Universals have traditionally thought to obey the identity of indiscernibles, that is, it has traditionally been thought that there can be no perfectly similar universals. But at least in the conception of universals as immanent, there is nothing that rules out there being indiscernible universals. In this paper, I shall argue that there is useful work indiscernible universals can do, and so there might be reason to postulate indiscernible universals. In particular, I shall argue that postulating indiscernible universals can allow (...) a theory of universals to identify particulars with bundles of universals, and that postulating indiscernible universals can allow a theory of universals to develop an account of the resemblance of quantitative universals that avoids the objections that Armstrong’s account faces. Finally, I shall respond to some objections and I shall undermine the criterion of distinction between particulars and universals that says that the distinction between particulars and universals lies in that while there can be indiscernible particulars, there cannot be indiscernible universals. In this article I address the Problem of Universals by answering questions about what facts a solution to the Problem of Universals should explain and how the explanation should go. I argue that a solution to the Problem of Universals explains the facts the Problem of Universals is about by giving the truthmakers (as opposed to the conceptual content and the ontological commitments) of the sentences stating those facts. I argue that the sentences stating the relevant facts are those like (...) 'a has the property F', that is, sentences stating that a particular has a certain property. Finally I show how answering these questions in this way transforms the Problem of Universals, traditionally conceived as the One over Many, that is, the problem of explaining how different particulars can have the same properties, into the Many over One, that is, the problem of explaining how the same particular can have different properties. Nuestro objetivo consiste en caracterizar la ontología corporal de las mujeres indígenas mapuce desde el esquema epistemológico sujeto-sujeto, propio de las teorías decoloniales. En este aspecto, nos interesa desnaturalizar ciertos mecanismos de subalternización, en tanto huellas de la colonialidad, que siguen operando no solo en la construcción de sentidos, sino también como reproductores de la opresión interseccional que experimentan estas mujeres. Preliminarmente, para este planteo, nos enfocaremos en la delimitación del concepto de interseccionalidad. Luego, intentaremos articular, desde un planteo feminista (...) decolonial, diversas narrativas de estas mujeres mapuce, vinculadas a la precarización de sus vidas y su salud, como parte de las violencias instituidas por la cultura hegemónica. Finalmente, nos resulta fundamental poner de relieve la resiliencia de las culturas subalternizadas, como forma horizontalizada de narrativizar un sentir decolonial desde la memoria performativa del cuerpo, contra ciertos dispositivos de subalternización, a partir de la clara referencia a las luchas y re-existencias de las mujeres indígenas mapuce, en el marco de una perspectiva situada en la decolonización, la emancipación y la liberación de los pueblos oprimidos. Bioethicists involved in end‐of‐life debates routinely distinguish between ‘killing’ and ‘letting die’. Meanwhile, previous work in cognitive science has revealed that when people characterize behaviour as either actively ‘doing’ or passively ‘allowing’, they do so not purely on descriptive grounds, but also as a function of the behaviour’s perceived morality. In the present report, we extend this line of research by examining how medical students and professionals (N = 184) and laypeople (N = 122) describe physicians’ behaviour in end‐of‐life scenarios. (...) We show that the distinction between ‘ending’ a patient’s life and ‘allowing’ it to end arises from morally motivated causal selection. That is, when a patient wishes to die, her illness is treated as the cause of death and the doctor is seen as merely allowing her life to end. In contrast, when a patient does not wish to die, the doctor’s behaviour is treated as the cause of death and, consequently, the doctor is described as ending the patient’s life. This effect emerged regardless of whether the doctor’s behaviour was omissive (as in withholding treatment) or commissive (as in applying a lethal injection). In other words, patient consent shapes causal selection in end‐of‐life situations, and in turn determines whether physicians are seen as ‘killing’ patients, or merely as ‘enabling’ their death. The dialogue Bruno of 1802 is arguably the natural starting point for any investigation on the concepts of finitude, evil and human freedom in Schelling’s middle metaphysics. In this dialogue the author elaborates for the first time in his system a concept of freedom and independence of the finite, which extends via his reformulation in Philosophy and Religion of 1804 to the Freedom Essay of 1809 and beyond to the works of 1810 and 1811 – Stuttgart Private Lectures and The (...) Ages of the World. The central ontological problem of the dialogue relates to the possibility of a separation between the absolute and the world as space of finite beings, which, according to the system of identity first presented in 1801, cannot exist as such. The question we will then address concerns the status of the finite as such and how would it be possible to admit both its existence for consciousness and the positing of an absolute and infinite principle of philosophy. We will show how Schelling’s interest shifts, almost unintentionally, from the infinite principle to the finite as such, as a principle of freedom and self-initiation independent of the real. Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. This study investigates contemporary Mayan oral stories through the lens of Julian Jaynes's theory on the origin of consciousness, aiming to identify a potential connection between the literary elements of these narratives and traits of pre‐consciousness outlined by Jaynes. Jaynes's neuropsychological thesis argues that human consciousness emerged around 3000 years ago after a period of “bicameral mind,” characterized by auditory “hallucinations” that guided non‐habitual behavior. He claims that remnants of bicameral mentality linger to this day in all cultures. While his (...) theoretical framework has been applied to cultures in Europe, the Middle East, and Asia, this research uniquely surveys early Mayan texts and focuses on 78 oral narratives from Lake Atitlán, Guatemala. Our findings reveal traces of bicamerality, evident in the gradual fading of inner voices replaced by divination, anomalous mental states, encounters with the supernatural, and spiritual possession. Contrary to pathologizing these phenomena, the narratives often present them as abilities the Maya may not have felt culturally compelled to suppress to the extent presumed in other societies. Monitoring systems have recently arisen to verify compliance with corporate codes of conduct for labor. This article places codes in the context of broader debates on global governance and argues for an empowered participatory approach to international labor standards focusing on enabling rights. Based on ethnographic research in Mexico and Guatemala on the implementation of codes in the apparel sector and their use in cross-border organizing campaigns, it explores the effect of monitoring on worker empowerment and working conditions in global (...) factories. The analysis highlights institutional designs and political strategies capable of contributing to the protection of international labor rights. (shrink)

