Democracy means rule by the people, but in practice even the most robust democracies delegate most rule making to a political class The gap between the public and its representatives might seem unbridgeable in the modern world, but Legislature by Lot examines an inspiring solution: a legislature chosen through “sortition”—the random selection of lay citizens. It’s a concept that has come to the attention of democratic reformers across the globe. Proposals for such bodies are being debated in Australia, Belgium, Iceland, (...) the United Kingdom, and many other countries. Sortition promises to reduce corruption and create a truly representative legislature in one fell swoop. In Legislature by Lot, John Gastil and Erik Olin Wright make the case for pairing a sortition body with an elected chamber within a bicameral legislature. Gastil is a leading deliberative democracy scholar, and Wright a distinguished sociologist and editor of the Real Utopias series, of which this is a part. In this volume, they bring together critics and advocates of sortition who have studied ancient Athens, deliberative polling, political theory, social movements, and civic innovation. Without obscuring its limitations, the contributors offer a wide variety of ideas for how to implement sortition and examine its potential for reshaping modern politics. Legislature by Lot includes sixteen essays that respond to Gastil and Wright’s detailed proposal. Essays comparing sortition to contemporary reforms see it as a dramatic extension of deliberative “minipublics,” which gather random samples of citizens to weigh public policy dilemmas without being empowered to enact legislation. Another set of essays explores the democratic principles underlying sortition and elections and considers, for example, how a sortition body holds itself accountable to a public that did not elect it. The third set of essays considers alternative paths to democratic reform, which limit the powers of a sortition chamber or more quickly establish a pure sortition body. In discussions of health reform, the increased use of health information technology is a common element of nearly every serious proposal on the table. Health IT includes electronic health records kept by providers, personal health records offered by health insurance plans or owned by consumers, and electronic health information exchanges. Although health reform initiatives being discussed contain little detail regarding health IT, in general they promote health IT to facilitate the electronic sharing of health information to improve individual and population (...) health. During the 2008 presidential campaign, the health care proposals of both President Obama and Senator McCain discussed health IT. President Obama’s proposal invests $50 billion over the next five years to promote the adoption of health IT with privacy safeguards. Senator McCain’s plan also encouraged the adoption of health IT, with an emphasis on coordination. (shrink)

Some have referred to relatively recent forms of popular Buddhism as an ‘engaged’ Buddhism that has revived or redirected traditional Buddhist ideas and practices found in meditation texts to reflect a greater social or worldly emphasis than suggested in earlier historical moments. One of these ideas is the quadripartite framework of the ‘immeasurable states’ (aprameya/appameya) or ‘divine abidings’ (brahmavihāra), the most prominent of which in popular Buddhism is mettā (friendliness/loving-kindness). This article traces the philosophy of the ‘immeasurable states’ found in (...) meditation texts from various Indic traditions (Buddhist, Jain, and Hindu) and then presents the ways in which these traditional ideas (especially mettā) have informed popular Buddhist movements in the twentieth century. Points of discussion include: ‘engaged’ Buddhism's relationship with traditional Buddhist ethics; arguments concerning the coalescence of monastic-centred meditation practices with popular Buddhist notions of social service; and the distinct utilization of mettā in contemporary Buddhist societies in contrast to the mobilizing impulses of comparable religious communities (Hindu and Jain) with a similar heritage of mettā discourse in South Asia. This volume of Burke's writings and speeches is divided into two parts. The first covers the period between the time of his retirement from the House of Commons in 1794 and his death in 1797. His main preoccupation during this period was, of course, the French Revolution and the progress of the war against France. Surveying developments with dismay and apprehension, he produced a critique of the Revolution which expressed much of his mature thinking on political and social life, and (...) issued a clarion call for a European crusade to save civilization. Part II contains Burke's writings and speeches relating to Ireland. From his entry into political life, he was intensely interested in Irish problems, religious, economic, and constitutional, and in Anglo-Irish relations. Fervently believing that Great Britain and Ireland should be partners within the Empire, in his last years he was deeply disturbed by the influence of the French Revolution on Irish politics. This paper brings kāmaśāstra into conversation with poetics (alaṅkāraśāstra) and modes of literary criticism associated with Sanskrit literature (kāvya). It shows how historical intersections between kāvya, kāmaśāstra, and alaṅkāraśāstra have produced insightful cross-domain typologies to understand the nature and value of canonical works of Sanskrit literature. Edmund Burke was one of the most influential commentators on the events of the French Revolution. This edition throws new light on Burke's motives, and the reasons why his writings were both widely read and widely rejected.

