Bereby‐Meyer, Hayakawa, Shalvi, Corey, Costa and Keysar investigate lying for self‐serving reasons. Participants in their experiments had to report the outcome of rolling a die only known to them. They inflated their outcomes less, and thus lied less, when using a foreign language than when using their native language. The authors suggest that lying for self‐serving reasons is an automatic tendency that can be overcome by speaking in a foreign language. [71].

In Meyer’s promising account [7] deontic logic is reduced to a dynamic logic. Meyer claims that with his account “we get rid of most (if not all) of the nasty paradoxes that have plagued traditional deontic logic.” But as was shown by van der Meyden in [4], Meyer’s logic also contains a paradoxical formula. In this paper we will show that another paradox can be proven, one which also effects Meyer’s “solution” to contrary to duty obligations and his logic in (...) general. (shrink)

The greater part of this book is a careful analysis and defense of H. von Helmholtz's theory of perception. But this analysis is also meant to justify a more basic thesis, which can be seen as the central point of the work as a whole. This central thesis is the assertion of the need to return to a plausible form of epistemological realism after the long and misguided history of mind-dominated philosophy--that is to say, of Cartesian rationalism, subjective and objective (...) idealism, phenomenology, and linguistic philosophy. This contribution aims at discussing the agonistic dimension of John Dewey’s pragmatism. The paper starts by reconstructing Dewey’s influence on Albert Meyer, a leading figure of 20th-century American psychiatry. This comparison will shed light on Dewey’s influence on Meyer, focusing on some core psychological notions such as mental health and growth. Moreover, it will show the key role played by the category of conflict in Dewey’s pragmatism, and how the latter can account for the darker and more problematic sides (...) of human life. The paper ends with a quick elaboration on the notion of survivance, which denotes the ability to “go on” – both as individuals and as societies – in the face of conflict and devastation. (shrink)

Victim's Stories and the Advancement of Human Rights takes on a set of questions suggested by the worldwide persistence of human rights abuse and the prevalence of victims' stories in human rights campaigns, truth commissions, and international criminal tribunals: What conceptions of victims are presumed in contemporary human rights discourse? How do conventional narrative templates fail victims of human rights abuse and resist raising novel human rights issues? What is empathy, and how can victims frame their stories to overcome empathetic (...) obstacles and promote commitment to human rights? How can victims' stories be used ethically in the service of human rights? The book addresses these concerns by analyzing the rhetorical resources for and constraints on victims' ability to articulate their stories and by clarifying how their stories can contribute to enlarged understandings of human rights protections and deepened commitments to realizing human rights. It theorizes the normative content that victims' stories can convey and the bearing of that normative content on human rights. Throughout the book, published victims' stories-including stories of torture, slavery, genocide, rape in wartime, and child soldiering-are analyzed in conjunction with philosophical arguments. Charles Sanders Peirce is generally regarded as the founder of pragmatism, and one of the greatest ever American philosophers. Peirce is also widely known for his work on truth, his foundational work in mathematical logic, and an influential theory of signs, or semiotics. Albert Atkin introduces the full spectrum of Peirce’s thought for those coming to his work for the first time. Although clinical ethics scholarship and practice has largely avoided assuming an activist stance, the many health care crises of the last eighteen months motivated a distinct change: On listserves, in blog postings, and in published essays, activist language has permeated conversations over such issues as the impact of triage policies on persons with disabilities and of color, and how the health care system has historically failed African Americans. In this paper, I defend this turn, arguing that clinical ethicists should embrace (...) activism—generally, and with particular emphasis on institutional, mesolevel concerns. Ethicists are often uniquely situated to understand the structural factors that regularly motivate clinical ethics cases, and they are often in a privileged position to be effective change agents. In making this case, I also stress the need not to overstep one's skills and to be acutely cognizant of the political risks associated with such work. (shrink)