According to political minimalism, a debate is considered political when it revolves around the question “What shall we do?” This account suggests that certain issues related to human enhancement technologies (HETs), which have traditionally been addressed in the realm of applied ethics, could be better approached from a political standpoint. However, this raises the question of who constitutes the “we” – the communities that face the political challenges posed by HETs. We argue that there is a global human community that (...) directly faces at least some of these challenges, and this fact underscores the relevance of a cosmopolitan perspective. While some authors have already advocated for a cosmopolitan approach in addressing issues such as poverty or climate change, they often do so from a moral outlook, without adequately distinguishing between ethics and politics. In contrast, we assert that HETs present compelling arguments in favour of cosmopolitanism as a political stance. In support of this claim, we consider two cases: the pills that would allow people to eat at will without gaining weight, and the choice between different types of cognitive enhancers. (shrink)

Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. In this paper I argue that Modal Realism, the thesis that there exist non-actual possible individuals and worlds, can be made compatible with Metaphysical Nihilism, the thesis that it is possible that nothing concrete exists. Modal Realism as developed by Lewis rules out the possibility of a world where nothing concrete exists and so conflicts with Metaphysical Nihilism. In the paper I argue that Modal Realism can be modified so as to be compatible with Metaphysical Nihilism. Such a modification makes (...) Modal Realism neither incur further theoretical costs nor lose its theoretical benefits. Thus such a modification constitutes an improvement of Modal Realism. (shrink)

