Antalya, which is today’s attraction center with its historical and natural beauties, was described as “a city like heaven” since ancient times. This city hosted many civilisations and states until the 13th century and became an important seaport after The Seljuks took over the region. The Seljuks applied civilization and urbanization policy also in Antalya, like other regions they ruled. The mosques, madrasahs (Islamıc theology institutions), schools, baths, caravansearis (hostels), hospices, and water cisterns in this period changed the structure of (...) the city and paved the way for improvements of public life. During the Ottomans some of these social institutions were kept active while the others no longer served to the public. However, with the construction of new social institutions, urbanization was resumed. The madrasas were generally built near or adjacent to the mosques, and had a significant role in developing the society and cultural structure. Although the madrasas in Antalya were mainly the institutions that maintain the education system, the research on these madrasas mostly focuses on their architectural features. The majority of these madrasas that are not comprehensively studied. Therefore, the functioning structures and the problems of Antalya Madrasas (Antalya, Korkuteli and Elmalı), which are reflected in the archive documents between the 17th and 20th centuries and also both individuals and institutions that had influence on these madrasas are going to be investigated in this study. Thus, this paper will shed more light on Antalya Madrasas.Summary: Antalya city, which was completely under the Seljuk sovereignty during the reign of Sultan Alaeddin Keykubat I (1219-1236), was named as Alâiyye dedicated to the Sultan's name and became an important port city of the Seljuk State after then. In the process of the fall of the Seljuk State and the beginning of the Emirates (Beylikler) period, the city became a land of Teke-Oğulları, a part of a Hamid-oğulları, and in 1390 the city became an Ottoman city after the struggle of Yıldırım Bayazid with Teke-oğuları. Antalya was home to the madrasahs, one of the formal education institutions during both the Seljuk and the Ottoman Empire. The madrasahs were built next to the mosque or in a detached area built by sometimes administrators or statesmen, sometimes by members of the dynasty or by the citizens who were wealthy. In Antalya, both single floor and second floor madrasahs were built. This study based on the documents from Prime Ministry Ottoman Archive, the travel books of İbn Bibi and Evliya Çelebi, the works on Antalya Madrasahs to be determine the madrasah in the districts of Antalya as Korkuteli and Elmalı. In addition to the Seljuk madrasahs such as Imaret Madrasah, Atabey Armagan Madrasah and Karatay Madrasah, there are also some madrasahs belonging to the Ottoman period, in Antalya. As a matter of fact, the madrasahs increased in number in the period of the Ottoman. Antalya madrasahs which are reflected in archival documents for any reason are as follows: “Süleyman Madrasah” located in Hatip Süleyman Street, “Madrasah built by Haci Mahmed” located in Elmali Street, “Hacı Abbaszâde Hacı Süleyman Madrasah” in Süleyman Street, “İsmail Efendi Madrasah” in Tahtapazarı Kızılsaray Street, Kasab Hacı Ahmed Madrasah, Hacı Cafer Ağa Madrasah, Murad Ağa Madrasah, Esir Hacı Ali Madrasah, Hacı Hasan Madrasah,“Madrasah built by Hasan Efendi” in Keçiyalar Street, in the Kadılar Street of Gediz County “Madrasah built by Yusuf Efendi”, “Madrasah built by Hızır Efendi” in Cami-i atik Street, Murat Pasha Madrasah, “Sefer Ağa Madrasah” located outside the city wall, “Büyülü Minaret Madrasah, Hatuniye Madrasah, Sheik Sinan Camii Madrasah located outside the city Wall, In addition to these madrasahs mentioned in some studies in Antalya, it is also stated that there are madrasahs such as Müsellim Madrasah, Kesik Minaret Madrasah, Karakas Madrasah, Varsakli Mehmet Efendi Madrasah, Meydan Madrasah, Surmeli Madrasah, Canmülk Madrasah, Ahi Kız Madrasah, Hacı Naim Efendi Madrasah, Susam Madrasah, Çömlekçi Madrasah, Değirmenönü Madrasah, Ak Mescid Madrasah, Âşık Doğan Madrasah and Çukur Madrasah.According to archive documents, in the sub-district of Antalya, which is used as a plateau or plateau area, some madrasahs were recorded as follows: Pınarbaşı Madrasah, Hızır Efendi Madrasah, Mustafa Efendi Madrasah, Emir Sinaneddin Madrasah, Hacı Menlü (Mevlüt) oğlu Ömer Medrese, Abu Bakr Agha Madrasah, Koca Hafız Medrese, Hacı Mollaoğlu El-Hac Ömer Madrasah, Sheikh İsmail Efendi Madrasah. However, Süleyman Fikri Erten, who works on Antalya, stated that the number of madrasahs is eight as: Haci Ahmet Madrasah of Kalkanlı, Sultan Hatun Madrasah, Koparanzade Hacı Hüseyin Madrasah, Karabayırlı Hacı Hüseyin Madrasah, Kaşlı Ali Efendi Madrasah, Hacı Hüseyin Madrasah, Şalaka Ahmet Madrasah and Oyunyeri Madrasah.The madrasahs built in Elmalı, another distict of Antalya, were as follows: Ketenci Ömer Paşa Madrasah, Esbak Mir-i Ahur Hacı Mehmet Bey Madrasah, Haydar Baba Madrasah, Arifî Ahmed Paşa Madrasah, Hüseyin Efendi Madrasah, Debbağ Baba Madrasah, Şeyh Ümmi Sinan Madrasah, Babazade Hacı Abdurrahman Madrasah, Hacı Şeyh Efendi Madrasah, Mustafa Efendi Madrasah, Hasan Efendi Madrasah, Salih Efendi Madrasah, Halil Efendi Madrasah, Çankırlı Madrasah, Osman Efendi Madrasah and “Mehmet Efendi Madrasah in Örtekiz village”. In addition, two madrasahs, except from these, were also found in the archive documents.A madrasah was built almost at every Street of Antalya and the madrasahs were usually named by the name of their builders. Madrasah students were provided with a certain amount of scholarship to continue their education according to the level of the education in the madrasahs and the level of the courses taught, salaries of the scholars, the status of the builder of the madrasah. The scholars who worked in the madrasahs worked with a document called berat-i sharif and in the case of the disappearance of this document a new berat-i sharif would be prepared by the Shaykh al-Islami. Scholars working without this document were also determined. In the scholar appointments foundation, board of trustees, müfti, and the city regents were very influential. There were also some appointments resulted from death, promotion besides leaving job with their own will. There were some problems with the appointments in Antalya and the foundation revenues to which the madrasah was attached were delivered to certain individuals until these problems were resolved.In madrasahs of Antalya, science was given a great importance and all kinds of monetary issues were tired to be eliminated with donations given to both scholars and students. However, it is observed that madrasahs were involved in some events in Antalya. As a matter of fact, among those who participated in the Şah Kulu Rebellion that took place in 1510-1511, there were also madrasah students and education training had therefore been disrupted for a long time. it is known that the state sent orders to the judges (qadi) in the region consecutively in order to prevent the rebellion. Also during this period some madrasahs were used as the activity center of armed students or people who disguised them.One of the issues that negates the education and training in the madrasahs in Antalya is that in 1890 the immigrants started to be hosted in Antalya and the guests visiting were accommodated in madrasahs as there were no other available places. This situation had been continued for a long time and even telegrams have been sent about the students living on the sidewalks.Another important issue that disrupts education was epidemic diseases. It was reported that too many people died in the district of Istanoz because of smallpox, there was no doctor and the health personnel should go to the region urgently. Despite all the problems experienced in madrasahs, they continued their activities in Antalya and while continuing their activities under the control of foundations in 1826, with the establishment of the Ministry of Foundations, they were connected to this institution. Bu konudaki kafa karışıklığı konuyla ilgi araştırmacıları farklı değerlendirmelere sevk etmektedir. Erzurum Erzen’i ve Siirt Erzen’i hakkında kaynaklarda verilen bilgiler de zaman zaman birbirlerinin yerine kullanılabilmekte ve Erzurum’un fetih tarihi hakkında yanlış değerlendirmelere sebep olmaktadır. Hz. Peygamber’in Medine’ye hicretinden sonra henüz bir yıl geçmeden Mescid-i Nebevî inşa edilmiş ve bu esnada Bakī’ Mezarlığı da teessüs etmiştir. Bakīu’l-Garkad, Cennetü’l-Bakī’ gibi adlarla da anılan Bakī’ Mezarlığı’na ilk defnedilen kişinin kim olduğu mevzuunda birbirinden farklı rivayetler bulunmaktadır. Bu hususta, ilk defnedilen sahâbînin Ensar’dan Es’ad b. Zürâre veya Muhacirlerden Osman b. Maz’ûn olduğu şeklindeki rivayetler ön plâna çıkmaktadır. Bu makalede, Osman b. Maz’ûn’un vefat tarihi ile ilgili rivayetler bağlamında onun Bakī’ Mezarlığı’na ilk defnedilen kişi olup olmadığı konusu ele alınmaktadır. (...) Bu makalede ele alınacak rivayetler çerçevesinde ortaya konulacak bilgiler, Bakī’ Mezarlığı’nın teşekkül tarihine ışık tutmuş olacaktır. Bakī’ Mezarlığı’nın teessüsü ve ilk defnedilenlerle ilgili rivayetlerin müstakil olarak analiz edilmemiş olması bakımından konu