolution that gives rise to aesthetics and the Dutch Baroque. Although the Spinozist thought is inscribed in the anthropological conversion by virtue of which beauty turns out to be an effect on the subject and not a property of objects, its understanding of art is unassimilable to "aesthetics" as a differentiated and autonomous area that it was consolidated in the eighteenth century, and rather conceived art integrated to life and common experience -at the same time, as praxis of bodily origin within the reach of anyone, presents points of contact with the historical avant-gardes of the twentieth century-. Spinoza conceives the production of "artworks" less as an aesthetic fact than as a body activity ethically oriented to the good life. (shrink)

El bioderecho es un neologismo que trata las reglas jurídicas de comportamiento en el contexto de cuestiones bioéticas; se ocupa también del hombre, su dignidad, vida e identidad. El presente estudio descriptivo busca atribuir significado al concepto de dignidad en dos modelos de bioderecho, que develan el estatuto jurídico reconocido por estos a los adultos mayores. Se aplica el método de análisis elaborado por Laura Palazzani. The paper deals with the relation between abduction and inference to the best explanation. A heuristic and a normative interpretation of IBE are distinguished. Besides, two different normative interpretations —those vindicated by I. Niiniluoto and S. Psillos— are discussed. I conclude that, in principle, Aliseda’s theory of abduction fits better with a heuristic account of IBE.

There are different Bayesian measures to calculate the degree of confirmation of a hypothesis H in respect of a particular piece of evidence E. Zalabardo (Analysis 69:630–635, 2009) is a recent attempt to defend the likelihood-ratio measure (LR) against the probability-ratio measure (PR). The main disagreement between LR and PR concerns their sensitivity to prior probabilities. Zalabardo invokes intuitive plausibility as the appropriate criterion for choosing between them. Furthermore, he claims that it favours the ordering of pairs evidence/hypothesis generated by (...) LR. We will argue, however, that the intuitive non-numerical example provided by Zalabardo does not show that prior probabilities do not affect the degree of confirmation. On account of this, we conclude that there is no compelling reason to endorse LR qua measure of degree of confirmation. On the other side, we should not forget some technicalities which still benefit PR. (shrink)

According to the “no-miracles argument” (NMA), truth is the best explanation of the predictive-instrumental success of scientific theories. A standard objection against NMA is that it is viciously circular. In Scientific Realism: How Science Tracks Truth Stathis Psillos has claimed that the circularity objection can be met when NMA is supplemented with a reliabilist approach to justification. I will try to show, however, that scientific realists cannot take much comfort from this policy: if reliabilism makes no qualifications about the domain (...) where inference to the best explanation is reliable, scientific realists flagrantly beg the question. A qualified version of reliabilism, on the other side, does not entitle us to infer the realist conclusion. I conclude, then, that Psillos’s proposal does not make any significant progress for scientific realism. (shrink)

Epidemiological models have played a central role in the COVID-19 pandemic, particularly when urgent decisions were required and available evidence was sparse. They have been used to predict the evolution of the disease and to inform policy-making. In this paper, we address two kinds of epidemiological models widely used in the pandemic, namely, compartmental models and agent-based models. After describing their essentials—some real examples are invoked—we discuss their main strengths and weaknesses. Then, on the basis of this analysis, we make (...) a comparison between their respective merits concerning three different goals: prediction, explanation, and intervention. We argue that there are general considerations which could favour any of those sorts of models for obtaining the aforementioned goals. We conclude, however, that preference for particular models must be grounded case-by-case since additional contextual factors, as the peculiarities of the target population and the aims and expectations of policy-makers, cannot be overlooked. Counterfactuals abound in science, especially when reasoning about and with models. This often requires entertaining counterfactual conditionals with nomologically or metaphysically impossible antecedents, namely, counternomics or counterpossibles. In this paper I defend the make-believe view of scientific counterfactuals, a naturalised fiction-based account of counterfactuals in science which provides a means to evaluate their meanings independently of the possibility of the states of affairs their antecedents describe, and under which they have non-trivial truth-values. Fiction is here understood as imagination (in contrast (...) with its most typical association with falsity), characterised as a propositional attitude of pretense or ‘make-believe’ (Walton 1990). The application of this theory to scientific counterfactuals makes their evaluation a game of make-believe: a counterfactual is (fictionally) true iff its antecedent and the rules of the game prescribe the imagining of its consequent (Kimpton-Nye 2020). The result is a practice-based account of counterfactuals and counterfactual reasoning in science which incorporates insights from theoretical and experimental analytic philosophy as well as cognitive science. This way, the make-believe view of scientific counterfactuals shows that the evaluation of scientific counterfactuals is none other than a question of scientific representation in disguise. (shrink)