According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

This study examined health professionals’ (HPs) experience, beliefs and attitudes towards brain death (BD) and two types of donation after circulatory death (DCD)—controlled and uncontrolled DCD. Five hundred and eighty-seven HPs likely to be involved in the process of organ procurement were interviewed in 14 hospitals with transplant programs in France, Spain and the US. Three potential donation scenarios—BD, uncontrolled DCD and controlled DCD—were presented to study subjects during individual face-to-face interviews. Our study has two main findings: (1) In the (...) context of organ procurement, HPs believe that BD is a more reliable standard for determining death than circulatory death, and (2) While the vast majority of HPs consider it morally acceptable to retrieve organs from brain-dead donors, retrieving organs from DCD patients is much more controversial. We offer the following possible explanations. DCD introduces new conditions that deviate from standard medical practice, allow procurement of organs when donors’ loss of circulatory function could be reversed, and raises questions about “death” as a unified concept. Our results suggest that, for many HPs, these concerns seem related in part to the fact that a rigorous brain examination is neither clinically performed nor legally required in DCD. Their discomfort could also come from a belief that irreversible loss of circulatory function has not been adequately demonstrated. If DCD protocols are to achieve their full potential for increasing organ supply, the sources of HPs’ discomfort must be further identified and addressed. (shrink)

In this article, we present for the first time Schelling’s early critique of absolute idealism within his middle metaphysics (1804–1820), which has great relevance and influence on the subsequent course of German philosophy, and, more broadly considered, on later systematic thinking about the categories of unity and duality. We aim to show how Schelling defends a form of metaphysical duality, from 1804 onwards, without relapsing into a stronger Kantian dualism. In this sense, our author rejects both the dualism between nature (...) and spirit, necessity and freedom, as well as the monist-immanent metaphysical stance later associated with Hegelian panlogism. Against Hegel, Schelling increasingly vindicates the reality of the finite and degrades the infinite to mere ideality in a movement that resembles later existentialism. Furthermore, we defend Schelling against the accusation of irrationalism that sections of Hegelianism formulated against him and present the concept of infinity without the notion of totality, which he thinks of, much like Fichte, in the light of the concept of an ‘infinite task’. Schelling’s later criticisms of Hegel are shown to be influenced by his early idealist critique of the period at hand. (shrink)

Plato’s Parmenides and Lysis have a surprising amount in common from a methodological standpoint. Both systematically employ a method that I call ‘exploring both sides’, a philosophical method for encouraging further inquiry and comprehensively understanding the truth. Both have also been held in suspicion by interpreters for containing what looks uncomfortably similar to sophistic methodology. I argue that the methodological connections across these and other dialogues relieve those suspicions and push back against a standard developmentalist story about Plato’s method. This paper claims that we have direct and complete perceptual access to other people’s emotions in their bodily and behavioural expression. The claim is understood, not by analogy with the perception of three-dimensional objects or physical processes, but as a form of Gestalt perception. In addition, talk of direct perceptual access to others’ emotions is shown not to entail a behaviourist view of mind; and talk of complete perceptual access is shown to include both the phenomenological character and the dispositional (...) nature of emotions. Studies that have explored the wish to hasten death (WTHD) in patients with advanced illness have found that the feeling of being a burden may trigger WTHD. Research suggests that both the feeling and the wish are indicators of multidimensional suffering whose meaning may depend on the patient's biographical background. Therefore, we carried out a systematic review and meta‐ethnography. Fourteen qualitative studies, reported in 16 articles, met the inclusion criteria. The analysis identified two themes: the personal and social dimensions that (...) could help to explain the feeling of being a burden in these patients. These dimensions reveal how this feeling is linked to physical, psychological/emotional, existential and social factors. The feeling of being a burden cannot be understood without considering patients’ personal interpretation of their dependency or care needs, and hence it is also necessary to understand their biographical background. Such an understanding is crucial to inform clinical policies based on the moral duty to provide all patients with humane care. (shrink)

Este artículo propone una discusión sobre la naturaleza hermenéutica de la corporalidad (Leiblichkeit). Un aspecto que resultará decisivo para descifrar fenómenos corporales como el dolor y que hará comprensible la tesis del filósofo de que para lograr un acceso al fenómeno del dolor es preciso tener en cuenta lo que denomina aspectos existenciales del fenómeno del cuerpo (Leibphänomen). Para ello, este trabajo mostrará, por una parte, en qué sentido el ser corporal(leiblich sein) de lo humano es un fenómeno cooriginario de (...) las otras estructuras existenciales que integran su ser-en-el-mundo (In-der-Welt-sein) y, por otra, el carácter afectivo de dicha constitución existencial o mundana de la experiencia corporal. Una perspectiva hermenéutica que contribuirá asimismo a entender el carácter extático y disruptivo del dolor. (shrink)

