In this paper we argue for a naturalistic solution to some of the methodological controversies in regulatory science, on the basis of two case studies: toxicology and health claim regulation. We analyze the debates related to the scientific evidence that is considered necessary for regulatory decision making in each of those two fields, with a particular attention to the interactions between scientific and regulatory aspects. This analysis allows us to identify two general stances in the debate: a) one that argues (...) for more permissive standards of evidence and for methodological pluralism, and b) an opposing one that not only defends strict evidence requirements but also stipulates the use of one particular scientific methodologies for data generation. We argue that the real-world outcomes produced by alternative regulatory options are a vital piece of information that allows for the empirical assessment of these two stances. In particular, this information on outcomes makes it possible to analyze which standards of evidence and scientific methods generate the most useful knowledge as input for regulatory decision making. Our conclusion is that instead of an a priori selection of methodologies and standards, such decisions ought to be based on empirical evidence related to real-world outcomes. (shrink)

Brian Garrett has criticized my diagnosis of the paradox of self-consciousness. In reply, I focus on the classification of 'I'-thoughts, and show how the notion of immunity to error through misidentification can be used to characterize 'I'-thoughts, even though an important class of 'I'-thoughts (those whose expression involves what Wittgenstein called the use of 'I' as object) are not themselves immune to error through misidentification. 'I'-thoughts which are susceptible to error through misidentification are dependent upon those which are not. A hemi-implicative lattice is an algebra $(A,\wedge,\vee,\rightarrow,1)$ of type (2, 2, 2, 0) such that $(A,\wedge,\vee,1)$ is a lattice with top and for every $a,b\in A$, $a\rightarrow a = 1$ and $a\wedge (a\rightarrow b) \le b$. A new variety of hemi-implicative lattices, here named sub-Hilbert lattices, containing both the variety generated by the $\{\wedge,\vee,\rightarrow,1\}$ -reducts of subresiduated lattices and that of Hilbert lattices as proper subvarieties is defined. It is shown that any sub-Hilbert lattice is determined (up to isomorphism) by (...) a triple (_L_, _D_, _S_) which satisfies the following conditions: _L_ is a bounded distributive lattice, _D_ is a sublattice of _L_ containing 0, 1 such that for each $a, b \in L$ there is an element $c \in D$ with the property that for all $d \in D$, $a \wedge d \le b$ if and only if $d \le c$ (we write $a \rightarrow _D b$ for the element _c_), and _S_ is a non void subset of _L_ such that _S_ is closed under $\rightarrow _D$ and _S_, with its inherited order, is itself a lattice. The idea that thoughts are structured is essential to Frege's understanding of thoughts. A basic tenet of his thinking was that the structure of a sentence can serve as a model for the structure of a thought. Recent commentators have, however, identified tensions between that principle and certain other doctrines Frege held about thoughts. This paper suggests that the tensions identified by Dummett and Bell are not really tensions at all. In establishing the case against Dummett and Bell the paper (...) argues (a) that Frege was committed, in virtue of his doctrine of decomposition, to the thesis that a single sentence can express a range of thoughts, and (b) that Frege was committed, in virtue of his views about truth, to the thesis that a single thought can be expressed by structurally different sentences. But neither of these theses comes into conflict with the basic principle. (shrink)

