Rendre hommage à un auteur, ce n'est pas seulement célébrer ce qu'il fut mais c'est aussi alerter sur ce que son oeuvre apporte au présent et à l'avenir de la connaissance. C'est bien le sens donné à cet hommage à André-Jean Arnaud. Repenser le droit, c'était pou r cet auteur érudit : repenser les lieux, les conditions et les façons de l'étudier en dépassant les frontières géographiques en même temps que les frontières disciplinaires. En montrant en quoi André-Jean (...) Arnaud fut, hors des sentiers battus et des orthodoxies de la production et de la transmission des savoirs en la matière, un exceptionnel précurseur et l'infatigable artisan d'un nouveau régime de connaissance sur le droit, le présent ouvrage s'adresse à toutes celles et à tous ceux, enseignants, chercheurs, étudiants ou simples citoyens, pou r qui l'étude du droit permet de mieux comprendre ce que sont et ce que sont susceptibles de devenir nos sociétés. André Tosel, décédé en mars 2017, était un philosophe engagé, attaché tout au long de son existence à faire vivre un marxisme critique puisant notamment dans le meilleur de la tradition italienne de ce courant de pensée ; il fut l'un des rares français à introduire et discuter les oeuvres majeures d'A. Labriola et surtout d'A. Gramsci, ainsi par ailleurs que celles de Vico dont il fut un fin connaisseur. Il consacra sa thèse de doctorat d'état aux rapports entre (...) religion, politique et philosophie chez Spinoza et contribua de façon décisive à de nouvelles lectures du philosophe en le mettant en miroir de Marx. Professeur de philosophie des universités de Besançon, Franche Comté, de Paris 1 Panthéon-Sorbonne et de Nice Sophia-Antipolis, dans lesquelles il occupa de nombreuses fonctions de directions administratives et scientifiques, il était un homme de collectif attaché à faire vivre le savoir, s'engageant dans la vie universitaire et politique, contribuant également de manière décisive au lancement et à l'animation de la revue Actuel Marx. Passionné par l'évolution des pensées contemporaines, il intervenait régulièrement dans des débats d'actualité, sous la forme de contributions dans L'Humanité ou dans des ouvrages destinés à un public large, tout particulièrement dans la dernière période sur les questions de sécularisation, de laïcité et de religion. Cet ouvrage entend lui rendre hommage en abordant les différentes facettes de son oeuvre, traversant un demi-siècle de vie intellectuelle. (shrink)

This article is part of the period of methodological expansion, proposed by the philosopher Arturo Roig (1922-2012), in the 70's and 80's. Although the analysis of categories is rooted in the philosophical field, this expansion is made in the direction of social categories. More specifically to the categories of “civilization” and “barbarism”, both in the field of the history of ideas and in the philosophical history of Latin American liberation. First, we give different definitions and their multiple uses of category (...) in philosophy. Subsequently, we analyze the category of “human dignity”, one of the arms of the very broad anthropological a priori category, systematized by the thinker from Mendoza. Then we disaggregate the proposal of a categorical rearmament, which has among its multiple functions: the rescue, criticism, replacement, reworking and integration of categories that have been forgotten, distorted, dehistoricized and decontextualized. The categories of “civilization” and “barbarism” have generated a semantic ordering of the discursive universe in Latin America. We review different theses proposed by Roig, in the historicization of the assessment -both negative and positive- of the category “barbarism” that different thinkers in Latin America have expressed. Among them: Juan Montalvo, Domingo Faustino Sarmiento, José Hernández, Juan Bautista Alberdi, Ezequiel Martínez Estrada, among the main ones. (shrink)