Background: COVID-19 has taken many lives worldwide and due to this, millions of persons are in grief. When the grief process lasts longer than 6 months, the person is in risk of developing Complicated Grief Disorder. The CGD is related to serious health consequences. To reduce the probability of developing CGD a preventive intervention could be applied. In developing countries like Mexico, the psychological services are scarce, self-applied interventions could provide support to solve this problem and reduce the health impact (...) even after the pandemic has already finished.Aims: To design and implement a self-applied intervention composed of 12 modules focused on the decrease of the risk of developing CGD, and increasing the life quality, and as a secondary objective to reduce the symptomatology of anxiety, depression, and increase of sleep quality. The Intervention Duelo COVID follows the principles of User Experience and is designed according to the needs and desires of a sample of the objective participants, to increase the adherence to the self-applied intervention, considered one of the main weaknesses of online interventions.Methods: A Randomized Controlled Trial will be conducted from the 22nd of December of 2020 to the first of June 2021. The participants will be assigned to an intervention with elements of Cognitive Behavioral Therapy, Acceptance and Commitment Therapy, Mindfulness and Positive Psychology. The control group will be a wait-list condition, that will receive the intervention 1.5–2 months after the pre-measurement were taken. The Power Size Calculation conducted through G*Power indicated the need for a total of 42 participants, which will be divided by 21 participants in each group. The platform will be delivered through responsive design assuring with this that the intervention will adapt to the screen size of cellphones, tablets, and computers.Ethics and Dissemination: The study counts with the approval of the Research Ethics Committee of the Autonomous University of Ciudad Juárez, México, and it is registered in Clinical Trials. The article is sent and registered in clinical trials before the recruitment started. The results will be reported in future conferences, scientific publications, and media. (shrink)

La “conservación de la salud” ha constituido el eje sobre el que se han articulado y evaluado las aportaciones de Descartes a la medicina. Sobre ello, las interpretaciones canónicas se han circunscrito a la terapéutica cartesiana para las enfermedades, obviando otras dimensiones a las que el proyecto médico cartesiano también se dirigió. De ese modo, el presente artículo aborda un segundo sentido de conservación de la salud entendido como “preservación de la salud”, dirigiéndose, para ello, a un análisis de la (...) dieta cartesiana, cuyo empleo evita, según Descartes, la contracción de distintas afecciones. Dicho examen trata de mostrar en qué sentido la dieta posibilita la preservación de la salud, y cómo ésta se justifica apelando a la propia fisiología cartesiana. (shrink)

This article contends that Dworkin's notion of ‘genuine’ theoretical disagreements, which is a fundamental pillar in his criticism of legal positivism and semantic disagreements, requires a realist reinterpretation. This view is defended according to two core arguments. First, a realist reinterpretation of ‘genuine’ theoretical disagreements enables Dworkin to avoid semantic criticisms such as the one advanced by Joseph Raz, who propounds a sophisticated model of criterial semantics to explain theoretical disagreements. Second, to make intelligible the distinction between theoretical and semantic (...) disagreements in law, we need to resort to realist elements. The conclusion is striking and in clear contradiction with Dworkin's ametaphysical and epistemic abstinence. The article shows that there is a problematic tension within Dworkin's constructivist project and that he should revise either its ametaphysical view and epistemic abstinence, or notions such as ‘genuine’ theoretical disagreements. In Section 21 of his fifth letter to Clarke Leibniz attempts to derive the Identity of Indiscernibles from an application of the Principle of Sufficient Reason to God´s act of creation, namely that God has a reason to create the world he creates. In this paper I argue that this argument fails, not just because the Identity of Indiscernibles is false, but because there is a counterexample to one of the premises that Leibniz cannot satisfactorily rule out.

