The article deals with the aesthetic dimension of humour. The author starts with Hannah Arendt’s distinction between labour as a set of tasks necessary for the reproduction of biological life and praxis as an expression of freedom. In the same way the humour would be detached from the “working communication” of everyday life. Humour represents a “break” with ordinary modes of communication. This is done through “transpositions”, which can take the form of objectual transpositions (which play on the equivocal references (...) of a term), verbal transpositions (which contrast the uttered hypertext with a more usual hypotext; self-deprecation is a special case of verbal transposition) or metacognitive transpositions (like the “lapalissade”). The aesthetic value of humour is increased by the simplicity of the means used to obtain the contrast. (shrink)

Liang Qichao, Rudolf von Jhering, and Rights Stephen C. Angle [T]he Celestial Empire, with its bamboo, the rod for its adult children, and its hundreds of millions of inhabitants, will never attain, in the eyes of foreign nations, the respected position of little Switzerland. The natural disposition of the Swiss (...) in the matter of art and poetry is anything but ideal. It is sober and practical, like that of the Romans. But, in the sense in which I have thus far used the expression "ideal," in its relation to rights, it is just as applicable to the Swiss as to the Englishman. 1Rudolf von Jhering (1818-92) published Der Kampf ums Recht (The Struggle for Law) in 1872. He was already regarded as one of Germany's most important legal philosophers, and Der Kampf helped to ensure a world-wide reputation. His argument that people should be less like the "adult children" of China and more like the English found audiences everywhere, including China, where Der Kampf was translated between 1900 and 1901. Jhering's doctrines stimulated Liang Qichao (1873-1929), one of China's leading thinkers, to publish "Lun Quanli Sixiang (On Rights Consciousness)," in 1902 as part of his manifesto On the New People. Liang tells us that the "essential points" of his essay, which is among the earliest and most sustained treatments of the concept of rights to appear in Chinese, are mostly taken from Der Kampf. 2 We will see that there are indeed certain similarities that make Liang's "quanli" 3 (the standard Chinese translation of "rights") resonate with Jhering's notion of "Recht," and these similarities--chief among which is a kind of individual assertiveness--help to explain [End Page 241] Liang's interest in Jhering. My discussion of the two thinkers will offer at least the beginnings of an explanation of why German conceptions of law and rights were so attractive to Chinese intellectuals.As is often the case with cross-cultural comparisons, we will also see that these similarities mask some less obvious but deeply important differences. For Jhering the relation between following the procedures of the law and exercising one's Recht is crucial; for Liang, in contrast, quanli are deeply related to ethical concerns. This difference in turn colors their respective notions of assertiveness, which thus turn out not to resemble one another as closely as first appeared. When we see Recht and quanli as separate concepts emerging from separate discourse contexts, these differences will make sense.In "On Quanli Consciousness" Liang regularly quotes Jhering, often at some length. One important passage reads as follows: In ancient times, Lin Xiangru scolded the King of Qin saying: "Smash both my head and the jade disk!" 4 Now given the size of the state of Zhao, how could such love be expressed for a tiny thing like a jade disk? He was saying that Qin could smash the disk, kill him, invade his territory, endanger his state, and still he would not surrender. Ah! This was nothing other than "quanli"! Jhering has also said: "If an Englishman traveling to the European continent is one day asked to pay an irrational charge by the hotel's carriage driver, in every case he will resolutely scold [the driver]. If the driver won't heed his scolding, the Englishman will struggle for justice without tiring, always preferring to extend his stay; even if his traveling expenses were to increase as much as ten-fold, he would not cease. Unknowing people all laugh at this great fool, but none of them understand that this person's struggle over a few shillings is in fact a vital part of what allows the nation of England to stand tall by itself in the world. This abundance of quanli consciousness and sharpness of feelings of quanli are the great reasons behind the ability of the English to establish their state. Now let... (shrink)