This volume gathers contributions at the intersection of history and politics. The essays, covering such topics as diverse as Italian identity in the Tientsin concession, international refugee policies in the interwar period and after, and the myths and realities of the Ukranian-Russian encounter in independent Ukraine, show that history provides better grounding as well as a more suitable paradigm for the study of politics than economics or other hard sciences. All of the contributors have a common link - doctoral work (...) supervised and shaped by Professor Andre Liebich - but have since expanded widely in the world. ABSTRACT: In this essay I characterize arguments by analogy, which have an impor- tant role both in philosophical and everyday reasoning. Arguments by analogy are dif- ferent from ordinary inductive or deductive arguments and have their own distinct features. I try to characterize the structure and function of these arguments. It is further discussed that some arguments, which are not explicit arguments by analogy, nevertheless should be interpreted as such and not as inductive or deductive arguments. Wellman identified three types of conductive arguments, the third of which contains both pro and counter-considerations in the same piece of reasoning. This paper provides a pragma-dialectical analysis of this type of argumentation, with special focus on argumentation reconstruction. It argues that the account of pro/con argumentation in the framework of argument-as-product has problems solvable by a pragma-dialectical approach. The paper asserts that pro/con argumentation should be analyzed as a dialectical strategy of a protagonist, where acknowledgement of counter-considerations shows that (...) the antagonist’s reasons have been taken into consideration, although the pro-considerations override them. Thus, the pro-considerations of pro/con argumentation should be interpreted as the protagonist’s overriding defeaters of the antagonist’s counter-arguments, the protagonist incorporating the latter as counter-considerations. The paper further argues that the pragma-dialectical framework needs an additional conceptual tool to properly reconstruct complex forms of pro/con argumentation. Finally, the pragma-dialectical approach to reconstruct pro/con argumentation has several advantages, especially to a more logical-structural approach to complex pro/con argumentation. (shrink)

In this article, we first review the development of clinical ethics in pediatrics in the United States. We report that, over the last 40 years, most children’s hospitals have ethics committees but that those committees are rarely consulted. We speculate that the reasons for the paucity of ethics consults might be because ethical dilemmas are aired in other venues. The role of the ethics consultant, then, might be to shape the institutional climate and create safe spaces for the discussion of (...) difficult and sometimes contentious issues. Finally, we report how pediatric clinical ethics has evolved differently in a number of other countries around the world. (shrink)

Cet article tente de dégager la signification de la circoncision comme signe de l’alliance avec Dieu, telle qu’elle émerge des précisions données dans les discours divins de Gn 17. Dans sa dimension individuelle, le rite demande, en vue de l’alliance, de consentir à une perte de complétude, qui fait entrer dans le manque: il permet ainsi un ajustement de la relation d’Abraham vis-à-vis de Sarah, ce qui l’ouvre à la fécondité. Dans sa dimension collective, il établit Abraham et son clan (...) dans une différence par rapport aux autres nations, consacrant l’élection en vue de la bénédiction de tous à travers des relations où sont respectées les singularités propres. Consentir à la circoncision, c’est dès lors aussi ouvrir une place, entre homme et femme et entre groupes, au Dieu qui sépare et rend fécond, précisément dans l’ajustement mutuel que rend possible la séparation. On a constaté que les hindous, en s’appliquant à réfléchir aux conditions d’une action juste et féconde, ont été amenés peu à peu à faire de la sagesse une science des moyens. This paper critically examines the forays into metaphysics of The Dual Nature of Technical Artifacts Program (henceforth, DNP). I argue that the work of DNP is a valuable contribution to the epistemology of certain aspects of artifact design and use, but that it fails to advance a persuasive metaphysic. A central problem is that DNP approaches ontology from within a functionalist framework that is mainly concerned with ascriptions and justified beliefs. Thus, the materiality of artifacts emerges only as the external (...) conditions of realizability of function ascription. The work of DNP has a strong programmatic aspect and much of its foray into metaphysics is tentative, so the intent of my argument is partly synthetic: to sum up these issues as they are presented in the literature and highlight some recognized problems. But I also go beyond that, suggesting that these problems are foundational, arising from the very way in which DNP poses the question of artifact metaphysics. Although it sets out to incorporate objective aspects of technology, DNP places a strong focus on the intentional side of the purported matter-mind duality, bracketing off materiality in an irretrievable manner. Thus, some of the advantages of dualism are lost. I claim that DNP is dualistic, not merely based on “duality”, but that its version of dualism does not appropriately account for the material “nature” of artifacts. The paper ends by suggesting some correctives and alternatives to Dual Nature theory. (shrink)

This paper addresses several issues in argumentation theory. The over-arching goal is to discuss how a theory of analogical argument schemes fits the pragma-dialectical theory of argument schemes and argument structures, and how one should properly reconstruct both single and complex argumentation by analogy. I also propose a unified model that explains how formal valid deductive argumentation relates to argument schemes in general and to analogical argument schemes in particular. The model suggests “scheme-specific-validity” i.e. that there are contrasting species of (...) validity for each type of argument scheme that derive from one generic conception of validity. (shrink)