önem arz etmektedir. İslâm tarihi kaynaklarında sahabe arasında yaşanan hadiseler hakkında pek çok rivayet bulunmaktadır. Ancak bu rivayetlerin tamamının sahih olmadığı ehlinin malumudur. Binaenaleyh bu tür tarihî rivayetlerin tahlil edilmesi, tenkide ve kritiğe tabi tutulması gerekmektedir. Çünkü sahabe konusundaki düşünce ve kanaatlerimiz, başta Kur’an’ın anlaşılması olmak üzere İslâm’ın kaynak, kavram ve kurumlarıyla ilgili anlayışımızı belirleyecek ve dinî telakkimize de doğrudan yansıyacaktır. Bu durumda araştırmacıların vazifesi, sahabe ile ilgili rivayetlerin sahih olanlarını tespit etmek ve bu sahih rivayetler ışığında doğru değerlendirmeler yapmaktır. Bu çalışmada, sahabenin (...) önde gelenlerinden Ammâr b. Yâsir hakkındaki bazı haberler, özellikle Halife Hz. Osman’ın ona karşı sergilediği tutum ve tavırlar ile ilgili olarak ilk dönem İslâm tarihçilerinden Belâzürî’nin derlediği rivayetler eleştirel bir bakış açısıyla ele alınmakta, sened ve metin açısından tenkide tabi tutularak incelenip değerlendirilmektedir. Bu bağlamda Hz. Osman’ın Ammâr’ı dövdüğüne veya Medine’den sürgün etmek istediğine dair nakledilen rivayetlerin bir kısmının senedlerinin sâkıt olduğu, bazılarının ise sened açısından sahih olmadığı ve daha ziyade Şiî temayüllü olduğu vurgulanmaktadır. Mezkûr rivayetlerin içerik açısından da birbirleriyle uyuşmayıp tenkide ve tartışmaya açık olduğu ve bu rivayetlerden hareketle yapılan yorum ve yaklaşımların sağlam delillere dayanmayıp isabetli olmayan bir kısım iddialardan ibaret olduğu okuyucuların dikkatine sunulmaktadır. Amaç, bazı sahabilerin birbirlerine karşı tutum ve tavırları hakkında daha doğru ve gerçekçi değerlendirmeler yapılmasına imkân sağlamak ve İslâm toplumunda yaşanan bazı sorunların sebep ve sonuçlarının daha sağlıklı tahlil edilmesine yardımcı olmaktır. Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her (...) bir aşamada ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

Pathways to Contemporary Islam: New Trends in Critical Engagement highlights that the current tensions in Islam and the Muslim world are the result of historical dynamics as opposed to an alleged incompatibility between religious tradition and modernity. The emphasis on pathways indicates that critical engagement and contestation have always been intrinsic to the history of Islam. The aim of the book is to elaborate the contemporary pathways and analyse the trends that contest the Islamic intellectual tradition, the relationship between religion (...) and politics, and the individual and collective practice of religion. The collection of essays analyses the current efforts of critical re-engagement with the Islamic intellectual tradition and underlines the historical diversity of Islamic orthodoxies that led to the establishment of various pathways in the practice and role of religion in Muslim societies. Turkish culture is based on tolerance, the product of the unique Islam–Turkish synthesis. This synthesis is crucial today for a more balanced perception of Islam because it opposes extremism and the terror that is associated with it. The Turkish–Ottoman Empire followed earlier traditions and set up a system based on tolerance towards its ethnically diverse subjects. It was due to this exceptional system assuring stability and freedom of conscience that the Empire was able to hold together people of different religions, (...) languages and races, and to protect and preserve different cultures and languages. This tradition of tolerance and harmony lives on in modern Turkey. Although today there are bound to be certain misinterpretations of Islam, the majority of Turks firmly oppose intolerance and terrorism. (shrink)

In most countries where Islam is acknowledged as a, or the, source of legislation, abortion is permitted under certain conditions and at certain stages of pregnancy. This article examines some of these laws and argue that they represent a continuation of the logic that governed the views of pre-modern Muslim jurists on abortion, that is, harm aversion. However, these laws also add a ‘modernist’ twist to that logic – rather than repealing that logic altogether, modernist views on ‘rights’ and the (...) advancement of medical knowledge and technology have influenced the priorities of Muslim jurists and lawmakers as far as abortion and the issues associated with it are concerned. This influence has furthermore been possible by a conscious selection and blending of pre-modern views to serve modern concerns. In all this, however, harm aversion remains the centrifugal principle, even when the abortion discourse in Muslim countries appears couched in the modernist discourse of rights. (shrink)

Contemporary Islamic management scholars have agreed that values are embedded in quality management. Their agreement is grounded on the famous prophetic tradition encouraging diligence in work, uttered more than 1400 years ago, which has been narrated authentically. However, little studies have specifically indicated its application in quality management activities. As quality management is initiated in the West, little attention has been given to Islamic perspective of the discipline. However, as the Japanese had successfully implemented quality management in their cultural value (...) perspective, many parties come to acknowledge the significance of values. In the literature, various Islamic values have been linked to quality management practice. While studies analyzing and categorizing them is limited, several values are redundant or being termed differently, though they are similar in crux. This article compiles the values and categorizes them depending on similar bases of Quranic verses or Prophetic traditions. The categorization proposes a set of Islamic values related to quality management practice, based on a simple frequency analysis matrix. Bu çalışmada İmam Mâlik’in/Mâlikîlerin necasetler ve kadınların özel halleriyle ilgili üç sünni mezhep başta olmak üzere cumhura muhalefet ettiği ve bu mezhebin karakteristiği haline gelen bazı temel meselelerden yola çıkılarak onların Hicaz bölgesi kaynaklı bir mezhep olarak eser çizgisinde mi rey çizgisinde mi yahut bu iki arasında olup esere mi daha yakın olduğu ihtimallerini ortaya koymak amaçlanmıştır. Bu noktada Mâlikîlerin ve diğer mezheplerin muteber klasik kaynakları ile “ihtilâfu’l-fukahâ” türünden eserlere müracaat edilmiştir. Ele alınan örneklerde Mâlikîlerin görüşleri şöyledir: Suların pislenmesi konusunda (...) Mâlikîler suyun azlık ya da çokluk ölçüsünü değil suyun rengi, tadı ve kokusu gibi temel vasıflarından birinin değişip değişmediğini esas alarak hüküm vermişlerdir. Eti yenen hayvanların idrar ve dışkıları konusunda eti yenen hayvan necis bir şeyler yeyip içmemişse bunların hem idrarları hem de dışkılarının temiz olup, namaza engel olmadığı görüşünü benimsemişlerdir. Köpeğin kendisinin ve yaladığı kabın temiz olup olmadığı konusunda Mâlikîler köpek ve domuz dahil canlı olan her hayvan -necis bir şey yemiş olsa bile- temiz olduğu görüşünü savunmuşlardır. Hayzın herhangi bir alt sınırının olup-olmadığı noktasında bunun alt bir sınırının olmadığı ve bir defalık kanama yani kısa bir müddet kanın gelmesinin âdetin sübutu için yeterli olduğunu görüşünü benimsemişlerdir. Âdetli kadının Kur’an okuması meselesinde ise bu durumda olan kadının Kur’an’a dokunmasının yasak olduğu, fakat onu dokunmadan okuyabileceği görüşünde olmuşlardır. Hatta öğretici veya öğrenci olanlar zaruret miktarınca eğitim amacıyla ruhsat hükümden faydalanarak Kur’ân’a hem dokunabilir hem de onu okuyabilir. Elde edilen bulgular neticesinde İmam Mâlik’in/Mâlikîlerin maslahat ve istihsanı kullanmada öne çıkan bir mezhep olarak reyi kullanmakla birlikte, genel olarak nasların umumundan veya mutlaklığından hareket ettikleri, görüşlerine aykırı özel nasları mutlaka usule ait bir yöntemle te’vil ettikleri yahut cerh ve ta’dil yoluna başvurdukları veya meşru gerekçeleri olan istihsan yoluyla terk ettikleri, dolayısıyla esere daha yakın oldukları ve Hicaz fıkhını temsil ettikleri sonucuna ulaşılmıştır. İslam tarihinde Müslüman topluluk içinde ilk fikrî ve fiilî anlaşmazlıklar Hz. Peygamberin (s.a.v.) vefatının ardından başlamış daha sonra Hz. Osman ve ardından Hz. Ali döneminde olayların büyümesiyle Hâricîlik mezhebi tarih sahnesine çıkmıştır. Sıffîn savaşını bitirmeyi ve Müslümanlar arasında barışı temin etmeyi hedefleyen Tahkîm olayı başka bir ayrılıkla neticelenmiş, Kur’ân’ı-Kerîm’in hükümlerine uyulmadığı gerekçesiyle Müslüman topluluktan büyük bir grup ayrılarak Nehrevan’a çekilmiştir. Çoğu taşradan gelmiş, eğitim seviyesi düşük askerlerinden oluşan ve daha sonra Hâricîler diye isimlendirilen bu grup, kendi içlerinde de anlaşamamış (...) pek çoğu aşırılık yanlısı bir tavırla Emevî ve Abbasî Devletleri döneminde isyan etmiş ve muhtelif şiddet olaylarına karışmıştır. Hicrî üçüncü asrın sonlarında İbâdiyye hariç, başta Ezârika olmak üzere aşırılığa meyleden veya şiddete başvuran Hâricî gruplar dağılıp yok olmuştur. Hâricî kitleler içerisinde ortaya çıkmış olan İbâdiyye kendi dönüşümünü sağlayarak ve hatta fikir ve yöntemlerindeki yumuşaklık sebebiyle halktan gerekli desteği alarak bir yandan Kuzey Afrika’da 132 yıl hüküm süren Rüstemîler Devletini kurarken diğer yandan da fikrî bünyesini inşa etmiştir. Günümüzde Kuzey Afrika, Umman ve Zanzibar’da yedi milyona yakın