This paper compares tracking and phenomenal intentionality theories of intentionality with respect to the issue of naturalism. Tracking theories explicitly aim to naturalize intentionality, while phenomenal intentionality theories generally do not. It might seem that considerations of naturalism count in favor of tracking theories. We survey key considerations relevant to this claim, including some motivations for and objections to the two kinds of theories. We conclude by suggesting that naturalistic considerations may in fact support phenomenal intentionality theories over tracking theories.

Causal accounts of scientific explanation are currently broadly accepted (though not universally so). My first task in this paper is to show that, even for a causal approach to explanation, significant features of explanatory practice are not determined by settling how causal facts bear on the phenomenon to be explained. I then develop a broadly causal approach to explanation that accounts for the additional features that I argue an explanation should have. This approach to explanation makes sense of several aspects (...) of actual explanatory practice, including the widespread use of equilibrium explanations, the formulation of distinct explanations for a single event, and the tight relationship between explanations of events and explanations of causal regularities. According to intentionalism, phenomenal properties are identical to, supervenient on, or determined by representational properties. Intentionalism faces a special challenge when it comes to accounting for the phenomenal character of moods. First, it seems that no intentionalist treatment of moods can capture their apparently undirected phenomenology. Second, it seems that even if we can come up with a viable intentionalist account of moods, we would not be able to motivate it in some of the same kinds of ways that intentionalism (...) about other kinds of states can be motivated. In this article, I respond to both challenges: First, I propose a novel intentionalist treatment of moods on which they represent unbound affective properties. Then, I argue that this view is indirectly supported by the same kinds of considerations that directly support intentionalism about other mental states. (shrink)

This paper contends that a research ethics approach to the regulation of health data research is unhelpful in the era of population‐level research and big data because it results in a primary focus on consent (meta‐, broad, dynamic and/or specific consent). Two recent guidelines – the 2016 WMA Declaration of Taipei on ethical considerations regarding health databases and biobanks and the revised CIOMS International ethical guidelines for health‐related research involving humans – both focus on the growing reliance on health data (...) for research. But as research ethics documents, they remain (to varying degrees) focused on consent and individual control of data use. Many current and future uses of health data make individual consent impractical, if not impossible. Many of the risks of secondary data use apply to communities and stakeholders rather than individual data subjects. Shifting from a research ethics perspective to a public health lens brings a different set of issues into view: how are the benefits and burdens of data use distributed, how can data research empower communities, who has legitimate decision‐making capacity? I propose that a public health ethics framework – based on public benefit, proportionality, equity, trust and accountability – provides more appropriate tools for assessing the ethical uses of health data. The main advantage of a public health approach for data research is that it is more likely to foster debate about power, justice and equity and to highlight the complexity of deciding when data use is in the public interest. A decade of advocacy for the inclusion of pregnant women in the clinical research agenda is starting to pay off. In September, the United States Task Force on Research Specific to Pregnant Women and Lactating Women issued its advice to the secretary of Health and Human Services on addressing gaps in knowledge and research on safe and effective therapies for pregnant women and lactating women. The task force is pushing for major reforms. If its recommendations are taken up, we can (...) anticipate a significant shift in pregnancy research in the United States. This will affect pregnant women, clinicians caring for them, researchers, and institutional review boards. (shrink)