La primera etapa de este trabajo, parte de la idea del Canon Occidental de Harold Bloom, pero trasladándola al ámbito de la explicación de la conformación y desarrollo de lo que podríamos denominar el Canon liberal, y sostiene que ese canon se cierra con On Liberty; pero, como un pensamiento canónico constituye siempre una realidad dinámica, compleja y en tensión interna permanente, las lecturas e interpretaciones de On Liberty, sobre todo las realizadas en nuestro país desde coordenadas que interpretan a (...) Mill en un sentido no-liberal, iliberal o anti-liberal (como la reciente de Carlos Rodríguez Braun), en realidad, constituyen ejemplos de una lucha interna dentro de ese canon por “abrirlo” y por superar el enorme influjo (“angustia de las influencias” en la terminología de Bloom) que dicha obra ha tenido en el pensamiento occidental. Un ejemplo de la tensión interna dentro del propio canon liberal entre el utilitarismo (y su defensa del valor del individuo y de su bienestar, que es dinámico y en construcción, como elemento crucial de un estado libre, y justo) y el liberalismo (y su defensa del valor primario de la libertad interpretada esencialmente como no intervención y poder limitado) la encontramos en la discusión llevada a cabo por Mill en el capítulo V de Sobre al Libertad acerca de la educación obligatoria. En la segunda parte de este trabajo se exponen y comentan con una cierta amplitud las tesis de Mill sobre este asunto, debido a su relevancia para la interpretación del sentido estricto del liberalismo de Mill. Creemos que es posible articular ambas tendencias sin obligar a Mill a dejar de ser liberal por el hecho de admitir posibles limitaciones a la libertad en circunstancias específicas. Es así por tanto posible sostener que hay buenas razones liberales de raíz utilitarista para sostener dos tesis distintas: (a) que es necesario garantizar una educación universal y obligatoria hasta un cierto nivel, y (b) que caso de noestar adecuadamente garantizada esta educación universal y obligatoria, es aceptable y estaría justificado que el propio Estado no sólo estimulara dicha educación sino que directamente la proporcionara, llegando al extremo de establecer cuáles son los contenidos de esta educación y asegurar su impartición. Finalmente, en la última parte del trabajo, se defiende que no hay contradicción entre esta defensa de una educación obligatoria y universal asumida por el estado y la paralela crítica de Mill al papel de la asunción permanente por parte del Estado de la tarea de educar a los ciudadanos.Para concluir, se defiende el papel central de Mill y de On Liberty en el canon liberal, que debe ser interpretado en un sentido plural, diverso, dinámico y vivo, no necesariamente encerrado o enclaustrado exclusivamente en la tesis, por otra parte central al liberalismo (pero no única) del poder limitado y del rechazo del intervencionismo. Sólo haciendo del liberalismo algo diverso y plural podrán los actuales liberales superar la influencia de Mill y pensar de un modo post-milliano en sentido genuino. (shrink)

In Thinking about Consciousness David Papineau develops a position that combines the following four theses: A) Phenomenal properties exist. B) Any phenomenal property is identical to some material property. C) Phenomenal concepts refer to material properties that are identical to phenomenal properties. D) Phenomenal concepts are vague. The overall position is intended to do justice to materialism (in virtue of (B) and (C)), while at the same time accommodating the concerns both of those impressed by the Knowledge Argument and related (...) arguments (in virtue of (A)) and of those skeptical about the prospects for a science of consciousness (in virtue of D)). En este escrito se analizan ciertos conceptos del estructuralismo empirista de Bas van Fraassen, en particular, el de representación, para intentar una crítica a su posición con respecto al vínculo entre los modelos de las teorías y, en última instancia, el mundo físico por medio de los modelos de datos, a los cuales van Fraassen les adjudica el papel de representantes de los fenómenos. Bovens (2010) points out that there is a structural analogy between the Judy Benjamin problem (JB) and the Sleeping Beauty problem (SB). On grounds of this structural analogy, he argues that both should receive the same solution, viz. the posterior probability of the eastern region of the matrix in Table 1 should equal 1/3. Hence, P*(Red) = 1/3 in the JB and P*(Heads) = 1/3 in the SB. Bovens’s argument rests on a standard error in implementing Bayesian updating, which is (...) spelled out in Shafer 1985. When we are informed of some proposition, we do not only learn the proposition in question, but also that we have learned the proposition as one of the many propositions that we might have learned. The information is generated by a protocol, which determines the various propositions that we might learn. We should then update not on the proposition in question, but rather on the fact that we learned this proposition as one of the many propositions that we might have learned. A well-known application of this insight is the Monty Hall problem (MH) as Speed (1985: 276) points out in a discussion of Shafer 1985. As an illustration, let us apply Shafer’s insight to the MH. In the MH, the contestant in a game show learns that there is a goat behind two of three doors X, Y and Z and a car behind one door. She is asked to pick one of the three doors. The contestant picks door X. Monty will then open one of the remaining doors, which he knows to have a goat behind it. Suppose Monty opens door Y. The contestant is then asked whether she wants to …. Endowing $$$$ with the binary operation $$\sim$$ ∼ the algebra $$$$ results an l-hemi-implicative semilattice, which also satisfies the identity $$a \sim b = b \sim a$$ a∼b=b∼a. In this article, we characterize the commutative l-hemi-implicative semilattices. We also provide many new examples of l-hemi-implicative semilattice on any semillatice with greatest element. Philosophical accounts of self-deception can be divided into two broad groups – the intentionalist and the anti-intentionalist. On intentionalist models what happens in the central cases of self-deception is parallel to what happens when one person intentionally deceives another, except that deceiver and deceived are the same person. This paper offers a positive argument for intentionalism about self-deception and defends the view against standard objections.