Colexification refers to the phenomenon of multiple meanings sharing one word in a language. Cross‐linguistic lexification patterns have been shown to be largely predictable, as similar concepts are often colexified. We test a recent claim that, beyond this general tendency, communicative needs play an important role in shaping colexification patterns. We approach this question by means of a series of human experiments, using an artificial language communication game paradigm. Our results across four experiments match the previous cross‐linguistic findings: all other (...) things being equal, speakers do prefer to colexify similar concepts. However, we also find evidence supporting the communicative need hypothesis: when faced with a frequent need to distinguish similar pairs of meanings, speakadjust their colexification preferences to maintain communicative efficiency and avoid colexifying those similar meanings which need to be distinguished in communication. This research provides further evidence to support the argument that languages are shaped by the needs and preferences of their speakers. (shrink)

Entre os temas kantianos discutidos por Nietzsche, o tradicional problema do estatuto da coisa em si é particularmente relevante para a formulação de sua própria filosofia. Por esse motivo, a compreensão de Nietzsche desse problema também se tornou um dos assuntos mais debatidos e controversos entre seus intérpretes. De forma geral, tende-se a identificar na filosofia de Nietzsche uma trajetória que o levaria da admissão de um conceito de coisa em si em sua juventude até uma negação, em sua filosofia (...) madura, da coisa em si, considerada como uma concepção contraditória. A discordância entre os comentadores surge quando se pergunta se o conceito de coisa em si que Nietzsche nega é exatamente aquilo que Kant entendia por coisa em si. Nosso trabalho pretende discutir essa questão a partir do estudo de três objeções de Nietzsche ao conceito de coisa em si, levando em consideração os aspectos históricos do problema e as soluções oferecidas pela literatura secundária. Among the Kantian issues discussed by Nietzsche, the traditional problem of the status of the thing-in-itself is particularly relevant to the formulation of his own philosophy. For this reason, Nietzsche's comprehension of this problem has also become one of the most debated and controversial subjects among his interpreters. There is a general trend among them to identify in Nietzsche's philosophy a path that would lead him from the assumption of a concept of thing-in-itself in his youth to a denial of the thing-in-itself, in his late philosophy, what is regarded as a contradictory conception. The disagreement among them takes place when it is called into question if the concept of thing-in-itself that Nietzsche denies is exactly what Kant meant by thing-in-itself. My purpose is to discuss this issue by means of a study of three objections made by Nietzsche to the concept of thing-in-itself, taking the historical aspects of the problem, as well as the solutions offered by the secondary literature, into consideration. Frühgeborene im Grenzbereich der Lebensfähigkeit befinden sich in einer prognostischen Grauzone. Das bedeutet, dass deren Prognose zwar schlecht, aber nicht hoffnungslos ist, woraus folgt, dass nach Geburt lebenserhaltende Behandlungen nicht obligatorisch sind. Die Entscheidung für oder gegen lebenserhaltende Maßnahmen ist wertbeladen und für alle Beteiligten enorm herausfordernd. Sie sollte eine zwischen Eltern und Ärzt*innen geteilte Entscheidung sein, wobei sie unbedingt mit den Präferenzen der Eltern abgestimmt sein sollte. Bei der pränatalen Beratung der Eltern legen die behandelnden Ärzt*innen üblicherweise numerische Schätzungen (...) der Prognose vor und nehmen in der Regel an, dass die Eltern ihre Behandlungspräferenzen davon ableiten. Inwieweit probabilistische Daten die Entscheidungen der Eltern in prognostischen Grauzonen tatsächlich beeinflussen, ist noch unzureichend untersucht. In der hier vorliegenden Arbeit wird eine Studie reflektiert, in welcher die Hypothese geprüft wurde, dass numerisch bessere oder schlechtere kindliche Prognosen die Präferenzen werdender Mütter für lebenserhaltende Maßnahmen nicht beeinflussen. In dieser Studie zeigte sich, dass die elterlichen Behandlungspräferenzen eher von individuellen Einstellungen und Werten als von Überlegungen zu numerischen Ergebnisschätzungen herzurühren scheinen. Unser Verständnis, welche Informationen werdende Eltern, die mit einer extremen Frühgeburt konfrontiert sind, wünschen und brauchen, ist noch immer unvollständig. Bedeutende medizinische Entscheidungen werden keineswegs nur rational und prognoseorientiert gefällt. In der vorliegenden Arbeit wird diskutiert, welchen Einfluss der Prozess der Entscheidungsfindung auf das Beratungsergebnis haben kann und welche Implikationen sich aus den bisher vorliegenden Studienergebnissen ergeben – klinisch-praktisch, ethisch und wissenschaftlich. Johnson -Laird has argued that spatial reasoning is based on the construction and manipulation of mental models in memory. The present article addresses the question of whether reasoning about time relations is constrained by the same factors as reasoning about spatial relations. An experiment is reported that explored the similarities and the differences in the performance of subjects in comparable spatial and temporal reasoning tasks. The results indicated that, in both the temporal and the spatial content domains, the data were (...) in agreement with the view that subjects solved problems by constructing models in memory rather than with a logical rule conceptualisation of reasoning. An analysis of the premise-reading times on the basis of premise-linking order provided support for an on-line process of mental models construction, and offered an explanation for the finding that spatial problems that did require an inference of transitivity were easier than problems that did not. No essential differences in processing and performance were observed across the two content domains, although in the time domain the correctness data were in agreement with both the mental models theory and the logical rules view. The results are discussed with respect to the mental models theory and the structural characteristics of the problems. (shrink)