nüfusa sahip olan bu mezhep pek çok açıdan etüt edilmeyi hak eden bir topluluk ve bir fikir akımıdır. İbâdiyye, hicrî ikinci asra dayanan yazılı eserleri ve yüzyıllarca biriktirdiği deneyimi ile İslam dininin inanç, davranış ve siyaset esaslarının tedvini için sosyo-politik zeminin anlaşılmasında değerli verilere sahiptir. Öte yandan mezhebin her açıdan objektif olarak ele alındığını söylemek mümkün görünmemektedir. Hicrî üçüncü asrın sonlarından itibaren yazılan fırak ve makālât türü eserlerde çeşitli gerekçelerle Hâricîlik için kullanılan pek çok yerici ifade, aidiyeti iyice araştırılmadan İbâdiyye’yi teşmil edecek şekilde kullanılmıştır ve halen de kullanılmaya devam etmektedir. Burada asıl dikkat edilmesi gereken önemli bir husus, ehl-i biꜤdat yahut ehl-i küfre ait olduğu değerlendirilen pek çok şahıs, düşünce veya ekolün ilmi açıdan tevsiki yapılmadan İbâdiyye’ye nispet edilmiş olabileceğidir. Bu makalede İbâdiyye’nin tarihi derinliklerine inilerek hem inanç sahasına yeni birtakım fikir veya tespitleri kazandırmak hem de mezhebin doğru bir şekilde anlaşılmasına katkı sunmak için İbâdiyye’ye nispet edilen bazı fikir, şahıs yahut alt grupların durumu ele alınmıştır. Kin marriages have been a subject of literary, historical, sociological, religious, and medical studies from past to present. Such a marriage has been discussed within the science of fiqh in terms of religion. Ḥanafī and Mālikī mujtahids stated that this marriage is permissible. While Shāfiʿī and Ḥanbalī mujtahids did not recommend kin marriage by seeing it permissible. Based on the fundamental doctrines of Islamic law, they argued that marrying a foreign candidate is mustahabb and answered the related criticisms against their (...) fatwa. In scientific studies, genetic risks in kin marriages were found to be twice as high. Therefore, the kin marriage was not recommended and it is suggested that those who will marry with relatives should undergo carrier tests. In some contemporary religious studies, it has been argued that the families established by kin marriages are stronger, the genetic research does not have absolute precision, and it may be ideological in the form of weakening the family-society structure. Besides, the ijtihads distant to close kin marriage is weak in terms of evidence and opposing evidence has been put forward to defend kin marriage. On the other hand, in some sociological studies, it has been argued that kin marriage is predominantly caused by religion and that it wekaned the social solidairty. This study analyzes the classical and contemporary approaches to kin marriage in detail within the framework of thesis-antithesis in terms of fiqh, uṣūl al-fiqh, and evidence, and evaluates such studies from a fiqh point of view by including medical research results and some sociological studies on kin marriage. A generally accepted deterministic link cannot be established between kin marriage and genetic disorders. Because, the same risks are found in marriages with foreigners and also arise from harmful substance addiction. However, the genetic risk rate in marriage with close relatives is twice that of marriage with a foreign candidate. The least of the two possible losses is preferred. So it is very sensible that a marriage that is twice as likely to take such a risk should not be recommended by religion. Because, the main purpose of religion in marriage is to protect the generation and ensure its continuation. The fact that such a marriage is not religiously prohibited does not mean that it was recommended. Because it is left to individuals and public authority to limit the ibaha on the grounds of maṣlaḥa. On the grounds that the hereditary risk rate is high, kin marriage is not recommended in the fiqh and an effort has been made to prevent such a marriage from becoming widespread. Sociologically, marriages with a foreign candidate who is equivalent to a close relative are more appropriate in terms of strengthening the social organization. It is seen that Shafi'i and Hanbali ijtihad, which do not recommend close relatives marriage, are supported by current medical and genetic research. It is understood that the ijtihads that does not recommend marriage with close relatives is inaccurate in terms of evidence, and the views that argue that such marriages are stronger in terms of benefits are not in place. In general, it is seen that religion is distant from kin marriage, and such marriages are mostly caused by psychological, sociological, and cultural reasons. The fact that such marriages are common in areas belonging to the Shāfiʿī and Ḥanbalī schools that do not recommend marriage with close relatives, on the other hand, the fact that marriages between close relatives are less in Hanafi regions, which state that the same marriage is only permissible, supports this. In this respect, some claims arguing that such a marriage stems from religion based on the understandings that refer to that kin marriage is recommended by religion, are not accurate. For this reason, it is difficult to establish a connection between the disintegration of social unity, the spread of hereditary diseases, and the claims that religion recommends consanguineous marriage. Today, enlightening the religious aspect of kin marriage will be beneficial in protecting society against hereditary risks. (shrink)

The purpose of this research is to provide an overview of state governance for corporate social responsibility (CSR) in the countries of the Gulf Cooperation Council (GCC). A systemic literature review method is employed to collect 88 relevant publications, and a qualitative coding method is used to identify 98 governance instruments from those publications. These are grouped into 13 themes and then examined within three conceptual models. The findings reveal that most of the instruments are geared towards ethical expectations, internal (...) and external social responsibility, raising awareness, and socio‐economic development. The findings are then explored within four theories. The results suggest that CSR governance in the GCC is at a moderate to high level of bureaucratization; reflects Islamic identity, national development targets, and business accountability; is between the stages of habitualization and objectification; and relies mostly on normative pressures. Recommendations for policymakers and company managers are then presented based on these findings. (shrink)

Fıkıh usulünün dil ve yorum bahislerinde yer alan konulardan biri âmm lafızlardır. İlk dönemlerde umum ifadelerin tanımına, varlığına ve kapsamına dair tartışmalar yer alırken Gazzâlî sonrasında klasik mantığın konularından olan tümeller de tartışmada yerini aldı. Bu makale âmm lafızların gönderimde bulunduğu anlamın tümelliğini sorgulamakta ve klasik sonrası usul düşünürlerinin umum-tümel ilişkisine dair teorik açıklamalarını incelemektedir. Makalenin iddiası şudur: Fıkıh usulünün elfâz bahislerinde ele alınan umum ifadelerin tümellere delâletini savunan ve bunu dilin zihnî suretlere vaz olunmasına bağlayan ilk usulcü Gazzâlî’dir (ö. (...) 505/1111). Fahreddin er-Râzî (ö. 606/1210) ve sonraki dönem usulcüler ise âmm lafızların tümelliğini kabul etmemiş sadece fertleri arasında tümel bir anlamın var olduğunu savunmuştur. Aynı düşünceyi devam ettiren Karâfî (ö. 684/1285), İsfahânî (ö. 688/1289) ve Sübkî (ö. 771/1370), İbn Sînâ’nın (ö. 428/1037) etkisiyle umum ifadeleri tümel önermeler olarak değerlendirirken Teftâzânî (ö. 792/1390) kapsam kavramı üzerinden hem tüm hem tümel olarak görmüştür. Her iki farklı anlayışın öğretilerini eklektik bir tavırla inceleyen Cem‘u’l-cevâmi‘ üzerine şerh ve haşiye yazan usulcüler ise tüm, tümel ve tümel önerme olmak üzere üç farklı kabul sergilemiştir. In a landmark 1994 case, the Court of Justice of the European Union ruled that individuals had the right to ask for Internet links that contained certain information about them to be delisted by search engines. This came to be known as the “right to be forgotten.” This paper discusses the extent to which this right is consistent with the Islamic tradition. Following an overview of some aspects of the right to be forgotten and why it is endorsed in the (...) European Union with its emphasis on privacy but not in the USA with its exaltation of free speech, the paper discusses two related issues: (1) elements in the Islamic tradition potentially conducive to endorsing a particular understanding of the right to be forgotten and (2) some possible obstacles from that tradition that could challenge the recognition of this right from an Islamic perspective. The paper concludes that despite some challenges, including Qur’anic verses and certain views, activities, and institutions, the right to be forgotten is defendable from within the Islamic tradition by reference to the principle of _satr_, which breaches that one should not seek to publicize personal information that causes harm to other people or even to oneself. The paper seeks to contribute to discussions on this new right by showing what a religious tradition such as Islam can offer to them. (shrink)

