Ce texte résume la présentation et les commentaires des parties prenantes recueillis lors de l’atelier de la Société canadienne de bioéthique et du forum communautaire de mai 2023, lors d’une session intitulée « Clinical Ethics Fellowship in Canada: Making the Move Towards Standardization ». The specificities of mental health care combined with the contemporary context of health care make ethical issues particularly salient in psychiatry. Thus, residents in training in this medical discipline may be particularly exposed to difficult situations involving an ethical dilemma, which can be a cause of distress and moral suffering. Future physicians are equipped with knowledge and skills that should enable them to address the ethical issues inherent to clinical practice, as teaching of this discipline is now a requirement for (...) accreditation of residency training programs in Canada. However, many questions remain about the design of a valid and effective clinical ethics education for these young practitioners. In this essay, we attempt to sketch out possible answers to this wide range of questions, based on our experience as residents. After having examined some of the specificities of the ethics curriculum which we benefited from the psychiatry residency program at the University of Sherbrooke, we analyze how its structure can be a good example for ethics training of other young professionals, that is, residents. More specifically, we highlight how creating a space to acknowledge the suffering of the care giver in-training can have an impact on their own sensitivity to the suffering of the patient who they are treating. There is an increasing need for quality in ethics consultations, though there have been significant achievements in the United States and Europe. However, fundamental concerns that place the profession in jeopardy are discussed from the perspective of the U.S. in a manner that will be helpful for other countries. The descriptive component of the essay (the first two points) explains the achievements in ethics quality (illustrated by the IntegratedEthics program of the Veterans Health Administration) and the progress on standards and (...) competencies for ethics consultations (represented by the Core Competencies of the American Society for Bioethics and Humanities). Based on these achievements, the analytical component of the essay (the final three points) identifies and seeks to resolve three fundamental concerns (with increasing levels of importance) that compromise quality in ethics consultations: standards of quality; professionalism; and credentialing. The analysis argues for clearer standards of quality in ethics consultation and urges further professionalism by explaining the need for the following: interpreting the ASBH core competencies in a normative manner, developing a Code of Ethics, and clarifying the meaning of best practices. However, the most serious concern that threatens quality in ethics consultations is the lack of a credentialing process. This concern can be resolved effectively by developing an independent Ethics Consultation Accreditation Council to accredit and standardize graduate degree programs, fellowship experiences, and qualifying examinations. This credentialing process is indispensable if we are to strategically enhance quality in ethics consultations. (shrink)

During the 1970s and 1980s, legal precedent, governmental recommendations, and professional society guidelines drove the formation of hospital ethics committees (HECs). The Joint Commission on Accreditation of Health Care Organization’s requirements in the early 1990s solidified the role of HECs as the primary mechanism to address ethical issues in patient care. Because external factors drove the rapid growth of HECs on an institution-byinstitution basis, however, no initial consensus formed around the structure and function of these committees. There are now almost (...) 40 years of empirical studies on the composition, administration, and activities of HECs in the United States. We conducted a systematic review of the available empirical literature on HECs to describe their evolution. As HECs changed over time, they increased their total number of members and percentage of members from nursing and the community. Although physicians increasingly chaired these committees, their presence as a percentage of overall members declined. The percentage of administrative members remained steady, although committees became increasingly likely to have at least one administrative member. HECs were also increasingly likely to report to an administrative body or to the board of trustees or directors rather than to the medical staff. Finally, consultation volume increased steadily over time. There has not, however, been a national survey of the composition of ethics committees, their administration, or volume of consultation in more than 10 years, despite increasing calls for professional standards and quality improvement assessments among HECs. In France, the practice of clinical ethics, and more specifically of clinical ethics consultation (CEC), is marked both by a heritage of practices from across the Atlantic and by a desire to adapt to the needs of the national context, which is increasingly giving a voice to patients. While the practice remained marginal in France for a long time, a number of structures developed in the wake of the Covid-19 health crisis. The aim of this article is to take (...) an initial national look at the practice of CEC in France, from its origins to its prospects. An exploratory questionnaire was drawn up by 5 teams offering CEC and linked by a historic partnership. It consisted of 4 parts: presentation of the structure, form taken by the CEC, whether or not they agreed with the fundamental