According to van Fraassen, constructive empiricism (CE) makes better sense of scientific activity than scientific realism (SR). I discuss a recent episode in biomedical research - investigations about Helicobacter Pylori and its relation to peptic ulcer. CE's expedient to cope with it is a sort of belief substitution. I argue that replacing realist beliefs by empiricist surrogates (as-if beliefs) could accommodate scientists' expectations and behavior. Nonetheless, theoretical agnosticism could hardly motivate scientists to focus just on the observational consequences derived from (...) the theory at issue. Contrary to van Fraassen, I conclude then that, concerning scientific practice, realist beliefs cannot be considered as a gratuitious surplus which should be rejected. (shrink)

Levels of organization and their use in science have received increased philosophical attention of late, including challenges to the well-foundedness or widespread usefulness of levels concepts. One kind of response to these challenges has been to advocate a more precise and specific levels concept that is coherent and useful. Another kind of response has been to argue that the levels concept should be taken as a heuristic, to embrace its ambiguity and the possibility of exceptions as acceptable consequences of its (...) usefulness. In this chapter, I suggest that each of these strategies faces its own attendant downsides, and that pursuit of both strategies (by different thinkers) compounds the difficulties. That both kinds of approaches are advocated is, I think, illustrative of the problems plaguing the concept of levels of organization. I end by suggesting that the invocation of levels may mislead scientific and philosophical investigations more than it informs them, so our use of the levels concept should be updated accordingly. Bayesianism and Inference to the best explanation are two different models of inference. Recently there has been some debate about the possibility of “bayesianizing” IBE. Firstly I explore several alternatives to include explanatory considerations in Bayes’s Theorem. Then I distinguish two different interpretations of prior probabilities: “IBE-Bayesianism” and “frequentist-Bayesianism”. After detailing the content of the latter, I propose a rule for assessing the priors. I also argue that Freq-Bay: endorses a role for explanatory value in the assessment of scientific hypotheses; (...) avoids a purely subjectivist reading of prior probabilities; and fits better than IBE-Bayesianism with two basic facts about science, i.e., the prominent role played by empirical testing and the existence of many scientific theories in the past that failed to fulfil their promises and were subsequently abandoned. EI artículo pretende comparar y valorar dos enfoques diferentes deI argumento de la manipulabilidad -I. Hacking y R. Harré-, cuya idea basíca es que, de cara a establecer la existencia de una entidad, manipularla puede ser tan importante corno observarla. Por último, a fin de evitar los aspectos más cuestionables de ambos enfoques, propongo entender la eficacia manipulativa corno obtención de informacion fiable. (...) The ‘manipulability argument’ has been reeently employed in favour of scientific realism. The underlying idea is that, in order to establish the existence of an entity, manipulating it is so important as observing it. Two different approaches to the ’manipulability argument’ are compared: Ian Hacking’s ‘experimental realism’ and Rom Harré’s ‘depth realism’. In order to avoid the most controversial aspects of both approaches, I suggest that manipulative efficacy be understood as the attainment of reliable information. (shrink)

Philip Kitcher has developed a sort of inductivist-reliabilist justification for scientific realism. After distinguishing his argument from a well-known abductivist one (the "no-miracles" argument), I will argue that Kitcher's proposal cannot adequately meet the antirealist challenge. Firstly, it begs the question against the antirealists; secondly, it can hardly support a plausible - piecemeal - scientific realism. I will explore an alternative inductivist approach that exploits correlations between theoretical properties and empirical success. On my view, its prospects for avoiding the aforementioned (...) shortcomings are better than Kitcher's standpoint. I dare say, however, that an inductivist strategy alone cannot satisfy the demands of scientific realism since, in the end, an abductive move may well be mandatory for grounding it. (shrink)

In the last decades, the evidence-based approach has become dominant in the biomedical sciences. Its influence has extended from clinical practice to other areas such as drug regulation and public health. Nonetheless, given the limitations of the evidence-based framework, a more pluralist approach towards evidence has been demanded. In this sense, evidential pluralism holds that evidence of mechanisms should complement statistical evidence. This paper aims to explore and discuss the prospects of evidential pluralism in public health. First, we will analyse (...) the evidential standards of the International Agency for Research on Cancer. Those standards are argued to be in line with the pluralist approach. Second, we will consider the main challenges for gathering evidence of mechanisms in public health. For that purpose, diverse types of evidence of mechanisms will be identified. And third, we will assess the role of agent-based models as mechanistic studies. Based on a case study, we will discuss whether agent-based models can provide evidence of mechanisms and mitigate the abovementioned challenges. (shrink)