In 2004 Emanuel et al. published an influential account of exploitation in international research, which has become known as the 'fair benefits account'. In this paper I argue that the thin definition of fairness presented by Emanuel et al, and subsequently endorsed by Gbadegesin and Wendler, does not provide a notion of fairness that is adequately robust to support a fair benefits account of exploitation. The authors present a procedural notion of fairness – the fair distribution of the benefits of (...) research is to be determined on a case-by-case basis by the parties involved in each study. The fairness of the distribution of benefits is not assessed against an independent normative standard. Emanuel et al.'s account of fairness provides a framework for objecting only to transactions that occur without the fully informed consent of the weaker party. As a result, a debate about exploitation collapses into a debate about consent. This is problematic because, as the proponents of the fair benefits framework acknowledge, neither the trial participants' consent nor the host community's consent preclude exploitation. Attempts to stipulate normative standards of fairness to protect research subjects in developing countries have been controversial and divisive, and it is therefore understandable that bioethicists would be tempted to develop accounts of exploitation that are independent of such prescriptive principles. I conclude, however, that the utility of the fair benefits model of exploitation as a policy tool will ultimately depend on whether a substantive principle of fairness can be developed to underpin it. Making data broadly accessible is essential to creating a medical information commons. Transparency about data-sharing practices can cultivate trust among prospective and existing MIC participants. We present an analysis of 34 initiatives sharing DNA-derived data based on public information. We describe data-sharing practices captured, including practices related to consent, privacy and security, data access, oversight, and participant engagement. Our results reveal that data-sharing initiatives have some distance to go in achieving transparency.

Doch wahrend die deutschsprachige Literatur zum Staatsdenken im europaisch-nordamerikanischen Raum kaum noch uberblickt werden kann, ist die Zahl der politikwissenschaftlichen Veroffentlichungen zum Staatsdenken muslimischer Intellektueller bisher sehr uberschaubar. Diese Lucke soll der vorliegende Band schlieaen, der sich an Regional- und Sozialwissenschaftler ebenso wie an interessierte Laien wendet. Der Begriff des Staatsdenkens ist dabei bewusst weit gefasst, um auch die politische Ideengeschichte des Mittelalters und auch (...) die modernen politischen Theorien berucksichtigen zu konnen, bei denen der Staatsbegriff im engen Sinne zwar keine zentrale Rolle spielt, zugleich aber doch standig als Bezugsrahmen prasent ist. This target article considers the ethical implications of providing prenatal diagnosis (PND) and antenatal screening services to detect fetal abnormalities in jurisdictions that prohibit abortion for these conditions. This unusual health policy context is common in the Latin American region. Congenital conditions are often untreated or under-treated in developing countries due to limited health resources, leading many women/couples to prefer termination of affected pregnancies. Three potential harms derive from the provision of PND in the absence of legal and safe abortion (...) for these conditions: psychological distress, unjust distribution of burdens between socio-economic classes, and financial burdens for families and society. We present Iran as a comparative case study where recognition of these ethical issues has led to the liberalization of abortion laws for fetuses with thalassemia. We argue that physicians, geneticists and policymakers have an ethical and professional duty of care to advocate for change in order to ameliorate these harms. (shrink)

In their response to ‘Public interest in health data research: laying out the conceptual groundwork’, Grewal and Newson critique us for inattention to the law and putting forward an impracticably broad conceptual understanding of public interest. While we agree more work is needed to generate a workable framework for Institutional Review Boards/Research Ethics Committees, we would contend that this should be grounded on a broad conception of public interest. This broadness facilitates regulatory agility, and is already reflected by some current (...) frameworks such as that found in the guidelines approved under Australia’s Privacy Act. It remains unclear which elements of our broad account Grewal and Newson would reject, or indeed where the substantive disagreement with our position lies. (shrink)