proposals, and whether or not they wanted to form a national CEC collective. The results cover 38 organizations, 26 of which say they practice CEC. Although the practices of these 26 organizations varied, they all agreed on the objective of offering case-by-case medical decision support, with the majority adhering to the basic principles identified and wishing to participate in a CEC collective. This initial exploration provides an opportunity to put the practice of CEC in France into perspective in the international context and opens up prospects for collective work on the practical and methodological fundamentals, both by drawing on the similarities and the differences between different countries. JANICE L. SCHULTZ Canisius College Buffalo, New York Authority and Leadership in the Church: Past Directions and Future Possibilities. By THOMAS (...) P. RAUSCH, S.J. Wilmington, Del.: Michael Glazier, 1989. Pp. 158. $15.95. Rather than offering a sustained study of the question of authority and leadership in the Church, Rausch presents a collection of essays related to the topic. The format reflects the book's genesis: much of the material was developed for the 23rd Faith and Order Conference of the Texas Conference of Churches on the subject "Authority in the Body of Christ." Although the title does not reflect the hook's ecumenical focus, readers who want a general introduction to the present status of agreement in ecumenical discussion of authority and ministry may find Rausch's hook helpful. In " Authority in the Ecumenical Dialogue " Rausch reviews and summarizes the ARCIC Final Report, the Lutheran-Roman Catholic Dialogue, the WCC Baptism, Eucharist and Ministry text, and the Consultation on Church Union. The emerging consensus on the value of ordained ministry in these documents indicates that this ministry is permanent, although the threefold ministry of bishop, presbyter, and deacon stands in need of reform. Rausch notes that the documents do not limit " valid " ministry to ordained ministry in communion with the historic episcopate. As for the shape of ministry in the church of tomorrow, not surprisingly, he identifies shared responsibility and collegiality as the marks of the future exercise of authority. Among the important issues still unresolved by the churches are Petrine ministry and primacy and the problem of the " reception " of ecumenical documents. The chapter on authority and reception, originally published in Theological Studies, may well be the most original contribution of the book. It broadens the discussion of reception from its historical " classical " understanding as " the acceptance by local churches of particular ecclesiastical or conciliar decisions " to an ecumenical understanding of the concept as " the acceptance by one church of a theo- 166 BOOK REVIEWS logical consensus arrived at with another church, and ultimately, the recognition of the other church's faith and ecclesial life as authentically Christian (p. 103)." He concludes that (1) reception is more properly understood as a process rather than as a juridical determination, (2) it also involves formal decisions on the part of church authorities, (3) it cannot be reduced to the acceptance of doctrinal formulations, and (4) the norm for recognizing a common faith is not agreement with a particular ecclesial position but agreement with the apostolic tradition. Ultimately, reception involves the whole church and is not the sole product of theologians or church authorities. Ecumenical dialogues will only be effective when they enter into the practical life of the churches. In "Imaging Tomorrow's Church: Models of Christian Unity" Rausch summarizes four models of church unity: organic union, conciliar fellowship, reconciled diversity, and communion of Churches. He opts for the fourth model. The chapter does not offer any new information to someone familiar with ecumenical discussions, but it does serve as an introduction for the neophyte. Rausch's image of authority in the future lies somewhere between a strictly hierarchical or institutional model and a more egalitarian model. His final chapter, " Authority in Tomorrow's Church," predicts that the church of the future will be " ordered " in the sense that it will combine an authoritative ordained ministry (based on the church's apostolic office) with a recognition of multiple and diverse charismatic gifts. He retrieves Karl Rahner's suggestion that recognition of charism for leadership in an individual may result in that person's " relative" ordination for a particular local community. Authority of the future will be collegial with a more participatory style of decision-making. The renewed papacy will encourage not only a more participatory style of decision-making but also a broader participation in the formulation of church teaching. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. Não sou amansador de cavalos! E, mesmo, quem de si de ser jagunço se entrete, já é por alguma competência entrante do demônio. Será não? Será? De primeiro, eu fazia e mexia, e pensar não pensava. Não possuía os prazos. Vivi puxando difícil de dificel, peixe vivo no moquém: quem mói no asp’ro, não fantaseia. Mas, agora, feita a folga que me vem, e sem pequenos dessossegos, estou de range rede. E me inventei neste gosto, de especular idéia. O diabo existe e não existe? Dou o dito. Abrenúncio. Essas melancolias. O senhor vê: existe cachoeira; e pois? O senhor ache e não ache. Tudo é e não é... Quase todo mais grave criminoso feroz, sempre é muito bom marido, bom filho, bom pai, e é bom amigo-de-seus-amigos! Sei desses. Só que tem os depois – e Deus, junto. Vi muitas nuvens. Mas, em verdade, filho, também, abranda. Olhe: um chamado Aleixo, residente a légua do Passo do Pubo, no da-Areia, era o homem de maiores ruindades calmas que já se viu. Me agradou que perto da casa dele tinha um açudinho, entre as palmeiras, com traíras, pra-almas de enormes, desenormes, ao real, que receberam fama; o Aleixo dava de comer a elas, em horas justas, elas se acostumaram a se assim das locas, para papar, semelhavam ser peixes ensinados. Um dia, só por graça rústica, ele matou um velhinho que por lá passou, desvalido rogando esmola. O senhor não duvide – tem gente, neste aborrecido mundo, que matam só para ver alguém fazer careta... Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Esse Aleixo era homem afamilhado, tinha filhos pequenos; aqueles eram o amor dele, todo, despropósito. Dê bem, que não nem um ano estava passado, de se matar o velhinho pobre, e os meninos do Aleixo aí adoeceram. Andaço de sarampão, se disse, mas complicado; eles nunca saravam. Quando, então, sararam. Mas os olhos deles vermelhavam altos, numa inflama de sapiranga à rebelde; e susseguinte – o que não sei é se foram todos duma vez, ou um logo e logo outro e outro – eles restaram cegos. Cegos, sem remissão dum favinho de luz dessa nossa! O senhor imagine: uma escadinha – três meninos e uma menina – todos cegados. Sem remediável. O Aleixo não perdeu o juizo; mas mudou: ah, demudou completo – agora vive da banda de Deus, suando para ser bom e caridoso em todas suas horas da noite e do dia. Parece até que ficou o feliz, que antes não era. Ele mesmo diz que foi um homem de sorte, porque Deus quis ter pena dele, transformar para lá o rumo de sua alma. Isso eu ouvi, e me deu raiva. E o velhinho assassinado? – eu sei que o senhor vai discutir. Pois, também. Em ordem que ele tinha um pecado de crime, no corpo, por pagar. To succeed, an accreditation process for clinical ethics fellowship programs (CEFPs) would need support from CEFP directors. To assess CEFP directors’ opinions, we surveyed all 36 CEFP directors in the United States and Canada, achieving a 100% response rate. We found that support for accreditation is strong, with 30.6% strongly supportive, 44.4% supportive, 22.2% neutral, 2.8% opposed, and 0% strongly opposed. Most directors (77.8%) would be likely to apply for accreditation within the next five years regardless of the availability of (...) government funding; even more (86.1%) would apply if government funding became available for accredited programs. Most directors thought that lack of a national accreditation process (75.0%), lack of agreed-upon standards (90.0%), and lack of funding for CEFPs (91.7%) were at least moderate problems for the field. When directors were asked what they thought was the greatest challenge or barrier to developing an accreditation process, many mentioned the diversity of programs and the challenge of achieving consensus on accreditation standards. Directors offered a variety of suggestions for how to overcome or manage challenges or barriers, including collecting data on existing programs, mirroring standards established for other health professions, and setting clear expectations on the need for compromise. When directors were asked how they expected that accreditation and government funding would affect their own programs, the field of clinical ethics, and patient care, directors mostly had very positive expectations; no director expected negative effects in any of these areas. Overall, this study provides evidence that developing an accreditation process for CEFPs would be both possible and desirable. Our findings have immediate practical implications for the field and will inform efforts that are already underway to establish an accreditation process for CEFPs. (shrink)

D'autres sont moins connus et peuvent faire peur, comme : " paradigme scientifique, représentation, standardisation, idéologie, éthique ". Ce manuel se propose de les apprivoiser par un exposé simple. (...) Il poursuit deux finalités : d'une part, la formation générale personnelle du lecteur ou de la lectrice et, d'autre part, l'acquisition de compétences didactiques. Cet ouvrage intéressera particulièrement les professeurs et étudiants des Hautes Ecoles et des IUFM, les enseignants du secondaire ainsi que les étudiants du 1er cycle universitaire pour un cours d'introduction à la théorie de la connaissance. Effective documentation is considered a core competency for clinical ethics consultation. Ethics consultants within the Cleveland Clinic in Cleveland, Ohio, observed variation in the formatting of ethics chart notes across consultants and realized that this formatting was based on their own views of effectiveness. To minimize variation and optimize the readability and understandability of ethics chart notes for end users, a team undertook a quality improvement project to assess the formatting preferences of healthcare professionals who rely on ethics (...) class='Hi'>consultation notes. The team developed three sample templates and conducted interviews with stakeholders to understand their preferences. A single standardized template was developed based on the preferences that emerged, which all consultants on the ethics consultation service then utilized. In the first five months of implementation, the percentage of end user respondents marking the highest Likert scale option on a post-consultation survey regarding whether the ethics consultation service provided helpful documentation increased from 60 percent to 72 percent compared to the same five-month period in the year prior. This article discusses an interdisciplinary and community-engaged public health law course that was developed as part of The Future of Public Health Law Education faculty fellowship program. Law and public health students worked collaboratively to assist a local health department in preparing for the law-related aspects of Public Health Accreditation Board review.