İslâm’ın ilk dönemlerinden itibaren Kur’ân’da Arapça dışında bir kelimenin bulunup bulunma-dığı hususunda farklı görüşler ileri sürülmüştür. Bu görüşler çerçevesinde mesele, Kur’ân’da yabancı dillerden bazı kelimelerin bulunup bulunmadığı merkezinde tartışıldığı gibi, bazı kelimelerin köken itibarıyla Arapça olmakla beraber şer’î terminolojinin ortaya çıkışı sonra-sında Arapların o zamana kadar bilmediği yeni anlamlar kazanmış olmasının Kur’ân’ın arabî olmasına engel teşkil edip etmeyeceği boyutuyla da tartışılmıştır. Şâfiî, Kur’ân’ın arabîliği görüşünün ilk ve en tavizsiz savunucularından biridir. Kur’ân, muhatapları Arap olduğu için Arapça nazil olmuştur. Her dil, (...) o dili konuşan halkın kültürünü ve düşünce yapısını da barındı-rır. Şâfiî nazarında Kur’ân’ın arabî olması Arap dilinin kurallarına, üslubuna uygun olmasının ötesinde Arap kültürünü ve düşünce yapısını da barındırması demektir. Muhataplar açısından bakınca da kendi dillerinde inen vahyin kendileri için olabildiğince açık/mübin olması gerekir. Dolayısyla Şâfiî’nin er-Risâle’de, nasslardan hüküm çıkarırken Arapçanın kural ve üsluplarını dikkate alma üzerine kurmuş olduğu beyân teorisi Kur’an’ın arabî olması ile yakından alakalı-dır. This paper explores the epistemological affordances of Islamic ethics as alternative knowledge within intercultural education. Despite the calls for epistemological plurality in intercultural education that centre epistemologies of the South, educators may find it hard to reaffirm their situated knowledges and practices because they may have been overwhelmed by the wide endorsements of the mainstream literature. Drawing on in-depth interviews with 25 EFL teachers, this study aims to (a) unpack educators’ perspectives around the adoption of alternative knowledges anchored in local (...) epistemologies and sensibilities, (b) foreground educators’ epistemic positioning around alternative knowledges and how they are perceived as sites for cognitive and pedagogical renewal to account for local particularities and conditions and (c) examine inter-epistemic tensions within educators’ reasoning in terms of how they navigate (in)congruencies between the mainstream and Islamic philosophy at the conceptual, pedagogical and practical levels. Findings reveal that educators acknowledge the legitimacy of Islamic ethics and their epistemological/pedagogical significance in intercultural education. However, some factors may problematize educators’ attempts at making use of Islamic ethics including the additional burden of reflecting alternative knowledges while attending to contextual factors (class size, the course’s orientation, exams, time constraints, etc.) and the lack of sufficient training in intercultural education. Sünnî usulcülere göre sahih olan haber-i vahid zan ifade etmekle birlikte, böyle bir haberle amel etmek naklî ve kat’î delillerin bir gereği olarak vaciptir. Şiî-Usûlî geleneğin temsilcilerinden Şerif Murtazâ ise haber-i vâhidle amel etmenin aklen caiz olduğunu, ancak bunun dinî açıdan vacip olmadığını iddia etmiştir. Ona göre Kur’an, mütevâtir haber ve masum imamın dâhil olduğu icmâ kesin bilgi kaynağı olduğundan bağlayıcıdır. Haber-i vâhid ise zann ifade etmektedir. Böyle bir haberle amel etmeyi gerektiren naklî kat’î bir delil ise bulunmamaktadır. Bu nedenle (...) haber-i vâhid amelî konularda hüccet değildir. Şerif Murtazâ, Sünnî usulcülerin haber-i vâhidin hüccet olduğuna dair naklî kat’î delillerini eleştirmiş, usulcüler ise bu eleştirilere cevap vermişlerdir. Araştırmamız Şiî-Usûlî geleneğin haber-i vâhide yaklaşım evreninden Şerif Murtazâ örneğini ele almayı ve Sünnî usulcülerin görüşleriyle mukayese etmek suretiyle değerlendirmeyi hedeflemektedir. Şerif Murtazâ’nın âhâd haber konusundaki yaklaşımı özü itibarıyla masum imam teolojisine dayanmakta-dır. Araştırmada masum imam teolojisinin ve haber-i vâhidle amel etmeyi gerektiren kat’î bir delilin bulunmadığı iddiasının nas, icmâ, tevâtür ve makul açısından vakıaya aykırı tutarsız bir görüş olduğu tespit edilmiştir. ÖZ Geçmişi insanlık tarihi kadar eski olan iyilik yapma ve sevap kazanma duygusundan doğan vakıf, İslam ile birlikte hukuksal bir zemin kazanarak ebedi bir müessese haline gelmiştir. Sosyo-kültürel ve dini hizmetleri üstlenen vakıf ya da vakfa benzer fiiller yalnızca Müslümanlar arasında değil diğer dinlere mensup insanlar arasında da yaygın şekilde görülmekteydi. Örneğin Hint devletlerinde kralların din adamı olan Brahmanlara köyler hediye ettiği görülmektedir. Brahmanlar bu köylerin mülküne sahip olmamakta, köylüler tarafından işlenen toprakların gelirini almakta ve böylece varidat sahibi olmaktaydılar. (...) Dârülislâm’da gerek Müslüman gerekse de gayrimüslim tebaa tarafından kurulan vakıflar şerʻî hukuka bağlı olarak faaliyet göstermekteydi. Osmanlı Devleti’nin üç yüz yedi yıl hüküm sürdüğü Kıbrıs Adası’nda da aynı şerʻî hükümler bağlamında çok sayıda vakfın kurulduğu görülmektedir. Osmanlı Dönemi Kıbrıs vakıfları üzerine birçok çalışma yapılmasına rağmen bunlardan yalnızca biri gayrimüslim vakıflarını konu edinmektedir. Söz konusu çalışmada ise yalnızca yedi şahıs vakfı ele alınmakta ancak kiliselere ait fetih öncesi ve sonrası vakıflarına değinilmemektedir. Bu çalışmada işaret edilen söz konusu eksiklik üzerinde durulacaktır. Genel olarak KKTC Girne Milli Arşiv ve Araştırma Dairesinde bulunan Kıbrıs Şerʻiyye Sicilleri kaynak olarak alınmakla birlikte, Osmanlı Arşivi ve Vakıflar Genel Müdürlüğü Arşivinden tespit edilen belgeler analiz edilecektir. Öncelikle gayrimüslim ve zimmî kavramları açıklanarak Kıbrıs’ta bu kategoriye giren şahıslar ve bunların hukuki haklarına değinilip İslam hukukunda gayrimüslimlerin vakıf kurma hakları üzerinde durulacaktır. Diğer bir başlık altında iki tablo halinde verilen biri iptal edilmiş on bir şahıs vakfı ile farklı cemaatlere ait yirmi bir kilise ve manastır vakfı ayrıntılı olarak incelenecektir. (shrink)

Modernizmle birlikte Batı'nın değişen insan, dünya, evren ve Tanrı algısı, şüphesiz Batı ile sınırlı kalmamış, hemen hemen bütün dünyayı etkilemiştir. Maddeye şekil verme hünerini ileri derecede geliştiren ve bunu kullanarak dünyanın geri kalan önemli bir kısmını ya bizzat veya nüfuz alanı oluşturarak egemenliği altına alan ve dünya coğrafyasında önemli değişiklikler meydana getiren Batı'nın bu faaliyetleri, ondan etkilenen diğer kültürlerin kendi din, ahlak, gelenek ve adetlerinden şüphe etmesine sebep olmuştur. Batı'nın üzerimizdeki askeri faaliyetlerinin ve belki Batı'ya olan coğrafi yakınlığımızın, bu etkinin (...) bizde daha fazla hissedilmesinin kaynağı olduğu söylenebilir. Bu çerçevede, fikir dünyamızda son yüzyılda seyreden bir hareketlilikten ve buna bağlı olarak meydana gelen önemli değişikliklerden söz etmek mümkündür. Kendi kültür, ahlak, din, örf, adet, gelenek, kısacası medeniyet anlayışımızı, yeni paradigmaya uydurma gayreti, aydınlarımızın çoğunun seçtiği yol olmuştur. Bununla birlikte Batı'dan teknolojinin, teknolojiyi oluşturan bilginin ve bilgi yönteminin alınmasının şart olduğunu, ancak kadim kültürün korunması gerektiğini savunan aydınlarımız da az değildir. İşte bunlardan biri de son yüzyılda, kültürümüz ve kültürümüzü meydana getiren bilgi dallarıyla ilgili birçok eser kaleme almış olan Ömer Nasuhi Bilmen'dir. Bir toplumu, diğerlerinden ayıran en önemli faktörlerden biri de etik kurallar konusundaki tercihlerdir. Bilmen, belki de bunu fark ettiği için, etik konusuna çok fazla önem vermiş, bu konudaki değişime karşı çıkmış ve kadim ahlak sisteminin korunması gerektiğini var gücüyle savunmuştur. In this article are mentioned the educational history, institutions and activities of the Mountain Jews living in Azerbaijan in private religious schools and state schools in the period after the independence of the Tsarist Russia, the Soviet Union and Azerbaijan. In addition mentioned, the Religious Education Centers whic established by the Mountain Jews by their communities in the 19th century Tsarist Russia and the secular schools of the state. In the religious schools called Talmudhuna and Nobuhunde, mostly male students were (...) educated by rabbi, reznik and religious teachers. With the opening of modern style schools, Mountain Jewish children in many regions of Tsarist Russia started to enroll in these schools. While mostly male students were enrolled in these schools, girls received religious and traditional education in their families. During the Soviet Union, Religious Education Centers were completely closed, only public schools continued education. Enrollment and attendance at schools has been made compulsory. Mountain Jewish children continued their education in public schools like the children of other nations. After Azerbaijan gained its independence, Mountain Jews continued to receive education in public schools and gained the right to open their own religious education institutions. In this new period, Mountain Jews expanded their opportunities by opening new educational institutions, especially in Baku and Quba cities, with the support of the Azerbaijan State and the help of their coreligionists in other countries. Mountain Jewish children in these cities receive education in both public and private religious schools. (shrink)