Nottelman (2016) and Peels (2023) identify several categories of ignorance: factive, objectual, and practical, with erotetic ignorance —understood as the lack of knowledge of answers to questions—viewed as reducible to factive ignorance. This paper argues that erotetic ignorance is not in fact reducible to factive ignorance. More precisely, erotetic knowledge does not solely involve a relationship between a subject and a true proposition or set of propositions; instead, it involves a relationship between a subject, a true proposition or set of (...) propositions and epistemic goals of inquiry. Today, the linguistic approach offers us an irreplaceable method for the direct study of the constitutive processes of social phenomena (A. Delobelle, 1981). In fact, each social phenomenon is basically inhabited or interpreted by language. It is language processes that give its ramifications to the social and form disstinct sub-groups in it. This is why, when these processes are observed in their formal dynamics, outside their vehiculated “contents,” it is as though we find ourselves faced with the very functioning of (...) the social: as though we have in it a typically experimental terrain for the direct study of social phenomena. We argue that the pivotal role assigned by Northoff to the principle of top-down modulation in catatonia might successfully be applied to other symptoms of schizophrenia, for example, hallucinations. Second, we propose that Northoff's account would benefit from a more comprehensive analysis of the cognitive level of explanation. Finally, contrary to Northoff, we hypothesize that “top-down modulation” might play as important a role as “horizontal modulation” in affective-behavioral alterations.

This article considers the origins of alphabetic writing, tracing its probable source to ancient Egypt, southern Levant or the Sinai during the Egyptian Middle Kingdom (17th century BCE). It supports the view that the earliest scripts were acrophonic representations of a West-Semitic language, whose use developed under the rule of the Hyksos in Egypt but was arrested there with the expulsion of this foreign dynasty at the end of the 16th century BCE. The development is then traced through the Levant, (...) with particular attention given to the emergence of cuneiform alphabetic scripts in Ugarit (c. 1300 BCE). This form of writing disappeared with the fall of Ugarit, but linear alphabetic scripts were preserved in a variety of Near-Eastern languages, notably Aramaic and Phoenician. These two languages, by becoming linguae francae respectively of the Syria-northern Mesopotamia and the Anatolia-Eastern Mediterranean regions, brought about the spread of alphabetic writing up until the 8th century BCE. The article concludes by examining the influence of the Phoenician script on Greek, Etruscan and ultimately Latin forms of writing. (shrink)

Although the evidence remains tentative at best, the conception of hallucinations in schizophrenia as being underconstrained perception resulting from intrinsic thalamocortical resonance in sensory areas might complement current models of hallucination. However, in itself, the approach falls short of comprehensively explaining the neurogenesis of hallucinations in schizophrenia, as it neglects the role of external attributional biases, mental imagery, and a disconnection between frontal and temporal areas.

Legal positivism understands natural law as performing classifying connections between morality and law as tests of legal validity: if a norm with some pretence to legality contradicts a moral good, it cannot be called a legal norm. The new natural law school, however, claims that natural law develops qualifying connections between morality and law: tests of legal validity are performed by non-moral criteria such as due enactment or efficacy, and morality determines not what the law is, but rather which law (...) is legally binding and which is legally defective. This article will demonstrate that Aquinas's endorsement of the lexeme lex iniusta non est lex cannot be interpreted in any of these senses. Rather, Aquinas's strong version of natural law indicates clearly that it can indeed be a classifying criterion of positive law, and that it cannot be the only and exclusive criterion of legal validity. This paper presents a method to compute a posteriori probability intervals when the initial conditional information is also given with probability intervals. The right way to make an exact computation is with the associated convex set of probabilities. Probability trees are used to represent these initial conditional convex sets because they greatly save the space required. This paper proposes a simulated annealing algorithm, which uses probability trees to represent the convex sets in order to compute the a posteriori intervals.