Ah! Nana est un journal de bande dessinée publié entre 1976 et 1978. Adapté d’un magazine apparu aux USA en 1970, le Wimmen’s comix, sa spécificité est d’être réalisé par des femmes et de viser un lectorat féminin. C’est pourquoi il représente une aventure pionnière dans le monde de la bande dessinée française. Son contenu reflète les préoccupations féministes de son temps, pour aborder des sujets les plus délicats comme les plus tabous de la société de la fin des années (...) 1970, parmi lesquels la sexualité féminine, l’inceste ou les différentes violences subies par les femmes. Des dossiers consacrés à une thématique particulière sont appuyés par une mise en image sans détours, crue et parfois cruelle. Il en faut beaucoup pour bouleverser les mentalités. Les femmes d’Ah! Nana en ont-elles trop fait? En tout cas ce projet était trop original pour survivre à cette époque. Il est un échec commercial que le poids de la censure condamne définitivement. Mais il reste une tentative, jusqu’ici jamais reconduite en France, de permettre aux femmes de s’exprimer dans la bande dessinée et il rend compte de leurs difficultés à être publiées. (shrink)

Tahâvî (v. 321/ 933), hicrî üçüncü asrın sonları ile dördüncü asrın başlarında yaşamış Hanefî fakihidir. Tahâvî’nin daha çok muhaddis olarak tanınmasına rağmen hadis ve fıkha derin vukufiyeti, her iki alana da temas eden hadis-sahâbî kavlî münasebetini onun üzerinden incelemeyi daha anlamlı kılmaktadır. Müctehid fakihlerin hüküm istinbâtında başvurduğu sahâbî kavlî, Hz. Peygamber’e dayanması bakımından semâ/tevkif ihtimali bulunan bir delildir. Bu sebeple sahâbî kavlini sünnet birlikte değerlendirmenin lüzumu ortaya çıkmaktadır. Ayrıca Tahâvî’nin sahâbî kavli ile sünnet arasında net bir ayırım yapmaması, Hanefî usûlünün (...) teşekkül süreci açısından önemlidir. Tahâvî, ictihad usûlü anlayışında sahâbî kavline deliller hiyerarşisinde Kur’an, sünnet ve icmâdan sonra yer vermektedir. Eserlerindeki tercihleri dikkate alındığında Tahâvî, sahâbî kavlini tevkife hamlettiği yerlerde sünnet olarak değerlendirmektedir. Hatta sahâbî kavli ve uygulamasının icmâa dönüştüğü durumda sünneti neshedebilecek mertebede gördüğü anlaşılmaktadır. Tahâvî ictihadî olan, re’y ve te’vil ifade eden sahâbî kavlini ise mutlak delil almayıp bu durumdaki sahâbî kavli karşısında kıyasa gitmektedir. During the past century of oriental studies, the question of when and where Muslim traditions came to be propped up with validating lines of transmission has attracted a considerable amount of scholarly attention, for its bearing on the key issue of the historicity of ḥadīth. In this essay, I review the existing theories about the origin of the isnād, which alternate between the lifetime of the Prophet’s Companions and the end of the second century AH/c. 816 CE. Based on a (...) hitherto largely overlooked tradition and two general methodological premises, I associate the inception of corroborative attribution to past authorities in legal and theological ḥadīth with the aftermath of al-Mukhtār b. Abī ʿUbayd al-Thaqafī’s revolt in Kūfa. Over the course of the second/eighth century, the isnād institution spread out across the major centers of learning in the caliphate and entered the field of historical reports. Such geographical and typological unevenness of the isnād’s evolution gave rise to conflicting theories about its chronology. (shrink)

