Alexis de Tocqueville (1805–1859) was convinced that without a new possibility for transcendence, democracies would be ill-prepared to allow for actual freedom. In Democracy in America, his study of the United States, he explained that when self-interest was enlightened, individuals would tend to identify their personal benefits with the well-being of the community. By transcending their individualistic tendency to self-enclose, they would contribute to forming and maintaining a real sovereignty of the people. However, unless the “doctrine of self-interest well understood” (...) was aided by a higher ideal, by itself it would eventually fall short, thus paving the way for new forms of despotism. Religion, and more specifically, reformed versions of Christianity, seemed to effectively elevate the outlook of the early Americans. As I will argue, however, Tocqueville ultimately held that those versions lacked the profundity and stability required to resist the strong materialistic and individualistic tendencies of people living in a democracy. Tocqueville’s apparent, if anxious-ridden, preference for Catholicism as the more adequate civil religion resonates with important aspects of Augustine’s theory of the Two Cities, the earthly and the heavenly city. For both Tocqueville and Augustine, the Roman Church’s stable doctrine was what could more successfully teach mankind the truth about their limited condition, hence making them more capable of learning the “art of being free.”. The individual informed consent model remains critical to the ethical conduct and regulation of research involving human beings. Parental informed consent process in a rural setting of northern Ghana was studied to describe comprehension and retention among parents as part of the evaluation of the existing informed consent process.

The debate over risk-related standards of decisional capacity remains one of the most important and unresolved challenges to our understanding of the demands of informed consent. On one hand, risk-related standards benefit from significant intuitive support. On the other hand, risk-related standards appear to be committed to asymmetrical capacity—a conceptual incoherence. This latter objection can be avoided by holding that risk-related standards are the result of evidential considerations introduced by (i) the reasonable person standard and (ii) the standing assumption that (...) patients have capacity. This evidential approach to justifying risk-related standards of capacity avoids the most significant challenges faced by extant views while grounding risk-related standards in two fairly uncontroversial views in biomedical ethics. Immediately before the release of DSM-5, a group of psychiatric thought leaders published the results of field tests of DSM-5 diagnostic criteria. They characterized the interrater reliability for diagnosing major depressive disorder by two trained mental health practitioners as of “questionable agreement.” These field tests confirmed an open secret among psychiatrists that our current diagnostic criteria for diagnosing major depressive disorder are unreliable and neglect essential experiences of persons in depressive episodes. Alternative diagnostic criteria exist, but psychiatrists rarely encounter them, (...) forestalling the discipline’s epistemological crisis. In Alsadair MacIntyre’s classic essay, such crises occur in science when a person encounters a rival schemata that is incompatible with their current schemata and subsequently constructs a narrative that allows them to reconstruct their own tradition. In search of rival schemata that are in conversation with their own tradition, psychiatric practitioners can utilize alternative diagnostic criteria like the Cultural Formulation Interview, embrace an epistemologically humble psychiatry, and attend to the narrative experience of a person experiencing a depressive episode. Personal authenticity is out of fashion amongst analytic philosophers. Yet, Kierkegaard, Nietzsche, Heidegger, Sartre and Camus were clearly preoccupied by its theoretical and practical viability. In this study, Jacob Golomb illuminates the writings of these philosophers in an attempt to explain their particular ethical stance on the subject. This book will prove invaluable reading for students and teachers of philosophy, literature and education and indeed for anyone who has ever empathized with Camus's Meursault, Sartre's Matthieu or Nietzsche's Zarathustra.