(2) Can we explain how fully fledged self-conscious thought and language can arise in the normal course of human development? Bermú dez argues that a paradox (the paradox of self-consciousness) arises from the apparent strict interdependence between self-conscious thought and linguistic self-reference. The paradox renders circular all theories that define self-consciousness in terms of linguistic mastery of the first-person pronoun. It seems to follow from the paradox of self-consciousness that no such account or explanation can be given. Drawing on recent work in empirical psychology and philosophy, the author argues that any explanation of fully fledged self-consciousness that answers these two questions requires attention to primitive forms of self-consciousness that are prelinguistic and preconceptual. Such primitive forms of self-consciousness are to be found in somatic proprioception, the structure of exteroceptive perception, and prelinguistic forms of social interaction. The author uses these primitive forms of self-consciousness to dissolve the paradox ofself-consciousness and to show how the two questions can be given an affirmative answer. (shrink)

Psychiatric treatment and diagnosis rests upon a richer conception of normativity than, for example, cognitive neuropsychology. This paper explores the role that considerations of rationality can play in defining this richer conception of normativity. It distinguishes two types of rationality and considers how each type can break down in different ways in delusional psychiatric disorders.

Forms of thinking that involve thinking about thought are only available to creatures participating in a public language. Thoughts can only be the objects of further thoughts if they have suitable vehicle and the only suitable vehicle is public language sentences. These language-dependent cognitive abilities range from second-order reflection on one's own beliefs and desires and the capacity to attribute thoughts to others to the ability to entertain tensed thoughts and to deploy logical concepts. Many of these language-dependent cognitive abilities, (...) however, have primitive analogues that do not involve intentional ascent and hence are available at the nonlinguistic level. This chapter considers the practical implications this has for the scope and limits of nonlinguistic thought. The chapter explores the question: what types of thinking are in principle unavailable to nonlinguistic creatures? There are two types of intentional ascent, which might be termed explicit and implicit intentional ascent respectively. (shrink)

[1] Recent philosophy of mind and epistemology has seen an important and influential trend towards accounting for at least some features of experiences in content-involving terms. It is a contested point whether ascribing content to experiences can account for all the intrinsic properties of experiences, but on many theories of experiences there are close links between the ascription of content and the ways in which experiences are ascribed and typed. The issues here have both epistemological and psychological dimensions. On the (...) one hand, a theory of experiential content has a fundamental role in explaining how knowledge of the world can be acquired through experience. On the other hand, there are important psychological questions about the phenomenology of experiences and the conditions under which content ascriptions are made. (shrink)

