Heuristics make decisions not only fast and frugally, but often nearly as well as “full” rationality or even better. Using such heuristics should therefore meet health care standards under liability law. But an independent court often has little chance to verify the necessary information. And judgments based on heuristics might appear to have little legitimacy, given the widespread belief in formal rationality.

Judges in multiple US states, such as New York, Pennsylvania, Wisconsin, California, and Florida, receive a prediction of defendants’ recidivism risk, generated by the COMPAS algorithm. If judges act on these predictions, they implicitly delegate normative decisions to proprietary software, even beyond the previously documented race and age biases. Using the ProPublica dataset, we demonstrate that COMPAS predictions favor jailing over release. COMPAS is biased against defendants. We show that this bias can largely be removed. Our proposed correction increases overall (...) accuracy, and attenuates anti-black and anti-young bias. However, it also slightly increases the risk that defendants are released who commit a new crime before tried. We argue that this normative decision should not be buried in the code. The tradeoff between the interests of innocent defendants and of future victims should not only be made transparent. The algorithm should be changed such that the legislator and the courts do make this choice. (shrink)

Max Stirner pioneered a radically existentialist thinking in which the ego or the Unique One is able to appropriate its “predicates” or determinations as objects of consumption. In this sense the singular event is privileged over the intellectual “spooks” that express the predicate’s independence from and mastery over its subject. Karl Marx’s thinking was decisively altered by his encounter with Stirner, to whom he replied at length in The German Ideology. I propose that Marx and Engels’s critique and appropriation of (...) Stirner provides the basis for what I call “communist existentialism,” and that this is the proper standpoint for radical philosophy today. After giving an account of this position, I briefly adopt it to critique two of the communist standpoints associated with “communization,” those of Tiqqun and Theorie Communiste. (shrink)

In scholarship on the history of philosophy, it is widely assumed that Charles Fourier was a utopian socialist who could not have exerted a significant influence on the development of Karl Marx's thought. Indeed, both Marx and Engels seem to have advanced this view. In contrast, I argue that in 1844 when Marx was developing his anthropology and social critique, he relied upon Fourier's thought to supply a key assumption. After establishing this connection, I explain why Marx's tacit reliance on (...) Fourier creates a problematic undercurrent in his thought. (shrink)

Cette contribution examine les rapports entre le matérialisme des intérêts que revendique Bakounine dans ses derniers textes et la critique qu’il propose des notions d’intérêt général, de représentation politique et de centralisation dans La théologie politique de Mazzini et l’Internationale. Son objet est de montrer que la prise en compte du rôle social et historique des intérêts rend caduque toute possibilité d’un intérêt général qui viendrait à son tour fonder la légitimité d’une représentation politique dans une assemblée centraliste. La première (...) partie de l’article examine le rapport entre ce matérialisme des intérêts et la conception matérialiste de l’histoire proposée par Marx et Engels. La seconde insiste sur la critique de l’intérêt général comme fiction et sur l’impossibilité qui en découle de toute représentation dans le cadre d’un système centralisé, la reconnaissance de cette impossibilité débouchant même sur une critique du mandat impératif. De 1815 - avec le Congrès de Vienne qui inaugure une ère de Restauration - à mars 1848, avec les répercussions de la révolution de février en Europe, la période du Vormârz ("avant mars") se caractérise, au sein du monde germanique, par une vie intellectuelle d'une particulière effervescence. Les grandes philosophies qui se sont construites pour dépasser Kant, avec Fichte, Schelling et Hegel, autorisent bon nombre de penseurs allemands à considérer l'Allemagne comme étant philosophiquement en avance sur son temps, ou (...) tout au moins à la pointe de la modernité. Cette avance théorique tranche pourtant avec la réalité politique et sociale de l'époque, façonnée par Metternich. Many authors assume that we are rationally required to be somewhat moved by any recognized reason. This assumption turns out to be unjustified if not false, both in general and under any non-trivial restriction. Even its most plausible forms are contradicted by the possibility of exclusionary reasons. Some have doubted the latter’s possibility. But these doubts are also shown to be unfounded, and exclusionary reasons’ pervasive role in normative theorizing is defended.