In a general context of increasing complexity of the ethical issues inherent in health practices, health professionals and specifically nurses find themselves forced to follow these changes in terms of skills development and ethical empowerment. Therefore, training practices are called upon to be revisited with the aim of developing ethical action. The research is based on this hypothesis : within the framework of ethics training, nurses who benefit from education based on the activity analysis centered on the schemes that govern (...) ethical behaviors would see an increase in their level of self-efficacy linked to ethical behaviors. This results presented in this study ould make several contributions to educational practices and serve the training and specifically the education of nurses in health ethics. (shrink)

L’intérêt croissant des théologiens moralistes pour la liturgie comme ressource pour la formation éthique des sujets est aujourd’hui soupçonné au nom de distinctions tenues pour acquises en théologie morale fondamentale : entre Église et monde, entre morale de la foi et morale autonome, entre éthique communautaire et morale universelle. Ces distinctions sont bien sûr essentielles à la réflexion éthique.L’attention pour la liturgie qui se manifeste aux Etats-Unis dans les années soixante-dix correspond à un changement de problématique en théologie morale fondamentale. (...) En marge d’un vif débat catholique, le courant communautarien protestant désigne une autre question : celle de la formation des sujets éthiques par leurs communautés d’appartenance. Pourtant, les accents sont contrastés au sein de ce courant communautarien, qui revalorise les vertus en les rapportant à leur contexte confessant. Dans la première partie de son article, Ph. Bordeyne montre que les deux sensibilités qui traversent le courant communautarien permettent de dégager des différences significatives au sein de l’intérêt actuel pour la liturgie. En deuxième partie, il examine l’expérience pastorale de l’Église, autour de l’initiation chrétienne des adultes notamment, en tant qu’elle aide à trouver une posture plus équilibrée pour rendre compte des rapports entre l’éthique et la liturgie. Une troisième partie dégage quelques critères, tant en direction des sujets que des communautés, pour mieux tirer parti du potentiel de formation éthique contenu dans la liturgie.The growing interest of moral theologians in the liturgy as a resource for the ethical education of subjects is under suspicion today in the name of distinctions considered established in fundamental moral theology: between the Church and the world, between Christian morality and autonomous morality, between communitarian ethics and universal morality. These distinctions are, of course, essential to ethical reflection.The interest in the liturgy that appeared in the United States during the 1970s corresponds to a change of the field of inquiry in fundamental moral theology. On the fringe of lively Catholic debate, the Protestant communitarian current points to another question: that of the formation of ethical subjects by the communities to which they belong. However, there are contrasting strains within this communitarian current, which reasserts the value of virtues by relating them to their confessional context. In the first part of his article, P. Bordeyne shows that these two tendencies, which run through the communitarian current, bring out significant differences within the present interest in liturgy. In the second part, he examines the pastoral experience of the Church, notably in the Christian initiation of adults, insofar as it helps to find a more balanced position in explaining the relationship between ethics and liturgy. The third part points out a few criteria allowing subjects and communities to take better advantage of the potential of ethical training contained in the liturgy. (shrink)

To address the current lack of knowledge about clinical ethics fellowship programs (CEFPs), we surveyed all 36 programs in the U.S. and Canada. The number of CEFPs has grown exponentially over the last 40 years and far exceeds previous estimates. Commonalities among CEFPs include: 88.8% require an advanced degree or rarely accept applicants without one; 91.7% of programs do not restrict applicants to a specific background such as medicine or philosophy; and 88.9% of programs compensate fellows. CEFPs vary widely on (...) numbers of fellows trained in the last 3 years (1–111), numbers of consultations performed by each fellow (0–450), and salaries paid ($0-$95,000). Less than half of programs meet CEFP standards established by ABPD. Nonpaying programs and larger programs tend to have lower admission standards and lower expectations for fellows. We hope these data will help inform CEFP standards that promote quality and consistency without stifling desirable diversity and innovation. (shrink)

The primary objective of The Health Care Ethics Con sultant is to focus attention on an immediate practical problem: the role and responsibilities, the education and training, and the certification and accreditation of health care ethics consultants. The principal questions addressed in this book include: Who should be considered health care ethics consultants? Whom should they advise? What should be their responsi bilities and what kind of training should they have? Should there be some kind of accreditation or certification program (...) to ensure that those who call themselves ethics consultants are in fact qualified to advise, consult, research, and write in health care ethics? The distinguished authors ofthese articles are persons with diverse backgrounds, interests, presumptions, and val ues. Not surprisingly, therefore, diverse responses have emerged to the questions posed. Though the book's chapters are individually authored, they are informed by the group discussions that went on during active workshop sessions, and by knowledge of the contributions of others. All of the chapters meaningfully represent their consensus. This is not to say that there were no disagreements regarding specific details, but rather that there were no fundamental objections on the book's basic content among a panel of authors who share basic premises regarding the role, responsibilities, education, and certifica tion of health care ethics consultants. Clinical ethics consultants provide a range of services in hospital settings and in teaching environments. Training to achieve the skills needed to meet the expectations of employers comes in various forms, ranging from on-the-job training to formal fellowship training programs. We surveyed graduates of clinical ethics fellowships to evaluate their self-reported preparedness for their first job after fellowship training. The results indicated several areas of need, including greater exposure to program-building skills, quality improvement skills, and approaches to working with members (...) of higher administration. These data will be of use to educators as well as to fellows who advocate for elements of training in preparation for their first position. (shrink)