Presents Edmund Burke's writings on politics, history, culture, and society along with selections from his letters.

The rationale for pursuing the development and use of Germ-Line selection and modification techniques is examined in this essay. The argument is put forth that it is the moral obligation of the medical profession to make available to the public any technology that can cure or prevent pathology leading to death and disability, in both the present and future generations. Society should pursue the development of strategies for preventing or correcting, at the Germ-Line level, genetic features that will lead to, (...) or enhance, pathological conditions. Because prenatal screening and even early embryo screening and selection can prevent only a subset of known genetic disorders, direct genetic intervention is the only way in which certain couples can exercise their rights to reproductive health. Finally, the arguments most often raised against the pursuit of and use of methods for Germ-Line intervention shall be discussed. This article offers a novel, conservative account of material constitution, one that incorporates sortal essentialism and features a theory of dominant sortals. It avoids coinciding objects, temporal parts, relativizations of identity, mereological essentialism, anti-essentialism, denials of the reality of the objects of our ordinary ontology, and other departures from the metaphysic implicit in ordinary ways of thinking. Defenses of the account against important objections are found in Burke 1997, 2003, and 2004, as well as in the often neglected six paragraphs (...) that conclude section V of this article. (shrink)

This article presents a narratological reading of the Gospel of Mark with special attention given to the role, function and rhetorical impact of point of view. It is argued that through the use of ‘witnesses’ ranging from the omniscient narrator, to the character God, to the Old Testament Scriptures, the author of Mark presents a point of view that his implied reader would find difficult to counter. In addition to this, the article demonstrates that the motifs of allegiance, misunderstanding and (...) opposition in the Second Gospel are almost entirely confined to the adoption or rejection of the point of view being advocated for by the author of Mark. In the end, it is shown that only in the death of Jesus on the cross and the subsequent ‘centurion’s confession’ are the motifs resolved and is the point of view of Mark accepted by a human character. This essay considers the relationship between ideal theory and non-ideal theory. It begins with Rawls’s conception of ideal theory and A. John Simmons’s articulation of non-ideal theory. Both defend the priority of ideal theory over non-ideal theory. The essay then considers three different conceptions of the social barriers standing in the way of an ideal society, taken broadly from Mill, Marx, and Foucault. Each conception of power suggests a divergent strategy for pursuing non-ideal theory. The Foucauldian conception also suggests reasons (...) to mistrust our own political and moral judgments. The essay advocates a more limited view of the relationship between ideal and non-ideal theory than is commonly described, in which ideal theory retains its logical priority but not its temporal priority. In other words, the essay argues that we will fare best when we focus first on reducing specific injustices while setting aside further speculation about the character of an ideal society. (shrink)

Volume 1 of the Writings and Speeches of Edmund Burke presents Burke's early literary writings up to 1765, and before he became a key political figure. It is the first fully annotated and critical edition, with comprehensive notes and an authoritative introduction. The writings published here introduce readers to Burke's early attempts at a public voice. They demonstrate in a variety of ways how determined he was to become involved in the social and intellectual life of his times. The one (...) work of Burke's early life which has long been recognized as having prime critical significance, the Sublime and the Beautiful, is naturally found here. In addition the volume includes the first fully edited version of other works which have been neglected, notably the Vindication of Natural Society, a substantial satire on current philosophical and religious thought, the Abridgement of English History and the Hints for an Essay on the Drama. The volume also prints reliable texts of his early poems and prose `characters' as well as the first complete text of The Reformer since it was first published in 1748. This was a weekly paper devoted principally to the Dublin cultural scene and was edited by Burke shortly after he graduated from Trinity College, Dublin. (shrink)

