This paper considers contractarianism as a method of justification. The analysis accepts the key tenets of contractarianism: expected utility maximization, unanimity as the criteria of acceptance, and social-scientific uncertainty of modelled agents. In addition to these three features, however, the analysis introduces a fourth feature: a criteria of rational belief formation, viz. Bayesian belief updating. Using a formal model, this paper identifies a decisive objection to contractarian justification. Insofar as contractarian projects approximate the Agreement Model, therefore, they fail to justify (...) their conclusions. Insofar as they fail to approximate the Agreement Model, they must explain which modelling assumption they reject. (shrink)

We examine a contribution L. Susan Stebbing made to the understanding of critical thinking and its relation to formal logic. Stebbing took expertise in formal logic to authorise logical intervention in public debate, specifically in assessing of the validity of everyday reasoning. She held, however, that formal logic is purely the study of logical form. Given the problems of ascertaining logical form in any particular instance, and that logical form does not always track informal validity, it is difficult to see (...) how she could justify her belief in logical interventionism. Her answer to this problem is the contribution we explore here. It involves the view that although the logician’s expertise is not sufficient to assess arguments made in everyday contexts on its own, it nevertheless plays a unique role in giving systematicity and direction to the critique of such arguments, in particular, in public debate. I respond to Vaidman’s recent criticisms of my paper “A New Problem for Quantum Mechanics”.

The percentage of female entrepreneurs is far below the level of males, although it has increased over the past several years. Based on the theory of planned behavior, the purpose of this article is to specify a model in which the relationship among entrepreneurial potential, gender and entrepreneurial intention are explored, by analyzing how perceived behavioral control (PBC) and perceived entrepreneurial skills, as exogenous variables, affect expression of intention for business, and how these are mediated by their entrepreneurial motivations and (...) risk taking propensity. Control variables where also included in this model, such as necessity-driven motives for business, in order to observe whether these are an influential factor. An implementation of Structural Equation Modeling (SEM) was used to analyze data collected from 677 students. Variables within the model were compared by gender using t-Test, and all multivariate analysis were done by each one separately as well in order to better gauge their perceptions. Results showed that mean differences between males and females are not abundant, and come only from intentions, PBC and subjective norm, which are higher in males; and motives for business higher in females. Multivariate analysis shows gender differences at the mediation level and that necessity-driven motives are an influencing factor, more so in males, and it hampers the significance of subjective norm. Finally, the theoretical and practical implications of the results within the framework of entrepreneurship in Spain and future alternatives to improve the entrepreneurial potential are discussed. Building on Nozick's invariantism about objectivity, I propose to define scientific objectivity in terms of counterfactual independence. I will argue that such a counterfactual independence account is (a) able to overcome the decisive shortcomings of Nozick's original invariantism and (b) applicable to three paradigmatic kinds of scientific objectivity (that is, objectivity as replication, objectivity as robustness, and objectivity as Mertonian universalism).

In the context of African American enslavement and the legacy of that enslavement, do some uses of the word “nigger” possess the power to enslave? It goes without saying that the words “negro,” “nigger,” “colored,” and “black” are an important part of the language and discourse of African American enslavement—as terms used by slave owners, slave traders, slave catchers, and slaves themselves; as terms still used today by people living with the legacy of slavery; and as terms highlighted by academics (...) in explaining these events and various other aspects of the African American experience. However, the aim of this article is to explore the role of these words as instruments of racial enslavement within the USA—past and present. To be more precise, the article argues that in several different ways relating to bodies of law, enforcement of law (or lack thereof), and the scope of law, the words “negro,” “nigger,” “colored,” and “black” come to not simply mean “a slave” but actually to make African Americans slaves. There is a growing body of literature on whether or not online hate speech, or cyberhate, might be special compared to offline hate speech. This article aims to both critique and augment that literature by emphasising a distinctive feature of the Internet and of cyberhate that, unlike other features, such as ease of access, size of audience, and anonymity, is often overlooked: namely, instantaneousness. This article also asks whether there is anything special about online (as compared to offline) hate speech (...) that might warrant governments and intergovernmental organisations contracting out, so to speak, the responsibility for tackling online hate speech to the very Internet companies which provide the websites and services that hate speakers utilise. The value of resting electroencephalogram (EEG) in revealing neural constitutes of consciousness (NCC) was examined. We quantified the dynamic repertoire, duration and oscillatory type of EEG microstates in eyes-closed rest in relation to the degree of expression of clinical self-consciousness. For NCC a model was suggested that contrasted normal, severely disturbed state of consciousness and state without consciousness. Patients with disorders of consciousness were used. Results suggested that the repertoire, duration and oscillatory type of EEG microstates in resting condition quantitatively (...) related to the level of consciousness expression in brain-damaged patients and healthy-conscious subjects. Specifically, results demonstrated that (a) decreased number of EEG microstate types was associated with altered states of consciousness, (b) unawareness was associated with the lack of diversity in EEG alpha-rhythmic microstates, and (c) the probability for the occurrence and duration of delta-, theta- and slow-alpha-rhythmic microstates were associated with unawareness, whereas the probability for the occurrence and duration of fast-alpha-rhythmic microstates were associated with consciousness. In conclusion, resting EEG has a potential value in revealing NCC. This work may have implications for clinical care and medical–legal decisions in patients with disorders of consciousness. (shrink)