Given the enduring debate over what constitutes quality, and therefore appropriate training, in clinical ethics consultation, it is unsurprising that there is variation in the structure and content of clinical ethics fellowship programs. However, this variation raises questions about the value of fellowship training when the ethicists that emerge from these programs might be quite different. The specifics of fellowship programs are largely internal. As such, the extent of variation and whether such variation is problematic remains unclear. In this (...) article, we summarize lessons learned from discussions between fellows, their mentors and program directors at the 2020 Clinical Ethics UnConference, and outline some possible ways to advance the conversation about variation in fellowship programs and training. We argue for the more open sharing of training specifics in order to help break down the siloed nature of fellowship programs. Greater transparency could, firstly, allow for more robust reflection on and refinement of training practices and, secondly, allow us to better balance professionally appropriate consistency with unavoidable or desirable variation based on local norms, culture and leadership. BackgroundTo help inform the development of more accessible, acceptable, and effective ethics consultation (EC) training programs, we conducted an EC training needs assessment, exploring ethics practitioners’ opinions on: the relative importance of various EC practitioner competencies; the potential market for EC training (that is, how many individuals would benefit and how much individuals and hospitals would be willing to pay); and the preferred content, format, and characteristics of EC training.MethodsAs part of a multipart study, we surveyed “best informants” who (...) self-identified as the person most actively involved in EC or healthcare ethics in a random sample of 600 U.S. general hospitals, stratified for bed size.ResultsThe competency that was ranked most important for a lead or solo ethics consultant was knowledge of ethics, while common sense was ranked least important. The median estimated number of individuals at each hospital who would benefit from EC training was six at the basic level, three at the advanced level, and two for EC management training. In 19.1 percent of hospitals, respondents thought their hospital would not be willing to pay anything for EC training within the next two years. Respondents thought potential trainees would be likely to participate in EC training on multiple different topics. Opinions varied widely on preferred formats. Most respondents thought it very important to be able to interact with instructors and with other trainees, practice EC skills, receive a certificate for completing EC training, and complete EC training during work hours.ConclusionsThese findings provide U.S. population data that may be useful to healthcare educators and bioethics leaders in their efforts to develop EC training programs and products that match trainees’ preferences and needs. Si la formation est l’une des principales formes de l’intervention en éthique, sa réussite est largement tributaire des contextes institutionnels dans lesquels les formateurs sont appelés à intervenir. Et dès lors que la compétence éthique est considérée comme le concept organisateur de cette formation – ou est à tout le moins largement mise de l’avant par des organismes tels que l’OCDE – la définition de ce concept imposera un design de formation, des pratiques d’enseignement mises en œuvre par le formateur (...) et, par conséquent, le type d’activités proposées dans la formation. D’où l’importance de s’assurer que la conception de la compétence éthique permet la prise en compte d’un maximum de variables présentes en milieu de travail afin de pouvoir en assurer son déploiement de manière efficiente. Nous partirons de ces constats pour proposer une approche pragmatiste du social dans le but de mieux prendre en considération les contextes d’action et les situations auxquelles sont confrontés les travailleurs. Ces éléments, qui doivent être pris en compte pour concevoir la compétence éthique, nous inciteront alors, par un simple retour des choses, à privilégier une conception pragmatiste de l’éthique et de la compétence éthique, ce qui implique aussi de revoir la gestion sur une note plus démocratique. Pour mener notre démonstration, nous rappellerons tout d’abord les modifications opérées dans les milieux de travail et leurs caractéristiques actuelles, en insistant sur les contraintes et les exigences de ces milieux à l’égard des travailleurs. Cela nous amènera alors à défendre une conception décentrée de l’éthique et de la compétence éthique pour favoriser un outil nous aidant à corriger les pratiques dans une démarche de formation continue, in situ, plutôt qu’une compétence conçue sur le mode technique du renforcement des comportements. The role of Hospital Ethics Committees is to support patients and their relatives as well as medical staff in solving ethical issues that arise in relation to the implementation of medical care. In Poland there are no clearly formulated legal regulations concerning the establishment and functioning of hospital ethics committees. Hospitals applying for accreditation are obliged to present solutions defining the way of solving ethical issues in a given institution, some of them appoint HECs for this purpose. The aim of (...) this study was to analyze information concerning the functioning of hospital ethics committees in Poland on the basis of publicly available data published on the websites of accredited hospitals. Very few accredited hospitals make public information about functioning in their ethics consulting facilities through hospital ethics committees. In most cases, the information provided on the functioning of HECs is general, both in terms of the committees’ functioning, type of cases under consideration and the composition of personnel. Background: Bioethics consultations are conducted in varied settings, including hospitals, universities, and other research institutions, but there is sparse information about bioethics consultations conducted in corporate settings such as pharmaceutical companies. The purpose of this article is to describe a bioethics consultation service at a pharmaceutical company, to report characteristics of consultations completed by the service over a 6-year period, and to share results of a consultation feedback survey. Methods: Data on the descriptive characteristics of bioethics consultations were (...) collected from 2008 to 2013 and analyzed in Excel 2007. Categorical data were analyzed via the pivot table function, and time-based variables were analyzed via formulas. The feedback survey was administered to consultation requesters from 2009 to 2012 and also analyzed in Excel 2007. Results: Over the 6-year period, 189 bioethics consultations were conducted. The number of consultations increased from five per year in 2008 to approximately one per week in 2013. During this time, the format of the consultation service was changed from a committee-only approach to a tiered approach (tailored to the needs of