Earlier this year, the U.S. Department of Health and Human Services announced its intent to strengthen enforcement of legal protections for health care providers' conscience rights. It proposed regulations that would give the DHHS Office of Civil Rights greater authority to ensure that recipients of federal funding comply with federal conscience laws. This recent development creates an opportunity for scholars and policy‐makers to revisit the perennial debate about whether and how law should protect health care providers' rights of conscience. Arguments (...) about who should be protected, what actions should be protected, and whether there should be any limitations on the exercise of conscience rights have brought us no closer to a resolution. However, there is one remaining avenue for analysis that has, surprisingly, received very little attention—the question of how providers are protected, and from what consequences. Existing U.S. conscience laws immunize health care providers from a wide range of adverse consequences—including civil liability, criminal prosecution, administrative penalties, adverse action by employers, and discrimination by private actors, among others. However, academic and public policy debates rarely acknowledge the breadth of these protections. It is essential to disentangle this network of possible protections. (shrink)

The practice of health-care professional involvement in capital punishment has come under scrutiny since the implementation of lethal injection as a method of execution, raising questions of the goals of medicine and the ethics of medicalized procedures. The American Medical Association and other professional associations have issued statements prohibiting physician involvement in capital punishment because medicine is dedicated to preserving life. I address the three primary arguments against health-care professionals being involved in lethal injection and argue that they are not (...) strong enough to prohibit physician involvement in the lethal injection process. Kant’s views on the problem of the laws of nature and the theleological principle presented in this context, which Kant proposes in the character of a regulative methodological postulate. (...) The analysis of fundamental philosophical notions (the law of nature, necessity, causality, purpose) carried out from the position of an extreme aprioristic rationalism leads Kant to the conclusion about the basic impossibility of educing the conception of purpose (in relation to nature) from aprioristic transcendental laws, ie. such laws which the theoretical reason imposes to the nature by necessity. However, the fact of a total functioning of an organism does not fit, according to Kant, into the frames of a mechanically understood causality. Kant tries to solve this problem choosing the way of conclusion by analogy and finally he suggests to introduce into the living nature a specific causal relation in which the purposes constitute a particular kind of causes and results at the same time. That conception oscillates between mechanicism and theological finalism, and the fitting of a science system into the frames of aprioristic categories does not permit a finally decide about the supremacy of one or the other way of seeing the world. However, nevertheless, the perceiving and stressing of the peculiarity of organic symptoms, the formulation of the postulate about their unreductability to the law of a mechanical type constitute unquestionable and great merit of the author of the Criticism of the Judgment Authority. The idea of the totality of organism, though involved in subjective idealistic non consequences of Kant’s conceptions has in the given historical period all features of a deep and progressive thought, outpacing and inspiring several later research ideas, both in philosophy and in natural science. Using randomly generated sequences of binary events we asked participants to make predictions about the next event. It turned out that while predicting uncertain events, people do not behave unsystematically. Our research identifies four types of relatively consistent strategies for predicting uncertain binary events: a strategy immune to short-run sequential dependencies consisting of the persistent prediction of long-run majority events, hereafter called the long-run momentum strategy ; a strategy immune to short-run sequential dependencies consisting of the persistent prediction of long-run (...) minority events, called the long-run contrarian strategy ; a strategy sensitive to short-run sequential dependencies consisting of the prediction of short-run majority events, called the short-run momentum strategy ; and a strategy sensitive to short-run sequential dependencies consisting of the prediction of short-run minority events, called the short-run contrarian strategy . When the character of events remains unknown, the most common strategy is the short-run momentum strategy. With the increase of a perceived randomness of the situation, people tend more often to use the short-run contrarian strategy. People differ in their general beliefs about the continuation or reversal of a trend in various natural and social processes. Trend believers, when facing sequences of binary events commonly perceived as random, tend to use momentum strategies, whereas those who believe in the trend's reversal tend to use contrarian strategies. When individual patients' medical decisions contribute to population-level trends, physicians may struggle with how to promote justice while maintaining respect for patient autonomy. This article argues that this tension might be resolved by using the informed consent conversation as an opportunity to position patients as societal stewards.

Medicine often views hospice care as “giving up,” which results in a reduced quality of end-of-life care for many patients. By integrating a theology of the Sabbath with modern medicine, hospice becomes a sacred and valuable way to honor the dying patient in a comprehensive and holistic way. A theology of Sabbath as “Sacredness in Time” can provide the foundation for a shift in understanding hospice as a legitimate care plan, which shifts the focus from controlling and manipulating space for (...) the body, to rest and enjoyment of time for the whole person. First, I explore vitalism and its negative effects on the institution of hospice. Second, I address the main misconceptions and biases surrounding hospice in order to establish hospice as an appropriate option for the terminally ill. Finally, I argue for a shift away from sacredness in space (as seen in vitalism) to sacredness in time. (shrink)

This paper begins with the assumption that the differences among women pose a threat to building a unified feminist theory and practice. Utilizing the work and methods of Michel Foucault, I explore theoretical and practical implications of taking difference seriously. I claim that a politics of difference puts into question the concept of a revolutionary subject and the idea of a social totality. In the final section a brief Foucauldian analysis of the feminist sexuality debates is given.