Prof. Dr. Fuat Sezgin Prof. Dr. Fuat Sezgin anısına ithaf ettiğimiz Felsefe ve Din Bilimleri Özel Sayımıza hoşgeldiniz. Prof. Dr. Fuat Sezgin, 24 Ekim 1924 tarihinde Bitlis’te dünyaya gelen Fuat Sezgin, il-kokulu Doğubayazıt’ta, ortaokul ve liseyi ise Erzurum’da bitirdikten sonra 1943 yılında İstanbul’a geldi. İstanbul Üniversitesi şarkiyat (Doğu bilimi) Araştırmaları (...) Enstitüsü’nde ünlü Alman şarkiyatçı Prof. Dr. Hellmut Ritter’in (1892-1971) öğrencisi olan Sezgin, Ritter’in tavsiyesi üzerine İslâm bilimlerine yöneldi. 1951’de İstanbul Üniversitesi Edebiyat Fakülte-si’den mezun olduktan sonra Arap Dili ve Edebiyatı alanında “Buhârî’nin Kaynakları Hakkın-da Araştırmalar” başlıklı teziyle doktorasını tamamladı. Bu çalışmasıyla, hadis kaynağı olarak İslâm kültüründe önemli bir yere sahip olan Buhârî’nin sözlü kaynaklar yerine yazılı kaynaklara dayandığı tezini ortaya attı. Doçent unvanını 1954 yılında alan Sezgin, 1960 askeri darbesinin ardından üniversi-telerden uzaklaştırılan 147 akademisyen arasında kendi adının da bulunması üzerine 1961’de Türkiye’den ayrıldı ve çalışmalarına Goethe Üniversitesi’nde (Frankfurt) devam etti. Câbir bin Hayyân hakkında hazırladığı ikinci tezini 1965’te Goethe Üniversitesi Doğa Bilimleri tarihi Enstitüsü’ne sunan ve bir yıl sonra profesörlüğe yükseltilen Sezgin, aynı yıl kendisi gibi şarkiyatçı olan Ursula Sezgin ile Evlendi. Alanında şimdiye kadar yazılan en kapsamlı eser kabul edilen Geshichte des arabisc-hen Schrifttums (Arapça Yazma Eserler Literatürü Tarihi) başlıklı kapsamlı eserinin ilk cildini 1967’de yayımlayan Sezgin, 1978’de Kral Faysal İslâmi İlimler Ödülü’ne lâyık görüldü. Bu ödül nedeniyle kendisine takdim edilen maddi desteği değerlendirerek 1982’de Goethe Üniversitesi Arap-İslâm Bilimleri Tarihi Enstitrüsü’nü, ertesi yıl ise bu enstitü bünyesinde, tarih boyunca Müslüman bilim insanlarının icat ettiği 800’den fazla bilimsel alet ve düzene-ğinin modellerinin sergilendiği İslam Bilim ve teknoloji Müzesi’ni kurdu. Bu müzenin bir benzerini 2008 yılında istanbul’da kuran Sezgin, 2010 yılında Prof. Dr. Fuat Sezgin İslam Bilim Tarihi Araştırmaları Vakfı’nın kuruluşuna öncülük etti. Kahire Arap Dili Akademisi, Şam Arap Dili Akademisi, Fas Rabat Kraliyet Akademisi, Bağdat Arap Dili Akademisi, Türkiye Bilimler Akademisi şeref üyeliği de dâhil olmak üzere çok sayıda ödül ve nişana layık görülen Sezgin’e; Erciyes Üniversitesi, Atatürk Üniversitesi, Süleyman Demirel Üniversitesi ve İstanbul Üniversitesi tarafından fahri doktora unvanları verildi. Frankfurt am Main Goethe Plaketi, Almanya Üstün Hizmet Madalyası, İran İslâmi Bilimler Kitap Ödülü ve Cumhurbaşkanlığı Kültür ve Sanat Büyük Ödülü ile taltif edildi. Prof. Sezgin’in öncülüğünde kurulan İstanbul İslâm Bilim ve teknoloji tarihi Müzesi, Kültür ve Turizm bakanlığı 2016 özel Ödülü’ne lâyık görüldü. Arapça, Süryanice, İbranice, Latince ve Almanca başta olmak üzere 27 dil bilen Prof. Dr. Fuat Sezgin, 30 Haziran 2018’de İstanbul’da vefat etti ve Gülhane Parkı’ndaki İstanbul İslâm Bilim ve teknoloji tarihi Müzesi’nin bahçesine defnedildi. Vefatının ardından, 2018/6 sayılı Cumhurbaşkanlığı genelgesi ile 2019 yılı “Prof. Dr. Fuat Sezgin Yılı” olarak ilân edildi. Cumhurbaşkanlığı genelgesinde "İslam kültür ve medeniyetinin daha iyi anlaşılmasını sağlamak ve onu yeni nesillere en doğru şekilde aktarmak amacıyla yapılacak söz konusu çalışmalara ilgili tüm kamu kurum ve kuruluşlarınca her türlü destek ve katkının sağlanması hususunda gereğini rica ederim." İfadelerine yer verilerek Fuat Sezgin’in ülke sathında anlatılması ve düşüncelerinin anlaşılması için çeşitli faaliyetlerin yürütülmesi istenmişti. Koordinasyon Merkezi olarak da Kırıkkale Üniversitesi seçildi Dünyanın önde gelen bilim tarihçilerinden olan, İslam Bilim Tarihi alanındaki çalışmaları bulunan Prof. Dr. Fuat Sezgin’i gelecek nesillere tanıtmak, fikirlerini anlatmak amacıyla Sivas Cumhuriyet Üniversitesi tarafından da birçok faaliyet yapıldı. Dünyanın önde gelen bilim tarihçilerinden Prof. Dr. Fuat Sezgin’e, İslam Bilim Tarihi alanındaki çalışmalarından dolayı Üniversitemiz tarafından “Fahri Bilim Doktoru” unvanı verildi. Prof. Dr. Sezgin’e fahri bilim doktoru unvanı verilmesi dolayısıyla Üniversitemiz