Local food systems seem virtuous in the larger context of the neoliberalization of global food systems and increasing food insecurity. However, local food systems are critiqued for reproducing neoliberalism when they prioritize niche-market consumerism over enhancing access for poor people. Advocates, in contrast, insist local food systems contribute to an equitable political economy of food if they are place-based and inclusive. Local food systems must not, according to them, be condemned monolithically in light of their neoliberal tendencies, but evaluated instead (...) on a case-by-case basis regarding their potentially innovative solutions to food insecurity. We heed this call by investigating how a regionally-renowned local food system addresses food insecurity in an impoverished corner of rural Appalachia. Specifically, we use qualitative methods, including semi-structured interviews, participant observation, and document analysis, to evaluate the local food system in Athens County, Ohio. Our findings indicate that extra-local processes under neoliberalism, including austerity and economic marginalization, create a large-scale context of malign neglect in which local food security initiatives operate. Place-based strategies for food security, in response, emphasize producer profitability and consumer responsibility as solutions to extra-local constraints. These localized processes of benign neglect, however, reproduce stifling neoliberalisms within the Athens local food system, giving it a defensive stance that fails to promote innovative modes of inclusion despite its sustainable reputation. Malign and benign forms of neglect, working in creative tension, perpetuate a problematic paradox of food insecurity amidst a seemingly robust local food system as neoliberalization operating at a variety of scales remains unchallenged. Many clinical ethics support services do not involve patients. This is surprising because of the broad commitment to provide patient-centered healthcare. Clinical ethics support services are a component of the healthcare system and have an influence on patient care, and should therefore align with the regulatory and ethical requirements of patient-centered care, just process and cultural competence. First, in order to achieve good patient care, it is essential to involve patients in making their own healthcare decisions. Second, just ethical deliberation (...) requires that the deliberating parties have access to complete, accurate and unbiased information – this is best achieved through direct patient input. These arguments are especially compelling in the case of non-dominant cultural and ethnic groups. Here, we argue that when a clinician refers a case to a clinical ethics support services for consideration, and that case involves a conflict between the views or values of the clinician and the patient, the patient is entitled to, at a minimum: (a) be informed of the referral; (b) have the opportunity to speak directly to the clinical ethics support services prior to deliberation; (c) be provided with any opinion directly from the clinical ethics support services; and (d) have the opportunity to speak to a clinical ethics support services member after the deliberation. We use New Zealand as a case study to support and extrapolate the ethical principles and the minimum patient involvement requirements. We draw on our empirical research with senior doctors at a tertiary New Zealand hospital. Clinicians in our study indicated that they would feel bound by clinical ethics support service advice and that the clinical ethics support service has a significant impact on patient care in the case it reviews. En las actividades ordinarias de nuestra vida cotidiana encontramos nuestros actos de percepción confrontados por las cosas materiales. A ellos ─actos de percepción─ les atribuimos una existencia "real" asumiéndolos de tal manera que los sumergimos y transfundimos, de forma múltiple e indefinida, dentro del entorno de realidades análogas que se unen para formar un único mundo al que yo, con mi propio cuerpo, pertenezco. Ahora bien sí frente a la cotidianidad