the case). The five most frequent topics were informed consent, early termination of a clinical trial, benefits and risks, human biological samples, and patient rights. The feedback survey results suggest the consultation service is well regarded overall and viewed as approachable, helpful, and responsive. Conclusions: Pharmaceutical bioethics consultation is a unique category of bioethics consultation that primarily focuses on pharmaceutical research and development but also touches on aspects of clinical ethics, business ethics, and organizational ethics. Results indicate there is a demand for a tiered bioethics consultation service within this pharmaceutical company and that advice was valued. This company's experience indicates that a bioethics consultation service raises awareness about bioethics, empowers employees to raise bioethical concerns, and helps them reason through challenging issues. Background: Although ethics consultation has been introduced to clinical practice for many years, the results of empirical studies to evaluate the effectiveness of ethics consultation are still controversial. The design of randomised controlled trials is considered the best research design to evaluate the effect of a clinical practice on the outcomes of interests. In order to understand the effects of ethics consultation, we conducted this search for studies with the design of randomised controlled trials to evaluate ethics (...) consultation.Objective: To provide an integrated review of studies with the design of randomised controlled trials to evaluate the effectiveness of ethics consultation.Methods: PubMed was used to search for studies using the randomised controlled trial design to evaluate the effectiveness of ethics consultation. The search term used was “ethics consultation”. The selection criterion was limited to “randomised controlled trial”.Results: Four articles that met both search criteria were retrieved. One of these articles reported a study that did not actually use the design of a randomised controlled trial and is excluded from the following discussion.Conclusions: To apply randomised controlled trials to evaluate the effectiveness of ethics consultation is extremely difficult as long as two issues are not resolved: the standardisation of ethics consultation and a placebo for ethics consultation to eliminate the placebo effect. Thus, the results generated by the design of randomised controlled trials are always problematic. Furthermore, as long as the two issues exist, the results generated by the design of quantitative research methods always pose problems. (shrink)

Cet article remet en question les fondements théoriques et pédagogiques de la notion de compétence éthique ainsi que la conception de l’éthique qu’elle préfigure. Après une analyse du contexte d’émergence de cette notion, notamment dans le champ de la santé, nous verrons en quoi l’approche socioconstructiviste de l’apprentissage, à laquelle se réfèrent de nombreux dispositifs de formation, fait de l’éthique une ressource d’action visant l’adaptation passive des professionnels au contexte organisationnel et socioprofessionnel. Nous proposerons dès lors de revisiter l’apprentissage de (...) l’éthique dans une approche pragmatiste plus critique et plus émancipatrice. Nous en exposerons les principales orientations pédagogiques et insisterons, pour conclure, sur la responsabilité des environnements socioprofessionnels. BackgroundClinical ethics consultations can be complex interventions, involving multiple methods, stakeholders, and competing ethical values. Despite longstanding calls for rigorous evaluation in the field, progress has been limited. The Medical Research Council proposed guidelines for evaluating the effectiveness of complex interventions. The evaluation of CEC may benefit from application of the MRC framework to advance the transparency and methodological rigor of this field. A first step is to understand the outcomes measured in evaluations of CEC in healthcare settings. ObjectiveThe primary (...) objective of this review was to identify and map the outcomes reported in primary studies of CEC. The secondary objective was to provide a comprehensive overview of CEC structures, processes, and roles to enhance understanding and to inform standardization.MethodsWe searched electronic databases to identify primary studies of CEC involving patients, substitute decision-makers and/or family members, clinicians, healthcare staff and leaders. Outcomes were mapped across five conceptual domains as identified a priori based on our clinical ethics experience and preliminary literature searches and revised based on our emerging interpretation of the data. These domains included personal factors, process factors, clinical factors, quality, and resource factors. ResultsForty-eight studies were included in the review. Studies were highly heterogeneous and varied considerably regarding format and process of ethical intervention, credentials of interventionist, population of study, outcomes reported, and measures employed. In addition, few studies used validated measurement tools. The top three outcome domains that studies reported on were quality, process factors, and clinical factors. The majority of studies examined multiple outcome domains. All five outcome domains were multidimensional and included a variety of subthemes.ConclusionsThis scoping review represents the initial phase of mapping the outcomes reported in primary studies of CEC and identifying gaps in the evidence. The confirmed lack of standardization represents a hindrance to the provision of high quality intervention and CEC scientific progress. Insights gained can inform the development of a core outcome set to standardize outcome measures in CEC evaluation research and enable scientifically rigorous efficacy trials of CEC. (shrink)

Research within the H2020 PROGRESSIVE project has identified good practices in user co-production strategies and methodologies. Early findings from research in the PROGRESSIVE project were shared with relevant stakeholders outside the consortium for consultation and review. The outcomes of that initial investigation highlighted the need to focus on the objectives, processes, and methods used in user and older people co-production. This guide adapts these insights and makes them relevant specifically for standardisation in ICT for active and healthy ageing. All over the world, many individuals (scientists, intellectuals, citizens) today believe in the inevitability of a collapse of our civilization and their existence is profoundly disrupted: can they still plan to start a family? Should they continue their studies, or (...) should they start preparing for survival today? Does existence still have any meaning? In clinical ethics consultations, we are confronted with requests for definitive contraception for environmental reasons that put the medical profession and the very foundations of clinical ethics in difficulty. Probably the most interesting feature of the 40-year history of biomedical biotechnology is the extent to which it has been open to – and influenced by – concerns over