Kül-tür Merkezi’nde düzenlenen tören İstiklal Marşımızın okunması ve saygı duruşuyla başladı. Programa Rektörümüz Prof. Dr. Alim Yıldız, Sivas Belediye Başkan Yardımcısı Ah-met Özaydın, Fatih Sultan Mehmet Üniversitesi Rektörü Prof. Dr. Musa Uzun, öğretim elemanları ve öğrenciler katıldı. Rektörümüz Prof. Dr. Alim Yıldız yaptığı açış konuşmasında, "İnsanlara İslam bilimlerinin gerçeğini tanıtmak, benlik duygularını olumsuz etkileyen yanlış yargılardan onları kurtarmak ve ferdin ehemmiyetine olan inancı kazandırmak amacıyla İslam Bilimi Tarihi araştırmalarına adanmış bir ömürdür Prof. Dr. Fuat Sezgin Hocamız. Öyle büyük bir otoritedir ki onu anmadan, onun hazırladığı eserlere bakmadan, bilim tarihiyle, İslam tarihiyle ilgili ortaya bir şeyler sunabilmek çok zordur. Bilim tarihinin en çalışkan, en birikimli bilim insanlarından biridir. İslam tarihine, İslam düşüncesine, İslami eserlere ve bilim dünyasına vermiş olduğu katkılarıyla bir medeniyet kâşifi, eşi bulunmaz bir değer ve ‘darbeler neden kötüdür’ sorusunun mücessem cevabıdır Prof. Dr. Sezgin. Bilgiyi hikmetle taçlandırıp irfana ulaştırmadıkça hiçbir şeyi yerli yerine oturtamayız." dedi. Konuşmanın ardından Rektör Yıldız, 93 yaşındaki Prof. Dr. Fuat Sezgin’e cübbe giydirdi. Daha sonra Sezgin katılımcılara ‘Arap İslam Tarihinden Bazı İzlenimler’ konulu ders verdi. Prof. Dr. Fuat Sezgin, “İnsanların bilgi tarihi ile ilgili verileri yazılı olarak kaydetme gayreti, politik tarihe olana nispetle tesadüflere ve keyfi değerlendirmelere göre çok geri zamanlarda oldu. İslam bilim tarihi yüksek ve kaliteli görüşleri yansıtır. Bunları burada sunamayacağım. Birçoğunu Arap-İslam tarihi adlı kitabımın bugüne kadar çıkmış olan 17. cildinde kaydetmeye çalıştım. Onu İstanbul’da Gülhane Parkı’nda İslam Tarihi Araştırmaları Vakfı yayınları arasında bulabilirsiniz.” dedi. Prof. Dr. Sezgin “Bilimler tarihinin verilerini değerlendirmekte, yaşanılan zamanın etüt şartını gözden kaçırılmasının esas olması gerektiğini anladım ve henüz kitabımı yazma-ya başlamadan rastladığım Fransız Coğrafya tarihçisi Joseph Toussaint Renaud (1795-1867)’un şu sözleri beni çok etkilemişti. “Tesadüf teknik ve sanatın ilerlemesinde çok büyük bir rol oynamaz. İnsanlar buluşlarında devamlı bir şekilde birden bir sıçrayışla değil, adım adım hareket eder. Her zaman aynı hızda değil, fakat devamlı olarak insan icat etmez. Olanı ilerletir.” ifadelerine yer verdi. Konuşmasının sonunda Prof. Dr. Sezgin, “Benim 65 yıldır yaymaya çalıştığım Arap İslam bilimleri tarihi hemen hemen her gün beni hayata bağladı. İslam dünyasında büyük bir hızla ilerleyen bilimler MS. 8. yüzyıldan itibaren Fransa ve İngiltere’ye diğer taraftan 10 ve 11. yüzyıldan itibaren Sicilya’ya ve İtalya’ya 9. yüzyıldan itibaren Bizans’a ulaştılar. Avrupa-lılar teknik bilimleri diğer bilimlere nazaran daha kolay anlıyor ve alabiliyorlardı. Bu anlam-da onlar 16. yüzyılda bazı yönlerde Müslümanlara ulaşmaya hatta onları geçmeye başladılar.” ifadelerini kullandı. Programın sonunda Rektörümüz ve Fatih Sultan Mehmet Üniversitesi Rektörü Prof. Dr. Musa Duman, Prof. Dr. Fuat Sezgin’e tezhipli bir tablo hediye ettiler. 2019 Prof. Dr. Fuat Sezgin Yılı kapsamında Sivas Cumhuriyet Üniversitesi Merkezî Kütüphanesi’ne Prof. Dr. Fuat Sezgin’in ismi verildi. Ayrıca Üniversitemiz Rektörlüğü tarafından düzenlenen 5’inci Hazan Şiir Dinletisi Sezgin anısına ithaf edilmiştir. 2019 yılının Haziran ayı içerisinde ise Üniversitemiz Rektörlüğü öncülüğünde ve İlahiyat Fakültesi Dekanlığınca ile Sivas Merkez Ulu Cami’de merhum Prof. Dr. Sezgin için Kur’an-ı Kerim tilaveti ve Mevlid-i Şerif programı gerçekleştirilmiştir. Son olarak üniversitemiz rektörlüğü tarafından desteklenen ve Sivas Cumhuriyet Üniversitesi İlahiyat Fakültesi tarafından yayımlanan Cumhuriyet İlahiyat Dergisi’nin 23. Cilt 3. Sayısı (Felsefe ve Din Bilimleri Özel Sayısı) Prof. Dr. Fuat Sezgin anısına ithaf edilmiştir. Volume 1 of the Routledge History of Philosophy covers one of the most remarkable periods in human thought. The essays present the fundamental approaches and thinkers of Greek philosophy in chronological order.