descrita anteriormente asumimos una actitud escéptica acerca de lo que (...) es “real” en el mundo,nos descubriremos haciendo una reflexión filosófica. Bajo esta deliberación encontramos que, por ejemplo, la cualidad "verde", tiene existencia por medio de la sensación "verde"asociada a un objeto dado por la percepción, lo que nos lleva a pensar que no tiene sentido vincularla sensación como cosa en sí misma a cosas materiales existentes en sí mismos , esto nos lleva a pensar que las cualidades de los sentidostienen carácter subjetivo.A pesar de esta reflexión es conveniente acotar que esta subjetividad no interesaa las ciencias exactas ya que éstas procuran lo objetivo. -/- Desde este punto de vista,encontramos dentro de los estudios de Galileo Galilei el principio que subyace al método matemáticoconstructivo de nuestra física moderna ; de esta manera, y bajo este principio,los colores ─ por ejemplo “verde”─ son solo vibraciones en un medio repudiando de esta forma el carácter subjetivo a la vez que se mantiene la objetividad. Sin embargo, dentro del campo de la filosofía el idealismo transcendental de Kant marca un cambio de paradigma en relación a lo anterior. Kant sostiene que no solamente las cualidades de los sentidos tienen carácter subjetivo, sino que espacio y tiempo, conceptos fundacionales dentro de la física, no tienen significación absoluta; en otras palabras, espacio y tiempo son formas de nuestra percepción . Para Kant aquello que sustenta nuestra percepción y aquello que sustenta el conocimiento matemático aplicado a la experiencia son lo mismo: intuiciones puras a priori del espacio y el tiempo. De esta manera, y bajo esta perspectiva, sólo la teoría de la relatividad deja muyen claro que las dos esencias: espacio y tiempo, como formas de la intuición en términos kantianos, no tienen lugar en el mundo construido por la física matemática concebida por Galileo . -/- Según esto, los colores no son siquiera vibraciones en un medio sino simplemente una serie de valores de funciones matemáticas en las que se producen cuatro parámetros independientes que corresponden a las tres dimensiones del espacio y la del tiempo, expresado como principio general esto significa que el mundo real y cada uno de sus constituyentes con sus características sólo pueden ser, en términos husserlianos, objetos intencionales de actos de conciencia . En otras palabras: los datos inmediatos que recibo son las experiencias de la conciencia. Esto nos permite afirmar que la sensación de un objeto está presente de una forma físicamente real para mí con quien esa sensación se relaciona. Esto es lo que Brentano llama objeto intencional ;es así como al percibir un objeto, por ejemplo: veo este “libro” mi atención está totalmente dirigida hacia él. Yo "tengo" la percepción, pero sólo cuando hago de esta percepción ─ acto libre de reflexión ─algo que "conozco" con respecto a ella ─y no sólo el “libro”─ llego precisamente a un segundo acto: objetos intencionales de actos de conciencia, que son a los que referíamos antes . -/- El objeto intencional es inmanente y lo que es inmanente es absoluto ; es exactamente lo que es en la forma en que lo tengo, y puedo reducir esto, su esencia, por los actos de reflexión . En otras palabras, es un componente real de mis experiencias; contrario a lo que sucede con el acto primario de percepción, donde el objeto es trascendental , esto es, se da en una experiencia de conciencia pero no es un componente real de la misma. Por otra parte, los objetos trascendentales tienen sólo una existencia fenoménica; son apariencias que se presentan de múltiples maneras. Ninguno de estos modos de aparición puede pretender presentar aquello que percibimos – por ejemplo el libro- tal como es en sí, además en toda percepción está involucrada la tesis de la realidad del objeto que aparece en ella; este último es, de hecho, un elemento fijo y duradero de la tesis general de la realidad del mundo . En resumen, lo que interesa ver claramente es la importancia enel dato de la conciencia como punto de partida en el que debemos situarnos si queremos comprender el significado absoluto . (shrink)