Philosophers have often argued that ascriptions of content are appropriate only to the personal level states of folk psychology. Against this, this paper defends the view that the familiar propositional attitudes and states defined over them are part of a larger set of cognitive proceses that do not make constitutive reference to concept possession. It does this by showing that states with nonconceptual content exist both in perceptual experience and in subpersonal information-processing systems. What makes these states content-involving is their (...) satisfaction of certain basic conditions deriving from a general account of representation-driven behaviour that is neutral on the question of concept possession. How precisely to understand and evaluate counterfactuals can be an intricate issue. The aim of this article is to examine a new set of difficulties for evaluating counterfactuals that arise in the context of the dynamical spacetimes described by the theory of general relativity (GR). The initial value formulation provides us with a methodology to pin down the specific combination of features of the theory at the origin of the difficulties, namely, non-linearity and certain non-local aspects (typically captured by ellipticity (...) at the analytical level), in particular when combined with the global and/or quasi-local character of physical quantities in GR. Finally, we connect the philosophical question about counterfactuals with concrete applied physical issues in GR about extracting meaningful predictions by constructing appropriate initial data sets, leading us to question the very suitability of the Cauchy approach to fully account for the explanatory power of the theory. The author challenges the view that birth cannot be a morally relevant fact in the process of development from zygote to child. He reviews specific arguments against giving any moral significance to the fact of birth. Drawing on recent work in developmental psychology, he contends that the lives of neonates can have a level of self-consciousness that confers moral significance but can only be possessed after birth. He shows that the position he has argued for provides a framework within which (...) the move from the moral validity of aborting sentient fetuses to the moral validity of infanticide might be resisted. He concludes that arguments suggesting that birth can be morally significant support the view that the acquisition of moral significance is a gradual and multilayered phenomenon. (shrink)

Recent work on Descartes has drastically revised the traditional conception of Descartes as a paradigmatic rationalist and foundationalist. The traditional picture, familar from histories of philosophy and introductory lectures, is of a solitary meditator dedicated to the pursuit of certainty in a unified science via a rigourous process of logical deduction from indubitable first principles. But the Descartes that has emerged from recent studies strikes a more subtle balance between metaphysics, physics, epistemology and the philosophy of science. There is much (...) to be praised in this revaluation, but a dangerous amount of over-compensation has gone on, particularly in the reinterpretation of the role of sceptical doubt in Descartes' thought. This reinterpretion plays down the epistemological reasons for worrying about scepticism, suggesting that Cartesian physics is what ultimately drives the introduction of scepticism in the First Meditation. It is now 25 years since Gareth Evans introduced the distinction between conceptual and nonconceptual content in The Varieties of Reference. This is a fitting time to take stock of what has become a complex and extended debate both within philosophy and at the interface between philosophy and psychology. Unfortunately, the debate has become increasingly murky as it has become increasingly ramified. Much of the contemporary discussion does not do full justice to the powerful theoretical tool originally proposed by Evans (...) and subsequently refined by theorists in the late 1980’s and early 1990’s – most effectively, I think, by Christopher Peacocke (particularly in his 1992). Even worse, significant parts of the discussion are somewhat confused. This paper makes a start on clarifying what I think ought to be the central issues in debates about nonconceptual content. I begin in §1 by pointing out how narrowly focused contemporary discussion is relative to Evans’s original discussion. We are not making as much use as we should of nonconceptual content as a tool for understanding subpersonal information processing and the complexities of its status relative to perception and thought at the personal level. In §2 I turn to what is the central focus of contemporary discussion, namely, the content of perception and identify a “master argument” for nonconceptualism based on the relation between conceptual capacities and capacities for perceptual discrimination. The aim of §3 is to clarify the relation between the claim that perception has nonconceptual content and some superficially similar claims discussed by philosophers of perception. Finally, in §4 I explain why the attention recently focused on what is sometimes called the state version of the nonconceptualist thesis seems to me to be misdirected. (shrink)