The first half of this Editorial examines the implications of the close link between morality and religion in Islamic thinking. There is no separate discipline of ethics in Islam, and the comparative importance of reason and revelation in determining moral values is open to debate. For most Muslims, what is considered halāl (permitted) and harām (forbidden) in Islam is understood in terms of what God defines as right and good. There are three main kinds of values: (a) akhlāq, which refers (...) to the duties and responsibilities set out in the shari‘ah and in Islamic teaching generally; (b) adab, which refers to the manners associated with good breeding; and (c) the qualities of character possessed by a good Muslim, following the example of the Prophet Muhammad. Among the main differences between Islamic and western morality are the emphasis on timeless religious principles, the role of the law in enforcing morality, the different understanding of rights, the rejection of moral autonomy as a goal of moral education and the stress on reward in the Hereafter as a motivator of moral behaviour. The remainder of the Editorial is concerned with the two main aspects of moral education in Islam: disseminating knowledge of what people should and should not do, and motivating them to act in accordance with that knowledge. Ultimately, moral education is about inner change, which is a spiritual matter and comes about through the internalisation of universal Islamic values. (shrink)

Agricultural production has an important role in the Turkish economy as in many countries. However, the hazelnuts, tea and fresh fruits have been produced through inefficient methods for a long time. With the development of technology and new techniques, farmers have started to produce more efficient agricultural production with low costs. The basis of these partnerships, known as sharecroppers among the farmers, is based on muzara’ah and musaqat partnerships in Islamic Law. However, today it is not known whether these partnerships are made in accordance with the conditions of muzara’ah and musaqat agreements. In this study, we investigate how musaqat partnerships are made over hazelnut production, and we also try to detect problems that appear during the partnership. In addition, we offer suggestions to eliminate the detected problems. When the literature on musaqat is examined, it is seen that this partnership agreement is not the subject of research separately, and that the issue is generally discussed in some fiqh issues that concern partnership agreements. During the literature review, it was seen that today there are no studies on how the partnership contract is fulfilled and what problems emerge in terms of Islamic law. The fact that this study directly focuses on the current practices of musaqat partnership and identifies the emerging fiqh problems will fill a gap in the literature. (shrink)

Abū Ishāq al-Ṣaffār was one of scholars of the Western Qarakhānids’ period who followed the Kalām thought of al-Māturīdī (d. 333/944). His theological works Talkhīs al-adilla and Risāla fī al-kalām, his method in kalām, and frequent reference to his works by Ottoman and Arab scholars indicate that al-Ṣaffār is a respected and authorative Māturīdī theologian. The article focuses on his defense of the kalām. By adding a long introduction to Talkhīs about the naming, importance, and religious legitimacy of the science (...) of kalām, Saffār asserted that the kalām should be learned. When systematical vindication of the science of kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the kalām among Ḥanafī-Māturīdīs. Even though he does not state its systematic, it can be understood that vindication of kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation. Al-Ṣaffār’s defending the science of kalām shows that there were opposite thoughts against kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania. In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of kalām. In addition, he was trying to go beyond the oppositions of Ḥanafī jurists. His vindication is consistent and has scholarly depth because it is able to be against a strong opposition. -/- SUMMARY: Abū Ishāq Ibrahīm b. Ismāil Zāhid al-Ṣaffār al-Bukhārī is a scholar belonging to the Ḥanafī theological tradition which was improved by the contribution of Ḥanafī theologians who used thinking system of Abū Ḥanīfa (d. 150/767) as base and adopted Abū Manṣūr al-Māturīdī (d. 333/944) and his thoughts in historical process. The contents of his theological works Talkhīs al-adilla li-qawāʿid al-tawḥīd and Risāla fī al-Kalām, the method that he used, and references to his works made by Ottoman and Arab scholars indicate that he is an important Māturīdī theologian. The article focuses on his defense of the science of Kalām. -/- In Talkhīs al-adilla, there are two sections including the subject of naming, and importance and necessity of Kalām discipline. Here, the necessity of learning Kalām and its value are defended in detail. -/- Besides, rumors “Abū Ḥanīfa turned away from the science of Kalām in his doomsdays” and that “He prohibited to make occupation with Kalām completely” are evaluated. -/- When systematical vindication of the science of Kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the Kalām among Ḥanafī Māturīdīs. Even if Abū Manṣūr al-Māturīdī, Abū al-Yusr al-Bazdawī (d. 493/1100) and Abū Muʿīn al-Nasafī (d. 508/1115) defend that the science of Kalām is not wrong for religion; yet, the vindication of Kalām does not take a place under a separate title and in a detailed manner in any of Māturīdī