Maybe you only have 1000 units of some resource, but 10,000 people need the resource or would benefit from it. One question: why do you control the resource? Leave that aside for now. A second question: how should you allocate the resource? If you are a decision-maker in a health system, and if the resource has to do with medicine or public health, we are in the world of the ethics of scarce resource allocation decisions in healthcare. Munthe et al (...) 1 note that the ‘operational norms that guide actual decision making in this area tend to be similar across health systems’ and include principles concerning need, prognosis, equal treatment and cost-effectiveness. Even with just these principles, there are hard questions of how they ought to be specified, operationalised and balanced against each other when they conflict. They do not focus on this. Instead, they identify a concern: paying attention only to these principles in making allocation decisions may lead decision-makers to miss ‘negative dynamics’ that result from their decisions. They aim to rectify this by suggesting a ‘sustainability’ principle that would sit alongside these other ethical principles, serving as a side-constraint that rules out certain allocation choices or as a distinct reason to be weighed in the decision-making calculus (or a reason to save or insure against negative dynamics). ObjectiveCo-morbid insomnia and sleep apnea is a common and debilitating condition that is more difficult to treat compared to insomnia or sleep apnea-alone. Emerging evidence suggests that cognitive behavioral therapy for insomnia is effective in patients with COMISA, however, those with more severe sleep apnea and evidence of greater objective sleep disturbance may be less responsive to CBTi. Polysomnographic sleep study data has been used to predict treatment response to CBTi in patients with insomnia-alone, but not in patients with COMISA. (...) We used randomized controlled trial data to investigate polysomnographic predictors of insomnia improvement following CBTi, versus control in participants with COMISA.MethodsOne hundred and forty five participants with insomnia and sleep apnea [apnea-hypopnea index ≥ 15] were randomized to CBTi or no-treatment control. Mixed models were used to investigate the effect of pre-treatment AHI, sleep duration, and other traditional, and novel [quantitative electroencephalography ] polysomnographic predictors of between-group changes in Insomnia Severity Index scores from pre-treatment to post-treatment.ResultsCompared to control, CBTi was associated with greater ISI improvement among participants with; higher AHI, less wake after sleep onset, and less N3 sleep. No quantitative electroencephalographic, or other traditional polysomnographic variables predicted between-group ISI change.DiscussionAmong participants with COMISA, higher OSA severity predicted a greater treatment-response to CBTi, versus control. People with COMISA should be treated with CBTi, which is effective even in the presence of severe OSA and objective sleep disturbance. (shrink)

In simplified form, the argument that I am defending holds that the incompatibility of our freedom with determinism follows from the conjunction of (1) a plausible supervenience claim which says that whether a human agent is free depends only on what happens during the agent’s life and (2) a freedom-cancellation principle of Richard Gale which says that an agent is not free if all of her actions are intentionally brought about by another agent. У статті розглянуто результати археологічного дослідження трипільського храмового комплексу – Небелівського храму. Автор виокремлює особливу знахідку, а саме – залишки керамічного диска з групою фішок до нього. Ця знахідка в науковому світі дістала назву Небелівський Диск. Відзначено, що засадничим явищем інтер’єрного простору Небелівського Храму стала умовна яма (заглиблення) у самому центрі ритуального залу. Вона є центральною храмовою точкою, яка надає ключ до інтерпретації головного храмового символу, котрий ймовірно був рослинного походження. У статті проводяться паралелі між головним ритуальним залом Трипільського Храму (...) та особливою ритуальною спорудою ведичної релігії «prâcînavamsa» («прачинаванса»), в якій проводився найголовніший ритуал ведичної релігії «ашвамедха». Це засвідчує значну подібність двох сакральних споруд, а найголовніше – це подібність заглиблень у центрі священного простору, яке позначалося «Світовим Деревом» (за В. Топоровим). Автор доводить, що особливості інтер’єрного наповнення Небелівського Храму висвітлюють уявлення давніх людей про структуру священного Космосу, про місце людей у ньому та символи, які пов’язують сакральне суспільство з космологічними уявленнями. Особливість даного дослідження полягає в тому, що внутрішнє храмове наповнення є, по суті, матеріалізованим духовним світом давніх землеробів, який транслює їхню релігійну космологію. (shrink)

Determinism is a doctrine or assumption best defined in the realm of the natural sciences. In this paper I explain in detail the four senses of determinism, from the most fundamental metaphysical sense, to the most complex epistemic (predictive) sense. I take as a starting point the analysis of determinism offered by Stephen Kellert. Each of these senses is then expounded and commented with a view to explore some of the implications of each of them in theoretical physics. The most (...) important of my tasks in this paper is to differentiate between the metaphysical and epistemic consequences of the deterministic assumption. My objective is to show that determinism as an ontological tenet is capable of withstanding criticism, even though predictive determinism is likely to be false. (shrink)