The paper is a critical examination of some aspects of Laudan's views in his book Science and Values. Not only do the aims of science change; there are axiological disputes in science as well. Scientific disagreements are not solely theoretical or methodological. Progress in science consists not only in developing new theories more suitable for implementing certain epistemic values than earlier ones but also in reaching a deeper understanding of those values. The paper considers whether there are principles to guide (...) axiological choices in science, whether the task of assessing the legitimacy of goals makes any sense. Larry Laudan's criteria to settle questions concerning the aims of science are critically canvassed. According to Laudan, axiological choices are on the same footing as the theoretical and methodological ones: all of them may be objectively grounded. The generality of the principles and their naturalistic flavour are the most remarkable merits of Laudan's account but the results are rather meagre. His principle of coherence may be, in the end, a mere a posteriori justification of changes in axiological direction carried out by the scientific community. The rejection of a demonstrable utopian goal, granting naturalistic assumptions, is completely sound but it has a very limited scope. The paper suggests that science could not demonstrate much about goals. From the rejection of semantic utopianism we can draw a need for a previous clarification rather than sustantive criticisms and, finally, Laudan's charge of epistemic utopianism is very controversial. The paper analyzes which is the proper role of history of science in philosophy of science. I argue that, traditionally, philosophy of science has focused on the normative dimension of science. Several positions within philosophy of science stem from different perspectives on such dimension. I classify them according to two variables . Then I discuss the role of history of science within all these four alternatives. I conclude that: philosophers and historians pursue not only different, but opposite aims; historical evidence (...) is useful for assessing the relation between methods and results; besides this, only very simple or radical philosophical views can be “refuted” by historical evidence; the disagreement between those who think that history of science is necessary for philosophy of science and those who think it is not is, in fact, a disagreement about the prospects for a generaltheory of science; such disagreement cannot be resolved appealing to historical evidence; if it can be resolved, philosophical arguments should somehow be invoked. Una cuestión controvertida en la teoría bayesiana de la confirmación es el estatus de las probabilidades iniciales. Aunque la tendencia dominante entre los bayesianos es considerar que la única constricción legítima sobre los valores de dichas probabilidades es la consistencia formal con los teoremas de la teoría matemática de la probabilidad, otros autores -partidarios de lo que se ha dado en llamar "bayesianismo objetivo"- defienden la conveniencia de restricciones adicionales. Mi propuesta, en el marco del bayesianismo objetivo, recoge una sugerencia (...) de Wesley Salmon. No obstante, mientras que para Salmon las probabilidades iniciales se justifican en tanto incorporan la frecuencia de éxito de las hipótesis del pasado, el factor decisivo en mi opinión es el éxito probabilístico de las hipótesis del pasado. Así, la asignación de una probabilidad inicial a una hipótesis h será correcta si refleja el éxito probabilístico de hipótesis del pasado semejantes a h. En esta línea, propongo una regla para fijar las probabilidades iniciales de las hipótesis, y acabo discutiendo algunas objeciones generales en contra de mi planteamiento. One of the most controversial issues for Bayesian theory of confirmation concerns the status of prior probabilities. Orthodox Bayesianism claims that logical consistency with the theorems of mathematical theory of probability is the only constraint on prior probabilities, while some authors claim for further requirements. I agree with the latter standpoint. My proposal is inspired by Wesley Salmon's frequentist justification of prior probabilities. According to him, prior probabilities are the best assessments of past scientific hypotheses' success. I think that historical information is relevant here, but I propose to focus on a particular sort of success -i.e., "probabilistic success". I claim that a particular prior for h is correct insofar as it reflects the probabilistic success of past scientific hypotheses similar to h. I also suggest a rule to set the priors for contemporary hypotheses. The closing paragraphs are devoted to some general objections against this proposal. (shrink)