While claims for the return of expropriated land by Native Americans and other indigenous peoples are often evaluated using legal frameworks, such approaches fail to engage the fundamental moral questions involved. This essay outlines three justifications for Native Americans to pursue land claims: to regain properties where original ownership has not been superseded, to aid the long-term survival of their endangered cultures, and to challenge and revise the historical misremembering of mainstream American society. The third justification is most controversial. It (...) asserts that understandings of history shape perceptions of the present, and that intensively pursued land claims can provide powerful challenges to inaccurate conceptions of the past. This essay argues that Native Americans are for this reason justified in strategically pursuing land claims that are difficult to justify on other grounds, and closes with some worries about the legitimate role of strategy in political action. This volume of The Writings and Speeches of Edmund Burke continues the story of Edmund Burke, the Rockingham party in British politics, and the American crisis. By 1774 Burke was already recognized as a master of parliamentary debate and an accomplished writer. By 1780, however, his reputation was to have risen substantially. Probably the most important single reason was his Speech on Conciliation with America, which was presented to the House of Commons in March 1775, published, and circulated to a (...) wide audience on both sides of the Atlantic. In that speech, Burke used the full force of his intellect and eloquence to set out the Rockinghams' first comprehensive plan for achieving lasting peace in the Empire. The public commendation he received helped him to gain recognition for offerings such as his second conciliation proposal in November 1775, and his Letter to the Sheriffs of Bristol in 1777. It also gave him some of the confidence he needed to announce the Whig party's historic conversion to a moderate reform programme in his celebrated speeches on economical reform in 1779 and 1780. Numerous writings and speeches in this volume are transcriptions of previously unpublished manuscripts from the collections at Sheffield and Northampton. These allow the reader new insights into the workings of Burke's mind not just in relation to the major political issues, but also to a multitude of engaging subjects such as education, capital punishment, religious dissent, and the return of the Rockingham Whigs to government power. By the eighteenth century, the term 'sublime' was used to communicate a sense of unfathomable and awe-inspiring greatness, whether in nature or thought. The relationship of sublimity to classical definitions of beauty was much debated, but the first philosopher to portray them as opposing forces was Edmund Burke. Originally published in 1757 and reissued here in the revised second edition of 1759, this influential treatise explores the psychological origins of both ideas. Presented as distinct consequences of very separate emotional lineages, (...) beauty and sublimity are traced back through a web of human feelings, from self-preservation instincts to lust. Burke's doctrine of the sublime was to have far-reaching effects. In Britain, it informed perceptions of landscape in art and literature for years to come. Meanwhile, on the continent, Kant regarded Burke as 'the foremost author' in 'the empirical exposition of aesthetic judgments'. (shrink)

Both the approach taken by World Rugby to address the question of trans women participation in women’s rugby and the paper by Jon Pike that explains the ethical justification for the exclusion of trans women players from world rugby are compelling when understood within the dominant rugby/sport narrative. However, in this article, I suggest that what is absent is a radical feminist understanding that engages with the political purposes of separate sport spaces for women in producing feminist counternarratives that challenge (...) men’s power in/over sport. Decisions about the inclusion of trans women in women’s sporting competitions should be made on a sport context-by-sport context basis oriented by broader feminist political goals. (shrink)

Initiatives to encourage more women in STEM-related industries have had mixed results. Adding more women to longstanding male-dominated STEM occupations has highlighted issues in workplace culture that are hostile to women. In this case, the CEO of an engineers' professional association, NSE, is accused of making a sexually suggestive remark to two female engineers at the annual convention. One of the women, Claire, lodged a complaint with the board. After reviewing the investigation report, the board voted to ask the CEO (...) to quietly apologize to both women. Claire, in the meantime, posted a negative review of the NSE's handling of her complaint which is getting considerable media attention. The purpose of this case is for students to examine the competing interests NSE faces in promoting the safety of female members, protecting its reputation for advancing the profession and women in engineering and supporting an otherwise “brilliant CEO”.