social values and the public’s voice. Good intentions notwithstanding, however, benchmarks and best practices are woefully lacking for informing the policy-making process with public values. This is particularly true in the United States where the call for “public debate” is often heard but seldom heeded by policy-making bodies. Geneforum, an Oregon-based non-profit, (...) has developed a practical and working model designed to encourage deliberative democratic processes for addressing the ethical and social issues raised by emerging biotechnologies. Ordinary citizens do not need to be scientists to understand the important implications of the new technological advances. When factual information and basic principles are conveyed in linguistically and culturally appropriate ways, the scene is set for a shift from monologue to dialogue, from “I-thinking” to “We-thinking,” to occur. This paper describes the Geneforum model structured to intensify the democratization of policy decision-making, in general, using genomic science, in particular, as one example of its application. La notion de compétence demeure singulièrement complexe à penser dans les dispositifs de formation. Généralement définie comme savoir-agir situé, elle est souvent réduite à son acception instrumentale, rendant flagrante l’opposition entre théorie et pratique dans la formation universitaire à visée professionnalisante. Cette conception de l’apprentissage interroge la place de la pratique dans les dispositifs de formation : simple redondance ou lieu d’un véritable apprentissage? Pour dépasser cette opposition entre théorie et pratique qui se niche dans les définitions mêmes de la (...) compétence, nous proposons une lecture pragmatiste de la notion de compétence, en menant l’enquête avec John Dewey. Nous serons ainsi invités à penser la compétence comme un processus appartenant au continuum de l’expérience et à interroger le principe même de l’enseignement d’une compétence éthique. (shrink)

Les « approches » ou « démarches compétences » sont à l’ordre du jour et se multiplient dans les entreprises, les organisations, les administrations publiques, les universités. Mais permettent-elles de faire confiance aux professionnels concernés? Constatant que la plupart de ces démarches sont fondées sur des additions et des classifications de compétences, j’ai créé, dès 1994, la définition de la compétence en termes de « savoir agir avec pertinence en situation en créant et mobilisant une combinatoire de ressources variées internes (...) et externes ». J’expose dans le présent article les changements de raisonnement qui m’ont conduit à faire évoluer les paradigmes avec lesquels sont traitées les approches par compétences. C’est par rapport à ce changement de paradigme que je précise comment j’aborde le concept de « compétence éthique » en le situant par rapport au paradigme que j’expose et en proposant quelques pistes pour la formation à l’éthique appliquée. The development of ethics case consultation over the past 30 years, initially in North America and recently in Western Europe, has primarily taken place in the secondary or tertiary healthcare settings. The predominant model for ethics consultation, in some countries overwhelmingly so, is a hospital-based clinical ethics committee. In the United States, accreditation boards suggest the ethics committee model as a way of meeting the ethics component of the accreditation requirement for payment by Health Maintenance Organizations, and in (...) some European countries, there are legislatory requirements or government recommendations for hospitals to have clinical ethics committees. There is no corresponding pressure for primary care services to have ethics committees or ethics consultants to advise clinicians, patients, and families on the difficult ethical decisions that arise in clinical practice. Group process consultants use themselves as instruments of intervention at the micro, meso and macro levels, and therefore need to have a deep sense of personal self-awareness and self-regulation as they serve as complex dynamic containers of group consultation processes. In this paper, I proceed from an ethnographic perspective to describe, reflect on and explore my emotional and cognitive lived experiences as consultant to participants’ diversity encounters during a Robben Island Diversity Experience (RIDE) event in South Africa. Nineteen participants (...) attended the event. It became clear that discussions were enhanced when the consultant was able to tap into somatic experiences as an additional source of information. The understanding of my consulting role experience may assist both current and emerging consultants in this and similar paradigms to gain insight into the impact of their own psychological disposition and socio-demographic profiles in contributing towards the deconstruction or formation of a good-enough consulting container. He provided an extensive list of citations about ethics consultations collected by him and by David Schiedermayer, M.D., for their new book Ethics Consultation: A Practical Guide.)In Ethics (...) Consultation in Health Care, editors John Fletcher, Norman Quist, and Albert R. Jonsen (I, 1989) define ethics consultation as "the provision of specialized help in identifying, analyzing, and resolving ethical problems that arise in clinical care. In medical ethics the area of consultation has grown rapidly since 1978 when Edmund D. Pellegrino (II, 1978) noted, "we cannot separate technical-moral decisions from the philosophic principles we use to justify them. Medicine and ethics must be engaged with each other at every level."In 1980 Albert Jonsen raised the question of whether an ethicist could be a consultant and said that the ethicist as consultant is a casuist, one whose moral reasoning is based on a system of reasoning that is applied to particular cases. He describes historical casuistry in Western culture, comparing it to modern moral philosophy, and suggests that a "new casuistry seems timely" for ethics consultation (II, Jonsen 1980). By 1984 ethicist Ruth Purtilo recorded her thoughts following an ethics consultation. A health care institution's eligibility for JCAHO accreditation, which is required for federal reimbursement, requires adherence to this specification (III, JCAHO 1992).The new International Directory of Bioethics Organizations provides an index of 129 different groups that indicated to the authors that they offer bioethics consultations. Of these, 83 are in the United States and 46 are in other countries. The ethics consultants included in the directory encompass a broad group of professionals who will assist patients, families, and primary care medical staff in finding solutions to ethical dilemmas resulting from use of new technologies or new treatments in health care. Consultants often come from the health fields: physicians, nurses, and other health personnel, but other professionals are also active as ethics consultants. “Chiaroscuro” is a art technique that makes use of light and shade to suggest depth and solidity on a flat surface. I argue that the standards regarding accountability in the second edition of the Core Competencies for Healthcare Ethics Consultation , are chiaroscuro, because, despite the offered lists of competencies, it is very difficult to imagine how consultants might be held accountable to such standards. It is not clear to which of the many suggested standards a consultant should be (...) held accountable, and even if one stipulates that only the tabulated competencies are meant as standards, the vague wording makes it hard to know how a consultant might fail to meet the standards or perform excellently. In addition, because terms such as “ethics” and “ethical” are not defined in the document, we are left with no way to determine whether consultants have made appropriate recommendations. The document is useful as a point of discussion, but not yet ready to serve as a tool for holding practitioners accountable. (shrink)