In the Discourse on Metaphysics Leibniz put forward his famous complete-concept definition of substance. Sometimes this definition is glossed as stating that a substance is an entity with a concept so complete that it contains all its predicates, and it is thought that it follows directly from Leibniz’s theory of truth. Now, an adequate definition of substance should not apply to accidents. But, as I shall point out, if Leibniz’s theory of truth is correct then an accident is an entity (...) with a concept so complete that it contains all its predicates. The aim of this paper is to clarify Leibniz’s notion of substance in the Discourse with a view to explaining how that definition successfully distinguishes between substances and accidents. (shrink)

In this article, I use Lorena Cabnal’s notion of territorio cuerpo-tierra to analyse seventeen in-depth interviews with women leaders of rural social movements and other organisations in Colombia. In the interviews, social leaders condemn violence that is epistemic, systemic, militarised and that permeates all ambits of life. They denounce how the coloniality of power operates, while at the same time they propose alternatives for a better life from their own cosmovisions by enacting food sovereignty and constructing feminisms from ‘below’. I (...) demonstrate how these social leaders’ actions are entangled in decolonial feminist struggles, which undermine the way in which women in the Global South have been constructed as ‘objects’ or ‘in need of saving’. These women are not ‘victims who need saving’, but politically active subjects who enact change locally and nationally through their ‘territories bodies-lands’. Not only do their narratives highlight the intimate relationship of the body with the land, but I argue that we must follow their lead in order to dismantle the coloniality of power. (shrink)

This article tries to elucidate the Deleuzian project of the reversal of Platonism in relation to that of Nietzsche. To this aim, I have made a predominantly historiographic sketch of the question in both authors. In the case of Nietzsche, I inquired about both the relationship that the reversal of Platonism presents in his philosophy with the problem of nihilism and the evolution that the topic undergoes throughout his vast intellectual production, until it reaches its final formulation. With regard to (...) Deleuze, I offer a broad overview of his work aimed at tracing the subject, from his interpretation of the Nietzschean formulation, as opposed to that of Heidegger, to the meticulous way in which it fits into his own philosophy as a shift of the essence in favour of the event as a source of singularities. Judges and lawyers believe that international law, customary law, and legal systems such as the Third Reich or apartheid law in South Africa are law. But how do we explain the fact that there is one concept of law when there are different conceptions of law with a variety of different features? Finnis, inspired by the Aristotelian notion of central case, adumbrates the idea that the concept of law might be unified by a primary concept which is the concept of (...) “law as practical reason”; that is, law conceived from an ethical perspective. He advances two arguments to defend his methodology: the conceptual and the functional. Contra Finnis, the paper shows that neither the conceptual nor the functional argument can successfully support the view that “law as practical reason” is the central case of the concept of law. The study clarifies the Aristotelian notion of central case and illustrates the mistaken application of this notion to the concept of law. However, we also argue that Finnis's insight–the idea that all the different conceptions of law might be unified for the purposes of theoretical research–is fundamental and appealing. This paper aims to reconstruct Finnis's insight through the model of core resemblance. The result is that the different conceptions of law can be unified by resemblance to the concept of “law as practical reason,” though there is no identity among the different conceptions of law. Con todo, el planteamiento de los argumentos escépticos referidos a la duda metódica cartesiana ha evidenciado la necesidad de hallar una justificación al propio criterio de la percepción clara y distinta. Frente a los intentos basados en la indubitabilidad de la percepción o en la garantía surgida de la bondad divina, se defenderá una justificación alternativa pragmatista.

Cash assistance programs have been piloted as Basic or Guaranteed Income across the United States. This research asks how programs are being designed and evaluated, with implications for how collective program impacts are understood. To answer this question, we assemble and review 105 programs based in the United States, covering over 40,000 beneficiaries. We compare eligibility criteria, funding sources, distribution amounts, program administration, pilot duration, and evaluation measures. We find that just over half of the programs use income-based qualifications and (...) most (84 %) have some form of place-based eligibility criteria defined by residence. The plurality of programs (28) are based in California (CA) and 16 operate at the county level. We also find that while the development of pilots often uses community development framing, funding and evaluation measures tend to be more aligned with either economic or public health intervention assessments. As multiple fields of study engage with poverty alleviation, our findings add nuance to the complex and continuously developing landscape of interventions and evaluations. (shrink)
