In Anarchie, Staat, Utopia aus dem Jahre 1974 legte Robert Nozick eine libertäre Staatstheorie dar, die er auch als Utopie verstanden wissen will. Ist nun diese Selbst-Etikettierung berechtigt? Hierzu möchte ich sowohl Nozicks Auffassung von einer Utopie betrachten, als auch nach einem sinnvollen Utopie-Begriff suchen, dem ein als utopisch bezeichneter Text zu genügen hat. Dabei werde ich hauptsächlich den Blick auf Thomas Morus’ genre-prototypischen Text über die Insel Utopia richten. Neben der Frage, ob Nozicks Staatstheorie als Utopie bezeichnet (...) werden sollte, möchte ich zum Schluß versuchen, eine Antwort auf die Frage zu finden, warum sich Nozick eines Begriffs bedient, der im allgemeinen Sprachgebrauch durchaus nicht immer positiv verstanden wird. Perhaps no work since John Rawls’ A Theory of Justice has attracted as much recent attention as Robert Nozick’s case for a minimal state—an ingeniously argued critique, not only of antinomian individualism, but also of liberal and socialist contractualism. It might be added that the book is no solace either to more conservative political theorists, who lament state incursion into private life, but whose political structures exhibit either actual or potential constriction of human life. Nozick’s book is both a searching (...) examination of the limitations of utilitarian consequentialism and the redistributivism of Rawls. His essential theme is that "a minimal state limited to the narrow functions of protection against force, theft, fraud, enforcement of contracts etc., is justified; that any more extensive state will violate persons’ rights not to be forced to do certain things, and is unjustified; and that the minimal state is inspiring as well as right." It is also Nozick’s contention that the coercive power of the state should not be used paternalistically to prohibit activities to people for their own protection, or to force some citizens to aid others. The last part of the book is a framework for Nozick’s utopia, and it is in this section that an essentially theoretical approach, amplified by little political or sociological data, exhibits its defects. One suspects that almost all states started with simplistic hopes for minimal coercive activity, and succumbed almost inevitably to the metastasis of function as socio-political life grew in size and complexity. Night watchmen become more than night watchmen when more than watching is needed. Moreover, Nozick’s utopia would seem to necessitate, at least by implication, coercive redistributivism and some kind of compensatory or levelling taxation process. This reviewer is not sure that he understands precisely what Nozick considers correct property theory in a state of nature. The author modestly asserts the tentative, incomplete, and conjectural nature of his work. But the taxed and manipulated citizen who grows in sympathy for the sentiments of Proudhon’s famous litany should welcome this highly literate and well argued case.—R.P.M. (shrink)

At 30 years' distance, it is safe to say that Nozick's Anarchy, State and Utopia has achieved the status of a classic. It is not only the central text for all contemporary academic discussions of libertarianism; with Rawls's A Theory of Justice, it arguably frames the landscape of academic political philosophy in second half of 20th century. Many factors, obviously account for the prominence of the book. This paper considers one: the book's use of rhetoric to charm and disarm (...) its readers, simultaneously establishing Nozick's credibility with readers, turning them on his ideological opponents, and helping his argument over some of its more serious substantive difficulties. This paper responds to an ingenious footnote from Robert Nozick’s book Anarchy, State, and Utopia. Using a table of four possible situations, Nozick defines what it is to be jealous, envious, begrudging, spiteful and competitive. I deny a claim that Nozick makes for his table, a claim needed for these definitions. I also point out that Nozick fails to capture what he has in mind by jealousy.