ven a cursory look at the extensive literature on mindreading in nonhuman animals reveals considerable variation both in what mindreading abilities are taken to be, and in what is taken as evidence for them. Claims that seem to contradict each other are often not inconsistent with each other when examined more closely. And sometimes theorists who seem to be on the same side are actually talking at cross-purposes. The first aim of this paper is to tackle some important framework questions (...) about how exactly the mindreading hypothesis is to be stated. It emerges in sections 1 and 2 that there are three importantly different versions of the mindreading hypothesis that need to be distinguished. The first (which I call minimal mindreading) occurs when a creature’s behavior covaries with the psychological states of other participants in social exchanges. The presence of minimal mindreading is not in itself evidence for the presence of what I term substantive mindreading. Substantive mindreading involves attributions of mental states. There are different levels of substantive mindreading, varying according to the category of mental state attributions that they involve. Section 2 explores different types of substantive mindreading, according to the extent to which they involve explicitly representing the agent’s backgtround psychological profile. This gives us a principled way of distinguishing propositional attitude mindreading from perceptual mindreading. -/- It is clear that much of the reasoning behind attributions of mindreading abilities to nonlinguistic creatures is analogical in nature. We see in section 3 that much of the discussion in this area proceeds on the basis of a double analogy between animal cognition and human cognition. Researchers assume both that animals solve many problems of social coordination that are analogous to problem solved by humans and that since humans solve those problems using mindreading strategies, so too do non-human animals. How we apply the second analogy, of course, depends upon our interpretation of the particular mindreading strategies that humans employ – in particular, it depends upon the centrality of propositional attitude psychology (or folk psychology) in human social understanding and social coordination. There are good reasons for thinking that the role of propositional attitude psychology in human social life is very much over-stated. This has repercussions for how we think about substantive mindreading in nonhuman animals. It very much weakens the analogical case for identifying propositional attitude mindreading in nonlinguistic creatures. -/- Suspicion of claims of propositional attitude mindreading in non-human animals turns out to be well-founded. In section 4 I present a revised version of an argument I have given elsewhere (Bermúdez 2003) to show that the most sophisticated form of substantive mindreading (the type of mindreading that exploits the concepts of propositional attitude psychology) is only available to language-using creatures. This article argues that bodily awareness is a basic form of self-consciousness through which perceiving agents are directly conscious of the bodily self. It clarifies the nature of bodily awareness, categorises the different types of body-relative information, and rejects the claim that we can have a sense of ownership of our own bodies. It explores how bodily awareness functions as a form of self-consciousness and highlights the importance of certain forms of bodily awareness that share an important epistemological property with (...) canonical forms of self-consciousness such as introspection. Are philosophy and literature allies or enemies in Jorge Luis Borges's fictions? In this paper, I argue that Borges can satisfy membership in the allies camp because his fictions provide the imaginative scenarios the allies believe are so necessary to this coalition; however, because his stories question philosophy's hold on reality, they can also seem to fall into the enemies camp by countervailing any claim philosophy has on reality and truth; although, ultimately, the manner in which Borges forges an (...) alliance between philosophy and literature will be for reasons not traditionally accepted by those in either the allies or enemies camps. This chapter provides an argument that intentional ascent requires semantic ascent, on the grounds that intentional ascent requires the ability “to hold a thought in mind” in a way that can only be done if the thought is linguistically vehicled. It tries to explain that there is an important class of thoughts that is in principle unavailable to nonlinguistic creatures. It also explores how language can function as a cognitive tool. Many of these functions do not actually require a full-fledged (...) language. If language is to have a distinctive, unique, and essential cognitive function, so that the difference between linguistic and nonlinguistic cognition is qualitative rather than merely quantitative, then it should be investigated further. The chapter takes into account many aspects of language where language functions as a cognitive tool: memory augmentation; environmental simplification; coordination; transcending path-dependent learning; control loops; and data manipulation and representation. ABSTRACTThis article addresses the identity of the legitimate actors of international law-making from the perspective of democratic theory. It argues that both states or state-based international organisations, and civil society actors should be considered complementary legitimate actors of international law-making. Unlike previous accounts, our proposed model of representation, the Multiple Representation Model, is based on an expanded, democratic understanding of the principle of state participation: it is specifically designed to palliate the democratic deficits of more common versions of the Principle (...) of State Consent.