theologians works. -/- The method that al-Ṣaffār used when he is defending the science of Kalām, differs from strategy of Abū Ḥanīfa. While Abū Ḥanīfa has mentioned that there is a need for the science of Kalām under these new circumstances, al-Ṣaffār has defended theologians who were charged with being Ahl al-Bidaʿ, by trying to prove that the prophets especially the Prophet Ibrāhīm, even the Companions of the Prophet Muḥammad (Ṣaḥāba) and the Successors of the Companions (Tābiʿūn) scholars use their minds and make arguments in religious matters. In this respect, he emphasizes that the Qurʾān orders to think and discuss gently, not to be stay in silence: “And dispute with them, using what is best” (16.125-126). Therefore, he states that this discipline which took a mission to explain and defend the creed of Islam (ʿaqīda), cannot be characterized as an innovation (bidʿah) or illicit. -/- His vindication method can be defined as a more developed type of method that Abu’l-Ḥasan al-Ash’arī’s (d. 324/935) used in Risāla fī istiḥsān al-khawḍ fī ʿilm al-kalām. Even though he does not state its systematic, it can be understood that vindication of Kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation: -/- a) Explanation: Explaining the necessity and importance of the science of Kalām by giving information about its definition, names, value and place among other principles. -/- b) Demonstration: Revealing the religious basics of the science of Kalām from the Qurʾān, the Sunna of the Prophet Muḥammad, the Companions of the Prophet, and the Successors of the Companions thus specifying that it is legitimate for religion. -/- c) Refutation: Replying the claims having aim to weaken the value of Kalām principle and its religious legality. -/- Al-Ṣaffār describes ‘the science of Kalām’ as ‘Knowing the Real with the evidences which help to reach the absolute information’. By allocating the concept of 'Ḥaqq', he repeats the definition of Kalām as “it is to know God with certain evidences” in a part of his work, and “it is to know the principles of religion (uṣūl al-dīn) with certain evidences” in another part. He describes Kalām as “Knowing ḥaqq / God / uṣūl al-dīn by depending on evidence”, and tries to prove that it is wrong to consider a science which performs the stated duty, as illicit and abominable and thus turn away from it. -/- Al-Ṣaffār thinks that it is right to call this principle as ‘Kalām’ because of the certain evidences leading to the truth that this science has used. This thought was defended by other theologians as well. -/- For example, according to Saʿd al-Dīn Masʿūd al-Taftazānī (d. 792/1310) it seems like to say “This is the word (kalām), not the other knowings” by the way of the power of evidences used in Kalām.Thus, it is appropriate to give name Kalām for this science which based on certain evidences. -/- Al-Ṣaffār’s explanations revealed in scope of vindication of the Kalām are adopted by some of following scholars. Ḥusām al-Dīn al-Sighnāqī (d. 714/1314) in his book called al-Tasdīd sharḥ al-Tamhīd fī qawāʿid al-tawḥīd quotes Saffâr’s explanations as the same. -/- Al-Ṣaffār indicates that the method told in the Qurʾān is to reply questions about religion, beliefs and rejection instead of remaining in silence. The duty taken on by Kalām is this vindication activity performed by the prophets whose examples are described in the Qurʾān and which is legal and demanded. His way of thinking and vindication of the Kalām resembles that of Abū Manṣūr al-Māturīdī. Al-Māturīdī says, “Prophets and we were ordered to invite infidels to Islam. When this invitation happens, the respondents will ask for evidence and explanation, and discussion will be inevitable. Therefore, discussing and talking about subjects of Kalām is not objectionable”. -/- Thoughts of al-Māturīdī and al-Ṣaffār regarding the vindication of the Kalām were repeated by Nūr al-Dīn al-Ṣābūnī (d. 580/1184), and Fakhr al-Dīn al-Rāzī (d. 606/1210) later. According to al-Ṣābūnī, the evidences put against deniers and especially the discussion made by the Prophet Ibrāhīm to defend his own belief, prove the legality of Kalām discipline. Likewise, according to al-Rāzī, the duty of Kalām is just an activity performed already in the Qurʾān and ordered to the prophets. At this point of view, since the prophets were leading to Kalām, banning this activity is nonsense. -/- According to al-Ṣaffār, the reason for why Abu Hanifa avoids his son Hammād from these discussions is that Abu Hanifa does not like discussions based on obstinate. Otherwise, it cannot be that Abū Ḥanīfa prohibits to learn Kalām and make discussion about Kalām. According to him, this behavior of Abū Ḥanīfa results from that people discussing with him are ignorant about the subject of Kalām, discussion turns to an obstinate, and coming to an end of discussion seems impossible. This comment of al-Ṣaffār is quoted in Miftāḥ al-saʿāda wa-miṣbāḥ al-siyāda by ʿIṣām al-Dīn Aḥmed b. Muṣṭafā Tashköprüzāde (d. 968/1561) and in Minaḥ al-rawḍ al-azhar fī sharḥ al-Fiqh al-akbar by ʿAlī b. Sulṭān Muḥammad al-Qārī (d. 1014/1606) as same as his words. -/- Al-Ṣaffār’s defending the science of Kalām shows that there were opposite thoughts against Kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania.In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of Kalām. This paper examines reports of Eremya Çelebi Kömürcüyan (1637 – 1695) and Luigi Fernando Marsili (1679/80 in İstanbul) on three churches still existing in the late seventeenth century. Their topographical informations are compared with early pictorial representations