Sur ce point, nous montrerons que la délibération permet d’éviter que ne surgissent des désaccords politiques insoutenables, qui mettraient en péril l’intégrité du corps politique. | : Deliberative epistemic theories of democracy highlight the importance of deliberation for the achievement of correct decisions. The aims of this paper are to discuss the mechanisms which allow an open, free and inclusive forum of deliberation to achieve correct decisions and to discuss the impact of deliberation on disagreement. I concentrate on the constructive function of democracy which designates the capacity of deliberative democracy to identify and frame the problems of justice faced by a polity in epistemically positive ways. I first explain how democracy can pool information. This is then used to explain how deliberation can enable agreement to emerge. This is followed by a discussion of the limits of deliberation and how it is unable to resolve some disagreements. The final element of my discussion is an explanation of the role of deliberation in framing political disagreements. I argue that deliberation helps in avoiding unsustainable political disagreements which could bring about political decay. (shrink)

The overall aim of this thesis is to assess the legitimacy of constitutional laws and bills of rights within the framework of procedural epistemic democracy. The thesis is divided into three sections. In the first section, I discuss the relevance of an epistemic argument for democracy under the circumstances of politics: I provide an account of reasonable disagreement and explain how usual approaches to the authority of decision-making procedures fail to take it seriously. In the second part of the thesis, (...) I provide an account of the epistemic features of democracy and of the requirements of democratic legitimacy. I develop a revised pragmatist argument for democracy which relies on three presumptive aims of decision-making: justice, sustainability and concord. In the third and last section, I first argue for the desirability of constitutionalism. I then explain why constitutionalism, as it is usually understood, is incompatible with my procedural epistemic account of democratic legitimacy. In the last chapter, I offer a two-pronged solution to the apparent incompatibility of constitutionalism and epistemic democracy. I first argue for the appropriateness of political constitutionalism, as opposed to legal constitutionalism, in understanding the relationship between rights and democracy. I then provide an account of rights protection and judicial review compatible with epistemic democratic legitimacy. Finally, I use the notion of pragmatic encroachment to explain how constitutional laws can achieve normative supremacy through the increased epistemic credentials of the procedure. (shrink)

I aim to explain why majority voting can be assumed to have an epistemic edge over lottery voting. This would provide support for majority voting as the appropriate decision mechanism for deliberative epistemic accounts of democracy. To argue my point, I first recall the usual arguments for majority voting: maximal decisiveness, fairness as anonymity, and minimal decisiveness. I then show how these arguments are over inclusive as they also support lottery voting. I then present a framework to measure accuracy so (...) as to compare the two decision mechanisms. I go over four arguments for lottery voting and three arguments for majority voting that support their respective accuracy. Lottery voting is then shown to have, compared to majority voting, a decreased probability of discrimination. That is, I argue that with lottery voting it is less probable under conditions of normal politics that if the procedure selects X, X is reasonable. I then provide two case scenarios for each voting mechanism that illustrate my point. (shrink)

The idea of a purgatorial journey to the Ten Kings of the Ten Hells is a distinctive feature of funerals and ancestral worship in Chinese Buddhism and Chinese popular religions. In Indian Buddhism ideas emerged of chief deities presiding over others in a few of many heavens and of various hells with different tortures governed by Yama and his messengers, yet the idea that each hell was governed by a ‘king’ is not found in early Indian Buddhist sources. This article (...) examines what is probably the earliest enumeration of hell-kings, in the S?tra on Questions on Hells. This very early example derives from an extraordinary story about how King Bimbis?ra and his eighteen ministers became Yama and kings of eighteen hells after a disastrous defeat in battle. My analysis will illustrate how this account was probably consciously formulated by an author familiar with two sources: the story of the Buddha’s concern about the fate of his followers in the Shenisha jing, and the popular Chinese belief in sacrificial cults of ‘defeated armies and dead generals’. I engage with the philosophical ramifications emanating from the guidelines established for crafting philosophy paper abstracts (Lian, 2023) and underscore their significance in the domain of academic philosophical writing. A pivotal focus of this research is to navigate the intricate philosophical challenges posed by cross-disciplinary investigations bridging applied linguistic statistics with philosophical paper composition, specifically, the nuanced interpretation (...) of linguistic findings in a manner palatable to philosophers. My exploration probes into the dynamics of various concepts within Inter-Disciplinary Research (IDR), highlighting the complexities in reconciling semantic intuitions related to the notions of "Method (M)" and "Conclusion (C)". I delineate three philosophical stances: (1) deferring to scientific authority, (2) recognizing