En los últimos años, Europa asiste a un desconcertante fenómeno: la consolidación y crecimiento de una pluralidad de partidos populistas de derecha radical que luchan por hacerse con un espacio en el escenario político. En este artículo sugiero que existe una relación particularmente compleja entre el liberalismo y este tipo de movimientos, por la cual los populistas de derecha son capaces de detectar y explotar algunas de las debilidades y contradicciones del discurso y la práctica liberales. Mediante la utilización de (...) las herramientas conceptuales proporcionadas por la teoría política y jurídica, propongo tratar de desentrañar con cierto nivel de detalle en qué consiste esta paradójica relación y reflexionar sobre los que considero que pueden ser sus aspectos más relevantes. This article is about David Hume's account of mixed emotions. Hume on mixed emotions is connected with Sir Isaac Newton's optical experiments and subsequent invention of the colour wheel, as well as more recently to Robert Plutchik's colour wheel of emotions.

The assumption that commonsense psychological explanations of behavior are causal underlies current debate between simulation theory and theory theory regarding the nature of cognitive mechanism responsible for our folk psychological practices. Theory theorists claim that these explanations are subsumed by the covering law model of causal explanation. Simulationists are not explicit about the nature of the explanations produced by simulation. In what follows, I propose a set of plausible conditions that a correct causal simulation-produced folk psychological explanation will satisfy and (...) point out two prima facie problems. In discussing a possible solution, I discover that the latter incurs the need for some sort of causal law. An examination of two likely candidates for these laws reveals that neither is capable of playing the role required. I then suggest alternative routes that simulationists might explore in order to provide simulation theory with a sorely-needed account of the nature of the explanations produced by simulation. Underlying the current debate between simulation theory and theory theory is the assumption that folk psychological explanations of behavior are causal. Simulationists Martin Davies, Tony Stone, and Jane Heal claim that folk psychological explanations are explanations that make sense of another person by citing the thoughts important to the determination of his behavior on a given occasion. I argue that it is unlikely these explanations will be causal. Davis et al. base their claim on the assumption that a certain isomorphism (...) obtains between the cognitive mechanisms of human beings. Investigation into the nature of the isomorphism required reveals that it is of a sort that is unlikely to obtain. I suggest that in order to maintain their challenge to theory theory, simulationists must either motivate and describe a non-causal simulation-based account of folk psychological explanation or else delineate a causal account that attributes a nonessential, heuristic role to simulation. This paper deals with one of Plutarch’s favourite subjects - the relation between human beings and animals. In order to gain new insight into this topic, a three-step approach is chosen: First, the paper investigates some of the essential ideas concerning animals (their soul, their emotions and intellectual capacities) to be found in Plutarch’s work and the vocabulary he employs. Secondly, the paper focuses on Plutarch’s unique style of writing and his skillful use of the Socratic method to guide his (...) audience. Thirdly, Plutarch’s personal opinion will be analyzed. In the first part of this paper, Plutarch’s work serves as a lens to unfold the nature of contemporary discourses on the relation between man and animal (with broad agreement on some points and controversies about others) as well as the different notions associated with the terms theria and zoa. A special focus is placed on the ‘Gryllos’ (mor. 985 d-992 e). Plutarch’s treatise ‘Whether the creatures of the land or the creatures of the sea have more phronesis’ (mor. 959 b-985 c) is an important contribution to the field of animal ethics and the subject of the second part of this paper. The ingenious structure of said text illustrates Plutarch’s qualities as a writer and how carefully he employs maieutic methods to support his readers in developing their own point of view. The third part of this paper is devoted to passages from Plutarch’s oeuvre which illustrate his personal position in the debate on the relation between human beings and animals. He is clearly aware that life on earth is inextricably interwoven with acts of killing and destruction, yet he also believes that observing animals has some lessons to offer to mystery religions. Plutarch describes animals as ‘clearer mirrors to the divine’, thereby illustrating that he perceives creatures - whether tiny or large - as a unique chance to gain a better understanding of the miracle of life. In this capacity animals provide a way for human beings to improve their insight into the nature of the divine. (shrink)

This chapter outlines different ethical approaches of relevance for a normative assessment of nano-release. We elaborate on traditional risk assessment and the well-known notion of a Precautionary Principle in order to demonstrate that these accounts need to be complemented to provide ethical guidance with regard to environmental influence of emerging technologies. We conclude that it is obligatory to engage in what they call an “eco-centric evaluation” of nano-release.

One of the central aims of science is explanation: scientists seek to uncover why things happen the way they do. This chapter addresses what kinds of explanations are formulated in biology, how explanatory aims influence other features of the field of biology, and the implications of all of this for biology education. Philosophical treatments of scientific explanation have been both complicated and enriched by attention to explanatory strategies in biology. Most basically, whereas traditional philosophy of science based explanation on derivation (...) from scientific laws, there are many biological explanations in which laws play little or no role. Instead, the field of biology is a natural place to turn for support for the idea that causal information is explanatory. Biology has also been used to motivate mechanistic accounts of explanation, as well as criticisms of that approach. Ultimately, the most pressing issue about explanation in biology may be how to account for the wide range of explanatory styles encountered in the field. This issue is crucial, for the aims of biological explanation influence a variety of other features of the field of biology. Explanatory aims account for the continued neglect of some central causal factors, a neglect that would otherwise be mysterious. This is linked to the persistent use of models like evolutionary game theory and population genetic models, models that are simplified to the point of unreality. These explanatory aims also offer a way to interpret many biologists’ total commitment to one or another methodological approach, and the intense disagreements that result. In my view, such debates are better understood as arising not from different theoretical commitments, but commitments to different explanatory projects. Biology education would thus be enriched by attending to approaches to biological explanation, as well as the unexpected ways that these explanatory aims influence other features of biology. I suggest five lessons for teaching about explanation in biology that follow from the considerations of this chapter. (shrink)