In recent decades we have been given one of the most interesting concepts in Islamic intellectual history, `the scientific miracle of Qur’ān whereby the proponents have almost established the scientific theories in the Qur’ān. However, such ardent claims must not come to be without any inspiration and methodology. This article, firstly, tries to trace the inspiration of such concept and then describe the methodology. However, as exciting as this concept seems, the methodology brings forth a very negative approach to prove (...) the miracle of the Qur’ān, which is value free. That negative value free mentality which is related to the status of prophet of Islam will be exposed and it will detail how the status of prophet of Islam was abated so badly to prove the science from the Qur’ān. To counter this negative narrative and to reveal the true status of prophet of Islam, arguments will be presented from the Qur’ān and Ḥadīth which are incontrovertible. Let it be known than, this analysis is not general but particular. However, it will be a novel critique to re-visit this concept. (shrink)

The main purpose of this study is to become acquainted with the educational institutions in Ottoman Empire during and after the 18th century. In this respect, special attention is given to which initiatives were taken in terms of education and which educational institutions were established during the aforementioned period. The need to comply with the West in terms of science, culture, reasoning, and technological advancements has led to the questioning of the current madrasah system. Upon revising the educational system of (...) the madrasah, which had difficulties in being productive and attaining to the necessities of the time, there have been initiatives primarily to establish and structure military schools. These attempts to reform education was intensively seen as from the early 18th century. The above-mentioned changes and progress have gained momentum with the Tanzimat era. It was observed that during this period, many schools were established beyond military; education levels were clarified and; females were given right to study. Similar to Tanzimat era during the first Constitutional Monarchy and Autocracy eras, positive contributions toward educational reforms were made. However, beginning from the middle of the second Constitutional Monarchy era, the economic and social complications that the state was going through had a negative impact on the educational system and the practicality of the educational institutions.Summary: Education has been the most important factor in determining the social, economic, and cultural level of a society. The level of development, which is the determinant of the superiority of the nations to each other over the world, varies according to the importance given to education. To be a pioneer in the scientific sense, to be able to have technological opportunities, to make people live more comfortable and peaceful, to have more power in the economic field and to ensure the continuity of the nation that depending on all these, it will be possible with the understanding of education that can read the time and future well. The fact that world states are superior to each other in different periods of history is directly related to their understanding of education. It can be said that in the centuries following the beginning of the new age, especially the Western nations have taken a more positive step at this subject. The changes in both mental and action spheres such as XVI. century Renaissance movements, XVIII. century enlightenment movement and finally the industrial revolution triggered the development in the scientific and technological field. In these periods the importance given to thinking and the freedom of thought has been the main factor of the progress in the scientific field. The European nations, which went beyond their religion-based bigotry and prioritized the free and secular understanding, have become superior to other nations of the world. However, it is not quite possible to say that in the same periods the Ottoman Empire was able to adapt with the same speed to such accelerations of change and development that placed in Europe. One of the main reasons for this situation and perhaps most importantly is that the educational concept in the Ottoman Empire remained within a static structure in the last centuries. In particular, the matters such as the madrasa being away from productivity, the limitation of the understanding of the science only with religious sciences, has led to the problem of inability to adapt to the rapid transformation that in Europe. The first steps towards eliminating this weakness noticed by the state executives over time has been taken through the improvement and transformation of the Ottoman educational institutions. It is possible to say that the first attempts as to these restructures of education, which is also called as Westernization or modernization by the educational historians, has begun in the period of Sultan III. Selim. In the context of the Nizam-ı Cedid movement, a number of positive initiatives in education, such as the improvement of madrasas, the opening of military schools and translation activities, constitute the core of the changes that will take place in later periods. Immediately afterwards, in the period of II. Mahmut, making the reading and writing education compulsory, opening of Western-style junior high school, establishing medical and vocational schools that provide education at higher education level are considered as positive innovations of the period. The time interval from the proclamation of the Tanzimat edict until the First Constitutional monarchy is the period in which the institutionalization and structuring towards education in the Ottoman Empire is at the highest level. Besides many educational institutions in this process where the ministry responsible for education and training is established and the regulation containing the arrangements regarding this field is put into force, one of the most important initiatives made is laying the foundations of the Dâr al-Fünûn (Ottoman University) which is considered as the first university in this land. The fact that many educational institutions established in this period that are the roots of today's educational institutions is important in terms of demonstrating the accuracy of the initiatives within the mentioned period. In Meşrutiyet (the First Constitutional Monarchy) and the subsequent period of Mutlakiyet (Autocracy), contributions were provided on previous positive structuring. However, the social and economic problems experienced in the country since the second half of II. Meşrutiyet (the 2nd Constitutional Monarchy) have been effective in the inability of continuing innovations towards education. In this study, the educational institutions established in the Ottoman Empire before and after the Tanzimat period were discussed. The aim is not just to reveal what these schools are. It was also aimed to emphasize which areas in which schools are required to be based on which needs, which obstacles are encountered during the change of mentality in education, regulatory activities foreseen to overcome obstacles and to what extent they have been successful. In this regard, the signals of change as to the structure of educational institutions, which could be the source of most of the republic period, started from the beginning of 1700s and continued until World War II period. During this period of more than a hundred years, the political periods related to the structure and functioning of the state have also been influential in the structuring of educational institutions. In fact, the Reorganization (Tanzimat) period, which is known as ‘reform’ in the mentioned process, is considered as the stage where the change and transformation concerning education is the most. It is seen that the process of westernization still continues even though it is not with the same acceleration in the Constitutional Monarchy and Autocracy periods after the Reorganization period. When looking at the facility of educational institutions in chronological order, it is determined that there is a dominated understanding that prioritizes to train military staff in the military field and to have a competent army with the technological possibilities of the time, in other words, to create a strong defence system against the foreign powers of the country. Indeed, for the first time in order to give technical information about modern military, Hendesehane opened and started to operate in İstanbul in 1734 by Mahmut I; Mühendishâne-i Bahrî-i Hümâyûn, the school of the first military maritime was opened in 1775 in order to provide modern education; Mühendishâne-i Berrî-i Hümâyun was founded in 1795 in Istanbul, in order to train artillery and military officer (military engineer); Mekteb-i Harbiye, which was opened in 1835 to train officers, and Menşe-i Küttab-ı Askeri, which was established to train military scribes, contributed to the contemporary construction of the army. In the mentioned period, the most important change outside the military area was in the health area. In this sense, in order to meet the medical doctor needs of the army, Tıbhâne-i Amire was established in 1827. In 1867, the first civilian medical school, Mekteb-i Tıbbiye-i Mülkiye, started education and training. Another important innovation movement for education was in the field of law. In this context, the School Law was established in 1880. In order to train competent staff in administrative staff, the schools of the Mekteb-i Mülkiye, the schools of teacher, the schools that enable women to do