The fundamental Hennigian principle, grouping solely on synapomorphy, is seldom used in modern phylogenetics. In the submitted paper, we apply this principle in reanalyzing five datasets comprising 197 complete plastid genomes (plastomes). We focused on the latter because plastome-based DNA sequence data gained dramatic popularity in molecular systematics during the last decade. We show that pattern-cladistic analyses based on complete plastid genome sequences can successfully resolve affinities between plant taxa, simultaneously simplifying both the genomic and analytical frameworks of phylogenetic studies. (...) We developed “Matrix to Newick” (M2N), a program to represent the standard molecular alignment of plastid genomes in the form of trees or relationships directly. Thus, massive plastome-based DNA sequence data can be successfully represented in a relational form rather than as a standard molecular alignment. Application of methods of median supertree construction (the Average Consensus method has been used as an example in this study) or Maximum Parsimony analysis to relational representations of plastome sequence data may help systematist to avoid the complicated assumption-based frameworks of Maximum Likelihood or Bayesian phylogenetics that are most used today in massive plastid sequence data analyses. We also found that significant amounts of pure genomic information that typically accommodate the majority of current plastid phylogenomic studies can be effectively dropped by systematists if they focus on the pattern-cladistics or relational analyses of plastome-based molecular data. The proposed pattern-cladistic approach is a powerful and straightforward heuristic alternative to modern plastome-based phylogenetics. (shrink)

The paper presents the second part of the study of “sponsored goods” in the cultural sector. It describes economic activities of theaters, concert organizations and museums in three dimensional index space coordinate axes being the lag of labor productivity, faster growth of salaries and tickets prices in relation to the corresponding macroeconomic indices. The methodology of constructing such indexes and statistical data used for this purpose are described in the first article published under the title “Symptoms and consequences of Baumol’s (...) cost disease in cultural sector: an econometric study of “sponsored goods”. The aim of the present article is to construct and analyse econometric model of cost disease based on statistical data on activities of Russian theaters, concert organizations and museums for the period of 1994-2010. The regression analysis based on structural model that reflects theoretically predictable links was chosen as a method of study. Such links include first, influence on cost growth of lag of labour productivity in arts organisations and parallel trend in salaries. Second, dependence of increase of income of such organizations on dynamics of labour productivity and ticket prices, third, balanced equation - product of equilibrium conditions for sponsored goods that describes the interrelation between costs of production, prices and budget subsidies. The calculations made it possible to construct basic and modified econometric models that establish statistical correlations between income deficit and three regressors, namely indexes of labour productivity, salaries and ticket prices. As a result of this model the article presents projections of regression relation of income deficit on «expenditures plane», «income plane» and «economic results plane». Theequations derived allow to conclude that there is a statistically significant income deficit negative elasticity by labour productivity index, positive elasticity by salaries index and ticket price index, as well as rising dynamics of Russian performing arts organization income deficit and its compensation in the nearest future. This contribution seeks to clarify the status of Ereignis and Dasein in the Beiträge zur Philosophie and to question, in particular, the relationship between these two concepts. The angle that will be preferred here is that of the discussion with transcendentalism. The author defends the thesis that there is an alteration in the meaning of “Dasein” between Sein und Zeit and the Beiträge zur Philosophie, having repercussions on the relationship between “Seyn” and “Da-sein”. At the very heart of this new (...) meaning of Da-sein in the Beiträge stands the conception of an “out-standing standing-within” that must be analyzed in detail. (shrink)

There is much in Weinstein’s article to contemplate, but I shall limit myself to making the following four main points. First, I believe that debates concerning the normative standing of hate speech law are always improved by heeding the internal variety of such law, and although I can see something of that same care in Weinstein’s article, such as when he distinguishes between different forms of hate speech law based on relative detriment to the legitimacy of so-called downstream laws, in (...) some instances this care is lacking. Second, Weinstein plays up the importance of collective authorization or democratic legitimacy of downstream laws vis-à-vis “(a) the obligation of those restrained by the speech restriction to obey a downstream antidiscrimination law; and (b) the morality of enforcing the downstream measure against those whose participatory rights have been impaired by the upstream speech restriction.” These may be important aspects of what it means to detract from the legitimacy of downstream laws, but they do not exhaust the relevant aspects. Third, I think that Weinstein’s article ignores some important nuances in what I have argued about hate speech laws and political legitimacy, and ignores something that might be true of the relationship between political and democratic legitimacy, namely, it might be that political legitimacy takes lexical priority over and, therefore, cannot be traded off against, the collective authorization or democratic legitimacy of downstream laws. Finally, I believe that in describing my use of the precautionary principle as “plainly indefensible” Weinstein has done justice neither to the raw plausibility of that principle nor to how I applied it to the special silencing effects of hate speech.