Aujourd'hui, le discours relatif à la culture et à l'identité est-il double ou dédoublé ? Certains Moldaves plaident pour leur identité roumaine, d'autres pour leur identité moldave et ceci sur un fond (...) à nombreuses touches multiculturelles. Un représentant du quartier général d'une organisation internationale a demandé à un collaborateur moldave son avis quant à la nationalité qu'il faudrait indiquer sur la liste des employés. Puisqu'au moment où, pour les ressortissants de la République de Moldavie, il a été écrit «moldave», le représentant roumain a objecté que cette nationalité n'existe pas. Si vous étiez le représentant moldave, que répondriez-vous?Before 1812, the current Republic of Moldova, then a territory of the Rumanian region called Moldova, chose France as a cultural model and outlet. After this date, the territory became part of the Russian Empire under the name of Basarabia and thus entered a completely different cultural space at the border of civilizations. Nowadays, is the discourse related to culture and identity doubled or divided? Some Moldavans opt for a Rumanian identity and others a Moldovan one in a context with many multicultural aspects. A representative of the headquarters of an international organization asked a Moldavian colleague under which nationality he should be put down on a list of employees. “Moldavian” was chosen for citizens of the Republique of Moldova only for the Rumanian representative to object that this nationality did not in fact exist. En esta contribución mía en ocasión de los cien años de la adhesión de Edith Stein a la Iglesia católica, deseo volver a proponer extractos de mi último libro que le he dedicado a ella: Assonanze e dissonanze. Dal Diario di Edith Stein (Mimesis, Milán, 2021), en el que vuelvo a recorrer toda su existencia humana e intelectual, imaginando haber encontrado un diario suyo, que en realidad he reconstruido partiendo de su historia de una familia judía, su epistolario, en particular (...) el que sostiene con Roman Ingarden y de sus obras. Ya que el libro ha sido escrito durante el periodo de la pandemia en la que en Italia estuvimos obligados a permanecer en casa desde marzo hasta mayo de 2020, entrelacé mi diario de esos largos días con el de Edith Stein. Muestro aquí algunas páginas extraídas del capítulo V dedicado a su conversión y muestro paralelamente su camino espiritual e intelectual: qué sucedía en su alma y cómo eso se reflejaba en sus libros, en particular, el «escrito secreto» sobre la religión, Libertad y gracia, y su Introducción a la filosofía. _Everyday Life and the Sacred_ offers gender sensitive interdisciplinary perspectives from the fields of feminist theology and religious studies on the everyday and the sacred. The volume aims to re-configure the current domain of religion and gender studies.

In this paper, we study the effects of using an algorithm-based risk assessment instrument (RAI) to support the prediction of risk of violent recidivism upon release. The instrument we used is a machine learning version of RiskCanvi used by the Justice Department of Catalonia, Spain. It was hypothesized that people can improve their performance on defining the risk of recidivism when assisted with a RAI. Also, that professionals can perform better than non-experts on the domain. Participants had to predict whether (...) a person who has been released from prison will commit a new crime leading to re-incarceration, within the next two years. This user study is done with (1) general participants from diverse backgrounds recruited through a crowdsourcing platform, (2) targeted participants who are students and practitioners of data science, criminology, or social work and professionals who work with RisCanvi. We also run focus groups with participants of the targeted study, including people who use RisCanvi in a professional capacity, to interpret the quantitative results. Among other findings, we observe that algorithmic support systematically leads to more accurate predictions from all participants, but that statistically significant gains are only seen in the performance of targeted participants with respect to that of crowdsourced participants. Among other comments, professional participants indicate that they would not foresee using a fully-automated system in criminal risk assessment, but do consider it valuable for training, standardization, and to fine-tune or double-check their predictions on particularly difficult cases. We found that the revised prediction by using a RAI increases the performance of all groups, while professionals show a better performance in general. And, a RAI can be considered for extending professional capacities and skills along their careers. (shrink)