education, the improvement of schools that train the clergy and the regulations based on this take attention as educational activities carried out in the mentioned period. Türk ve İslam tarihinin kırılma noktalarından birisi 1040 yılında Selçuklular ile Gazneliler arasında cereyan eden Dandanakan Savaşı’dır. Savaşın ardından Selçuklular hızlı bir yükselişle özellikle Sünnî İslam coğrafyasında etkin ve belirleyici güç haline gelmiştir. Göçebe kültürden gelen ve bir oba hüviyetinde iken çok kısa bir sürede önlenemez bir şekilde hâkimiyet alanını Türkistan coğrafyasından Anadolu içlerine kadar genişleten Büyük Selçuklu Devleti, kurumsal olarak da olgunlaşmaya başlamıştır. Bu noktada hem merkezi yönetimde hem de vilayetlerde ortaya çıkan yetişmiş eleman ihtiyacını birçoğu daha (...) önce Gazneli devlet teşkilatında görev yapmış Fars asıllı devlet adamları karşılamıştır. Bu isimlerden birisi de ileride Nizâmülmülk adıyla şöhret bulacak ve namı isminin önüne geçecek olan Hasan b. Alî b. İshâk et-Tûsî’dir. Nizâmülmülk, devlet gücünün askeri alanda elde edilen zaferlere endekslendiği bir dönemde askerî, idarî, ilmî ve ekonomik alanda attığı adımlar ve aldığı tedbirlerle Büyük Selçuklu Devleti’nin kurumsallaşmasında son derece etkin bir isim olmuştur. Bu etkinlik neticesinde hem halk hem de devlet adamları nezdinde saygın bir yer edinmiştir. Bu çalışma çerçevesinde Nizâmülmülk’ün devlet bürokrasisi içerisindeki konumuna, hükümdar ve hanedan üyeleri ile olan ilişkilerine ve vezirlik sürecinde attığı adımların Selçuklu tarihine yansımalarına değinilecektir. Özet: Devlet kademesinde görev almaya Gazneliler Devleti’nin Horasan Valisi Ebü’l-Fazl Sûrî’nin yanında başlayan Nizâmülmülk, Horasan Bölgesi’nin Selçukluların kontrolüne geçmesiyle birlikte hizmetlerine Selçuklu Devleti’nde devam etmiştir. Çağrı Bey’in hizmetinde rüştünü ispat eden Nizâmülmülk, Çağrı Bey’in en güvendiği isimlerden biri haline gelmiştir. Öyle ki, Çağrı Bey ileride önce Horasan’ın sonrasında tüm Selçuklu yurdunun yönetimini üstlenecek olan oğlu Alparslan’ı Nizâmülmülk’e emanet etmiş, oğluna da Nizâmülmülk’ü bir baba olarak kabul etmesini, ona muhalefet etmemesini öğütlemiştir. Alparslan, babasının tavsiyeleri ve üvey kardeşi Süleyman ile giriştiği taht mücadelesinde gösterdiği yararlılık münasebetiyle devletin en önemli idari görevi olan vezirlik makamını Nizâmülmülk’e tevdi etmiştir. Bu dönemden itibaren vefatına kadar, yaklaşık 30 yıl kesintisiz bir süreyle Büyük Selçuklu Devleti’nin vezirliğini yapmış ve V./XI. yy.’ın ikinci yarısından itibaren Büyük Selçuklu siyasetinin en etkin figürü haline gelmiştir. Melikşah’ın tahta geçebilmesinin Nizâmülmülk ile ilişkilendirilmesi, onun döneminde elde edilen başarıların ve devlet sisteminin düzenlenmesi, şehirlerin imarı, ekonominin güçlenmesi gibi ülke içerisinde yaşanan olumlu gelişmelerin Nizâmülmülk’ün marifetiyle gerçekleştirildiğinin dillendirilmesi, Tanrı tarafından yeryüzünü yönetmek ve inşa etmek için seçildiği düşünülen bir sultan varken bir vezirin devlet için nimet olarak gösterilmesi sultanın vezirine bakışını etkilemiştir. Bu noktada üzerinde durulması gereken hususlardan birisi de Nizâmülmülk’ün kendisini nasıl gördüğü ve devlet içerisinde kendini nerede konumlandırdığıdır. Nizâmülmülk’ün Sultan Melikşah’a verdiği bir cevapta devletin geldiği noktayı ve sultanın mevcudiyetini kendi varlığıyla eşleştirmesi, tarihinin gördüğü en yetenekli vezirlerden biri olan Nizâmülmülk’ün özgüveninin son derece yüksek ve kendisini kudret sahibi olarak gördüğüne işaret etmektedir. Bu anlamlandırma halk nezdinde herhangi bir kutsiyeti bulunmayan vezirlik makamındaki bir kişinin, toplum nezdinde Allah tarafından seçildiğine inanılan kutlu kişiye meydan okutan gücü kendisinde hissetmesinin kaynağını sorgulatmaktadır. Aranan cevap Nizâmülmülk’ün vezirlik sürecinin çeşitli başlıklar altında ve bu başlıklara dair verilecek örneklerle incelenmesi neticesinde onun devletin iç işleyişine etkisinin tespitinde ve farklı kesimlerle kurduğu ilişkide saklıdır. Nizâmülmülk, Selçuklu tahtına karşı sıkı bir bağlılık göstermiştir. Bu bağlılığını lüzumu halinde savaş meydanında göğüs göğüse çarpışarak sergilemiş, gerekli olduğunda kıvrak zekâsı ile sorunları devlet için tehlikeli boyuta gelmeden çözmüş, siyasi öngörüsü ile aldığı tedbirler sayesinde devletin büyümesine katkı sağlamıştır. Onun bu sadakati ve samimiyeti, Selçuklu sultanları tarafından karşılık bırakılmamış, Alparslan vezirinin fikirlerine büyük önem verip tercihlerini bu doğrultuda şekillendirirken, aleyhine söylenen sözlerin hiçbirine kulak asmamıştır. Melikşah da, bir anlamda kendisine Selçuklu tahtını veren Nizâmülmülk’e gerekli hürmeti göstererek bütün devlet işlerinin yürütülmesini ona tevdi etmiş ve kendisini bir “baba” gibi gördüğünü ifade etmiştir. İlaveten Selçuklu tarihinde bir ilk olmak üzere Melikşah, Nizâmülmülk’e atabeg (el-emîrü’l-vâlid) unvanını vermiştir. Melikşah, Büyük Selçuklu tahtındaki ilk yıllarını, gençliğin etkisiyle, polo oynayıp, büyük av partileri düzenlemekle geçirmiş ve bundan dolayı devlet içerisinde bütün güç Nizâmülmülk’ün eline geçmiştir. Ortaya çıkan bu durum da “ülke resmen ve ismen sultanın olmakla birlikte gerçekte ‘Nizam’ına kavuştu.” ifadesiyle açıklanmıştır. Ayrıca Melikşah’ın saltanatı döneminde elde edilen askerî, siyasî ve ekonomik başarılar Nizâmülmülk’ün yeteneği ve devlet işlerinde attığı adımlara bağlanmıştır. Nizâmülmülk, hanedan ile kurduğu ilişkinin yanı sıra devlet kademesinde görev alan farklı zümrelerle de güven üzerine dayalı yakın bir ilişki biçimi geliştirmiştir. Örneğin, Nizâmülmülk’ün katıldığı askerî seferlerde bir nefer gibi askerlerin içerisinde savaşa katılması ordu içerisinde kendisine saygı duyulmasına yol açmıştır. Ayrıca, Melikşah ile Kirman Hâkimi Kavurd Bey arasındaki taht mücadelesinde Melikşah’ın safında yer almakla birlikte Kavurd Bey’i destekleyen bazı isimlerin yazdıkları destek mektuplarının ortaya çıkmasına engel olarak hem emirlerin korkularını yatıştırırmış hem de itibarını artırmıştır. Nizâmülmülk’ün yakın ilişki içerisinde olduğu bir diğer grup ilmiye sınıfı olmuştur. Bilge vezir, Tuğrul Bey döneminde Amidülmülk Kündürî tarafından takibata uğrayan ve baskılara maruz kalan ilim adamlarının yurtlarına dönebilmelerine imkân sağlamıştır. Bu ilim adamları da yurtlarına dönüşlerini sağlayan isme zihinlerinde ve gönüllerinde her zaman özel bir yer ayırmışlardır. Birçok âlimin çalışmalarını Nizâmülmülk’e ithaf etmesi, diğer saiklerle birlikte, bunun bir göstergesidir. Nizâmülmülk bir adım daha atarak, Sultan Alparslan ve Melikşah’ın müsaadeleriyle, bu ilim adamları için hâkim olunan coğrafyanın her tarafında ilimle iştigal edebilecekleri medreseler inşa etmiştir. Nizâmülmülk’ün adına nispetle Nizamiye Medreseleri olarak isimlendirilen bu medreselerde hem eğitim-öğretim kadrosuna hem de öğrenim süresi boyunca ve de mezun olduktan sonra öğrencilere sunulan imkânlar, insanların medreselere olan ilgisini arttırıyordu. Medreseler eliyle bir taraftan önceki dönemde yerlerinden edilen ve baskıya maruz kalan ilim adamlarına bir borç ödenip iade-i itibar sağlanırken diğer taraftan da Büyük Selçuklu Devleti’nin idari ve adli sisteminin ihtiyaç duyduğu yetişmiş insan gücü inşa edilmiştir. Nizâmülmülk, toplum lehine attığı adımlar ve sorunların çözümüne verdiği önem ile halkın desteğini sağlamıştır. Öyle ki insanların hayatları boyunca ona minnettar kaldığı vurgulanmıştır. Nizâmülmülk halkın sorunlarının çözümüne önem göstermiş ve onlarla yakından ilgilenmiştir. Nizâmülmülk’ün verdiği güven duygusu halkın hoşuna gitmiş ve toplum içerisinde kabul görmesine vesile olmuştur. Nizâmülmülk’ün bir diğer hasleti de fakirlere sofrasını açmasıdır. Böylece onlarla diyalog kurmuş ve gönüllerini kazanmıştır. Her yönüyle eksiksiz bir devlet adamı olan Nizâmülmülk, toplumun her türlü ihtiyacının çözümünü düşünmüş ve bu yönde adımlar atmıştır. Nizâmülmülk’ün toplumun her kesimi ile kurduğu samimi ve yakın ilişki o kadar büyük bir takdir ve beğeni toplamıştır ki bu durum Nizâmülmülk’ün toplum nezdinde sultan itibarı görmesine sebep olmuştur. İlaveten Selçuklu coğrafyasının her yerinden ve toplumun her kesiminden insanın kendisine yönelmesi hasebiyle Kâbe’ye benzetilmiştir. Nizâmülmülk, devlet kademesinde görev alan aile bireyleri, ilişki içerisinde olduğu âlimler, kendi ordusu ve emirleri ile bir güç odağı haline gelmiştir. Bunun sonucunda Nizâmülmülk, 11. yüzyılın son çeyreğinde rakipsiz bir şekilde Büyük Selçuklu siyasetinin en etkin figürü, Selçuklu yönetimini ve politikalarını belirleyen isim ve Selçuklu tarihinin en önemli olaylarında karar mercii olmuş ve sonuçta Selçuklu tarihine damga vurmuştur. İbnü’l-Esîr, Fatımî veziri Bedr el-Cemalî’nin kendisi için kullandığı sayısız lakabı kaydettikten sonra sadece Mısır’a hâkim olan bir devletin veziri bu kadar lakap kullanıyorsa Nizâmülmülk’ün “ilah”lık iddiasında bulunması gerekirdi diyerek hem Selçuklunun azametini hem de Selçuklu devletinde Nizâmülmülk’ün yerini göstermektedir. Court (Shar’iyya) recordings are at the forefront of primary written sources, which contain important documents related to Turkish history, sociology and culture. The court records shed light on city history of the period concerned with rich information and documents. These records are important books in which the documents related to the judicial, administrative, economic, architectural and