Access to abortion services in the United States continues to decline. It does so not because of significant changes in legislation or court rulings but because fewer and fewer physicians wish to perform abortions and because most states now have "conscientious objection" legislation that makes it easy for physicians to refuse to do so. We argue in this paper that physicians have an obligation to perform all socially sanctioned medical services, including abortions, and thus that the burden of justification lies (...) upon those who wish to be excused from that obligation. That is, such persons should have to show how requiring them to perform abortions would represent a serious threat to their fundamental moral or religious beliefs. We use current California law as an example of legislation that does not take physicians' obligations into account and thus allows them too easily to declare conscientious objection. (shrink)

Recently, empirically minded philosophers have employed evidence of widespread, fundamental moral disagreement to argue against moral realism. I argue that the empirical evidence does not refute realism because the disagreement is consistent with certain pluralistic versions of moral realism that posit a set of pro tanto normative principles. Others have appealed to pluralism in defense of moral realism but have used pluralism to attack the empirically based approach to ethical theory. Although I argue that the empirical argument against moral realism (...) fails, I defend the approach and suggest better ways that (pluralist) moral realism could be tested empirically. (shrink)

In Buddhism, Meditation and Free Will: A Theory of Mental Freedom , Rick Repetti explains how the dynamics of Buddhist meditation can result in a kind of metacognition and metavolitional control that exceeds what is required for free will and defeats the most powerful forms of free will skepticism. This article argues that although the Buddhist path requires and enhances the kind of mental and volitional control Repetti describes, the central dynamic of the path and meditation is better understood as (...) a process of habituation. This not only involves the dis‐identification from mental and emotional content that Repetti discusses—and is commonly emphasized in modern presentations of mindfulness or insight (vipassanā ) meditation—but also a transformation of the heart that is effected through the complementary psychological and somatic qualities associated with calm abiding (samatha ) and concentration (samādhi ) and emphasized in the Pali Nikāyas and commentaries. Clinical ethical consultants are subject to an unavoidable conflict of interest. Their work requires that they be independent, but incentives attached to their role chip relentlessly at independence. This that they be independent, is a problem without any solution, but it can at least be ameliorated through careful management.

Feminist studies of female genital cutting (FGC) provide ample evidence that many women exercise effective agency with respect to this practice, both as accommodators and as resisters. The influence of culture on autonomy is ambiguous: women who resist cultural mandates for FGC do not necessarily enjoy greater autonomy than do those women who accommodate the practice, yet it is clear that some social contexts are more conducive to autonomy than others. In this paper, I explore the implications for autonomy theory (...) of these understandings of the relation between culture, FGC, and women’s agency. I review the range of worldwide FGC practices – including “corrective” surgery for “ambiguous genitalia” in Western cultures as well as the various initiation rites observed in some African and Asian cultures – and the diverse cultural rationales for different forms of FGC. I argue that neither latitudinarian, value‐neutral accounts of autonomy nor restrictive, value‐saturated accounts adequately explain women’s agentic position with respect to FGC. I then analyze a number of educational programs that have enhanced women's autonomy, especially by strengthening their introspection, empathy, and imagination. Such programs, which engage women's autonomy skills without exposing them to autonomy‐disabling cultural alienation, promote autonomy‐within‐culture. This understanding of autonomy as socially situated, however, entails neither endorsement of FGC nor resignation to its persistence. (shrink)

Journalists are regularly criticized for causing harm to others, such as invading privacy, printing, or airing offensive material, and so forth. Although most sensitive journalists readily acknowledge these harms, they frequently argue that the pursuit and coverage of news is nonetheless justified because it fulfills a greater moral purpose - satisfaction of the public's right to know. This article argues that although "the public s right to know" does justify some harmful journalistic behavior, too often the phrase is used without (...) the conceptual precision necessary to justify the competing harm. That is, journalists often confuse having a right to know with having an interest or curiosity in knowing and such conceptual confusion too often allows journalistic behavior to occur that would otherwise be seen as unethical.