Schon im Altertum versuchten eine Reihe von Autoren ihm nachzueifern, und nachdem Thomas Morus mit dem namengebenden Werk "Utopia" die Gattung gleichsam neu belebt hatte, entstand eine nicht mehr zu uberblickende Flut utopischer Entwurfe. In Part III of Anarchy, State, and Utopia (1974), Robert Nozick presents what he calls ‘the model of possible worlds’ (307) to examine the formal properties of utopia, defined as ‘the best of all possible worlds’ (298). The basic idea is that each person is given the power to create any possible world and its inhabitants by imagining them. Two definitions of stability have been proposed: (a) the non-circular definition according to which a world is stable if and (...) only if nobody can imagine a better world and (b) the circular definition according to which a world is stable if and only if nobody can imagine a better world that is also stable. In this paper, we prove four theorems (namely, the indeterminacy theorem, the stable dystopia theorem, the nobody’s utopia theorem and the redundancy theorem) that provide us with decisive reasons to reject the circular definition and opt for the non-circular definition of stability to analyse Nozick’s theory of utopia. As liberal socialism maintains, the constitution results in a balance between neo-liberal thinking and the Keynesianism adopted by the german,,people's parties“. As a result challenge to the social state a society of dependent classes magnifies the,,social power“ of politics and damages the common good in the debit of present contributors and future pensioners of the pension systems. El presente capítulo se propone, en primer lugar, elucidar algunos aspectos de la dimensión política de distintos textos nodales de la obra de Hans-Georg Gadamer, como Plato und die Dichter [1934], Platos Staat der Erziehung [1942], y el más tardío Idee des Guten zwischen Plato und Aristoteles [1978]. Para ello, se realizará una revisión crítica de una de las lecturas contemporáneas de estos aspectos, aquella realizada por Dennis Schmidt. En las conclusiones, tras analizar la relación entre phrónesis, areté y andreía (...) en los diálogos platónicos, intentaré demostrar cómo estas nociones alumbran la cuestión de la seducción del poder (descuidada por Schmidt en su lectura del Platón gadameriano), así como la inseparabilidad de este problema con respecto a la concepción dialéctica de la utopía. A partir de esto último se sugerirá que es posible, desde y más allá de la lectura gadameriana de Platón, repensar la idea de desobediencia civil y el valor político del mito desde el punto de vista de la utopía. This article surveys Filippo Tommaso Marinetti's social utopia from the inception of Futurism until its end during World War II, contextualizing it in relation to the various diffused anarchistic ideologies of European artists and intellectuals. From the second half of the nineteenth century onward radical politics and the artistic avant-garde were in close dialogue. Max Stirner's individual anarchy held a special appeal to modernist artists, including Gabriele D'Annunzio and Marinetti. Marinetti's aim of renovating Italy's cultural and political life initially (...) led him to glorify the destruction of old institutions. At the end of World War I he developed a more or less coherent utopian vision of a new society, based principally on the exaltation of individual freedom and the importance of art. During the Fascist regime, Marinetti abandoned politics and concentrated his efforts on making the Aerofuturism of the interwar years the official art of Fascism, which the Futurists saw as the fulfillment of their “anarchist” dream. Global justice or the lack thereof has internal connections with global poverty. Global justice is an ideal pursuit of cosmopolitanism, which regards basic human needs as its rightful object. The right to life, from the point of view of global justice, is the most fundamental in the list of Human Rights. International anarchy and the current international economic order, however, cast a utopian shadow on the realization of this right when we consider the de facto institutions and the ostensible goal (...) of impartial love for everyone. Humanitarian aid is another approach to the problem of contemporary global poverty. Its difficulty lies first in people’s different conceptions of obligation and donation. They consider the former as duty while the latter is seen to lie beyond the call of duty. Second, in terms of a correlation between right and duty, since everyone has the right to life, the duty falls accordingly upon organizations or individuals. Meanwhile, donation as duty is not perfect obligation, thus is not compulsory either. Finally, international humanitarian aid is constrained by nationalism and partial love. Hence, in the light of either government or individual, the humanitarian aid approach is beset with challenges. Global justice has gained academic importance worldwide since John Rawls’ later works. By contrast to domestic justice, it is a theory of justice that proposes to include all human beings. Global justice stands for a kind of utopian justice in regard to both the institutional path and the humanitarian aid approach. I shall examine the theory of global justice under these two aspects. This paper analyses Nozick's possible-worlds model of utopia. It identifies and examines three arguments in favour of the minimal state: (1) the minimal state is the real-world analogue of the possible-worlds model and can hence be considered to be inspiring; (2) the minimal state is the common ground of all possible utopian conceptions and can hence be universally endorsed; and (3) the minimal state is the best or at least a very good means for approximating or achieving utopia. (...) While constituting fascinating lines of inquiry, all arguments are found to be wanting and unable to yield the conclusions that Nozick intended to establish. Nonetheless, they establish interesting and important results, in particular the result that the minimal state is the maximal institutional structure that is in principle compatible with the complete satisfaction of the maximal non-arbitrary set of preferences that are in principle co-satisfiable, as well as the corollary that in utopia any state will exert at most the functions of a minimal state. Joseph Déjacque was a sailor a mere nineteen years of age when he heard for the first time the gentle, “feminine” tone of anarchy: The voice was not of a woman; it was an odd officer’s soft words, not even “four words,”1 which did not command anything but instead permitted the things to be done and the sailors to do things their own way. Anarchy is not the absence of orders; it is the absence of butch command. And this absence, (...) gently maneuvered, produces “harmony”. This efficient and enthusiastic maneuver of anarchy was to be discovered by the young Parisian proletarian Joseph Déjacque far away from his native Faubourg Saint-Antoine, amid “the Oriental seas,” aboard a frigate of war, in 1841. I argue that Robert Nozick, in his well-known book “Anarchy, State, Utopia”, is working with Locke’s notion of the natural right to property merely instrumentally. I use the term “instrumentally” in the sense that the pieces of the source are not used within the context of the original work but are used atomically to support one’s argument or theory. Instrumental use of Locke’s theory causes incoherence in his theory. This paper introduces the incoherence in the question and explains how (...) this incoherency is inherent to Nozick’s interpretation and usage of Lockean Proviso. (shrink)