From the beginning, a code of ethics for bioethicists has been conceived of as part of a movement to professionalise the field. In advocating for such a code, Baker repeatedly identifies ‘having a code of ethics’ with ‘professionalization’. The American Society of Bioethics and Humanities (ASBH) echoes this view in their code of ethics for healthcare ethics consultants (HCECs)1 and the subsequent publication in the American Journal of Bioethics.2 Taking for granted that a code of ethics could be a valuable (...) asset for HCECs, this essay has two aims. First, there are good reasons to doubt that the label ‘profession’ has significant meaning for HCECs. Attempts to accurately conceive of a profession fall into two broad camps: substantive and formal. Substantive conceptions should be rejected. Specifically, substantive conceptions beg the question about what it means to be a profession, which produces devastating problems for practical application. Formal conceptions of profession (eg, Davis’ conception3) avoid begging the question, but do so at the cost of identifying the responsibilities of a profession. Using the term ‘professional responsibilities’, then, requires additional explication and classifying HCECs as professionals requires the identification of their role-specific responsibilities.i Second, this essay will critique the ASBH code of ethics for HCECs as a first articulation of these responsibilities. As written, this code of ethics has limited value for HCECs because most of the responsibilities identified in this code do not identify HCEC-specific responsibilities. In closing, some important strategies to improve upon this initial attempt to define the responsibilities of HCECs are identified. For at least the last decade, Baker has encouraged bioethicists to adopt a code of ethics. It is a matter of tacit consensus that rationalist adeptness in urban planning traces its foundations to the philosophy of the Renaissance thinker and mathematician René Descartes. This study suggests, in turn, that the planned urban environment of the Renaissance may have also led Descartes, and his intellectual peers, to tenets that became the foundations of modern philosophy and science. The geometric street pattern of the late middle ages and the Renaissance, the planned townscapes, street views and the formal garden (...) design, appeared as parables for the perfection of the universe and the supremacy of critical reason. It is within this urban metaphor that Descartes's philosophical narrative betrays perceptual and conceptual impact from the contrast between convoluted medieval townscapes and the emerging harmonious street patterns where defined vistas and predictable clarity of street views were paramount. The geometrically delineated street views of the Renaissance new town became the spark that lit the philosopher's sagacity in reflecting upon the concept of "clear and distinct ideas." Past suggestions that Descartes was led to his philosophical breakthroughs through his discovery of co-ordinate geometry reinforce further the stance that Renaissance planning predisposed rationalist thought. This paper seeks to explore the significance of a specific kind of religious experience for the rationality of religious belief. The context for this is a gap between what is often allowed as rational and what is embraced as certain in the life of faith. The claim to certainty at issue is related to the work and experience of the Holy Spirit; this experience has a structure which is explored phenomenologically. Accountable Care Organizations are a key mechanism of the Patient Protection and Affordable Care Act. ACOs will influence incentives for providers, who must understand these changes to make well-considered treatment decisions. Our paper defines an ethical framework for physician decisions and action within ACOs. Emerging ethical pressures providers will face as members of an ACO were classified under major headings representing three of the four principles of bioethics: autonomy, beneficence, and justice. Conflicts include a bias against transient populations, a motive (...) to undertreat conditions lacking performance measures, and the mandate to improve population health incentivizing life intrusions. After introducing and explaining each conflict, recommendations are offered for how providers ought to precede in the face of novel ethical choices. Our description of novel ethical choices will help providers know what to expect and our recommendations can guide providers in choosing well. (shrink)

The thesis of this paper encapsulates the deep suspicion postcolonial theory has of privileged identity claims while ignoring the manner in which identity is negotiated in a postcolonial context. The limits of identity claims with regard to theology and ethics is analyzed through Rahner’s presentation of “Indifferent Freedom” and its impact on gendered subalterns. A feminist postcolonial theological anthropology rejects the dehumanizing consequences of Rahner’s move to condone violence in the face of force in the world. What is needed rather, (...) is a non-violent and embodied response in the face of violence, initiated by the gendered subaltern, which simultaneously captures Rahner’s original intention of linking spirituality to ethics. Gayatri C. Spivak’s notion of the caress to interrupt the dehumanized discourses of exploitation and unequal power is forwarded as the way to being human in the postcolonial context, in order to make Rahner’s theology and spirituality more concrete for postcolonial societies. The main designs of modern theories of syntax assume a process of syntagmatic organization. However, research on first language acquisition leaves no doubt that the structured combination of single lexical items cannot begin until a critical mass of lexical items has been acquired such that the lexicon is structured hierarchically on the basis of hierarchical feature bundling. Independent of a decision between the main views about the design of a proto language (the grammarless “Holophrastic view”,Arbib & Bickerton 2010: 1,Bickerton 2014) (...) or the ‘Compositional View’ as taken byRizzi (2010),Carstairs-McCarthy (2010), and others. What seems to be the minimal offset for language is the existence of grammatical categories like verb and noun, on the one hand, and, on the other hand, functional categories as needed for the expression of all kinds of agreement between the distinct categories to form recursively structured complexes. I follow the different stages of complexification asking whether there is paradigmatic next to syntagmatic organization and what its added value is for the evolution of grammar. The conclusion will be that paradigmatics is an indismissible part of the organization of early language in that it structures the lexicon so as to make primary and secondary syntactic merge possible and, consequently, is also a prerequisite for movement. The guiding idea of this position is Roman Jakobson’s insistence on the twofold organization of language and grammar. The two organizational designs, syntagmatics and paradigmatics, are manifest within each module: in the phonetic, the morphological, the syntactic, the semantic, and the pragmatic form (consider Jakobson’s1971a,breiterated argument). Vast transformations in the conditions of human life and the growth of scientific knowledge call for large-scale reconstruction in morality. This is the historical context for the contemporary problem of the relation between empirical knowledge and ethics. The present paper examines the metaethical aspects of this problem. It is argued that the sharp isolation of ethics from empirical science, representing a philosophical convergence of Kantian, phenomenological and positivist theses, should be seen as a distinctive intellectual program in the 20th century (...) ethics and not as an established theory; that this program has by now had its trial and failed, both on the conceptual and the empirical side; that the program rests on a psychology now abandoned in the progress of science. It is suggested that an opposing integrative program which relates empirical knowledge and ethics is more likely to succeed, that it is better grounded psychologically and stands a better chance of a helping deal with the practical problems of morality in the contemporary world. These several theses are explored in outline, with some indication of the way conceptual frameworks in ethics are to be justified in the long run. (shrink)