social structure of a city as well as diplomatic correspondence between the center and the province were recorded. The purpose of this study is to (...) prepare a detailed catalog in addition to the catalog which was made in 1963 and contained only 119 books specifying only the dates covered by the book number. As we have seen in this study, all of the 119 notebooks in the records do not consist of the court registers in the known form. They are the books that include the records of court proceedings, which are different from those of the court, especially after the Tanzimat e.g. Qassam, Enkiha, Zabt al-Da’wa, Permission and so on. The microfilms of the books were presented to the service of researchers in Sivas Ziya Bey Library of Ancient Works. The originals of the books are in the Prime Ministry State Archives.SummaryShar’iyyaregisters are one of the primary written sources about Turkish history, sociology, and culture relevant to our life. They are important notebooks, which are related to the judicial, administrative, economic, architectural and social structure of a city, and also in the form of diplomatic correspondence between the central and provincial posts.After the Anatolian Selçuk (Saljūq) State, which collapsed under the pressure and domination of the Iranian Mongols in the last half of the XIIIth century, a state was established in the Selçuk-Byzantine border in the north-west of Anatolia in XIVth century, which did not even lasted a hundred years and had a reign in three continents. In the Bursa inscription, which dated to 1337/8, the second Ottoman Sultan (Sulṭān) Orhan was titled as the mujahedeen (warrior), the sultan of the veterans, son of veteran of veteran. The fact that Orhan carring these titles shows that since the earliest times, the Ottoman sultans considered themselves as the leader of the religious war against the infidels. Since the first years of the establishment of the Ottoman State, the Sharīʿa ruled on the establishment of administration and for this reason, they established institution of the Shaykh al-Islām(the chief juristconsult). Firstly, by appointing a subaşı(subashi, an Ottoman gubernatorial title) to the conquered places, then it gradually began to establish judicial courts from the smallest areas.In the XVth century, the number of qāḍī increased in parallel with the increase in their jurisdiction as a result of the expansion of the Ottoman Empire, and the proliferation of the administrative units called sancak, (sanjaq, division of a province) and so the failure of oneqāḍīto satisfy court affairs of an entire sanjaq. New districts arose from some of the former large districts. As a result of this in the XVIth century, the administrative system of the sanjaq's Tımar system and at the same time a geographical integrity of the districts/provinces to see the legal work of a qāḍī to pass by the districts and sub-district as a legal caused to occur two legal definitions that is legal and military administrative. Records of qāḍīs, which is called as sicilemerged because it was their duty to record their works and orders issued to them and the answers and the provisions given to them.The courts of Shar’iyyaserved as primary general courts (maḥākim-i ʿumūmiye) until the declaration of the Tanẓīmāt in the Ottoman Empire and heard the suit at legal, criminal, administrative, military, financial and all kinds of cases. Tanẓīmāt period, or rather Maḥmūd II and the period following him, the judicial organs in terms of reorganization was a circuit that was on the scene.In this way, which was occurred in the judicial system, records which were kept in the Meşihat (Mashīkhat) began to diversify depending on this change. Since in the registry books, which we call classical, all correspondence between the central and provincial offices were recorded. Records such as pleas, letters of patent, verdicts, order of the high, bonds etc. could be found in these documents.These records, which are one of the most important sources of an Ottoman city history, were kept in the museums and libraries of the cities until recently. A few years ago, these records, with a correct decision, were collected in the Prime Ministry Ottoman Archives and it was preserved and presented to the use of researchers by transferring them into digital. The Sivas Court building as it is known in history is now in the Pāshābeg quarter and known as the Court Bazaar in these days. There is no clear information about when the court was built in Sivas. In time, changes have occurred in cities and we are losing the historical side of them. In addition, the fact that people acted in an unconscious manner that would harm the historical texture was the biggest factor in disappearance of material remains. With the remaining physical materials available, we can only access crumb information and we can only make predictions. In this evaluation, the biggest materials are the documents and notebooks, which are the memory of city dates. However, it is understood from the records that there is a foundation belonging to this court and some of the court's repair and maintenance works were carried out by this foundation. As it is understood from a document dated 14 August 1798, one of the repairs was sponsored by Ḥüseyin Efendī. In an inscription dated 1906, which was found during the renovation of the basement of an apartment building owned by the General Directorate of Foundations in May 2018, the location of the building was previously known as the Sivas Muftī 's Office.In this study, a total of 240 registry books belonging to Sivas were prepared as in a catalog system. In this study, we have seen that a great deal of records have been lost, burnt or destroyed in a certain way through history. The burn marks in the records of 79 is a striking example in this regard. The book number 139, which is not shown in Osman Ersoy's work, is a record book in classical form. An important case in this study is that the register number 206, which is registered to Sivas, belongs to the province of Burdur and it is also a registry book in classical form. Dede Korkut Stories are a national cultural heritage that narrates about events and challenges of Oghuz Turks in 10th-11th centuries. This period of time is important, as it was the times when Turks became Muslims. In this work, heroism, customs, habits and traditions, socio-cultural and moral life of the Turks before and after becoming Muslims are analysed. One of the topics addressed in this work is religious beliefs and worships of the Turks after became Muslims. In this context, the belief (...) in Allah appears to be the most emphasized type of belief in the stories. The theme of fate, which is included in the subjects of Tawḥīd (oneness of Allāh) is another theme mentioned in the stories. The stories also includes some expressions regarding particularly the Prophet Muḥammad as well as some other prophets. Jibrīl and ʿAzrāʾīl angels are also mentioned. As for the Divine Books, only the Qur’ān is namely addressed and other divine books are not mentioned. The beliefs regarding afterlife, such as death, resurrection, heaven, hell, pool of al-Kawthar (abundance) are also referred to in the stories. The Book of Dede Korkut is not a didactic work written to teach Islam. On the contrary, in the stories, Islam is discussed as an element of the spirit/essence of individual and society. The aim of this study is to investigate the representations of the beliefs of tawḥīd, prophecy and hereafter of the Turks, especially the Oghuz Turks with reference to narrations in Dede Korkut stories. It aims to discuss them in the context of six pillars of faith and evaluate from the Islamic belief point of view.Summary: The Book of Dede Korkut consists of twelve epic stories created within the oral tradition of Turkish Folk Literature. It is said that the origins of these stories, which are one of the oldest works of Turkish Folk Literature, went as far as 7th century. It is generally accepted that the Book of Dede Korkut, which narrates about Oghuz Turks who lived in 10th-11th centuries was transferred to writing after 15th century. There is no information found about writer/s of the Book. Dede Korkut, who considered being the narrator of the stories, is in fact a character in the stories. Dede Korkut plays qobuz, reads poetry, names children, mediates in marital affairs, resolves disputes, and leads religious rituals in the stories. Therefore, he stands out as a saint figure and considered to be wise man of the Oghuz Turks in almost every story, especially regarding social events. In this work, there are many expressions about heroism, customs, habits and traditions, socio-cultural and moral experiences of the Turks before and after becoming Muslims. The stories bear many traces from the earlier Turkish beliefs. However, these are not the issues of this study. The dates of the emergence of the stories, 10th and 11th centuries, coincides with the times when the Turks became Muslim. This situation makes the stories more important as they include rich narratives about the fundamental beliefs of Islam. Especially the belief in Allāh, which is one of the six pillars of faith, appears to be the most emphasized in the stories. In these stories, Turkish and Persian names of Allāh as well as His Arabic names and