of Constantinople/İstanbul (Hartmann Schedel, 1493; Giovanni Andrea Vavassore, c. 1530/50; Onufrio Panvinio, 1600; Pîrî Reis, 16th century; Franceso Scarella, c. 1686) in order to check whether the churches can be identified with those depicted here. The church of Aya Yani (St John) mentioned by (...) Eremya Çelebi must have been located south of the Stable Gate (Ahırkapı). Marsili describes a church near the Sultan’s stables and a further one inside the Seraglio Garden. The location of the stables can be determined using the İstanbul-view from Matrakçı Nasuh (1537). The church of Aya Yani and „the church near the stables“ must therefore be identical. In Schedel’s illustration, the church in the Seraglio is erroneously designated as S. Grovus, whereas on the Düsseldorf copy after Buondelmonti’s Liber insularum Archipelagi (1485/90) it is labelled s. Maria. The building can be identified with the church of the Theotokos of the Hodegoi Monastery. Regarding the church depicted on the vedute of Vavassore and Panvinio in the former area of the imperial palace, the thesis already established by Cyril Mango is maintained, according to which the remains of the Nea Ekklesia can be seen here. Little is known about the original form of the Nea Ekklesia, but there is evidence from written sources that it was erected above substructures with underground spaces that were open to the public. If the church that Eremya Çelebi saw south of the Stable Gate, while Marsili located it near the Sultan’s stables, can be identified with the Nea Ekklesia, as suggested in this essay, then considerable remains of the building must have been still present at the end of the seventeenth century. The main purpose of this paper, which takes the form of an essay, is an attempt to answer the question of the limits of artificial intelligence (AI). In the introductory section, we present the key milestones in AI development, both historical and future projections, in which two terms – Artificial Human (AH) and Artificial ‘god’ (AG) – play a special role. In the second section, we clarify the question of the limits of AI by indicating the hypothetical goal of AI (...) development. The third section develops the argument proposed by C. F. Weizsäcker, originally formulated for cybernetics. The conclusion of this argument is optimistic about limitations to the possibilities of cybernetic simulations. We apply this argument to AI and subject it to a critique which ultimately undermines the legitimacy of its conclusion. We base the critique on two well-known results: the theorem of the unsolvability of the halting problem and Gödel’s first incompleteness theorem, and we formulate two objections interpreted without adopting Church’s thesis. In the crucial fourth section, we present a third objection in the form of a hypothesis for which we argue that AI (AH), understood as a subject, will always be solipsistic. (shrink)

This thesis explores the party system and political parties in the post-communist Albania. The overarching question of the thesis is what kind of party system has developed and what is the structure and organization of the Albanian political parties. The study analyses the period 1991-2013, that is the period between the first and the last general elections. I argue and test that the Albanian party system is stable and that the Albanian political parties are mass clientelist parties with deep territorial (...) penetration. The members of the parties have ceased to paly their traditional roles of the era of mass party and their attachment tot he party is not ideological but aims to ensure material benefits in return for the support provided to the party in elections times. As parties don't have many tools at hand they use their organizational structure to stabilize electorate, which explains the low level of electoral volatility in Albania and as consequence the stability of the party system. The thesis ahs an institutional embedded and a historically structured framework according to which party strategies are shaped by both the institutional context and the historical setting in which parties are created and operate. Following this line of reasoning, the weak societal roots of parties do not allow for party identification or voter alignment; the early access to public funding reduces the incentives of parties to create strong links with the members and society to collect financial resources and; in line with the features of the patrimonial communism which is characterized by clientelism and nepotism, the Albanian political parties develop the same relationships between the higher echelons of the party and the lower strata of the party structure. On the other hand the lack of media access in the early phase of organization and the need to stabilize the electorate, encourage the Albanian political parties to seek a deep territorial penetration which results in the creation of mass clientelist parties. In order to test the hypothesis I have undertaken three steps: a) the analyses of the Effective Number of Parties and Electoral Volatility; b) the internal distribution of power, the role of the membership and the relationship of the organization with society and; c) the identification of financial resources of the political parties. Twenty essays, all specially commissioned for this volume, address the texts' historical and literary contexts and identify key social, political, and cultural factors affecting their ethical ideas. They also explore how these texts can contribute to contemporary ethical discussions. The Holocaust marks a decisive moment