The American Medical Association’s (AMA’s) “Opinion 1.1.7, Physician Exercise of Conscience” attempts to help physicians strike a reasonable balance between their own conscientious beliefs and their patients’ medical interests in an effort to minimize harms to both. However, some ambiguity still remains as to whether the severity of harms experienced by physicians and patients is to be assessed externally (by policy makers or by a professional body like the AMA), or internally by the subjects of those harms. Conflicts between conscientious (...) physicians’ self-assessments of the moral harm associated with various actions and the AMA’s external assessments of such harms are likely to lead to challenges in the implementation of some provisions of its opinion. This commentary argues, however, that provisions (b) and (e) of the opinion, which describe the information physicians should provide about their own scope of practice and about the existence of controversial procedures, are less likely to conflict with physicians’ subjective assessments of moral harm, and therefore will face fewer challenges in implementation. This article argues that the Supreme Court’s decision in Dobbs is likely to impact medical decision-making by pregnant patients in a variety of contexts. Of particular concern are situations where a patient declines treatment recommended for its potential benefit to the fetus and situations where treatment is withheld due to potential risk to the fetus. The Court’s elevation of fetal interests, combined with a history of courts using abortion jurisprudence to guide their reasoning in compelled treatment cases, means that Dobbs (...) has the potential to limit patient autonomy in a wide array of clinical settings. The article calls on professional medical associations to issue ethical guidance affirming the duty to respect the medical self-determination of pregnant patients. (shrink)

Occupying an eccentric position with respect to critical theories, Foucault prefigures a queer critical thought and practice. In this paper I make a case for the continuing importance of Foucault for rethinking feminism within the context of neoliberal governmentality despite continuing skepticism about the value of his ethical writings. I draw not only upon the work of Foucault, but also that of queer feminist Eve Kosofsky Sedgwick.

In Foucault, Politics, and Violence, Johanna Oksala argues that Foucault offers us a “political ontology” that might be used to free us from rigid adherence to specific political concepts and rationalities . I raise questions concerning her method, the eliminability of violence, and what a genealogical critique can and cannot do.

Niniejszy tekst podejmuje kwestię bogów i bohaterów mitów greckich, odnosząc ją do obecnej w psychologii głębi koncepcji archetypów i nieświadomości zbiorowej. Główny cel badań sprowadza się tym samym do bacznego przyjrzenia się potencjalnej korelacji pomiędzy zewnętrznymi w rozumieniu starożytnego Greka postaciami bogów i bogiń, a wewnętrznymi przejawami nieświadomości zbiorowej, które mogą stanowić – według Carla Gustava Junga – istotę antycznych bóstw. Ponadto został poddany namysłowi problem wpływu „wewnętrznych bogów” na sposób myślenia, odczuwania i działania jednostki, wpływu zarówno pozytywnego, jak i (...) negatywnego. Recent media reports have drawn widespread attention to the experiences of patients who are denied reproductive services at Catholic hospitals. For some patients, such as those experiencing miscarriage, denial of appropriate treatment can lead to serious health consequences. However, many patients are unaware of the limitations on services available at religiously affiliated health care institutions. As a result, patients’ ability to make informed and autonomous decisions about where to seek treatment is hindered. There are currently no federal or state laws (...) requiring health care institutions to inform patients directly of the full scope of medical services they are unable to provide on the basis of religion or conscience. Given religious hospitals’ significant role in the provision of health care in the United States, it is essential that patients be clearly informed about institutional limitations on care. This goal would be best served by adopting a federal disclosure law similar to the Patient Self-Determination Act. (shrink)

In recent years, a trend has emerged in the field of art conservation, the aim of which is to protect street art objects. Attempts to conserve murals face many problems. This is due to various factors – lack of time distance to this type of objects, difficulties in assessing their artistic value, frequent lack of interest of artists in the conservation of their works, material impermanence of murals, their often-occasional nature; also, the fact that most of these objects are not (...) legally protected. The paper discusses the problems faced by an art restorer who wants to save murals. Examples of murals are presented, the conservation of which is not possible, among others, due to the fact that the houses on which they were painted are intended for demolition. There are also examples of murals whose rescue from destruction gained public approval and the conservation of which was carried out. The paintings are in a very poor condition. This is a feature of most murals, which are usually made on old, unrepaired plasters with low-quality paints. Their maintenance is a very difficult task. The presentation shows the various stages of conservation of works lacated in Warsow. The conservation of the murals is carried out in order to preserve street art facilities. Apart from the involvement of art conservators, social support for this type of activity is also important. However, one should be aware that most of murals have no chance of becoming a permanent part of the city landscape. Their fate will be determined by chance. (shrink)

Joanna Crosby and Dianna Taylor: The theme of this special section of Foucault Studies, “Foucauldian Spaces,” emerged out of the 2016 meeting of the Foucault Circle, where the four of you were participants. Each of the three individual papers contained in the special section critically deploys and/or reconceptualizes an aspect of Foucault’s work that engages and offers particular insight into the construction, experience, and utilization of space. We’d like to ask the four of you to reflect on what makes a (...) space Foucauldian, and whether or not (and why or why not) you’d consider the space created by the convergence of and intellectual exchanges among an international group of Foucault scholars at the University of New South Wales in the summer of 2016 to be Foucauldian.