The movement advocating the formal certification of clinical ethics consultants may result in major changes to the field of clinical ethics consultation by creating a new standard of care. The actual certification process is still in the development phase, but unanswered questions include: What will certification cost, and, Who will pay? Currently there is little salary support for ethics consultants and no regulation requiring healthcare institutions to offer clinical ethics consultation. Without the support of healthcare administrators and accreditation (...) bodies, this may remain unchanged.Healthcare administrators may be unwilling to pay for certification or professional services if accreditation bodies do not require healthcare institutions to provide certified ethics consultants’ services. If consultants will not be reimbursed or paid, they may not seek certification. If certified consultants are required, healthcare administrators may look for ways to cover the costs for providing this service, including insurance or third-party reimbursement and direct billing of patients for consultations, which may affect who performs and who participates in ethics consultation. However, this is less than ideal, as bioethicists believe ethics consultation should be available to all as part of providing safe, quality ethical care and support and guidance for patients, families, and healthcare staff.Going forward, bioethicists should study quality improvement, patient safety, and cost-savings resulting from certification-eligible clinical ethics consultants’ activities. Administrators and financial personnel can be surveyed regarding their support for the certification process. Bioethicists should enlist the help of patient rights and safety advocacy groups, professional medical associations, and healthcare administrators. Bioethicists should invite accreditation bodies, healthcare administrators, and financial personnel to collaborate in the development of the certification process. Without their support, certification may be of value only to the bioethics community, and may have little standing in actual clinical healthcare institution settings. (shrink)

As clinical ethics consultants move toward professionalization, the process of certifying individual consultants or accrediting programs will be discussed and debated. With certification, some entity must be established or ordained to oversee the standards and procedures. If the process evolves like other professions, it seems plausible that it will eventually include a written examination to evaluate the core knowledge competencies that individual practitioners should possess to meet peer practice standards. The American Society for Bioethics and Humanities has published core knowledge (...) competencies for many years that are accepted by experts as the prevailing standard. Probably any written examination will be based upon the ASBH core knowledge competencies. However, much remains to be done before any examination may be offered. In particular, it seems likely that a recognized examining board must create and validate examination questions and structure the examination so as to establish meaningful, defensible parameters after dealing with such challenging questions as: Should the certifying examination be multiple choice or short-answer essay? How should the test be graded? What should the pass rate be? How may the examination be best administered? To advance the field of health care ethics consultation, thought leaders should start to focus on the written examination possibilities, to date unaddressed carefully in the literature. Examination models—both objective and written—must be explored as a viable strategy about how the field of health care ethics consultations can grow toward professionalization. (shrink)

In this study, Canadian healthcare ethics consultants describe their use of ethics decision-making frameworks. Our research finds that ethics consultants in Canada use multi-purpose ethics decision-making frameworks, as well as targeted frameworks that focus on reaching an ethical resolution to a particular healthcare issue, such as adverse event reporting, or difficult triage scenarios. Several interviewees mention the influence that the accreditation process in Canadian healthcare organizations has on the adoption and use of such frameworks. Some of the ethics consultants we (...) interviewed also report on their reluctance to use these tools. Limited empirical work has been done previously on the use of ethics decision-making frameworks. This study begins to fill this gap in our understanding of the work of healthcare ethics consultants. Background Ethically, informed consent regarding randomised controlled trials (RCTs) should be understandable to patients. The patients can then give free consent or decline to participate in a RCT. Little is known about what patients really understand in consultations about RCTs. Methods Cancer patients who were asked to participate in a randomised trial were surveyed using a semi-standardised interview developed by the authors. The interview addresses understanding, satisfaction and needs of the patients. The sample included eight patients who participated in a (...) trial and two who declined. The data were analysed on the basis of Mayring's qualitative analysis. Results Patients' understanding of informed consent was less developed than anticipated, especially concerning key elements such as randomisation, content and procedure of RCTs. Analysing the result about satisfaction of the patients, most of the patients described their consultations as hectic and without advance notice. Health limitations due to cancer played a decisive role. However, most of the patients perceived their physician to be sympathetic. Analysing the needs of patients, they ask for a clear informed consent consultation with enough time and adequate advance notice. Conclusion This study fills an important empirical research gap of what is ethically demanded in an RCT consultation and what is really understood by patients. The qualitative approach enabled us to obtain new results about cancer patients' understanding of informed consent, to clarify patients' needs and to develop new ideas to optimise the informed consent.