in modern suffering in which it becomes almost impossible to find meaning or redemption in the experience. In this study, C. Fred Alford offers a new and thoughtful examination of the experience of suffering. Moving from the Book of Job, an account of meaningful suffering in a God-drenched world, to the work of Primo Levi, who attempted to find meaning in the Holocaust through absolute clarity of insight, he concludes that neither strategy works well (...) in today's world. More effective are the day-to-day coping practices of some survivors. Drawing on testimonies of survivors from the Fortunoff Video Archives, Alford also applies the work of Julia Kristeva and the psychoanalyst Donald Winnicot to his examination of a topic that has been and continues to be central to human experience. McClure's introduction situates the essays historically from nineteenth-century assemblages of textual references to (...) sexual practice to the present, when attention to prostitution has grown out of interest in women's history, the history of sexuality, and cultural studies. She notes important modern approaches and the vexed question of terminology and its relationship to behavior. As McClure states, "while prostitutes in the ancient world may have been socially marginal, they were symbolically and even socially central" (6). Most of the essays, organized into three categories, concentrate on written evidence; some may wish that illustrations had been included.Section A: "Prostitution and the Sacred"In "Marriage, Divorce, and the Prostitute in Ancient Mesopotamia," Martha Roth concentrates on the impact, especially on marriage, of unmarried women (harı\mtu in Babylono-Assyrian, kar.kid in Sumerian) who had sexual relations with men. She concludes that the documents assign responsibility to the unmarried woman who has sexual relations with a man and that the law codes attempted to prevent or minimize the economic repercussions of such unions on inheritance. Roth finds no evidence of "ritualized or institutionalized sexual intercourse" (23) in Old Babylonian evidence (nineteenth to seventeenth centuries B.C.E.).In "Prostitution in the Social World and Religious Rhetoric of Ancient Israel," Phyllis Bird mainly provides interpretations of references in the Hebrew Bible to prostitution (e.g., the quest for "oriental sacred prostitution") and surveys elite, male religious biases. The prostitute "type" of the Hebrew Bible resembles that of surrounding cultures (41). Bird disentangles the considerable metaphorical uses of prostitutional language from other more literal references in order to concentrate on the differences between one called a prostitute proper (zonah, one who engages in extramarital sexual relations) versus one called qedes=ah ("consecrated woman"). The verb zanah referred to all extramarital sexual relations except adultery, and Bird dissects the problems involved when no one English word can be used to cover the range of meanings that the Hebrew root ZNH carries: raped women are defined by the same word, as are women who lure men [End Page 419] into adultery. In each instance, "an unmarried woman is involved in a sexual act" (45). The city can be personified as a prostitute or bride, and prostitutes symbolize dishonor in narrative texts. ZNH and its derivatives describe illicit political activity and describe Israel herself as a fornicating woman. Bird finds no evidence that prostitution was illegal in ancient Israel; the abundant references to and metaphorical uses of terms derived from ZNH suggest strongly that prostitutes were a feature of life, without establishing that females might engage in prostitution in order to pay religious fines. Bird notes briefly that male prostitution in ancient Israel was homosexual and had its own terminology (49).In "Heavenly Bodies: Monuments to Prostitutes in Greek Sanctuaries," Catherine Keesling examines literary references to votive monuments erected by or commemorating female prostitutes in Greek sanctuaries in the archaic and classical periods. She concentrates on the degree to which Rhodopis' and Phryne's famous monuments were liminal or transgressive, but she incorporates findings about other votives. Keesling observes that Rhodopis' votive stands midway between those that Snodgrass terms "raw" (everyday objects, e.g., weapons) and "converted" (e.g., statues): Rhodopis dedicated a tithe of ox-spits ("raw") but constructed the offering so that the spits could not be removed (thus becoming "converted"). Keesling also discusses the monument, known only from literary sources, supposedly dedicated to Leaina, who was loyal to the tyrannicides. This tongueless statue, if originally dedicated to her, is the only canting-device animal statue found in a sanctuary (64–65). Phryne's portrait statue in the sanctuary of Apollo at Delphi is also singular as the only portrait before the Roman period that was not part of a family group, as one of three pre-Hellenistic gilded bronze portraits, and... On October 31, 1994, it was announced that a confidential settlement had been reached in Doe v. Kohn, Nast & Graf, P.C., et al., 862F. Supp. 1310 ). The settlement in ths widely publicized AIDS discrimination case came three weeks after the trial began in the District Court for the Eastern District of Pennsylvania, Nov. 2, 1994, at 10).Plaintiff Doe, an associate employed at Kohn, Nast & Graf, a prominent law firm in Philadelphia, filed an AIDS discrimination case under the (...) Americans with Disabilities Act against his employer claiming that the firm fired him in March 1993 because he was HIV-positive.