In Anarchy, State, and Utopia, Robert Nozick seeks to demonstrate that principles of justice in acquisition and transfer can be applied to justify the minimal state, and no state greater than the minimal state. That approach fails to acknowledge the critical role that forced exchanges play in overcoming a range of public goods and coordination problems. These ends are accomplished by taking property for which the owner is compensated in cash or in kind in an amount that leaves him (...) better off (by his own lights) than before the transaction. Forced exchanges use coercion to form the state, but the just compensation requirement guards against redistribution state imposed redistribution for collateral purposes. Once these forced exchanges are allowed to form a state, then they may be used thereafter to justify the powers of taxation and eminent domain used to support infrastructure (roads, sewers, public utilities) that neither the minimal state nor private markets can supply. In Anarchy, State, and Utopia, Robert Nozick contrasts entitlement theories of justice and “traditional” theories such as Rawls', utilitarianism or egalitarianism, and advocates the former against the latter. What exactly is an entitlement theory of justice? Nozick's book offers two distinct characterizations. On the one hand, he explicitly describes “the general outlines of the entitlement theory” as maintaining “that the holdings of a person are just if he is entitled to them by the principles of justice in acquisition and (...) transfer, or by the principle of rectification of injustice ”. On the other hand, his famous “Wilt Chamberlain” argument against alternative theories is first said to apply to “non-entitlement conceptions”, and later to any “end-state principle or distributional patterned principle of justice” — which amounts to an implicit characterization of an entitlement conception as a conception of justice which is neither end-state nor patterned. In Anarchy, State and Utopia, Robert Nozick argues, first, that free-market anarchism is unstable -that it will inevitably lead back to the state; and, second, that without a certain "redistributive" proviso, the model is unjust. If either of these things is the case, the model defeats itself, for its justification purports to be that it provides a morally acceptable alternative to government (and therefore to the state). I argue, against Nozick's contention, that his "dominant protection agency" neither meets his (...) monopoly condition for statehood nor need run afowl of his redistributive requirement. In Anarchy, State and Utopia Robert Nozick criticizes a broad range of theories of distributive justice using a thought experiment that involves the financial incentives for playing basketball. In this paper, I defend the so-called “patterning” conceptions of justice that are the targets of Nozick’s “Wilt Chamberlain” argument, via the development of an extended analogy between the distribution of politically relevant resources and the playing of games, as this latter activity is characterized by Bernard Suits in his influential book (...) on the subject, The Grasshopper. I argue that the plausibility of this analogy makes possible a more decisive refutation of Nozick’s argument than those suggested by Thomas Nagel and G.A. Cohen. I also briefly speculate about the implications of my game analogy for how philosophers should think about particular types of economic utopianism, especially those that involve conjectures about what human life would be like in a post-scarcity environment. In Anarchy, State and Utopia, Nozick presented his doctrine of right libertarianism, largely a contemporary restatement of Locke’s moral imperative that an individual’s rights to his life, liberty, and property are absolute and place limits on state action. Parallelly, Nozick espoused the free-market system as a framework that not only respects individual rights but ensures material benefits. While the free market results in radical inequalities in holdings and widespread dispossession, Nozick treats the process as morally just and any state (...) redistribution through taxation as wrong. However, neither Nozick nor his many critics fully considered the role of money in capitalist free markets, an omission I begin to address. Nozick asserts that money emerges pre-politically through the uncoerced actions of individuals, and that it derives its value from the commodity that underpins it. This conception of money underpins Nozick’s claims that a minimal state can be just and that the free-market system is a moral, efficient, and neutral allocator of resources. However, Nozick’s approach omits addressing how money’s general acceptability and stability are achieved. Answers can be found in heterodox economic paradigms, which put the state at the center of money creation, rendering money (and the state) incompatible with natural rights. Furthermore, by insisting on money’s commodity nature, Nozick ignores the seventeenth century revolution in money, necessitated by the emergence of free-market capitalism and commodity money’s inability to underpin it. In other words, it is not commodity money but credit money that should be the proper object of Nozick’s analysis. I go on to analyze what credit money is, how it arose, and why some form of it is necessary in a free-market context. Ultimately, I argue that it is not compatible with natural rights and is itself redistributive. Key words: money, distributive justice, Nozick, Locke, free market capitalism, natural rights. In chapter four of Anarchy, State, and Utopia, Robert Nozick raised interesting questions about whether or not it is ever morally acceptable to act against what are agreed to be an individual's natural moral rights. The pursuit of these questions opens up issues concerning the specific content of these individual rights. This essay explores Nozick's questions by posing examples and using our considered responses to them to specify the shape of individual rights. The exploration provisionally concludes that a conception (...) of individual moral rights quite different from Nozick's looks attractive and merits further development.