Van Fraassen's argument from the "bad lot" challenges realist interpretations of inference to the best explanation. In this paper I begin by discussing the replies suggested by S. Psillos and P. Lipton. I do not find them convincing. However, I think that van Fraassen's argument is flawed. First of all, it is a non sequitur. Secondly, I think that the real target for the scientific realist is the underlying assumption that epistemic justification results from a comparative assessment among rival explanations. (...) I argue that justification for believing an explanation does not depend on comparison, but on the extent that criteria of explanatory goodness are fulfilled. Therefore, in addition to offering more or less intuitive IBE-tailored arguments, realists fond of IBE should have to analyze the implicit standards of explanatory goodness. In the last section I distinguish between contextual and transcontextual criteria concerning explanatory goodness. Concerning the latter, I focus on consilience, simplicity, analogy and conservatism. \\\ Un argumento empleado por van Fraassen contra las interpretaciones realistas de la inferencia a la mejor explicación es el argumento "del mal lote". El articulo comienza discutiendo las réplicas de S. Psillos y P. Lipton. Aunque ninguna me parece convincente, pienso que el argumento de van Fraassen no resiste un examen cuidadoso. En primer lugar, la conclusión antirrealista que él extrae es un non sequitur. Además, el argumento parte de un supuesto muy cuestionable, a saber, que la justificación de una explicacion es resultado de una comparacion con sus rivales. En mi opinion, la justificación no depende de esto, sino del grado en que la explicacion satisface ciertos criterios de bondad explicativa, independientemente de que haya o no comparación. En consecuencia, la socorrida estrategia de defender el realismo cientifico basándose en la IBE pasa necesariamente por un análisis de los criterios implicitos de bondad explicativa. Mi propuesta es distinguir entre criterios contextuales y transcontextuales. En los últimos incluyo: la diversidad de la evidencia explicada, la simplicidad, la analogia y el conservadurismo. Recently, a number of philosophers have begun to question the commonly held view that choice or voluntary control is a precondition of moral responsibility. According to these philosophers, what really matters in determining a person’s responsibility for some thing is whether that thing can be seen as indicative or expressive of her judgments, values, or normative commitments. Such accounts might therefore be understood as updated versions of what Susan Wolf has called “real self views,” insofar as they attempt to ground (...) an agent’s responsibility for her actions and attitudes in the fact (when it is a fact) that they express who she is as a moral agent. As such, they seem to be open to some of the same objections Wolf originally raised to such accounts, and in particular to the objection that they cannot license the sorts of robust moral assessments involved in our current practices of moral responsibility. My aim in this paper is to try to respond to this challenge, by clarifying the kind of robust moral assessments I take to be licensed by (at least some) non-volitional accounts of responsibility and by explaining why these assessments do not in general require the agent to have voluntary control over everything for which she is held responsible. I also argue that the limited applicability of the distinction between “bad agents” and “blameworthy agents” on these accounts is in fact a mark in their favor. (shrink)

A number of philosophers have recently argued that we should interpret the debate over moral responsibility as a debate over the conditions under which it would be “fair” to blame a person for her attitudes or conduct. What is distinctive about these accounts is that they begin with the stance of the moral judge, rather than that of the agent who is judged, and make attributions of responsibility dependent upon whether it would be fair or appropriate for a moral judge (...) to react to the agent in various (negative) ways. This is problematic, I argue, because our intuitions about whether and when it would be fair to react negatively to another are sensitive to a host of considerations that appear to have little or nothing to do with an agent’s responsibility or culpability for her attitudes or behavior. If this is correct, then theories which make attributions of responsibility dependent upon the appropriateness of our reactions as moral judges will turn out to be fundamentally misguided. (shrink)

Despite journalism’s commitment to ethical principles such as accuracy, humanity and diversity, compliance with the gender perspective in content is still minimal in approximately one hundred countries. This inequality reinforces misperceptions, imbalances, and perceived differences between men and women. To address this situation, from 2010 to 2021, eight Spanish media companies appointed a new editorial position responsible for self-regulating gender equality. This qualitative study focused on 10 journalists who currently exercise or have exercised that job, to detect, describe and propose (...) the implementation of this new professional role. This study suggests that gender editing has advanced equality in parity of sourcing and the presence of women in the opinion sections, but implementation of equality in overall content is more difficult. Gender editors’ daily work is hampered by a lack of management support and an absence of independence in editorial decisions. (shrink)

The concept of ‘ownership’ is increasingly central to debates, in the media, health policy and bioethics, about the appropriate management of clinical data. I argue that the language of ownership acts as a metaphor and reflects multiple concerns about current data use and the disenfranchisement of citizens and collectives in the existing data ecosystem. But exactly which core interests and concerns ownership claims allude to remains opaque. Too often, we jump straight from ‘ownership’ to ‘private property’ and conclude ‘the data (...) belongs to the patient’. I will argue here that private property is only one type of relevant relationship between people, communities and data. There are several reasons to doubt that conceptualising data as private property presents a compelling response to concerns about clinical data ownership. In particular I argue that clinical data are co-constructed, so a property account would fail to confer exclusive rights to the patient. A non-property account of ownership acknowledges that the data are ‘about the patient’, and therefore the patient has relevant interests, without jumping to the conclusion that the data ‘belongs to the patient’. On this broader account of ownership, the relevant harm is the severing of the connection between the patient and their data, and the solution is to re-engage and re-connect patients to the data research enterprise.