domain-specific terminologies, and (3) interrogating peripheral scientific theories. I posit that these stances significantly influence the ways philosophers engage with and resolve the cross-disciplinary semantic and theoretical contentions stemming from the rhetorical structures of "Method (M)" and "Conclusion (C)". My aim in this paper is to draw Plotinus and Derrida together in a comparison of their respective appropriations of the famous “receptacle” passage in Plato's Timaeus (specifically, Plotinus' discussion of intelligible matter in Enneads 2.4 and Derrida's essay on Timaeus entitled “Kh ō ra”). After setting the stage with a discussion of several instructive similarities between their general philosophical projects, I contend that Plotinus and Derrida take comparable approaches both to thinking the origin of the forms and to problematizing (...) the stability of the sensible/intelligible opposition. With these parallels in focus, I go on to explain how examining such points of contact can help us to dismantle the canonical constructs of “Plotinus the metaphysician” and “Derrida the anti-metaphysician” that have obscured important connections between Neoplatonism and deconstruction, and suppressed latent resources within the Platonic tradition itself for deconstructing the dualistic ontology of so-called “Platonic metaphysics.”. Although I believe that social agency, quite generally, occurs within practices and structures, the relevance of structure depends on the sort of questions we are asking and what interventions we are considering. The emphasis on questions is also relevant in considering metaphysical and meta-metaphysical is- sues about realism with respect to (...) gender and race. ABSTRACT This article asks why African American Philosophy matters. The notion of the “Black philosopher” continues to be an enigma. African descendants are not generally associated with the revered location and status of “the philosopher” and with doing philosophy. In a celebration of the sustained work of the Black philosopher-practitioner, who continues to suffer a fate of deliberate academic “invisibility” and historical erasure, this article supports the expansion of philosophical categories, philosophical conversation, and philosophical inclusivity. This work contends that the (...) marginalization of African American philosophy can be understood from a synthesis of Foucault’s thesis of “subjugated knowledge” and Black philosopher Lewis Gordon’s explanation of “subverted realization,” which is built in to “white” modern thought. Both key philosophers help locate the problem questioned here. The overriding current of the “white stream” of philosophy, by its deliberate exclusion of African American philosophy, disqualifies it. A central reason to worry that managers should not use nudges to influence employees is that doing so fails to treat employees as _rational_ and/or _autonomous_ (RA). Recent nudge defenders have marshaled a powerful line of response against this worry: in general, nudges treat us as the kind of RA agents we are, because nudges are apt to enhance our limited capacities for RA agency by improving our decision-making environments. Applied to managerial nudges, this would mean that when managers nudge (...) their employees, they generally bolster their employees’ limited RA agency and, thus, treat employees as the kinds of RA agents they are. My aim is to vindicate a qualified version of the initial worry from the nudge-defender response and, as a result, provide a clearer, more plausible framework for evaluating managerial nudges than what nudge critics have previously given. I do this, first, by showing how nudge defenders rely on equivocation between two different senses of “treating someone as RA.” The _value-preserving_ notion that supports the nudge-defender prescription to protect and enhance RA capacities is different from the _authority-recognizing_ notion that underwrites the initial worry about nudging. Second, I argue that the authority-recognizing notion of treating someone as RA implies that managerial nudges treat employees as RA just when the nudges are compatible with relating to employees as equals. Third, I explain how, to determine when managerial nudges are compatible with relating to employees as equals, we need to consider how employees surrender aspects of their equal, agency-grounded authority to managers. Entre ellas está la distinción entre filosofía especulativa y experimental. Intentaré evaluar la validez de esta distinción para la filosofía moral experimental del siglo XVIII y, en particular, para la propuesta de Hume. Mostraré que si la distinción se entiende en términos excluyentes, resulta inapropiada porque el mismo Hume plantea que (...) la especulación es lo que define a la filosofía. Además, antes que considerarlas como excluyentes, el filósofo escocés propone una conciliación entre la práctica de la experimentación y la teorización. Por último, sostendré que aquello que Hume considera como “falsa filosofía” no puede entenderse como sinónimo de filosofía especulativa.: A persistent criticism of the distinction between empiricism and ra-tionalism has provoked the emergence of new distinctions in order to under-stand modern philosophy in a more adequate way. One of those distinctions is that between speculative and experimental philosophy. My aim is to evalu-ate the validity of this distinction for eighteenth-century experimental moral philosophy in general and for Hume’s thought in particular. I will show that if this distinction is understood in exclusive terms, then it cannot be adequate because Hume himself states that speculation is what defines philoso-phy. Hume also proposes a reconciliation between experimental practice and theoretical activity instead of considering that they are mutually exclusive. Finally, I will make clear that what Hume condemns as “false philosophy” is not a synonym for speculative philosophy. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Perceiving Particulars:A Buddhist DefenseMark SideritsIn a recent article in this journal, Monima Chadha claimed that the position of certain Buddhist philosophers concerning the perception of particulars is incoherent.1 Her defense of what she calls a "Nyāya-Kantian" position raises interesting questions concerning how we have knowledge of mind-independent reality. While the view that she subscribes to may well be right, I shall try to show that her arguments against the (...) views of the Yogācāra-Sautrāntika Buddhists fail to undermine their position. But some of the issues involved here intersect with underlying themes in the recent debate between Arindam Chakrabarti and Stephen Phillips over the status of indeterminate perception in Nyāya,2 so I shall have something to say about that as well.The basic position I shall seek to defend has the form of a conditional: if we wish to maintain anything like the broadly metaphysical-realist stance that is fundamental to both Yogācāra-Sautrāntika and Nyāya (as well as to Kant), then we need to hold that in at least some cases of perception it is individuals as such that are the objects of our cognitive states. Chadha's discussion leads her to the conclusion that we never perceive particulars as such. Instead, she says, what are cognized in perception are always universal features, so that what are ordinarily thought of as the particulars [End Page 367] that figure in perception are such only relative to a context. Now, I am sympathetic to such a view, since it may be compatible with the sort of antirealism advocated by the Madhyamaka school of Buddhism.3 But this should tell us that something has gone awry here, since the "Nyāya-Kantian" and the Mādhyamika make for uneasy bedfellows. My diagnosis will be that Chadha has misconstrued those realist intuitions that stand behind the Yogācāra-Sautrāntika position. A proper appreciation of these will also turn out to play a role in the defense of indeterminate perception in classical Nyāya.1Let me begin by attending to some terminological matters. In the preceding paragraph I applied the label "metaphysical realist" to the Yogācāra-Sautrāntika school of Buddhism, to Nyāya, and to Kant. Few will question my calling Nyāya realist in any sense of that term, but eyebrows may well go up over my calling Yogāca ¯ra Sautrāntika (or at least the Yogācāra wing of this syncretic school) by the same name in the same breath. Yogācāra is, after all, aptly called a species of subjective idealism, for it denies the existence of physical objects. Metaphysical realism is usually understood as the view that truth is determined by the nature of mind-independent reality (by "what is there anyway"), and do not subjective idealists deny the existence of all mind-independent entities? But "mind independence" here does not mean being independent of cognition, but rather being independent of the concepts that we happen to employ. The metaphysical realist is thus one who holds that there is a quite determinate way that things ultimately are apart from any and all schemes of conceptualization. Understood in this way, metaphysical realism is something that is subscribed to by such subjective idealists as the Yogācārins and Berkeley.4 While they maintain that nothing exists apart from mind or the mental,5 they also hold that this fact is quite independent of the ways in which we or any other cognizers conceptualize reality. Subjective idealism is but one of a large number of ontological views that might properly be called realist in the present sense.But, then, what of Kant? Surely Kant is rightly thought of as maintaining that all of the phenomenal world is in some sense the result of processes of conceptual construction, so how can he be called a metaphysical realist? It is true that much of what is currently called antirealism has a distinctively Kantian pedigree. Al-Ghazālı̄ famously claims in the Incoherence of the Philosophers that al-Fārābī and Avicenna are unbelievers because they hold philosophical positions that conflict with Islam. What is less well-known, however, is that Averroës claims in the Decisive Treatise that al-Fārābī and Avicenna are not unbelievers; rather, al-Ghazālı̄ is the true unbeliever for writing the Incoherence of the Philosophers. In this paper, my aim is to present a sustained reconstruction of Averroës’ legal and philosophical argument for why al-Ghazālı̄ is an unbeliever. The (...) crux of Averroës’ argument is that al-Ghazālı̄ has expressed false allegorical interpretations of scripture to unqualified persons, which has led them into unbelief. By being causally responsible for other people’s unbelief, al-Ghazālı̄ is an unbeliever as well. (shrink)

Although these changes are generally positive, some historiography debates have not been adequately reflected in historical texts on science. In this article, I discussed how women scientists are represented in the history of science through the case of Rosalind Franklin. In our effort to give women the place they deserve in the history of science, I have discussed what should we pay attention to as historians of science. My particular emphasis was on reflecting the structure of scientific research correctly, avoiding covering institutional discrimination and clearly writing the contribution of the figure discussed to science. I intend to make a contribution to the literature on Franklin, but more importantly, I tried to point out some common mistakes in texts about women scientists, especially Franklin. (shrink)