Philosophers of music often appeal to intuition to defend ontological theories of musical works. This practice is worrisome as it is rather unclear just how widely shared are the intuitions that philosophers appeal to. In this paper, I will first offer a brief overview of the debate over the ontology of musical works. I will argue that this debate is driven by a conflict between two seemingly plausible intuitions—the repeatability intuition and the creatability intuition—both of which may be defended on (...) the grounds that they are reflective of our actual musical practices. The problem facing philosophers within this debate is that there is no clear way to determine which of the two conflicting intuitions is more reflective of our musical practices. Finally, I offer discussion of an experimental study that was designed to test participants' intuitions regarding the repeatability of musical works. The evidence presented there suggests that the participants broadly accept the repeatability of musical works, but in a much narrower way than philosophers would likely accept. (shrink)

One of the major developments in cancer research in recent years has been the construction of models that treat cancer as a cellular population subject to natural selection. We expand on this idea, drawing upon multilevel selection theory. Cancer is best understood in our view from a multilevel perspective, as both a by-product of selection at other levels of organization, and as subject to selection at several levels of organization. Cancer is a by-product in two senses. First, cancer cells co-opt (...) signaling pathways that are otherwise adaptive at the organismic level. Second, cancer is also a by-product of features distinctive to the metazoan lineage: cellular plasticity and modularity. Applying the multilevel perspective in this way permits one to explain transitions in complexity and individuality in cancer progression. Our argument is a reply to Germain’s scepticism towards the explanatory relevance of natural selection for cancer. The extent to which cancer fulfills the conditions for being a paradigmatic Darwinian population depends on the scale of analysis, and the details of the purported selective scenario. Taking a multilevel perspective clarifies some of the complexities surrounding how to best understand the relevance of evolutionary thinking in cancer progression. (shrink)

Seth Shabo has presented a new argument that attempts to codify familiar worries about indeterminism, luck, and control. His ‘Assimilation Argument’ contends that libertarians cannot distinguish overtly randomized outcomes from exercises of free will. Shabo claims that the argument possesses advantages over the Mind Argument and Rollback Argument, which also purport to establish that indeterminism is incompatible with free will. I argue first that the Assimilation Argument presents no new challenges over and above those presented by the Rollback Argument, and (...) second that the Rollback Argument itself neither presents a deep challenge to, nor raises the cost of, accepting libertarianism. We often know what we are judging, what we are deciding, what problem we are trying to solve. We know not only the contents of our judgements, decidings and tryings; we also know that it is judgement, decision and attempted problem-solving in which we are engaged. How do we know these things?

Discussions of monotheism often consider its bigotry toward other gods as a source of conflict, or emphasize its universality as a source of peaceful tolerance. Both approaches, however, ignore the combined danger and liberation in monotheism's 'intolerance.' In this volume, Christopher Haw reframes this important argument. He demonstrates the value of rejecting paradigms of inclusivity in favor of an agonistic pluralism and intolerance of absolutism. Haw proposes a model that retains liberal, pluralistic principles while acknowledging their limitations, and he (...) relates them to theologies latent in political ideas. His volume offers a nuanced, evolutionary, and historical understanding of the biblical tradition's emergence and its political consequences with respect to violence. It suggests how we can mediate impasses between liberal and conservative views in culture wars; between liberal inclusivity and conservative decisionism; and, on the religious front, between apologetics for exclusive monotheism and critiques of its intolerance. Creating education systems that promote democratic sustainability has been the concern of political thinkers as diverse as J. S. Mill, Dewey, Benjamin Barber and Derek Bok. The classic dichotomisation of democratic theory between deliberative democrats and Schumpeterian democrats suggests that education in the service of democracy can be constructive—that is, provide a student with the skills necessary to elect her leaders without changing her nature—or reconstructive—that is, fundamentally and radically reshape the student to produce a citizen whose goals are transformed (...) to be congruent with society. Michael Oakeshott, who has written extensively both on political regimes and on the purpose of liberal education, offers a third way to assess the connection between government and education. Despite his own dismissal of civic or political education as fundamentally vocational and thus beyond the boundaries of the liberal arts, this paper provides a potentially surprising Oakeshottian defence of political education within the liberal arts with reference to the importance he places on experience as a pedagogic tool. Thus, Oakeshott's educational philosophy has a certain resonance with the recent calls to locate the relevance of liberal arts within the burgeoning development of experiential civic engagement programmes in American universities. I discuss Ruth Marcus' conception of beliefs as dispositional states related to possible states of affaires. While I agree with Marcus that this conception accounts for the necessary distinction between belief and linguistic assent, I argue that the relationship between dispositional beliefs and our assent attitudes is more complex, and should include other mental states, such as acceptances, which, although they contain voluntary elements, are further layers of dispositional doxastic attitudes.