attributes are mentioned directly or indirectly.The belief in predestination and casualty related with Allāh's eternal knowledge and determination is another faith object that takes place in the stories. The issues regarding the predestination discussed in the stories as follows: the deeds occur with the wish of Allāh; Allāh decides whether the child male or female; Allāh predestines human lifetime, livelihood, time of death and calamities.There are also narrations about the belief in the prophets in the stories. Particularly the Prophet Muhammad's prophecy is prioritised. Adam, Noah, Abraham, and Moses are the other prophets mentioned in the stories. The successive authority of Adam and His story with Iblīs; the wife and donkey of Noah, not burning of Abraham when he was thrown into the fire, the speaking of Allāh with Moses and the staff of Moses are some of the expressions related with prophecy in the stories. Nimrod against Abraham and Pharaoh against Moses are described as negative personalities in the stories. In the stories, the Prophet Muhammad (pbuh) is handled in a position that intercession is demanded from Him. Greetings and prayers are read for Him. His intercession is sought for forgiveness of sins and acceptance of prayers. He is exalted with some attributions, such as the holly Prophet Peace be upon Him, friend of Allāh, the leader of religion and the headman of religion. When the Prophet Muhammad is mentioned, it is felt that there is a high respect and an enthusiastic love. When he is addressed, the expressions indicating respect and affection, such as "His name is magnificent Muhammad" and "His name is magnificent Muhammad Mustafa" are used in the stories.In the stories, only the Qur’ān is mentioned among the divine books, none of the Torah, the Zabūr and the Injīl is mentioned. It is referred that the Qur’ān descended from the heavens and it is the word of Allāh and His knowledge, and it was copied (collected) by Uthman. It is described as "Magnificent Qur’ān".It is seen in the stories that there is also a place for the belief in angels and only two of the four great angels are mentioned. One of them is ʿAzrāʾīl, the death angel. It is one of the main heroes in the story of Deli Dumrul. ʿAzrāʾīl is described as an angel from the sky, who has red-winged, who takes the souls of living beings by the command of Allāh and kill them. It is also narrated that ʿAzrāʾīl takes the form of human and pigeon, and the struggle of ʿAzrāʾīl with Deli Dumrul. The other great angel mentioned in the stories is Jibrīl. In the story of Emre, the Son of Begil, it is described as an angel fulfilling the commandments of Allāh. Apart from these, there is no information about other angels and their characteristics, such as not being gendered, not to sin, and being created from light. Within the scope of invisible beings, the Devil is also narrated in the stories as it did not prostrate itself to Adam, and therefore it was repelled and cursed.The principle of the belief in Hereafter, which is one of the pillars of faith, is also dealt with in the stories. The ending, death, resurrection, reckoning, Heaven, Hell, seeing Allāh's face in Heaven, drinking water from the pool of al-Kawthar are some of the topics addressed in relation to this principle. While talking about Heaven in the stories, the words "Uçmak" (flight) in Turkish and "Behesht" (paradise) in Persian are mentioned in addition to Arabic "Jannah" (heaven).The Book of Dede Korkut is not a religious book written to teach the ʿaqāʾid (beliefs) of Islam or its practices. On the contrary, it is a work that narrates about people’s lives and social experiences. There is neither any specific verse from the Qur’ān nor sayings or the deeds of the Prophet (ḥadīth) included in the stories. However, the contents of many issues stated in the Qur’ān and ḥadīth are expressed in the stories. For instance, the statements from the surah (chapter) al-Ikhlāṣ (sincerity), such as al-Aḥad (the one), Allāh begets not, nor was He begotten, and not being any equivalent to Him are mentioned in the stories. Likewise, not burning of the Prophet Abraham when thrown into the fire, speaking of Allāh with Moses and giving the stuff to him as a miracle are also stated in the Qur’ān. As for the pool of al-Kawthar, the believers’ seeing Allāh in Heaven, ineffectiveness of the deeds without saying in the name of Allah are mentioned in ḥadīths. However, some information that is not rooted in the Qur’ān and ḥadīths, such as the stinging of Nimrod's arrow is also encountered in the stories. Based on the narrations in the stories, it seems possible to draw the conclusion that the Oghuz Turks mentioned in the Book of Dede Korkut adopted Ahl al-Sunnah (people of Sunnah) interpretation of Islam. However, it should be reminded that this implication will lose its meaning if it is proved that the original versions of the stories were redesigned according to the interpretation of Ahl al-Sunnah in the process of transferring them into writing. The purpose of this study is to reveal the function of the concept of Infāq, which is included in the terminology of the Qurʾān itself, in social assistance and solidarity. Poverty has always been one of the social problems from past to present. Although it is analyzed differently in each society via different criteria, poverty generally refers to the condition in which a person lacks the basic necessities for a minimum living standard. Unfortunately, millions of people starve for basic biological (...) and social needs such as nutrition, shelter, education, health, and even water. This is a shame for the humanity. There are both international and national charities working to reduce the misery and poverty. However, due to socio-economic and structural problems such as globalization, disproportion in income distribution, unemployment, overpopulation, economic crises, lack of social security systems, and wars, poverty rises gradually and it is still one of the major social problems needed to be solved. Islam which is the last one of Abrahamic religions and its holy book Qurʾān consider social cooperation and solidarity pretty important within the context of Infāq and hold the believers responsible for the organization of social life. Infāq is an umbrella concept in the Qurʾān, referring to all expenses and cooperation in the name of Allah and it is one of the main qualities of believers. Infāq, which includes other forms of cooperation such as obligatoryalms (zakāt) and charity (ṣadaqā), enables a person to share his tangible values with those who have worse life conditions than himself. In this way, the Quran aims to promote human relations and thereby enhancement and peace in the society. In other words, Infāq aims to eliminate social injustice which refers to social and economic inequalities, to protect the economically weak people against the difficulties in life, and thereby, to maintain economic and social stability. Helping the needy is a powerful path toward having spiritual peace, removing selfish feelings, and keeping emotional wellbeing. People with good mental health will be able to build more humane relationships with others. It is obvious that Infāq would play an important role inbuilding a sense of fellowship and trust. A wealth of person who shares his wealth with the poor will be deemed legitimate by the needy people. Thus, the needy people would be freed from negative feelings and behaviors such as jealousy, incapacity, hatred, bullying, and hostility, and feel a sense of fellowship and gratitude towards those who have better life conditions. One of the most important reasons for robbery, extortion, purse-snatching, and etc., which are currently occurring more frequently, is economic deprivation. Considering the fact that this kind of incidents takes place more frequently in poor countries than developed ones, it is obvious that Infāq has a strategic role in fulfilling the basic needs of the needy. Poverty might be linked to violence, which might end up with murder. Infāq which is divine cooperation approach would take an important role in fighting against criminal incidents that cause fear and indignation. Moreover, the Quran does not specify any certain economic condition to be able to do Infāq, and thereby, it makes people with various economic abilities become a part of the social cooperation. As everyone would take care of people who are relatively worse off, interindividual trust will be strengthen and circle of cooperation will be expanded. According to the Qurʾān, people’s all goods and possessions actually belong to Allah. People are just the trustees of this wealth. Allah grants as much wealth as He wills to whomever He wills. While the rich is responsible for sharing their wealth with the needy, the poor is responsible for bearing the troubles caused by poverty with patience and endeavoring to make money in a halal way. Unless Infāq is done in order to please Allah, it does not have any significance in the presence of Allah. The reason why people have different material living conditions is that both the poor and the rich are subject to test. Thus, they would get rewards for hereafter besides the sustaining of social unity and solidarity. Allah is the only warrantor of the tangible and spiritual wealth gained in return for Infāq.
